scene an off duty sheriff's deputy. paul chambers joins us from just outside the market. >> this investigation is now going into hour six. the scene is right here behind me. you can still see deputies out there but that is the store across the way. that was the scene of the attempted robbery. here's what we do know. just after 10:30 last night alameda police say two armed men who were wearing either masks or something covering their face came inside the bond fair market here on the 1500 block of high street. according to police there were two employees inside. one in the stock room and the other working the register. they were going to rob the store when they came in contact with that deputy that was inside. the deputy fearing for his life and the lives of two of the store employees drew his gun. >> the deputy ended up shooting and killing one of the suspects who was armed.

and possibly shot the second suspect who we are still looking for now. >> reporter: now investigators are looking at bay area hospitals to see if anyone has been admitted for gunshot wounds. no one else was injured. according to witness statements they do not believe the robbers fired a final shot. also this morning the investigation continues into another deadly officer involved shooting in the bay area. this one happened near christine drive in vacaville following a brief chase last night. police say they were forced to shoot and kill a 20-year-old man after he charged at officers with a knife and hammer. this is vacaville's second deadly police shooting in the past few weeks. >> later we will find out the cause of death for a passenger

on asiana flight 214. the chronicle reports two sources told them the teenager was alive when she was run over and killed by an airport fire rig. the other says she was buried up to a foot of fire fighting foam. it's unclear if it happened before or after they sprayed the foam. oakland police hope neighborhood surveillance video will help them find the gunman responsible for the killing of an eight-year-old girl. a relative of the victim alaysha described to us the gunfire. as reported on yesterday's news she was at a friends house for a sleepover when someone rang the door and fired half a dozen bullets through the door. >> she loves people and she was a happy child. and she loved her mama. she loved her mama.

>> the other three victims are expected to recover. more than 30 uniformed and plain closed police officers canvassed the neighborhood last night. oakland police chief calls the violence against children an emergency. >> this is family needs you lord. come by here. >> and a group of mothers who lost children to gun violence held a vigil for alaysha. they gathered across the street where the shooting happened. one of the women who showed up to offer help was the mother of oscar grant. >> my heart bleeds. my son was only 22 but this is just a baby. this baby has not even went to high school. she doesn't have an opportunity. >> eight-year-old alaysha is the youngest victim in oakland this year. they also want to show solidarity with the hunger strike organized by the state's

prisoners. the rally is scheduled to begin at 11:30 at the california state building. similar rallies are planned in oakland, chicago, and los angeles, and new york. six days after a jury acquitted george zimmerman in trayvon martin's death, martin's participants are speaking out -- parents are speaking out. >> my son was unarmed and the person that shot and killed him got away with murder. >> protests and rally were held across the area. the justice department has placed a hold an all evidence in the case. negotiators for bart and labor unions are set to resume contract talks at 9:00 this morning. they have more than two weeks to reach a deal before bart workers strike again. they remain far apart on all the main issues.

however, there is still hope they can reach a deal and keep bart trains rolling. negotiators say they are ready top work around the clock to reach an agreement. next month's planned implosion could provide a valuable lesson about the hayward fault. it's concerned the most seismicically unsafe building at the california state university system. they tell the newspaper they will install 600 seismic monitors in the neighborhood and the implosion almost act like a tiny earthquake. scientists will use it to calibrate their seismographs. in southern california more people have been forced from their homes as that wild fire continues to grow. the fire is burning in very steep and rugged terrain near ido wild which is west of palm springs. 6,000 people are evacuated and so far more than 23,000-acres have burned. one commercial building and six homes have been destroyed.

4,000 other homes are threatened. firefighters worry a spike in heat today could make their efforts more difficult. the drakes bay oyster company most obey environmental laws. a marin county judge says the oyster farm at point rays must remove the clams grown by the farm. it must also manage debris including plastic tubes put in the water by the previous business. a federal appeals court is still deciding if the oyster company can stay in business. a lawsuit has been filed against the outside lands music festival by a woman who says she was raped and robbed. security did not help the woman as she was assaulted in a wooded area. three women reported being sexually salted during -- assaulted during last year's festival. the city of san francisco is moving forward with a bike registry program to help cut down on the number of stolen bikes. a new report shows more than

fog, sun. i'm splitting the difference. it's warm for some, it's hot for others. there is thick morning fog. we'll keep an eye on things. 60s and 70s coast and bay. 70s and 80s and 90s far enough away yes. good morning. still areas of fog, low clouds and it will be a big difference in the temps again. 90s inland but 60s and 70s by the water. tomorrow marks one year since the deadly movie theater shooting in aurora, colorado. on july 20th of last year a gunman shot and killed 12 people and injured dozens of others. today there will be a ceremony for the victims at the same colorado state park where a gun rights group plans to hold a rally. one state lawmaker calls that a slap in the face. a couple that survived the movie theater shooting plans to get married tomorrow. just to turn the tragic anniversary into a positive day. they were on a date when the gunman started shooting inside the theater. han was shot while shielding davis from the bullet. and she says she was right by his side as he recovered.

he proposed a few months later. >> it brought me back to that night and how he did kind of save me. so of course i want to keep him around. [ laughter ] >> reporter: eugene and kristin have known each other since elementary school. we will learn more about detroit's plans to emerge from bankruptcy. rick snyder is scheduled to hold a news conference in about 2.5 hours about a plan to restructure the city's debt. it is the biggest u.s. city to ever file for bankruptcy. several california cities have also filed for bankruptcy in recent years. vallejo declared bankruptcy in 2008 and emerged from protection three years later. stockton declared bankruptcy last year. at the same time it was the largest u.s. city to declare bankruptcy. and orange county declared bankruptcy in 1994 while facing a debt of $1.7 billion.

time is 4:45. the conformation of janet napolitano as the next president of california was met with protest. uc campus police arrested six protestors and removed them from the room. as you can see there. the protestors say the record number of deportations during napolitano's time as homeland security secretary makes her a bad choice. in her remarks she tried to address their concerns. >> documented or undocumented, we welcome all students to the university of california. we are here we're in the business of education. >> napolitano becomes the first female president of the university. she will be paid a salary of $570,000 as uc president. the board of regents say they

offered $20,000 more which is what the current president makes but napolitano opted to take the pay cut. and she will receive a relocation stiven. as well as an annual car allowance, benefits, and retirement plan. her current salary as secretary of homeland security was roughly $200,000. some online classes at san jose state are on hold after more than half the students failed their final exams. the university announced the suspension of five online classes less than six months after they debuted. courses being suspend red statistic us, algebra, instruction to programming and psychology. they need to reevaluate the courses and considering longer semesters for online students. the maker of vitamin water will do forward was a class action case. they accused coca-cola as

richmond high school gang rape trial. they were convicted of all three charges against them. they are on trial for participating in the brutal gang rape of a 16-year-old girl outside richmond high school home coming dance in 2009. a richmond police officer who worked closely with the victim was happy with the verdict. >> i mean, nothing ever makes what happens this horrific event go away, but i think she will appreciate the justice system served. >> they will be sentenced on august 15th. both men could get life in prison. two other men have been convicted in the case and two others are still awaiting trial. new zealand set a new top speed while getting one step closer to a final round. they recorded a top speed of more than 40 knots. that is 50 miles an hour.

sol traffic on 101 and 280 are both doing very well. it's 4:55 let's go to steve. still lots of low clouds around. antioch has dipped to 59. when we had that really, really hot weather temperatures in the 70s to 80s. there is a cool little breeze for some. yes some areas will warm up but this is just above average. and by the coast and bay i don't see much change. high pressure system will continue to build over us. maybe today and tomorrow. then i think that is it. it will hang around. we'll have normal summertime pattern here. 50s on the temps. still a westerly breeze off in the delta. sat west at -- southwest at 18. that is not bad. it will still be warm to hot as you get farther inland. 50s and 60s and 40s in the mountains. thick fog but a westerly breeze that is the direction the wind

is coming from. if it was a north, northeast, then the coast would be about 95. but that isn't about the case. if we don't top out today, it will be tomorrow. we will see gradual cooling. temperatures heading back to the 80s. the san francisco zoo is welcoming a new girl to its family. a new baby gorilla was born on wednesday. weighing in at five pounds one ounce. the unnamed baby is a western low land gorilla which is considered an endangered species. she will be introduced slowly to the zoo's six other is gorillas. coming up next in our 5:00 hour breaking news from alameda. a deadly officer involved shooting at a neighborhood market. we have learned there was trouble at the same store just last week. also big money problems for one ambulance company.
