now. well, good morning. welcome to "mornings on 2." it is thursday, it's june 20th. i'm dave clark. >> good morning. i'm tori campbell. let's begin with a quick look at weather and traffic with steve. last day of spring? nice one? >> it will be nice. a cooler. temperatures today will warm up. again, nothing just -- we've been below the last few days. we'll be near the average 60s, stents and 80s -- 70s and 80s. here's sal. good morning. heading out to the macarthur maze, no problems. the toll plaza is backed up for a 20-minute delay. let's go back to the desk. happening now -- any minute, the u.s. supreme court will issue its next round of decisions. one could be the fate of gay marriage in california. half an hour ago, people lined up outside of the washington, d.c. court eagerly awaiting to

get inside. landmark cases include prop 8 and the defense of marriage act. brian flores is closely monitoring all of the movements. >> good morning. i'm keeping an eye on things. so far, no ruling. we're definitely down to the minutes to see if there will be a decision today or not. there are a handful of options that we could see today. but what it boils down to, is the fact the supreme court will make some type of decision today or sometime next week as the court ends its session at the end of the month. again, the supreme court issues rulings on mondays and thursdays only, roughly around this time. so either way we'll let you know. one ruling that could come, they could uphold prop 8 which could keep gay marriage illegal in the state. two, the justices could dismiss the appeal allowing gay marriage. third, they could strike down

prop 8 as uncons sty or four it could broadly say that gay marriage is unconstitutional. whether a decision comes down today or not, the clerks are ready. >> we would be ready immediately. we would be ready for the secretary to issue guide lines though. it would still be a few days. >> now, the contra costa clerk there anticipates a 20% increase in weddings when or if a decision comes down and they say they would not start to issue marriage licenses force same-sex couples until early next -- for same-sex couples until early next week. deep in mind, too -- keep in mind, too, that the supreme court has cases pending, which includes doma and prop 8. in the newsroom, brian flores, ktvu channel 2 news. >> thank you, brian.

another high-profile case we're tracking is about affirmative action. a white female claims she was denied admission to the university of texas despite having equal or better scores than minority students who were admitted. the uc system and california attorney general kamala harris both filed friend of the court briefs in support of the university of texas. we're expecting a decision 0p that case by the end of the month. so stay with ktvu for that decision as well as prop 8 and doma online and on air. we'll bring it to you as soon as it happens. that night, we'll go in depth on the decision on a special. police in oakland searching for two gunmen who attacked a 7- eleven store clerk. this happened about midnight on grandavenue. police say the gunmen roughed up the store clerk there, cleaned out the cash register, then they ran off. the clerk was taken to the hospital. we don't know his condition

right now. those robbers are still on the loose. oakland police will talk about plans to combat robberies and other criminal activity. ktvu's tara moriarty joining us live from oakland police headquarters. you have details about a mobile command unit. tara? >> reporter: yeah, it can be used not only to fight crime but to prevent it and yesterday afternoon, opd rolled out the mobile command unit for the first time in order to target robbers. >> let's say we've got a crime going on here. you can actually say, okay, i want a unit over here. >> reporter: we got an exclusive look inside the unit where police can map out strategies for nabbing suspects. it also has a camera perched on top which police say is not only a visual deterrent. it has the capabilities to catch criminals in the act and monitor activity within a four- block radius, important since

police say robberies have jumped to 30% last year. the rockridge and grand lake neighborhoods, two spots where thieves are notorious for snatching items. >> i can say there is a robbery in progress and send units there. >> it kind of brings the police station out to the community. we can do everything done from a dispatch and police unit. >> reporter: the surveillance video can be used and that can be used against a thief in court. this is part of the larger crime-fighting strategy which breaks this into five districts and commanders can focus on issues specific to those neighborhoods. tara moriarty, ktvu channel 2 news. >> thank you. vandals have returned to san francisco's golden gate park and park officials are asking for the public's help. here's video from when vandals targeted the park's trees, benches and golf course two

years ago. the park manager tells "the chronicle" that vandals returned in september and then again two months ago. they snapped the tops of 200 young trees near fulton, killing the trees. police patrols have been increased and the public is being asked to report any suspicious activity. caltrans will have to meet with wildlife agencies and bird groups about construction work in petaluma if the governor approves the budget on his desk. there is a bill in the budget that has to do with nets put under bridges by caltrans that have killed hundreds of federally-protected birds. the nets were put up to keep the birds from nesting during the highway 101 widening project. after years of skyrocketing tuition at state universities, there could soon be some relief after governor brown signs the budget. coming up at 7:25, the program that could help thousands of families afford college in southern california. dozens of suspected san jose gang members are due back

in court today. a judge may set a trial date for almost 50 suspects. they've been indicted. the long list of felony charges in this case include murder, robbery, drug sales, witness intimidation. nine of the suspects are still out there on the run. a court hearing set for today involving oakland's harborside medical marijuana dispensary. the city wants a stay while it appeals a judge's dismissal of the lawsuit to keep harborside open. the u.s. attorney's office is trying to shut down the dispensary by seizing the property. the harborside generates about $20 million a year. it contributes almost $1.5 million a year in taxes to the city of oakland. 7:08 tonight a public memorial will be held in celebrate to sell -- in san jose to celebrate the life of a bicyclist killed on her way to work last week. the woman was hit and killed after two trucks crashed into

military officer who will decide if the men should be court marshaled. aaron hernandez of the new england patriots now connected to two shootings. police in massachusetts are investigating his possible involvement to the shooting death of a semipro football's player whose body was found near his home. another case, that he shot a man at a miami strip club. authorities closed that case without filing charges. jury selection resumes in the murder trial of george zimmerman. we want to take you live inside the courthouse. that's the defense attorneys. they are questioning 40 potential jurors. yesterday, prosecutors asked them about their experiences with guns and neighborhood watch programs. 12 said they own guns. one is a them of the nra and -- member of the nra and one of

them was the victim of a violent assault. lawyers hope to begin opening statements on monday. this afternoon, prosecutors will discuss the evidence against three men charged in a triple shooting last month in san francisco. police say the defendants drove up to the victims, tried to rob them and then gunned them down near a b.a.r.t. station in the mission district. the suspects are 34-year-old larry car, 33-year-old george vickers and 30-year-old jason wittenburg. investigators say an officer was injured when the suspects tried to escape police and backed into a patrol car. bail for the three parolees was set at a million dollars. 7:18. we have breaking news. the u.s. supreme court did not issue a ruling this morning on california's proposition 8 during its session. that means the earliest a ruling could come down on california's ban on same-sex marriage would be monday. the court only announces rulings on mondays and

thursdays beginning at 7:00 a.m. they are expected to add other days next week. the court handed down rulings on three cases. the court is scheduled to make a decision on proposition 8 before their current session ends at the end of this month. 7:18. thousands of people are asking linked in to change its policy on privacy settings. the issue came up after a woman says her former employer who she says sexually harassed her at work was using linked in to keep track where she was. she wanted to be able to block him from reading her profile page. the woman says she needed a court order or she could list the only people allowed to see her page. critics say that would block other people looking to make a professional connection. today's expected to be the last day of apple book anti- trust trial. attorneys are scheduled to deliver closing arguments today. prosecutors say apple wanted to book prices and conspire with

he could end relationships with them and maintain control of his possessions. he med guilty to the murder -- he pled guilty to the murder of his girlfriend, whose body was found in a trash can. authorities are investigating the deaths of other women, including his ex-wife strangled in the same area as his girlfriend. law enforcement in the south bay are looking for the gunmen who opened fire near the san jose police activities league. the shooting happened just after 6:00 last night on virginia south and south kick road in east san jose. officers found a man shot at least once. he was rushed to the hospital with life-threatening injuries. doctors say his prognosis was grim. no arrests have been made in the case. 7:34. happening now -- a federal judge in oakland will hear arguments. this could affect former and current college student athletes. san ramon native sam keller is among those suing the ncaa. he used to be a quarterback for arizona state.

he and others say the ncaa is making pro of thes from video games that use their names and images without compensating them. now, they want to turn their lawsuit into a chaz-action lawsuit. no -- class-action lawsuit. san jose city leaders are suing mlb because they say they are tired of waiting. san jose wants baseball to allow the as to relocate and move to the south bay. legal experts say that lawsuit comes at a very high cost. they say it eliminates the possibility of an indefinite delay. however, it also guarantees baseball will not allow the as to move any time soon because of a long, drawnout legal process. santa clara county has reached an agreement on a new budget but it still has a $70 million shortfall. supervisors say the new budget will avoid layoffs and minimize cuts to services. supervisors hope to make up the new -- the budget shortfall

with labor concessions, revenue from a sales revenue increase and by eliminating 64 vacant positions. in san francisco, millions of dollars in federal funding for people with h.i.v. and i a.i.d.s. could be in jeperpydy -- jeopardy. money and treatment services could be reduced by $7 million over the next two years. that's unless replacement money could be found in san francisco's budget. over the past three years, $20 million has been cut from these offices. the search for a kayaker believed to have drowned in a lake near livermore has been suspended indefinitely. that's because park police say they simply don't have enough money to continue the search. they spent the early part of this week searching lake devale for 30-year-old michael perez. he vanished sunday afternoon after taking off his life jacket to swim to shore. park police are trying to find the funding to resume the search with more divers.

"the sopranos" creator said he was a genius. fans of the show remembering

reserve said it could start to scale back the stimulus program and end it by the middle of next year, all all this because the u.s. economy is doing better. taking a live look at the big board, all the u.s. markets are down about 1.5% right now. the dow currently down 215. the nasdaq is down 44. s&p down 24. it's even sharper downattorneys overseas. at -- sharper downturns overseas. home sales jumped last month. that puts adjusted annual rate at 5.2 million homes. that's the highest rate in three and a half years which occurred as a buyer tax credit deadline was approaching. the medium price was 209,000, the highest level since 2008. economists say both the numbers indicate the housing market recovery is continuing. americans filed 18,000 more applications for unemployment benefits last week. that put the number of new

claims at 354,000. economists say that's still consistent with modest but steady growth in the job market. jobless claims are down 6% from the start of this year. it was certainly a big story here at ktvu news. and now it's a big movie. key senators say they are close to a bipartisan agreement on immigration reform. the legislation would reportedly grant legal status to undocumented people living in the u.s. the bill would call for hundreds of miles of mexico border fencing. the number of agents hired to protect the border would nearly border and drones would watch the u.s. mexico border from above. senator feinstein is weighing in on the drones now that the fbi has admitted to using them for surveillance in the u.s. feinstein says they are the biggest threat to american privacy and must be regulated. she spoke out yesterday after fbi director robert mueller told the senate judiciary committee his agency has used drones for surveillance in the u.s. another wildfire in colorado is pushing smoke into the denver area. the line gulch fire is 30 miles southwest of denver near the town of evergreen in jefferson county. more than 100 people have been told to leave because of the

will be sometime next week. there was speculation there might be a ruling today. this is new video of ted olson, the attorney fighting to end prop 8. he was seen entering the court which led some, especially in the social media realm, to suggestion there would be a decision today. now that there was no decision, the earlier we'll hearing will be on monday. the other new information is the court is considering adding another decision day next week. typically the court issues rulings on mondays and thursdays. we're hearing it may issue more rulings on wednesday as well as there are 11 rulings that need to be issued. includes prop 8 and doma. back here at home, clerks are ready just in case they strike down prop 8. >> we had a lot of inquiries from people calling in to find out what they need to do to get a marriage license and what they -- and can they be married here. they don't always say it's for

>> here are the three resultings handed down today in the -- rulings handed down today in the case. in the second case, by a 5-3 decision, the court ruled in favor of american express saying an arbitration agreement between the credit card company and merchants prevented them from filing class-action claims against american express. in the final case in a 6-2 decision with judge kagan recusing herself, the court found that a government program violated first amendment rights by compelling partnering organizations to specifically oppose prostitution in order to get funding for a.i.d.s. programs overseas. as brian mentioned, the court still has about 11 pending cases. the court will probably have to hand down decisions besides on monday. make sure you stay right here with us ktvu as well as

blocks down. i'm rotating it to go ahead of us. >> we got an exclusive look yesterday afternoon inside the unit where police can map out strategies for nabbing suspects. the mobile unit had the camera on top which police say is not only a visual deterrent. it has the capability to catch criminals in the act. it can monitor activity within a four-block radius. important since police say robberies have jumped 40%. the rockridge and grand lake neighborhoods, two spots where thieves are notorious for snatching iphones and ipads. >> there's been a lot of alarms installed in the neighborhood. police presence is definitely helpful. >> how careful are you when you use your phone? >> i try to be real careful. but i do forget. >> reporter: the mobile unit can record video and that surveillance can be used against a thief in court. the unit is part of the crime

fighting strategy which breaks off into five districts. and that will help police with those specific neighborhoods. vandals have returned to san francisco's golden gate park and now park officials want your help to catch them. there's some video from two years ago. vandals targeted the the -- targeted the park's trees, benches and the vandals returned in september and then again two months ago and snapped off the tops of two young trees near fulton streets. police patrols have been increased. you are being asked to report any suspicious activity you may see. caltrans will have to meet with wildlife agencies and bird groups about building work in petaluma if the governor approves a budget on his desk. there's a bill in the budget that has to do with nets put under bridges by caltrans that have killed hundred of federally protected bird.

they hope to make up the budget shortfall with labor concessions, revenue from a sales tax hike and by eliminating 64 vacant jobs. in san francisco, millions of dollars in federal funding for people with h.i.v. and a.i.d.s. may be in jeopardy. according to the examiner. money for treatment could be reduced by $7 million over the next two years. that's unless replacement money could be found in the city budget. over the past three years, about $20 million has been cut from those services. some high-powered weapons are off the streets. this all started with the traffic stop in oakland. highway patrol officers pulled over 33-year-old dion montae moses last friday on foothill boulevard. officers found a loaded semi- automatic handgun, a high powered rifle, high-capacity magazines, body armor and marijuana in his car. officers also served a warrant as a -- at a san rafael home

linked to moses and seized five more rifles, a handgun, a thousand roundses of ammo and cocaine. the city of walnut creek has hired a new police chief. tom hamlin has been in law enforcement for 23 years. he recently worked as a police lander in the sacramento area. he replaces the prior chief who retired last month. police say the reported attempted abduction of a little girl was a hoax near the pacific pier. a friend even backed up up her story. but police became suspicious when they were unable to find a witness. the girls made up the story, they admitted. not clear why. richmond became the first city in contra costa county to ban plastic bags. the city council approved an ordinance to ban plastic bags and retail and grocery stores.

the earliest we'll hear anything would be on monday. and the court is considering adding another decision day. typically the court issues rulings on mondays and thursdays. we're hearing they may issue more rulings on mondays and wednesday as well. there are other issues that need to be ruled on as well. back here at home, wedding planners say business would pick up again. >> i have gotten a few more calls. people are kind of seeming to have that hope to get that completely finalized but i definitely do see that it's been more inquiries regarding wedding planning for sure. >> the contra costa county clerk anticipates a 20% increase in weddings if prop 8 is overturned and would not start to issue marriage licenses for same-sex couples until they get more direction from the state and tori brought up a very interesting point in the last half-hour. it's very rare for the supreme court to hold off a decision until next session but

according to experts they don't have to make a decision now. but the way things are shaping up, talk about adding more rulings on wednesday, it is definitely looking like toe ma and prop 8 will be decided. we'll find out on that decision this afternoon. brian flores, ktvu channel 2 news. >> thank you. the court did hand out three rulings today. one made it harder for the government to use the facts of a prior conviction to enhance a federal criminal sentence. the court also ruled in an arbitration agreement between american express and merchants prevented them from filing class action claims against the credit card company. and first amendment rights were violated by forcing partnering organizations to oppose prostitution in order to receive a.i.d.s. funding. there's still 11 cases left because the court issues no more than five opinions today, there must be three more days

outpouring of grief. people are running the italian television, they are rerunning "the sopranos" programs. people are sad and close to him and consider him family. >> was he there for -- was he there for a film festival as well as for vary -- vacation? >> reporter: that's right. it was a vacation with his son, just the two of them. he was expected to go to taormina on the island of sisly for a film festival to be given an award honoring his life achievement as an actor. the director of the film festival has spoken to him -- had spoken to him a couple of hours before he passed away. he was very excited to go to sisly where he had family and where he felt very close and wanted to show his son his roots and things like that. the film festival now is being dedicated to his honor and that -- he was supposed to go on the 22nd of june. that will be another moment

firefighters in vallejo are here at the scene of a bolt fire. this broke out at about 45 minutes avenue a at almond avenue and willow streets. this video was sent to us by a ktvu viewer. the solano county firefighter department says a box caught on fire. in san francisco, an apartment fire at an historic building in the tenderloin district happened about two hours ago on jones street. luckily, no one was hurt. but the red cross is helping at least one woman find a new place to live. that building has been around since 1924. it's on the national registry of historic places. it has retail businesses on the ground and an apartment over above. the fire was contained to just one unit. still no word on the cause of

the fire. 8:53. it was a dark day in bay area history and now film critics are weighing in on a movie about it. pam cook is in our studio to talk about "fruitvale station." >> tickets are selling out wherever it is shown. tonight the story of the night oscar grant was shot and killed comes to oakland. >> what's going on? >> there will be a private screening of the movie in oakland. some of the actors include octavia spencer will be there along with oscar grant's family and the film's director, a bay area native. the man who is moderating a discussion after the showing says it is an important film because you get to know oscar grant. >> he's a son, he's a father. he's a fiance. he's all of these types of human attributes that often get lost when we have victims of police violence.
