home and spread to another. both on max welton road in piedmont, not far from highway 13. we're on the scene and one of the homeowners just barely survived the oakland hills fire storm only to see his house burn today. christian? >> reporter: definitely a personal tragedy for him and his family. it appears this point the fire department has the scene under control. this is the look at the area on max welton at hill top. the road is still closed. you can still see there are lots of fire crews. there are eventually two homes that have been damaged. no word on how much at this point. of the home's owner says he wasn't home when the fire started. his daughter was. >> my daughter was in the house taking a nap and all the sudden heard things crashing, probably glass breaking or something. >> reporter: now, cohen's daughter was able to escape and was not hurt. can you see the flames as they

burned. one home moved to at least one neighboring home. neighbors in the area were working together trying to put out spot fires, trying to stop the flames from spreading. no word at this point on how it started. firefighters are still on scene making sure that there are no hot spots and there will be -- there were two factors working against the firefighters in this case, the winds pushing the fire up slow and the location which made it tough to get water to put that fire out quickly. >> without higher elevation, smaller plains were it was difficult to put the fire out, window assistance from oakland fire. >> from our vantage point, it might be hard to make out exactly how high we are in the oakland hills. that gives you a sense on why it was so difficult to get that water pressure. the homeowner is right here. his family at this point, safe.

officers heard gunshots in a neighborhood less than two miles away. >> as they responded the area to locate victims or witnesses they noticed the suspect vehicle fleeing from the scene at a very high rate of speed. >> shots were fired on 82nd avenue and the ford explorer with the teenagers sped through neighbors ending with the crash. >> the preliminary investigative information we have officers were not in pursue. >> the subaru driven by robert of oakland was pronounced dead at the scene. the teenager suspects were arrested on the spot. >> we were happy they're off the street because clearly they are dangerous individuals. >> reporter: oakland police say they are still investigating the circumstances of this accident, and the circumstances of that shooting in which police say

shots were fired but no one was hit. in oakland, ktvu channel 2 news and a 19-year-old had just stepped off the muni train on the m line in engleside heights when he was shot or killed. of the name of the victim has not yet been released. in oakland, police are investigating a deadly shooting in the past two days. just after 11:00 on 89th avenue near mcarthur boulevard and another shooting on sunday that killed a 21-year-old man. no one has been arrested in either of those killings. >> developing news nought out of narobi, the president declared the deadly siege of a shopping mall is over. 11 suspects are in custody. in the news room, part of that

comes the diplomatic overtures of iran, but there will be no face to face meeting between the president during the general assembly. it was too complicated given how any meeting may be perceived in iran in california received a deadline extension in a court mandate to reduce the prison population. california's been fighting against the early release of inmates to comply with the order, and today a panel of three federal judges agreed to extend the end of the year deadline to january 27th. the court is hoping the state can come up with a long term solution to the over crowding problem. the judges want to hear recommendations for a possible solution by mid-october. now to the looming bart strike, there are will only 16 days left of the cooling off period. bart's union workers have promised to strike if no deal is reached by the deadline. today contract talks continued.

an east bay father is beaten and left for dead after going to check on a noisy group of people outside of his home. tonight police are interviewing high school students in pleasanton as they try to find whose responsible. we're live with who found the

man unconscious on the sidewalk. >> reporter: police are still interviewing witnesses and teenagers whom they're calling persons of interest if a brutal beating. police say they're still trying to piece together exactly what happened here in up scale middle ton place. david lemont was beaten up outside his house they believe may be teenagers. neighbors are outraged. >> they left him there unconscious and for all we knew they could have died. >> police have been interviewing two students at high schools. >> some of the information we received led to the identity of several involved parties that are currently persons of interest. >> police say lemont approached a group of young people making noise saturday morning. his wife found him unconscious. a neighbor said he reported to police he may have seen a suspicious car leaving the area.

outside. let's talk about the waves. is this the time the waves start getting bigger? >> they're not that big now but winds are really the story today. the winds are blowing. you've got a small craft advisory offshore and an issue for the salmon fishermen as they move out by the fair lines. real windy, and swell it is start to get really big into november and december. 81 in fairfield. numbers kind of like they were yesterday. maybe a little cooler in a couple spot. 81 in santa rosa. i talked about these systems last night. these are nice looking weather systems, snow in the cascades. we're on the south end of all this. we're getting cooling by virtue of cooling. the winds will continue tomorrow, not as much tomorrow, but tonight in that wind bringing the on shore flow, we'll keep temperatures on sort of the mild side tomorrow.

hall to oppose the city's participation if a plan called rad, rental assistance demonstration which protestors say will privatize the city's public housing. one woman is worried about her future. >> we mind end up getting displaced. it could effect our rent, and we're, like the least able to move. we're all on fixed incomes on disability, and if we get displaced, like we have nowhere to go. >> the city housing officials have been holding community meetings on the program. they say it will preserve public housing with private partnerships that'll raise money for badly needed renovations home prices rose again in july. actually they experienced the fastest increase since 2006. according to the standard and case shriller 20 city home price index, prices nation wide rose

it's coming out of the west so even though it's howling at 41 miles an hour at the san francisco airport, a westerly wind was setting us up with a moisture cooler flow. so winds right now in san francisco are 21 miles an hour so the winds are still out of the west. here's what changes. as we go into the next 24 hours, winds are going to start to clock around and start to come out of the east. that give this is prompt the national weather service to issue a fire weather watch for the hills around the bay area. winds are going to gust 25, 35, maybe a little more than that. the fire danger is increasing. today's winds not good, but not as bad as dryer winds forecasted over the next 36 to 48 hours. we'll see you back here and ken? >> bill, max welton road is still closed, that leads to the fire scene. the evacuation order has been lifted. even though this fire is out, firefighters and of course neighbors who live in these hills
