county, colorado. good afternoon. i'm tori campbell. the clock is ticking and we are now less than a month away from another possible b.a.r.t. strike. ktvu's sal castanedo joins us live from oakland as negotiations get underway between b.a.r.t. and one of its unions. good afternoon, sal. >> reporter: tori, good afternoon. right now, b.a.r.t. is at the table with seiu. they are talking about work rules and things that don't have much to do with salaries or pensions. but that will change next week. this is a preview to tense negotiations that will be over money, many view this as. b.a.r.t. has yet to send a response to the offer on the table. b.a.r.t. says it has addressed safety concerns to the satisfaction of several government audits. >> our security programs have gotten the gold standards from the tsa. safety is just a smokescreen.

they don't want to talk about the fact there want 20% in pay, an -- they don't want to talk about the fact that they want 20% increase in pay. >> i was here when we lost two of our workers, members of our union. >> reporter: the strike in july lasted for four days. it had some 400,000 widers scrambling to find other ways to get to work. in august, governor jerry brown got a judge to impose a 60-day cooling off period. those 60 days are up october 11th. transportation experts say if the strike happens, we'll see even bigger backups, more crowded buses, and ferries. live in oakland, sal castanedo, ktvu channel 2 news. developing news now out of

northern colorado where flash floods have left three people dead. the waters are keeping rescuers from reaching stranded people. tara moriarty is live in the newsroom with more including a dramatic rescue. >> good afternoon. we'll show you the video in a minute. people who live in colorado say they are stunned, rockslides and flash flooding have taken out homes and put dams at risk forcing hundreds of people to evacuate. boulder county has been the hardest hit area with up to 6 inches of rain falling over a 12-hour period. a 20-foot wall of water was reported north of boulder. there have been many 911 calls for help. some dramatic video we want to show you a man submerged in a car was caught on tape. he was one of three drivers trapped when rushing water washed out a road. >> the road was eroded from all of the raining through the drainage area. so we're able to save the lives in the cars. there was a victim in each car.

>> this was a devastating overnight storm in the dark. i anticipate as the day goes on, we're likely to find other people who are victims of the storm. >> reporter: volunteers are trying to help stranded people until emergency crews can arrive because so many roads are impassible. an emergency official says one person died when a structure collapsed in jamestown. in colorado springs, police found another dern dead on the west side. a state of emergency has been declared. thousands of residents are urged to stay home and off of the roadways. the university will be closed through friday due to severe flooding. water damage has been reported in several buildings on campus and crews are working to assess the potential safety hazard before the campus reopens. we'll keep you posted on this developing story. live frpt newsroom, i'm tara moriarty, tori, back to you. >> thank you. right now, we have exclusive new information on a

story we first told you about on "mornings on 2." a man is in custody in connection with a theft that was caught on video. only on 2, claudine wong reports he may be behind a rash of crimes in other cities. >> reporter: it all started with this -- a laptop theft captured on video. a crime lasting just about nine seconds. watch as this man walks up to this t-shirt store, looks in, and then runs in, grabs the laptop and takes off. >> i looked up and i saw someone dashing out of the door. >> reporter: and just like that, he was gone. another man taking off with him. >> they made a bolted straight across into a getaway car that they had parked waiting at the corner on the freeway ramp, to go right on 580 westbound. >> reporter: this case took a major turn just before 7:45 this morning when at 34th and san pablo, a veteran oakland police officer made a stop and made contact with the man inside. he quickly realized that this man was wanted in connection

with last night's laptop theft. but then as he started looking deeper, the picture got deeper. >> we do believe this will be related to multiple crimes from robbery to theft and we believe that we have one of the individuals, one of the primary individuals responsible for these crimes in custody. this is a large due in part of great work. >> reporter: great police work that led them to call other agencies. el terel cerrito police say he may be connected to other laptop burglaries and berkeley said the same think. police asked us not to show too much because of the ongoing investigations. the nine seconds caught on camera were a small part of a much bigger story. in oakland, claudine wong, ktvu channel 2 news. benicia police released

images of a bank robber wearing a moo moo who held up a bank yesterday. he handed the teller a note but did not use a weapon. she gave him cash but police won't say how much. he was last seen running through a parking lot next door. now to the morgan fire burning on mt. diablo. it's been burning near morgan territory and marsh creek roads since it broke out sunday afternoon. firefighters have made huge gains on a fire that's almost completely out. they are putting out smoldering embers and flareups. according to calfire, the fire is 90% contained. full containment is expected tomorrow. just over 3200 acres burned. all evacuation orders and road closures have been lifted. however, mt. diablo state park remains closed. it could remain by monday. the focus now will be on preventing erosion and mudslides during the rainy season in the burned areas of

mt. diablo. the state park service will rehabilitate the mountain and repair trails and replace veg takes destroyed by the fire -- vegetation destroyed by the fire to help prevent erosion. >> we have to re-seed the soil. the vegetation's cut off. what was not burned off, we have to make sure the oil won't wash away with the first rains. >> the park service is looking for the bare spots on the mountains so it can be covered with biodegradable sheet sheathing. in shasta county, the number of homes destroyed is at least twice. officials say 68 homes, 128 outbuildings have burned down in happy valley. one death is blamed on a fire. firefighters found the body of brian henry in a motor home after he refused to evacuate. the fire has burned since

a number of developments today in our continuing coverage of syria. the united nations has received a letter from syria saying it plans to join the treaty which bans the production, stockpiling or use of chemical weapons. secretary of state john kerry is in again knew vau where he plans to meet with russia's foreign minister about syria. this comes on same day that vladimir putin wrote in the new york times, to americans be careful about operations in syria. if you have an iphone, you can help catch sexual predators. the federal department of homeland security released an iphone app that lists suspected predators that prey on children. it's available for free on itunes and has video, suspect

information and the person's last-known whereabouts. people can use the app to supply anonymous tips to authorities. >> for us, kind of the next logical step to contact the public directly and get the assistance of the population out there. although the app is available only for iphones right now, the department of homeland security is working on a version for other smart phones. two teens are recovering after being shot while standing in their front yard. east palo alto police are searching for the shooter but they say they believe they know what sparked the shooting. here's more. >> reporter: this 16-year-old is on crutches after a bullet went through his side. during an interview with us, he started to bleed. he didn't want to show us his face but recounted how he and his 17-year-old brother were shot at 11:00 last night. >> we were smoking a cigarette

and the car stopped right there where your guy's truck is. as soon as we looked and said who is that, he started to shoot at us. >> reporter: police say 23 rounds were fired at the boys hitting both as well as the house. the shooter left in a silver newer model honda. after getting patched up, the teen left for school but several hours later returned because of the pain. >> it hurts. it's the worst pain i ever felt in my life. never been shot before. don't want to get shot again. >> reporter: police are reinterviewing the victims and using the evidence to try to track down the shooter. the window of the family car was shot in a shooting over labor day weekend. police think there's a connection. >> prior to that, there was a shooting. not to go into too much detail, it could be a retaliation for what happened in menlo park. these individuals could somehow be related to that. >> reporter: investigators say the two teens are listed as gang members from redwood city,

but the 16-year-old told us he no longer is. but he had this to say about his brother -- >> maybe he will come to realize he's putting other lives at risk. >> reporter: police want anyone with information to call them. janine de la vega, ktvu channel 2 news. governor brown says he supports raising california's minimum wage. the governor says the minimum wage has not kept pace with rising costs since this was last adjusted six years ago. right now, there's proposed legislation to raise the wage from $8 to $9 an hour beginning july 1st, 2014. and a second increase in 2016 to $10 an hour. enrollment at california's community colleges is expected to increase for the first time in years. college officials are crediting proposition 30, which was approved by voters in november, for the bump. they say the tax measure is allowing schools to restore course offerings. the state's community college system is expected to add about 60,000 students this year.

this will be the first enrollment increase since 2008. san francisco city officials broke ground this morning on a new affordable housing project in chinatown. it's located on prodway between samsung and battery street. the project includes 75 apartments plus retail states. >> so this is i think just a beginning. 75 units affordable housing but 18 of those are gonna be dedicated to homeless. that's incredible. those individuals need to be helped in this city. >> mayor lee said the location of the project is important because it will give the people who live there access to the central subway once it's built. one of the most successful sailors in olympic history is moving into a new position on oracle's team when the america's cup races resume this afternoon. ben ansly has replaced john

the birds, three crows and one scrub jay were found in antioch, concord, danville and la fayette. west nile virus is transmitted through the bite of an infected mosquito. so far this year, two people in contra costa county have come down with the disease and 117 statewide. six have died. well, we started out with another day of overcast, partly to mostly cloudy skies out there. the clouds are beginning to lift a little bit out to the golden gate. now we're talking about a dense marine layer, a shallow marine layer with some dense fog. the clouds are lifting enough to mix out. as a result, we have a few breaks in the overcast. may have heard about the extreme flooding in parts of boulder. you can see the flow from albuquerque towards parts of colorado. we have a dry weather pattern here in the bay area as you can see. most of the state son the dry side -- is on the dry side. there's the breakout near the golden gate bridge and the over cast near the bay itself.

of september. but at least over the next five days. looking stable. >> thank you mark. >> sure. grocery stores in berkeley could be forced to label all genetically modified produce. the city council voted to look into the requirements. in the last election, california voters rejected the proposition that would have required all grocery stores in the state to gable gmos -- to label gmos. in berkeley, 70% voted in favor of the store. whole foods is being claimed by the state of california claiming they are telling foods with pesticide not registered with the state. the state says to sell a pesticide product in the stores, the company must register it with the state to be tested for safe use. the agency says whole foods has not done that. whole foods says it cannot comment on pending issues.

stock market mostly leer in early afternoon trading today as. traders are continuing to watch developments in syria. as one investor said it's really starting to tee escalate with the hope of a diplomatic solution. the dow is down 20. the nasdaq is also down 7 and s&p is down 5. the federal trade commission has begun an inquiry into facebook's new privacy policies are in line with an agreement it made with the ftc. under the deal, facebook must get explicit permission from users before it can tuesday their information in advertising. the ftc says facebook has changed the wording on its privacy notice but it's not clear its changed its policy. the powerball jackpot just
