they were gusting to above 30 and temperature 67 degrees. just shows you how important weather conditions are. the winds are bad, but when it's a cool, moist wind like that, it's not the end of the world. they have a good handle on the fire. when i come back, we'll talk about a change. today was the coolest day of the week. i'll see you back here. >> breaking news out of the east bay. there's a medical emergency at the downtown hayward bart station and that stopped northbound trains. a fire captain told crews, they are trying to rescue a person. at this point, northbound trains will not be running through that station for at least another half hour. of course, it is 5:00 now. the height of the evening commute. major delays are expected. if you have the choice to avoid bart in that area right now, you should try and do that. we understand there may be word of a bus bridge being set up, but again, this is happening at the height of the evening commute and bart says major

delays are expected. we are working to get more information on what is happening at the hayward situation. we'll bring you more information as soon as we can. continuing coverage now. this graduation photo is one of the last pictures taken of a little boy killed by a pit bull that belonged to a family member. we have new information now from ktvu's rob roth who spoke with the boy's family about what happened and rob is live in union city where rob, you learned whoo that little boy was doing just before the dog attacked. rob. >> reporter: frank, a family is grief stricken here on elizabeth way. the owner of the pit bull is the six-year-old boy's uncle, who happens to be a san mateo police officer. this is the paper cap six-year- old wore just recently to his kidergarden graduation. >> we aren't doing good at all. a huge loss. glt family says other small children were playing in the

backyard yesterday. he was also playing with the family dog. a two-year-old pit bull. michael is the family's attorney. he says some of the children told police it appears nifi was sitting on the dog's back when the dog bit the boy on top of the head and clamped down. he heard a commotion downstairs. he went downstairs and he saw that the dog had the child and then he just went to the dog immediately and took ahold of the dog at the jaw and the dog released. >> paramedics took the boy to stanford hospital where he died from his injuries. the owner of the dog is an officer with a san mateo police department. relatives say the dog never exhibited aggressive behavior before. >> he played with kids, very obedient. he stayed at the door. so we never had any problems with him at all. took him around with us. my kids loved him. >> this is a big surprise. >> huge shock. >> reporter: union city police are investigating. they say the family is cooperating. the dog is being held at the tricity animal shelter in

fremont where it will remain in quarantine for ten days. there will be a hearing about what to do with the dog, but authorities believe the dog will most likely have to be put down. reporting live in union city, ktvu channel 2 news. a judge today refused to deny bail to a former teacher in fremont who is accused of raping a young boy. f 3-year-old, michael soup is accused of raping a boy 15 years ago inside a classroom at mission valley elementary school in fremont. he previously served time on child pornography charges. the district attorney's office says investigators uncovered evidence of the alleged rape after shoop asked them to confirm that he had been rehabilitated. the alameda county sheriff's department released the identity of a masked gunman killed by a deputy last friday at an attempted robbery. investigators say 32-year-old,

quency williams had three convictions. the deputy shot williams several times after the suspect's gun was fired in his direction during the robbery at boulevard burger on castro valley boulevard. the restaurant reopened yesterday after being shut down over the weekend following that shooting. continuing coverage now of the fight to bring the a's to the south bay. it has been a four-yearlong ordeal for san jose leaders. ktvu's robert honda live at city hall where the city is now taking major league baseball to court. robert. >> well, the city council made its final sessions before the summer break significant ones. first, behind closed doors and very publicly after that. san jose decided to take major league baseball to court. they hope can lead to the a's coming to san jose, but in its response, major league baseball gave people here at city hall no encouragement. the city of san jose and a's owner have been trying to bring the team to the south bay for

about four years. a baseball stadium project and a lot of hopes have been in limbo as major league baseball tried to decide how to resolve the giants territorial right. today, san jose with the unanimous support filed this lawsuit in federal court against commissioner, budde selig and major league baseball. >> is this clear, we aren't going to get an answer? we filed a legal action to get rid of the territory restrictions. well, i don't know what is going on. i've never had a chance to speak with him. i don't know what impact this will have on major league baseball. we will assert our rights. >> the law firm say the city has those rightses because the a's owner wants them to come to san jose. so, officials called baseball's antitrust exception and says san jose has lost more than $100 million in potential revenue waiting for the deal to be approved. >> major league baseball has no right, no right whatsoever, to deny the 10th largest city

in america their right to have a baseball team. led them bid competitively. >> but in response, major league baseball says it has acted in the best interest of the fans and says the lawsuit is an unfounded attack with no basis in law or fact. coming up at 6:00, more details as well as where lou wolf fits in. ktvu channel 2 news. the mayor spoke out hours after the announcement of the san jose lawsuit. she says there is no reason for the team to go and the city has plans to keep the a's. >> they may have losses, but we have fights and i don't think san jose has a fight at this point. so we are ready to go and i think our city and our fans deserve to have real, serious negotiations go on about the future of the home for the a's. >> mayor quan says oakland has been focused on providing a new

site. one at the coliseum complex. the other at the howard shipping terminal right next to jack london square. we now know who will head up the san jose fire department when the current chief steps down this summer. deputy chief, ruben torres has been named acting fire chief. torres is a 27 year veteran of the department with eight years of senior command experience. they will be stepping in for the chief who is leaving to head up the las vegas fire department. mcdonald has served as san jose's fire chief for three years. one person is dead after a fire at a small home in sunny vail this morning. ktvu obtained cell phone video that shows how bad that fire was. >> this is cell phone video taken of the house shortly before 6:00 a.m. neighbors say it looked like a fire ball. >> just massive orange flames shoot all the way to the sidewalk almost. the whole house was completely engulfed. >> huge plumes.

when firefighters arrived, they could not enter because it was too dangerous. the flames traveled, which was 800 square feet. it threatened the two adjacent houses, but firefighters were able to contain the fire. >> made an aggressive attack on the fire. extinguished the fire and we discovered a body that was deceased in the kitchen. >> neighbors were in disbelief. a woman in her mid 50s lived in the house. she is well liked and holds a prayer group once a week there. >> it's really sad to hear she was possibly, it was possibly her in there. i can't imagine it being anybody else. she lives alone. the sweetest, the sweetest person. she is going to be really missed. >> investigators with the department of public safety has not identified the body. while authorities say it is likely the victim died from the fire, they will investigate the cause of death to make sure crime didn't take place. they are still trying to determine the origin of the fire. >> we want to identify the victim and identify their

family. first and primarily. from that, we want to know how the fire started and if there's anything suspicious regarding the fires. g reporting in sunny vail, ktvu channel 2 news. eight people were hurt in a fire at the construction site for the new san francisco general hospital today. the hospital says a temporary platform caught fire in an elevator shaft at 9:30 this morning. seven workers had to be treated for smoke inhalation. about 350 workers were evacuated, but returned to work by noon. spokeswoman said the fire did not affect services at the existing hospital. new at 5:00, a rainbow colored flag is flying over san francisco city hall at this hour in celebration of pride month. as he has done in previous years, mayor ed lee raised the rainbow flag. pride month is highlighted by the supreme court case on california's proposition 8, which bans same-sex marriage. a ruling is expected ahead of the pride parade on sunday, june 30. also, a christian folk

singer is creating more ripples on the last day of san francisco's gay pride weekend. shock began an antigay marriage rant during the concert at the san francisco yoshi. it caused public outrage, her tour was canceled. exam meres reportedly sponsored on july 30, it's not clear where it will be held. >> bart police are investigating the death of a person on the tracks at the colma bart station. the body was found under a train just after 9:00 this morning and the station was shut down while police investigated and removed the body. there's no information yet on why the person wa the tracks or that person's name. trains were still through the station during the closure. they weren't stopping. operations, though, were back to normal at 11:20. >> following a breaking news story. san jose police say a hit-and- run driver is still at large. the accident happened at 3:25 yesterday afternoon near highway 87. police say they are examining

what appears to be a white bumper. the mays fallen off the suspect vehicle. they identified the victim, but can't release that information because they are having trouble contacting relatives. a public memorial will be held to celebrate the life of a bicyclist killed last week. 23-year-old, shayla was crushed under two trucks that collided in downtown san jose. left behind a two-year-old daughter, olivia. the little girl is being taken care of by friends. now to continuing coverage of that wild fire that is burning in the sierra foothills. cal fire now says it was started by an unattended campfire. the so-called carson's fire is out of control and burned 1600 acres near highway 840. that's the main route into yosemite national park. the highway is still open despite the fire. 1500 people have been forced to evacuate their homes so far and

no structures have been damaged or destroyed. as of now, that fire is only 15% contained. he performed naked acrobats inside a san francisco bart station. today he was in court. new at 5:30, the people who also showed up at court today and the confrontation they say may have led up to this incident. >> and only on 2, an east bay man who hired a private investigator after opd couldn't help him get justice, may have uncovered a much larger crime. >> but we are in court as an accused serial killer breaks into song during his own murder trial.

courtroom. kristen is live in san rafael. you've been in the courtroom and some people are now telling you, it looks like they are having a hard time representing himself. >> there's a lot of interest. take a look at the cases. front page news here. the prosecution started the morning off calling the first witness, but naso, who is representing himself started the day off with an objection. >> accused serial killer began the day asking the judge if he could reopen his opening statement. he said after he wrapped up yesterday, he reflected on it. said quote, i was thinking joe, you got squeezed out of the box. >> the judge denied the request. he broke out into song in the verse of, just one of those things. winning them over. >> you know, i am trying to do the best i can. >> the prosecution called the

first witness. naso's parole officer from nevada. roger jacobs testified he found the so-called, list of ten with locations and references to women. on the stand, my impression was, it was a list of murder victims. and sometimes tense exchange with his parole officer, he demanded, can you prove it? that's why you're on trial, responded jacobs. i know what this case is about. court watchers noted the judge repeatedly had to step in to stop the questioning and his lack of experience as a lit litigator is hurting his chances. >> he wanted to talk to him to start behaving himself. >> this afternoon's testimony by two parole officers centered around incriminating items they found in his home, including that list of numbers with references to women and geographical locations. the case could last all the way until november, but just 45 minutes ago, the judge asked both sides in this case to try to speed things up. we are live at the superior

court, christian, ktvu channel 2 news. an innocent man who was almost killed by police during the man hunt for a former los angeles police officer earlier this year has now filed a lawsuit. david perdue says police rammed his pickup truck and fired three bullets into his driver's side window. at the time, the officers were looking for christopher who killed four people, including police officers. perdue's truck was mistaken for the one dorner was driving, even though it was a different make and a different color. and this isn't the only case of mistaken identity during the man hunt. l.a. recently reached a $4 million settlement with two women who were in another pickup truck when they were shot at by police. >> the city of richmond may file a lawsuit against chevron over damages from last summer's refinery fire. the justice coalition is urging to file suit.

sent 15,000 people to hospitals. the city gave time to come up with the own compensation package. no agreement has been reached. investigators say that one of the reasons the chevron refinery blew up last august was that there were not enough state inspectors to properly oversee it. >> our consumer editor has news of inspectors that will soon be at work. >> calls for tripling inspection staff from 7 to 21. >> certainly a step in the right direction. >> senior scientist of communities for a better environment says the increase is not meaningful. >> we probably need something like 30 to 40 times that kind of commitment before we would be able to verify and ensure safety. >> with 22 inspectors, each inspector would be able to see a plant twice a year and for two days. there are 1600 facilities to inspect. that's not appealing to port richmond residents right across the freeway. >> absolutely unacceptable

that's all there is. i live up the hill. i saw the black clouds and breathed in the bad air. i think that's not enough. they need to do more. >> i think it's an improvement. it's a good starting point. >> michelle thinks something else is needed. >> i think the main issue is motivation. and what other processes for making sure that there are no accidents happening and detecting it when there are as soon as possible. >> we did find one bit of sympathy for chevron. >> chevron does provide jobs. they provide a meaningful product that we all use every day. >> but community watchdogs still doubt the plant's safety. >> the rest of the refineries, the vast majority of it, the corrosion that caused the disaster, we saw with one pipe out of the thousands of miles of pipe. that corrosion is widespread. we have enough evidence to know this refinery is essentially ticking time bomb. >> some folks we spoke with, including environmentalists think these refineries need to have full-time inspectors 24/7.

ktvu channel 2 news. >> right now, we have breaking news from the hayward bart station. we have live pictures here from news chopper 2. here's what happened at 4:30 this afternoon. someone jumped in front of a train. that person was killed at the hayward bart station. as a result, service at that bart station has been shut down in both directions. the coroner has been called to the scene to take away the body. bart is in the process, we are told, of setting up some kind of bus bridge, but again, this happens at the height of the evening commute. we don't know how long service is going to be shut down. but obviously, this is going to impact a lot of people on their way home from work tonight. again, the headline at this hour, one person died at the hayward bart station today after jumping in front of a moving train. as we get more information, we will bring it to you. in particular, when bart service is up and running again, but right now, they are setting up a bus bridge. so keep that in mind. it is going to be a long

more breaking news now. this time out of san francisco where a fire is burning at 519 ellis street. that is in the tenderloin area of san francisco. not far from levenworth. just a couple minutes ago, we were seeing a lot of black smoke coming out of this building. now that smoke is turning white. generally that's a good indicator that firefighters are getting an upper hand on the flames. we don't know what kind of building this is, but presumably, the people inside that building have been evacuated. obviously, ellis is probably, we can't tell from these pictures, but it's a good guess to say ellis is blocked off to traffic right now because of all the fire apparatus on the scene fighting that fire. let's see as we move in here, well, it's still difficult to tell exactly what kind of building this is. it almost looks like it's a

residential building. the headline here, a fire burning in san francisco on ellis street. not far from leavenworth. working to get more information as we do, we'll pass it along to you. after years of failed negotiations for peace in afghanistan. taliban leaders announced today they will hold face to face talks with u.s. and afghan officials. they also announce the opening of a new political office for that exact purpose. and in just a few days, u.s. representatives will travel to participate in those meetings. afghan president will not attend the initial meeting, but will enter the negotiations at a later date. the talks will be focused on ending insurgent attacks throughout the country. women in the military will take on a much greater role in combat. the pentagon unveiled plans to put females closer to the front line. >> we are looking at our seals and special boat crew members. in the marines, special operations command, we are

looking at our marine critical skill operators. >> military branches outlined how they will integrate women into combat roles. and leon panetta ordered all jobs open to women unless military commanders requested a specific exception. the marine corps says it is testing men and women to make sure they quote, do this right. right means we maintain combat effective units across the total force and we don't set our female marines up for failure by not preparing them for any result in institutional change. >> in 2012, the army opened more than 14,000 positions to women. today's announcement could make another 6,000 jobs available. the pentagon says women may begin training for elite positions in navy seal units in two years. the republican led house approved the antiabortion bill today. the legislation would ban abortion after 20 weeks of pregnancy. it does include an exception that was added at the last moment for women who get

pregnant through rape or incest. but the bill isn't expected to get very far once it moves over to the senate. and saying this bill is a quote, assault on a woman's right to choose. ten states have passed similar laws, however, and are facing court challenges. >> health insurance provider plans to stop selling individual health insurance policies in california as of next month. the connecticut based company made the announcement yesterday. this means nearly 50,000 current etna policyholders will have to find new coverage by january. after one month after the company decided not to participate in the state run insurance market. part of the new federal healthcare law. up next, the top u.s. official showing support for the gay community. plus. the man accused of harassing bart passengers while naked has his day in court. what his friends believe what he was doing inside that bart

we told you to expect noticeably cooler temperatures yesterday and we did get the cooldown and these pictures show us trees waving in the breeze and the flags being whipped by winds. so breezy there and that's not the only place. >> also whipped up that fire in benicia. firefighters didn't have too many problems because of the weather. >> the wind is a problem, but when it's a cool wind, temperatures on the cool side. humidity is high. like 45%. the winds were there. but really allowed firefighters to get a handle on the fire. fire danger is high, but this type of weather pattern as you saw earlier, allows firefighters to squash these fires down quickly and they sure did in the benicia area. 68 in liver more. so these numbers are down. they bottomed out. this is as cool as it will be all week. temperatures tomorrow at this time, show you these observations. will be mid 70s, something like

that. low 70s. a little warmer tomorrow. here's the culprit right here. you go, look at this thing. doesn't look like the beginning of summer in the pacific northwest. raining up there. they are getting snow in the northern cascades. that system affects us by being close to us. it takes a version and makes it stretch out. that's why all that moist, cool air pushed inland. that's why our relative humidity in the mid 40s in the inland bay valleys. the strong winds up in napa, ushering in cool, moist air. 32 miles an hour. so gusting well over that. winds in the santa clara valley, gives you great air quality. the winds storm will be lighter. marine layer is really stretched itself out. the inversion, there's no inversion. all the air just got up over the coastal hill. inversion will form tomorrow. it will put a lid on it. the fog will become compact and temperatures will start to warm. you'll see that.

accused of performing these naked acrobatics inside a san francisco bart station. made its first court appearance today. >> and we are hearing from the man's friends and also some of his fellow circus performers this evening. >> david stevenson was in court and david is live in san francisco where supporters say that a medical condition is behind his bizarre behavior. david. >> that's right. that acrobat made his first court appearance and we talked to his friends about what he apparently thought he was doing inside that bart station. a spanish speaking interpreter translated for gainer perez, as his public defender entered not guilty pleas on two felony and four misdemeanor charges. prosecutors say the acrobat is the naked man seen on video, physically accosting passengers in the san francisco bart station last month. >> here is his memory of what happened. he was in a play and he was acting out at the bart station. >> his friends from his former

berkeley service troop describe him as disciplined. but they say an apparent medical condition has led to angry outbursts and prompted his firing. >> the day before he went out, he had to become violent. i had to intervene on a violent incident with jay and i actually was assaulted by him. >> the charges could change depending on the outcome of a medical assessment. >> regardless of what caused the behavior to occur, this is a person that could be dangerous to himself and certainly to very dangerous to others. >> he is being held at a medical psychiatric jail pod on $100,000 bail. his friends say he needs treatment instead of prison. >> i spoke to him on the phone a couple of times. he has been very, very depressed and crying, you know, and withdrawn. >> along with this case, he also faces deportation back to columbia. based on an expired visa. his next court date is set for mid july. reporting live in san francisco, david stevenson,

more now on that breaking news from san francisco. a fire that was burning in a six story apartment building on ellis street. you can see the picture sure looks different from how it did a couple minutes ago. these are live pictures from news chopper 2 where it appears firefighters now have that fire out, but you can see it did cause, appears to be damage

there to the roof. again, we learned this is a six story apartment building. we are still working to try and figure out what caused the fire and also how much specific damage was done to that building inside. we can see, obviously, it caused damage on the outside. we're not sure if the damage on the inside. these were pictures taken earlier where the fire was in full swing here. started late this afternoon and firefighters were able to get it out fairly quickly. presumably ellis street is blocked with all of the fire apparatus. this is not far from leavenworth. keep that in mind if you are going to be in that area, that there will be traffic delays as a result of this. again, working to get more information as we take one last live look from news chopper 2. of a fire that burned a six story apartment building. it looks like it may have started in the upper floor on the upper corner unit there on the 6th floor. as we get more information, we will be sure to pass it along to you. >> in louisiana, everyone is back at home after a natural

gas pipeline explosion this morning that forced evacuations. it exploded 70 miles north of new orleans. people say it sent a huge fire ball into the sky. no one was hurt and just one mobile home suffered major damage. authorities are trying to determine what caused the explosion. investigators released new video and announced a record to solve a cold case in new york's times square. march 6 of 2008 when a bomb went off at a military recruiting station. the police commissioner says the explosion narrowly missed bystanders. a bicycle rider that police believe was the bomber. a $65,000 reward is being offered in the case. an incident caught on camera. bieber was leaving a los angeles comedy club when he hit a photographer. take a look in the center. the man in the white t-shirt falls to the ground and grabs

we have an update on the hayward bart station closure we told you about earlier. a bart spokesperson told ktvu news just a few minutes ago that trains are running through the hayward station in both directions. but they are not stopping. crews have been working to remove a body from the tracks. these pictures were taken probably about an hour ago. right now, what they are doing is waiting for the corner. in the meantime, a bus bridge has been set up and commuters can take ac transit buses to the downtown hayward station from the south hayward or bay fair stations. hayward station will likely be shut down for another hour, but again, trains are running in both directions with some delays. only on 2, an oakland man who hired a private investigator when he felt he

solving robberies is a top priority. live in oakland, ktvu channel 2 news. >> concorde police are handing out free steering wheel locks to deter car thefts. the department is handing out 900 clubs to residents who own certain cars. the club attaches to the steering wheel to make the car undrivable. now qualifying vehicles include honda, toyota, nissan, and accura passenger cars between 1995 and 2005. those cars are targeted in 2/3 of all city car thefts. the program is funded by money seized in drug busts. regulators and decided to go along with the government request to recall 2.7 million older model jeeps. the recall affects grand cherokees from 1993 through 2004. and jeep liberties from 2002 through 2007. the problem lies in gas tanks that could rupture and catch fire in a crash. federal regulators say 51 51 have died in such fiery

san francisco served as the final stop for an unusual cross country rally. it's called the nuns on the bus immigration reform tour. >> truly blowing the fog away. >> with song, there was prayer, as a cheerful group of sisters rolled into san francisco's marina district today. the nuns have been on the road for three weeks, holding rallies in support of immigration reform. they are urging congress to pass the law that provides a pathway to citizenship for some 11 million undocumented immigrants. >> immigrants build the economy and build our community. it is the glory of our past and
