happen just moments before that home burst into flames. >> and hundreds of firefighters near mount diablo gaining control of the morgan fire this morning. there was a bit of a close call late last night. why the flames threatened to jump a containment line. >> contract talks finally resumed. why another possible strike could be weeks away. >> will apple introduce a new iphone today? we'll tell you what's expect at the big announcement at the tech giant this morning. >> complete bay area news coverage starts right now. this is ktvu channel 2 morning news. >> good morning. want to take you out live to the mobile communications center for the mount diablo fire. very active scene out there. alex savidge has been on this story. he's going to have the latest on the fire fighting efforts in just a bit. it was a very intense night out there.

it is tuesday september 10th. i'm pam cook. >> good morning. i'm dave clark. first we're going to steve. how's it looking? >> it's looking cooler today. we have a little low forming helping to increase the fog from around 1200 yesterday to over 1800 now. also helped along by a delta breeze. 50s and 60s on the temps. i don't expect these to change too much. they are running warmer to the north bay. san jose will start off at 60. maybe patchy low clouds. going for a high downtown at 82. that temp has been coming down. today we're only going 65. mostly cloudy to start. overall, look for a lot of low clouds and fog and heading back to the coast. much more than yesterday. cooler inland. the wind picks up . not the low 100s or upper 90s. 60s, 70s coast and bay. update on your traffic with sal. >> right now we're looking good around the bay area.

i want to take you to some live pictures. interstate 880 in loek land does look good. no major problems. and by the way , the traffic volume is getting a little higher. we don't see any huge traffic jams just yet. we're also looking at the bay bridge toll plaza. traffic is busy in the middle lanes. those metering lights should be on soon. south bay commute looking good. slowing here and there. for the most part it's not bad. on 101 on the peninsula. and slowing on 8 80 southbound right here as you drive approaching winton avenue. that's the normal morning slow down. not a big deal. let's go back to the desk. >> we're still following breaking news in berkeley that's where one man died in an early morning fire right there. reportedly he was 50 years old and lived alone in a third floor apartment. the house is about a mile away from the uc berkeley

campus. and several students also lived in that building. >> i woke up in the middle of the night around 2:00 and heard screaming and yelling outside. i literally got woken up by the screams. ld us yet what caused the fire. neighbors say the man often left candles burning in his room. >> this morning, firefighters are slowly but surely making progress battling that huge wildfire in the eastern slopes of mount diablo. crews are surrounding the fire that started sunday night. alex savidge joins us night from the fire command center in dublin where a briefing is scheduled this hour. >> reporter: good morning. a total of about 700 firefighters are making solid progress on the morgan fire. we were told a couple minutes ago that a team of firefighters just returned here to the mobile command center, the base camp essentially for this fire fighting effort. these folks have been out overnight trying to build up the containment

line. the morgan fire is no longer growing in size. it stands now still at about 3700 acres burned. cal fire is supposed to release a newest mate sometime within the hour. crews have built a containment line around 20% of the fire so far. that containment number could go up as well throughout the morning. still, there was a bit of a close call last night. here's video from news chopper 2 that shows a flare up triggered by strong winds late in the night. this fire threatened to jump the containment line. crews were able to fight back the flames and didn't allow the fire to jump across morgan territory road where there are a number of homes and ranches on the other side. the fire reignited in an area that was thought to be contained. and even though there's a mandatory evacuation order in place for that area, a number of people remained behind. and crews say that was problematic. >> we're advising people it's best to get out of the area they

are living in so we can get fire equipment in. the time to evacuate is not when we're trying to get fire equipment in. it presents a hazard for the firefighters trying to get into the area. >> reporter: the morgan fire first broke out on sunday afternoon. hot, dry conditions spanned the flames. the exact cause of the fire is still under investigation. crews yesterday really gained the upper hand on this fire thanks to a relentless era tack that included drops on a large plane. there were water drops from helicopters as well. much of the fire is burning up in the steep rugged canyons of mount diablo. and crews have been able to steer the flames away. there was one structure that was possibly damaged by the fair. it was an out building connected to a communication's center up on the summit of mount

diablo. alex savidge, ktvu channel 2 news. >> this morning, evacuation orders remain in affect for about 100 homes. here's a map of the latest locations where that big fire forced dozens of people out of their homes. the evacuated streets are outside of clayton in a remote area surrounding trail ride road. the red cross set up evacuation shelter at the community library. it will be open for at least two more day as. not all who have to evacuate are human. horses get very frightened by fires. heather farm in walnut creek is taking them in. acting as animal evacuation center. many people have brought their horses to get them out of harm's way. and here's some more information on the animal evacuations related to the fire. in addition to heather farm in walnut creek, the contra costa county fair grounds taking

avert another bart strike. the two sides metaphor the first time since a judge ordered a cooling off period 30 days ago. the bart and union still far apart on issues of pay, pension and healthcare costs. those issues they won't even talk about them until next week. >> mediator set the schedule and they felt that the parties weren't quite ready to negotiate. >> the unions say they are going to call a strike if no deal is reached by october the 10th. that's when the cooling off period ends. >> happening today, apple set to make that big announcement and anticipation is building. the company is hosting an event where they are expected to release a new version of the iphone. janine joins us now with what we can expect. >> reporter: we are here in front of the apple store where you can see this color wheel. some tech analysts are saying the iphone may be introduced in more colors.

that's one of the many predictions being made. the mysterious invitation was colorful and said quote this should brighten everyone's day. tech analysts say the iphone 5s will be introduced which will be faster and may have a fingerprint scanner in it. the phone is only offered in the standard black or white. but gold is the new rumored color that may be added. also predict a cheaper version will be released without siri featuring a plastic case, and a lower end camera. >> something like that would probably appeal to me. i'm not tech savvy. but my husband wants the fastest and greatest and most innovative thing. it's easier for him. i don't know whether he would be interested in something that's plastic and slower. >> analysts seem to disagree on whether a new version of the

ipad will be introduced today but seem to agree a smart watch will not be revealed. most tech writers say apple will introduce the ios 7. a new operating system which will support iphones and ipads. talk apple launching itunes radio which could be similar to what pandora offers. the event today begins at 10:00 a.m. at apple headquarters. reporting live, ktvu channel 2 news. >> a former stanford hospital technician has been arrested accused of -- arrested david ira bradford. the female patient told detectives he fondled her on two occasions during brief stays at the hospital. detectives say they are not aware of other victims but encouraging anyone to call with information. today occupy cal protestors will reveal how they are getting ready against the university of california.

filed a lawsuit against uc berkeley demanding millions of dollars. the lawsuit stems from occupy protest on the cal campus in november 2011. police officers who came to remove occupy tents got into intense confrontation. claiming police brutality, false arrest and violation of freedom of speech. >> 6:10. stanford and uc berkeley are on a new list of the top universities of america. the list compiled has stanford tied with the university of chicago for 5th place. uc berkeley is ranked number 20. the list has princeton ranked number one followed by harvard, yale and columbia. >> for anyone who is curious, ucla right behind cal at 23. 6:11 is the time. animal abuse caught on camera. >> what the syrian government

channel 2 morning news. we have developing news this morning that could hold plans against syria. syria's foreign minister says the country accepted russia's proposal to place chemical weapons under international control. kyla campbell live to explain the skepticism from law makers. >> reporter: the white house and members of congress said they prefer a diplomatic resolution rather than military strikes and this could be what they've been waiting for. >> i am very skeptical. the fact is you can't pass up this opportunity, if it is one. but you've got to right away determine whether it's real or not. >> senator john mccain said international monitors should be dispatched to syria so they can secure them and keep president assad from using them.

this comes after syria's foreign minister said the country has accepted russia's proposal to place chemical weapons under international control in order to derail the u.s. aggression. president obama said yesterday this proposal could be a breakthrough. remains skeptical syria would follow it. could change the president's address to the nation tonight. and also scheduled to head to capitol hill to meet with senators today. there are hearings and meetings amyl teary reaction to syria. i'm working on that story for 7:15. kyla campbell, ktvu, channel 2 news. >> this developing story this morning. and you can watch the prime time address right here on ktvu channel 2 tonight at 6:00. uncertainty about a military strike in syria and refinery problems are being blamed. prices jumped as much

as 20 cents a gallon since the end of august. gas is averaging $3.98 in san francisco right now. $3.90 in oakland. problems with refineries are contributing to the high prices. >> time now 6:16. a new report says most inmates who were released early under three strikes law have not been rearrested. about 1,000 inmates have been released under proposition 36. of those who were released, only 2% have been arrested again. that's compared to the statewide average of 16%. the report was released by the stanford law schools and the naacp fund. a congressional hearing will focus on the congress between state and federal marijuana laws. that hearing was requested after erik holder announced changes to federal drug policy last month.

holder announced federal authorities will no longer interfere while the states adopt medical marijuana laws. the judiciary committee will hear opinions for and against legalizing marijuana. >> 6:17 is the time. let's check in with sal. how's the commute? >> looks good. i would say even though it is getting busier, not all that bad. don't have a lot of problems out there. bay bridge toll plaza westbound. there's a back up here in the middle lane. not all that bad. in the middle lanes, i should say. there are no major problems. i think people are getting used to that new span. that first day was incredible. we've moved on from that. taking a look at the commute if you are driving on san mateo bridge. traffic looks good. it has been a nice drive. we continue to focus on the santa clara valley. there's a little bit of slow traffic on

northbound 101. for the most part, nice drive. and 101 looks good. let's go to steve. >> thank you. a very good morning. cooler today and tomorrow. fog bank is much bigger today. a little locuming in. tomorrow sunny and breezy. thursday and friday a quick warmup. down by the weekend. roller coaster right here . temperatures 88 in san jose. oakland was 79. livermore 102. today 82. still warm but significantly cooler. fire conditions, what's interesting here is the last observation was at 3:17 a.m. from the remote side. wondering if the fire is playing into the sensor. i haven't seen anything in three hours. the last check was 76. i think it's down to 22. humidity 20%. there is definitely a stronger westerly breeze today.

temperatures will come down. we'll start off at 80 at noon and northwest. and 88 today. down a good 10 to 12 degrees. the wind is not great but at least it's west and not east. 60s or 50s on the temps. i don't think they are going to change. fairfield, 23 miles per hour. much stronger than yesterday. and any gusts 25 to 30. higher elevations yesterday, hardly anything. low clouds are back and making a bigger push today. 56 in reno. and 63 out in sacramento . look for cooling trend to take place. you can see signature the low right there. help usher in a breeze. fog, sun, warm. not as warm. cooler inland and around the bay. the fog bank is increased. still hot up towards clear lake. santa rosa, low 80s. napa. san rafael. low to mid 930s. antioch, brentwood. berkeley at 70.

officers connect to state and federal criminal databases in just seconds. getting that information quickly can help keep the officers safer in the field. >> there is a huge significance to the passage of time and that can mean the passage of seconds in terms of that officer's own safety as well as the safety of the community. >> now, 600 police officers are testing out that app right now. it's getting positive reviews. san francisco police chief says all the officers will be trained on that app by the end of the year. >> ready or not, flu season is getting closer. and this year's flu shots are ready to go. the makers of the flu shots are sending out their stock to clinics and doctor's offices. more than 135 million doses are being produced. large supply should be available by later this morning. the cdc says everyone six months and older should get a shot no later than october. the u.s. secretary of

education is threatening to withhold federal funds from california schools. this comes in response to a new law proposed by state law makers. if it passes, students would start taking standardized tests. for one year, scores would have to be suspended. it's the lack of test scores that's stirring up the controversy. the law is awaiting a full vote of assembly and state senate. firefighters are beginning to win the battle against the huge wildfire on mount diablo. cal fire holding a briefing this hour. >> reporter: a deadly two-alarm fire. who made it out alive and who didn't. >> good morning. right now traffic is getting a little busier especially at some of the key commutes. how long it's going to take you to cross the bay bridge. >> a lot more in the way of low clouds and fog and cooler pattern. how much cooler plus how long this will last as well.

>> thank you, pam and dave. we have a cooler pattern coming back in. yesterday fog was around 1,000 feet. yesterday it's up, up, up. that really helps it make a push inland. 57 continuing. 59 san jose. maybe some patchy low clouds to start. 72 at noon. a high today downtown. a little warm. probably about 86. san francisco will go 65. the fog is back. a couple reports coming in. super foggy. for some, a great day. not as hot. 60s, 70s by the water. here's sal. >> just getting word of some power lines down. just listening to that on the radio. let's go out and take a look at some of the key commutes.

this is a look at 880 in oakland. the traffic is moving along nicely. by the way, the toll plaza, we have a back up. the metering lights are on. it's 15 minute delay before you get into the city. no major problems by the way. we have wires down. i want to -- i think i'm going to be able to get if i can play it. i'm having trouble with my maps here. please allow me to see if i can get this on. maybe not. let's go to you steve. >> all right. we'll pick it up from here. time is 6:32. still following breaking news . one person has died in an early morning fire there. tara moriarty has been there since 4:30 this morning. we know several uc berkeley students lived in that same building. >> reporter: actually, there was one uc berkeley student. she was a grad student here.

all of them were shaken up. waited out here to make sure everybody made it out safely. sadly, one person did not. he lived on the top floor. the roof is basically gone there. investigators are trying to figure out what sparked a fire there. there are quite a few holes. crews are going to wait until it gets lighter out. the fire broke out about 1:30 this morning near region street where about a mile from the uc berkeley campus. woke up to screams, police knocking on doors. they grabbed what they could and ran out. they realized the man on the third floor described as being in his 50s had not made it out. >> when all of the tenants came out, we were like where's andrew? we don't see him. oh, no, he's probably still up there. eventually, i guess maybe 15, 20 minutes later, they took him down, rescued him and took him to the hospital. and i heard he passed away.

>> reporter: the two alarm fire started on that third floor apartment. neighbors say they would frequently see candles lit. the victim was also a smoker as well. this is a 7 unit building. one person at uc berkeley grad student as we mentioned, all residents are staying with friends right now. the damage is extensive. looks like the tenants are out for a while. we're going to tell you about an extra challenge firefighters face in trying to rescue that man from third floor. i'm tara moriarty, ktvu channel 2 news. >> this morning, firefighters are gaining ground on the huge wildfire of mount diablo. 700 firefighters are now surrounding that fire. started sunday afternoon. alex savidge has been on this story since the beginning, live from the fire command center in dublin. >> reporter: good morning. we got new figures from cal fire. the containment here has jumped to 45%. that's the new number

we just got a short time ago. and cal fire did some new mapping on the edge of this fire. and they now are putting the burn area about 3200 acres. that's actually down from yesterday. so the size from this fire is down. later on today a short time from now, a new contingent of firefighters will be heading out trying to build up containment lines as they have been doing throughout the night. there was a bit of a scare that happened last night on the eastern edge of this fire. the fire flared up because of sudden strong winds and the flames threatened to jump a containment line. crews were able to fight back the flames and the fire wasn't allowed to cross over morgan territory road. quite a few homes and ranches on the other side of the road. some people who were ordered to evacuate had stayed behind there. this flare up shows the fire is a real threat and firefighters have a difficult job in front of them.

>> to improve containment line, we start mop up. gives us more space between the area that's burned and the area that hasn't burned. >> reporter: the morgan fire broke out sunday afternoon. the exact cause of the fire is still under investigation. crews really got the upper hand on this fire with an era tack that included retardant drops from a large dc-10 airplane. and helicopters doing airdrops as well. right now most of the fire activity is up in the steep rugged canyons burning away from where most of the homes are in this area. a lot of homes and ranches just outside of the clayton area still are under evacuation order at this time. but the fire burning away from those homes and crews feel good about the progress they've made so far. the containment number has jumped to 45% this morning on the morgan fire. live this morning in dublin, alex savidge, ktvu channel 2 news. >> 6:36.

this morning, evacuation orders still in affect for about 100 homes just east of mount diablo state park. the latest locations has forced dozens of people out of their homes. the evacuated streets are outside of clayton in a remote part. red cross set up an evacuation shelter at the community library. going to stay open for two more days. >> san jose's allen rock park will be closed today due to increased fire danger. closed over the weekend due to fears extreme heat could spark a fire. today's decision to shut down the park has to do with the strain the mount diablo fire is putting on resources. conditions will be assessed daily and closures could extend throughout the week. 6:37. a san jose pre-school is in mourning today after the death of a baby. brian flores joins us now to explain whether police consider the baby's death to be

suspicious or not. brian. >> reporter: yeah , police and the coroners continue to investigate, pam. good morning to you. behind me is the discovery pre-school here in san jose. we're not sure if it's going to be open today after a four-month old baby died yesterday afternoon. we don't know the exact cause of how the baby died. what's being reported is a staff member here saw a four month old child was not breathing yesterday afternoon. that staff member called 911 pretty quickly. firefighters were the first to arrive. after several attempts, they were not able to save this baby boy's life. the chaplin was called after that. i just got off the phone with the coroner's office. they will be performing an autopsy. i did ask if it appears to be suspicious. at this point it does not appear suspicious. they are still working on a cause at this point. but, again , that autopsy scheduled for today or tomorrow. according to san jose police as well, does

not appear to have signs of foul play. police continue to investigate, however. cause of death expected to be released within the coming days. brian flores, ktvu, channel 2 news. >> time is 6:38. a new bill regulating sex offenders at schools it's been signed into law thanks to efforts of parents. require schools to notify parents at least two weeks in advance if a registered sex offender will be on a school campus. the law comes after a convicted sex offender volunteered at a festival sat saint francis cabrini perish. parents were angry finding out the man had permission to be at the event. $500 reward is being offered to find a woman accused of abusing dogs. take a look at this video taken by a private investigator who happened to be in the area. shows the woman violently yanking then kicking three dogs she was walking in south san jose yesterday.

the video has been turned over to the police. san jose animal services has begun an investigation. >> what stopped you from saying something to her? >> it happened in the course of maybe 3 or 4 minutes. i was trying to get some evidence. >> police say they will be out in that neighborhood today trying to find that woman seen on the video. if you have any information about her, call san jose police. >> the new bay bridge has a good luck charm. crews have installed a new bearded trol. modeled after the famous bay bridge troll. an unknown artist created the new troll which was placed in an undisclosed location. crews removed original trol on labor day. it will likely be housed in a mu is he um or park. cal trans setting up a timetable for tearing down the old bay bridge. demolition

cooler pattern today. also more on the rain which won't stop down in las vegas. i'll show you that in a second. mark, one of my twitter weather observers say it rained everyday there. not something you hear often. we have a bigger fog bank today. yesterday temperatures topped out. i promise cooler today. 102 in livermore. i know some of you like the warm weather. 115, i think he'd be happy. i'm serious. 82 in san jose today. 72 in oakland. 81 in napa. and livermore 90 today . 50s and 60s. 60s on the lows. mount diablo was 73 and jumped up to 76. this is about an hour old. it is west around 22 to 29 miles per hour. humidity 23%. 73 to 76. will be cooler still warm but not as hot as yesterday. 80

at noon and 88 at 4:00 today. west at 20. i think temperatures coming down a good 10 or 12. helped along by the fog bank and westerly breeze which has kicked in. 60s on the temps or 50s for many. fairfield goes from 5 to 7 to 23 today in 24 hours, that's a sure sign. some of the higher elevations are over 25 as well. low clouds and fog starting to thicken up. it's lifted. i can see the ocean. that's because the base has gone from 1200 feet to 1800 feet. a little damp for some. couple reports coming in. it just keeps going . there's a low there wrapping back in towards las vegas and continues to rain. also on the desert of california. very active pattern there for a while. for us, a couple days of cooler weather. still warm but not as warm. cooler inland and the wind has picked up in the delta but the higher elevations. always takes another day or two for clear lake to cool down or vacaville.

welcome back to the ktvu channel 2 morning news. a lot of waiting this morning. dow jones up 90 points. some of the spheres easing over strike, waiting for apple announcement. the dow, nasdaq and s&p all up. >> preliminary investigation indicates a man who died in a fall on sunday outside of candle stick park fell accidentally. medical examiner said 32-year-old kevin haze fell off a pedestrian overpass during sunday's 49er's game. witnesses say he appeared to be intoxicated. san francisco police chief says alcohol may or may not have been involved. but it looks like a tragic accident. that very same day, two fans were hurt when a railing collapse at the raiders/colts game. the fans did not appear to be seriously hurt. new information on a fire

in sonoma county that burned a pallet factory on sunday. look at this. the fire caused $2 million damage. making it one of the worst commercial fires in the county's history. it started along highway 121 south of downtown sonoma. it spread to a pallet factory and several rvs. think the sparks from chains on a tow truck may have started the fire. >> pg&e will not face charges from the state or the county because of the pipeline explosion. the deadline passed yesterday on the third anniversary of the deadly explosion and fire. 8 people died, 38 homes destroyed. pg&e could face possible federal charges. prosecutors have two more years to file. three years later, some of the homes destroyed in the pipeline explosion are still being rebuilt. 22 of the 38 destroyed homes have been rebuilt or are in construction. all of the damaged homes have been repaired.
