of a man -- bicyclist who struck -- struck a plea deal. >> reporter: prosecutors call this latest conviction the first of its kind in the state and possibly the first in the nation. and it came from this intersection where a bicyclists struck a pedestrian last year. 37-year-old cyclist christopher bucari pled guilty to felony manslaughter in the collision and death of suhi wee. >> we never anticipated necessarily that we were going to seek incarceration in this case. this is a case that the individual has no prior history. >> reporter: bucari's conviction comes 18 months

molesting a child. 28-year-old limone worked as a soccer coach. he was arrested earlier this month for alleged lewd acts with a 6-year-old girl and possession of child pornography. detectives determined there were two more victims one of them a 5-year-old girl. >> he took sexually explicit photographs of her. detectives were able to corroborate this evidence by retrieving those unmistakable, unclothed images from his cell phone. >> reporter: investigators say earlier this week they expect to file charges involving a 7- year-old girl who was also allegedly molested. >> to get an idea why the ymca was so blind sided by the arrest of limon. elizabeth jordan said when lhermine was hired he passed a background check which is required for every employee that would be working with

children. he also passed a background check by the state which is part of the ymca hiring process. lhermine went through two interviews as well as a 30 hours o f -- the teenager was a volunteer at the zoo when she encountered the bat. i learned that it is a mexican bat. the bat was out on the daylight that's a red flag experts say to leave it alone. >> there was a bat on one of the displays and she went up to it. it got on her hand and she

thinks that it bit her. >> reporter: health officials tell me the mexican bat has teeth so tiny you may not know if it bit you. health officials say there's nothing special about the zoo. two other rabid bats found in san lorenzo and pleasanton. although no other human cases this year. never approach a wild animal. rabbis is fatal unless treated properly. more details now, this is the first case so far this year of animal rabies in alameda county according to the state department of public health. contra costa county has reported one rabid bat. there's been four rabid bats one in san francisco. one in contra costa county. >> we are learning more tonight how government ordered furloughs could leave the bay area and california vulnerable to a danger this time of year.

john sasaki explains how those mandatory cut backs may impact the state's ability to fight wildfires, john -- >> reporter: julie these are national guard cargo planes. the choppers often work disaster including wildfires. >> reporter: these national guard helicopters fight california wildfires and rescue people in distress. >> saving lives on a daily basis is great. we'realready down an aircraft as it has. we're directly affected. >> reporter: it's because of once a month furloughs. >> we only have 12 helicopters, but when 20% are impacted by delays on maintenance, that has

a direct impact on us trying to put out fires and save lives. >> we really slowed and it helps put out the fire or cools them off. >> reporter: they also responded to hurricanes including katrina and three years ago using c130 the guard brought a seriously injured man back from a boat that was 1,800 miles off the coast of baja california. >> imagine if you're a company in the area and you had to send all your employees home for one week. then be ready to respond to the next oakland hills fire or the next catastrophic earthquake. >> reporter: the guards men are receiving a 20% pay cut. >> you take care of your people first and that helps the mission in the end. >> we have the people, we're ready to go, we just need the funding. >> reporter: the guards men say they just want to be able to fulfill the mission the way that california wants them to.

an update now on some developing news in san francisco. fire crews appear to be getting the upper hand on a building fire on potrero hill that we first told you about on ktvu news at 5:00. news chopper 2 captured these pictures. the two alarm fire started on san bruno avenue southeast of highway 101 and north of san francisco general hospital. there's no word yet on how this fire started or if anyone was hurt. two fishermen are saved this evening after they had to be rescued from their boat. the 42-foot commercial boot ran aground on the regional marina. the two fishermen had just headed out from an outgoing tide. no word yet on when they plan to try to remove that stranded boat. there's still no deal between b.a.r.t. and workers on a new contract. that leaves 12 days of negotiation to try to broker an

agreement before another possible strike. the 30 day contract extension ends on august 3rd. the commission isn't waiting until the 11th hour to have a plan in place should the workers walk out. tom vacar has the small but significant steps taken today by the -- >> reporter: this main organization for transportation in the bay area is not going to wait until the last minute for a strike that's more and more likely to happen. neither party seems to be on the same page. >> we need to be talking about salaries, pensions, benefits. >> we're no farther along than we were yesterday or the day before yesterday. >> reporter: so they launched their strike plans today. besides coordinating with other transit agencies, caltrans and the chp, they're asking people to consider casual car pooling. >> 80 personalty of the car

that is cross the bay bridge have three empty seats in them. there's the driver and that's the biggest waste of transportation resource that we have in the bay area. >> reporter: experts say if just 25% of those 280,000 passengerless cars, that's 30,000 commuters without a single car. if half did it b.a.r.t. wouldn't even be a gridlock factor. >> if you can car pool and get to the car pool lanes your commute goes a lot better. >> reporter: ferries are being readied. >> we're going to make sure all the boats are in the best conditions that they can. that the parking lots are ready. they don't want to say that b.a.r.t. is at fault. , they don't want to think that the unions are at fault. they just want to say, you have to work this out. >> both, both. they have to come to an agreement. >> work with them.

it's all about compromis, giving and taking. >> this could be the most powerful ally you can have in making toll collecting more efficient which make it is bridge more efficient and therefor make sure commute even seizier should that be the case. tom vacar, ktvu channel 2 news. the latest round in the court fight over lethal injection is aimed at the food and drug administration. a federal appeals court found the fda was wrong to allow one of the drugs to be imported from overseas. it's an anesthetic used to put inmates to sleep before executions. the lawsuit was filed by inmates in california, arizona and tennessee. executions by legal injection have been on hold in california since 2006 due 2006 -- due to a separate lawsuit. a commission is looking into why so many schools are in trouble. the accrediting commission says 19% of the state's 112 community colleges are on some

sort of a sanction. a task force will come up with recommendations that they hope will result in fewer schools being placed on sanctions. >> the bigger issue for our system is that we've been cut by 1 $1.5 billion because of the budget cut. we've been forced to reduce courses and turn away about half a million students. the most severe sanction has been given to city college of san francisco which will lose it accreditation next year if it doesn't make required changes. >> foreclosures across the state rose during the second quarter. new numbers numbers out from data quick showed 25,000 notices were filed. it is the second lowest level in seven years. only on 2, our exclusive ktvu field poll shows governor

we're just getting the news of a search for an 8-year-old boy. his family told authorities that he has no history of running away but his father did tell authorities that they did argue because his father would not let him wear a new pair of sneakers. within the past few days authorities arrested two men in what might be considered one of the largest animal cruelty cases in the country. nearly 18,000 reptiles and rodents were either found dead or had to be euthanized after an investigation into a breeder's business practices. jade hernandez spoke with a north bay human society struggling to deal with what rescuers were asked to do once they arrived on the scene and we want to warn you, some of the images you are about to see might be disturbing. inside of this lake wood

her own wedding just for the chance to dance with her father. despite not having a groom or an engagement, rachel created a fake wedding for the chance to dance with her dying father. doctors only gave him months to live. >> i'm saddened over the fact that i won't be there for the events of her life. and that's been difficult on me. >> reporter: friends, family and former patients of the doctor all attended the father- daughter dance, and it's emotional i can't read this one. the community helped rachel pull it off in less than 10 days. >> good for them. emotions were high in stockton as troops returned from afghanistan today. the soldiers from the 126th aviation battalion were met by family and friends.

from the tropics is delivering big fire issues with that. so far not a problem right. so far we have thunderstorms in the bay area proper and hopefully that continues. 77 in walnut creek, 83 in livermore. 61 in antioch. you're going to see lots of low 60s in the east bay valley. your wednesday tomorrow will be warmer today because of less cloud cover. the extended forecast once we warm up we kind of go like this as we head into the five day forecast. what i mean is we'll get into the low 90s and we'll stay in the low 90s. high pressure sets up and we get into a more typical sunny pattern. very little cloud cover, and a temperature spread you could expect. and then around the bay mid-70s and low 80s. upper 50s to low 60s at the

coast. 79 in sonoma. these are your bay area highs for wednesday. 87 in walnut creek and again less cloud cover. less humidity you will notice that. you will notice it tonight when you go to bed too. it won't be quite as muggy as it was the last couple of nights. then the five day forecast, temperatures tomorrow warming up. as you notice they just sort of stay there. they stay in the low 90s and linger right into the bay area week end which looks to be pretty nice. just kind of a nice looking weather pattern. your bay area weather forecast, a slight chance for a sprinkle or something tonight. >> but the humidity should be leaving us. >> leaving us, yeah. history is being made at the at&t park today. the giants and reds doing something that has never happened before in baseball. look at 'em.
