complete bay area news coverage starts right now. this is ktvu channel 2 news at noon. it's been nearly five years since california passed proposition 8 and now the supreme court is ready to issue a long-awaited ruling on the controversial ban. good afternoon. i'm tori campbell after several weeks of waiting, that decision is scheduled to come down tomorrow just after 7:00 a.m. on the final day of the high

court session. the highly-anticipated ruling could have several outcomes. the court could uphold proposition 8 which would keep the same-sex marriage ban intact. it could strike down proposition 8 on various grounds, including deeming it unconstitutional, or it could decide that supporters of prop 8 lack standing to appeal and therefore the court declines to issue a ruling which ultimately means that same-sex marriages could resume in california. whatever the outcome, there are events planned in san francisco. sal castanedo joins us live from the castro to explain what's being done there. >> reporter: good afternoon, tori. here in the castro, it seems like everyone has heard about this and there's a buzz in the air about tomorrow's expected ruling. no matter what the ruling is in these key cases. many in the lgbt community say they will be out tomorrow either to celebrate or to demonstrate for the right to marry who they choose.

here in the district, here in the castro district, many have been talking about this, those who have been the face of the movement say this day itself is a victory. >> it's been almost five years since prop 8 divided californias into haves and have nots. we want to see our friends, our loved ones plan their wedding days. he we know so many couples engaged to be married. we want to see them walk down the aisle and say "i do." >> reporter: when newsom allowed couples to marry at city hall, the line stretched around the block. that was in 2004 for about a month. the marriage ceremonies were stopped by the california supreme court on march 11th of 2004. now, gavin newsom refuses to take credit for being the leader in this movement. he says the people have taken the -- take the credit. >> these are the heroes. these are the folks. they didn't have to show up at

city hall. they didn't have to participate in what we had in store. they didn't have to say "i do." it's the fact they did, and their commitment and follow through. fox like -- folks like stewart have not stopped -- stewart and his partner have not stopped. >> reporter: you might remember that gavin newsom, who was mayor of san francisco at the time, took considerable heat for coming out and doing that and allowing gay couples to marry. in fact, he took a lot of political heat. he even told me that barack obama refused to have his picture taken with them and then the leaders came around very slowly and much later. he still rememberers the way it was -- remembers the way it was in 2004 and he like a lot of people say they will be watching intently at 7:00 our time. sal castanedo, ktvu channel 2 news. >> it's amazing how things have changed in the last fine years.

"mornings on 2" will have both decisions as soon as they come down tomorrow just after 7:00 a.m., we'll bring it to you on air and online. and then in the evening, we'll go in depth tomorrow in a cute news special at 6:30 p.m. the high court did issue some rulings this morning. the biggest decision handed down was on the voting rights act. the supreme court ruled a key part of that act is unconstitutional. the decision frees states with the history of racial discrimination from having to clear voting procedure changes with the federal government. most of the locations in question are in the south. but here in california, monterey, yuba and king counties were also under federal oversight of election practices. a big vote is taking place today that could authorize b.a.r.t.'s unions to go on

strike. ktvu's tara moriarty joins us live toicks plain what this all -- live to explain what this all means to commuters. >> reporter: one of the unions is meeting here. we're at the oakland coliseum. they are behind closed doors trying to figure out if they will be striking. they will be counting the votes at 10:00 tonight. this has been a particularly contentious contract negotiation periods, issues that are being hammered out, salary increase, medical benefits and pension. the union has even filed a lawsuit accusing b.a.r.t. of refusing to budge on safety issues. if the two sides don't come together, b.a.r.t. operators and station agents could walk off the job, essentially shutting down the entire system. >> we have issues of health and safety that are paramount to our contract proposals. b.a.r.t. is ignoring those issues.

they are telling us we're not interested in bargaining on that. >> it doesn't mean that they are now going to go on a strike and with we hope -- and we hope it doesn't get to the point. we're hoping there is a deal made before we have a work stoppage and really shut down the bay area. >> reporter: if a deal is not reached by sunday at midnight, it could have a desk stating impact on a 400,000 passengers that right b.a.r.t. every weekday. workers we're told will most likely vote for a strike. they do it almost every contract negotiation year. but they say they are ready to sit down at the bargaining table and that will happen with all five unions and b.a.r.t. tomorrow. if the workers do strike, they've not set a date for that. but they will give the public 72 hours' notice. david stevenson will have much more at 5:00. tara moriarty, ktvu channel 2 news. >> thank you, tara. if b.a.r.t. employees do decide to strike it will be the fourth in the agency's history. the last strike lasted six days. it resulted in a four-ier contract with a 7% raise.

the first b.a.r.t. strike was for two weeks in 1976. it was in solidarity with b.a.r.t. police. a lockout and strike in 1979 lasted for 90 days. managers helped to operate trains during that period. president obama is calling for proof that the keystone pipeline will be climate- friendly before the project is approved. he spoke about the pipeline project in a climate change speak at georgetown university this morning. the president said the state department is in the final stages of evaluating the pipeline proposal and that he's tell telling the department to approve it only if it does not significantly increase greenhouse gases. >> the net effects of the pipeline's impact on our climate will be absolutely critical to determining whether this project is allowed to go forward. >> the keystone pipeline would carry oil from tar sands in western canada to refineries

along the texas gulf coast. the project has sparked an intense battle between oil producers and environmentists. an early-morning home invasion in san francisco ended with three people shot including one of the intruders. as ktvu's alex savidge tells us that's because one of the victims fought back. >> reporter: three armed men burst into the house at the end of elmira street around 2:30 this morning. it was a haven't home invasion that ended -- violent home invasion that ended with gunfire. the intruders shot the husband and wife who live here. but the tables were turned when the husband managed to wrestle the weapon away from one of the gunman and shot him with it. the motive for this break-in remains unclear. >> it's too early to clear. i don't know what the circumstances are and why they targeted this home in particular. but it aim pierce that this home was -- it appears this home was targeted. >> reporter: the wife who was shot has life-threatening injuries. her husband, though, is expected to survive and the intruder shot is in critical

condition. police say there were children inside the home when this shooting happened. none of them were hurt. but they were taken to the hospital just to be checked out. >> i'm sure it was scary to the kids. they've been taken to the hospital for evaluation, observation and hopefully they will be fine. >> reporter: police are searching for two of the armed intruders. neighbors are not sure why the gunmen in this case would go after this family. but a nearby business opener shared this video from two nights ago that he says shows three men trying unsuccessfully to break into this same home that was the scene of this morning's triple shooting. alex savidge, ktvu channel 2 news. a non-related incident police in san francisco with also investigating the deadly shooting of a man at a muni bus stop. it happened at west point road in hunter's point yesterday around 1:00 in the afternoon. police say a car drove up and someone started shooting. the 19-year-old man has been

identified as jaquan rice. his 17-year-old give was also shot. she's in critical condition. san francisco police are asking for the public's help in finding a missing teenaged girl. 16-year-old gabrielle spagnola went missing yesterday afternoon in the city's north of panhandle neighborhood. she was last seen around 3:00 on heys street. she's described as white, 5'6", 120 pound with brown hair and brown eyes. anyone who has seen her is asked to call police. the los angeles police chief is calling it a blatant attempt to assassinate cops. the incident happened about 4:30 a.m. right in front of a police station. someone opened fire on two officers entering the station. that triggered a huge response by the department to find the gunman. officers cordoned off a 25- block area and the manhunt continues at this hour. >> these were undercover officers working a burglary task force here out of the wilshire station. ' they are opening the gate,

somebody for some reason opened fire striking them many times. >> one officer was grazed on the head by a bullet or debris while the other officer was grazed with a bullet by the hand. the l.a.p.d. increased security at all 19 stations after this incident. new details about why the men's warehouse says they fired founder george zimmer. the cold and wet start to the day. but ktvu's steve paulson will be here to tell you when you can expect a warmup. >> reporter: we're in downtown san jose, where ground is being broken for a new development. we'll tell you why city leaders say this is so significant. ?.=(=pcpcpcpcpcpcpcpcpc2h

a groundbreaking ceremony has just wrapped up in downtown san jose. a high-rise apartment building is going up on the corner of south market and santa clara streets. janine de la vega tells us why this project is so important. >> reporter: they call is a groundbreaking while it's symbolic for construction, it symbolizes a huge step for san jose. >> this is an extraordinary opportunity for us to put hundreds of people to work while we brings hundreds of

residents into downtown. >> reporter: here, a 23-story high-rise apartment complex will be built. 312 unit also fill it, along with a lap pool, wi-fi lounge. this is in the downtown area that used to sit empty but are quickly filling up. >> it's important for me to have a short walk to the nightlife. >> reporter: the high rise on south market is the first to be built in downtune san jose since the economic downturn. it's been a half decade since we've seen a crane over downtown. we've missed it. >> essex property trust bought the parcel of land and planned to invest in the project. city leaders are cutting fees on construction on fees and taxes to help lure more developers to the area. >> i'm a property owner. i have three tenants. i've had an empty space for three years. we just filled up the space.

i think if we get more people downtown, we'll get more of the area busy. >> reporter: the project is expected to create 500 construction jobs. it will be completed in the summer of 2018. cal's renovated football stadium and new training center opened to rave reviews last fall. now there are growing concerns about the financing plan for the project due to slow ticket sales. that could cripple cal athletes by training millions of dollars away from cal's operating budget. the total cost, 474 million is the most expensive facility upgrade in college spot -- college sports history. an alameda grand jury is weighing in on an controversy otherring -- involving and oakland teen center. it found a congresswoman improperly interfered.

the auditor came to the similar conclusion a fewer years earlier. they did not name the congresswoman. after dispute over new safety measures for the america's cup could end up in court. the four competing teams are working with meditators on 37 s measures in the wake of last month's fatal training accident. attorneys say they are prepared to go to court over a rule change that requires special equipment to control airborne catamarans. the first america's cup race is scheduled for july 7th. well, traffic is back to normal this noontime on a busy east bay freeway clogged this morning by a deadly crash. a woman was killed when her suv was hit by a big rig before 5:00 a.m. on fremont on 880. this is just south of stevenson boulevard. debris from the crash was scattered across the freeway. three southbound lanes were closed for hours and traffic

backed up for miles. the highway patrol is looking into what caused the accident. investigators say the woman who was alone in the suv may have just entered the freeway before the crash. >> it appears the mazda came over from the right, drove in front of the big rig. it appears it slowed down to unknown speed. at this point, the big rig struck the year of this mazda tribute. >> the truck driver was not injured. new details about the firing of men's warehouse founder, george zimmer. the retailer says zimmer warranted full control and had difficulty accepting that the company has an independent word of directors. the company added that zimmer had not been on the chief executive officer for two years. he was fired last year and in response he resigned from the company board. plans to expand the ferry building in san francisco could take years.

once complete, it would transport thousands of additional passengers across the bay area. tonight, a hearing is scheduled for a $110 million proposal that would add three new docks to the ferry building. project managers say additional services to richmond and berkeley are top pry or -- priorities and. bonfires on ocean beach could soon be banned because the cost of picking up after them is becoming too high. the park service plans to hold community meetings to find alternate ways to run the fire pits. in the past, the park service says it cost about $90,000 a year to pick up trash and debris. well, a very cloudy day for some. a very rainy one for others, especially up into marin county. there's reports coming in from marin county up to sonoma county in the russian river. i would not be surprised if some record rainfalls are set for the day.

you can see the source of the moisture continues to stream in here. it's up from the west- southwest. so the humidity is off the chart as well. you are sitting with temperatures in the 60s and 70s. if we can break through some of the cloud cover, senate's state meteorology department, cloudy and 74 degrees. if there were breaks, it would probably go to 84. we had the:00 and some of that -- we had the cloud cover and some of that steady rain, blue canyon, 2 1/2 inches of rain. you get the lift coming up in the hills. i know in cass zoo der raw, inch and a half -- cazadero, inch and a half there. i will bet kentfield and ross come in with impressive totals along with mount tam later on today. 60s and 70s. if it weren't for the cloud cover, mountain da -- mountain view is the only one that says a little bit of sun. the rain line seems to be lifting.

but things have calmed down up into mendocino county and lake county from healdsburg south, things have been picking up. santa rosa out to the russian river. the radar doesn't pick up all of this. santa rosa has had an inch of rain. it looks like mill valley, san rafael, some -- larkspur very heavy rain. julie said it's pouring here. the farther north you go, the rain picks up over to berkeley, richmond and then you get a little south of that. it seems to calm down. the rain line, sfo, concord. there's not a lot left. still the heavier rain continues to paint to the north. 60s and 70s. ukiah is 63 degrees. fresno, 87. the cloud cover is putting a cap on some of these warm temperatures, but it's so warm, muggy and humid. all it could take was a little bit of sun and then you would be too muggy. i think we have a lot of mug.

the rain will be ending. temperatures 60s and 70s held down by the cloud and rain and the rain will continue. if it continues like it has been. i would not be surprised to see some records coming in by this afternoon. fog, clouds, rain, drizzle today, some of that rain is steady. warmer on wednesday after that fog lifts and then much warmer. i would not be surprised if some inland areas see 100 degrees by sunday, monday. we'll go from one extreme to the other. >> i don't think the coast will get in on that. i think the inland areas will rock it up. >> next week is the 4th of july holiday. >> sunday and monday look to be the two warmest days now. if you plan to travel for the 4th of july holiday, you are not alone, about 41 million americans are expected to travel by car, plane or train. at least 50 miles from home. that's down a bit from last year. 34million plan to drive to their fireworks show or barbecue. about 3 million will fly. one popular coffee company

s&p up 17. across the nation starbucks is raising its prices by 1% today. it's about 3 to 4 cents per drink. starbucks says this only increases about one-third of the drinks on the menu. it does not affect popular brewed coffees and frappuccinos. the special olympic torch is on the way to the summer games with a pass through oakland. oakland police contributed 83 runners to help carry the flame of hope to the berkeley a -- to the berkeley/albany border. they say it's a good way to give back. >> it's something that doesn't get enough attention. we wanted to highlight the connection between the police department and the community. >> this is a -- this is a year- round fund-raising event. the opd team has raised at least $12,000 so far. cute on the news at 5:00 -- today on the cruise at 5:00 we're expecting to hear from the family of a young man shot
