"mornings on 2" starts now. welcome to "mornings on 2." you're looking at a live picture of the u.s. capitol building where a temporary spending measure passed by the house is expected to be rejected. one lawmaker not there for last night's vote. nancy pelosi, what she decided to celebrate instead -- coming up. i'm tori campbell. >> i'm i'm dave clark. let's check weather and traffic. steve, you are not concerned about the rain? >> this is not much rain. it's here. there's a lot of rain in the northern part of the state. we're just too far south. not enough cold air or jet stream to do much. we're getting a lot of foggy conditions, cloudy conditions. less towards the south bay. low clouds and drizzle. we've had a little bit of rain. there's been some 1 inch plus

amounts in mendocino county north. for us a couple hundreds. san jose is close. almost everybody in the 60s. napa, starting off 63. they've had .02 on the rain. let's go to 75 today. it's a mild air mass. no cool air yet. some of that will start to filter in tonight and tomorrow. nothing dramatic, it will be cooler tomorrow. today, cloudy to mostly cloudy. very light rain. heavier rain farther north. a lot of drizzle. 70s on the temperatures. here's sal. traffic is getting busy in one particular place. that would be the east bay, livermore valley. other places are getting busy, too. let's start off with a look at the toll plaza. that's backed up for a 10, 15- minute delay. live problems on the bridge as you get into san francisco. i do want to mention the traffic on interstate 880 is going to be a little bit slow as you drive south and get closer to hayward. i want to mention, though, 580.

i want to show you this. from here on the altamont pass through. this whole solid line of stop- and-go traffic. that's -- that's even unusual for this commute. usually it slows right to about here and then that's it. it's a little bit slower than normal and then from here to the su know grade. we've had slow traffic as well. we've had a couple of fender- benders in the hayward area that have been cleared. if you are driving to castro valley, it will be slow. back to the desk. this morning, vallejo police are investigating the city's 18th homicide of the year. ktvu channel 2 reporter, alex savidge is at the scene of the deadly shooting with new information from a witness. >> reporter: good morning. this 18-year-old victim was shot through the neck according to a neighbor. he collapsed right here in the doorway of this apartment unit. he died right here. the shooter in this case who opened fire fired quite a few

rounds towards this apartment building. you can see one bullet here that went through the front window. a few doors down, i want to show you how lucky another neighbor was. look at this. the bullet hit the barbecue grill right -- that was sitting in front of his window. the man was inside when this happened. thankfully the bullet stopped in the grill. there was a round that went through the windshield of a car that was parked here in this complex. the deadly shooting happened last night just after 7:00 at this complex on the 1300 block of santa clara street. several shots were fired. police say the teenager in this case was clearly targeted although investigators are not sure what the motive was here. what police are not calling the shooting -- while the police are not calling the shooting gang-related, the lieutenant said there's been a few between gangs in this area. it's heated up recently. one neighbor said he heard the shots, walked outside, saw the victim on the ground a few

doors down. >> i walked up to him. i'm looking at him. my daughter is coming down there. my -- everybody coming down. screaming. we look at him. he had blood everywhere. nothing we could do about it. get the police here. >> reporter: investigators have now put out a description of the shooter they are looking for involved in last night's homicide. what was the 18th killing of the year so far here in vallejo. police are still talking to witnesses hoping more people come forward with information. as of right now, authorities are not releasing the name of this 18-year-old young man who was killed here last night but police do tell me he lived in this area. live this morning in vallejo, alex savidge, ktvu channel 2 news. 7:05. attorney general kamala harris wants california school districts to change the way they deal with kids who skip school. truancy is costing millions of dollars and is also linked to crime. janine de la vega is live in

santa cruz where the truancy rate is particularly high. >> reporter: good morning, dave. in santa cruz county, it ranks in the top three in the state when it comes to truancy. it's at 30% and earlier this year, public safety officials actually met to discuss how preventing truancy can translate into less crime. in a new report, released today, state attorney general kamala harris says attendants in schools and california is at a crisis level. it's causing sons qenses for our economy, safety and children. the department of education finds that one out of every five elementary school children were reported to be truant in the 2011/2012 school year. a student is considered truant if they are absent or tardy by more than 30 minutes without a valid excuse three times in a school year. studies find that students who miss school at an earlier age are likely to struggle academically and drop out. many who are chronically truant

end up in juvenile hall. jails show there's a high percentage of inmates who lacked a high school education. here is the truancy rate in the bay area. contra costa county ranks the highest at 29%. alameda county and san francisco are at 23% and santa clara county came in at 14%. among those with the lowest rates are marin county and solano county, which just had a rate of 6%. and student attendance is based on the amount of funding that the district gets. in this report, it says that school districts lost 1.4 billion a year because of kids missing school. coming up in the next hour of "mornings on 2," we'll tell you some of the recommendations that the state attorney general is getting because of these truancy rates. reporting live from santa cruz, janine de la vega, ktvu channel 2 news. >> thank you. 7:07. several teenagers have been arrested in mill valley and

hospitalized after an out-of- control drug-fueled party. sheriff's deputies say eight teenagers were found inside what was supposed to be a vacant house yesterday morning. several were covered in blood. officials say the blood came from a 16-year-old boy who had injured himself while possibly being under the influence of lsd. >> some substance that led us to take a stance that we had to provide medical care but at the same time protect ourselves. >> deputies say the young man fought with him them and had super-human strength. police arrested the 16-year- old, his 18-year-old girlfriend and an 18-year-old man all on resisting arrest, being under the influence and assaulting emergency responders. deputies say a 16-year-old girl who hosted a party was sited

under the ordinance. her parents could be responsible. the vacant home is owned by her family. property owners can be fined $750 to $1,000 whether they know about the party or not. to our continuing coverage of the deadly stabbing of the l.a. dodgers' fan at at&t park. yesterday, the family of jonathan denver went back to the ballpark on the last day of the 2013 season and passed out fliers, urging witnesses to that fatal stabbing to please come forward. >> anyone who may have witnessed the incident to come forward so that both families can have some measure of closer. losing a child is sa heartache -- is a headache. >> jonathan denver was killed after going to a giants' game with family members and friends

wednesday night. the only identified suspect, michael montgomery, was released friday night. prosecutors say there's not enough evidence to charge him at this time. >> we've posted more video of the plea by denver's family. you can take a look at it. find the link on our home page at ktvu.com. proceeds from this weekend's giants' games went to benefit injured giants' fan bryan stow. bryan stow was at the game. you can see him there giving a thumbs up to the crowd. the giants donated $10 from each ticket sold thursday, friday and yesterday's game. that money will help out with his recovery. he suffered brain damage after being badly beaten outside of dodgers' stadium on opening day in 2011. the clock is sticking toward another possible b.a.r.t. strike. the 60-day cooling off period comes to an end. as you can see in this calendar, just a week and a half. negotiations in the b.a.r.t. contract talks are set to

resume at 9:30. b.a.r.t. management and unions plan to meet every day during these final days of the cooling-off period. but at this point, the two sides are still an estimated $112 million apart on the on the key issues of salaries and benefits. b.a.r.t. workers could walk off the job again if there's no agreement between october 11th. this morning, the oary da councilman pushing for a -- orinda countyman pushing for -- councilmember will be at the b.a.r.t. station encouraging passengers to sign an on-line petition. he wants to make it illegal for b.a.r.t. workers and other transit employees in california to walk off the job. he says the four-day b.a.r.t. strike in july clearly showed how transit strikes can cripple and entire region. and they have similar laws in other states. >> yes. it's not allowed.

likely. yesterday, the republican-led house passed a temporary spending bill but included a year-long delay of president obama's healthcare law. the democrat-controlled senate won't go for that. a continued standoff will mean the first shutdown in 17 years. now, house minority leader np was not in washington, d.c. for the house vote over the weekend. we called her office this morning and they told us she was in california celebrating her 50th anniversary and that it was an event scheduled a long time ago. in a republican-controlled house, her vote would not have made a difference in the outcouple. some are criticizing -- outcome. some are criticizing her for not being present. if there is a shutdown, some government services would be unavailable immediately. kyla campbell has information on what and will not be affected. >> reporter: without a deal,

open in concord. it will open giving people a chance to enroll in covered california. now, under the affordable care act, the program will make it easier for people to get health insurance. it will offer plans from 13 companies. state organizers say about 4 million people are eligible for it. 400,000 living here in the bay area. now, the call center was -- is set to open at 8:00 a.m. tomorrow. agents can answer questions in 13 different languages. well, nurses will be pick keting outside three kaiser permanente hospitals. organizers say the rally will help educate people who are about to sign up for obamacare. they say people need to realize some of the plans limit access to hospitalization as well as safe nursing care. a spokesperson from kaiser oakland says all of the patients regardless of their health plan get appropriate levels of care. that nurses' rally will be from 2:00 p.m.

to 6:00 p.m. in oakland, modesto and sacramento. it is 7:17. we're now learning more about how the national security agency tracks americans using social media. "new york times" reports that the nsa has been tapping into phone, e-mail data and even facebook to -- to make graphs. they use that information to find out who people travel with their information and their location. originally it was used to track foreigners. but the times says it includes americans. the report indicates documents leaked by edward snowden. police will use both cameras and license plate readers to combat drug-related violence in an area at facebook headquarters. they will install one camera at each entrance to the bel haven neighborhood.

the readers will be on two parked police patrol cars and one unmarked car. 7:18. this morning, opening statements will due to begin for a peninsula high school student accused of trying to rape his former teacher. police say 21-year-old david very last questions pulled a knife on his former teacher in the garage of redwood city's summit high school last year. police say he then tried to rape her but he was stopped by another teacher. the victim later told police she recognized her attacker's voice as the teenager she had been teaching for several years. 7:19. former giants' pitcher brian wilson now has his 2012 world series ring and he's not apologizing for confronting his old boss about it. wilson now pitches for the dodgers. he was caught on camera at at&t park asking why he did not get

his ring. larry bear said we get him that ring that night and he handled that situation. >> very direct. what happened in the east bay? >> another crash, southbound 880. the traffic is going to be slow in the area. so the crash is here. the last crash was right and here and the traffic is still very slow in the area. i want to mention that northbound traffic may get a little bit of an effect from the rubberneckers and the line i've drawn is all of that slow traffic from the altamont pass as you drive through. speeds are low through this area. if you are driving through, it's -- gosh, 23 miles an hour. that's not really good for a morning commute. i don't have to tell you that. san mateo dumbarton bridge traffic look good. let's take a look at the san mateo bridge toll plaza area. no problems there. cloudy, as steve's been mentioning, and we did have wet

roads earlier. the traffic at the toll plaza is backed up for a 20, 25- minute delay. to the ramp for 880, it's not that bad. it's a better-than-usual morning at least for now at the toll plaza. here's steve. thank you, sal. mostly cloudy. this is a weak front for us. it was a whopper of a system up in the pacific northwest and also extreme northern california. you get to around willits, and there was some really hefty rain totals. 1.50 to 8 inches of rain. torrential rain. seattle has had 5.36 inches of rain. that's more than the average they get for december and january. we get a little bit. this little guy is racing ahead of the low. there's no cold air with it. there's already some breaks in the clouds. 24-hour rainfall totals, not

federal investigators hope to reach the wreckage of this jet crash in san santa monica today. a business jet crashed into an airport hangar last night. the hangar collapsed around it. a crane will be needed to lift the hangar off the plane. we still don't know how many people were on board that flew in from idaho. it's believed there are no survivors. a family that moved from san jose to virginia, they are loeping someone will -- they are hoping someone will give back the things that were stolen from their moving truck in san jose. the truck and some items have been found. but some really sentimental items like their children's baby books and a wedding dress, they are still messing. those items can be returned anonymously by mailing them to the south valley family ymca. that address, you see it on the

traffic and lelelling. we have slow traffic. i'm gonna put a speed up here. southbound 880 is 26 miles an hour. not a very good speed, not very encouraging. at least not for now. let's go to the bay bridge toll plaza where traffic is filling in quickly. this is a 30 to 45-minute delay. in fact, the new bay bridge is a big hit with bay area commuters. more drivers are crossing it since it opened on labor day. but more cars mean slower commutes. ktvu's brian flores explains this in a live report. brian? >> reporter: it's all about perspective. as you take a look behind me, the long wait here on the eastern span of the bay bridge. traffic heading into san francisco. many commuters say it's a headache sitting through this traffic. but some also say it also shows how the bay area economy is strengthening. the san francisco chronicle examined westbound bridge traffic for the first two and a half weeks. according to their numbers and backed by the metropolitan

transit commission. on average, there are 1600 more cars on the bridge than this time last year. while it may be cause the bridge is generally nicer to look at, according to the employment development department, there were 93,000 people more employed last year, which would explain why you might have noticed traffic on other bridges. but, of course, the major setback is the commute time, as you mentioned, sal. while the -- what the chronicle found from the toll plaza to fifth street, it takes about 15 minutes on the old bay bridge, that was about 13 minutes. as we take it back out here live, eastbound traffic in the afternoon, it looks like it's flowing nicely. for the past few weeks, transit ridership has increased on b.a.r.t. and other transit agencies as

well. brian flores, ktvu channel 2 news. >> thank you, brian. we have exclusive new information about that horrific high-speed crash in san francisco that killed a 16-year- old boy friday morning. ktvu's tara moriarty joining us live from san francisco. what do you know now? >> reporter: sources have revealed that 58-year-old jenfy zhu was arrested on charges of vehicular manslaughter. she posted bail. she's no longer in jail. we're on the streets where we believe she lives. we tried knocking on her door but did not get an answer. a lot of questions for her, especially from the friends of kevin phan. last night they put flowers and notes at the intersection where the horrific accident unfolded on the corner of pine and gough. san francisco police say zhu was driving at speeds up to 85 miles an hour for three blx before she rear ended the minivan at a stop site.

a mother and her children were seriously injured. three other people in a catering van were hurt. there will be a display case set up on the main floor of the high school to loner him -- to honor him at the high school. a witness say zhu fell to her knees and she went to the hospital, was treated and released. we'll try to get ahold of her this morning. we'll let you know if we can, tara moriarty, ktvu channel 2 news. a children's birthday party in golden gate park yesterday afternoon mail dangerous all of a sudden. the kids found a loaded gun. the kids reportedly found it as they played in the bushes near the conservatory of flowers. investigators have not said how the loaded gun got in the back.

tonight, pleasant hill may become the latest california city to impose restrictions on gun and ammunition sales. the city council is set to require an ordinance for drug dealers. under the same proposal gun store workers would have to pass a criminal background checks and gun stores would not be allowed to open near schools, parks or daycare centers. police say the ordinance would make this safer but critics say it would create an unfair burden on gunle doers. mountain view -- gun dealers. police tweeted this picture of some of the drugs collected during the two-day rave event. amnesty bins were set up for people to dump their drugs. about 25,000 people attended the rave. police say besides arrests made, they also received multiple complaints about

noise. 7:37. santa clara's historic downtown post office may soon be closed in some of the -- and some residents are not happy. the postal service holds a meeting. they will talk about this proposal. many residents say the 80-year- old building is vital to the success of the downtown area. if a proposal passes, postal services would move to a building two miles away. now, that closure if it happens will be part of the postal service effort to retuesday retuesday -- to reduce costs. today is janet napolitano's first day at the university. she will be paid $571,000 a year. that's about three times what she made as a member of the president's cabinet. but she insisted that she be paid $21,000 less than her predecessor. 7:38. tomorrow marks 20 years since polly klaas disappeared from her petaluma home.

on october 1st, 1993, 12-year- old polly klaas was kidnapped at knifepoint from her mother's home during a sleepover. about two months later, her body was found near cloverdale. richard allen davis was convicted of her murder and sentenced to death. since her death, polly's father, marc klass, started the klaas kids foundation which helps the kids of other children who have been abducted. the as could find out later tonight what time they will play during the first round of the american league playoffs. it will all depend on the tie- breaker between the tampa rays. the first home game will be held friday and saturday in oakland. the time of the games have not been released. tickets are still available. if you go to the website, there is are only a few left limb --

u.s. stock markets dropping earlier today as it became all but certain the federal government will partially shut down for the first time in 17 years at 9:00 p.m. our time tonight and treasury secretary jack liu was worried borrowing would be impacted. the dow is currently down 93. the nasdaq is down 13. s&p down 7. twitter plans to stop being so secretive about its ipo. the microbloging site based in folks filed for the ipo three weeks ago but it fired confidently and without providing -- confidentially and without a time line.

with another train. officials say this happened between an outbound train and an out of service train. they are still investigating why that out of service train was on the tracks. witnesses say they heard a loud crash and then they heard a lot of people screaming. none of the injuries at this point are said to be life- threatening. again, this is developing news from chicago. a head-on collision between two trains. we'll bring you details as we get them in. 7:47. happening today -- the man accused in the colorado movie theater shooting is expected back in court. at today's hearing, attorney attorneys will discuss a notebook james holmes sent to his psychologist. the journal who leaked the information about the notebook violated a gag order. if the reporter involved does not release her sources, she could face jail time. holmes has pleaded not guilty by reason of insanity for the 2012 shootings that killed 12

people. the retrial for the american student accused of killing her british roommate begins in italy. amman ta knox and her ex- boyfriend were -- amanda knox and her ex-boyfriend were acquitted after she spent four years in jail. the court has been sent back to italy. knox will remain in seattle. about the court convicts her, she will be ordered to return to italy. sheriff's deputies in monterey county investigating a tragic incident on a college incident. investigators say a csu monterey bay student died after falling from an upper floor balcony that happened late saturday night at an om- -- an on-campus dorm. police are hoping veins video will lead to the arrest of two men who they say broke

into a house last tuesday. you can see them using a tool to break into the house on cutting boulevard. and then after one of the men kicks the door open, the other one notices the camera and knocks the camera away. take a look at that. if you recognize those men, call the police. the berkeley police association is renewing its efforts to arm city police officers with tasers. right now, the city of berkeley does not allow their officers to carry tasers. instead they give them batons or guns and pepper spray. this later -- latest push comes after a mentally ill person was injured while trying to commit suicide. police say it wouldn't have happened if they were able to use a taser on him. 7:49. the second phase of the bp oil spill trial is now underway in new orleans. we're gonna have that story in a moment. we'll have more on "mornings on 2" after this. stay with us.

welcome back to "mornings on 2." nine minutes before 8:00. want to check in with sal, see what's happening on the roads. >> tori, can i say i like new necklace? >> oh, thank you. >> don't know why i noticed that. let's take a look at the commute now. traffic is moving along pretty slow on highway 4. i tell you what, highway 4 is improving. 680 is still slow nearby. at least we see some improvement here. let's move along and take a look at the commute here at the toll plaza also improving there. i mentioned that the commute might be slower than usual. it's damp out there. steve, our forecaster, has said that, well, it's not a big deal but sometimes on traffic it does cause slowdowns. the biggest slowdowns of the -- after the morning commute, after 8:00 have been 580 and also the peninsula, 101 and 92.

very slow. southbound from burlingame down to belmont. i think 280 would be a better route after you pass san bruno. let's go to steve. thank you, sal. mostly cloudy, partly cloudy. this system is falling apart. we're just too far south. i mean there's a lot of energy to the north. there's been some heavy-duty rain to the north also in the pacific northwest. it was making a pretty good push. it made for good rain up in parts of mendocino county. it fell apart and we're getting a little bit here. heavy rain up in the northwestern part of the state. 4 to 5 inches. about 1 to 2 as you get into parts of northern mendocino county. south of that didn't have enough. but at least it made it. st. helena, .25. sausalito, .04. napa .02. so partly sunny, mostly cloudy here in the morning. we'll clear it out. wind has been southeast so the lows are really mild. you can see there's not much left. if any rain is falling, it's

mostly sunny, same for wednesday. we get a system digging into the sierra. that will give us a north- northeast wind which means windy and normal weather. the second phase of the bp oil spill trial is now underway in new orleans. this time the focus is on what the company did to stop the flow of oil into the gulf of mexico after the 2010 spill. it will also focus on how much oil actually seeps into the ocean. bp is fighting claims that it was grocery negligent. plaintiffs say bp knew a spill was possible but was not prepared. bp is facing a pollution fine up to $18 billion. the city of san jose may soon lift its long-standing ban on fireworks and supporters say it could actually make san jose safer on the 4th of july. they say ending the ban on so- called safe and sane fireworks might reduce the interest to more dangerous and illegal fireworks. firefighters say there's been a

big increase in the use of fire crackers and bottle rockets since san jose-city sponsored show show ended. the show was canceled due to budget cuts. terrell prior didn't play yesterday against the redskins. he was due to start but problems from his concussion came back. so matt flint started for the raiders and the raiders lost, 24-14. by the way, prior suffered the concussion against the broncos eight days ago. still not clear whether he will play against the chargers on sunday. dante witner says he's ready to appeal if the nfl tries to fine him during the hit during last week's game. he was flagged for unnecessary roughness after he hit chris gibbons' helmet. back in week three, witner was penalized for hitting ahmad bradshaw with his helmet.

but the league said that hit was a legal hit. this morning, hundreds of low-income, east bay school children will get gifts to help them this school year. the organization k to college is passing out more than 400 packages of school and dental supplies. all of the kids go to lake elementary school in san pablo. about 500 schools nationwide have dropped out of the federally subsidized school lunch program. they say the new standards for healthier food are too expensive and too hard follow. that's only one half of a% of all schools in the program. 80% of schools say they meet the new requirements. school officials do say, though, students complain, the less greasy food just doesn't taste as good. sometimes you have to get used to it. truancy problems are big problems. the bay area counties topping the list when it comes to

truancy. >> reporter: and an 18-year-old young man gunned down at this vallejo apartment complex last night. we'll tell you about the frightening scene one neighbor found as he stepped out his door after the gunfire stopped. right now it's very slow in santa clara valley. northbound 101. you can see the slow traffic but some of the alternates are not much better. we'll explain.

sometimes it's 25. sometimes it's 15. but i guess the average time is 20 minutes here at the toll plaza before you make it onto the bridge. the speeds are -- i want to show you something. highway 4 between lone tree and loverrage, the speeds are picking up. i will show you on the map. the traffic has shifted in essence. people have already left the construction zone and now they are crowding on 680. there is a crash southbound 680 at treat. it's not in the lanes. some of that slow traffic is headed towards san ramon. let's take a look at the bay bridge toll plaza -- actually, we just looked at the toll plaza. so let's go back to the desk. >> thank you, sal. another deadly shooting last night in vallejo. the victim, 18 years old. ktvu's alex savidge is live at the apartment complex where neighbors witnessed the saddened of the young man's short life. good morning, alex. >> reporter: well, good morning, tori. this 18-year-old victim has not been identified by police. but a lieutenant did tell me, the young man lived in this

area. this was certainly a dangerous situation here for neighbors. this young man was hit through the neck with the bullet. but there were quite a few other shots that were fired through the apartment building that have hit any number of people in this area. the young man hit by the bullet, collapsed right here in the doorway. this is where he died. i want to show you some video that we shot this morning because just a few doors down from here, let me show you how lucky one neighbor was. a bullet hit his barbecue grill that he had in front of the window. thankfully, it didn't go inside the apartment unit. there was a round that went through the windshield of a car parked in this complex as well. this deadly shooting happened last night after 7:00. this complex is on the 1300 block of santa clara street. police say this teenager clearly was targeted in this case. although investigators can't say at this point what the motive might have been here. police are not calling the shooting gang-related. a lieutenant did tell me this

morning that there's been a feud in this area. listen to what one neighbor told me after the shots were fired. he walked outside to find a disturbing scene. >> i don't know if they wildly shooting or disregarding and shooting, shooting up the apartment, bullet holes upstairs and this guy down here, he ended up getting shot through the neck out the other side. i believe he instantly died. >> reporter: now, police don't have a description of the shooter from last night's homicide. this was the 18th killing of the year. so far here in vallejo. lieutenant told me this morning that they really at this point are looking for more witnesses to this crime to come forward to who really help them hopefully make an arrest in this case. neighbors in this area say they are familiar with this kind of violence. in fact, in this apartment complex last month, a man was shot and wounded. live in vallejo, alex savidge,

ktvu channel 2 news. 8:04. the state attorney general kamala hair ritz wants california school districts to make changes to do something about kids missing school. it's costing the state millions of dollars. ktvu's janine de la vega joining us live. she's in santa cruz where the truancy rate is very high. >> reporter: dave, we don't have the particular attendance numbers for this elementary school but what we do know is that santa cruz county ranks in the top three in the state when it comes to having the highest truancy rate. it's at 30%. in a new report released today, state attorney general kamala harris says attendance in schools in california is at a cry -- crisis level. it's causing consequences for our economy, safety and children. the department of education finds one out of every five elementary school children were reported to be truant in the 2011/2012 school year. a student is considered absent

or tardy by 30 minutes without a valid excuse. students who miss a lot of school are likely to struggle more and drop out of school later. parents need to collaborate on local agencies. contra costa county ranks the highest at 29% for truants. alameda county and san francisco are at 23%. the lowest rates, marin and napa county which just had a rate of 6%. research shows that school districts lose $1.4 million a year and the cost is even higher when you take into account the cost of incarceration because of kids who actually drop out and the loss of economic productivity and tax revenue. reporting live from santa cruz, janine de la vega, ktvu channel 2 news.

8:06. now to our continuing coverage of the deadly stabbing last wednesday night of a los angeles dodgers fan at at&t park. yesterday, the family of jonathan denver went back to the ballpark in san francisco on the last day of the giants' 2013 season. they handed out fliers, urging witnesses of the fatal stabbing to come forward. >> anyone who may have witnessed the incident to come forth so that both families can have some measure of closure. >> denver was killed after attending a giants' game last wednesday night. the only identified suspect, michael montgomery of lodi, was released from custody friday night. he claims the stabbing was in self-defense. prosecutors say there's not enough evidence to charge him at this time. we've posted more video of yesterday's comments by jonathan denver's family. you can find a link to it on our home page at ktvu.com.

proceeds from this weekend's games went to benefit injured bryan stow. he was at the game yesterday where he gave the crowd a thumbs up. the giants donated $10 from each ticket sold from the three games. that money is to go towards his recovery. he was beaten on opening day in 2011 at the game. the clock ticking toward another possible b.a.r.t. strike. the 60-day coolingoff period will end in a week and a half. contract negotiations are set to resume at 9:30 this morning. the b.a.r.t. management and the unions plan to meet every day during the final days of the cooling off period. but at this point, the two sides are still $112 million apart. b.a.r.t. workers could walk off the job again. in the meantime, this

morning, the orinda city countyman who wants a law -- councilman who wants a law banning strikes will be at the walnut creek b.a.r.t. station urging passengers to soin an on-line pe -- to sign an on-line petition. he wants to make it illegal to walk off the job. he says the four-day b.a.r.t. strike back in july clearly showed how transit strikes can cripple an entire region. drugs are being blamed for a party that turned violent in marin county. emergency responders were called to the home in mill valley sunday morning. deputies say a partygoer reported a teenager having a seizure, possibly from using acid or lcd. the firefighters say the 16- year-old boy refused to let them in and became combative. >> interesting that the firefighters and the deputy both described this individual as having super human strength. this ising we used to see years ago with the -- this is something we used to see years

ago with the use of pcp. we don't see that much anymore. >> deputies say the suspects were taken to a hospital and then later found for juvenile hall. mill ville has a social host ordinance. deputies say a 16-year-old girl who hosted this party was cited under the ordinance. her parents could be held responsible. the vacant home is owned by her family. property owners can be fined $750 to $1,000 for a party with teenaged drinking whether they know about the party or not. 8:10. the city of san francisco still dealing with a very expensive water main break. that february 27th water main break has cost the city $5.5 million so far. 23 homes and several cars were damaged when that water pipe burst on wiwona street and 15th avenue. the city is paying for the

damage right now. but they are blaming the break on an engineering company. the city says the engineers did not make sure that water pipe was safe after they performed some work near the pipe. it is 8:10. a loaded gun found in golden gate park. the most disturbing part is who found the gun and how it could have put innocent young lives at risk. so when this house doesn't get its way, it wants to shut down the entire federal government? >> we're less than 14 hours away from a possible shutdown in the federal government which services will actually be affected if a deal is not reached. things are improving in some commutes but some are still slow and getting slower. we'll tell you where those are -- straight ahead. already some pockets of sun. mostly cloudy, partly sunny skies. been a little bit of rain. but not too much. are we done for the rain this week? are there any other changes? embrace the season.

like republicans won't waiver. >> nobody knows what the rules are. cutting hours of many current employees, scared to higher new once. >> reporter: harry reid said he would not agree to this. without an agreement the shutdown kicks in. hun treads of thousands of federal workers nationwide face furloughs. the military won't get paid on time. it would be retroactive. people who select social security, disability and food stamps will still get the help but the economy is expected to suffer if the government shuts down for the first time in 17 years. live in washington, kyla campbell, ktvu channel 2 news. 8:15. more details now on the services that will not be affected due to the government shutdown. as kyla mentioned, social

security and medicare checks would still go out on time. post offices will remain open and process mail and military service members would be on duty. congress, by the way, still getting paid as well. now, the secretary of labor says a shutdown could delay the release of the jobs report due out this friday. that's because the people who prepare and release it would be furloughed. the white house could authorize a small staff to prepare the report in the event of a shutdown. but has not said if it will do so. nancy pelosi was not in world trade center over -- was not in washington, d.c. over the weekend. she was here in california celebrating her 50th wedding anniversary. it was an event scheduled a long time ago. in the republican-ceiled house, nancy pelosi's vote would not have made a difference in the outcome. some are still criticizing her for not being there in

washington. in other news, it's believed there are no survivors of a small jet crash at santa monica airport. a business jet crashed into a hangar right there. the hangar collapsed in the flames around the jet last night. officials say a crane will be needed to lift the hangar off the wreckage. the jet flew in from idaho. it would have crashed into nearby homes if it had not hit the hangar. we still don't know how many people were on board the plane or if this there were people inside the hangar. investigators will continue the investigation later today. there are two automakers recalling a total of 200,000 cars. mazda is warning about a problem with the doors in its maus za 6 sedans. the -- mazda 6 sa dance. these models -- sedans. these models' doors can open

and it's of no one's concern. the giants say wilson never responded to repeated attempts to give him the ring before thursday. well, lawyers for yankees' star alex rodriquez are expected to face off with mlb today about his suspension. both sides meet with an arbitrator today. the legal has issued a 211-game suspension for allegations he used performance-enhancing drugs. now, if the arbitrator does not overturn the decision, a-rod could lose millions in his pay. if it's overturned, mlb says that would weaken his power to enforce anti-doping rules. 8:25. happening right now, president obama is meeting with the israeli prime minister at the white house. iran is expected to be a major topic of discussion. before leaving israel prime minister benjamin netanyahu said he would be telling the

truth about the sweet talk and onslaught of smiles. president obama spoke to iran's new president on the phone, the first direct conversation between the two countries's leaders since 19 -- countries' leaders since 1979. as a girl scout volunteer, you can show girls that anything is possible. >> first lady michelle obama is helping the girl scouts with their new recruiting campaign. the scouts are looking for volunteer leaders. the campaign called "i can't wait to" focuses on the fun of scouting. the organization has seen membership drop nearly 25% in the last ten years. 8:26. a small device on nasa's "curiosity rover" is sending back more news from mars. it's about the size of bread. this device which was made in mountain view is giving new insights about the wind and

geeology -- geology. it detected a crust of large particles on top of smaller particles which gives the suggestion that mars has had a lot of fierce winds. the new bay bridge, proving very popular, as you know, with drivers. but it may be too popular. how many more cars have crossed the new span since it opened compared to a year ago. we're live in san francisco where police have arrested a 58- year-old woman they say is responsible for a car accident that claimed the life of a lincoln high school student. we've learned exclusively who she is and we'll let you know who she is coming up. and right now, traffic is still busy getting into the valley. westbound 237, you can see some slow traffic there as you drive through. some breaks in the cloud cover, mostly cloudy. got a little bit of drizzle. there is not much left. ♪

not a lot left. the best we could find here was .25. st. helena, cazadero in there. and then really mild lows. some never dipped below 60s. that's for sure. we're already 60 to 66 right now. napa, 63 low. i know at the airport and also in town there's probably rain north of town which had the .02 at the airport. the system hanging up in the sierra nevada. for us, it's the low clouds. there's not much underneath that. partly sunny. areas of fog, though. cool for some, but very mild for others. could be drizzle or mist holding on. highs today, 60s and 70s. good morning, the traffic is doing pretty well. but is still slow in san jose and the south bay, steve. this is northbound 101, it's improved a little bit. but 280 is slow and so is 85.

things are getting better and the roads are dry. in oakland, we have a lot of slow traffic on 580 stretching back in san leandro now. it's become worse. 880 is slow from the coliseum up to the brick wall. bay bridge we've seen improvement. just a little bit of slow traffic there on the right-hand side. that's maybe about a fife- minute delay. it -- five-minute delay. it had been as long as 40 minutes. the new bay bridge is a big hit. more drivers are crossing the bridge since it opened. but more cars mean slower commutes. brian flores explains now in this live report. >> reporter: you mentioned heavier commutes on the bay bridge. right now, the eastern span, traffic going into san francisco right now, this is a typical morning commute. but some people say it's become a headache now for the commute in san francisco despite the fact there's the new bay bridge. others say it is showing how the bay area economy is showing

its strength. the chronicle examined westbound bridge traffic for the first two and a half weeks since it opened. according to their numbers and backed by the metropolitan transit commission. on average, there are 1600 more cars on the bridge than this time last year. the mtc says that's enough to fill an entire freeway lane for about 48 minutes. does more car means that's a bad thing? according to the state eight employment development v, there were 93,000 more people employed in the bay area which could explain why you may have noticed traffic on other bridges as well. but, of course, the major setback is the commute times with the added features of the bay bridge. commuter times were supposed to decrease. what the chronicle found out from toll plaza to fifth straight, it takes about 15 minutes. it was 13 minutes on the old bridge. traffic running smoothly. that changes in the afternoon. traffic commute times have increased from 14 minutes to 17

minutes in the afternoon. and increased ridership as well on b.a.r.t. and other transit agencies as well. we're live here just west of the toll plaza, brn flores, vu chael 2 news. >> thank you. 8:33. we now have exclusive new information about the horrific high-speed crash in san francisco on friday morning, the one that killed a 16-year- old boy. tara moriarty is joining us live from san francisco. what did you find out this morning? >> reporter: sources inside the sheriff's department told me that 58-year-old jenny zhu has been arrested on charges of vehicular manslaughter. she did post bail last night. we're not sure how much the amount was. she's not in jail here. we came to the outer sunset district to a home we believe was hers. she knocked on the door. she did not answer. obviously people have a lot of questions for her, including the friends of kevin sand. he was the one killed in the car crash early friday morning. police believe zhu is

responsible. people left flowers on the corner of pine and gough. police say zhu was driving at speeds up to 80 miles an hour in a silver mercedes suv for three entire city plox before she rear ended the victim's van. three other people in a catering van were hurt. sand was a junior at lincoln high school where he was a member of the rotc drum corps. there is there will be a display set up all week long to honor him. witnesses say zhu got out of the car, fell hadder to knees -- fell to her knees and grabbed her head. she was taken to the hospital and treated and released the same day. this case has not been presented to the district attorney's office. it typically takes two days force the police to file the

report with the da's office, we're hoping to learn more information probably later this afternoon or early tomorrow morning. live in san francisco, i'm tara moriarty, ktvu channel 2 news. 8:35. a children's birthday party in golden gate park yesterday afternoon took a dangerous turn when some children found a loaded gun. the kids reportedly found it as they played in the bushes near the conservatory of flowers. no one was hurt. investigators have not said how that loaded gun got in the park. a new report in the new york times shows the number of accidental gun deaths in the children in the u.s. could be twice what the officials figure show. for example, in california, the time says the official count shows 11 children under the age of 15 killed in shooting accidents from 20007 to 2011. but the paper found another 16 children who died in shootings that were not classified as accidents. the paper says it's important to have correct statistics with

the current debate over gun control laws. tonight, pleasant hill may become the latest california city to impose tough new restrictions. the city council is set to require an ordinance requiring a police permit for gun dealers. under the same proposal, gun store workers would have to pass a criminal background checks. and gun stores would not be allowed to open near schools, parks or daycare centers. supporters say the ordinance would make pleasant hill safer but critics say it would create an unfair burden on gun dealers. more than 100 people arrested over the weekend at the beyond wonderland rave party. most of the arrests were drug- related. police in mountain view tweeted out this photo of some of the drugs seized during that two- day event at the shoreline amphitheater attracted 25,000 people. these bins were set up for people to dump their drugs.

police say along with the arrests, there were several noise complaints as well. a plan to close santa clara's downtown post office is very controversial. tonight the postal service will hold a meeting at santa clara city hall. a lot of residents say the 80- year-old building is important for the success of the downtown area. now, if that proposal passes. postal services would move to a building two miles away. that closure would be part of the postal service's efforts to reduce their costs. business owners in oakland are frustrated over a rise in break-ins and slow response from police. the surveillance video shows the third break-in at this bar in less than a week. on saturday, burglars stole several bottles of liquor. many owners think the same group is behind most of the 15 burglaries in the last three weeks. >> we've got fingerprints, dna, i've got a witness. word on the street, we know who
