first, breaking news in concord where a gas leak has forced evacuations. it's happening at burnett avenue and meridan park avenue. down fowler -- john fowler joins us live with more. good afternoon, john? >> reporter: good afternoon, tori. within the last three minutes, firefighters confirm the leak has been at least temporarily capped. it's there at that corner of meridian and burnett. businesses here for four blocks are shut down. this is what it sounded like here at concord's auto center. >> you are in the commercial area with several customers inside doing business. we estimate between 50, 75 people had to be evacuated. >> reporter: firefighters say cona construction backhoe -- a construction back dehoe hit a line and firefighters and police evacuated the kia and

toyota dealerships and other businesses. the fire department says somehow this happened despite having notified pg&e. let's take a listen. we've seen people trying to cross through here. the firefighters say the risk of fire and explosions is significant here. they are also trying to monitor for gas. it's heavier than aerosol. they are looking for them. pg&e was notified about the construction and somehow this accident still happened. we just got an update. they are saying that the total control ought to be in about an hour. but this intersection at burnett and meridian will be torn up, they say, at least for several more hours today. they are urging everyone to stay away. john fowler, ktvu channel 2 news. the san mateo county

coroner released the cause of death for a 16-year-old asiana airlines passenger struck by a fire truck after the plane crash at sfo. ktvu's brian flores is live in san mateo with the new information. good afternoon, brian. >> reporter: good afternoon, tori. yeah, the news conference ended about an hour and a half ago. during that time, san francisco's fire chief issued an apology to the families after she learned that one of the fire rigs hit a crash victim. the san mateo county coroner confirms what was suspected, he said internal hemorrhaging proves that ye meng yuan was alive before she was run over by a vehicle. >> multiple injuries, consistent with being run over by a motor vehicle. those injuries she received, she was arrive at the time. >> reporter: whale there was no

word how she became outside of the plane and whether other vehicles were around, she was covered in fire foam. >> obviously, like i said, it's devastating news to us. a tragic accident. we had members literally going onto the plane because we were continuing to rescue people that we had reports of that were still on the aircraft. i see this this as a tragic accident. >> reporter: the coroner said he met with the families yesterday to let them know about the findings. he said they were visibly upset. it's unclear whether the firefighters involved will face disciplinary action. buts fire chief says they will review all procedures to see if anything else could be done differently. >> this is difficult news for us. we're heartbroken. we're in the business of saving lives. and many lives were saved.

i continue to be very proud of the men and women of our department. >> reporter: we contacted the city attorney's office and they will await for the report before making any type of decision. in san mateo, brian flores, ktvu channel 2 news. >> thank you, brian. an officer-involved shooting kook sherr -- an off- duty sheriff deputy shot and killed one man at a convenience store. >> reporter: one man is dead, another man is injured after two masked men entered the bonfair market after 10:00 last night. what the gunmen didn't know is there was an off-duty sheriff deputy inside shopping. >> they came in and attempted to rob the store. that's when the confrontation took place. >> reporter: witnesses told police they don't think the suspects fired a single shot. police say the deputy feared for his safety.

>> the deputy ended up shooting and killing one of the suspects who was armed and possibly slot the second suspect. >> reporter: who was able to get away. investigators spent the morning checking area hospitals to see if he tried to get care for a gunshot wound. people living in this mostly quiet area were shocked to hear the news. >> it doesn't happen where you are hearing gunshots outside of your door. >> reporter: police say last night's incident was not the first time the store was targeted. in fact, they were just out here last week for a crime. >> the store was robbed eight days ago with a similar m.o., and again, it was an armed robbery at that time, too, the same time of the evening. >> it's a shame what happened. i feel like the neighborhood is protected. >> reporter: investigators are looking to see if the two crimes are related. in alameda, paul chambers, ktvu channel 2 news. police at san jose state

the house. the side of the home was left in pieces. police were chasing a nissan when the car rammed into the garage and ended up upside down. the driver was trapped and had to be rescued he was later sent to the hospital with minor injuries. the home has been red-tagged. negotiations are underway as both sides of the b.a.r.t. labor dispute are back at the table. they met at the caltrans building. they spoke to claudine wong who joins us live. any encouraging words, claudine? >> reporter: he well, they just broke for lunch -- well, they just broke for lunch. a spokesperson would only say it's going. no imminent deal. that's the downside. the upside of all of this is there is still time. it was business as usual at b.a.r.t. this morning as trains got

rolling, so did commuters. although the possibility of another strike certainly on the minds of riders we talked to. looks like i might need to get a carpool together. >> reporter: you're not feeling good about how things are going? >> no. >> reporter: as negotiations were about to get underway, we talked to the union and b.a.r.t., both said they understood why riders are so concerned about what's next. anything you can say to kind of ease those concerns? >> i wish that i could. i really do. i don't our riding public to be in this situation and our members to be in the situation. i can't right now. >> we're hopeful we'll have a deal before august had -- august 4th. >> reporter: where are you now? >> not sure. >> reporter: the mediator is not allowing either sides to discussion the details -- side to discussion the details. negotiations come after a two- day break. it's unclear if or when that will challenge. it appears both sides are ready

opened the door. she was at the home for a sleepover. three others were injured. sentencing is set today for deborah madden. she pleaded guilty back in march as part of a plea deal. prosecutors say madden stole the cocaine from the crime lab back in 2009. the investigation led to the dismissal of criminal cases. tomorrow marks one year since the deadly movie theater shooting in aurora, colorado. on july 20th, a gunman shot 12 people and independent injured dozens more during a midnight screening of the dark night. today there will be a ceremony for the victims at the same colorado state park where a gun rights group plans to hold a rally. a couple who survived the movie theater shooting plan to get married tomorrow. eugene hahn and christen davis were on a date when the gunman started shooting inside the

theater. hahn shielded davis from the bullets. she was right by his side as he recovered. he proposed a few months later. >> it was a night of horror and we wanted to change the date and make it our own. >> eugene and kristin have known each other since elementary school. the owner of the cabin where fugitive and former los angeles police officer christopher dorner died wants san bernardino county to pay her $420,000. candice martin of palmdale says the money is to reimburse her for the cabin which burned down -- dur the shootout. she said tear gas canisters started the cabin and sheriff's deputies let it burn. they are still gathering information related to the claim. dorner was suspended from the department when he shot and killed four people. the house of

representatives approved legislation that would requite the k-through 12 education law. republicans created the so- called student success act to proplace several key parts of the no-child-left-behind law. it's not been reauthorized by congress since 2007. this lacks oversite and gets rid of targets and goems to eevaluate -- to be -- goals and evaluate. >> this fight is about exwity. it's about every child in our country getting an education they deserve regardless of poverty, disability or other challenges. >> boert party says this -- both party says this law needs fixing but they are not expected to pass the students' success act. the city of san francisco is moving forward with a bike registry program to help cut down on the number of stolen bikes. a new report shows more than 4,000 bikes were stolen or

targeted last year which is up 70% in the past six years. the city says the increase in theft is likely due to more people riding their bikes in the city. in response the city wants to improve police enforcement and increase bike parking. muni is expected to release a plan in september. if you head to lake tahoe, don't be surprised to see a small submarine in the water. it will spend the next few weeks patrolling the western portion of lake tahoe. scientists are using it to look at the earthquake fault which is 1,000 feet under water. if a major quake hit the fault, it could create 40-foot waves on lake tahoe. >> because it's an enclosed basin, the wave will bounce back and forth for hours. >> lake tahoe is just a practice run for the submarine. it heads to antarctica for the real mission. it's designed to go 1,000 feet

it's been a bad day for technology stocks. major stock indexes were held back by a slump in the technology sector after microsoft and google reported disappointing earnings. the dow is currently down 20. but the nasdaq is down .8%, down 28 points. s&p is actually just barely in positive territory. google will delay building a controversial new office complex in mountain view. google planned to build a 1.1 million square foot campus that
