inland temps out of of the 70s and now more 80s. here is sal. moving along pretty well on the san mateo bridge. it does move well as you drive over to the peninsula. we are getting a little bit of a backup in the middle lanes. let's go back to the desk. we have new information now on the breaking news in san jose we've been following since 4:30 this morning. police shot and killed a pit bull. and officers now say the case is connected to a series of mailbox break ins. paul chambers is in san jose where moments ago he talked to the owner of the dog. what did the owner say? >> the owner is very upset. very shaken. she didn't want to talk bus. let me show you right here. this is still an active investigation. as we said police are still currently investigating mail theft that happened on another part of town. officers went to that part of town at 1:30 this morning.

the suspects actually lived in this area. people gave them the vehicle description and it led them back here. that is when officers conducted follow up investigations and we can see the video here and track that vehicle back to this area. the vehicle's registered owner is on probation. officers conducted a probation search and made contact with a female at the house. officers were talking to a female when a large pit bull appeared and began to bite the officer in the back of his leg. another female living in the home who says she is the dog's owner says there is plenty of signage warning people she has a dog. >> cops are wrong. they should have never been at the house. >> the officer was fearing for his safety and lives and that is when he shot and killed the dog. the officer was trance ported to the hospital with nonlife threatening injuries. this is still an ongoing investigation. we tried to talk to the woman and ask her what was going on. i do know police did take a man

and put him in custody. i'm not sure if he is under arrest. once again it all started with a mail theft investigation from this morning. live in san jose i'm paul chambers. trucks are backing up at the port of oakland and it will be hours before they can pick up and drop off their shipments. tara moriarty is live for us this morning at the port with more on the tragedy. >> reporter: you can see all the trucks already here. officials with the long shoreman's union tell us 1300 of its workers will not be here at work today because one of their own died on the job. we are here at birth 55. that is where daniels was driving her tractor and died.

they rushed daniels to the hospital but she later died. we have not received official conformation of the death. they had no idea the port would not be in operation today. >> i wish it didn't happen. like i said this is news to me. [ inaudible ] >> reporter: but you don't know what you are going to do. will you wait it out until 7:00 this morning. >> i will wait until 7:00 this morning and get the official word if you will. all that sort of stuff and go home. what else can you do? you're not going to go in. you might as well go home. no sense of sitting here. >> reporter: i spoke to a leader earlier this morning that says daniels was always smiling and will be missed. her coworkers are standing down for her for 24 hours which means the port will be back to

business for 7:00 tonight. many on these truck drivers will be forced to turn around and come back here tomorrow morning. what it means is specially a loss of millions of dollars. it is 6:04. the not guilty verdict in the george zimmerman case has led to yet another confrontation between police and protestors in downtown oakland. this follows three straight nights of violence and vandalism. brian flores joins us live to tell us how police plan to catch the demonstrators. >> reporter: it's a pretty quiet morning here in downtown oakland. if you go along telegraph you see businesses like this.

>> reporter: now this was the scene late last night at frank ogawa plaza. dozens of demonstrators clashed with police. this was the third night in a row of wide spread violence and vandalism. but this morning there is criticism federal others. >> because we are so liberal own progressive. allow them to do what they don't do any other place. shame on us and shame on the people that are not doing anything about us. >> another person was taken in because he violated the city's noise ordnance. opd says they believe vandals don't live in the oakland area. coming up a little later on, we will talk about how smearer

channels are not ready to point fingers. 6:06. we have photo of the waiter that was the target of a brutal attack at the restaurant on telegraph avenue during monday night's protest. a masked protestor hit him in the face with a hammer as he tried to protect the restaurant from violent demonstrators. in a couple hours state agricultural workers will do what they can to trap the game have fruit fly. it feeds on citrus, tomatoes, and other plants and can wipe out crops. workers say their treatment plan does not effect humans. they will be coating utility poles and trees. those flies will then be trapped and removed. bart has angered many

commuters with its recent labor troubles. bart has been awarded the highest security rating possible by the tsa. this award could play into current contract negotiations which could lead to another strike next month. the junes say bart has not done inform to address the safety of its workers or riders. let's check in with sal to see how we are looking. >> good morning. right now we are look pretty good on the roads. we had an earlier crash in contra costa county on 680. that has been clear. let's look at 24 and traffic is moderately heavy between walnut creek and oakland. also the morning commute is moving along. and there is a little bit of a backup at the toll plaza. it seems a little lighter than usual in this july people take

time off. if you are driving in walnut creek we mentioned that earlier crash is gone and that cig alert has been lifted. highway 4 i want to show you the road sensors. some of that is carried over to today. the fog has but not the breeze. warmer air is coming in. it will start coming down. it made a pretty good surge inland. by tomorrow we will have thicker fog and keep that into the weekend. as high pressure builds in it squashes it. you can see there is plenty to go around. most locations say cloudy although yesterday made it out to vacaville. a lot of low clouds and fog. has moves outs there is another system dropping offshore.

that will give us the western edge. again we don't get the north, northeast wind. it's the inland temps that will warm up. 90 to near 100 degrees. probably all the way into the weekend. yet coast will stay into the 60s and 70s. very mild for some. a little cooler to the north and far enough inland. the sea breeze which was the key yesterday is going down, down, down. yesterday was 35. two hours ago. still a little bit of a westerly wind. so we don't lose that. you can see from sfo and hayward. 37 in tahoe. 53 sacramento. a little cool for them. there is a lot of tropical clouds that might play. fog, sun, warmer. the fog will burn off sooner. lows are very mild. 60s and 70s and 80s.

their officers feared for her life and had no choice but to open fire on a pit bull. paul chambers is live in san jose where police investigated two separate crime scenes. >> reporter: police say records check show the vehicles registered owner on probation. officers conducted a probation search and made contact with the female inside the home. as they continue their investigation, officers were talking to that female when a large pit bull appeared from a basement and began to bite the officer in the back of his leg. another female living in the home who says she is the owner of the dog says the dog was just doing its job by protecting its home and not

surprised the dog bit the officer. >> if he came on the property, yes. that is what he was there for. >> reporter: you said you had a sign out? >> there is a sign on my gate. you can go look at it. >> reporter: the officer fearing for his life shot and killed the dog. the officers trance ported to a local area hospital and currently being treated for nonlife threatening injuries. we just learned the house where this happened is a police where several residents lived. coming up you will hear from the residents who said they heard the fatal shot. live in san jose i'm paul chambers. happening today the san jose police department is releasing updated crime statistics for the first six months of the year. the department is expected to send out updated information on the gang suppression efforts. this was all announced yesterday on twitter. today's report should include information on everything from homicides to hate crimes. it is 6:32. tragedy at the port of oakland has all but shut down

operation. ktvu channel 2 reporter tara moriarty is at the port where a long line of trucks could be turned away and told to come back later. right tara? >> reporter: that is right. in a half hour typically the trucks would be going into the gates. those gates will not be opening this morning. that is because of a fallen long shoreman. if you pan over to the right you can see this incredibly long line. that is unusual but they will get in at 7:00 this morning. we are told they will all be turned away and have to come back tomorrow morning. we're here at birth 55. that is where coworkers say 47- year-old joy daniels was drives her tractor when she died. this is a facebook picture of daniels that worked just hours before. emergency crews responded to the shipping yard around 2:45 yesterday afternoon and rushed daniels to the hospital but she later died. we have not received official conformation on the cause of death but meantime truck drivers say they had no idea the port wouldn't be in operation today. >> i will wait until can this

morning and then get the official word if you will. all that sort of stuff. and then go home. what else can you do? you are not going to go in. you might as well go home. no sense of sitting here. >> reporter: ilwu local 10 is to which daniels belonged. we spoke to some of the leaders that said daniels coworkers are standing down for her for 24 hours. which means the port will back to business as usual by 7:00 tonight. since pickups and deliveries only happen in the morning, many of the truck drivers will be forced to turn around and come back tomorrow. what means is a loss of millions of dollars to the port and the ships will not be able to off load their cargo today. tara moriarty ktvu channel 2 news. >> thank you. 6:34. more than 80 passengers on ash january that's airlines flight 214 plan to sue.

been the worst nightmare of any parent and for me as they be daphne's grandfather. >> oakland police say they have not identified john webb as a suspect in dauphiness disappearance. the girl was last seen in late june. the family is working with the class kids foundation to help find her. it's 6:35. patients of sutter health hospitals could be in danger of identity theft. last month sutter sent out letters to 4500 patients. notifying them of a security breech. the patients may have had their personal information leaked possibly including names, social security numbers, dates of birth, addresses, and phone numbers. sutter is offering effected patients free credit monitoring services and trying to determine the source of the security breech. the top research universities in the u.s. are being forced to tighten computer security as they are subject to millions of hacking attempts weekly according to the new york times. most of the cyber attacks are

catch the troublemakers. it's pretty quiet but that was not the case late last night. many businesses effected and some are still rebuilding like the men's warehouse located off telegraph. you see the boarded windows and broken glass from a few days ago. police are asking anyone with cell phone video to come forward so police can catch the vandals responsible. but as you mentioned this was the third night in a row of protests. some say compared to previous days. last night's protest was more subdued. many are upset over the george zimmerman not guilty vote. we spoke with many who agree with the protest but questioning about the uptake in vandalism. this has been echoed by many who say they don't want to point fingers but want the violence and vandalism to stop. >> i don't know.

>> frustrating. >> yeah. >> reporter: and former city council president e.g. fascia sayers he blame's oakland's political relationship for not taking is a law and order stance. police say they brought two people into custody. last night one person had an outstanding warrant. the other violated the noise ordnance. many of the vandals don't live in the oakland area. coming up we will tell you why the oakland police say they may consider mutual aid like in previous nights. live in downtown oakland i'm brian flores. it's 6:46. the justice department is not likely to file charges against george zimmerman. the justice department says it will be difficult to prove zimmerman targeted trayvon martin because he was black and prosecuting federal hate crimes requires clear evidence which they do not have in this case. yesterday attorney general eric holder says the department is

looking at all angles before making a decision. four of the six jurors in the zimmerman trial are distancing themselves from a juror that spoke to anderson cooper about the trial. that juror identified only as b- 37 told cooper she believed trayvon martin hit zimmerman first. she says martin played a large role in his own death. four of the other jurors issued a statement yesterday saying her views are her own. ohio man is expected to plead not guilty today to more than 600 new charges in connection with a kidnapping of three women. the expanded indictment against ariel castro now includes more than 1,000 criminal counts including charges of kidnapping, rape, and child endangerment. castro is accused of holding three women captive for about ten years in his cleveland home. his trial is scheduled to begin early next month. a child care worker is due in court today.

20-year-old nicholas lhermine was arrested after the little girl told her parents that lhermine assaulted her. it happened when he was alone inside with the girl. while searching his computer they also found pornographic photos of a 17-year-old girl. two new walmart stores are opening in the bay area this morning. but not everyone is happy about it. walmart neighborhood markets open their door to the public in vallejo and -- the vallejo store will provide 95 new jobs. but protestors plan to be at the pleasanton opening. they are opposed to low wages and walmart's "antiunion action". let's swing it to sal. >> traffic is doing pretty well around the bay area. we've had a couple things going
