controversial surveillance monitoring center that they say will keep people safer. we're live in oakland to explain why not everyone is happy about the measure as the debate continues. >> reporter: good afternoon. you're right. the oakland city council in their early morning hours gave the go-ahead to begin construction of this surveillance center, otherwise known as the domain awareness center. this will be a hub for police to watch everything that's going on in the city. before the city council votes some residents were not happy about it. >> motion passes. thank you. >> reporter: that was video of oakland residents not happy over the city council's decision from last night. many say this will infringe on privacy rights. others say it won't make a difference at all. the center will be monitored by oakland police and will of the capability to pull in different camera feeds within the city and the port. it may also include license plate readers and some type of

social media aspect. the city council approved early safeguards. they include not including video feeds from oakland city schools and the coliseum. . >> the privacy policies will be vetted. we have also enumerated what sources are part of this phase. to be clear, it does not involve cameras from oakland schools. that was a controversial issue. we made clear that is not part of this project at this time. >> reporter: in response in the meantime, the aclu released a statement saying in part, that the oakland city council last night made the unfortunate decision of approving a vast surveillance center which could be used for warrantless surveillance of oakland resident who is have engaged in no wrongdoing. we spoke with residents this morning who say they're mixed about the domain awareness center. >> i don't think it makes any

difference. more safer in downtown oakland? no, not at all. maybe they'll use it for what they need but i don't think it will be any different than what it was. the level drama that the police can control is very little. >> reporter: when we talked with the city council members this morning, they say they needed to' prove this because they would otherwise lose $2 million in federal funding. the center is scheduled to open next year. back to you. . more details now, the oakland city council also approved the controversial tools of violence bill. that proposal would ban demonstrators from carrying hammers and other item that is could be used as weapons. however, some council members said the bill was too broad and that it could end up banning protest signs and other items. the council agreed to make some changeses to the bill to address those concerns. to our continuing coverage of the countdown to another possible bart strike.

the deadline is now just four days away. we are in oakland where both sides in the labor dispute are back at the negotiating table. >> reporter: good afternoon. union leaders say that negotiations were inching forward until bart's chief negotiator came back from vacation and now all that has changed. thomas hawk, bart's chief negotiateor, entered the caltrans building this morning to resume labor talks. >> we did make movement last week. the tenor of the conversation totally changed when he returned monday. >> not positive? >> it's not moving. we're not getting any responses. it's very difficult to bargain with yourself. >> hawk has come under fire by unions for not being present for ten days of negotiations. >> he is getting paid $400,000 to sit at the table and not bargain with us. that is clear. >> he has been negotiating contracts with labor unions for

decades. he is a professional and we're confident that he can work with the bart employees. >> bart officials admitted that they needed to make changes in regards to pension, health care and salary increases, topics that have become sticking point force bart workers this contract go around. they say it may come at a price. >> what the union wants in terms of salary increases would translate to a double digit fare increase, an 18% fare increase, for our riders. >> union leaders say bart has skewed the numbers in its favor. bart officials have not budged these past two days. >> if you want to make a deal, bring us the information we need so we can counter, so we know what your real position is instead of giving us plank stares. we're animateded. we're trying to get things done. we're like dentists. we got the tools. it's like pulling teeth that aren't there. we cannot get a response. it's frustrating. >> reporter: yesterday the two

sides met until 6:00 p.m. bart officials say they are willing to burnt midnight oil to strike a deal sooner rather than later. they say both sides really want to avoid a strike. everybody just left the caltrans building to break for lunch. back to you. . >> thank you. santa clara county has a new supervisor after yesterday's run-off election. we are live in san jose where supporters of cindy chavez are celebrating her victory. >> reporter: good afternoon. the unofficial results from the registrar's office shows that cindy chavez won 56% of the vote over theresa alvarado. she will be spending a lot of time here at the county building making critical decisions for the nearly 2 million residents that live here. despite the power, the position of county supervisor holds, there was a low voter turnout. just 18% of registered voters

voted. chavez says she will spend the day thanking those who support herd. the former san jose city councilwoman focused her platform on strengthening public safety, health reform and championing public schools. chavez says she's ready to take on the challenges the county faces. >> woreing with the county sheriff, i'm absolutely confident that taking resources we have now and redirecting them is one way we can get started without having to wait for the budget. if you think about it, we have the san jose police department, the county sheriff, probation, parole, san jose state has their own police officers. this is about having a lot of resources that need to be martialed in a really thoughtful way. >> reporter: the man who previously held the county supervisor seat pled guilty to fraud charges and misusing public money for his gambling addiction.

chavez says she wants to bring more transparency to county government by providing more information on what goes on behind the scenes to the public. back to you. . >> thank you. a hayward man shot several times in his car is expected to survive. it happened just before 10:00 ras night on revere avenue near albany street. police say the 33-year-old victim attempted to drive away from the area but hit another parked car. he was the only person inside the car. it appears to be the only person who was injured. >> we are working multiple crime scenes. it looks like the area where the victim was found is not where he was shot. so we're working multiple scenes here on this stretch 2200 block -- 200 block of revere. >> a family friend told us that he was shot seven times and needed emergency surgery. we were told he lives a few blocks from there and maif been trying to drive home. police say they have information about a suspect vehicle but

there have been no arrests. bug experts are headed to a goodwill warehouse in bulling game today with bedbug sniffing dogs. bedbugs were seen at that warehouse over the weekend. now that warehouse and one in san francisco are both closed. goodwill has already disposed of thousands of dollars worth of donated goods and plans to hire an exterminator. bed bucks have not been found at the charity's retail stores. . the sentencing hearing for private first class bradley manning opened today with testimony from a retired brigadier general. yesterday manning was found guilty on 20 charges under the espionage act for leaking government documents to the wikileaks website. prosecutors are expecting to get detailed testimony about any damage manning caused to national security and foreign policy. manning faces a maximum sentence of 136 years. he will also get a dishonorable

lorenzo today. the town is demolishing the old village marketplace. the shopping center has been vacant for almost 20 years. it will be replaced with a new marketplace complex. many residents who turned out to watch the demolition were nostalgic. >> i used to take a bus here. this is where we hung out. we went to the movie theater. this is part of our life. it's being torn down little by little. >> residents and officials say the new marketplace is part of an overall effort to spruce up san lorenzo. plans include a new library, senior center and street upgrades. walnut creek city attorney has resigned in the latest development around an alleged sex abuse scandal at the learner center for the arts. he claims he was being pressured to shut down an alleged sex abuse investigation of employees at the center. winter had been investigating whether workers at the center

acted inappropriately to report suspicions that a co-worker was sexually abusing teenage girls. police at san jose state university are looking for a man who beat a student during a fight last night on campus. police say it happened around 8:30 between the science building ats martin luther king library. the men got into a fight and one ended up slamming the other's face into the sidewalk and running off. it's the second violent attack on campus in the past two weeks. some students say they are concerned. >> i kind of feel unsafe. but it's never happened to me. it's usually happening at night and such, so i don't really feel the need to be in danger unless i wander out at night alone. >> campus police have not released a description of the suspect. san francisco police say they've arrested a 23-year-old oakland man in connection with a robbery and beating of a woman on market street a month ago. police released this vel vel of the attack at the time.

investigators believe christopher porter bailey was one of a group of people who attacked and robbed the 28-year-old victim. the robbery happened early in the morning of june 30. the woman was kicked in the head so severely she lost consciousness. police are trying to determine if the group attacked and robbed others that same night. new restrictions are in place for foreign airlines landing at sfo. those jets can no longer land at the same time as another jet landing on the parallel runway. domestic airline pilots may still land side by side. the faa says so far the new rules have not caused many problems at sfo but some pilots fear the rules will cause delays for all airlines. misconduct by a tsa airport screener was the focus of a hearing on capitol hill today. the house homeland security subcommittee heard from the gao which related cases of theft, sleeping on the job, and allowing friends and family to

bypass screening. the subcommittee chair said sometimes the penalties have been too light including letters of reprimand in the cases of theft. >> according to the recommended penalty, range on tsa's table of offenses and penalties or theft or unauthorized taking, a letter of rent manned is not included. >> the gao report says the number of reported misconduct cases went up 25% between 2010 and 2012. senator diane feinstein is speaking out about controversial surveillance programs in an editorial with "the washington post." she calls for greater transparency and privacy protections. however, she says the nsa's collection of phone records has prevented terrorist attacks. she's calling for making some of that information public. she also says phone record shz only be kept for two or three years rather than five. facing heavy pressure the california public utilities commission is proposing new

rules for regulating ride sharing services. the staitz says companies such as lift, side car and uber are under its jurisdiction. the commission concluded these services must be licensed. proposals include requiring drivers to undergo criminal background checks, there would be zero tolerance for drugs and alcohol, ride sharing services also need a minimum insurance of $1 million. the earliest the state puc could consider the proposal is september. . san francisco cab driver blasted their horns outside the cpuc office near city hall in protest of ride sharing startups yesterday. the taxi drivers seat ride sharing services as illegal taxis that steal their business. >> unfair regulation, unfair competition, not paying insurance, there are passengers in the event of an accident. >> the san francisco cab drivers association believes ride share drivers should go by the same

rules as cab drivers. . not much has chd the coast for almost three weeks. san francisco has not seen a 70-degree temperature since jul july 4. this morning we had information on san francisco, 26 out of 31 days in the city had fog. that is unusually high. many locations on the coast are saying, where is our sunshine? september is only a month away. we're getting closer. we had a little warm-up yesterday, a cooldown today. still getting a system up to the north, area of low pressure will move in the pacific northwest. i think vane piece of it will hang back. maybe into the weekend or early next week. so cooler today. the coast is sokd in 50s, 60s. there are some temperatures much cooler today than yesterday. that system moving in, you can see a spin in the atmosphere. that's helping to enhance that fog bank. there are some breaks.

there is some clearing just off the sonoma-marin coast. some of that fog still holding on. a westerly or southerly breeze. fairfield gusts up to 30 miles per hour, southeast toward san jose, now it's caw. northwest livermore, north mountain view. some of that fog beginning to burn off. it's cooler than yesterday. 60s, 70s, temperatures just really held down due to the cloud cover. it's heading back. that low cloud deck will head back. you can see a little clearing. it's off the mendocino coast, trying on the northern sonoma coast. our fog forecast has been doing what we thought. that's heading back to the coast i think it really ramps up tonight and makes a really strong surge tonight into tomorrow for another round of low clouds, nights and mornings and maybe to the delta. we'll see. cool coast, warm inland, not as warm as yesterday. westerly brees for most from sfo to golden gate to san pablo. sunny but not as hazy as it was.

better conditions now, not as much smoke. still a westerly breeze gusts to 35. morning fog is holding on to the coast. hazy, warming inland, temperatures down from a couple days ago. some 60s, 70s for most, 80s inland. pretty good breeze and pretty good westerly wind behind most of these locations. a lot of 70s, very low 80s. not on the coaftz, 60s there, 70s, a lot of 60s in san francisco to south san francisco. 70s on the peninsula. i don't see much change. if anything, a little cooler tomorrow. then a little warm-up friday through sunday. no sign of any heat. no sign of any break from that fog on the coast either. . >> thank you, steve. there will be more fogging for mosquitoes that carry the

west nile virus tomorrow night in the south bay. santa clara county vector control says mosquitoes tested positive for the virus in north san jose. the area to be fogged is north of highway 101 and south of the montague successway and west of seat seat. people who live in a that area should get information packets about the fogging today. crews will start work at 11:00 p.m. tomorrow night. we'll tell if you bay area rents are continuing to go up. no relief from bang fees on debit cards, what a court decided today. . steady growth in the u.s. economy and higher company earnings helping hold the stock market near record levels today. taking a live look at the big board, the dow is up 39. the nasdaq is up 24. the s&p is up 7. debit card fees could rise once again after a court ruling today. the federal reserve had capped the fees at 21 cents per swipe in 2011. today a federal judge in washington, d.c., invalidated that cap saying it violated a law that requires fees that reflect the actual cost of transactions. he also delayed enforcement of his ruling until an august 14 hearing to discuss what should happen next. bay area rents keep going higher. the average rent in san francisco is about $3,000 a month. that's according to real facts.
