an investigation into this young man's mental health. >> reporter: coming up at 6, that mental health allegation and the legal action they took today against the prosecution in this case. reporting live in san francisco, david stevenson, ktvu channel 2 news. an elderly woman was shot and killed this afternoon while driving through an oakland neighborhood. it happened a little more than three hours ago in the 2400 block of fern street. police say someone opened fire on the woman, causing her car to crash into a parked car. fern street was shut down during the investigation. police have made no arrests in the shooting. san jose police are investigating the 30th homicide of the year. the latest victim is an older woman found seriously injured in her home, who later died in the hospital. it happened on lundy avenue. that's where robert handa with what police and neighbors are

saying about the death. >> reporter: we are in the north san jose neighborhood, where police have been since this morning. you can see that investigators are still conducting their search for evidence, to try to solve what they call a violent death. the creek view inn in san jose is a subsidized housing complex filled mainly with people who have known each other for years. neighbors were stunned when someone called the san jose fire department to say one of the residents, a 62-year-old woman who lived here alone, seemed to be in distress. >> she was laying on the floor and they were doing cpr. her stomach was very extended. when they brought her out to the emergency vehicle, they were still doing cpr. i heard that some woman broke in and beat the [ bleep ] out of her. i don't know. >> reporter: san jose police homicide detectives were summoned and later confirmed she had been assaulted but not shot or stabbed. >> we do believe she had some type of physical attack or trauma.

we don't have any kind of suspect information. >> reporter: several neighbors told us the victim had someone staying with her this past week who had left abruptly. >> this was a person who used to live in this building about three to two years ago, and she was sent for a home invasion in those apartments. >> reporter: while police investigate, neighbors mourn the loss of a friend. >> she is one of the elders that lived in our complex, and it's sad that, you know, she's gone. >> reporter: neighbors told us the name of the victim, but it has not been officially released by police or the coroner's office. at this hour, detectives are still talking with neighbors and other possible witnesses about this recent roommate and anything else that helps them figure out what happened in the last hours of the victim's life. live in san jose, robert handa, ktvu channel 2 news. oakland police say they're gearing up for the possibility of more violent protests this

weekend. this was the scene the weekend before last, after the not guilty verdict came down in george zimmerman's murder trial. many merchants had windows smashed and complained there weren't enough police to stop the violence. the interim police chief says it was an intelligence failure. >> it was all pointing to a significant rally and march. so we staffed according to that. in hindsight, we obviously should have put more people out on saturday night. but we've learned from that. we're working on that to make sure that doesn't happen again. >> the department has cancelled regular days off for this weekend, and expects to have 150 extra officers patrolling friday and saturday nights. trayvon martin's father speaks out. ahead in 35 minutes, the emotional speech he gave on capitol hill and the fight he's vowing to take on. san carlos police are stepping up patrols after reports of a peeping tom.

in both cases, the women were showering in the bathroom. one incident happened on tuesday and the second this past monday. police say at this point, they have limited suspect information. >> i believe one of the windows had kind of a texture to it, so it was difficult to see out, which is good, because hopefully it was difficult for the suspect to see in. >> in the other case, the woman only saw set of eyes. police are asking people who live in the area to lock their doors, windows, pull down their blinds and always be mindful of their surroundings. a big section of downtown alamo was cordoned off after a gas line was ruptured. our newschopper 2 was over that gas leak earlier today at 3195 danville boulevard. it was right near the alamo plaza and pleasant courtyard shopping centers. ken? >> reporter: gasia, right now i'm standing on danville boulevard, which is closed, as it runs through alamo.

that intersection you see right there is stone valley road and there is that construction work taking place. it was an east bay crew working on a water line. that crew ruptured a gas line. the gas has been shut off. the repairs are being made. but questions remain about how the evacuation alert unfolded. this is danville boulevard in alamo. usually a busy road, but not today. >> everybody has been evacuated. when i left my office, i figured i'd go shopping at ace for a while, but they were closing down two. >> reporter: lloyd was one of the few people left around town. >> as we were digging to do our work, the markers were off, so our crew hit a half-inch gas line. >> reporter: the crew called 911. >> a safe evacuation area was identified and we established the evacuation area around the scene, with the public's safety

in mind. >> reporter: a 1,000-foot evacuation area was declared. what followed was a county phone alert. but the fire department says it got calls from people far from alamo, asking if they too should evacuate. this alert, which went out over at least one cable system, read evacuation in contra costa county. but the county says it sent out automated landline calls to the reds areas on this map and that their phone and e-mail alerts did specifically name alamo. where the confusion came from is unclear. for what was a relatively small gas leak but a major headache for some. >> everything will get back to normal pretty quick. >> reporter: well, the fire received calls as did ktvu from people in contra costa who live far from alamo, asking if they should evacuate. now, we did see the alert, the text alert, that was sent out by contra costa county. it was specific to alamo. the county says it is looking to see how that message may have been watered down or that

information omitted as it was passed from one medium to another. as for the gas line and evacuations, the evacuations have been lifted. pg&e says repairs here should be complete in six to eight hours. gas was also a concern in oakland's chinatown district after a minivan accident. it crashed about 2:00 this afternoon and receiverred a gas line. that forced a quick evacuation of the people inside. >> i smelled the gas. that's why i asked my wife, hurry up, get out of the house! and we called 911. then the fire department and the police, they come in. >> people in several nearby homes were also evacuated until the gas was turned off about 3:30 today. the man driving the van was described as police as disoriented and was taken to the hospital with injuries that are considered non-life-

threatening. bay area environmentalists filed suit today to protect children from pesticides. new at 5, ktvu health and science editor john is live with the story. >> reporter: angry parents here in sebastopol are trying to stop this vineyard development. they say it threatens children with pesticides that could drift into homes and these classrooms. once a low-impact apple orchard, workers preparing to plant grapes here. the problem? orchard view school is just yards away, one of five nearby schools. >> when they come out and spray, the wind is going to push it over, and my kid is going to be basically breathing in pest seeds. >> reporter: her son, cyrus, is in the second grade at orchard view. today we obtained this federal court petition. they are charging the epa with

years of failure to act. >> we are asking the epa to do its job. it has a mandate under federal law to protect children from pesticide exposure. >> reporter: environmentalists say with this air monitor, they discovered pesticides near every field they checked. environmentalists say readings significantly exceeded federal limits. >> pesticides are linked to learning disabilities, to autism, falling iq's and the epa needs to take action today. >> reporter: environmentalists and parents want a big buffer zone. >> you can't smoke around kids, so why should you be able to spray pesticides? >> reporter: the property owner plans to comply with federal laws. but activists say it's simply not enough. the epa told me it will decline comment until officials review this litigation. reporting live in sebastopol, health and science editor john

the new prince and third in line to the british thrown has a new name. three, to be exact. today it was announced that prince william and the duchess of cambridge have chosen to name their son george alexander louis. >> reporter: what's in a name? a lot, if you're the future heir to the english thrown. so meet george alexander louis, to be called his royal highness prince george of cambridge. the announcement came this afternoon. they say the duke and duchess of cambridge were delighted to

share their new son's name, a name which has significance in the ancestry of the royal family. george is the family the great- great-grandmother chose when he was crowned as the last king of the uk. this puts to bed a name game that has been played for months. as the anticipation of the royal baby's arrival grew, so did bets on the child's name. >> see how it goes. could be spencer. who knows? >> reporter: george was a top contender from the start. so were james and arthur. the prince had a visit from his great-grandmother, queen elizabeth, this morning. and also went to see his paternal grandparents' home. get used to prince george for now, unless of course the young boy becomes king some day. tourism officials in las vegas are using facebook to congratulate the new royal parents.

the las vegas convention and visitors authority posted a picture that says congratulations on the royal addition. see you in 20 years! students who want the best education may want to go west. forbes released an annual ranking of best colleges, and stanford was voted the best private university. uc berkeley placed 22nd on the overall list of colleges. ivy league schools on the east coast still ranked well. the city of berkeley is taking steps to cut down on mini dorms proliferating around the cal campus. these are housing units rented to students who live together. they say landlords pack too many people into properties without regard to traffic, parking or noise. facebook reported its second quarter earnings, beating wall street's

expectations. they reported a profit of $333 million on revenue of $1.81 billion. after being adjusted for one- time events, facebook earns 19 cents a share, 5 cents higher than forecast. facebook's users are up from a year ago. facebook closed at 26.51 a share. it was up even hire in after- hours training at almost $31 a share. federal analysts blame the closure of the onofry power plant. the plant generated enough electricity to power 1.4 million homes. >> bill martin told us it was going to be a little warmer. and by, i think you're right. turned out to be a nice

same-sex marriage remains legal in california. the state supreme court has rejected another request to halt gay weddings. the clerk of san diego had sought an injunction against licenses. he claims the u.s. supreme court ruling on prop 8 only applied to the couples who brought the original suit and to the two counties where they lived. the court has asked for more written arguments on the issue. on friday, it will be one month since the supreme court issued its historic decision on gay marriage. a number of gay couples returned to washington to say thank you and "i do." >> we're just beyond words. we're so excited and just proud

secret information about the u.s. government surveillance program. snowden's attorney says snowden is awaiting documents that would let him leave the airport where he's been for a month, reading russian literature. they voted to continue the nsa program that collects phone records belonging to millions of americans. libertarian-leaning republicans joined with liberal democrats in support of a measure that would have ended the program, but that measure was defeated. anthony weiner is vowing to press on with his mayoral campaign, despite pressure to quit because of a new sexting scandal. weiner said today that when it comes to voters, most of them will care more about the issues than the embarrassing things he's done in his past. he admitted to sending more sexually explicit messages to young women after he resigned for the behavior. he and his wife say they've

complete bay area news coverage continues. this is ktvu channel 2 news at 5. a second bart strike could be less than two weeks away. why bay area transportation officials say this time, the effect will be much worse. the clock is ticking as bart and union negotiators try to find common ground ahead of another looming strike. there are now 11 days left before the union's 30-day contract extension is set to expire on august 4th. the alternatives being considered the strike does happen. >> reporter: bart keeps saying it really does want to strike a deal with the unions. but its chief negotiator remains on vacation.

the latest assessment of a potential bart strike was short and sober. >> they are continuing to negotiate. but all indications are that the negotiations are still far apart. >> reporter: attempts to add on or hire buses during the strike earlier this month were essentially futile. >> it really was very limited service. the demand for that service far outstretched the supply that was available. >> reporter: and that was during a slow holiday week. >> a large number of people stayed home. drove alone. just sat in traffic or were on vacation. we don't see that there was a huge shift over to carpools. >> traffic in august is traditionally higher than a holiday weekend in july. i do think for those people who got tied up in the bart strike in july, you can expect the worst experience in august. >> reporter: some commissioners openly wondered. >> we should be engaging with the private sector. we should be doing everything we can to provide an alternative.

what's happening in emoryville. the special campaign runs through july 31. the eight days between now and then are one of the deadliest periods for crashes on i-80. interstate 80 spans nearly 3,000 miles, all the way to new jersey. a florida woman accused of scamming a sunnyvale woman out of 850,000 was scheduled to appear in court. peaches miller is accused of taking the money in exchange for removing a voodoo curse. she is been charged with grand theft and extortion. three people are under arrest, accused of an early morning burglar at a santa clara gun store. how police learned about the crime very quickly and recovered all of the stolen guns. >> reporter: a bold move early this morning by a trio of thieves.

police say they stole firearms at reed's indoor range in santa clara at around 3:00 this morning. >> they shattered a lot of windows. >> reporter: the alarm system alerted police, who say they arrived within three minutes. they spotted a suspicious car leaving the store and followed it. >> the officers got behind them. some items were thrown from the vehicle. those items turned out to be two rifles and five handguns. >> reporter: officers caught up with the car a quarter mile away on lafayette. police say the two men tried to run away, while the female passenger stayed. the men are brothers and are identified by police as 20-year- old jorel moreno and marcus moreno. the woman is tina marie guzman of san jose. >> i'm upset. it's like violating your own personal resident, as far as i'm concerned. it's a big mess to clean up. the biggest thing for me was everything was apprehended.

>> reporter: reed credits police and his elaborate alarm system that records video for helping to capture the thieves. >> it is alarming the burglars wanted guns, but, again, i think it's a perfect example of all the safety mechanisms in place, working to safeguard the community. >> reporter: reed isn't letting the burglar stop business. even though the thieves left behind a mess, he was able to clean up enough inside to open up the store at 10 a.m. san francisco's mayor today signed a new budget, one he says will improve the city's neighborhood and balance its books. the budget will close multimillion budget gaps over the next few years, he says. the budget funds 300 new police officers and 120 firefighters. the mayor says the budget is both fiscally and socially responsible. >> socially responsible budget also means that we engage our

customs and board patrol agents arrested a drive in charges of smuggling cocaine in her shoes is. shoes is -- shoes. that's the cocaine all wrapped up inside. it was in imperial county, just west of the salton sea. agents say the drive told them she was smuggling cocaine. but they were vague about what led to the admission. the cocaine was valued at $64,000. president kennedy's daughter caroline kennedy has been nominated to be ambassador of japan. if the senate confirms kennedy's nomination, she will be the first woman to serve as u.s. ambassador to japan. a federal judge cleared the way today for detroit's bankruptcy to go forward. the legal dispute began with the city's bankruptcy filing last thursday and concerns

about the cutting of pension benefits for public employees. a lower court attempted to derail the bankruptcy by saying it violated the constitution. but a federal appeals court has now frozen all litigation against the city for the duration of the bankruptcy proceedings. the father of trayvon martin made an emotional speech on capitol hill today, saying he wishes he could have saved his son's life. >> i vow to do everything in my power not to give up the fight for him. not only to fight for trayvon, but to fight for so many other young black and brown boys. >> tracy martin testified before the congressional caucus on black men and boys. martin said he appreciated president obama's comments that trayvon could have been here years ago. this deer got caught in

tomorrow ends up being most likely the warmest day we'll see, as temperatures get up in the mid to upper 90's. this high pressure system is building out of the southwest. it's not as aggressive. most of the heat stays out in the great basin. what's going to happen is it does this deal where it presses against the cooler air at the cost, so it stays cool at the coast. and oh, look, it's hotter inland. classic pattern. mid to upper 90's as we head into tomorrow. you'll still find heat in the valley. it's not a big cool-down, not a heat wave, just what you would expect. you see that cool bite of air right around the sea breeze, the greens and the yellows, 60's and 70's, and that's what you expect for this time of year. 95 in vacaville, 95 in clear lake. pretty toasty. east bay, 95 in livermore. air quality, it gets a little -- not around the bay, because

we've got a breeze, but in the inland valley, air quality will take a bit of a hit. gilroy, 92. air quality not as great in these areas, as the sea breeze doesn't get in there very easily. along the coast, fog, as we've had. and you'll see clearing too. you notice on saturday and sunday, the clouds kind of start to come in a little bit. that's from a weak weather system that's going to introduce quite a few clouds and send temperatures downward. so those are your inland temperatures. these are your coast. or these are your bay and these are your coast. and the bay, we're talking like hayward, fremont. right around the bay, upper 70's tomorrow, and low 80's as well. five-day forecast, really exactly what you might expect for this time of year. >> looks good. thank you, bill. san francisco will soon have dozens of high-tech parks. also, the major company that is

the latest figures out of spain indicate as many as 45 people were killed and 70 injured today when a train derailed outside of madrid. witnesses say they heard a loud explosion. the express train left the tracks about two miles from the station. all 13 cars derailed. four overturned. washington is weighing a plan to eventually stop door-to-door mail delivery and cut back on how many days it delivers mail. a house subcommittee debated a bill that would move delivery to cluster mailboxes. people who are elderly or have a disability can file for a waiver and would still be able to get the mail delivered to their door. the plan also gives the financially strapped postal service flexibility to deliver

mail just five days a week instead of six. >> folks don't like change, but if we refuse to allow the postal service to change, it will not survive. >> the postal service could safe more than $4 billion a year. the house hopes to vote on the plan since november. trader joe's is the favorite grocery store chain. the survey surveyed more than 6500 customers. publix and whole foods rounded out the top three stores. here in the western u.s., safeway ranked the highest. the 99-year-old wrigley field got the green light today to undergo a $500 million renovation. that includes a giant tv set above the ivy-colored walls. however, the tv owners had to agree to not put anything that blocks view of the field on the

rooftops. today's city leaders announced that they will offer free wi-fi in public spaces. >> reporter: san franciscans will be able to stay connected while they're out enjoying the city's parks. wi-fi will soon be set up in 31 different parks and public spaces. >> in this modern age, it has to happen. it's the type of thing where everyone is just so used to it now. >> we want to make sure we continue to bridge our digital divide. >> reporter: supervisor mark farrell has spent the last two years working on this project. and he was able to get google to donate $600,000 to install the free wi-fi. he says that money is a gift and it doesn't have to be repaid. farrell also told me people don't have to worry about the city monitoring what websites they visit. >> there's going to be no tracking of personal information. so it's truly the best of the best in terms of free wi-fi. again, as i mentioned, no

police just finished collecting evidence about 20 minutes ago. now, here is what happened. at 1:24 this afternoon, this woman was driving on fern street when she was shot. her car then slid backwards and crashed into a parked car. neighbors called 911. but by the time help arrived, the victim was pronounced dead here at the scene. >> at this time, we're not sure of how many suspects, if we're looking at one or several suspects that are responsible for the shooting. investigators are still on scene. they are talking with witnesses, reviewing video surveillance footage. >> reporter: just before this live shot, we had a chance to run up and talk to a couple of neighborhoods, including the gentleman whose car was hit in this incident. so far, we haven't been able to locate anyone who actually heard the shooting. but we have been told there may have been a small party in the area and that police were
