still in the 70s on the temps. a little low is forming. we're starting off with 50s and 60s. we'll go near 80 at noon but more of a west northwest wind. things are picking up. it will be cooler today and more of a westerly breeze. the humidity will go up. 57 seems popular. santa rosa and i take out very little in taxes so you get rewarded nicely. 62 in san jose. antioch. las vegas dealing with a lot of that. more on the way of fog, sun. it will be warm but not as warm. the wind has picked up in the delta also out at travis and some of the higher elevations. temperatures while still warm not as warm as yesterday. 60s 70s coast and bay. here's sal. >> good morning. we're doing pretty well as we look at some of these commutes.

starting off with a look at the toll plaza. really not a big delay at all. very light coming in to san francisco. the fog is there. the east shore freeway looks good. for the most part, we're having a very nice drive coming in from richmond to berkeley. if you are driving in san jose, northbound 280, traffic is clear. 4:30, let's go back to the desk. >> thank you. we are following breaking news of a deadly house fire in berkeley one mile from the uc campus. started about 1:40 this morning on oregon street. tara is live at the scene where one person has died. >> reporter: yes, we understand that was the man in his 50s. he lives on the third floor alone by himself. we're told that he was a smoker and would often burn candles. we don't know if that's the reason for the fire. fire investigator is on scene. he's going to, of course, let us know exactly what the cause is a

little later when the sun comes up. you can see right behind me here on the third story, that's where the fire broke out. and joining me live is jim. he was actually inside that building when the fire broke out. what happened? >> we were fast asleep and the next thing we knew, i think it was around 1:30, 1:40, the fire department bust in screaming we need to get our stuff and get out. we just grabbed whatever we could and we just ran out of the building. not everyday the fire department bursts into your bedroom. >> kind of scary. was it smoky? >> for us, we were on the lower floor. so not so bad. when we came out , it was hot. there was an inferno on the top floor. you can see the whole thing is destroyed there. yeah, it was burning pretty badly. >> we're glad you got out safely. thanks so much for joining us this morning.

we're on the 2400 block of oregon street. the fire broke out about 1:40 in the morning. we are waiting to speak to the battalion chief here. fire crews on scene wrapping everything up. the investigation portion of this fire starts. we're live in berkeley, ktvu, channel 2 news. >> also this morning, hundreds of firefighters are getting ready for another long day on the eastern slopes of mount diablo. the wildfire has more than tripled in size since sunday night. alex savage joins us now from the fire command center. we understand there were citizens moments overnight. >> reporter: there were. and speaking with the fire information officer a short time ago, the morgan fire has not grown in size since last night. fire crews essentially have this fireboxed in, there was a big scare for some of the people who live on the east side. want to show you video that shows a

large flare up that was triggered by strong winds at that time. the fire threatened to jump the containment line in that area. it nearly crossed over morgan territory road near marsh creek road and a number of homes. that's why there was so much concern on the part of firefighters and the people who live in that area. according to fire information officer i talked with this morning, no homes were burned last night. there is a mandatory evacuation order that remains in affect which is just outside of clayton. i'm told there were quite a few homeowners who stayed behind last night. an area of the fire that was thought to be contain suddenly reignited. spot fires are a real big concern when the winds pick up. >> this is the most wind we've had all day. anything that's still burning is throwing embers and that's the last thing we want is a spot across the line.

>> the morgan fire first broke out on sunday afternoon with the exact cause still unknown. so far it's burned 3700 acres of dry brush. thanks to a relentless era tack yesterday including retardant drops from a huge dc-10, the fire is 20% contained. crews feel like they are making good progress. much of the fire is burning up into the steep rugged canyons and crews so far have been able to steer those flames away from homes. live this morning in dublin, alex savage, ktvu, channel 2 news. >> evacuation orders remain in affect for 100 homes. want to show you a map where the fire has forced dozens of people out of their homes. outside of clayton in a remote area. the red cross set up evacuation shelter at the community library

in clayton. it will be open for at least two more day as. >> not all who have to evacuate are human. horses get spooked by fire. heather in walnut creek is taking them in. many people have brought their horses to get them out of harm's way. can hold as many as 20 horses in stables. in addition to heather farm, the contra costa county fair grounds is taking in animals, other people and animal hospitals in the area are offering to house the animals as well. some residents say they are not leaving. why this couple plans to stay put coming up at 4:45. the bay area air quality management district issued a smoke advisory. going out to people living in contra costa, alameda and santa clara counties. a viewer sent us this

refinery problems are being blamed for a spike in gas prices. jumped as much as 20 cents a gallon. gas averaging $3.98 in san francisco right now. $3.90 in oakland. $3.91 in san jose . problems with refineries are contributing to the high prices. >> 4:37. this morning we're learning the identity of a man found unconscious in union square who later died. a relative came forward to identify the man as 43-year-old manual gallegos. he had severe head injuries saturday morning. he had no identification on him. just keys. he may have been injured after some sort of fall. meantime, we are learning the identity of a woman killed outside a skating rink in antioch. amber abergain was

shot out the paradise skate roller rink after a fight broke out. two men were also shot and expected to survive. police have not made any arrests. >> talks between bart and unions are scheduled to get underway today with four weeks left to avert another strike. the two sides sat down together for the first time since the judge ordered a cooling off period. bart and unions are still far apart on pay, pensions and healthcare costs. those issues won't even be discussed until next week. >> the mediator set the schedule and they felt they weren't quite ready to negotiate. >> unions say they will call a strike if no deal is reached by october 10th when the cooling off period expires. >> apple is set to release latest iphone and possibly more than just one model. the coming out event will start at 10:00 a.m. at the company's headquarters. the so-called 5s

time now is 4:43. we're following breaking news out of san francisco where a fire damaged a section of bleachers at the america's cup pavilion. the fire started at 3:00 a.m. the cause still under investigation. we're hearing no one was hurt. >> pg&e will not face criminal charges from the state or san mateo county for the pipeline explosion. the deadline passed yesterday on the third anniversary of the deadly explosion and fire. 8 people died and 38 homes destroyed. could face possible federal charges. prosecutors have two more years to file. some of the homes destroyed in the explosion are still being rebuilt. 22 of

the 38 homes have been rebuilt or are in construction. all of the damaged homes have been repaired. pg&e announced it has settled the lawsuits for $565 million. >> funds are in place to finish a memorial to remember those who died on flight 93 during the september 11th attacks. has reached a $40 million goal to finish construction at the crash site in pennsylvania. the plane left from newark headed for san francisco on september 11th. honors the 40 passengers and crew members who fought against the hijackers and prevented a second attack. the 12th an versy of the attack is tomorrow. >> the cost to battle the rim fire in on yosemite continues to grow. officials say that fire fight reached $100 million. it has burned more than 253,000 acres and is 80% contained. the la times is reporting the costs

have been rising since firefighters continue to struggle with heat and dry conditions. nearly a dozen homes and 100 buildings have been destroyed. a news conference will be held to launch a recovery campaign for the rim fire. mount diablo state park isn't the only park closed today. allen rock park will be closed today. that park was closed over the weekend after fears extreme heat could spark a dangerous fire. today's decision to shut down the park has to do with the strain the mount diablo fire is putting on resources. conditions will be assessed daily and that closures could extend throughout the week. >> we continue our coverage of the big fire burning near the eastern slopes. mandatory evacuation order remains in affect for dozens of families. not everyone is waiting for the all clear to go home. last night we spoke to one couple who was tending to their goats and

chickens outside their homes. the mccords tell us they are staying put. >> until i see the fire coming over the ridge, we don't have to worry. >> i think we're going to be all right. the smoke is moving that direction. we're thrilled about that. >> emergency crews are also coming to the rescue of horses ands other livestock. the evacuation area is made up of ranches and rural houses. >> more than 700 firefighters are battling the huge flames near mount diablo. teams from across the bay area are on the fire lines. one fire house that was a few miles away was empty. station 11, one of four fire houses that was shut down due to budget cuts. >> definitely impacted the response. station 11 would have been part of that response.

80 westbound is off to a nice start coming out from the albany hill out to the macarthur maze. if you are driving to the bay bridge toll plaza, not a big delay. first hour or so where you can get a nice drive. you have a little bit of a window but not a big one. westbound 580 through livermore valley, this traffic does look good if you are driving over the hill. has been a nice drive and san mateo bridge, it does look good. 101 and 280. let's go to steve. >> thank you, sal. good morning, everybody. cooler today. a system moving in and allow the fog to lift a little bit. the good news for the fire temperatures coming down. it will be warm but not as warm as yesterday. the west wind picked up. 32 at mount diablo. they get a westerly wind and temperatures will not be as hot.

police in san francisco say early indication suggests a man who died after a fall, fell accidentally. 32-year-old kevin haze fell from pedestrian overpass over james town avenue on sunday during the 49er's game. witnesses say haze

appeared to be intoxicated. police chief says alcohol may or may not have played a role. it looks like a tragic accident at this point. the same day a railing collapsed at the raiders/colts game. two fans were injured there. one was treated at the stadium. the other did not appear to be seriously injured. the investigation is underway into a death of an infant. firefighters were called to the discovery years pre-school yesterday afternoon. they found a four month old child who was not breathing. firefighters could not save the child. investigators say there are no signs of foul play. >> tomorrow another round of mosquito fogging is planned. the spraying starts at 11:00 tomorrow night in milpitas and san jose. mosquitos tested in that area tested positive for west nile virus.

one human case of the virus. a woman came sick and hospitalized briefly and recovering at home. >> an ohio man who confessed on youtube to causing a deadly drunk driving crash is expected to enter a plea today. >> on june 22, 2013, i hit and killed vincent kilzani. >> admits to being drunk when he crashed head on killing a 61-year-old man. in the video, he says he will plead guilty and says the video is a warning to others not to drink and drive. if convicted, he faces more than 8 years in prison. she had only been married a week but a new bride is charged with murder after police say she pushed her husband off a cliff. jordan graham had been arguing with her husband and having second thoughts about the marriage. she reportedly told police her husband fell during a hiking trip. >> this morning, we're hearing
