. it's all come down to one final race. we're just over an hour from seeing whether or not oracle team usa can pull off an epic comeback and hold on to the america's cup. a popular south bay high school teacher behind bars. we'll hear from students. we're just two weeks from another possible bart strike with no deal in sight and both sides far apart, the plans bart is making in case workers walk off the job.

. good afternoon. i'm tori campbell. today is set to be the final winner take all race of the america's cup as long as the weather cooperates. the race has undergone much scrutiny over safety concerns, impact on the local economy and viewer attendance. now oracle team usa is one win from a comeback. we have team coverage with steve paulson in the weather center monitoring the race conditions. we begin with david stevenson live from the america's cup village. >> reporter: good afternoon. you can see the crowd of folks watching the oracle boat being towed out ahead of the race. a lot of energy and excitement out here on piers 27 and 29. you can see the people who began streaming in here at 10:00 a.m. getting ready for this final race. >> u.s.a.! u.s.a.! >> reporter: the rivalry is revving up ahead of the

scheduled 1:15 p.m. start. fans of oracle team usa and team new zealand turned out to see the boats pull up. the winner take all match means tensions and spirits are high. oracle fans are thrilled the team pulled out seven straight wins to tie with new zealand yesterday. team new zealand fans are more than a little concerned. >> panting, pacing, i can't imagine what they're feeling. it's so exciting. we're all very, very exuberant about it. >> you have to feel for the guys and oracle is doing a great job. they have not given up. they're playing with a lot of heart. i think we can get there. >> reporter: i attended a briefing by race organizers. they said they were very concerned this morning about wind conditions. the race director said things seemed to get into the condition

they wanted. he says he's now very happy. so are a lot of fans out here. we're told about 21,000 people turned out to watch the race on an average day. race organizers are not sure how many people will come out here. a lot of them are stretched out on the lawn already. back to you. . >> that's very exciting. thank you, david. the race has seen several weather-related delays from either too much wind or even too little wind. steve paulson joins us with the conditions this afternoon. >> i think they're fine right now. i'm seeing about 16-25-mile-per-hour winds, occasionally 34 gusts. on the bay it doesn't look that bad. it's picking up a bit. they don't to have worry about any clouds. it's clear. we have our wind cast. things stay in the 15-25-mile-per-hour range. that's definitely within the

limits. sometimes you get over 30, that's when you have to worry. everything looks good through this afternoon and even into tonight. the strongest gusts will be in the hills. we've gone 20 to 20-plus here. small craft advisory started at 11:00 a.m. they'll pick up to 25. i expect 30 later this afternoon. there have been a few gusts around the area, not so much on the bay. that northerly direction will kick in if it hasn't already. it's more northwest right now. it will be close but i think they'll get it in. it's borderline there right around 27-28 knots. so we're close. >> thank you, steve. oracle's c.e.o. larry ellison's love for sailing has taken some of his attention from this week's oracle open world convention also in san francisco. he skip add keynote speech at the convention yesterday to attend the racesment the move did not sit well with some convention attendees who said

they paid thousands of dollars to hear him speak. about 60,000 people are attending the convention which ends tomorrow. some believe that if oracle wins the cup, ellison could come back and display the trophy to make amends. . in marin county a stand off is underway between authorities and a man who has barricaded himself inside an apartment near mill valley on maple street. authorities called a hostage negotiator but it's not clear if there are any hostages. it's also not known if the man is armed. paramedics and fire crews are on stand by. there are report that is the complex of evacuated. nearby residents were asked to shelter in place. . parents and students at a south bay high school are reeling in disbelief after a teacher there is accused of

having sex with a student. we spoke to students who learned about the allegations. we're live from santa clara. >> reporter: good afternoon. yes. we just heard from police. they told us that the victim in this case is a 17-year-old female student who attends school here at santa clara high school. it's homecoming week here on campus. the principal says this unexpected news comes as a blow. this morning the talk around the santa clara high school campus was that teacher hugo guzman was behind bars. the principal says they called police after someone tipped off the district office saying he was allegedly having sex with a student. >> really, really shocked and surprised. you wouldn't think that he would do such a thing. >> this student says hugo guzman was his teacher. >> he seemed like a weird guy the first time i met him. the girls were always on him.

he was just weird with the girls. they were always at his desk, always laying on his desk. he would just allow it. >> the teacher taught math and was in the avid program which helps students prepare for college. >> mr. cortez was a very popular teacher with staff and students. the safety of students is of the most paramount concern. >> the school district says staff is cooperating with police. cortez is on paid administrative leave. parents were alerted by phone. teens say they're disappointed. >> i just feel sick. it's gross. >> reporter: counselors are on cam fows help students cope with the news. police say there could be more victims and we will have more on this story coming up at 5:00. back to you. . san francisco police have

released surveillance video of a suspect wanted in the deadly shooting of a 20-year-old man at a muni light rail stop. the video shows the suspect on a muni train monday night moments before the shooting. he is described at asian, 20-30 years old. police say suspect shot and killed 20-year-old justin valdez after he got off the train at randolph and blight streets. investigators don't know what prompted the attack. the looming bart strike, the clock ticks down to the end of the governor ordered 60-day cooling-off period, there are just 15 days left until the october 10 deadline. both sides are back at the bargaining table to discuss the main sticking points regarding salary and benefits. bart and its unions are said to be more than $100 million apart. union employees have promised to strike if no agreement is reached by october 10. because of that threat, bart is making contingency plans.

the plan includes 200 free charter buses, bart also hopes to run several trains which would be operated by certified former train operators who have been promoted to management. all day carpool lanes would be made available and other transit agencies would also increase service. the $2 is million plan still must be approved by the agency's board of directors. there is new information about the asiana airlines crash at sfo. the associated press reports federal investigators are reviewing whether asiana airlines failed to meet legal obligations to help the families of the 291 passengers. under u.s. law, asiana airlines was required to provide a range of services including transportation and lodging so family members could comfort injured loved ones. three people died and dozens were hurt in the crash on july 6. . for the first time we are

. we have some chilling new video this noontime from the f.b.i. showing the gunman in the washington navy yard shooting. authorities released this footage showing aaron alexis inside the building. the f.b.i. says investigators have learned that aaron alexis believed he was being controlled by extremely low frequency electromagnetic waves. officials say he wrote my elf weapon on the shotgun he used in the shooting. the f.b.i. says it does not appear aaron alexis targeted any specific individuals. twelve people were killed in the rampage nine days ago. an elderly woman suffered critical injuries when she was hit by a pickup truck in oakland this morning. the accident happened at ninth and ellis streets in the chinatown district. she was in a crosswalk when it happened. police say the truck driver

mayor been blinded by the sun and did not see her. the driver remained at the scene. an elderly san francisco couple and their disabled daughter could soon be out on the streets. the family is being eviced from the home where they've lived for decades. why this family's personal crisis is becoming a city wide problem. >> this couple have been paying about $800 a month to live in this russian hill apartment. after 34 years, they are being evicted. . >> 30 plus years of memories. no matter where i go i'll always have this place in my heart. i have a lot of memories here. >> the property was bought last year. the plan was to renovate it and turn it into luxury tenancy in common units and sell. >> it's breaking our hearts.

we feel like we have to draw line the somewhere. as a city we need to come together and do something about it. >> tenancy advocacy groups showed their support for the lees and their disabled daughter. their case is one in a rising number of evictions using the ellis act, a state law adopted in 1985 that allows a land lore to evict it tenants in order to get out of residential housing market. . >> do they just move out just because somebody else will pay more rent? that's not -- i don't think that's the kind of community i want to be in. >> the new landlord offered buyouts to the residents here but the lees refused to budge. the lees have spent hundreds of dollars on fees applying for low income housing. so far they're on the waiting list for several places. there are thousands of people ahead of them. the lees have nowhere to go. the lees are willing to go to jail to draw attention to the

situation. these type of evictions have tripled since the beginning of the year. . >> he feels very disappointed, very angry. >> they just feel it's an injustice. at the same time, he loves his city. . >> the lees say they thought they would retire here. they can't imagine leaving. that dream is quickly slipping away. back to you. . unemployment checks that have been delayed for thousands of californians will be processed as soon as tomorrow. state officials are dealing with a backlog of about 80,000 claims because of a computer system upgrade over labor day. the system was supposed to stream line the process but it malfunctioned and state workers have been approving payments ma'amly since then. officials plan to speed things up by sending checks without

confirming eligibility. governor jerry brown is in oakland signing legislation to increase the state's minimum wage. the bill increases the minimum wage from $8 an hour to $9 an hour on july 1 of next year. then on january 1, 2016, the minimum wage will increase again to $10 an hour. tonight a fire weather watch begins for the north and east bay hills. the national weather service says people should expect a combination of strong winds and low humidity. this is the same area of the 1991 oakland hills fire. >> i had lived through the 199 is fire when i lived in the oakland hills. we are very familiar with it. first living things out, then if you have time to go back. >> no injuries were reported. the cause of the fire sund

investigation. uc davis won an $11 million federal grant to lead a national study on transportation and climate change. the stiewd study will be base ted university's institute of transportation studies and will engage other universities across the country in the two-year project. the goal is to find ways to reduce greenhouse gases for the u.s. department of transportation and to help prepare the u.s. infrastructure for climate change. davis is known as a bike friendly city with 22% of commuters pedaling to work. two kayakers got a very close look at a humpback whale off the coast of santa cruz. these photo rps taken by a marine biologist for sanctuary cruises. he says right after they were taken, the whale flapped the water causing a giant wave that washed over the kayakers.

. we have gone from rain saturday to very warm temperatures monday. now we have clear skies. the wind has picked up and cool conditions. there we go out on the bay. i think they'll get start. the wind is picking up a little bit. i'm seeing 16-34 generally. sfo 26 miles per hour, santa rosa 29, 40 mount diablo. so the wind is picking up on the bay. i think they'll get started here. it looks like they're gonna go. it's a really close call, very fine line. we do have clear skies but the wind speeds have been picking up for a -- the system is dropping down. there is not much cloud cover. we are getting the cooler air. that cooler air is destabilizing things. it's around 20-25. there could be some stronger gusts. i think they'll start off all right. it's getting really close.

a lot of wind speeds are getting cranked up here. we have that fire weather watch starts tonight. gusts could be over 2,000, 3,000 feet maybe up to 50. the wind is turning more northwesterly and more northerly late tonight and tomorrow. there is plenty of instability coming down. had things could really pick up later this afternoon or tonight. 60s for some. it's definitely a cooler air mass unless you are in southern california. santa rosa 70, 61 san francisco, livermore not at 70 yet. it's a cool pattern. it's not so much the delta breeze. it's the northwest breeze starting. from sfo to san jose, everything is turning more northerly or northwesterly. that's a sign of things to come. pretty good breeze out there,

cooler pattern. there could be definitely some activity beginning to pop up in the afternoon in the sierra nevada. we saw that yesterday. i think a repeat performance. cloud cover will definitely pop up. best chance of snow late tonight or tomorrow. the low equals a cooler, breezy pattern for us. so 60s and 70s coast and bay and even inland. it's sunny and nice. so a little windy at times. some clouds to the north and to the east. this is one of those days where napa and santa rosa can be warmer than st. helena or clear lake. cold air is filtering in on everybody. a little modification by the coast.

sluggish sales. walmart called the report false. the dow is down 56. nasdaq down five. more information about twitter's ipo, a new report said twitter will list on the new york stock exchange instead of the nasdaq and is likely to be priced between $28 and $30 a share. still no ipo date has been set. many people rely on the san francisco based website yelp for business reviews. now a new report says not all reviews are real. a new study by a harvard business professor says 20% of all yelp reviews are fake. the study claims the reviews are actually written by the business, its employees or someone paid to write a good review. no comment yet from yelp. new safety measures are put in place at a deadly bay area
