www.ktvu.com has special section dedicated to the 50th anniversary of martin luther king speech. a in san francisco began deliberations in the case of a former sheriff's deputy who is accused of carrying out illegal dui spinnings. stephen tanabe is accused of setting the men up. he did it to help a private investigator working for the men's wives in divorce cases. he is charged with conspiracy, fraud and extortion. we know the name of the man who was shot and killed yesterday by police officers. >> you could hear the gun shots sent to us from a viewer. he led them on a chase on hillcrest avenue yesterday afternoon. the chase ended when he lost control of his car and ran. police say he was carrying a

gun. officers opened fire after he pointed the gun at them. no officers were hurt. police arrested a 25-year- old after a shooting near a elementary school this morning. officers responded to calls of gunfire and found the victim in front of a home. the victim was 26 years old. he was shot in the leg and hospitalized. police interviewed two people running into the school and determined they were witnesses. they arrested him a few blocks away. they also found a weapon. democrats rejected a plan by governor jerry brown to deal with over crowding in the prison system. the governor's proposal was dead on arrival. democrats opposed the early release and spending more money to move inmates into private prisons. a court ordered california to

reduce their population by 10,000 inmates by the end of the year. an increase in humidity is giving firefighters an edge as they try to gain control of the rim fire near yosemite national park. containment is now 23%. but the fire is still threatening thousands of homes and buildings. the burn area is estimated at 293 square miles with smoke reaching as far as reno and carson city, nevada. rangers closed a road till after labor day to accommodate fire crews and it now encroached on the hecht hetchy water shed. as a precaution the san francisco water department is increasing the amount of water pumped out of hecht hetchy to other reservoirs. hetch hetchy reservoir delivers water to 2.5 million people in san francisco and the bay area.

went up today. initially we were told two homes were destroyed. today firefighters said five me they say 10 more were damaged. the fire started along side interstate 80 yesterday and spread into a residential area. 50 people were evacuated from their homes. wind helped spread the fire but a chief told us that wasn't their only problem. >> behind us here we have cypress trees, we have palm trees. all are embers through the air. some land in some homes. >> the fire was under control by 6:00 p.m. last night but three crews spent the night there just in case. they had to respond to one flair up that was quickly controlled. investigators have been looking along the highway for crews but they still don't know what caused the fire. crews are scheduled to fog for mosquitos to stop the

we are continuing to count thousand final two hours till the existing bay bridge closes for good. ktvu channel 2 news crews are in contact with caltrans and the chp and we will keep you posted about road closures as soon as they begin happening. to a problem we have seen a lot. graffiti in san jose just as soon as the city paints over it. police say this is about more than just blight. tonight we have an example of how taggers can turn violent. only on 2, ktvu's janine de la vega spoke to a man who was beaten and hospitalized after he confronted taggers. >> right here is where i layed. >> reporter: one month ago he was beaten and left on the ground unconscious in his neighborhood.

the veteran lives close to the freeway and heard a sound in the middle of the night. when he walked towards the pedestrian bridge he spotted six men with spray paint cans dropping them on cars. >> i yeld at them to stop. yelled at them to stop. >> reporter: that is when they started beating him. >> broke my nose. dislocated my jaw. >> reporter: he says the case highlights why law enforcement is focusing efforts on catching taggers. >> we need to apprehend these folks. >> reporter: we found spray cans and graffiti near a bridge. the california highway patrol also noticed an increase and they have started a new task force that patrols over night looking for taggers. >> we have arrested 7 of them.

today. the national science foundation is awarding to tech bridge in oakland. they help girls with careers in science, technology, engineering and math. it served 4,000 girls with after school and summer programs. head start is a program for preschoolers but it is a casualty in the budget battle. ktvu's rob roth visited a school today and showed us what the cuts are doing to parent, teachers and students. >> we have to listen to our -- and? >> reporter: for these preschoolers in the head start program it is story time but the story of head start is a sad one. the sequester meant budget cuts across -- budget cuts across the country. this mother's daughter is one
