announcement b.a.r.t.'s chief will make in just a couple of hours. >> reporter: good morning, tori. yes. i talked to a spokesperson with b.a.r.t. in the last 30 minutes. she said what's going to happen today, b.a.r.t.'s police chief is going to make himself available to let everyone know why he's bringing patrick oliver in. a lot of changes have been made since the fatal shooting of oscar grant at this station in 2009. but the question is, has enough been done. the chief wants an outsider to help answer that question. that's why he's calling on patrick oliver. he's a former chief of at least two police departments and served as a commissioner on the police accreditation for two agencies. maybe more notable in all of his credentials, he was part of the association that put together the noble report. that very long and very critical report of the b.a.r.t. police department done following the oscar grant

shooting. oliver is familiar with the department and should have an opinion about the reforms put in place. we talked to riders this morning about whether they've seen changes and one man said he has not seen enough. >> i feel like it there's not enough training. >> reporter: do you think they've done enough to fix problems? >> so far, i haven't seen any changes. >> reporter: we should note this announcement comes almost three years to the day after rainy was hired on as the police chief. when he was hired, it was announced he would usher in an era of change in the department of policies and procedures. the hope is oliver will help decide if enough change has been made. that review is expected to start next month. live here in oakland, claudine wong, ktvu channel 2 news. a highly-praised new movie about the b.a.r.t. police shooting of oscar grant

is being screened in oakland tomorrow. the grand lake theater is holding a private screening of "fruitvale station." the film was shot in the east bay and was directed by an oakland native. it won the grand jury prize at the sundance film festival. the movie opens to the public on july 12th. new this morning, the investigation in berkeley goesen to into an early-morning house fire. now, this one started around midnight at the home on milvia street. the investigators say the fire started in the basement and quickly spread to the attic. a woman living in the house called 911 when she first smelled smoke but she called 911 a second time after learning on the lights. >> the first time i didn't smell it as much as i did. i hadn't turned the lights on. when i turned the lights on, then i saw it. >> luckily, she was not hurt but that fire forced her out of her house. >> investigators still don't know how the fire started. family and friends will

hold a special celebration of life for a young college student from emeryville. he was killed in north oakland just one hour before his 23rd birthday. police say he was coming home from a pickup basketball game when he got into a minor car accident. witnesses say the man who hit his car, got out, shot and killed him, and then drove away. the reward money is coming to $30,000 as police search for the two men. the mother of a missing man who has brain damage pleading with police to take his case more seriously. shawn sidi's mom told the "examiner" he should be considered at risk. she's accusing the police of ignoring a lead that he may have gone to marin county from golden gate park last month. she's planning to hold a vigil this sunday pushing the police to investigate further. complaints about a gay pride flag in calistoga caused

the city to take the flag down. the flag was put up last friday to celebrate napa county's gay pride week. but some members of the community, including a former mayor, told "the press democrat" they rejected to the -- objected to the flag flying next to the u.s. flag. the rainbow flag was taken down on monday. the city council never formally considered raising the flag in the first place. the wait goes on for the u.s. supreme court to issue its ruling on california proposition 8, the ban on same- sex marriage. the court is scheduled to rule before the end of the month. coming up for you at 7:25. what one of the lead lawyers in the case is predicting will happen. it is 7:06. new this morning, tesla is recalling some of its model-s sedans. the electric carmaker says it discovered an incorrectly mounted bracket on a rear seat latch. tesla says all affected cars were manufactured between may

10th and june 8th of the this year. car owners will be contacted by tesla. the company will pick up the car, fix the problem and return the car in a few hours. they are offering loaner cars to owners who need them while the repair is made. san francisco's cable cars will attract visitors from around the world. the tourists may get a thrill ride they are not expecting. cable car accidents have been costing the city of san francisco plenty of money. the city has had to shell out $8 million in just the past three years to pay off settlements. that's to cover all sorts of injuries from broken bones to severed limbs. >> they range from very minor to some very rare, severe accidents. you know, those occur from the 19th century technology. >> cable car operators say the biggest problem is riders not paying attention. they say many of these injuries happen when people kind of fool around and hang off the side of

the cable cars. you kind of feel like you have to do that as a tourist. >> yes. sal, you're back. is now a good time to head to the toll plaza? >> it's not -- this is the peak time if you can avoid it, you can stay home and watch us for a little longer, that would be great. it's not affected by crashes on the bridge and westbound. it's backed up to the 880 overcrossing. it's about a 15, 20-minute delay getting on the bridge. we've been watching the span as well. the morning commute is going to be okay on 880. both directions looking good. if you are driving on the commute in san jose, the road sensors show some slow traffic on 101, 280 and 85 are doing well in the santa clara valley. let's go to steve. all right, sal. thank you. mostly clear skies. a little bit of patchy fog. not too much. rather cool. some upper 4040s. a very -- upper 40s. a very cool air mass in place associated with the low that

brought down by an outside source. the whistle-blowers stopped short saying plthe was shot down b insist the explosion on that plane was no accident. two new developments are jeopardizing peace talks between the u.s. and pakistan. hamid hamid karzai is breaking off negotiations because he's angry that the taliban and u.s. will begin peace talks without first bringing in the afghan government. he also says the name of a new taliban office in the middle east disrespects the afghan people. he says he will not pursue peace talks with the taliban until the u.s. drops out of the negotiations. well, despite the upcoming negotiations, this morning, the taliban claimed responsibility for an attack that killed four american troops at bagram air base last night.

the taliban fired twice. president obama just spoke a few minutes ago in germany calling on countries to cut back on nuclear weapons. as kyla campbell reports from our washington, d.c. newsroom, the president says this will not weaken u.s. security. >> reporter: president obama says the u.s. can still protect americans and our allies while reducing the number of nuclear weapons here by about a third. president obama says he wants to move forward with a treaty that could cut russia and american nuclear weapons since the lowest level since the 1950s. he says it's time to negotiate with russia and move on. on top of this, he says the world needs to reject the nuclear goals of north korea and iran. he wants to secure nuclear materials around the world. >> and call on nations to begin negotiations on a treaty that ends the production of materials for nuclear weaponsens. these are steps we can take to

create a world of peace with justice. >> reporter: how president obama says these moves would affect terrorism, when i see you next. live in washington, kyla campbell, ktvu channel 2 news. 7:15. happening right now in washington, d.c -- fbi director robert muller is making his final -- robert mueller is making his final appearance. that's patrick leahy right there. the hearing is supposed to focus on fbi operations in general. but with the recent revelations about phone surveillance at the national security agency, robert mueller is expected to be questions about that as well. we haven't seen mueller on camera but he's due to step down as fbi director on september 4th after serving 12 years in that position. we'll be checking on these live hearings in washington throughout the morning. google, taking steps now to distance itself from the national security

administration's operation prism. now, google is asking a specialized federal court to relax the gag order over data requests its made. most of the nine tech companies who had been receiving requests for information on lders have said homany times they were asked for that information but google wants to go further. experts say it's not likely the court will grant google's request. 7:17. the city of brentwood is throwing the book at kids who cut class. brentwood is considering daytime loitering regulations for teens. "the contra costa times" reports the council will take up the measure next tuesday. the vice mayor says in stead of going to school, some teens are hanging out in some parts of the city and causing problems for businesses. a man shot and killed at a castro valley burger vint was a wanted parolee. he's 32-year-old quincey williams of oakland. williams was shot during a

robbery late friday night. investigators say he was trying who hold up boulevard burger on castro boulevard. he ended up in a struggle over a gun -- over a gun with one of the workers. there will be a game 7 in the nba finals after an incredible thriller for pro basketball fans last night. >> game over! >> who expected that? the miami heat won in overtime. 103-100. they scored five points on the closing seconds to force an overtime and survived elimination by the san antonio spurs. so now the finals are evened up, 3-3. lebron james came on strong down the stretch. he had his 11th postseason triple-double. when it looked like the spurs were gonna win it. but the championship will be

welcome back. a strange story. a fishing trip turned into a near death experience for a 13- year-old boy stabbed in the neck by a fish. now res boy is aiden.

he went fishing in arkansas with his family on father's day. his mother was holding a catfish they caught when it suddenly jumped and hit aiden. >> he got nervous, the fish flopped around. it just smacked him on the neck. >> one of the barbs in the fin of the catfish punctured his skin. the family called 911. they had to wait 30 minutes for the fish to stop moving so the paramedics could cut it away. aiden was airlifted to a hospital. doctors carefully pulled out the barb. it was just a couple of centimeters from a main artery. a construction company worker has found human bones in alameda. now, the discovery was made by the worker was repaving a walkway. the coroner's office said the bones were those of an american

indeup. the area where the bones were found were once of site of a shell mound built by a tribe. people on both sides of the same-sex marriage issue are waiting for the ruling from the supreme court on proposition 8, the ban on same-sex marriage. one of the lead attorneys for the anti-prop 8 side says there will be more lawsuits if the high court rules for anything less than full marriage rights in all 50 states. >> we're gonna win it for every american in all 50 states. whether that comes true or to not, i don't think anybody could say. >> david boyd said they could throw it out because prop 8 supporters lacked legal standing. in that case, the lower ruling that found this ruling is unconstitutional would stand. the supreme court decision could come tomorrow or next week. stay with ktvu for the decision

whichever day it happens. the ruling will come down at 7:00 a.m. on "mornings on 2." we'll bring it to you as it happens on the air and online. that night we'll go in-depth on the decision in a ktvu news special at 6:30. 7:23. new developments in the east bay, a third girl has come forward accusing a former east bay football coach of molestation. prosecutors now filed new criminal charges against 51- year-old barron edwards. a judge increased his bail to more man $34 million. edwards faces 39 felony charges. he coached a couple of years at kennedy high school in richmond. he's now scheduled to enter a plea on july 2nd. the repair work on mendocino's historic skunk train can now move ahead thanks to help from a local nonprofit. back in april, a tunnel collapse dumped thousands of tons of rock onto the tracks of

the train. yesterday, san francisco-based save the redwoods league announced it is donating $300,000 to pay for the necessary repairs. want to check in with sal. how is 24 doing? >> it's slow because of a stalled car on the right-hand side. people were slowing to take a look at it. 24 near the la fayette b.a.r.t. station. there's a tow truck on the side and the traffic gets better after that. between walnut creek and oakland a little bit crowded right now. at the bay bridge, you can see traffic is backed up to about about the foot of the -- to about the foot of the macarthur maze. we've been looking at slow traffic out of the livermore valley. it gets better by the time you reach livermore. between hayward and union city, from 238 to mowry avenue, the traffic time is 22 minutes which is about normal. let's go to steve.

san francisco police made ten arrests raft night at at&t park -- last night at at&t park. pam, these were not rowdy fans? >> no. the arrests were people who work at the ballpark. they came largely during a peaceful rally. it first started with 300 to 400 concession workers before

last night's game outside of the park, as you can see. this is the latest development in the labor dispute between union workers and management. they've been working without a contract for the past three years. they are now asking for fans to help. now, this is a picture sent to us from a viewer, chris coleman, who was at last night's game. it shows the concession workers, some of them about 40 to 50 went inside the park and they are sitting right there in front of the gilroy garlic booth asking people to bring their own food to the park instead. >> right now, we're just trying to get the company to pay attention to the core issues the workers need, which is decent wages and a city that's getting more and more unaffordable. >> reporter: management said they are offering a fair raise and one of the best packages in the country. police say the protesters who went in the park were arrested.

reporting live in the newsroom, pam cook, ktvu channel 2 news. >> thank you, pam. 7:30. new this morning, one out of every nine bridges in america is in need of serious repair so says a new study on structurally deficient fans. these are not regular -- spans. these are not regularly-used bridges. nearly 3,000 bridges in california are structurally deficient. 12% of the bridges down from 13% last year. a busy bridge in washington state that collapsed last night over the skagit river will reopen today. the bridge's failure sent two cars tumbling into the river before. it cut off washington state's main roadway to canada. the temporary span and reason placement cost nearly $18 million. the federal transportation department is paying for all but $1 million of the work. some 70,000 cars travel on interstate 5 over this bridge

every day. neighbors call it a major step in the right direction. six months after flooding in east palo alto. coming up at 7:45, the levee repairs that are finally complete and the work that still remains. 7:31. new developments in about a homicide in -- about a homicide in san jose. police arrested three people for a deadly stabbing. they were arrested saturday. police accused them of stabbing a 56-year-old man outside of a home thursday on checkers drive. that man died at the hospital. police say the attack was gang- related. although now face murder charges -- all three now face murder charges. an attack that sent one woman to the hospital. she suffered a broken nose, a ruptured blood vessel and her t- shirt was covered in blood. well, monday, four young men

and two women cornered her at an ac transit bus stop right next to the east mont police substation. she gave them the $15 in her pocket but they demanded her backpack also. >> i know. i know. [speaking in spanish] >> a good samaritan happened to be driving by, scared off the attackers and took her to the police station. police arrested two of the four suspects. they also recovered her backpack but her wallet, her phone and her keys are all gone. 7:33. guests of a motel 6 were running for safety after embers from a grass fire set the roof on fire. the grass fire flared up after 7:00 p.m. yesterday near 880 in cordelia. the motel manager says the motel was at 95, capacity when

the fire -- 95% capacity when the fire started. guests were forced to leave their belongings behind. one person was taken to the hospital after falling in the parking lot. guests had to find somewhere else to stay. the damage is expected to be assessed today. this morning, firefighters are watching over this area in benicia where a fire blackened more than 120 acres. they want to make sure it does not catch fire again. high winds kicked up the grass fire yesterday afternoon. this is west of interstate 680 near lake herman road. the flames destroyed a shed. calfire tweeted that it had the fire fully contained late last night. san jose has a temporary fire chief. this is deputy chief ruben torrez who had been with the department for 27 years. he's agreeing to serve as acting chief until the city deed sides on a permanent -- see sides on a permanent replace -- decides on a permanent replacement.

7:34. a campaign against sugary drinks is heading to congress this morning. the mayors of san francisco, oakland, la, new york, and more than a dozen other large cities wrote to congress yesterday. they are calling for new limits on food stamps. now, the mayors don't want food stamps used to buy soda and other sugary drinks. they call it a major contributor to childhood obesity. a proposed ordinance in walnut creek is ban smoking is being expanded to include all apartments based on the public hearing last night in city council. patios, balconies and common areas are included. the ban would include sidewalks outside of restaurants and at city parks and public events. the city council will take up the updated ordinance on july 16th. 7:35. new this morning, carnival rides, corn dogs and cotton candy. one of the oldest and most popular fairs in the bay area

kicks off for another year today. ktvu's brian flores is in pleasanton to explain how organizers plan to keep going, keep the 101-year old alameda county fair going. good morning, brian. >> reporter: good morning, tori. still looking forward to the gates opening. if our producer lindsey is there, i would like to be here for the noon news. just throwing it out there. pretty quiet here. this is probably the quietest is will be for the next few days. this new ride is called vertigo. it takes people 95 feet up in the air, spins people into a 85- foot circle. please do not eat before you go on the ride. 500,000 people attended the fair. officials expect to have more visitors next year. what's new? a free-style motocross show that happens every day in the afternoon. they will have a show at 1:00, 3:00 and 5:00. there's also a roller skating

rink as well. there's eight designated smoking areas. officials approved the move ins and they said there did it so they can -- and they said they did it so everyone could enjoy the fair. >> we felt like creating these areas was great for all of the good of the fair guests here. >> reporter: of course, everyone is looking forward to the rides but the food as well. they will have the classics like corn dogs and funnel cake, krispy kreme hamburgers. mac and cheese on a stick. if you come today entry is only $1. so are the cost of the rides as well. parking, though, is still $10. concert lineup, pretty good as well. stocks are really very much on stand by right now in early trading on wall street. investors are waiting for word from the federal reserve. the dow, you can see, just down a fraction right now. the nasdaq is up a fraction. s&p is flat. and it's all eyes now waiting on the fed. about three hours from now, the federal reserve will wrap up its two-day policy meeting and ben bernanke will be holding a news conference at 11:00 a.m. our time to say what was decided. now, most analysts expect bernanke to say the fed will

continue to buy u.s. bonds at the current pace. so that is what investors are hoping to hear. but they believe policymakers will add they could scale back the program if the jobless numbers improve later this year. 7:44. new this morning, the face of men's warehouse clothing chain is now out of a job. george zimmer founded the fremont based company in 1993. you know him best appearing in the commercials saying you are gonna like the way you look. i guarantee. so far the company's board has not said why they are getting george zimmer go. they do say they will discuss with him the extent, if any, of his ongoing relationship with the company. levee repairs have been made after a creek overflowed and flooded a neighborhood on the peninsula. ktvu's janine de la vega joining us live in east palo alto now to tell us more about the work that was just completed. janine? >> reporter: dave, people who i spoke to this morning who live

near the creek here say they are relieved that some of this first phase of repairs isen to. this is a very -- repairs is done. now, they've put down mesh and concrete to prevent what happened last christmas. there was torrential rainfall and it caused major flooding in various neighborhoods in east palo alto and palo alto. the levee overflowed and fail and mud and debris came down and threatened pg&e's infrastructure. governor brown called a state of emergency so east palo alto could qualify for state funds. in the hirst phase of work, the slope of the creek has been shored up. workers used mesh and rock and installed a new concrete dike and that cost about $165,000. there are still some weak points where high water can

1800 acres have burned. hundreds have been evacuated. now we're learning the fire was started by an abandoned camp fire. so far, it's only 40% contained. we have new information on the plaque forest fire in coles, a big one. a husband and wife who died in the fire have been identified. authorities say that mark and robin hurricanelotz were apparently trying to evacuate when the flames overtook their car last week. they were long-time employees with the air force space command. containment has grown to 85%. at least 500 homes have been destroyed. hundreds of people are still evacuating. house republicans have advanced an immigration bill that would boost criminal penalties against anyone living in the u.s. illegally. republican-controlled house judiciary committee approved the safe act last night. the legislation would make it a federal crime to be in the country illegally instead of a civil defense. democrats call it a step in the wrong direction. the house committee vote comes as the senate debates a different bill that would grant sit stenship to millions. a new report estimates the bill

an nfl football player is at the center of an east coast homicide investigation. the home of new england patriots' tight end aaron hernandez was searched by police. the body of a 22-year-old man who had been shot in an industrial yard was found less than a mile away. "sports illustrated" says an suv rented to hernandez's name is linked to the homicide. the magazine reports that hernandez was questioned but is not considered a suspect. >> one of the police officers later said to us it looked like he had been shot and dumped there. >> two of hernandezes's in-laws tried to -- two of hernandez's in-laws tried to leave but they were stopped and questioned by police. the 2.2 million park opened on may 31st, the skate park.

crowded. also the morning commute on the golden gate bridge looks good heading south to marin county. if you are driving from san francisco to marin, that drive looks good. let's go back to the desk. b.a.r.t.'s police chief is bringing in extra help to take a closer look at his department. ktvu's claudine wong joins us live from oakland to talk about who will be assessing the department and why. good morning, claudine. >> reporter: the chief wants an outsider to look inside the department. we're at the fruitvale station. we've been talking to riders. this is where oscar grant was fatally shot back in 2009 and it was the reform that came out of this that will be looked at. this morning, the police chief is expected to announce he's calling in help the department. patrick oliver will be coming in next month. the b.a.r.t. police was under a lot of scrutiny since the shooting. since then a b.a.r.t.

oversight committee was formed. and ken rainy, he was hired a year after that happened. when he came in, he was told that this was going to be his job, ushering in this era of change, change in terms of visibility, in officers' training, giving a new look at practices, policies and procedures. one rider we talked to said he wants to see more progress as the process moves forward. >> i'm happy. satisfied. >> reporter: who is patrick oliver, this gentleman coming in? well, he has several things on his resume to note. he was a former police chief in at least two departments in ohio. he also serves as commissioner for the commission of accreditation for law enforcement agencies but he was also part of the committee that compiled the original noble report. if you remember, that report was one of two done in the wake

of the oscar grant shooting. it was very long and very critical and patrick oliver was part of putting that altogether. certainly, he's familiar with the b.a.r.t. police department and the direction they've tried to go in the last two years. now, we're not sure how long this review is going to take. what i do know is that the police chief is making himself available to answer questions about why he picked mr. oliver to come in, how long this is going to take. we expect to be able to ask him those questions later this morningge and have continuing coverage for you on ktvu. live in oakland, claudine wong, ktvu channel 2 news. >> thank you. 8:02. an award-winning new movie about the b.a.r.t. shooting is being screened tomorrow. the film was shot in the east bay and was directed by oakland native ryan kooglar.

>> reporter: officers will be targets those who do not stop for -- targeting those who do not pedestrian. we'll be heading over to catch them in action. we'll see you in 45 minutes. live in foster city, tara moriarty, ktvu channel 2 news. new this morning, the investigation goes on in an early-morning house fire in berkeley. it started about midnight at a home on milvia street. the investigators say the fire started in the basement and then quickly spread up to the attic. the woman in the house called 911. she first smelled smoke and then called 911 a second time when she turned on the lights. >> the first time, i didn't smell it as much as i did. i turned the lights on and then i saw it. >> luckily, she was not hurt. but that fire forced her out of the home. investigators are still not sure how the fire started. tonight, family and friends will hold a special celebration of life in honor of a young college student from emeryville. he was killed one week ago in

north oakland one hour before his 23rd birthday. police say he was heading home from a pickup basketball game when he got into a minor car accident. witnesses say the man who hit the victim 'car got out, shot and killed him and drove off. the reward money has climbed to $30,000 in the search for the two men. the mother of a missing man with brain damage is pleading with police to take his case more seriously. sean sidi's mom said he should be considered at risk. she accused officers ignoring a lead that sidi may have gone to marin county from golden gate park. she plans to hold a vigil this sunday to push police to investigate further. complaints about a gay pride flag at city hall in calistoga caused the city to take the flag down. the flag was put up last friday to celebrate napa county's gay

pride week. but some in the community, including a former mayor, told "the press democrat" they objected flying next to the american flag. the wait continues for the u.s. supreme court to issue its ruling on california's proposition 8, the ban on same- sex marriage. the justices are scheduled to rule before the end of the month. coming up at 8:25. what one of the lead attorneys in the case predicts will happen. so the ruling could come as early as tomorrow or next week. if it does, it will happen at 7:00 a.m. all right. 8:06. sal is back. you are keeping an eye on the peninsula, right? >> we've had a couple of things going on there. westbound 92 off the san mateo bridge. there was a crash near west hillsdale. it's farther into san mateo. we've had a couple of things going on on the stretch. the san mateo bridge and highway 101 nearby are pretty slow. also the morning commute is going to be busy if you are

between the united states and the taliban. this morning, hamid karzai is breaking off important security negotiations with the white house. now, karzai is angry that the taliban and the u.s. will start their peace talks without first bringing in the afghan government. he also says the name of a new taliban office in the middle east disrespects the afghan people. now, he says he will not pursue peace talks with the taliban until the united states drops out of those negotiations. despite those upcoming negotiations with the u.s., this morning, the taliban claimed responsibility for an attack that killed four american troops at bagram air base last night. the taliban said it fired two rockets at the base, right outside of kabul. it is 8:14. happening right now, in washington, d.c., the u.s. congress is holding a ceremony to dedicate a statue of civil rights leader fredrick douglas. this is a live picture right now. douglas was born a slave in

$70 million in bonuses as part of a deal with an employees' union. the white house ordered no discretionary bonuses because of the automatic spending cuts. the irs will only say it's negotiating with that union. state senators and other elected officials, including the governor, may be getting a pay raise. the seven-member panel th oversees their salaries could vote today to restore some pay cuts imposed during lean budget years. the california citizens commission dropped lawmakers' based salaries from 116 a year down to 191 -- 116,000 a year down. this morning, a group of whistle-blowers announced that the official investigation was

wrong about the twa airline going down on long island. the group of whistle-blowers, which include memberses of the original team, say radar data and eyewitness statements say the plane was brought down by outside source. this video of a baggage handler having an offday. it's gone viral. it was taken by a passenger in china. it shows the worker tossing boxes on the conveyer belt. most fell off. eventually, a worker came along to help and all of the boxes made it on the flight. the city of brentwood throwing the book at those kids cutting class. brentwood is considering new daytime loitering rules for teenagers. the contra costa times reports the council will debate the measure next tuesday. the vice mayor says instead of

this country singer has died at the ainge of 90 -- age of 90. that was whitman performing "rosemarie." he was known for his yodeling. a family member said he died of heart failure at a hospital. san francisco's cable cars will attract visitors from around the world this summer. but the tourists may get a thrill ride they are not expecting. cable car accidents have been costing the city of san francisco plenty of money. the city has had to shell out $8 million in the last three

years to pay off settlements to cover all sorts of injuries from broken bones to severed limbs. >> they range from very minor to some very rare, severe accidents. those occur from the 19th century technology. >> cable car operators say the biggest problem is riders not paying attention. they say many injuries happening when people are hanging off the side of a cable car. 8:24. people on both sides of the same-sex marriage issue are waiting for the ruling from the u.s. supreme court on california's proposition 8, the ban on same-sex marriage. one of the lead attorneys for the anti-prop 8 side says there will be more lawsuits if the high court rules for anything less than full marriage rights in all 50 states. >> we're gonna win it for all americans in all 50 states. whether that comes true or not, i don't think anybody can say.

ten people were arrested at last night's giants' fame. they are fans but -- game.

they are fans but as pam cook reports, they are loss workers making a point. >> nearly 400 concession workers headed to the ballpark last night. it wasn't to work or watch the game. it started with a fairly peaceful rally outside of at&t park before the game. you can see the workers standing outside. they've been without a contract for the past three years. and they continue to fight with management over wages and benefits. the arrests came after 50 workers bought tickets and went inside the park. we want to show you a picture sent to us from a viewer, chris coleman, who was at last night's game. you can see the concession workers, some of the people sitting right there in front rest gilroy garlic fry booth. they are asking people to bring their own food instead of buying it here. >> save yourself some money. don't buy food at the ballpark.

>> now, others are joining in on the protest. but again, ten people arrested last night. police say that they were in violation of conduct code by blocking the booth. the union spokesperson would not say if there would be another strike down the road but the company that they work for says this is offering one of the best compensation packages in the country. reporting live in the newsroom, pam cook, ktvu channel 2 news. new this morning, one out of every nine bridges in america needs serious repairs, so says a new study on structurally deficient spans. these are not rarely-used bridges. in fact, 260 people use them every day. nearly 3,000 bridges in california are structurally deficient. that's 12% of the bridges in the state down from 13% last year. and we have new video of a busy

bridge in washington state that collapsed last month over the skagit river. it reopened just a few hours ago. the bridge's failure sent two cars tumbling into the river below. no one was injured or hurt. it also cut off washington state's main roadway to canada. some 70,000 cars travel over interstate 5 over that bridge every day. a levee is fixed where water once overflowed into an east palo alto neighborhood. the creek topped its banks and flooded woodland eve last year. the first phase of repairs is finished. the damaged road has been repaired. next they plan to fix the points where the water seeps through. new developments in san jose this evening about a homicide that occurred last week. about 30 minutes ago, ktvu learned from police that for the second time this year, the victim was an innocent

bystander. now, earlier this morning, police announced several arrests in the case. robert alvarez, cassandra reyes and a third american not being named because he's a juvenile, they were arrested on saturday. police say they stabbed a 56- year-old man outside of a home last thursday on checkers drive. he later died at the hospital. police say the attack was gang- mow vateed. they say -- gang-most rated. they say this the second time this year that an innocent victim became the target of deadly gang violence. all three suspects face murder charges. a robbery victim in oakland is talking to ktvu about the attack that sent her to an emergency room. 46-year-old morena menendez suffered a broken nose, a ruptured blood vessel and her t- shirt was covered in blood. on monday, four young men and two women cornered here at a bus station. she gave them the $15 she had in her pocket but they also

demanded her backpack. >> give me the bag, give me the bag. no, no money. >> he punched you? >> yeah. >> a good samaritan that was driving by was able to scare off the attackers and took the woman to the police station. police later arrested two of the six suspects. they also got her backpack back. but her wallet, her phone, her keys were gone. 8:34. a fire in core deal just sent guests of a motel 6 running for safety and in search of a new place to stay. the grass fire began after 7:00 p.m. yesterday on the side of 880 near the suisun valley exit in solano county. embers landed on the roof of the motel sparking flames in the adick -- attic. the manager said the motel was at 90% capacity when the fire began. evacuating guests were forced to leave everything behind.

>> the second story right here with the door opened right there, we've seen flames coming. it was pretty hot. it was getting hot. >> motel guests had to make other arrangements to find a place to stay. the motel will remain evacuated today while the damage is assessed. the city of san jose now has a temperature fire chief. he's ruben torres. he's been with the department for 27 years. he's agreed to serve as the acting chief until the city decidessed on a permanent replace -- see sides on a permanent replacement for willie mock donnell who will take -- mcdonnell who will take over the las vegas department. brian flores is at the fairgrounds in pleasanton for the fairs. the gates won't open for two and a half hours.

workers' sit-in. their union wants fans to bring their own food to the giants' game until this dispute is settled. happening now a new campaign for pedestrian safety gets underway in san mateo county. tora moriarty joins us live from san mateo with what police officers are doing today. good mornings tara. >> reporter: -- good morning, tara. >> reporter: officers will be tracking counsel on people who don't stop for pedestrians. you can see the crosswalk and the seven officers, seven out of the two dozen, fanning automatic all over the peninsula to crack down on unsafe motorists. burlingame, foster city and san mateo, each had a pedestrian killed in the month of april. so these officers really wanted to get out on the streets and start reminding people that they need to pay attention while driving. >> please be cognizant of pedestrians in the roadway, either in crosswalks, about to enter crosswalks. just be watchful for pedestrians. if you do see them, it's

incumbent upon you to yield an stop your vehicle and let them cross through safely. >> reporter: now, in the one minute since we arrived, two people already have not stopped for the police decoy. you can see that that officer is handing out a ticket to at least one driver who is in violation and right now if we pan over the decoy is getting ready to -- ready to walk across the street instead. this is a hot bed for tickets. on any given day, officers can come out here and hand out a ton of tickets because people simply do not stop. there is goes another one. the officer will be firing up his engine and taking off. there he goes. that's to catch another person. so as you can see, a great reminder to folks out there if you are thinking about talking on your cell phone, being distracted. officers will be out on the

peninsula today. definitely keeping an eye on the roadway and handing out the tickets. we're live in san mateo, tara moriarty, ktvu channel 2 news. >> thank you, tara. three people are facing federal charges for forcing a mother and her child into what police call modern slavery. charges against three were announced yesterday in cleveland. they are accused of keeping a mentally disabled woman and her daughter captive for more than a year. authorities say the two were forced into manual labor while the three suspects collected the mother's benefits. >> we're physically punished for toiletry accidents and were threatened with pit bulls and pythons. >> the case first drew attention to police when the victim was caught stealing candy from a local store. the police suspected more was going on, investigated and

the could of men's ware -- the ceo of men's warehouse, the man you've seen on tv saying "i guarantee it" has been fired from the company he created. janine de la vega has more on the surprising shakeup. >> reporter: a lot of people are shocked to hear this news that george zimmer is out because he was the founder and

really the face of the company. we all grew up watching those commercials. we haven't been able to get a chance to get reaction from workers yet. it's not open. now the men's warehouse did not give a reason on why it is firing the founder and executive chairman george zimmer. he started the company in texas in the 1970s selling slacks and sports coats. the men's warehouse became a specialty store that specialized in suits. he starred in the first television commercial where his popular slogan was "you will like the way you look. i guarantee it." analysts say the timing of this is strange because today is the men's annual share hold meeting but now it is delayed. here's what customers had to say -- >> he's kind of been the face of men's warehouse, yeah, definitely. i would say i'm surprised. i would be curious to find out why. >> reporter: and you connect him -- >> and you connect him with the
