>> we're looking to see if the public will help us for the public to help us to put our father with his son. >> reporter: police are looking to church the teenage suspect with murder. the reason he was robbing chang to get money to buy a cell phone. john sasaki, ktvu news. weather is being blamed for an accident in oakland that injured a woman and took down a palm tree. it happened in front of the grand lakes theater in oakland on grand avenue. the woman driving the car was taken to the hospital but is expected to be okay. the car hit standing water and hydroplaned. >> we've had widely scattered showers. heaviest rainfall was in the north bay. santa rosa in the last 24 hours got over an inch of rain. the official rainfall totals on my next weather hit for you.

you can see the scattered showers in the petaluma area. what we're looking at now is a drying out period. ahead i'm going to be talking about the chance for a clearing commute. and the big news how hot it's going to be around here. we'll see you back here at 16. at 5:15, we spent this day hitting some of the wettest spots in the bay area including one that's been causing trouble since the weekend. we'll tell you about the one silver lining from this june storm. >> the u.s. supreme court is expected to release its decision tomorrow on california's same-sex marriage ban proposition eight. cities around the bay area are gearing up for what they expect to be big celebrations for tomorrow's decision. but ken wayne is joining us with how these are going to be celebrations or protests. >> reporter: thousands of people are expected to gather here at about this time

tomorrow. and as you said, the question is, will they be celebrating or protesting tomorrow's court decision. whatever that decision it will be historic. the old televisions at the glbt museum mark a place in time. the 80s, 70s and before when gay and lesbians fought for their life. marriage always part of that. >> the struggle has been a long struggle since the beginning of the lgbt movement we've been talking about marriage. >> reporter: paul is curator of the museum expected to be a gathering place tomorrow when the decision is announced. >> i can't be better for a history museum than when history is being made right before us. >> reporter: it's what brought david neese here today. >> we're visiting from chicago, we were hoping they would make the decision today and we could be at the castro district when it happened.

>> reporter: people will gather at 6:00 p.m. and oakland and concord at the rainbow community center at 6:30 tomorrow evening. the question is will those events be celebrations. >> so it's going to be a very, very important day in supreme court history. it's just we don't know why just yet. >> reporter: uc hastings david levine says he believes the supreme court will take a middle approach rather than rule for or against prop eight. >> my guess is we will get an opinion saying that the appeals never should have been brought. >> that would be a victory for gay marriage supporters but a potentially messy one. and a victory less than what some may hope for. we will hear from gavin newsom then mayor of san francisco who played a historic role in this story. we'll hear why he says whatever the decision tomorrow the fight will not as he believes be over. in san francisco, ken pritchett, ktvu channel 2 news. there are two potential outcomes when the supreme court rules.

it could simply dismiss the appeal and clear the way for same-sex marriage here in california. it could decline to rule saying the court shouldn't have taken up the court to begin with. in that case the supreme court's decision would stand and gay marriage would be allowed in california. or the high court could overturn the lower court's ruling. in that case proposition eight would be upheld and same-sex marriage would remain banned here in california. be sure to stay with ktvu for the latest. we are also expecting a rules tomorrow morning as well. mornings on 2 will have both decisions as soon as they come down expected just after 7:00 a.m. we'll bring it to you on air and online. then in the evening we'll go in- depth into the decision at 8:30. san francisco police are investigating a home invasion that ended with three people shot including one of the intruders. police say three armed men broke into a home on elmira street. this is in the city's bay view neighborhood. a man, a woman and two children

were inside. both adults were shot. the woman has life threatening injuries. police say the man was able to wrestle away a gun from one of the intruders and shot him with it. that intruder is in critical condition. >> we believe one of the victims in the house somehow got ahol a -- ahold of the gun and shot the suspect. >> his gun? >> his gun, his own gun. >> the intruders ran from the home. this video from a near by business shows three men trying unsuccessfully to break into that very same home just two nights ago. san francisco police are also asking for the public's help in finding a missing teenage girl. gabrielle spagnola disappeared yesterday afternoon. she was last seen around 3:00 on hayes street. gabrielle is described as white, 5'6" tall about 120 pounds with brown hair and brown eyes. anyone with information about her whereabouts is asked to

call police. b.a.r.t. workers are voting on whether or not the take the ne ward a strike. david stevenson live in oakland here with just how soon we'll know the outcome, david. >> reporter: that's right, b.a.r.t. workers are voting in the building right behind me on whether to authorize the strike. as workers vote. b.a.r.t. passengers are anxiously awaiting the outcome. >> i'm able to reach far distances with b.a.r.t. and if that's taken away it's going to take me longer to reach my destination. >> reporter: union's representing some 2,300 workers have been unable to come together over salaries, benefits and pensions.

>> this vote is a tool. we don't want to go on strike. we want the district to sit down and negotiate a fair contract with us and we can put all of there stuff to bed. >> reporter: business groups urged a quick resolution. >> the region can't afford it. it's a huge inconvenience. a huge disruption to a vibrant committee. >> this would be a huge mess. >> reporter: the current contract expires sunday night. b.a.r.t. leadership says there's still time to reach an agreement. >> we want to keep the trains running. we feel there's a deal to be had. >> reporter: they promise to give the public 72 hour notice if a strike is called. >> it will be hard for me to go to school. i do summer school and come all the way from the city. >> reporter: the strike authorization board continues until 10:00 tonight. b.a.r.t. union leaders tell me they will announce the results at 9:00 a.m. tomorrow morning. reporting live in oakland, david stevenson. b.a.r.t.

workers rallied today. union leaders, elected city officials and b.a.r.t. employees all gathered outside the 24th street station in the rain. they noted that a b.a.r.t. electrician robert rose was killed while working on the tracks at that station in 2001. union workers say there wasn't adequate lighting in the station then and that it hasn't been improved since. >> in an event of an evacuation, it's going to be chaos. and the train there's thousands of people on that train. so how do you safely evacuate folks when the lighting is inadequate. >> reporter: this is the first time the union has raised any safety questions. several bay area transit agencies gathered today. ac transit buses will carry buses to the san francisco transbay terminal. solano county's sol tran will bus people into the city.

extra ferry boats will run from vallejo, oakland and alameda to san francisco. and caltrain is still an option from the peninsula but the agency says it's already running at capacity. a teenage girl is in the hospital after a shooting at a muni bus stop yesterday. we told you about this story yesterday. the young man waiting at that bus stop with her was killed. she learned today that the young man had been the victim in a well publicized pit bull attack years ago. >> reporter: that's right, we understand that the girl is still being kept here at san francisco general hospital. we did return to the crime scene today and that's where i learned that the young man the 19-year-old had been victim of violence before as a child in a violent pit bull attack. we do understand that the young man rice you see here this is a photo that we received from one

of his friends. they say that he was a good kid. that he enjoyed rapping. he was going to have a job sometime this summer. and that he had many relatives who were in the area. family and friends put up balloons and candles at the muni bus stop where he was shot along with his 17-year-old girlfriend. they say that was at the corner of middle point and west point roads. at about 1:00 yesterday afternoon. witnesses say that a female driver in a green jeep cherokee pulled up and stopped and then a young man in a gray hooded sweatshirt got out. he opened fire right there. hopped back in the car and opened more fires then drove off. police put down more than 30 evidence markers there at the crime scene. the second tragedy for rice's family. they confirmed that he was the 11-year-old boy back in march of 2005 who was brutally attacked by two pit bulls in concord. at that time his mother talked

a cold war style diplomatic fight started today. russian's president said russia has no extradition agreement with the u.s. today. he called american criticism of his decision on snowden rubbish. snowden is accuse of espionage. kerry and saudi arabia made another plea to russia today. >> we're not looking for a confrontation. we're not ordering anybody we're simply requesting under very normal procedure for the transfer of somebody just as we transferred to russia seven

people in the last two years. >> reporter: intelligence officials say they're concerned snowden might share top secret documents with russia. the gun that killed trayvon martin was shown to the jury today. the officer who arrived on the scene and performed cpr on martin took the witness stand. also on the stand a witness who said that volunteer patrols are supposed to call 911 and let police handle a suspicious individual. gruesome crime scene pictures were also shown that included the body of the 17-year-old victim. a gunman ambushed two california police officers today. the officers were attacked early this morning outside a substation. the detectives were rushed to the hospital where they are expected to recover. at least 200 officers spanned out searching for suspects. security was tightened on all

police officers in california. san jose based company says the $3.1 million in bonuses will keep four top executives in their jobs while the company is being sold off to the highest bidder. the company announced plans to file for bankruptcy protection. lowe's has made an opening bid to acquire 16 of the chain stores. a woman was killed when her suv was killed by a big rig just before 5:00 p.m. in fremont just south of stevenson boulevard. three southbound lanes were closed for hours and traffic backed up for miles. witnesses told the chp the mazda tribute cut off the big rig and the two vehicles crashed. the truck driver was not hurt. this unusual wet weather brought good news to firefighters and those who want to avoid crowds but it's still causing problems in san francisco airport.

california. >> this is my 37th year flying air tanker out of santa rosa. and i really don't recall this much rain in june. >> reporter: but say the pilots make no mistake. when this weather goes away, that will be tomorrow, fire season is right back on. >> with the heat and the little breeze that we're going to have. it'll be right back to where it was before the rain within two days. >> here at sfo rain and a low ceiling caused the second straight day of delays some as long as four hours. i'm consumer editor tom vacar, now to my colleague chief meteorologist bill martin. >> tommy you're right. it is going to warm up as we head into tomorrow. the rain is leaving us. we got rain in june. the last 24 hours there's the cloud cover. you see it streaming in out of the pacific. just a moist flow. a lot of moisture headed our way. originally the models thought this moisture is going to hook

up with upper level dynamics and it's really going to rain hard. some forecasts are saying up to 2-inches of rain. the moisture came in but never locked in any dynamics any lift or anything. the rainfall accumulations were there. but they weren't that heavy. expect in the north bay. i got reports in the genre reports -- in the jenner area up to 2-inches of rain. that's the last 24 hours that's good news though. great news for firefighters right. take a little relaxer here because you know for the next couple of days things are going to be kind of moist and fire danger is going to be down. but the big story in the weather center is now the rain is gone things are really going to heat up. by the weekend, by the end of the weekend we're going to be talking about fire danger again. even though it's going to help, have helped for this type of weather. we have upper 70s and low 80s.

out toward the brentwood area. most of us mid-70s to low 80s. temperatures are going to work their way up. tomorrow morning when you wake up there's cloud cover. see the green here, that's drizzle. in the morning commute, check in with steve, sal in the morning. maybe a little fog in the morning. it's 5:00 a.m. and look what happens. kind of gone. by the afternoon plenty of sunshine. that oftentimes leaves the coast kind of cool with fog right here alon the coast. but in the inland valley, places just away from the coast temperatures are really going to go up. it's not often you see the line go this vertical. this thing is going straight up from temperatures today from the 60s to triple digits as we head into the weekend. so i'll be tracking that closely for you. the five day forecast, there's your tomorrow. mid-80s in the warm spots. mid-60s coast side.

new home prices are rising across the country. sales jumped 2.4%. that is the fastest rise in years. san francisco led the nation with a 23.9% increase in april compared to a year ago. it was a good day on wall street stocks rebounded after the encouraging reports on the economy. the nasdaq was up 27 and the s & m500 was almost up 15 points at the close. president obama is putting a sweeping new plan into global warming. he says he doesn't have enough patient for those who deny the

problem. >> 97% of scientists including by the way some who originally disputed the data, have now put that to rest. they've acknowledged the planet is warming and people are contributing to it. >> he says it's the responsibility for future generations. he calls for subsidies for alternative energy companies and efforts to reduce emissions globally. >> we need an inclusive agreement because every country has to play its parts and we need an agreement that's flexible because different nations have different needs. >> republican critics are denouncing this plan as a job killer. all the president's proposals can be enacted without approval

from capitol hill. a power outage that hit much of california's central coast has delayed the launch of a new nasa shuttle. it was supposed to launch today, but a utility substation failure caused a widespread power outage that also hit the air force base. in vallejo, police are searching for a hit-and-run driver responsible for killing a pedestrian. the driver's car struck the 48- year-old man as he was crossing the street around 10:00 last night. the victim died this morning at a hospital. the driver is described as a white woman in her 60s with shoulder length white hair. the vehicle was a 1991 to 1998 four door ford taurus with faded silver paint. a new development in a deadly south bay fire.

a desperate plea as police search for the man who killed her son. her 22-year-old son was shot and killed after a fender bender in oakland. what police learned from video of the incident, christien kafton. >> reporter: friends and family gathered at the spot where 23- year-old ian nacado was killed. his mother asking anyone with information
