this morning, nelson and other volunteers were in court when the suspect garcia torres was scheduled to enter a plea for kidnapping and murder. the case was instead continued to next month because it will defense is reviewing and waiting to see evidence. >> we wanted to get a plea. we wanted to get this process in place and get going. it's frustrating to see this activity. >> reporter: sierra's mother agrees. she doesn't believe torres will reveal information. no one will step forward until a. >> that's our only hope now since he's not saying anything. >> reporter: sources close to the investigation would not comment directly but acknowledged torres has been uncooperative. legal analysts say the fact he had to change attorneys last year because of a conflict with a trial involving his father is the main reason the court proceedings have dragged on. >> that doesn't softening the blow. it doesn't make me understand

gillman avenue around 9:30 this morning. two were hit in their upper bodies. no arrests have been made. two men were found dead in east coke land -- east oakland hours apart. one was riding his bike when he was shot and killed 5:30 a.m. four hours later, police found another man dead near 648th 6 -- near 648th 648th 6 -- 64th avenue. police have been trying to determine if that was a homicide. news chopper 2 is over rush creek court this. the two alarm fire started around 2:15 and damaged two neighboring homes. one firefighter was hurt but injuries are minor. cause of the fire are under investigation.

returning now to our coverage of the prop 8 decision public works crews in san francisco spent hours cleaning up the castro district. thousands gathered last night to celebrate the supreme court's historic decision on proposition 8 and defense marriage act. that came days before the pride situation. it's only adding excitement to the annual event. a record number of people are expected this weekend. we're live in san francisco with the new edition to the pride festivities this year m. >> reporter: this year's pride festival will feature more police and the national guard. organizers of san francisco's pride festival expect more than a million people at this weekend's event thanks to wednesday's supreme court ruling against same sex marriage ban and act. >> it brings momentum to the

before. >> i've been coming here for years, at least 10 years i've been coming to this beach. never seen this. >> reporter: john was camping here at dylan beach when he saw a large mass at the water line. >> i was like whoa. here's a dead whale on the beach. crazy. >> reporter: for those nearby, the smell was hard to miss. >> it was scary. >> gross, old fish. >> in the spot where the whale washed 77, it's a half mile south of the resort. -- washed up, it's a half mile south of the resort. >> that's part of the course of what happens. >> reporter: according to the marine mammal center, this is a juvenile gray whale and the second time it's wash add shore. it was found last week. samples were taken.

because of the terrain where it washed up there was not a safe way to conduct a test. they had it towed back out to the ocean. a crew will try to figure out how the whale died. it could be tough because it's been decomposing about two weeks. ktvu channel 2 news. governor jerry brown joined by democratic leaders signed a $96.3 billion funding plan. it begins restoring social policemans cut during the recession. governor brown called today a water shed moment for millions. >> it's a big day for school kids and california residents that don't have health care or adequate health care. >> it was voter approved prop 30 which raised the sales tax
