victim. eric? >> reporter: friends of the victim say justin valdez was an athlete and a hard working student. moments ago i spoke to a friend of his in southern california who said he loved being in san francisco and enjoyed taking the train and walking. we got a tip that there had been an arrest. this afternoon police confirmered and it appears -- confirmed and it appears they didn't have to go far from the shooting to find the man. >> reporter: the death of justin valdez near a muni stop not far from san francisco state came as a shock to students on campus. >> it is really sad and tragic. >> reporter: san francisco police say justin valdez was getting off of the train when he was shot before 10:00 p.m. monday night. police released this video of a suspect. it is nikhom thephakaysone, arrested at his home yesterday. >> i am eric. >> reporter: that is where we

found his father. >> reporter: do you think your son is responsible for this? >> i have no idea, sir. i have no idea. for now san francisco police are not saying what led them to the suspect. news of an arrest is only some consolation for friends of justin valdez. his principal in southern california said he over came obstacles. >> the fact that he was able to take ap classes and go straight to a university out of high school says a lot about who he was. >> reporter: i received a text from a friend of justin valdez who said there is a candlelight vigil at san francisco state tomorrow at 7:00 p.m. as for the investigation, police plan to hold a news conference tomorrow to release new details about the arrest. live in san francisco, eric rasmussen, ktvu channel 2 news.

strong winds in the bay area tonight are increasing concerns about fire danger. here is a live picture of san francisco bay where you can see the stars and stripes blowing in the breeze there. in some places wind gusts reached 30 miles per hour. our chief meteorologist bill martin joins us now with what we can expect tonight. >> the winds are going to continue to blow but they will start changing directions. today is windy and breezy but they are on shore but the winds tonight start to come out of the northeast and as you know, right, that is a dry, warm up direction and that is when you get the red flag warning, goes into effect tonight at 11:00 p.m. novato 23. breezy. 23 in nappy. westerly winds. it is not as nasty as the winds

we have new information on the attack on a man. police identified four people who were present saturday morning when the man was beaten so bad he was left in a coma. a 18-year-old is a person of interest. his name hasn't been released. three other teens are considered witnesses. all four are cooperating and that they don't believe anyone else was involved. he was attacked when he was confronted by young people who were making noise outside his home. police say leads are pouring in as they investigate an attack on a safeway store manager but the assailant hasn't been caught. police say a man punched the 51- year-old in the head knocking him to the ground. it happened monday morning at the store. mese say the manager is in sear -- police say the manager is in

serious condition. dna evidence is credited for a pair of arrests in a 25- year-old cold case. the sheriff's department says fausto chavez and high profile inmates are behind bars for the killing of wynetta davis. dna linked the two men to the crime. the arrest of a teacher who is accused of having sex with a student sent shock waves through the school. santa clara high school math teacher hugo guzman was taken into custody yesterday. students said they had been -- there had been rumors and on monday officials say a tipster alerted the district about his relationship with a 17-year-old female student. >> the police, the district and

the administrators worked together to investigate and we did find there was evidence that an inappropriate relationship had happened. >> the district says hugo guzman passed a background check. he is expected to make his first court appearance tomorrow. for the second time this year the berkeley police officer's union is asking for stun guns. it will make their jobs and the public safer. but as ktvu's allie rasmus tells us not everyone agrees. >> reporter: the union is bringing this issue up because of an incident last week. police responded to a call about a mental illness man threatening to kill himself. he stabbed himself multiple times before officers could step in. >> reporter: if their officers had stun guns the outcome would have been different. >> if a taser was available and

the individual could have been tased the injury could have been prevented. >> reporter: the police department has 167 officers. the union asked leaders for stun guns before. the spring the union sent out an e-mail to residents. 80% prefer stun guns. >> i don't see why not. >> i think it is a deplorable idea. >> he helps kids. she is not buying the reason for requesting stun guns again. >> what that man needed was a mental health expert. >> reporter: she thinks it will increase tensions. >> there will be tragic incidents and the improper use of the tasers. >> it is risk free. if you look at a taser causing a death, it is more likely

the aircraft, objects that are used around the aircraft, lugging wheel might come loose. sandwich wrapper. piece of trash. the idea is we want to keep the area clean, keep it safe. >> air traffic controllers shut down two runways. a crew regularly cleans but officials say this helps get everyone involved in airport safety. a man taken into custody is undergoing a mental health evaluation tonight. authorities were called to an apartment at 9:45 a.m. this morning. sheriffs say the man claimed to be armed with guns and he threatened to kill officers. after an hour the suspect surrendered he is a 59-year-old man. deputies say no guns were found inside the apartment. officials complied with a court order to transfer 2,000 inmates out of prisons where they could catch valley fever.

it killed 36 california inmates in the last six years. back in june a judge gave officials 90 days to move inmates prone to valley fever to prisons where it hasn't been prevalent. with contract negotiations at a stand still university of california at berkeley is imposing terms of a contract on 8,000 service employees. the union representing the university maintenance, food service and janitorial workers say the terms amount to a 1.5% cut in take home pay. they say it is raising the workers required contribution to their pensions. science studies are getting a boost thanks to a donation. they have gifted $30 million to the university. it will be used to fund science

ph.d. programs. they plan to raise another $5 million. summer is over but fire season is heating up with a red flag warning starting tonight. officials are reminding everyone to create the defensible space around their homes. ktvu's john fowler is live where he found another fire hazard today. john? >> reporter: that's right. right now the winds are coming out of the west. they picked up in the last few minutes. i will tell you as the fire conditions, the red flag red flag warnings begin we will expect problems from power lines among the trees. >> reporter: trees in higher elevation neighborhoods at risk of snapping power lines. >> the trees swing into the power lines and under the right conditions that could cause a fire. >> reporter: a tree service crew just ahead of the winds
