popular school monitor. what we were told outside of the courtroom. good afternoon. i'm tori campbell. topping our news, a scary sight this morning as the window washers' empty platform dangled high above san francisco city streets. the incident closed streets and prompted evacuations. happening now, the area is once again returning to normal. tara moriarty is live on san francisco's embarcadero to tell us what crews had to do to secure the area. good afternoon, tara. >> reporter: good afternoon. this was quite a scare for folks in the financial district walking around. they look up, as you can imagine, this scaffolding dangling from the 41st floor. you can see the building, the one with the flag on top right there. this all happened around 7:00 this morning. passersby noticed the unit hanging unsafely from one embarcadero center on the 300 block of clay street. now, as a precaution, police closed battery between

sacramento and clay. they also shut down the 28th through the 30th floors of the high rise. onlookers said it was kind of a frightening sight, especially on friday, the 13th. about 7:15, i came outside and heard sirens go by. walked outside and saw the rig at an angle that was not correct for theaway these rigs operate. >> i don't believe it was because it's friday, the 13th. i believe it's an unfortunate situation that happened. i'm happy everybody is okay. >> reporter: crews were able to secure the rig within three hours. one of the firefighters pulled a spiderman stunt. he was lowered on the side of the building, then he grabbed ahold of the runaway scaffolding. talk about nerves the steel. this is so high up there. traffic was impact for the morning rush but cars and pedestrians were all rerouted. the good news, absolutely no one was hurt. live from san francisco, i'm

tara moriarty, ktvu channel 2 news. >> all right. thank you, tara. a san ramon starbucks will not be opening for business today after being damaged by a fire. it started after 4:00 this morning at the starbucks near the crow canyon common strip mall on crow canyon place. when firefighters arrived, flames were coming from the back of the coffee shop. smoke was coming from two neighboring businesses, a restaurant and a bank. extra police had to be brought in to secure the area. firefighters had to bank in to see if the flames extended into the businesses. >> we made access to the bank and that business and cleared out the smoke and found there was no fire in there, it was just a smoke extension, no fire extension. >> the banks and restaurants sustained smoke damage. no one was injured. the cause of the fire is under investigation. a homeless man is now in jail accused of starting a grass fire yesterday that forced evacuations in san anselmo.

newschopper2 flew over the fire scene shortly after the fire started along sunnyhills drive. authorities say the man tossed a match setting off the fire. police arrested him a short time later. the cost of fighting that huge morgan fire on mt. diablo this week has soared ie millions of dollars. calfire announced today that more than $4.5 million has been spent battling the fire. 452 firefighters are still on the scene. the 3100-acre wildfire is now 95% contained. calfire investigators have determined that illegal target shooting sparked the fire but no arrests have been made. and calfire expects to fully contain a huge wildfire in shasta county sometime this weekend. the clover fire outside of redding has destroyed at least 68 homes. sheriff deputies say one man who refused to leave his home died in the fire.

one volunteer fire chief has been flighting the flames all week, chief adallas, even raced to save one moment moments after learning he lost his own house in the wildfire. >> at that point, i wasn't not thinking about my house. i was making sure that one didn't burn. there was nothing in my mind but saving that house i was on. >> the fire in shasta county has burned 8,000 acres since it started on monday. a 26-year-old man is in custody after leading police hon a high-speed chase through a north bay neighborhood. the chp says he was under the influence and it's not the first time. claudine wong spoke with a passenger in that car to find out what happened. >> reporter: it all ended in the yard at this home just of a 3:00 this morning. the car took out a stop sign and a fence, but the chp says the house was saved by the tree. the driver, 26-year-old patrick mcguire, can be seen in the back of this police car.

we found the passenger sitting on the curb. >> turned too tight and then the next thing we i know, we're in the back of the house. >> reporter: were you guys drinking? >> i'm a christian, i don't think. >> reporter: was your buddy drinking? he was driving? >> i can't comment on that. >> reporter: the chp says the car was driving at more than 80 miles an hour one 101 and even after exiting attempts to pull them over failed. >> continued through the residential district at about 60, 6 a miles an hour, running stop signs and -- 65 miles an hour, running stop signs and then crashing into the home. >> reporter: into the home of nick deeden inside with his wife and daughter. >> very loud. i mean, three, four blocks, people can hear. >> reporter: the chp says alcohol was found inside the car including a bottle that said saving lives one beer at a time. mcguire has a history of dui.

he was convicted in 2007 and then in 2011. he's facing felony, dui and evasion charges. >> mistakes you make and you look back on them and wish you had not made them. >> the owner said he's loved the tree and he loves it more today. >> he says coming back from this won't take that long. but as for the driver who caused this, it's road looks to be a lot longer. claudine wong, ktvu channel 2 news. a federal appeals court in san francisco has upseld barry bonds' obstruction of justice conviction. the conviction was in connection with the case probing the balco steroids scandal. the 9th circuit court ofate peels ruled that -- of appeals ruled that his testimony was evasive and he was testifying about whether his trainer ever gave him performance-enhancing

drugs. bonds faces 30 days of home confine, two years of probation and a $4,000 fine. a new police report shows a surge in crime in berkeley over the first six months of this year. the report shows robberies are up 25%. and burglaries rose 34%. there have been four homicides so far in berkeley. there were five for all of last year. the chief plans to present the findings to the city council saying this shows the need for more police officers. a defendant in a murder case appeared in court. janine de la vega is live outside of the courthouse in san jose where family members of the victim are looking for answers. good afternoon, janine. >> reporter: good afternoon, tori. well, tives of rena figueroa wanted to be here at superior court to monitor the progress of this case. but there wasn't much movement today. they still don't know how she was killed because the case has

been sealed. the suspect was assigned to a public defender and that person still needs a couple of weeks to review the case before a plea can be entered. he's been charged with murdering figueroa. her body was found in her minivan several blocks away from her home. police say the two knew each other. her son says that he went to the same church and had children where his mother worked. but they were not friends. >> i just want to see that justice is servedded a and that -- served and that he basically pays for what he did. i don't know to know that he's just let go easily. >> reporter: figueroa worked at the school monitor for the past 12 years at olinder. a memorial service was held earlier but her family is taking her remains to mexico to

be buried. she leaves behind a husband and two sons. he will be back here for another hearing in two weeks. janine de la vega, ktvu channel 2 news. >> lu, janine. there's word of a possible labor agreement for san francisco police officers. the examiner reports the deal includes a multi-year 5% pay raise for most of the police force. at the same time, new recruits would face a possible pay cut. city supervisors are expected to give final approval on the deal next week. the nationwide food distributor known as united natural foods has chosen gilroy to open a new center. gilroy's mayor says the company will open a distribution warehouse in mccarthy business park on highway 152, east of 101. it promises to bring about 500 new jobs to gilroy and may open by the end of next year. united natural foods has dozens of other centers across the united states and canada.

the san jose earthquakes may have to wait longer to play at their stadium. there's a new delay in construction that may back the debut for a full year, until the start of the 2015 season. the team is expected to make an official announcement about the delay on monday. the earthquakes originally planned to we locate to their stadium near mineta international airport by the start of next season. the giants plan to help a fund-raiser for injured fan bryan stow. the event takes place on september 24th at at&t park in the game against the dodgers. $10 for every ticket sold will go to the brian so fund -- to the brian stow fund.

in koles's flood zone, the death toll is -- in colorado's flood zone is three. floodwaters cut off the road. president obama signed a disaster declaration for the state. the governor is asking people to stay off the roads and away from the water. >> you have toke recognize this water is filled with debris and -- you have to recognize this water is filled with debris and a foot of water can knock people over and you can be swept away. >> yesterday's rains brought floods to communities on the eastern side of the rockies. meteorologists say the rain should ease off today but may pick back up this weekend. as firefighters begin to mop up, investigators are looking for the cause of the massive wildfire that hit the

boardwalk yesterday. the remains of 50 businesses continue to smolder. the fire started in a yogurt shop. this area just recovered from tropical storm sandy a year ago. governor christie promised not to get the fire undo the recovery work of the past ten minutes. as many as 37 people died at a fire in a psychiatric hospital in northwest russia. the health ministry said 59 people were in the building when the fire started. it was apparently started by a patient smoking. secretary of state john kerry and his russian counterpart are wrapping up tense talks in geneva, switzerland on syria. they've been meeting for two days about removing syria's chemical weapons. both kerry and sergei are hoping they can work together. >> we're beginning on this

fencershibe led the response to a.i.d.s., h.i.v. dr. sara koti will serve as interim officer until a permanent replacement is named. the minimum wage in california would become one of the highest in the nation if governor brown signs legislation that's now on his desk. the state approved a bill to hike the minimum wage to $89 next july. it would go up to $10 by january 16. a full-time worker's wages would increase by $4,000. this would be the first increase in six years. people we spoke with say it seems only fair. >> it seems like it. people are struggling the way the economy is. it seems like minimum wage, people can't live on that

anymore. >> they say the increase will stimulate the economy because workers will spend more of what they earn. but opponents call it a job killer. governor brown has indicated he will sign the bill. if you are hoping to be among the first to get your hands on a new iphone, now is your chance. apple's latest smartphone devices introduced this week are now on sale online. the company began accepting preorders for the iphone 5-c and 5-s. customers will be able to purchase the phones in stores starting september 20th. airline passengers got a deal when they went to book tickets for the holidays. the airline was briefly giving away tickets for free after accidentally filing fares for zero dollars. some passengers say they purchased their tickets for $5 to $10. united quickly spotted the air and shut down the system for maintenance work. no word if the airline will honor the tickets sold at the

mistaken fares. and jetblue is slowly returning to normal operations at this hour after a computer failure caused system wide delays. 60 flights nationwide were delayed including at sfo. the problem was resolved about 90 minutes ago. a jetblue spokesperson says it will take times for all of the flights to get back on schedule. passengers are urged to check with the airlines to see if their flights are affected. a slight warmup in store for some of us this afternoon. we're looking at temperatures very similar to how we started yesterday unless you are still dealing with the clouds. oakland still mostly sunny and trailing a few degrees cooler than yesterday. take a look at the low cloud deck there. you can see, boy, it's awfully thick, about 15 to 1800 feet and that's what we will see for the weekend with a cooldown in store.

first, the clouds are hugging the coastline it looks like all the way down to san mateo crossing into the bay, oakland into san leandro perhaps you are dealing with mostly gray skies. outside of that we've cleared and temperatures are beginning to rebound as well. an onshore breeze, 14 miles an hour in fairfield. very similar to yesterday and i expect the winds will pick up for your area again for the afternoon. that cool pacific air will be with us for the entire weekend and around the bay. we have an advisory for small craft this afternoon which means if you plan to observe america's cup today it will be breezy in san francisco. 75 degrees right now in fairfield. 76 walnut creek, 60s around the bay. so off to a mild start for your lunch hour and then as we get into the afternoon, temperatures will continue to warm. this is the system responsible for our cooldown in time for the weekend. it's going to be shifting closer to the coast. as it does, it will bring cooler air, the onshore breeze will continue and the marine layer could thicken just a bit. afternoon highs for today, 77, san rafael. off to the east bay, low 70s
