the bart strike moving into day three. frustration hunting. the late night development that is giving some hope this morning. good morning. the morning commute is getting worse. the places you want to watch out for straight ahead. and commuters got up early here in walnut creek. i will tell you why so far the process is going pretty smoothly. good morning, to you. welcome to the ktvu morning news wednesday, july 3rd i'm dave clark. >> and i'm claudine wong in for pam cook. we begin with our top story. continuing coverage of the bart strike. we want to give you a live look at the commute. kicking into high gear. on the left side of your screen there are pictures of the ferry terminal in alameda as one of the boats gets on its way. the on the right side of the screen there is the bart station in fremont and you can see workers out there are getting people on shuttle

becauses that are headed into the city. we've been on since 4:00 this morning. we have seen the traffic getting busier while the lines for special bart buses and bay area ferries are getting long as well. let's go to sal in the traffic center. sal. >> reporter: all right claw deep. this is a look at interstate 880. right now the traffic here looks good. if you are driving on 580 westbound it's also getting busy but it still looks all right. on 80 westbound we have quite a crowd coming in from vallejo. when you do get to the bay bridge it's backed up all the way out to the mccarthur maze. let's go back to the desk. some progress but still no deal. bart and its striking unions met for nearly nine hours over night. tara moriarty is at the oakland headquarters where the two sides will resume negotiations at 1:00 this afternoon. tara. >> reporter: our crews have been here around the clock waiting for word. we finally saw movement just before 3:00 this morning. union leaders walked out.

they were obviously tired. we didn't see any bart officials walk out. we think they walked through another door. the two sides left around 6:30 last night. this is all taking place at cal tran headquarters. sort of neutral found for both parties. before talks union leaders say they needed to see -- here's what a union rep had to say. >> we made some progress this evening. as you can see it's rather late now and we decided we'll make more progress if we get some sleep. we worked very hard together both parties along with a very fine mediators that have been assigned. >> reporter: before negotiations we spoke to bart officials about their expectations. >> i'm glad we're going to have conversations. so we can find a fair contract that lets us both reward our employees for their great work and build the train system out. replace our old equipment. and make it safe for the next 40 years.

>> reporter: a letter from lieutenant governor gavin knew? was sent to both sides urging them to resume contract talks. bart did reach a tentative agreement representing about 200 office supervisors. but not the big unions. meanwhile the strike will go on and this is day three. live from oakland i'm tara moriarty ktvu channel 2 news. time now 6:02. as negotiations go on bart is adding more free buses for commute commuters today. alex savidge is joining us live. he's at the walnut creek bart station now where people started lining up two hours ago. >> reporter: yes, they got here very early trying to beat the rush. and apparently bart has done a good job accommodating the early morning commuters. you can see we've got a couple of buses lined up and those are unfilled buses. and right now there is no line of passengers compared to what we saw earlier. they added bart did seven extra

buses to come pick people up from the walnut creek station. a total of 20 buses coming through here. i am told by bart official here on scene that things should pick up later on. early this morning this was the scene as the line stretched down the block. a couple hundred people were waiting here. the first passengers told me they got here in line at 3:30 this morning. trying to snag one of the seats on board the buses into san francisco. and while this is all a frustrating process, many commuters are trying to be kind to one another. we saw one man that let a woman go ahead of him in line and take the last seat on a bus. he told me he was just fine waiting for the next bus. >> i have a 12 hour day nonmatter what i do because of the shuttle. there is no sense of getting upset. is >> reporter: now a couple hundred yards away from here from where the buss are picking up, there is a group of striking bart workers who are

walking the picket line right now. with no trains in service, bart is run sag total of -- is running a total of 80 buses into the city. picking up at fremont, dublin, pleasanton, west oakland, and here in walnut creek. all those buses can only carry 4,000 or so commuters. meaning if you want a seat, you'll need to show up early. despite the scene you see behind me here, the line is short. just a couple dozen people. the bart spokesperson here tells me don't let this deceive you. life in walnut creek alex savidge ktvu channel 2 news. some commuters are hoping for shorter lines at bay area ferry terminals this morning. katie utehs is live at the alameda ferry terminal with a look add how things are shaping up. >> reporter: when we arrived around 5:30 the line wrapped from the end of the awning here all the way down the dock and

the first boat out of alameda just took off with a full load of passengers. and this is the second ferry that is lining up. so far going rather smoothly. one woman i spoke with said this strike has caused her to change her commute plans permanently. >> this is my second day doing this. and yesterday i found it so pleasant that i'm not going back to bart. >> at all. >> they can keep it. i won't go back to bart. >> reporter: her commute was an additional 40 minutes longer compared to her usual trek into work. san francisco bay ferry has added additional vessels and says it's transporting around 18,000 passengers per day. that is more than double the amount of passengers which is 6,000. the issue with the ferry has been parking. the lots fill up fast. come out here back live. they have pulled in another vessel. that will load up. there is not much of a line to speak of at this point.

so things going rather smoothly. i'm told the parking lot will be completely full by the mid rush of the morning commute. coming up next in our live report i will tell you about an option to beat that cycling crunch. live in -- the bart strike doesn't just make the commute longer. it also costs more money to park. once drivers get to san francisco. drivers say some private garages are raising their rates to take advantage of the new demand. howard street garage went up $5 between monday and tuesday. price hikes range from $10 to $15 a day. san francisco doesn't regulate the rates at private garages but tickets for those expired parking meters they went up too this week. now it will cost you $74. the highest fee in the country. for constant updates on the commute and the bart strike including what you need to know

about alternate routes and services go to our ktvu home page. click on the bart strike tab. new this morning a bouncer has been rushed to the hospital after being shot at a bar in santa rosa. it happened around 1:15 this morning. anyone with information to contact santa roe sap police. the combination of extreme heat and the holiday giveaway may make driving dangerous. make sure you have plenty of water with you and stop often. they warn that dehydrated or tired drivers have slower reaction times. starting tonight chp officers will be everywhere looking for speeders and impaired drivers. the holiday enforcement period continues through midnight sunday. time now 6:08. sal, the sunol grade how is it doing? >> not well. we do have a crash there dave

and claudine. southbound 680 at durham road. injury crash here you can see the traffic is is very slow. some people are bailing and using mission boulevard. which is not all that bad of an alternate route. just to get around the problem. the crash is at durham. if you can get yourself on the freeway after durham, you will be doing yourself a favor. it's not doing very well at all. let's move along and take a look at the commute on westbound bay bridge. that is backed up for a 30-40 minute delay already. it's crowded. although it's moving in the fast track lanes. it's clearing up a crash at northbound 101. that is being moved out of the way as well. i would use 280 instead of 101. we do still have very high conditions inland. especially parts of mendocino county and lake county. but by the coast there is a lot more fog today. that heat advisory will go through thursday for some. big thunderstorms just blowing up yesterday. if you're up there if you have travel if you're up there you

know what i'm talking about. very high clouds are close to us. but it's really close to sending in a lot of high clouds for us as well. 50s and 60s. fog has been moving up the marin and sonoma coast. it's mainly hanging around the san mateo and santa cruz coastline. there is a lot more there today. very, very warm to hot conditions. it won't take long to warm up for some if you don't get any fog or hardly at all. there is plenty of low clouds around. look at the thunderstorms they have really picked up along northeast california. and also in reno. i might see a repeat performance of that. fog a lot more fog or low clouds. mostly sunny. it couldn't take much to go partly sunny. it's really hot up in lake county. clearlake 107. i know kolb or middletown around 106. vallejo 85. still 100s. pittsburg is out there.

you should still expect delays. at 6:14 let's go back to the desk. we are following developing news for you out of egypt this morning. protest continue in cairo after president mohammed morsi insists he will not step down. even as a deadline to do just that is less than two hours away. take a look now. these are live pictures of cairo's square. it is packed in there. at least 16 people were killed in clashes over night at cairo university between opponents and supporters of the egyptian president. the military has given him until 8:00 this morning hour time to bow to the demands of millions of protestors and resign. but president morsi went on national tv last night and said he is refusing to step down. a couple in canada has been arrested for plotting a terrorist attack like the boston marathon bombings. investigators say the suspects john stewart and amanda marie planned to lead and detonate

three pressure cooker bombs at a government building in victoria, british columbia on monday. which was canada day. time is 6:15. both republicans and business owners claiming a victory now in the fight against the president's health care law. as ktvu kyla campbell reports from our washington, d.c. newsroom the white house unexpectedly announced a delay for one of the key parts of obama care. kyla. >> reporter: businesses that employ 50 or more call-time workers will get an extra year. the treasury department is is delaying the central requirement until january 1st of 2015. businesses had said the reporting requirements were too complex and they are getting more time to better understand their responsibilities. republicans say this move shows just how unstable obama care is and they want it repealed but

that won't happen with democrats controlling the senate and president obama in the white house. some are frustrated the individual mandate still takes effect this coming january. that means most people will have to prove they are covered and some argue if big companies get to avoid that obama care requirement, why can't the little guy? just how many uninshired people know what is -- uninsured people know what is expected of them coming up next. a school teach sore scheduled to be arraigned today on sexually assaulting at least 12 former students. 45-year-old joseph andrew martin has been charged with 91 counts of mollless station. he most recently taught at wood side elementary school in concord. martin remains in jail on $10 million bail. the white house says it will have a response to an online petition about tesla sales plans in the next 30

days. tesla has stores and galleries in 13 states in washington, d.c. where it sales directly to customers. but several states want to ban those and require all sales to be made through dealerships. more than 100,000 people signed the petition in support of tesla. time now 6:17. san jose allen rock park still closed because of extreme fire danger. yesterday temperatures at the park hit 100 degrees. some of the neighbors who worry about visitors may be starting fires say they support that energy closure. the park has been off limits since sunday. east bay regional parks will stay open for the fourth of july holiday. park workers have been threatening to walk off their jobs tomorrow and on friday but they reached a tentative agreement. union members are scheduled to vote on that contract today. it includes pay raises also an increase in pension. workers and managers with ac

transit go back to the bargaining table today. since the bart strike began ac transit has been working on an extended contract. they are trying to negotiate a two deal but the two sides are at odds between pay and safety. a spokesperson says there has been slight progress in the talks over the past few days. the union says it will give a 24 hour notice if they decide to call a strike. well let's go now to sal in the traffic center. talking about that sunol grade. still not looking great. >> no, it's not because of a crash. just down the road you can see the traffic is very slow. heading south even the car pool lane is effected by this multivehicle injury crash. and it's backing up now into pleasanton. people are bailing off the freeway here scene trying to get on to fremont city street. if you are driving in fremont you should give yourself extra time. i would still say 880 is the

best bet there. let's move along and take a look at the commute here at the toll plaza. it's not all that bad. as a matter of fact if you are driving through. we're talking about highway 24. westbound 24 after the caldecott tunnel. very slow especially in the right lanes trying to get on to 580 westbound to transition to the bay bridge. so when you get out of the caldecott you will notice the two right lanes begin to slow all the way down to that mccarthur mini maze there. there is a lot more fog. that is for sure. but there is not much of a breeze. at least some of that fog some inland areas last night were a little cooler on the lows pap lot more fog. high and mid level clouds continue to get close off the coast. it looks like they will miss us. big thunderstorms up in the sierra. it has just been blazing hot. that heat warning will continue until thursday. i think things calm down a little bit. big time thunderstorms in the

mother load. yesterday probably a repeat performance. so if you are heading up there or up there watch out again. for us that fog is working its way up the coast. so 60s. a little cooler on some of the lows. no doubt about it. yesterday was upper 60s and 70s. a lot of fog. a lot of high clouds. but temperatures inland will still be really warm. those tomorrow thunderstorms they will calm down now. there is a lot of tropical clouds to the south. fog mostly sunny. it wouldn't take much to go partly cloudy. cool to hot. if you're up in lake county it's just crazy hot. 60s and 70s now. i think around the bay. some inland temps will come down a few degrees. it will take another day or two before others get in on that cool down. there is a lot of fog out there compared to the last couple of days. another huge difference between the coast and inlands temps. it does look cooler out to everyone. time now 6:21. firefighters a real lifesaver. rescuing a kitten in a burning

welcome back. time now 6:24. the amount of money that striking bart workers makes still a major sticking point in the bart strike. here's a break down of how much transit workers make. the average union employee earns about $71,000 a year in wages plus overtime, benefits, and retirement. while some frustrated bart riders say they find et hard to sympathize with bart workers. makerring this kind of money. the union says workers have valuable skills that are hard to replace. >> they are not wealthy. they do not have extraordinary benefits. ordinary working people who get up every morning and make the trains run on time. >> the minimum educational requirement for train operators and station agents is a high school diploma, a ged, or the equivalent. bart says its train operators make a base hourly wage of

$30.22. compare that to new york city subway operators earning an average of $31.80 an hour. in chicago $31.31 an hour. in los angeles the metro train operators earn $22.79 an hour. this morning we are getting a look at video of a fresno firefighter rescuing a kitten from a house fire. >> i look down and can see the cat shining in my spotlight. i look back and that is when i saw the cat and caught him. >> he poured water on the kitten, gave it oxygen and slowly massage the it back to life. >> it's a pretty cool thing that we were sable to help the kitten out. i really hope that cat is being loved. >> it looks like he is doing well. he is known for his love of

animals. the kitten has been returned to its owner. 6:26. let's head over to sal who is watching a couple trouble spots for us this morning. >> we will start claudine with the sunol grade and traffic is going to be slow. heading south. there is a crash on the sunol grade southbound on 680. the traffic is very slow as you can see southbound 680 is going to stay slow as you drive down to the fremont area. this is because of a crash near durham road. so one of the things you can do is get on the freeway after durham if you can swing it. the traffic is going to be busy. and it's stop and do. let's go and take a look at 880 northbound or actually this is a traffic on mission boulevard trying to get to 880 northbound. a lot of slow traffic. now let's go to steve. thank you. we have a much bigger fog bank today. that is for sure. there will be some cooling especially around the bay side.

strike. southbound 680 we will start here. this is a trouble spot. it has been there for a bit. and traffic coming down out of pleasanton to fremont is very slow. even the car pool lanes is slowing down. one thing you can do is use 880 as an alternate. westbound traffic is backed up along the berkeley curve to the bay bridge toll plaza. 30-40 minute delay already. let's go back to the desk. it's day three of the bart strike. both sides met all night. the almost nine hour meeting ended just before 3:00 this morning. tara moriarty joining us live outside of the oakland meeting center. where talks will resume again this afternoon. tara. >> reporter: our crews were here around the clock. we have been up all night. simply waiting for word and just before 3:00 this morning we did see some movement. bart union workers walking out of this building here. looking very sluggish. extremely tired after trying to hammer out a deal.

bart officials left through a different door. we didn't get their reaction. these two sides met around 6:30 and we were talking for nine hours. this is all taking place at cal tran headquarters. before the talk union leaders say they needed to see more movement on management and pay and safety issues. here's what a union rep has to say. >> we made prom guess tonight. mediator asked us not to speak to the press. we worked very hard and we will continue to work starting at 1:00 tomorrow. >> reporter: now bart did reach a tentative agreement with a small union. representing about 200 office supervisors but not the big unions. >> that is a great step forward. they have a tentative atreatment with us on the major economic conditions. and they're going to encourage the members to report back to work. we're looking forward to having them. >> reporter: a letter from gavin newsom and the state

insurance commissioner was sent to both sides today. again at 1:00 this afternoon the two sides will come together. meanwhile commuters brace for more chaos as day three of this strike kicks in. live from oakland i'm tara moriarty. happening now the commute is of course under way and it is expected to be another day of gridlock. bart offering free charter bus service sat five of its stations that go into san francisco. you're taking a live look at the walnut creek station. there are several buses waiting to pick them up. about 200 people have been waiting in line there. that is not the only spot commuters can catch a bus. they can catch a bus in fremont. janine de la vega is live there to explain how many buses are being put into service and how long this commute is taking for some riders. janine. >> reporter: we're here right on civic center drive. and there is no line. the only wait that people have here they are waiting for

people to come [ inaudible ] there is some bart employees helping to direct traffic. it has taken these buses for the last two days and taken about 1.5 to 2 hours to get into san francisco from free on the. the first bus left shortly after 5:00 a.m.. the buses are located about a half a lock away from the fremont bus bart station. things have been running smuttily. bart has been monitoring which cities have had the most need and placed more buses there. so here in fremont they have ten buses. in walnut creek there is 20. at dublin there is ten. and west oakland they have 32. one commuter told us despite having to get up early, she is pleased with the charter bus service. >> i think it's wonderful. the service is really good.

they can stay on strike. >> how long has it been taking to get to san francisco? >> about an hour. >> reporter: to san francisco? close to an hour? >> yes. yesterday was about an hour and ten minutes. >> reporter: normally bart handles 40,000 passengers a day. the charter buses can serve only 2 how long to 4,000 people -- 2,000 to 4,000 people. buss will be available until 8:00 a.m. at the east bay stations. but if you want to get a seat come before 7:30 a.m.. there are strikers but it's been pretty peaceful. again the only wait is really waiting for the bus to fill up. all right reporting live from fremont janine de la vega ktvu channel 2 news. >> thanks so much. the bart strike could mean an increase in air pollution. the strike could result in

chronicle they were ordering food when they suddenly ran to the freezer at the back of the restaurant. possibly because they felt threatened by a third party. when two employees went to check on them, one of the suspects opened fire. killing both workers who are identified as kenneth bradley and jose santa maria. what they are saying that this does not aear to be a robbery. >> witnesses were in the restaurant. employees in the restaurant. and patrons that stayed around. met with investigators. met with the officers that arrived. provided information. and as well as the business had good video surveillance. >> reporter: thaw is how police were able to apprehend one suspect. mean tile this morning oakland police holding community meetings to adjust the -- that goes from 8:30 to 9:30 this morning. it is for lake shore, lake park and grand avenue business

owners. another meeting being held at 7:00 tonight. this is for business owners from the grand lake neighborhood. now police are also looking for a second suspect this morning. but not released any information about the person. it's also being reported that the alameda county prosecutors have until the end of the week to decide if charges will be filed. in the newsroom brian flores ktvu channel 2 news. time now 6:38. the power is back on for thousands of south bay residents that lost their electricity in the heat. about 95 hurricane customers were effected. mostly in san jose and campbell. the power was restored to most of them by last night. about 88 customers in san jose still have no power. pg&e by the way is asking all customers to conserve energy. let's head right out to sal. i know we have problem areas. we expected a tough commute. anything that you know complicates that further not great news. >> yeah. either one of the things we've had is a couple different crashes. for the most part we have a lot of slow traffic. especially in the east bay. highway 24 westbound here in

lafayette looks good. in fact, it's going to look good until you get closer to the tunnel. then you will see slow traffic there and very slow traffic getting down the bottom of the hill. 880 and interstate 80 slow also approaching the bay bridge. there is a big backup at the toll plaza. slightly worse now than it was yesterday. it's about a 45 minute to one hour delay before you make it on to the bridge. and this morning's commute on the san mateo and dumbarton bridge a little bit busy. it's not stop and go but it's definitely busy 880 southbound is a little slow. and no trouble right now in santa clara valley on all the freeways. 01, 85, and 87 included. let's go to steve. well, from there is a much, much bigger fog bank. over night lows were running a little cooler. a lot of high clouds continue to get oh so close. up in the sierra nevada or offshore. the fog is definitely ramped up

here. still for inland areas and thursday you get to lake county and vacaville out to the valley santa clara valley it's hot. but there is a bigger fog bank. just not really much of a sea breeze yet. until we get the combination of the two. some inland areas will continue to be hot. i will bring temperatures down into san francisco into the 60s instead of the 70s. big time thunderstorms yesterday up in the sierra nevada. although did not effect reno. 105 yesterday in reno for a record high. tahoe was 90 degrees. for us we have a lot of fog and low clouds. 3:s an the temps. or 50. some of that fog needs to come a little more inland. it did make it to the oakland berkeley hills. fresno had a low of 78 this morning. all time high minimum temperature. waco, texas was 58 this morning. the coldest july low ever.

fog is around. maybe a few high mid level clouds. there is more fog coming up. big thunderstorms yesterday. a lot more in the way of low clouds and fog. clearlake blazing hot. i did bring some of the temps in. there was a little bit of a breeze by yesterday afternoon. vallejo cooled off a little bit. i think that trend will continue today for those around the bay. it's just well inland we will still be baking here. by the coast it could be down right cold and foggy for some. cooler for all as we head to the upcoming weekend. 6:42. the bart strike causing all kinds of commute problems around the bay area. coming up in ten minutes how fourth of july celebrations in san francisco may be effected. the line at the alameda ferry terminal is wrapping all the way around the parking lot.

behind the curve. at least an hour delay at the toll plaza. at this point it only looks to get worse. another traffic update is coming up. people are lining up to try top get on board a ferry and over the past two days there has been few problems with parking. katie utehs is live at the alameda ferry terminal where people are being encouraged to ride their bikes. katie. >> reporter: absolutely right. you can see this horrendous line behind me. it wrapped all the way around the parking lot. those people are snaking their way around to the ferry. it's the third ferry of the morning. they have all been full. it's unclear if all the folks will get a seat on the ferry. as they walk by they are noticing another option to beat the parking crunch that has been here. and that is free valet bike parking. >> why walk up there when we can ride up to the terminal and we'll watch their bikes. we only had ten bicycles the

first day. and then you know nody about it. and it doubled yesterday. >> reporter: at the ferry terminal there is free bike parks. it's being offered because of the ongoing bart strike. the ferry system has been a popular option for people. around 18,000 took san francisco bay ferries yesterday compared to the normal ridership of 6,000. with so many additional commuters, the parking lots have been filling up and so have the regular bike stands. commuters, regular commuters are excited about the free valet option now being offered. >> i'm grateful they are here today. i think they are saving a lot of people. bike rack space is limited here. so we've been trying to lobby them to get more rack space. >> reporter: most people continue to walk on to the ferry. it looks like this boat might load up before the rest of the lines are able to hop on board.

it is the third ferry of the morning. they have all been full. what we heard is it's the smoothest option. i spoke to a representative he tells me the longest delay they had yesterday was during the evening commute. that was a 45-50 minute delay out of san francisco. and he says they will try to keep up with this demand as long as possible. coming up in our next live report, i'll have more on what he says they are doing to keep up with demand. live in alameda katie utehs. here's a quick look at some of the other top stories. there as the bart strike enters the third day new negotiations sell for 1:00 this -- set for 1:00 this afternoon. they negotiated all night. almost nine hours until 2:45 this morning. we have no details but both sides say progress has been made. we'll get a live report on negotiations at the top of this hour. a bouncer rushed to the

hospital after being shot at a bar in santa rosa. it happened this morning at the epic social bar. police are still out there looking for that shooter. excessive heat warnings in effect until 7:00 p.m.. bay area cities are opening cooling centers to help beat the heat. cooling centers will be open today in several san jose locations. the pleasanton senior center has a cooling center. the king of koa too is testing another type of handcrafted drinks. starbucks is testing root beer, ginger ale. starbucks has recently expanded its juice and tea offering. the company can't say yet if the tests are successful enough to expand to other cities. there are fourth of july deals. jamba juice offering a buy one

the santa clara district attorney office is trying to decide whether to prosecute brooks. he is accused of punching divens and hitting him in the head with a beer bottle. he did need a couple stitches and at first he wanted to press charges but he has changed his mind. the da is considering a couple charges.

marin county fair opens today with a controversial new rule. they recently approved a ban against people wearing gang colors and insignia. they are trying to prevent gang turf wars. the fair runs for five days at the civic center fairground in san rafael. the bart strike may upset fourth of july fans. last year hundreds of thousands of people lined the waterfront to watch this fire works show. more than 128,000 people road bart into the city. now if the bart strike continues, transportation plans will have to change. other transit agencies encolluding muni, cal train, and ac transit will be running sunday or holiday schedules. oakland a's don't think the strike will hurt their attendance. division leading a's beat the cubs last night 8-7. they will play them again today. and it's fire works night. the a's are telling fans to get
