her life cut far too short. claudine wong is live in the diamond district. good afternoon, claudine. >> reporter: good afternoon, tori. yes, alicia was 8 years old. her birthday was last month. and her nickname ladybug. she came here last night from the walkway to the store here. this is the apartment of one of her closest friends. and then at 11:00 at night, the unthinkable happened. she was here on the other side of the store when someone riddled it with bullets. when the bullets passed through the door, they took alicia's life and they struck a 7-year- old, 4-year-old and their grandmother. teenager harden was in the apartment. he didn't want to be shown on camera. he says someone walked up to the door, the girls went up to answer. as they opened the door, someone just started shooting. >> it happened quick.

i don't know if she was dead or what. i sent for the place. >> reporter: as daybreak they tried to come to terms with what happened. >> she was such a sweet girl, such a loving girl. she would get up in the morning before everyone and get dressed, lay her clothes out. such a big girl and big heart. >> reporter: those who loved her describe her as sunshine and her loss unimaginable. this was supposed to be a childhood pastimes, a sleepover. her grandfather said she was so excited to go. >> i said do you need me to walk you to the door? you're not to big for that? she said no. and i think that's probably the last time i spoke to her.

>> reporter: alicia's mother is out of town but on her way back. all three people are expected to survive. the search is on for whoever is responsible. claudine wong, ktvu channel 2 news. >> thank you. oakland police continue to investigate the disappearance of a toddler a day after family and friends held an emotional vigil for her. ♪ jesus came and laid his hands on me ♪ >> last night's prayer vigil marked the week since daphne webb was reported missing. daphne's parents say police have received a lot of tips but have no substantial leads. both verdicts in the richmond gang rape trial are in both. both verdicts will be revealed in an hour. 21-year-old marcelas peter and jose montoya are charged in the 2009 attack on a 16-year-old

girl at a homecoming dance. they were tried at the same time but in front of two separate jurors. the panel in the montoya case agreed on the panel yesterday. the peters' jury came to their decision three days ago. each faces life in prison if convicted. the uc board of regents is expected to name homeland security secretary janet napolitano as the next uc president. but as sal castanedo reports live from san francisco, some people are angry with that choice and plan to make their voices heard. good afternoon, sal. >> reporter: good afternoon, tori. protesters are already gathered here in front of the ucsf mission bay campus. the group made up of uc students and employees are not happy with janet napolitano as the new uc president. >> i'm an undocumented student and janet napolitano has been no friend of immigrants. i think it's unfair that my

university which i'm very proud to be of would be considering somebody who is considered to be very anti-immigrant. >> reporter: the nomination of napolitano came to a surprise as many. she was chosen after a special regents committee selected her out of a reported field of nearly 300 candidates. her appointment has garnered national attention. she's expected toen confirmed easily -- to be confirmed easily. many have been wondering if she has enough experience to do the job. gavin newsom is in favor of the appointment saying the,needs a lead -- the saying the system needs a leader like napolitano. >> economically, we can't continue to do what we've done in the last decade. something radical has to change and i think it requires someone with a fresh perspective, a different set of eyes with leadership skills and qualities that can move the system to the 21st century. >> very exciting nomination given who it is.

the appointment of a president is a big day in university histories, always. >> reporter: you can see a couple of dozen people are here gathering signs. what they are planning to do is gather here and when the meeting resumes at 1:00, they plan to go in and make their concerns known at the public comment section. again, that's when janet napolitano will be introduced to the board of regents here in san francisco. live in san francisco, sal castanedo, ktvu channel 2 news. >> thank you, sal. more details now on janet napolitano's appointment. this is the first time in the uc system's 145-year history. it will be headed by a woman. napolitano graduated from santa clara university and was its first female valedictorian. she's a former governor of arizona and is only the third person to lead the ten-year-old department of homeland

security. we caught up with one of napolitano 'former sors who taught her in the 1970s. >> what doesn't come from the resume is how much she cares about undergraduate education and it seems to me that the challenge in the uc system is to bring together the undergraduate education part with the research part. >> acdameia runs in her family. the uc regents also faced confrontation of a student region yesterday. some jewish groups came out against the 21-year-old student, the first muslim student regent. critics say her calls for the university to divest from companies with ties to the israeli military make her unfit to represent all uc students. i will be doing a lot -- a lot

of research so all voices are heard and no one feels like they are left out of the table. >> she says her priorities are to work on financial aid system reform and on making the campus a safe and welcoming environment for all students. penn state university has reached about $60 million in settlements with men who say they were victims of sexual abuse. the men say former assistant football coach jerry sandusky abused them. the dollar comes from ted brown. brown says he does not know how many claims have been settled. he says some are still in negotiation. sandusky is serving a prison term after being convicted last year on 45 counts of child sexual abuse. 6,000 people remain evacuated because of a wildfire in riverside county. it's been named the mountain fire. it's burning in the area around highway 243 and highway 74 near mountain center. the fire started monday

afternoon. it's consumed nearly 23,000 acres and destroyed six homes. firefighters say it's 15% contained. the evacuations have included some areas on the western side of palm springs. oakland downtown business owners are voicing their concern about the police response over the violence after the george zimmerman verdict. they were upset about the damage caused. many met with sean whent behind closed doors. he said he listened and he will take whatever steps are necessary to make sure there are enough police and if needed he will call for mutual aid for protests. oakland city officials are considering banning officials to carry -- from banning make- shift weapons at demonstrations. this comes after a waiter was attacked with a hammer during the protest. some protesters have been

tense moments at a maryland mobile home park as a plane crashed into two homes. you can see the wing punctured the side of one house. no one inside or around the homes was injured. the 70-year-old pilot was conscious after the crash and was rushed to the hospital with critical injuries. no word on how he's doing. the cause of the crash is under investigation. texas governor rick perry

signed a law that imposes sweeping new restrictions on boorbs abortion in that state. the law prohibits abortion after the 20th week of pregnancy. it also requires that doctors performing abortions have hospital admitting privileges and that abortions be performed in surgery centers. only five abortion clinics out of 42 in the state meet that criteria. the law takes effect in october. president obama is defending his signature affordable care act as republicans and the house of representatives attempt to block key components of the law. the president spoke about obama care. this comes two weeks after announced it was delaying a key provision of the law for one year, the requirement that company extend health insurance to their full-time workers. the president says many are

getting rebates and several states are set up for lower premiums. >> in states like california, oregon, washington, new competition, new choices market forces are pushing costs down. [ applause ] >> house republicans are pushing two bills to repeal or change the law. president obama has said he would veto both bills. theport of oakland is back in business but things still have not gotten back to normal. a long line of trucks waited to drop off or pick up loads. the longshoremen's union shut down the port for 24 hours after one of their members died on the job. that left truckers lined up this morning all the way to the freeway. >> very slow. the thing to do --

[inaudible] >> union officials joy daniels suffered a seizure or crashed her truck. they say it's standard procedure for the union to stop work for a day any time someone dies on the job at the port. a redwood city couple who escaped a devastating apartment fire is suing the building's owner. the lawsuit claims the owner of the hallmark house of apartments failed to properly inspect and maintain the building. it also claims the building did not have enough smoke detectors and a sprinkler system should have been installed. one person died and 97 people were left without a place to live in last sunday's fire. 20 people including three firefighters were hurt. a santa cruz woman wants the sit to compensate her for repairs she had to make after a police shootout in february. the woman owns a five-unit apartment complex. it was the scene where officers confronted and killed jeremy goulet. he's the man accused of gunning down two santa cruz police officers. the owner said she had to pay

$5,000 to fix bullet holes in garages, fences and doors. but the city refused her claim for reimbursement. >> i've never seen so many police and military people in my life. i think the owner is not unreasonable to ask for compensation personally. >> the owner says the mayor visited her yesterday and told her that her claim will be put on the city council agenda for reconsideration later this month. we just got an update from pg&e. crews have restored power to almost all of the homes and businesses that lost electricity in san francisco earlier today near the embarcadero. the power went out about 6:45 this morning in the area of spear and harrison streets. the outage affected 64 commercial and residential customers. power lines were seen tangled up along spear street. pg&e says crews are still doing repairs and trying to find out what knocked out the power. right now everyone has their

power on except for one customer. east bay vector announced two new occurrences of west nile virus. the virus was confirm in a crow and a group of mosquitoes. a contra costa mosquito and vector control spokesperson said mosquitoes mature more quickly in hot water and unkg people to drain any -- urge people to drain any water on their property. drake's bay oyster company in point reyes will be allowed to stay open, for now. a judge ruled the business can continue to operate while the federal permit is under review. in california of this year, the california coastal commission issued a cease and desist order and restoration order against drake's bay. the orders accused of business of harming the environment. more and more people are riding ac buses.

the transit district said figures show a 6% increase in ridership over the last 12 months. that's about 10,000 people a day. an ac transit spokesperson credits more dependable service and better buses for the upswing. others say it may have to do with the economy. last month, ac transit reports having an average of 182,000 passengers a day. well, except for some fog near the coast, most of the bay area has sunshine. berkeley, emeryville, oakland, alameda. some of that fog burned off. harbor master off to the right in that building. i've been through that gate many teams. a friend of mine has a boat there. the fog has retreated back to the coast. there's still plenty to go around. i'm sure the santa cruz coastline will get in on the sunshine. it's going to get thicker as nights and morning build in. tonight, tomorrow, could have some areas of thick fog.

tropical clouds staying in california. i think i will come back to visit california, it says, and will do it for five, six days. it won't be as strong as the one we had a couple of weeks ago. the main days will be friday through sunday. 9os to 100s, to clearlake and ukiah. 71 for santa rosa. 75, san jose. so 60s for others. including oakland at 65, hayward at 66. 88 in reno. 80 in tahoe. it's hot up in the mountains. obviously hot in the desert. the high builds back in. and the heat is building toward us. a lot of fog on the coast. again, it's getting shallower and shallower. we'll say fog instead of low clouds. sunny, warmer for most. but sunshine for many that didn't see it there for a couple of days. temperatures 60s to 90s.

earnings gains at major u.s. companies and encouraging news pushing u.s. stocks to record levels today. a drop in claims for unemployment benefits signaled a healthier economy and encouraged investors to buy stocks. the dow is currently up 71, not quite as high as it was earlier

in the day. the nasdaq, also up a fraction and the s&p up 8. today, samsung and apple will see if technical experts can break the new security features on their homes. george gascon is one of the leaders of the secure our smartphones national task force. the group is concerned about the skyrocketing number of crimes that involve smartphones. so they are asking all phonemakers to make the phones a less desirable target for thieves. ktvu is following breaking news at oakland's fruitvale neighborhood. there's police activity at 29th avenue and east 12th street. we know that the incident may involve an amtrak train. there are no other details available. we have a crew there and we'll give i updates online at ktvu.com. san francisco's transit agency is stepping back from the plan to eliminate hundreds of parking spaces on polk street.
