now at noon -- high schoolers being questioned by police. why they are believed to be persons of interest in the beating of a pleasanton man that left him in a coma. an innocent driver is dead. two teenagers are in custody after a deadly crash in oakland. what police say the teens were doing just before the collision. and a group of parents now suing facebook. why they claim the social media giant is ignoring california law.

good afternoon. i'm tori campbell. a crash in oakland leaves an elderly man dead. police say he was hit by two teenagers trying to make a getaway after a shooting. ktvu's alex savidge has more. >> reporter: the force of the crash flipped this subaru station wagon on its roof. the 75-year-old man behind the wheel of the car was killed. police say he was broadsided by this red suv at the intersection of church and bancroft, next to eastmont mall. the suv was carrying two 17- year-old boys who police say were on the run suspected in a shooting just minutes earlier. officers heard gunfire around 10:00 last night near ruddsdale and 82nd avenue. >> as they responded to check the area to locate victims, they noticed the suspect vehicle fleeing from the scene

at a very high rate of speed. >> a short time later, that speeding suv blew thru this intersection, slamming into a passing car and killing that interknow sent driver -- innocent driver. police say they were not chasing the suv at the time of the crash. >> the preliminary investigation that we have, officers were not in pursuit of the vehicle but keep in mind there will be, you know, a full investigation into all of the circumstances. >> reporter: the two teenagers in the suv were arrested at the crash scene. police say it's unclear what prompted them to open fire on this street. but no one was hit by gunfire. >> we're happy they are off the street because clearly they are dangerous individuals. >> reporter: police say at the very least, these two teenagers will face vehicular manslaughter charges and depending upon what the district attorney decides, it's possible they could be charged with murder. in downtown oakland, alex savidge, ktvu channel 2 news. new details now in the robbery of casual carpoolers in oakland's rockridge district.

now oakland police say they've arrested a 17-year-old and a 22- year-old in connection with the robbery. the two are accused of robbing nine people including a pregnant woman at gunpoint yesterday morning while the victims waited for casual carpool rides at hudson and claremont avenue. a pleasanton man is in a coma after being attacked outside of his home. new at noon, tara moriarty was there as pleasanton police announced who they are questioning and joins us live where the neighborhood happened. >> reporter: good afternoon. police have not made any arrests but they are questioning some people of interests, they say, they won't tell us how many they are talking to but we know they are students that go to two different high schools in pleasanton. we've been talking to neighbors. they say they are absolutely shocked. it's a very quiet area. they do say the teens will come to this cul-de-sac to hang out and drink. saturday a group of teenagers was being busy on middleton

court next to the victim's house. dave lamont, the homeowner, came out, told them to quiet down. a quite broke out. that's when his wife stepped outside and saw her husband was lying unconscious on the ground. >> we don't know exactly what occurred except for the injuries sustained to the victim. according to witnesses, a dark- colored suv was seen leaving the area. the victim is currently at a local hospital where he's in a coma and unable to communicate wve -- with our investigators. >> i think he was trying to do everybody a favor and get these kids off the block. it's unfortunately how it, you know, something as simple as that just got out of hand rather quickly. i want these kids to have a conscious. think about what they did and come forward. ien mean, that's -- i mean, that's the right thing to do, that's the moral thing to do. that's the right thing to do. >> 51-year-old dave lamont has

two daughters,eer we're told one attends college. neighbors say that he was a good samaritan and they are just really sad about what happened and again hoping anybody who witnessed anything will come forward and police are also urging the same. live in pleasanton, i'm tara moriarty, ktvu channel 2 news. >> thank you, tara. turning now to the looming b.a.r.t. strike. there are now just 16 days left until the governor's ordered 60- day cooling-off period expires. at 10:00, b.a.r.t. was back at the bargaining table with one of the unions atu. according to b.a.r.t., ten of the remaining 16 days are scheduled to be devoted to discussing pay, benefits and healthcare. however, b.a.r.t. and its unions are still far apart by more than $100 million. b.a.r.t. workers say they plan to strike if no deal is made before the cooling-off period expires. a stray piece of debris caused some big problems this morning for more than a dozen motorists

on an east bay freeway. 13 vehicles had flattened tires and other damage after running over a three-foot long piece of metal. the first car was damaged just before 5:45 a.m. on southbound interstate 880 near the high street offramp. we got to see the piece of metal that caused the damage. the highway patrol says it may have fallen off the back of a truck. >> i saw it fly off the truck. >> you saw it come off the truck? >> yes. >> driving along in the morning, drinking the coffee, getting to work and boom, big obstruction in the road. >> took out two of my cars. i don't know what's going on with the bottom of my car, but it's not injured. >> no one was injured. the highway patrol has not been able to locate the truck that lost that piece of metal. lombard street is open after being shut down for a crash involving multiple vehicles. it happened just before 6:00 a.m. at lombard and franklin. police had to close the

intersection for about two hours. one of the vehicleses -- vehicles, a van ended up on the sidewalk. the conditions are not known. the cause of the crash is under investigation. new developments now in the kenyan mall attack. the kenyan president announced that security forces have finally defeated the small group of terrorists after four days of fighting in a nairobi mall. he said the attack left 240 casualties, including 61 dead civilians and six of his security forces. five terrorists were killed and another 11 suspects have been taken into custody. three floors of the mall collapsed. president obama spoke about that mall attack when he addressed the u.n. general assembly a few years ago. this is a week-long gathering that's also known as leaders' week. it marks the 68th annual yuns general assembly. the president said the world is more stable than it was five

years ago. but the attack on the kenyan mall is an example of the dangers that matalked about the to enforce a ban on chemical weapons in syria. >> when i stated my willingness to order a limited strike against the assad regime in response to the brazen use of chemical weapons, i did not do know lightly. >> the president also mentioned the need for a diplomatic solution in the case of iran and nuclear weapons. the newly elected iranian president was scheduled to april tend the gathering and possibly meet with president obama but we've just gotten word that he did not show up. later today, president obama and former president bill clinton will appear together in new york. both will speak at an event for president obama's healthcare reform, the affordable healthcare act. the joint appearance comes exactly one week before people who don't have health insurance can stop signing up for health insurance through marketplaces.

new at noon, a group of parents is filing legal action against facebook. the group accuses the social network giant of using their

children's pictures on advertisements without permission. justin gray just spoke with the attorney representing the parents and joins us live. good afternoon, justin. >> yeah, tori. this is all about the ads for promoting companies and services that pop up userring your friends' neighbors and friends on your feed. just last month, settled a lawsuit and agreed for new rules about how children's images would be used. parents who filed and appeal says the lawsuit still leaves a giant loophole. the lawsuit means the kids give permission when they sign up. the family says it's basically like a child righting their own -- writing their own excuse note to get out of school. >> they may be tagged on the internet for years to come, maybe to their personal embarrassment or professional detriment. >> coming up at 5:00, we talk to a bay area mother part of this lawsuit. she says she opened up her

facebook feed, saw a picture of her own daughter advertising risque clothing. we're live in just washington, justin gray, ktvu channel 2 news. oracle hopes to continue the hot streak as the america's cup races get underway in about an hour. they scored the fifth straight win after a slight wind delay. the second race was postponed until today. the score stands at 8-6. team new zealand only needs one more victory to take the cup. today's race begins at 1:15, weather permitting. the winds are looking pretty strong. now, today is the 18th day of the america's cup, making it the longest in history, partly due to the all of the cancellations due to the wind. but that means more money for san francisco. we checked out some of the hoey tells. the hotel on the water front only has a few rooms available for $600 a night. the fairmont and hyatt regency

are fully booked. >> if you tell them there's no rooms available, if they are incestent and say i'm not gonna check out, technically, you can't evict them. >> the expecter directer said people are spending more time outside of their hotels which means they are spending money and that's good news for businesses in san francisco. along the peninsula abandoned construction projects are a growing problem. janine de la vega tells us what palo alto cities are doing to combat illegal activity and blight. >> reporter: construction crews spent the morning working on the lot in the middle of this upscale palo alto neighborhood. on other streets, there's no movement. neighbors say this construction project has sat idle for over five years. some suspect drug deals.

>> there was illegal activity. called the police. they did come back and i guess put up a better fence that, you know, was supposedly more secure so kids couldn't get in. >> reporter: neighbors say the home on this lot was demolished years ago but nothing was built. the city wants to prevent that from happening. last night council members voted to create an ordinance that would set time limb is and impose penalties -- limits and impose penalties. >> primarily, we want people to live in the neighborhoods and not just keep them in permanent stagnation. >> reporter: under the current law, building projects have no time line requirements. the city acknowledges it has led to nummer hous projects that have not been completed because of either insufficient funds, poor contractors or neglectful property owners. the city says the ordinance will most likely apply to only future projects which is somewhat disappointing. >> i think it's good they implemented something.

it may not affect this particular project which means we know this can't happen again. wish it did affect this. >> reporter: the planning commission will draft an ordinance but it most likely won't be voted on until 2014. back to you. a grass fire in southern california is threatening several homes right now. the fire started yesterday evening just before 6:00 in the san gabriel mountains. so far, it's burned nearly 200 acres. it's only 5% contained. evacuations were ordered late last night but fire crews say so far, the fire is mostly burning in the angeles national forest away from homes. the cause of the fire is still under investigation. and federal researchers are working on a system to measure wildfires. they say it will be similar to the way earthquakes, tornadoes and hurricanes are measured. the new system would measure the intensity of the wildfire and would allow planners to assign better building codes for fire-prone areas.

the proposed scale would range from e-1 to e-4. a cooler breezy day in the forecast. giving you a live look outdoors. we have it looks like a little bit of fog there along the coastline. mostly sunny elsewhere. we actually woke up with a few high clouds rolling over the area. we may see a few for today. all of this has to do with the system that is to the north of us. so this system here will continue to bring us the cooler weather and the breezier conditions for your afternoon. if i slide in a little bit closer to the bay area, you can almost see a weak front that passed through a little while ago and behind it, the winds are picking up. do you see it move right across the bay area? so behind it our winds are beginning to pick up. it will be breezy in some areas especially along the coast. temperatures only a few degrees cooler but with the wind on it could feel breezier. in the last hour or so, i've

waufned the winds pick up. now reporting 22 miles an hour. 17 miles an hour in fairfield. for the inland areas in the delta area we've got winds gusting to 20 miles per hour and i think a long the coastline is where we'll see, again, some of the breeziest conditions for the afternoon. let me show you here picking it up for the afternoon, as we move into the second half of the day, notice the blue becomes more widespread around the bay area. these winds anywhere from 15 to 20 miles an hour. i do think especially along the coastline could gust to near 30 miles per hour in some of the windiest spots perhaps near 40. now into the evening hours, it will begin to die down, and the winds will lighten up. i do think we'll have wind in the forecast for the next few days. right now, 70 in oakland. 76 in napa. low to mid-70s in concord as well as antioch. a nice day out there. 78 in novato. 77 expected in san rafael. looking at 70 degrees for richmond this afternoon.

stock market is now mixed in light trading and this afternoon after two key reports gave a mixed picture of the u.s. economy, one showed home prices in july rose the most in over seven years. another shows consumer confidence closed as many felt less optimistic. google is expanding across santa clara county. in the last few weeks they've signed agreements to buy or rent more than 1 million square feet of office space. that's enough room for about 5800 more workers. and google is still planning to build a new campus at the nasa ames research center. one analyst said the spurt is like any other in silicon

valley history. struggling california homeowners have gotten more than $18 billion in financial help from a national mortgage settlement in the last year. nearly 3 billion of that has gone to borrowers in four bay area counties. contra costa county received $950 political, the most of any east or south bay county. more than 84,000 california families received reductions what they owed on first and second mortgages. bank of america must pay more than $2 million to settle a racial discrimination case. the money will go to 1100 african-american applicants. the government says b of a used unfair and inconsistent hiring guidelines that led to qualified applicants being rejected for teller and entry level positions. the shaq-amento era has
