"mornings on 2" starts now. good morning. i'm mike mibach. >> i'm tori campbell. dave clark has the day off. let's get a look at weather and traffic. steve? it will be warming up. >> yes, yesterday was the cool day. even though the fog is still there, it's made a surge inland. it will burn off sooner. that means inland temperatures get back in the 80s. 60s, 70s by the water. here's sal. steve, we have a look at the bay bridge coming into san francisco. traffic continues to move well once you get past the delay at the toll plaza, which is about 15 minutes. also looking at the commute on the san mateo bridge, that traffic looks good. back to the desk. we begin with breaking news we've been following in the south bay since 4:30 this morning. more than a dozen police cars

converged on third and empire streets in downtown san jose. police say an officer feared for his life and had no choice but to shoot and kill. ktvu's paul chambers is in san jose with what prompted the confrontation. paul? >> reporter: good morning. this all started to deal with a mail theft investigation. police say it happened around 1:30 this morning. that led them from one side of town to this part of town. that's when officers conducted and investigation and tracked the vehicle back to the intersection, the 500 block of third street. police say the records check showed the vehicle os on probation. officers went to the house and were talking to a female when a large pit bull appeared from a basement and began to bite the officer in the back of his leg. the officer fearing for his life shot and killed the dog. another female living in the home says she's the owner, she

says the dog was just protecting its home and she's not surprised the dog bit the officer. >> if he came on the property, yes, that's what he was there for. >> reporter: and you said you had a sign -- >> there's a sign on my driveway. >> if i kind of pet the dog he might -- i never had problems. i see the dog every day. i don't know what happened. >> reporter: now, that man lives inside the home. he says there are about 12 rooms inside of it. people rent them out. police did take someone into custody, although it's not clear what the reason was at this time. as for the officer, he was transported to a local area and is being currently treated for the dog bite. paul chambers, ktvu channel 2 news. a woman who found a baby abandoned in a gas station bathroom in vallejo says she's willing to take custody of the child. 37-year-old cameron johnson of ukiah said she found the 1-year- old boy crying in a stroller on

saturday so she called police. johnson said she stayed with the baby for three hours until child protective services arrived. police believe the baby was alone in the bathroom for about an hour before he was found. the boy's mother, 21-year-old huckhill was arrested on child abandonment charges. she's pleaded not guilty. the port of oakland is temporarily shut down after the death of a worker. tara moriarty is live at the port with even more information. tara? >> reporter: it's starting to get chaotic here. a lot of these trucks were supposed to make their deliveries and pickups at 7:00 this morning. the gates did not open. we're told they have to come back tomorrow morning. that's because a longshoreman died here and her coworkers are standing down for her for 24 hours.

joy daniels was driving her tractor when she died. this was a facebook picture of her hobefore. emergency crews responded to the hangin shipyard. they pushed her to the hospital. she died. we've not received official cause on the cause of her death. truck drivers had no idea the port would not be in operation today. >> i have sympathy for the family, you know, but still, you know, if they want to have a show of solidarity, have a benefit for the person, raise money at their hall, do whatever they want. don't kill everybody in the port. >> reporter: i spoke to an ilwu local 10 leader earlier this morning who says that the port will be back to business as usual by 7:00 tonight. but since those pickups and deliveries only happen in the morning, these truck drivers, again, are being turned away. what it means is a loss of millions of dollars to the port.

ships will not be able to offload their cargo today. live from the port of oakland, tara moriarty, ktvu channel 2 news. b.a.r.t. has angered many communitiers -- commuters but has been awarded the highest security rating possible by the tsa. this award could play into current contract negotiatns which could lead to another strike next month. the union says b.a.r.t. has not done enough to address the safety of the workers and riders. meanwhile, b.a.r.t. union workers have some potentially bad news for the 400,000 daily riders. those workers are prepared to stay out a long time if they strike again next month. b.a.r.t. management admits it would take months to train enough operators to get b.a.r.t. trains rolling, once again. want to check in with sal, see what's happening on the roads. >> right now we're looking at a new crash reported -- not that

new anymore. we reported it on the morning news, southbound 880 at mowry avenue. that crash is blocking a lane. they are moving to to the side. traffic is slowing down heading down to mowry avenue as a result of this crash. i want to mention that another trouble spot in the east bay is from concord to walnut creek. we had some earlier crashes near the walnut creek interchange this morning. if you are driving on 2 had 242 or 680 that will be extra slow. 80 westbound between pinole and richmond is beginning to slow down. no major problems on the richmond bridge right now. you can see traffic is moving along nicely until you reach the macarthur maze and then it slows down. here at the toll plaza, about a 15-minute delay. not as bad as it could be. just a little bit lighter than usual. if you are driving in san jose this morning, southbound 280, right here in downtown san jose, it looks pretty good. let's go to steve. >> thank you, sir. well, we have a lot of low

clouds around. a little thinner. a little thinner. yesterday had an area of low pressure right off the coast, which not only picked up the fog bank but gave us a howling sea breeze. still a west wind but much, much less than yesterday. temperatures yesterday, a good, 15, 20 degrees below average for some inland areas. we'll bump those up today, 83 for concord after yesterday's 70. 85 for livermore and 78 for san jose really cool. livermore should be closer to 90 this time of year. warm air is coming in. even though the fog is still up there, instead of 2800 feet, it's around 1400 feet. i think some thick fog will be in the forecast. there's still plenty there. low clouds made a march inland. but the low, there it goes. it's done. there's another one dropping in offshore. as it does, that's sending the high-pressure system in the four corners. if it crop -- if it dropped over us, it wouldn't happen.

the high is building in. today is the day where it's on its way. so that's why we're going to see some warmer temperatures. but today's the transition day. tomorrow 90s to 100. sacramento could be 105 to 110. inland temperatures will be warming up friday into sunday, maybe monday. 50s, 60s on the temperatures. mild conditions for some. sitting at 60 degrees. mild lows. without that breeze -- there's fairfield. it's gone from 17, 14, now 8. that's a howling message for warmer temperatures. even though we have a westerly wind, it's just falling apart. 38 in tahoe. 54 in sacramento. that's pretty cool for them. a lot of tropical clouds in the four corners. the high will build in, probably more for the sierra than us. low clouds, more so than fog. it will be warm. a westerly breeze. nothing like yesterday. 60s to 80s. some of these will be pushing

the upper 80s. oakland, 70. 84 pleasanton, 80 mill meet tis, 78 san jose -- milpitas, 78 san jose. still fog, but it will burn off sooner. palo alto, 76. warmer and then warm to hot for inland areas friday into the weekend, coast and bay really not that much change. >> all right. thank you, steve. concord police are searching for a man suspected of stabbing two people at a gas station. police say 21-year-old john glee son junior of -- gleeson junior of concord stabbed two men. police say he was with a group of people who walked up to the victims as they were pumping gas. police say gleeson asked if they were in a gang and then stabbed them for no reason. both men are expected to recover. three suspects have been arrested in connection with a smash-and-grab heist at a jewelry store. police arrested 23-year-old

travion austin banks, 23-year- old alexander and dixon, both of hayward. police say they robbed bennett jewelers at 1:00 yesterday afternoon at gunpoint. the suspects were arrested two minutes later during a traffic stop. jury deliberations continue in the trial of jose montoya. he's one of the men charged in a gang rape of a 16-year-old girl. yesterday, the jury returned a verdict for marcellas peter. the judge ordered that verdict sealed until this verdict. if a verdict is not reached by tomorrow, the first verdict will be read. the areas for the fruit fly being targeted are berryessa, white, tully street. the fruit fly feeds on citrus, tomatoes and other plants that can wipe out crops.

workers say this treatment will not affect people. all right. 7:11. another night of confrontation in downtown oakland. the latest crash between police and protesters. and the link between obesity and hunger. how a gene from your parents could trigger weight gain.

a lot of low clouds around. it's warmer. in fact, you can feel it a little bit. very mild lows and highs. once the fog burns off, i inland temperatures will get back in the 80s. a violent protest in india after two dozen children died from a contaminated school lunch. hundreds of people took part in the protest, at one point setting a car on fire. authorities say the meal the children ate contained a heavy

dose of pesticide used on wheat and rice crops. it was part of a free lunch program at the village school. an investigation is underway. in addition to the 21 children who died, 27 others were hospitalized along with the school cook. happening right now -- some house members are questioning treasury department officials about the president's healthcare law. this is a live picture of the house ways and means committee. as kyla campbell reports, they want specifics on why there's a delay for part of the law. kyla? >> reporter: mike, the house wants answers on how the treasury department decided to give employers an extra year before facing fines but not individuals. we'll take a live look at that hearing and california congresswoman mike thompson is on the panel. we hope to hear from him soon. they will get details pushing off penalties for employers who don't provide health insurance. they won't pay fines in the

2010 -- until 2015. republicans don't think people should have to prove they are ensured. this coming january, when their employers could drop them for all of 2014 without facing fines. this marks the 38th time the republican-controlled house has voted to delay, defund or repeal the president's new healthcare law. what the senate and white house have to say about this delay when i see you next. live in washington, d.c., kyla campbell, ktvu channel 2 news. sexual abuse victims are clashing with the catholic church over a bill that would permit victims to sue their employers in court. it would list the statute of limitations for a year. california allows suing until 26 years of age or until that person realized they were abused. the catholic church calls this bill a step backwards.

a 2002 bill led to hundreds of lawsuits resulting in the church paying $1.2 billion in settlements. we have new information about the lion that killed a 26- year-old woman at her fresno county wildlife work. a recent necropsy shows no signs of rabies. the tiger was shot and killed after the mauling. the parents of the individual say they believe the lion was playing with rough when the tiger broke the woman's neck. pg&e is ordered to pay a $300 million fine for the blast. a new proposal has pg&e shareholders pay for pipe upgrades. eight people die and 38 homes were destroyed in the explosion nearly three years ago. the defense secretary chuck hagel has ordered big cuts at

the pentagon. hagel wants to eliminate between 3,000 and 5,000 top staff members by 2019. that would be 20% of the current numbers. hagel says the cuts would come from both military and civilian staff members but it's not clear if the order would also apply to defense contractors. the boy scouts of america are banning morbidly obese members from their annual jamboree. any scout with a bmi of more than 40 is forbid to attend the camp in the west virginia mountains. an inducks of more than 40 equates to 100 pounds overweight. new research shows that some people are more prone to obesity because of a hunger hormone. a study in the journal of clinical investigations says people who inherit the high risk version of the obesity gene from both of their parents have higher levels of the

hormone that leaves them hungry after eating. researchers say this could explain why some people gain weight faster than others. this is ben bernanty answering questions about the fed's plan to tweak economic policy. in a break with tradition. he released his opening statement before he actually headed up to capitol hill. his written statement, there's bernanke there, said the fed's timetable for reducing bond purchases is not a specific timetable and that policy changes will be based on how the economy performs. checking right now, yahoo!'s stock is up over 6.5%. that's after it announced quarterly earnings after yesterday's closing bill. the adjusted profits were higher than expected but it denounced a 12% decline in ad prices in the second quarter and twimmed the -- trimmed the outlook for the annual revenue.

a fisherman from massachusetts has gone from catching fish to wrestling shark. he spent 45 minutes trying to reel the 200-pound shark in. he ran in the rod and wrestled the shark to shore. now he wrestles about five sharks a day. after bringing them on the beach, he takes a couple of pictures and then lets them go. a mother in louisiana is sharing a surreal shopping experience that could have left

her seriously injured. she was struck by lightning while inside a grocery store. >> when it hit me first, i felt a burn and then an excruciating pain to my thigh. >> lakisha brooks was struck. first responders say the electricity probably traveled through a sprinkler system and truck a metal plate on the floor where brooks was standing. >> it hit from my thigh and then ricocheted. >> brooks was taken to the hospital. she suffered some burns but was shaken up a little bit. otherwise, she said she was fine. we want to check in with sal. see what's happening on the

roads. things still going okay? >> i would say we've had a couple of glitches. traffic is moving along all right. traffic san bernardino 101 that looks good. there's a three-car crash on the right shoulder, northbound 101 right before the 280 interchange. traffic 101 is a little slow. westbound bay bridge, that's backed up for a 10, 15-minute delay before you pass the metering lights and get into the city. i want to mention on 80 westbound we've had some slow traffic, but it's lighter than it normally is coming down from pinole to richmond. we'll take that. if you are driving in fremont, we had a crash. that's slow. let's go to steve. all right, sal. thank you. a big fog bank out there. yesterday almost -- it almost felt like yesterday afternoon, that first cold front of the season even though it was more of a westerly wind and not a

northerly wind. we still have the low clouds. instead of being around 2800 feet, they are 1400 feet. the delta breeze collapsed. yesterday at this time it was 35 miles an hour. today it's 10. thicker fog will be in the forecast for the coast. as the height builds in, it will send the fog down the deck. i think tomorrow you'll have to deal with thick fog. it made a pretty good inland surge. no doubt about it. temperatures, 50s and 60s. it's mild on the lows. you take away the breeze, it feels kind of almost tropical. a little low spinning off the coast. that's allowing high pressure to build in. our low is out of the picture. warmer weather is on the way. warm to hot. it's definitely going to get hot. today the high starts to build in. it will make its impact more so as we get into friday into the weekend. there will be 100s away from the coast. here we go again. i don't think it will be as warm as that last episode. westerly breeze.

but it may stick around for a while, this extended warmup for inland areas. 60s to 80s. some locations were 18 degrees below average for this time of year. you know we have to make that up fast. we will. today we start the transition day. warm and hot inland. 60s and 70s today. 7:25. another major victory for gay rights where same-sex couples will eventually be able to tie the knot. >> reporter: we're live in downtown oakland where there's been another night of violence and vandalism after the george zimmerman verdict. we talked with business owners who support the protesters but are saying that they want the vandalism to stop.

the not guilty verdict in the george zimmerman case led to yet another confrontation between police and protesters in downtown oakland last night. this follows three straight nights of violence and vandalism. ktvu's brian flores joins us live to tell us how police hope to track down those responsible. good morning, brian. >> reporter: it's been quiet this morning. that wasn't. case a few hours ago. we're in front of the -- that wasn't the case a few hours ago. we're in front of the youth building. a lot of people are upset about this case being targeted by vandals. you can see the glass door

broken by vandals. a lot of windows on the left boarded up as well. this is one of those businesses that provides a voice for young people, tries to create positive change here in oakland. they spent a good part cleaning up glass. they have boarded up windows. a lot of people, especially on social media, very upset about what happened and are asking why. now, that was actually video provided about the windows that were broken here at youth radio. police are asking anyone with similar cell phone video or surveillance footage to any other business to come forward so police can catch the people responsible. in terms of the protests, this was the third night in a row. some say compared to previous days where some protesters went on the freeway, damaged buildings as well. last night's protest was more subdued. many are upset over the george zimmerman not guilty verdict in florida. we spoke to some people who agree with the protesters but

are questioning why the uptick in vandalism. merchants don't want to point fingers but they want the violence and vandalism to stop. >> he said -- i don't know. >> reporter: frustrating? >> yeah, frustrating. >> reporter: now, former city council president he de la fuente says he wants the violence to stop. police brought two people into custody yesterday. back out here live, the good news for youth radio, it continues to broadcast and provide the positive voice for the young people here in oakland. some employees feel betrayed and they were hurt by what happened and they will continue to move forward. they hope some of the young people will continue to check out how their voices can be heard. the bad news, they will have to clean up and find out how to pay for the broken windows caused by what o.p.d.

says is a small group of vandals. brian flores, ktvu channel 2 news. we have a photo of the waiter who was the target of a brutal attack at the flora rest on telegraph avenue. police say a masked protester hit him in the face with a hammer as he tried to protect the restaurant from violent demonstrators. co workers say the waiter is resting at home. and the protests sparked angry comments at the city council meeting. >> if the protesters if they don't live in oakland, they can't protest in oakland. >> many people expressed their outage of protesters from other cities causing trouble on the streets of oakland. some suggested police start checking the i.d.s of the demonstrators to find out where they live. earlier this morning, the san jose police department released its violent crime statistics. it says gang-rethe lated crime is -- gang-related crime is

down 16%. nongang-related crime is down as well. it pulled 221 guns off the streets but it says homicides are up this year. so far, there have been 29. some patients of sutter health hospital could be in danger of identity theft. last month, sutter sent out letters to 4500 patients notifying them of a security breach. the parents may have had their personal information leaked possibly including names, social security numbers, dates of birth, addresses, even phone numbers. sutter is offering free credit monitoring services and is trying to determine the source of that security breach. well, the top research universities in the west are being forced to tighten their security as they are subject to millions of hacking results weekly. according to "the new york times" most cyber attacks are believed to come from china. the universities may not be able to tell what was taken after a break-in. the university doubled the

cyber budget last year. great britain has just given the green light for gay weddings thanks to buckingham palace. queen elizabeth ii has just given her royal approval. yesterday a bill was passed legalizing same-sex marriage. it applies to england and wales. however, the first gay weddings are not expected to begin until next summer. the university of california regents will vote today on a new student member who would be the first muslim to hold the post. some jewish groups are opposing the nomination because of some of her political activities. the cal university student center sponsored this calling for the divestment of university funds for countries with economic ties to the israeli military or israeli set millionents. but the -- settlements. but the committee who recommended her said she's been active on promoting interfaith gatherings.

more than 80% on asiana flight 214 plan to sue. a chicago law firm says the crash might have been caused by a mechanical malfunction. the suit also says some escape ramps that open inside the plane blocked the passengers' exit. a bay area woman has filed a lawsuit against the airlines. the attorney claims the woman and her 8-year-old son suffered back and neck injuries in the crash. the woman said she's been unable to return to her job as a foreign language instructor for the military. the suit is seeking at least $5 million in damages. san francisco prosecutors call him a cold-blooded killer. 23-year-old barry white will return to court next wednesday. he faces 16 felony charges, including two counts of murder in connection to an attack at the san francisco jewelry mart last friday. prosecutors say surveillance video shows him shooting, stabbing and killing two store

clerks and wounding the owner of the store in a dispute over $300. the brother of one of the victims is having a difficult time coping. >> i don't understand why they have guns and knives. what's happening? >> prosecutors say one of the attacks was so severe the victim was nearly decapitated. white is being held without bail. this weekend, relatives of a missing girl in oakland will pray for her safe return. a candlelight vigil vigil for daphne webb is set for 6:30 tonight at 79th avenue and nrbl boulevard -- and international boulevard. john webb was noticeably absent during a news conference held by the family. daphne's mother was there but was too emotional to speak. >> they are to show their unwavering support, love, commitment to our effort in

bringing baby daphne home. >> oakland police say their investigation has not identified john webb as a suspect in daphne's disappearance. investigators say the girl was last seen in late june. the family is working with the klaas kids foundation to help find her. recycling processors from waste management will take off a protest outside of the company's headquarters in oakland in 90 minutes. they are angry about safety issues and low wages. workers will provide details during the protest about what they claim to be hazardous conditions on the job. happening right now, i want to show you some live pictures from pleasanton where a new walmart neighborhood market sore -- store is happening. a ribbon-cutting ceremony is happening. some people don't want the walmart in their neighborhood. they want to protest. walmart is actually opening two

stores. the american civil liberties union is calling for more restrictions on automated license plates scanners. tens of thousands of the devices are in use around the country. tiburon is one of the local towns that uses the scanners. the aclu claims the police used the devices to track where drivers drive and can store that information in databases for years. law enforcement officials say the practice is legal but the aclu says that police should immediately delete data that's not tied to a criminal investigation. california is preparing to test digital license plates but not everyone likes that idea. a recent bill is creating a poolt program that will outfit 160,000 cars with the digital plates. the state says the plates will have electronic numbers and save the dmv time and money. but privacy groups say it's not

a good idea. they say this means your location could be available to the government at any time. san francisco is taking a new step to encourage car sharing in the city. the municipal transportation agency will reserve as many as 900 onstreet parking spaces for car-sharing vehicles. the two-year test will expand to all neighborhoods. the program is expected to create controversy and it's likely to take months. >> very val sueable parking -- valuable parking spots. less go to sal and see what's working and what's -- let's go to sal and see what's working and what's not. >> we're gonna start off with 280 in san jose where we're seeing slow traffic getting up in the valley. 101 is slow. we haven't had any major problems. we've had a couple of minor things go on. we don't see anything major here. northbound 85 on the connector

ramp to southbound 17, there is a noninjury crash. it could be making things a little bit slower on all of the freeways. northbound 280 at parkmoore avenue. there was also a noninjury crash. just a lot of small things. getting word of a new crash, southbound 85 north of 17. in the same general area. 880 southbound, we've had slow traffic from 280 to mowry because of an earlier crash. 30-minute delay. usually on a good day, it's less than half of this. at the bay bridge toll plaza, it's about a 20-minute delay before you make it on the bridge. let's go to steve. we still have a lot of low clouds and fog around. we just don't have the breeze today. i mean, it's definitely been cut in half. i mean, yesterday it was roaring along about 30 plus miles an hour. today there is a lot of fog instead of being up around 2800 feet, it's up around 1400. it will continue to drop. yesterday we had a low off the coast. that pumped in a lot of cool

air. that cool air still with it for some inland. cloud cover keeping some lows really mild. i think fog will be extremely thick as we head towards tomorrow and friday. low clouds made a good surge. but they will burn off sooner. the low right there. that's responsible for the cooldown. the next doe is dropping much, much further offshore. as that drops that's allowing high pressure to drop desert southwest. it backed off. it's on its way here. it may stick around for a while. today is the in-between day. we'll see temperatures warming up to near average, maybe slightly below 38 tahoe. a little chill there.

planned for the golden years. a fire in southern california has destroyed three houses and three mobile homes in the mountains west of palm springs. about 50 homes are under investigation including camp ronald mcdonald. the fire is spreading heavy smoke and ash to surrounding communities. it's only 10% contained. in walnut creek a woman is recovering after being rescued from her burning home. the fire started on parkside drive yesterday afternoon. firefighters heard the woman screaming for help from a window and were able to pull her out. firefighters rescued several of her animals. the cause of that fire is still under investigation. the justice department is examining options for filing charges against george

zimmerman but says it's likely not to happen. yesterday, the department announced it would be difficult to prove zimmerman targeted trayvon martin because he was black. it says federal hate crimes require clear evidence, which they do not have in this case. yesterday, attorney general eric holder says the department is looking at all angles before making a final decision. four of the six jurors are responding to the intervun another juror gave to anderson cooper. that juror said she believed that trayvon martin hit zimmerman first. she said martin played a large role in his death. yesterday the other jurors' statements were her views are her own. an ohio man is expected to plead not guilty to 600 new charges in connection with the kidnapping of three woman. they expanded the indictment

against ariel castro that includes 1,000 criminal counts, including kidnap, rain and child endangerment charges. castro is accused of holding the three women captive for ten years in his cleveland home. his trial is expected to begin early next month. a child care worker working for the ymca is due in court. the 23-year-old was arrested on friday after a 6-year-old girl he was watching told her parents that he had assaulted her. police the incident happened while he was alone with the girl inside a portable classroom at paradise valley elementary school. while searching his computer, police say they found pornographic photos of a 17- year-old girl. >> to have someone we know and love and worked with for a long time to be charged with a crime like this is shocking. >> he could also face separate chimed pornography charges. president obama has admitted for the first time that it's unlikely that the

republican-led house house of representatives will pass immigration reform legislation before the month-long brake in august. in television interviews, the president said he thinks many republicans are struggling with the issue. >> i know it's tough. i know the republican house members are wrestling with it. many of their constituents are suspicious of. suspicious of what immigration might mean for their political futures in some cases. >> the senate has already passed a comprehensive bill that includes a path to citizenship for millions of undocumented immigrants. but house republicans have indicated they will come up with their own reforms and plan to address the immigration issue in smaller bills. the presidio trust in san francisco is planning a major bash to celebrate becoming self- sufficient. they no longer need tax payer money. there are about 200 businesses

and 1200 businesses in the presidio. revenues pay for maintenance and free public events. george lucas hopes to build a cultural arts museum in the presidio. the museum would focus on art over the past 150 years including digital art used to create animated and live action movies and special effects. lucas wants the museum dedicated to what he calls story telling. ford will upgrade some of the hybrid cars. the automaker says it will recalibrate the system on fords hybrids, including lincoln from the 2013 model year. ford will notify the owners of the cars next month. the move comes after some customers complain they are not getting the 47 miles per gallon mentioned in advertisements. chrysler is recalling

francisco. let's go to steve. >> all right, sal. thank you, sir. a lot of low clouds around. it's still a big fog bank. we don't have the westerly breeze around it. it was downright windy for some. if that's there is -- what's there is almost three quarters of what it was. warm air is beginning to move in. that will give us more of a thick fog bank starting tomorrow. today it's stilt up there high enough because it cleared the coastal hills. i think reduced visibility will be in the forecast tomorrow and friday. plenty to go around. it's much thinner far inland. but 50s and 60s. really mild start for some. temperatures have been stuck here. it's noticeably warmer. you can see a low spinning next to where it says pacific satellite. that's pretty far offshore. the high pressure has been gone. it's coming back. i don't think it will be as hot as what we had two, three weeks ago. it will send inland temperatures back in the 90s

off. temperatures will get pretty hot as we head to the weekend. here's sal. right now, traffic on 24 westbound, looks pretty good between walnut creek and oakland. there are no major problems. as a matter of fact, it's beginning to get a little lighter. also this morning we're looking at 80 westbound which has also seen its share of light traffic. when you get to the toll plaza, you will see a little bit of slow traffic waiting to get on the bay bridge. the time is 8:00. back to the desk. a woman who found a baby abandoned at a gas station in vallejo said she's willing to take custody of the child. she said she found the 1-year- old boy crying in his stroller on saturday so she called police. johnson said she stayed with the baby for three hours until child protective services. authorities say the baby was left alone for about an hour before he was found. the baby's mother was arrested on child bobment charges. she's -- abandon charges.

she's pled not guilty. the death of a long shore worker has stopped business this morning. tara moriarty is live with more on the delays happening now. good morning, tara. >> reporter: a lot of frustrated truck drivers out here this morning. that's because it's been pretty kay otic over the past -- chaotic over the past hour. they've had to go home because the port is closed. a lot of them taking off. they were supposed to do deliveries and pickup at the port at 7:00 this morning. they were told to leave. that's because a longshoremen died here yesterday and her coworkers are standing down for her for 24 hours. truck drivers are sympathetic but angry nobody told them that the port would be shut down. we just drove toward the freeway and the line of trucks lasted for miles. we're at berth 55 where joy be

daniels would drive a tracker. around 2:45 yesterday afternoon, they rushed her to the hospital but she later died. we've not received official confirmation as to the cause of her death. truck drivers say they had no idea that the truck would be in operation. >> there's trucks backed up all the way to the freeway for crying out loud. these guys don't know anything. they are just gonna keep coming in here. >> reporter: we spoke to an ilwu local 10 leader earlier this morning who said the port will be back to business as usual by 7:00 tonight. these pickups and deliveries only happen in the morning. it means the loss of millions of dollars to the port and the ships will not be able to offload their cargo today. live from the port of oakland, i'm tara moriarty, ktvu channel 2 news. >> thank you, tara.

happening right now, president obama is set to speak on the confrontation of richard cordray. he was confirmed by the senate yesterday after republicans blocked his nomination for nearly two years. this is a live picture inside the white house. we're waiting for the president to step out and speak. the breakthrough game after harry reid threatened to change senate rules unless republicans stop blocking president obama's nominations. b.a.r.t. has angered many commuters with its recent labor troubles. but the transit agency is getting a gold star when it comes to safety. b.a.r.t. has been awarded the highest security rating possible by the tsa. this award could play into current contract negotiations which could lead to another strike next month. the union says b.a.r.t. has not been enough to address the safety of the workers and riders. b.a.r.t. union workers have potentially bad news for the 400,000 daily

riders. today's "chronicle" reports those workers are prepared to stay out a long time if they strike again next month. b.a.r.t. management admits it would take months to train enough operators to get b.a.r.t. trains rolling, once again. we continue to follow the breaking news in the south bay. san jose police have shot and killed a pit bull they say bit an officer. an investigation led them to third and empire. an officer was talking to a woman at the door, when police say a pit bull came from the basement and bit the officer in the leg. the officer shot and killed it. the officer was taken to the hospital with non-life- threatening injuries. it's 8:04. want to check in with sal see what's happening on the roads. sal? >> i would say it's a moderate commute. it has not been all that bad. we've had commutes that have been lighter than usual.

in general, we see traffic getting better in this 8:00 hour already. at the toll plaza, for example, the backup is only to the middle of the parking lot. for a while it was backed up beyond the 880 overcrossing. this is a five or seven-minute delay. it's certainly not 20 to 30 as it was earlier. this morning's commute is looking a little bit better on interstate 880 southbound coming down from oakland to hayward to fremont. northbound on the right we're getting a little bit of a slowdown there, as you can see. in the south bay, we've had a couple of different incidents northbound 85 and 17. northbound 208 there was an earlier crash. if you are are trying to get in the valley, give yourself a few extra minutes. 8:05. let's go to steve. a lot of low clouds. but breaks already in the clouds. yesterday breaks inland but barely got over 7 for some. we also had a really robust sea breeze. that's not the case today.

there's a lot of low clouds. it just doesn't have the sea breeze. temperatures far below average for this time of year. 15, 18 degrees below average. today we'll warm it up. 78 for san jose. we're getting near average today. tomorrow we'll go above on some of the temperatures pl still plenty of low clouds. it's thinner. so it will burn off sooner. if this continues to march in, we'll be in a cooler pattern. as that moves out, that's allowing high pressure to move out. >> it's a strong one. we've been taking a look at this one for a month and a half. when it inches back towards us. by the weekend, 90s to 100s. even hotter than that out to the valley. we'll keep an i on things. chloe up in clearlake said, i think it's 15 degrees lower this morning. 64 there ises 49 -- verses 49.

candlelight vigil last night [chanting] >> the mother of kenneth harding was among those who gathered to mark the anniversary of her son's death on july 16th 2011. police say the 19-year-old apparently shot himself during an exchange of gunfire at a bayview district transit stop. his mother, though, said it was police who fired the deadly bullet and she's suing police saying they used excessive force. in addition to the gathering, there was another demonstration just hours earlier. >> justice for kenneth harding! >> protesters marched near church and dubose streets to spoe their supports for the harding family. they blocked the intersection for 30 minutes. no one was arrested. concord police are searching for a man suspected of stabbing two people at a gas station. police say 21-year-old john gleeson junior stabbed two people outside of the bon air

market. police say gleeson was with a group of people who walked up to a man pumping gas. both men are expected to recover. a new development in a santa rosa robbery case. three suspects have been arrested in connection with a smash-and-grab heist. police arrested trayvon banks austin, alexander brandon and irvin dixon. police say the suspects robbed bennett jewelers at gunpoint just about 1:00 yesterday afternoon. the suspects were arrested about 20 minutes later during a traffic stop. in less than an hour, jury deliberations will continue in the trial against 22-year-old jose montoya. he's one of the men charged with the gang rape of a 16-year- old girl outside of richmond high school. yesterday, a jury returned a verdict for the second defendant, it 20-year-old marcelas peter. the judge ordered that verdict

sealed until the verdict against montoya is reached. but if the second verdict is not reached by tomorrow afternoon, the first one will be read. in just about 20 minutes, state food and agriculture workers will begin their fight against the guava fruit fly. berryessa, white road, tully road in san jose are the areas targeted. that fly feeds on citrus, tomatoes and other plants and can wipe out crops. workers say the eradication treatment will not affect people. they will be coating utility poles and trees with a poison perfume that only affects male fruit flies. one of america's most popular magazines is making news itself. the cover of "the rolling stone" tells the entire story. and what a former facebook worker is saying about profile passwords. yummy, scrumptious bars. hmm?

yesterday they were around 2800 feet. today they are about 1400. that warm air aloft, there's very warm air up towards lake county. lows are 15 degrees warmer. that's huge. thick fog by tomorrow and probably into the weekend. you can see there's plenty of low clouds out there. it will burn off sooner. 60s for some. shom of the lows they never -- oakland, i don't think they got below 59, 60. that's mild. you take away the breeze. high pressure is coming in. i don't think it will be as strong as the one we had. inland temperatures will be in the 90s out to the valley. 100s around here. coast and bay they will be dealing with as low of 60s and -- with a lot of 60s and 70s. today, 60s, 70s and 80s. these are a little bit below average to near average. i don't think it will take long for some to start warming up fast. 90s will be back for some. weekend looks hot inland. coast and bay probably not as

the not guilty verdict in the george zimmerman case led to another confrontation between police and protesters in downtown oakland last night.

this follows three straight nights of violence and vandalism. kight's brian floor -- ktvu's brian flores is live downtown. >> reporter: it's been pretty quiet this morning. that was not the case hours ago late last night, another night of violence and vandalism after the george zimmerman verdict. we've been talking about merchants and businesses affected by a small group of vandals. even the nonprofit youth radio which provides a voice for young people and tries to create positive change in oakland, they spent time cleaning up broken glation and have boarded up -- glass and have boarded up windows. this morning -- [chanting] >> reporter: but this morning, oakland police are asking anyone with cell phone video or surveillance footage to come forward now so people can catch the people responsible. in terms of the protests, it

was the third night in a row. some say compared to previous days, there were protesters on the freeway and damaged buildings. last night's protest was more subdued. many are upset over the george zimmerman not guilty verdict in florida. we spoke to many people who agree with the protesters but are questioning why there's an uptick in vandalism. this has been echoed by merchants. others say they don't want to point fingers but want the violence and vandalism to stop. >> it may be we've run the limit in terms of the traditional dance we've done in terms of, you know, protests and that there has to be other ways of doing it. >> reporter: police brought two people in. one person had an outstanding warrant. the other violated the noise ordinance because of a boombox. the good news, youth radio continues to broadcast

providing that positive voice. the bad news, they obviously have to fix the windows and it will apparently cost thousands of dollars. we're live in downtown oakland, brian flores, ktvu channel 2 news. we have a photo of the server who was the target of a brutal attack at the restaurant flora located on telegraph avenue during monday night's protest. police say a masked protester hit him in the face with a hammer as he tried to protect the restaurant from demonstrators. the server is resting at home. this sparked angry comments at last night's city council meeting. >> the protesters, if they don't live in oakland, they can't protest in oakland. >> many people expressed their outrage over protesters from other cities causing troubles on the streets of oakland. some people suggested checking i.d.s of the demonstrators to find out where they live. this evening, relatives of a missing girl in oakland will pray for her safe return. a candlelight vigil for daphne

webb is set for 6:30 tonight at 79 blght and international boulevard. that's where her father reported her missing one week ago. john webb was noticeably yab sent during a news conference. daphne's mother was there but she was too emotional too speak. >> these past few days have been the worst nightmare of any parent and for me as baby daphne's grandfather. >> oakland police say their investigation has not identified john webb as a suspect in daphne disappearance. investigators say the girl was last seen in late june. the family is working with the klaas includes foundation to help find her -- class kids foundation to help find her. new information in the barry white case. he will return to court next wednesday. he faces 16 felony charges, including two counts of murder, in connection to an attack at the san francisco jewelry mart last friday. prosecutors say surveillance video shows him shooting,

stabbing and killing two store clerks and wounding the owner in a dispute all over $300. the brother of one of the victims is having a difficult time coping. >> i don't understand why this -- they have guns and knives. what's happening! >> prosecutors say one of the attacks was so severe, the victim was nearly decapitated. white is being held without bail. happening now -- these are live pictures from pleasanton where a small group of people are protesting a new walmart neighborhood market store. the store just opened on santa rita road an hour ago. protesters don't want the walmart here. they are opposed to low wages and what they call walmart's anti-union action. about an hour ago, a ribbon- cutting ceremony was held inside the store. 85 new employees have been hired to work there.

yesterday it was way up there. it's coming down today. temperatures will start to warm up inland. they were so far down yesterday, they will get down near average today. some areas will probably take no time at all to warm up. still plenty of low clouds. but the fog bank made a strong push, a little thinner today. a sign of high pressure building in as the weak low we had yesterday has moved all the way up near seattle. another low is dropping down. as that drops down, that sends this high up here, starting to head back up. >> it's blazing hot back east. i mean, just amazingly hot and humid back in the northeast. so for us, we'll get the heat but not the humidity. 50s and 60s. we'll ease into this. 12 miles an hour. yesterday at travis, 35. there's still a westerly breeze. 57, ukiah and also sacramento, fog a lot of it up and down the coast. some of that low cloud deck down towards southern california.

opening day at delmar, probably a beautiful day down there. tropical clouds for us might play into the forecast for the sierra. something to keep an eye on. fog -- it's low clouds. it will be fog tomorrow, though. 92 in clearlake. the low yesterday was 49. the low this morning 64. that's a huge difference, yet other locations, sonoma, novato, napa still the low clouds even though they burn off temperatures will warm up. we'll get near average. 70s, 80s. it does look warmer tomorrow. a lot of locations will be back in the 90s that were 70 degrees yesterday. that looks warm to hot on the weekend. 90s to 100 definitely to the valley, there will be 105s maybe plus. for the coast and may, 60s, 70s and 80s. tori. stocks edging higher in early trading after several major companies reported gains

and ben bernanke said there was no timetable for cutting down on the bond purchases. in his remarks, ben bernanke said the labor market is improving gradually with employers creating an average of 200,000 jobs a month. but he said unemployment is still too high. >> despite these gains, the job situation is far from satisfactory. as the unemployment rate remains well above its level, unemployment is still much too high. >> jamie dupree joins us via skype with more on bernanke's comments. he broke some precedent and released his statements earlier. any reason for that. >> reporter: i think they were trying not to spook the markets, tori. in fact, i couldn't believe it when i was driving into work this morning and heard they released it early, they never

do that. there's a big thing we have called a lockup in which reporters, economic reporters, go into a room in the congress and you are given the testimony an hour beforehand but you are not allowed to report on it until the magic hour arrives. today they let it out early not to spook the markets. last month when bernanke spoke about when the fed would stop buying mortgage-backed securities and other bonds to help keep interest lows, when word got out they might be changing, the stock market lost a lot of ground. they have since gained it back and bernanke says there's no set date. it will have to be an array of factors about how the market is doing. >> what does that mean to the investor, if you are not an investor? what's the bottom line?

>> reporter: the economic growth being moderate. the housing market is getting even. in the bay area. it's still not even in the country. even though there's economic job gains over 200,000 jobs each month over the half of year this year, there's still a high unemployment rate. that's why bernanke doesn't see a firm date when they will ease off their help for the u.s. economy. if the economy grows more, more people might come back into the job market and that may keep the jobless rate elevated even though a lot more people are working. >> i have to ask, there's always some skeptics. any political motivation in any of this statement? >> reporter: no. i think bernanke was trying today with the early release of his system and the way he framed it in this hearing to try to get the message out to stock exchanges and the stock market, they are not gonna do

this sparked debate in pairliment. gay couples can marry in england and wales but not in scotland and ireland. the san jose police department released its latest crime number this morning. it says violent gang-related crime is down 16%. homicides are up. so far there have been 29 this year. a dog owner in san jose says there are clear signs warning intruders about her pet. police say the canine attacked an officer on duty. ktvu's paul chambers was at the home earlier. he's now moved to san jose police headquarters with the latest. paul? >> reporter: mike, this started about 1:30 this morning when officers were investigating a mail theft issue. that was on one side of town. then that led them to another side of town. now, if we can take a look at video. this all started about 1:30 this morning. officers were conducting a followup investigation to that mail theft and tracked the vehicle back to the 500 block of third street. police say records check showed

the vehicle registered owner is on probation. officers conducted a probation search and made contact with a female inside the house. as they continued their investigation. officers were talking to that female when a large pit bull, bully, appeared from a basement and began to bite the officer in the back of his leg. the officer fearing for his life shot and killed the dog. >> i heard the shot and then i got up and stayed upstairs. i heard a lady crying. >> cops are wrong. they should have never been at the house and shot my dog. >> reporter: that lady owns the dog and said there are plenty of signs like these warning people that there's a security dog inside the home. now, we were told by another resident that there are about 12 rooms inside the house and people rent them out. police did take someone into custody although it's not clear why. as for the officer, he was transported to a local area hospital and is currently being treated for the dog bite. live in san jose, i'm paul chambers, ktvu channel 2 news.

some patients of sutter health hospital could be in danger of identity theft. sutter sent out letters to 4500 patients last month notifying them of a security breach. the patients may have had their personal information leaked possibly including names, social security numbers, dates of birth, addresses and phone numbers. sutter is offering affected patients free credit monitoring services and is trying to determine the source of the supreme court breach. the top research universities in the u.s. are being forced to tighten comur security as they -- computer security as they are subject to hackers weekly. according to "the new york times" most attacks are believed to come from china t even after discovering a computer break-in, the university may not be able to tell what was taken. the university doubled the budget since last year after discovering millions of attempted break-ins. the american civil liberties union is calling for

more restricted on automated license plate scansers. tens of thousands of devices are in use around the country. tiburon is one of the bay area towns that uses the scanners. the aclu claims that police use the devices to track where drivers drive and can store that information in databases for years. law enforcement officials say the practice is legal but the aclu said the police should immediately delete data not tried to a criminal investigation. california is preparing to test digital license plates but some people want to put the brakes on that idea. a recent senate bill is creating a bill that would outfit 150,000 cars with the plates. the plates will have electronic numbers and save money. but privacy groups say this means your location could be available to the government at any time. the university of california regents will vote today on a new student member who would be the first muslim to hold the post. some jewish members are

opposing the nomination. the cal berkeley student senator hosted the bill. the committee that recommended her says she's been active in promoting interfaith gathering the on campus. former secretary of state hillary clinton says her prayers are with the family of trayvon martin and every family who has lost someone to violence. >> no mother, no father should ever have to fear for their child walking down a street in the united states of america. clinton made the comments yesterday while speaking at the delta sorority convention in washington, d.c. she says the case last caused the low of -- has caused a lot of national heartache.

following pope francis on twitter could put you on the fastrack to heaven. the vatican will offer indulgences to people who offer the people who follow the treats. this reduces the amount of time that catholics believe they will have to spend in purgatory before going to heaven. indulgents are given out on july 22nd. chuck hagel has ordered big cuts at the pentagon. he wants to eliminate 3,000 to 5,000 top staff members by 2019. that would be 20% of the current numbers. hagel says the cuts would come from both military and civilian staff members but it's not clear if the order would apply to defense contractors. u.s. customs and border protections say they found more than $750,000 hidden inside a gas tank headed for mexico. authorities say a woman was driving with 4 tupacages of unreported cash vacuum sealed in the gas tank.

more than 8 a passengers on flight 214 plan to be sue boeing, the plane's manufacturer over the crash- landing at sfo. a chicago law firm filing on behalf of the passengers said the crash may have been caused by a mechanical malfunction. the suit also says some escape ramps that opened inside of the plane blocked the passengers' exit. a bay area woman has filed a lawsuit against the airline. an attorney claims the woman and her 8-year-old son suffered back and neck injuries in the crash. the woman says she's been

unable to return to her job as a foreign language instructor for the military. the suit is seeking at least $5 million in injuries. the death of a long shore worker has stopped business at the port of oakland. tara moriarty is live at the port where truck drivers are being told to turn around? >> reporter: that's right. they were pretty angry when they were told the port is closed and would have to come back tomorrow morning. very angry as they were forced to turn around. that's because they were told that more than 1300 longshoremen decided to stand down for 24 hours after a coworker died on the job. i spoke to an ilwu official early this morning. he said 47-year-old joy daniels worked at berth 55 driving a tractor. facebook shows a picture of her at work just hours before emergency crews responded. around 2:45 yesterday afternoon, they rushed her to the hospital but she later died. meantime, truck drivers say they had no idea that the port wouldn't be opened. >> well, i'm sorry about it,
