answered with the injunction which brings the strike to a halt for now. >> they emerged. and a board will investigate. they will issue a cooling off period. >> they are using it as a scare tactic and they were bargaining in bad faith. we heard how it was unnecessary to keep the public on pins and needles. there is no reason to continue the drama and the stress. the last thing we wanted was to see the train shut down again. we said what are our options.

this is the one we found we would exercise. the governor was willing to grant it. >> and bart has been covering smaller raises than what the workers want 5áed expecting them to pay more for benefits and would wipe out the raise t needs to up grade trains and the system. they are happy a third party is investigating the inquiry will take time from bargaining. a contract is the one thing they have been asking for since april. the good news there is no strike at least for now. this is the inquiry into the negotiations a three member board appointed by the governor will hold a hearing on the request for a 60 day cooling off period. that must commit a report in seven days. the governor will decide whether to authorize the

cooling off period. >> 6:04. we talked with the lieutenant governor after the news broke. the governor averted a strike and newsome said very little. >> when you make a commitment month to have a conversation at this stage which i'm more than happy to do and look forward to doing not at this moment. i appreciate you finding me and tracking me down but i want to fulfill my commitment that i made to both sides. >> he has criticized both sides in the bart labor dispute. the man who replaced him issued a statement on the mayor praised the governor for taking ca he took action in averting a strike. as we told you the governor stepped in two hours before the strike deadline ensuring that the bart trains will run for the next seven days. >> the trains are running again this morning but not everyone got the news that the strike

had been averted. who was running off an alternative form of transportation. alex. part of the plan was to shuttle people into san francisco and using large coach buses. and they showed up here a bit of a mix up for bart. rider recent pleased with what they found as the train were running the strike was on hold. the people i'm talking to this morning they got the news early on at leastment they found out before they went to bed. they were surprised and they were running this morning. and they spent a lot of time figuring out the way fos get around in the event of a strike. 400,000 or so riders used bart on average every day. people have been making plans to use the ferries, buses or the to car pool with people. a lot of people are pleased many wish they knew earlier.

good morning. westbound 80 lane of the bay bridge just west of the actual span are closed because of a fire. now we first started getting reports of this near treasure island. the truck was rolling along. it caught fire and ended up west 80 shy of 5th street. over 3rd street on the sky way. traffic is backing up. it's not technically on the

bridge but it is affecting all traffic coming across the bay bridge two hours you need to take bart. bart is running. take other routes into the city because this is a huge problem for your morning commute. that esnot going to get better any time soon. >> 19 american embassies are going to remain closed the rest of the week because of a possible terror threat. and from the news room, lawmakers are telling us some details about this threat. >> members say the nsa program is what picked up on messages being spent on operatives. analysts with the cia are scouring the databases and intercepts and web sites for clues. lawmakers say the final planning for an attack may

screens and some charred debris. you can see the balcony and it is completely gutted under it. it is just as bad and the fire started here at the first floor apartment unit and a man was cooking and left oil in a pan unattended. the kitchen was on fire. the alarms activated and they ran out but the fire and smoke spread to the second floor and traveled to the next building a woman who lives there said her daughters and her grandson were sleeping in a bed when the windows above them blew out because of the flames. >> and we're alive. i'm glad nothing happened to them. but she heard the people scream f she didn't they would have saw the glass on them. >> reporter: it took the firefighters an hour and a half

to knock down flames. three received smoke and water damage. officials are ruling the cause of the fire accidental d you can see where the blinds up there have melted a lot of broken glass and the fire actually again jumped between the two buildings and here you can see the damage of the car and parked near the fire, the red cross is helping the people displaced among them 12 adults. and they are trying hotel rooms and spending money for the next several days. live from san jose. a house fire in oakland is being investigated. that started about 4:00 this morning. 79th efficient and holly street. six people were in the house at the time. two of them suffered from smoke inhalation. they put that fire out quickly. no word on the cause.

the time is 6:47 a suspect is in fire after a man stabbed a worker several times. and it happened yesterday morning at oliver's ace hardware. they found the victim a man lying near the doorway. and they found the man in a nearby home. the victim was taken to the hospital and he was pronounced dead. investigators are identifying the victim of the san jose 30th homicide this year. a 19 year old kim weirly joyce was shot early on saturday morning riding in the car. it happened 1:20 near south second and east san salvador street. the shooter was outside of the car. the driver and the man was not

hurt. and. an inquest into the man killed by walnut creek police will start this morning. and officers shot a 22 year old tony banta on december 27th. police say that he charged at them with a knife. the family says that an officer fired in a panic after reacting to others officers falling behind him. a police officer shot and killed an armed 14 year old boy. police say they shot him yesterday because he pointed a gun at officers and refused to put it down. police say that the video shows shots at a group of men minutes before police. and they heard the shots last year. he is charged with attempted murder in the shooting of a boy. they were later dropped. time now is 6:49. and a-rod may be suspended today. someone familiar with the deliberations over his possible suspension tells the ap it will
