court will release its decision on what's being a contentious and emotional battle since the very first marriages were performed in san francisco nine years ago. tonight we hear from one of the central decision makers. >> tonight our interview with the retired judge on what may be the biggest case of his career. >> judge walker says he's enjoying life away from the federal bench. these days he sits perched high in a corner near the embarcadero doing mediation and judging. but he says the case is on his mind. >> the eve of the supreme court decision what are your thoughts tonight on this historic ruling? any gut feeling about tomorrow?

>> i don't think so. >> what would you like to see happen? >> i don't know that i have any personal wish. >> really? >> no. >> judge walker doesn't like to make predictions says there's a lot of different options. it's the procedural to appeal. he says tomorrow if the u.s. supreme court decides prop eight proponents lack support, then the prop eight would head back to california. >> the governor, the state officials are going to have to make the determination what is the effect of the district court judgment. i think that is a very possible outcome. >> reporter: judge walker says another likely outcome. the high court could appoint

the decision which would allow same-sex marriages to resume in california. >> there will be further proceedings and further litigation i'm sure. this is not the end of the story. it may be a big chapter in this story but it is not the end. >> how would you define your role in what many consider to be one of the most important cases to reach the supreme court in decades. >> my job julie was to be the trial judge tocreate a record. >> judge walker says he did just that laying out 136 page opinion challenging prop eight. now it is in the hands of other judges. he says that's who will ultimately decide this role in this historic case. >> and the judge's personal life had a big role in this case. >> it does. and we will bring you that tomorrow night when we go in- depth on prop eight on a ktvu

special beginning at 6:30. the biggest gathering will be in san francisco's castro district which has been a focal point in local gay history. paul chamber social security -- paul chambers is live in the city where there will either be a big celebration or a big protest. >> reporter: in a few hours we will know what the supreme court has decided on prop eight. there will be as you said, celebrations or protests there. they have barricades on stand by regardless of the decision. >> for social issue of our day -- john lewis and gafney have been together for eight years. they decided to take their relationship to the next level. now they hope the highest court will allow that light to many others. >> we will actually be the lucky 13. lucky 13th state in the union to allow marriage.

the way. i'm paul chambers, ktvu news. supporters of same-sex marriage are planning events around the bay area. in san jose lgbt activists are planning to meet at city hall at 6:00 p.m. in oakland the gathering is planned for 6:30 p.m. on telegraph avenue. and in concord the rainbow community center on willow pass road is holding a gathering. those who support proposition eight say there's more at stake than who is allowed to get married. if the supreme court bans same- sex marriage that will affect the process. >> do we have a democracy when the people's vote is rejected. >> proposition eight passed from 52% to 48% back in 2008. supporters of the amendment

together on pensions. >> this vote is a tool. we don't want to go on strike. we want the district to sit down and negotiate a fair contract with us. and then we can put all of this stuff to bed. >> reporter: a strike would jeopardize travel for 400,000 daily riders. business groups urged a resolution. >> the reason you can't afford it. it's a huge inconvenience, a huge disruption to a vibrant active economy. >> this would be a huge mess. >> reporter: the current contract expires sunday night. b.a.r.t. leadership says there's still time to reach an agreement. >> we want to keep trains running. we feel there's a deal to be had and so our focus right now is on keeping the negotiations going. >> reporter: union leaders say past histories show a contrast breakthrough usually comes down to the wire but they promise to give the public at least 72 hours advanced notice if a strike is called. it'll be hard for me to get to school. i do summer school and i come out the way from the city. >> reporter: b.a.r.t.

officials say they'll anuance akland, david stevenson, ing at ktvu channe2 news. a perfect storm of transit troubles is brewing in the bay area. ac transit union workers are reminding riders they have authorized their own strike. their contract ends on sundays the same day as the b.a.r.t. union's contracts. ac transit workers say they are concerned that management is talking about helping stranded b.a.r.t. riders. ac transit and the union is working with a state mediator to reach a contract. you'll find the very latest transit information with live cameras and live drive times for your commute. new at 10:00, the mother of the 19-year-old east bay man who died last year is suing monster beverages claiming the company's energy drinks led to the heart problem that took his life. alex morris of piedmont died last july. he died from cardiac arithmia.

she contends monster fails to warn consumers of the risk of the caffeinated drinks. the family of a 14-year-old maryland girl has also sued monster after their daughter died from cardiac arrest. should it be illegal for people to live in their cars in palo alto. that's the question before city leaders tonight. police say if the proposed ordnance is approved they would only respond to complaints.

kayaker who had a close encounter with a suspected great white shark. that's where heather holmes is live after speaking with the man ow her the bite marks on his kayak. heather. >> reporter: the man was out kayaking with his father-in- law. if you're familiar with this area he wasn't far from pedro point. when he suddenly saw this huge wall of water then felt this massive thud. >> almost instantly it came up straight underneath me. >> reporter: mike said the shark hit his kayak can such force it nearly pushed him into the ocean. and it's all he could do to stay inside the kayak as the shark continued to bump in front of it. >> it turned into man versus beast. i was holding on with every bit of balance i had. >> reporter: lanceburg says it was about 16 seconds before the shark finally let go of the kayak ripping a nylon strap in the back. >> that was one of the most

pacifica, i'm heather holmes. new at 10:00, parents rallied outside a school board meeting tonight upset about a decision to try to relocate a charter school. parents are protesting the decision to move the center to a joint location on the campus of wood middle school. parents say they're worried the move will hurt the middle school that is ranked among the best middle schools in the country. the charter schools in oakland appears dim. following the vote by the board of education. back in march the oakland unified school board voted to revoke the charters siting mismanagement of the school's mismanagement. then the school district voted the school could remain open. the alameda county board of education voted 5-1 to uphold oakland unified decision to revoke the charters. >> the first thing that oudc is

saying is allegations. it's saying that we are basing this revocation off of allegations. what is the meaning of allegations? things that have not been proven. >> administrators tell ktvu they will appeal tonight's decision and said they would unveil details sometime tomorrow. the berkeley city council made history tonight at its meeting. members confirmed the appointments of the first asian american fired chief in the continental united states. he has served as berkeley's intern chief. he is the a 23-year-old veteran working his way up from a firefighter paramedic. members of a slain 17-year- old -- family members of a slain 17-year-old boy say they are outraged. and the jury got it right and the real killer got away.

>> this was 44-year-old randy williams soon after he was arrested by vallejo police. they said he shot and killed 17- year-old gary white jr. in the street on robels way and vallejo a few days after thanksgiving. >> the kids came way closer to a wrongful conviction than any case should be. >> reporter: the killer was williams 19-year-old son nigel who called him to pick him up. the younger williams even wrote a confession. >> in his confession he said he wanted to come forward of doing the right thing. that he had been haunted of visions of shooting larry. >> reporter: the defense said williams was never at the scene and it was his girlfriend who came to pick up their son that night. the defense says there was no gunshot residue on williams hands or his clothes.

but tests were positive for the clothes on his son and girlfriend. the prosecution and police did not return our calls for comment. >> prosecuting the wrong person when there's not a single shred of forensic evidence that points to his guilt may give temporary piece but it certainly won't give justice. an antioch man is being held on $235,000 bail accused of kidnapping his own daughter. 23-year-old joshua benton faces several charges including child endangerment. he snatched his 11 -month-old daughter after arguing with the girl's mother yesterday prompting an amber alert. he turned his daughter with relatives then turned himself to police. police are searching for a

missing teen. her name is gabrielle spagnola. she was last seen wearing blue jeans and a blue jacket. anyone who may know of her whereabouts is asked to call police. several people were hurt tonight in an accident involving a trolley and two cars in san francisco. no one on board the f market trolley was hurt but three people in vehicles suffered minor injuries. we're told two cars collided on market street near guerrero street setting off a chain reaction. there's no word on what caused the crash. the wet weather is being blamed for a car accident that knocked down a small palm tree. the accident happened on lake park avenue. police say the car hit some standing water and hydroplaned then crashed into a tree. the woman's injuries did not appear to be life threatening. we got some light scattered showers throughout the day

today. more rain fell today than yesterday certainly. in the north bay over an inch in many places. santa rosa came in at 1.6- inches. the last 24 hours, mountain view and then down to san jose just .2 to .3 of an inch. so it was a rain event as best. clouds are starting to clear up. morning commute looks to be maybe cloudy but dry. it is warm outside right now. it's 67 right now in livermore. that's warm right. with cloud cover and this time of night. 69 in san jose. tomorrow is going to be a warmer day that's the weather headline. as we go into the next few days temperatures are going to increase until we get into the triple digits. we'll have the computer model. we'll run that through the weekend and we'll look at the specific forecast high for your neighborhood tomorrow and any warming that's coming. we'll see you back here. the oakland a's returned to a newly refurbished clubhouse for their game against the cincinnati red.

one is identified as derek hunter. the second is not named because he is 14 and a juvenile. the shooting left a 19-year-old man dead and 17-year-old girlfriend in critical condition. jana katsuyama spoke with the young man's father who said his son will be greatly missed. >> reporter: overlooking the city at a bay view stop. family and friends put balloons and candles out where rice was shot and killed yesterday. rice's father said he was near by and saw his son on the ground. >> i guess i was just shocked. >> reporter: rice and his 17- year-old girl friend were sitting at the bus stop around one clock. a green jeep cherokee pulled up to the bus stop. >> he got off the car opened fire and drove off. >> reporter: in march 2005 when

rice was 11 years old he was the victim of a brutal and high victim attack by two pit bulls in concord. at that time his mother spoke to ktvu. >> he said i love you and thanked god that he is living. like i said he's a strong kid. >> reporter: rice was not in a gang. they said he was about to start a summer job and had a lot of relatives in the neighborhood. his father says he will miss his only son. >> he's a very strong kid. i will miss his drive, his will power. you know. his respect, his structure. >> reporter: tonight staff here at san francisco general hospital tell me that the 17- year-old girl is still here. and she is in critical condition. jana katsuyama, ktvu channel 2 news. in the east bay police are on the look out for a stolen van that belongs to the contra costa water district. officials say the van was stolen while parked in a

detectives in the south bay are now investigating the deaths of a 61-year-old woman. ktvu's patti lee is now in sunny vale where the woman's neighbors are stunned to learn what they thought was an accident is now a homicide. patti. >> reporter: tonight we learned that this house was deliberately set on fire and the woman found inside is now considered to be a homicide victim. but when we asked family, friends and police about motive no one could come up with a reason. flowers and notes lined the outside of this sunny vale home destroyed by an early morning fire last week. inside firefighters found the body of elizabeth helen

people. begging them to please please come forward. >> reporter: investigators continue to review evidence in the scene. they're still trying to determine if the crash was an accident or possibly some kind of set up. jurors in the george zimmerman trial saw photos of trayvon martin's body and heard testimony about the crime scene. a crime scene investigator spoke out on the case. zimmerman has pled not guilty to second degree murder claiming self-defense. a deeply divided supreme court struck town a key element of the 1965 voting rights act designed to support the rights of minority voters. the justices voted 5-4 to no longer mandate that four parts that all or parts of 15 states with a history of voter discrimination get voter

there are questions tonight about what caused this fire at a commercial building today in los angeles. the fire in south los angeles was first reported around 1:30

this afternoon. the building housed a furniture wood working shop. it took crews about an hour to put out the fire no one was hurt. an ember from the fire started another fire about a block and a half away but crews were able to put that fire out quickly. some where between zurick and new york city more than $1 million vanished. the cash was stashed in the cargo hold of a swiss air flight saturday. 12 packets of $100 bills totaling $1 million. the president obama says this country's national interest must come first before the pipeline is approve. >> our national interest will be served. en if this project does not significantly exacerbate the problem of carbon pollution. the pipeline would carry

happening now texas republicans have just passed new abortion restrictions that are expected to close almost every abortion clinic in the state. this is a live picture from the state legislature in austin. the bill bans abortions after 20 weeks and requires all

procedures take place in a surgical center. that will shut down 37 of the 42 abortion clinics in the state. wendy davis had tried to filibuster the issue but after 13 hour filibuster she was cut off by another legislator who said she had gone off topic. a neighborhood hit hard by burglaries wants cameras on the street. some homeowners say they're ready to take matters into their own hands. the sub family has an elaborate set up of cameras around their home in san jose but have had packages stolen and break-ins. >> even having the security cameras and having an alarm system which we thought was a deterrent. apparently not. that's not happening because they're getting more and more brazen now. >> reporter: the family has joined many others in the neighborhood asking the city to allow private cameras on street poles or to have police

monitored surveillance. >> we are just asking what is there. this is something that's happening every week. every week we're having a couple of break-ins. >> reporter: they've approached city officials and were told privacy was an issue and that private cameras or even signs could not be put on public property or facilities. >> that way it can lead to a lot of confusion and can end up having counter productive results. >> it's still difficult for us to figure out who that person is. >> reporter: the neighborhood agrees but will keep pushing for city supported surveillance system. >> it's not a good feeling. now if i have to leave for two days i'm unnerved about it. >> reporter: based on a formal request by rose herr era, the city is researching compromises on surveillance systems can be reached. san jose is trying a new

tactic to deal with homeless encampments. more park rangers. san jose officials believe there are 10 to 20 encampments like this one. the water board approved the money for two rangers and the city agreed to fund two more. they are seeing an increase in calls about racoons. the furry masked invaders like to make themselves at home in attics and crawl spaces. two major pest control companies have fielded 200 calls in the bay area. dwayne tits is ceiling foundation vents and then spray a deterrent to flush out a family. >> they're denning up in people's homes and the mothers try to pick a really good spot. as the babies grow older they're more vocal and they wrestle around and play and

that's typically when the homeowners hear them. titus says he recently had to cut through dry wall in a home in santa cruz to remove a mother and her five babies. in a wet day today, the showers are in. and storm tracker 2 is showing the clouds. there's the clouds and watch everything start to lift to the north toward the evening hours. right now outside it's warm. we've got partly cloudy mostly cloudy conditions. and these clouds will be less evident tomorrow. there'll be less cloud cover tomorrow. the thing i note that's interesting, it's 56, very warm outside. some overnight lows very nice. like in san jose it's going to be in the low 60s. that's as cool as it's going to get. mild to warm kind of muggy overnight conditions. as we head into tomorrow, things start to warm up. you knew that was coming. you still have 62 degrees it's not hard to get much warmer.

temperatures tomorrow are ease he going to -- easily going to get into the eight 0s. it's going to continue to warm each day as we go into the bay area weekend. the computer model at 5:00 a.m. there's the cloud cover. that starts your day then watch what happens. we get to 7:00 a.m. there's a chance for sprinkles. it's not a big deal. it might be enough to slow you down a little bit on the great bridge. then the sun comes out. fog a constant player along the coast. when that fog burns off. watch these yellows and oranges come in. those are your 70s and those are your 80s. reds are 90s. it's certainly warmer than it was today and it will continue. you will notice the heat. the high pressure is coming out of the desert southwest. coastal sections are in the

60s. but we could easily by the bay area weekend see temperatures in the upper 90s, low 100s. this is a pretty dramatic line. it's going to warm rapidly. the warmest spot 88. 85 in pittsburg. 88 in brentwood. 87 in morgan hill. 82 in san jose. air quality is going to start to get a little dicey as the high pressure moves in and starts to put a cap on the environment. fire danger will come up as well but it will be nice. it does take fire danger, helps it out certainly. by the end of the weekend when all this heat kicks in. i suspect we're going to talk about a fire danger. because things are going to heat up real little really fast. it looks like it's going to get warmer and warmer each day. we're going into some real summertime heat here. >> and drying out over the air, the humidity. it's been muggy. >> it's going to dry out a lot. you will notice tomorrow much
