welcome to a brand-new day, it is the 4th of july, i am dave clark. >> and i am claudine wong. we will check your weather and traffic, steve paulson? >> there are some 80s for some of the higher elevations and some rain and lightning, lake county, northern sonoma county, and we see a little bit of cloud cover, lows are mild to warm, there is some fog on the coast, 60s to 100. westbound 792, traffic looks good as you -- westbound 92, also the morning commute is moving well but there is a lot of fog, 601 let's go back to the desk. this is day 4, negotiations broke off late last night after a marathon bargaining session. tara moriarty is joining us live and she is in oakland's

lake merit, what are negotiators doing today. >> they will be meeting and this is a 4th day in a row that these workers will be out there with their signs. -- signs. striking union members were trying to hammer out a deal and trying to reach an agreement. they ended things at 11:00 last night and the two sides will meet again at 11:00 this morning and the union negotiator expressed optimism after last night's talk but now that seems to have disappeared. >> we don't have any comment you guys we are working hard with mediators and we will be back here tomorrow morning very early... >> reporter: the sticking points for this contract pay and costs, they need to be

judiciary shows with its budget because it has to save -- judiciary shows with bunt isn't costs and they will meet for a special closed session at 11:00 this morning. bart management is announcing trains will not be running this 4th of july. they are blaming unions for this strike which they say has caught great description. right now charter buses are pulling up at, at least 5 east bay buses and they picked up people who have to work there. you can pick up free buses to each location and they will depart for san francisco by 8:00 a.m. and trips are scheduled between 4:00 and 6:00 p.m.

the san francisco blue and gold fleet will not be having service. the service is being scaled back and tomorrow they will be available on all routes. ac transit plans on running on a beefed up schedule today. buses will be running so people can get to the america's and they are also resuming service as well. >> many nip is on its normal sunday schedule and they will add extra -- muni is on its normal sunday schedule and they will add extra transportation caltrans will be running on sunday's schedules but they will be running on trains this evening. if you are planning on heading

to these events. and hundreds of thousands are headed to the area over the next few days but there is one silverling for a group of people, stay tuned we will have that story coming up at 5:15. in other news, most bay area cities have banned out use of these items, one of the few local cities where they can buy fireworks legally. >> reporter: that's right, this is the only city in santa clara county where safe and sane fireworks are legal. they will be busy today at this fireworks stand and police will also be busy. they posted they have a zero tolerance policy for illegal fireworks. you must buy safe fireworks and

it is also against the law to buy them here and take them to another city where it is illegal. bomb squads will be out patrolling and they are concerned about all of the dry vegetation and somebody sparking off fireworks. they are reported on the fireworks, most are all ages but they typically impact young children the most. >> most of the victims are children between the ages of 5 to 14, now over in alameda in east palo alto where all fireworks are legal, they will have additional fireworks where they track where gunshots are fired to find out where fireworks are being set off.

spectacular starts at 8:00 and san pablo is planned for 9:30 and we have lots more listed on www.ktvu.com. all you have to do is look for them on the home page. tomorrow with the race set for today, it could put the entire event in jeopardy. the director threatened to cancel the race unless safety recommendations are upheld. andrew bart simpson died when his boat capsized while training for the america's cup. in the meantime a big crowd is expected for the opening ceremonies. festivities start at noon with

a ribbon cutting on the embarcadero. now the opening ceremony begins at 3:00 this afternoon at the america's cup pavilion and that's a 9,000 seat arena. it will include the defending champ, oracle u.s.a. they are getting ready to celebrate the 4th of july and they are out in force on bay highways through the entire holiday weekend and they will be looking for holiday partiers who get out there after having too much to drink. there will be drunk driving checkpoints on several bay areas and roads. let's have a safe driver. done be too sleepily or stay home. i know in all seriously we are

warning you about that and this is also day four of the bart strike. today it is so light since a lot of people have the day off driving to where you need to go i don't think it will be a big problem and a lot of people don't like to drive. northbound 101, approaching the 880 split, getting up to highway 17, that is also moving well and they are talking about the intensity and it is mostly on a sunday, westbound highway 4, between pittsburgh and antioch. we have some rain and we will get a closer look at that in a moment. heat continues and the cloud cover throws higher humidity into the mix. i should say san francisco should be fine and tomorrow

night will be iffy and tomorrow will be hot, i just don't see it getting below 90 degrees. we have a stretch of warmer weather inland and cold and foggy for some over there. looks like it will start a cool down tomorrow and it is one of those where i will have to bow to that west wind but there are signs both forecast models are dropping temperatures. 4 and 5 degrees, it is not cooler, 20 degrees is cooler. this are some selvages and it is a mild warm rain, look at that line of rain going from the deep south all the way into cincinnati. some of the rain that is falling looks like it is falling apart but lake county back to clover dale and -- hillsboro, they had reports of lightning to the north and i

near a circle near the dining hall, it killed her an injured several adult staffers. she was studying environmental conservation and was also involved in the campus radio station. >> you don't always really know w much time somebody has left and she is definitely one of those people i wish i could have gotten to know better. >> now both her parents worked in the bay area. >> tuesday night, the body of a 77-year-old man was found on the floor south of modesto. they found a broken air conditioning unit which was blasting hot air over 100 degrees. an autopsy was conducted and found he died from the heat and other related conditions.

firefighters were called to the district and the building sprinklers had been turned off and neighbors saw squatters using candles. nobody was hurt. they are hoping surveillance video will help capture the suspects. he demanded cash and drove away in a newer acura mbx, if you have any information call police. they are announcing a crackdown by the federal government. they are filed a claim to block the government from seizing that and they would suffer a huge economic loss and they will get this week's bart

strike cutting them at least 100 for people living near the bart tracks. now the bart strike has brought a rare and welcomed break for people who live near the often busy trains. nearly 54 trains go across more than 100 miles of bart tracks from 4:00 a.m. to midnight, but those trains are now sitting in rail yards while they are out there walking picket lines. they can ride the newest wooden rollercoaster and the gold striker is open once again after being shut down for a day and a half. great america arrived on monday because of it and the screaming riders who made a walk to the tracks and the trains have solved the problems. some of you have to get someplace, sal will take care

. time now 6:24, a big sinkhole swallowed a woman's car. her chevy fell into that sinkhole and rescuers got a ladder and somehow she was not hurt. they blame add water-main under the road and they are investigating that. meantime they are making

progress, they are talking about the fire that killed 19 firefighters in arizona. the fire is now 45% contained and destroyed 25 structures. many people are in shelters wondering what happened to their homes a authorities hope to get the evacuated residents back into their homes by july 12th. goats are running loose near san francisco international airport and don't worry they are working. you can see they are cutting the tall grass which prevents fires and the airport is required to keep a clear zone and the goats are able to get closer to the ground than people can near fences. a group of bloggers are calling for a boycott on facebook. they have been discriminated

against and even banning certain bloggers. she said she has been kicked off the site because of what she has written. the freedom writers call on them not to use the website at all today. joey chestnut plans on bringing another title, he already holds the record for heating more than anybody else and tied the record last year. he is expected to beat everybody again since last year's second place finisher ate 22 fewer hot dogs. he will take home $20,000 plus the title. now, sal is there anything to see on our roads right now? >> not right now, dave, a lot

line runs along berkeley also to the trans bay terminal. ac transit said they will arrive every 15 minutes. there will be more cars on the road especially for our friends from the california highway patrol. >> it will be important to make sure you have a designated driver. make sure somebody is there to take care of you. >> now midnight, ac transit said, they will also double to half an hour and that line doubleels to every half an hour and from san francisco to berkeley, they will add 3 extra buses depending on how they go, ac transit said they may add service on saturday and sunday and it will continue. many are calling it the

worst evening commute since the bart strike started monday morning. and in downtown san francisco, cars are backed up bumper-to- bumper as far as could you see. drivers say it took as long as an hour to go just five blocks. they will get on a jam packed bus to the east bay. we have more continuing coverage, go to the ferry boat and bus skids looking for alternative transportation and you can sign up to get an alert on your mobile device. the rangers have already -- dangers have already started in the bay area, take a look at this, this is a small grass

fire which opened at 12:45 this morning. they are looking into the possible cause and crews were able to throw it out and it is dangerously dry out there. at least two businesses were affected, it happened on the road and investigators had to cut a hole through a metal door to get to the flames. the cause of the fire is still under investigation. a dog is in serious condition and the dog ate poisonous meatballs. katie set out to speak to the owner and joins us with new information. >> reporter: we just spoke with the veterinarian who treated oscar and those poisonous

meatballs are scattered throughout the area. he is inside that animal hospital and is he whimmerring and having seizures and they had to pump his stomach because of the poisoning. it happened in the twin peaks neighborhood. when oscar's owner got home he had seizures and snatched up one of those meatballs. she quickly took him to the vet and owners went back and picked up a lot of meatballs from the road and they believe they are laced with a poison called strict nine which is often fatal. oscar's owner is devastated. >> she feels like her child has been poisoned and she hopes nobody else has to go through what she is going through. >> reporter: they will be back to take a look at oscar and his owner wants the word out there could be other poisonings and

they need to know dog owners need to be on alert and those were meatballs potentially laced with poison and they are being sent to the lab to confirm for sure what happened but again oscar having seizures and we should have more video of oscar and his current condition. ktvu channel 2 morning news. the city college of san francisco may be forced to go to another cool now. the commission claimed they are failed to comply with accreditation standards. >> they are transferring on the other schools and it is not something i am necessarily looking forward to. >> students are already protesting. the city college chancellor is vowing to appeal.

they let them know classes are continuing and they can still graduate and their credits will transfer. administrators still have time to make improvements otherwise they have to shut down. they made this statement and i am quoting now, these will be difficult times for the college but this is a time to commit to vitalization so that this institution continues. they have hired a legal heavy hitter. he prosecuted lance armstrong and he claimed it was preventing the oakland a's from relocating to the south bay. how is highway 101.

day 4 of the bart strike and negotiations failed to reach an agreement despite a 10 hour bargaining session and the two sides meet again at 11:00. if you are commuting today bart is coming back and the blue and gold fleet, they are scaling back service because it is a holiday and they are helping people get into the city today. and there are several celebrations from the embarcadero, parades are planned in fremont and redwood city and there is a big one in orinda as well. festivities begin at 11:00 a.m. and san francisco's festivities

are set for tonight. police and the fire department says there is no such thing as safe and sane. here is a new warning about fireworks' danger, janine? >> reporter: here in gilroy you can buy a safe and sane fireworks in santa clara county where it is allowed. the stand is open but you can buy one here if you are not a resident but if you are a resident, you can buy them but cannot take them to another place where it is illegal. they will be issued a misdemeanor with $1,000 penalty or they cited just depend under on the circumstances. in all of santa clara county they will be responding to calls of illegal fireworks and

in san jose they will be responding there as they will have additional crews out patrolling starting at 10:00 a.m. >> i try not to set off illegal fireworks, it is not worth the risk. >> have your friends done it? >> yes, everybody seems to get their hands on it. >> reporter: in palo alto including safe and sane and they have more to show where fireworks are being set off. and back here, it says if you are going to buy safe and sane fireworks there is a 6% fee they will be adding to pay for extra patrols looking for anybody setting off illegal

show, there it is, it is over. fireworks organizers say they have done all they can to keep that from happening again, that fireworks show was over in seconds because the computer made all of the fireworks go off in seconds. last year's embarrassment was viewed millions of times on view tube and last year the people who produced last year's show is doing it for free this year. we want to give you a list of some of the things that is happening this morning. a parade will start at 10:00 a.m. and we have a festival in alameda and we do have a list of more events including
