then i think it will be sunny by this afternoon as the higher clouds cleared out. elevated fire danger will clear out. northerly winds. there's the band of high clouds going over us right now. it will clear out. once it does, then we'll have a lot of sunshine. mainly 50s. there a few 40s. san francisco today we'll start off with a lot of high clouds and then mostly sunny later on. high today of 68 degrees. but tomorrow temperatures look to be in the 70s for much of the coast because high pressure is on its way. we have to deal with this cloud band. high clouds, and then sunny, mostly sunny later on today. not much of a breeze yet. there might be a component of this later this afternoon and tonight. but morley tomorrow -- but more likely tomorrow. here's sal. traffic is gets busier. we've had a couple of minor crashes. we have a had a lot of slow -- we've had a lot of slow

traffic. the bay bridge has not filled in as much as we thought. it's backed up for a 20-minute delay. not as bad as it could be. hopefully it will stay this way and not got any worse. we have a feeling it will get more crowded as the day goes on. the 580 commute in the livermore valley has been slow, especially coming in off the alta mant pass but it does -- altamont pass. but it does even out. we've had a few problems near the bernal exit. there's clearing a crash. the traffic has been slow on 680 leaving the stoneridge mall area and toward pleasanton. the clock is ticking with another possible b.a.r.t. strike with time running out. you can see understand nine days about eight and a half days left. the 60-day cooling off period ends next thursday. in a few hours, the two sides

in the b.a.r.t. labor dispute head back to the bargaining table. we're learning about a major new development in another local transit dispute. tara moriarty joins us live with new information about the threat of an a.c. transit strike. good morning. >> reporter: we learned that a.c. transit transit workers a proposal from their company. that vote around 10:00 last night. bad news for a.c. transit. and really b.a.r.t. isn't looking much better. their negotiations resume in less than three hours. we understand that b.a.r.t. unions did make a counterproposal during a six- hour session yesterday. union leaders are also complaining about b.a.r.t.'s top negotiatorser, thomas -- negotiator, thomas hock about how he's run up a $194,000 tab since talks began. that includes his $350 fee, first-class plane tickets and a fine dining tag.

b.a.r.t. says the -- babb. dining tag. b.a.r.t. says the mud liking needs to stop. >> that would really suck. i take b.a.r.t. every day to go to work every day. >> reporter: how was it last time for you? >> it was definitely inconvenient. i had to leave a lot earlier and i already leave pretty early. >> reporter: b.a.r.t.'s general manager reacted to the union's complaints about hock saying if a reimbursement was made even for one glass of alcohol, b.a.r.t. will retroactively recover payment pass a credit against a future invoice. they say they only reimburse for coach fare. live from oakland, i'm tara moriarty, ktvu channel 2 news. >> all right. 7:05. just hours ago, a san jose house was engulfed in flames. flames and smoke were shooting through the roof by the time firefighters got there. but everyone inside got out

safely. now, ktvu's janine de la vega is live outside the home right now to show us the damage and also tell us what firefighters found inside. good morning, janine. >> reporter: good morning, dave. as you can see the home is still standing. much of the damage occurred in the attic where firefighters found a shrine with lights. there's damage to that room and all of the prayer items inside were destroyed. firefighters arrived and found flames coming out of the home near virginia. four people were inside the home when it started at 3:30 a.m. but were able to escape. the homeowner called 911 after hearing a crackling sound coming from the attic and seeing the fire. crews were able to knock down the flames within 2020 minutes and save the home -- 20 minutes and save the home. fire officials say it appears the fire started in the attic where a prayer room was set up with oil lamps.

>> we make metal and put light there and pray over there. that's a prayer place. >> reporter: as firefighters were mopping up and examining the home, they discovered there were no working smoke detectors inside. they were concerned because the homeowner decided to stay in the house even though there's into power on. they made sure he wasn't going to light candles and they did also install smoke alarms before leaving. the other three families are also staying here. fire officials say they will be investigating a cause of why this fire started. reporting live from san jose, janine de la vega, ktvu channel 2 news. >> thank you, janine. 7:07. happening right now, the house of representatives just came into session a few minutes ago and so far, this morning, it looks like the rhetoric between the two parties is showing no signs of letting up. now, just this morning, the white house announced that president obama is canceling two stops on his upcoming trip to asia because of the

government shutdown. the president is scheduled to leave saturday night. he will still travel to indonesia and bernai but is canceling visits to malaysia and the philippines. secretary of state john kerry will go in his place. the budget battle continues in washington, d.c. with no end in sight. republicans are trying to restore funding to specific parts of the government including national mules, parks, and veterans benefits. but democrats block those efforts. >> veterans today, parks tomorrow, maybe security agencies tomorrow and the next day. this will go on for weeks. >> the two houses disagree that we should sit down and discuss those matters. my goodness, they won't even sit down and have a discussion about this. >> yesterday, some world war ii veterans had to break in to visit the world war ii memorial in washington, d.c. which had been barricaded because of the

shutdown. another group is planning to visit this memorial today. political analysts say it is images like these that may end up embarrassing the politicians into taking action. there's concern about how a prolonged government shutdown could damage the economy. economists say the 800,000 furloughed workers will cut back on their spending since they are not getting paychecks. they will cut back on shopping, on buyer cars or going out to dinner. travel industry executives are worried. if government workers can't travel that means canceling flight and hotels. and tourists who can't visit national parks are postponing their vacation plans. the department of the interior has shut down almost all of the u.s. geeology department which tracks earthquakes. they will keep some usgs workers on the job. they are considered vital to

protect websites and property when there are emergencies like earthquakes. the menlo park office will have three people still working. but seismologists may be called in if there a happens to be an earthquake. you can go to ktvu.com to find out more about which programs will be affected by the government shutdown. look for the link under the hot topics section. there are new details in the case of a redwood city high school student accused of trying to rape a teacher at knifepoint. 21-year-old david velasqez testified that the attack was part of a senior prank intended to scare his teacher at the charter high school. he's currently on trial facing charges, including assault, kidnapping and false imprisonment. he said he waited around the campus wearing a scarf around his face and was shoeless to keep quiet. a man accused of shooting and killing a san francisco state student is scheduled to

return to court. 30-year-old nick holme first appeared in superior court last week. prosecutors say he went out hunting for victims. he's accused of killing justin valdez as he stepped off a muni train. the suspect faces murder charges and possession of firearms charges. 7:10. new this morning an early- morning house fire west of davis has left about four people without a home. it happened about 5:00 a.m. this morning. two brothers were in the home when they smelled smoke and then saw flames coming out of an air air conditioning uni-- air-conditioning unit. firefighters say the fire spread to a bedroom and attic. construction crews are in the process of knocking down homes in lake county damaged by a landslide. 17 homes were damaged. half of a nearby duplex also collapsed. the other half reportedly may

be saved. once the damaged homes are taken down the crews are gonna recontour the slope, put in some drams and cover it -- drains and cover it up with plastic. the work should be finished by october 15th. the fire that began last thursday in solano and yolo counties it will burn for a few more days. 20,000 bales of hay caught fire last week and is still causing air quality problems. the officials have extended a health warning because of that bad air out there. children, senior citizens and people with breathing problems, you are advised to stay inside. the cause of the fire is still under investigation. 7:12. some frightening moments at the oakland airport just this morning. what caused the jet to make an emergency landing at 4:20 a.m. also, a san francisco man found guilty of murder, a celebration led by the judge moments after his conviction and the victim's family is outraged. right now traffic is doing

welcome back. 7:15. new this morning, just hours ago, a fed-ex cargo jet made an emergency landing at oakland international airport. the control tower got a call around 4:20 this morning the -- saying the jet was having hydraulic crews. crews rushed out on a yellow alert. the plane landed safely 20 minutes later. the san mateo county district attorney is considering charges against a firefighter who allegedly ran over a teenaged girl after the

asiana flight. the coroner determined that she survived the plane crash but was run over and kill by a fire truck. prosecutors are trying to determine whether that veteran firefighter broke any laws or if it was just an accident. 7:15. we have new information now about an incident overnight at florida's jacksonville international airport that forced a five-hour evacuation. a federal law enforcement source says this morning that a man arrested at the airport said he had a bomb but the threat was a hoax. earlier police had said two suspicious packages were found at the airport, one in the parking garage. the other in the terminal. >> one of the devices was located -- was found near the checkpoint exactly where, i could not say. >> incoming planes were delayed on the tarmac until buses could pick up the passengers and no

flights were allowed to take off. the jacksonville airport is back open this morning. there is a new flag flap in the east bay. a dozen passengers forced the evacuation of the plan raising the china's raising of the flag in alameda. the flag was supposed to go up by the alameda sister city association. that was to celebrate china's national day which marks the founding of the people's republic of china. there was a similar controversy in san leandro last month. a protest stopped the city council's plan to raise the chinese flag in that city. supporters say this would be a show of sport for the bay area's growing chinese community. but critics say that could be viewed as supporting the human rights violation. 7:17. the family of kevin son announced the weekend memorial services for their 16-year-old child. he died in a horrifying crash in san francisco's lower

pacific heights neighborhood last week. a speeding driver slammed into his family's van killing the teenager and critically injuring his mother and sister. now, the wake for kevin is now scheduled for friday afternoon at the funeral home on 17th street in san francisco. his funeral will be held at the same funeral home at 8:00 saturday morning. there will be a funeral procession in colma for a 9:30 a.m. ceremony. san francisco worries the city may be selling its soul. the tour featuring mountain bikes will take over this month. the chronicle reports that john avalos reported on his facebook account that the city is bending over backwards for cheap bucks. mountain dew will display ads all over the city despite the

desire for healthier drinks. 7:18. sal is back. sal, how's it going out there? >> i would say it's going okay. there's a little bit of slow traffic out there, dave and tori. for the most part it's expected for this time of the morning commute. as we look at highway 4. it's exactly what you might expect at this time. the traffic is shifted from antioch and pittsburg. the traffic is moving along relatively well. the traffic is also going to be okay if you are driving on the bobb approach. there are no major problems. traffic continues to move along well. i do want to show you the commute in the south bay. northbound 101 traffic all the way up to the peninsula does look good and there are no major problems. there. if you are driving across the san mateo bridge, there's slowing on the hayward approach. but after that, it looks good. however, 880 southbound from leleling from fremont will be slow.

hundreds of headstart teachers, administrators are holding a rally to call for an end to the sequester cuts. these are live pictures of the rally. they are saying already more than 57,000 children across the country lost access to headstart preschool programs this year alone.

a san jose after- schoolteacher faces life in prison for being convicted of molesting nine young girls. keith woodhouse was convicted yesterday afternoon on 30 felony counts. the victims were enrolled at trace and el rancho elementary schools. all of them testified at the trial which lasted about two weeks. the sentencing date has not been set yet. 7:24. the family of a murder victim is accusing a san diego judge of improper behavior. now, the defendant, danny des poro was found guilty of first- degree murder. two weeks ago, judge cookson sentenced him to 53 years to life. but afterwards, she cleared the courtroom, then presided over the wedding of him and his fiance. the photos appeared on social immediate ya. you can see -- media. you can see the defendant with his hands uncuffed. the judge is also accused of making a cake for the couple. >> i don't understand why the judge would do that.

why would she do that? you know, i'm lost for words. >> now, the defense attorney believes the judge considered it a gesture hoping that the defendant who has a long history of violence mipt cause less -- might cause less trouble in prison. the san jose city council approves a proposal for healthier choices among vending machines. last night by a 6-3 vote, the council passed a bill requiring that at least 75% of the snacks and drinks in city contract vending machines are considered healthy. that means food that's low in sugar, salt and fat. the old law that took effect in 2006, required half of the food items were healthy. 7:26. no blue angels, no navy ships but san francisco is still finding ways to celebrate fleet week. >> reporter: we're live near union square where smash-and- grab vandals hit a store

we have a new crash on 680 at treat boulevard. it's a motorcycle verses a hummer. that's what chp says. it's very slow coming through on 680. the fire department and paramedics are on the way here. this is southbound 680 right at treat boulevard. this crash here is going to be affecting traffic. i want to mention that traffic is going to be busy on highway 4 and also on highway 80 in the west contra costa area. it's back up west of hercules on the way to richmond. let's take a look at the live picture of the bay bridge. that's backed up for a 20- minute delay. maybe longer than that. we're getting some slowing out of downtown san jose again. people have been avoiding 101. we've had some earlier crashes. 280 is not a great alternate. 7:32. back to the desk. we're finding out more about a smash-and-grab burglary in san francisco's union stair. it happened in the 100 block of post street about 11:30 last night. ktvu's claudine wong joining us live from the store with more

from a woman who was at the scene shortly after it all happened. good morning. >> reporter: good morning. this happened at 11:30 last night. we're about a block and a half from union square. the stores were all closed. icebreaker closed its doors a 8:00 at night. at 11:30, someone smashed this window, setting off the alarm at the business. police were notified and came down here. they are calling a smash and grab at the store. we talked to a woman who was here and helped the manager clean up. >> the police were here, and they handled it. i mean, it was unfortunate that it happened. but there's very good kind of cameras security things starting to happen around union square. i think that may be -- may have a positive impact. >> a positive impact important because more than one person we've talked to out here has pointed to the store across the

street and said this has actually happened to that store. one man said he saw broken windows twice. people doing the same type of crime. we talked to police trying to confirm that. but business owners and business employees say this is a problem and there's cameras and they hope that will help catch the peep responsible -- people responsible. back to you. >> thank you. day two of the government partial shutdown. democrats and republicans seem as far apart than ever on coming to an agreement to fund the government. lawmakers from both parties 0 suggesting the partial shutdown might last for weeks. still, republican congressman peter king of new york is charging that tea-party backed members of thehouse republican caucus are trying to hijack the parties. he says the increasing number of house republicans, perhaps as many as 100 are growing

weary of the ted cruz wing. kyla cam bem joins us live from our -- campbell joins us live from our washington, d.c. newsroom with more. >> reporter: the house will try to pass legislation today that failed to pass last night. we're taking a live look at the house floor where members will vote again today to fund the government in stages. starting with veterans affairs. national parks and the city of washington, d.c. but democrats and some republicans are not on board with that piecemeal approach. so far this week, house republicans pasted four wills to fund the government -- bills to fund the government. but each of them delayed or wanted to defund obamacare. democrats want a clean, temporary budget meaning no strings attached. republicans including tom mcclintock from california don't seem willing to do that. >> i would listen to the

millions of americans who are using their affordable health energy as a result of -- insurance as a result of obamacare. >> reporter: the senate is back to work at this hour. we'll keep an eye out on the floor to see if feinstein and boxer have a new reaction to this ongoing shutdown. live in washington, d.c., kyla campbell, ktvu channel 2 news. the federal government shutdown is having a ripple effect here in the bay area. 3,000 people work at the federal building in downtown oakland. now that many of them have been told not to come to work nearby shops and cafes that cater to the workers say they are hurting. >> i hope it doesn't last long, really, for everybody's sake. >> this is the way i feel. we're not -- i can't respect either one them. they are not working as a team and playing fairly with each other. >> the business owners say they can handle having fewer

customers for a day or so. if the shutdown drags on, the businesses will really take a hit. today is day two of the rollout of president obama's new healthcare law. the california version is called cover california and offers a variety of health insurance plans to californians. coming up at 7:45, the first day glitches at the covered california website. just imagine. no blue angels for fleet week this year. they are grounded and the navy ships, they won't be sailing into -- into port. san francisco says they will celebrate when the event kicks off on monday, still. brian flores is live from san francisco. you have more on the event and the business owners who are planning this. >> reporter: fleet weeks brings in about a million visitors each time it rolls around every year. without some of the major events, area merchants are trying to find ways to bring in

some of that tourist money here in the month of october. it won't includes the jets and the blue angels and the parade of naval jets but it will include fireworks. workers putting together four consecutive saturdays where fireworks shows will take place along fishermen's wharf. those shows begin at 8:30 at night with the first show starting this saturday. now, officially pier 39 is celebrating its 35th anniversary. it's unclear how much it will cost but they hope the fireworks shows will draw in tourism. tourism officials say this is meant to make up for lost revenue that would normally be brought in from major draws like the blue angel. a veteran stopped by and says he appreciates the fireworks but says overall, it won't be the same. >> how can you call it fleet week if the navy is not gonna be here, it's not complete week. it's christmas week or something. i don't know what you call it.

it's not fleet week. >> reporter: this coincides with the first wharf fest scheduled for october 26th to 27th. event organizers say that will be a family-friendly event. there will be chatter competition, tastings and live music. as you can meaug, this has been -- imagine, this has been a difficult time for this area. you have the federal budget cuts and the government shutdown affecting tours to alcatraz as well. we're live along pier 39, brian flores, ktvu channel 2 news. >> thank you, brian. 7:39. the shutdown of the federal government could slow down san jose's efforts to bring the oakland as to the south bay. that's because the city's lawsuit against major league baseball is being heard in the federal courts. on friday, a judge is scheduled to hear from both sides and consider baseball's request to have the suit tossed out. however, all of that could be delayed due to the government

shutdown. the city of oakland threw a playoff rally yesterday for the team. city leaders announced, they found a deep pocketed investor to block a coliseum city plan which expands the site toward the airport and builds up to three pro stadiums. mayor jean quan adds that a second site at howard terminal could be ready within months. she says the city is swept up in as fever. >> we're all getting ready for friday. you know, i think the momentum is building. you know, city hall will be green. all of the terminals and the cranes have been lift up in green, too. >> game one friday against the tigers is sold out. there's only about a thousand tickets left for game two on saturday. game one starts at 6:30 friday night, first pitch of game 2 is around 6:00 p.m. on saturday. teams then head to detroit for games three and four. if necessary, the final game five is in oakland a week from

tomorrow. whoever wins the best of five games advances to the american league championship series. a redwood city high school student accused of trying to rape a teacher at knifepoint has a shocking explanation for the attack. a convict already confessed to killing amber swartz from pinole 25 years ago, but coming up, the reason the case has been reopened and how the girl's mother feels about it. it's still pretty heavy out there. it's getting busier in some of the key areas. highway 4 is one of those spots where it's slowing way down. well, pretty good band of high clouds. they won't last too long. but temperatures a little bit warmer and cooler and what's in store for the weekend.

u.s. stocks dropping significantly as a partial government shutdown in washington enters the second day. this is adding to concerns over how soon a political compromise could be reached. really nothing in the offing at this point. the dow is currently down 131. the nasdaq is down 17. s&p down 12. it is 7:44. new reports says apple has the biggest stash of cash of any u.s. company. moody's says apple has $147 billion hoarded away. that represents 10% of all cash held by u.s. corporations. microsoft has the second largest cash holding but it's less than half of the size of apple's cash. meanwhile, not everyone is happy with microsoft's co

founder still serving in leadership. three of the top executives are pushing for bill gates to step down as chairman. they feel he might be holding the company back from finding a new direction after the departure of steve botcher. gates who is still the biggest shareholder is not commenting. dodge is about to recall almost 143,000 of its suvs and trucks. there's the problem with the instrument display panels in the 2014 grand cherokee and ram trucks. so far, no injuries have been reported that could be related to the problem. dodge is notifying owners to bring in their trucks and suvs for repairs. police have reopened a case of a little girl who went missing 25 years ago. pam cook has another. >> police in pinole announced that a new set of eyes should take a look at the missing person's case of amber swartz.

these disappeared from her front yard back in 1988 but police closed the case 11 years later after convicted killer curtis anderson confessed to her murder. he died after his conviction. a body has never been found. the case is being reopened to take a new look and to take advantage of modern science that was not available back then. amber's mother was there for the announcement. >> excited. i'm feeling maybe my days of running into brick walls is over with. [ cheers ] >> last week, a friend and former neighbor of the swartz family started an online petition asking authorities to reopen the case. more than 1,000 people have signed that petition. now, pinole police agreed to reopen the case. in our next hour of "mornings on 2," the other big reason family and friends want police to continue the investigation. reporting live in the newsroom, pam cook, ktvu channel 2 news. >> all right, pam.

7:46. new this morning, a mountain lion spotted along the peninsula. it happened in burlingame about 1:00 this morning in the backyard of a home on margarita avenue. now, we're told the mountain lion ran towards skyline boulevard near 280. san mateo county alerted residents. you are being advised don't approach the mountain lion especially one that's eating or has its cubs with it. 7:46. a vigil is scheduled for tomorrow to remember a mother who has run over and killed at san francisco's holly park. neighbors have created the shrine for 35-year-old christie svanemyr. she was killed last month while sunbathing at the park with her daughter and dog. her husband shared family photos with ktvu saying he's grateful for the support of friends and strangers but is having a difficult time raising their baby girl. a family friend says svanemyr was a loving mother. >> she was texting her husband

a picture of issa playing in the grass and she had text him that picture of her shortly before the incident happened. >> the city gardener accused in the accident was suspended without pay. so far no charges have been filed against the city worker as the case is still under investigation. his attorney says he's depressed at incident has -- and the incident has taken a heavy toll on home. the beta breakers race has a new owner and he's sharing his vision. the new owner is casey wasserman. he's the ceo of a talent and management company. he bought the race for an undisclosed amount of money from aeg. well, today he will meet with long-time race participants and with neighbors and city officials. he wants to hear their thoughts about the race. he wants the race to be fun and clean. he says there needs to be

talks at another transit agency. details about all of that -- coming up in a live report. good morning. i'm dave clark. >> i'm tori campbell. and let's begin with a quick look at weather and traffic. it will start warming up. >> a little bit. more so tomorrow. that's when the higher fire danger kicks in. we had a weak system driving by. that's giving us a pretty good band of high clouds, kind of painting the area. cool to mild, mostly sunny by this afternoon. this is mainly a morning event. el brated -- elevated fire danger. red flag warning goes down to the santa cruz mountains but the main focus will be the north and east bay hills. this one might be stronger than less. things can definitely develop here. pretty strong lows going to dig into eastern nevada. for now we have a lot of high clouds. not much of a breeze yet. there's a slight component of a northerly breeze in the north bay, a little south-southeast. parts of the peninsula and the south bay as that system comes

by. 68 in san francisco for a high today. after the clouds, though, i do think a north wind wins out for san francisco. they will go from partly cloudy to mostly sunny. i did see a hint of a north breeze in the napa valley. high clouds, sunny to mostly sunny later on. mild to warm. a lit breeze now. that -- light breeze now. that will start to pick up. 60s, 70s and low 80s. here's sal. there's a new crash southbound 101 on the peninsula at holly on san carlos on the way to redwood city. traffic is just a mess. you can see from way back in burlingame all the way to san carlos. there's a big traffic jam. if you are driving up the peninsula to the airport to san francisco, northbound 101 begins to slow just north of third street all the way into the downtown area. southbound 101 in marin county, we had an earlier accident near lucky drive. that's gone. but traffic is slow from san rafael and it's also slow from

novato to san rafael in the typical spots. across the bay on westbound interstate 80, it is still slow from pinole valley road. heavy pockets to the albany hills. you can see the bay bridge is improving. it's about a ten-minute delay at the toll plaza. definitely seeing the traffic time go down there. in san jose today, it's not as bad as it was yesterday. it's a little bit slow. but better than it was. getting into the valley. it slows down really at 17 all the way up to cupertino. 8:03. back to the desk. the clock is ticking towards another possible b.a.r.t. strike with time running out. about eight and a half days are left in the 60-day cooling off period. in 90 minute, the two sides in the b.a.r.t. lane hoar dispute head back to the bargaining table -- labor dispute head back to the bargaining table. now we're learning of another transit and another dispute.

tara moriarty has more. this is not good news. >> reporter: that's right. we were able to speak with officials this morning. they told us that the vote came down last night about 10:00. they rejected their company's proposal. not really that good news for a.c. transit and for b.a.r.t. it's not looking that much better. their contract negotiations resume in less than two hours. they have to come together before next friday. otherwise, we could see another strike. now, b.a.r.t. unions did make another counterproposal during a six- hour session yesterday. union leaders are complaining about b.a.r.t.'s p negotiator, thomas hock citing a story in the examiner about how he's racked up a $194,000 tab since talks began this spring. that includes his fee of $350 an hour, first-class plain tickets and -- plane tickets and $3,000 fine dining tab. b.a.r.t. passengers say the mudslinging has to stop and the talking has to start. >> hey, you are telling me,

it's unbelievable. it's frustrating and it's mind boggling. enough is enough. i hope they resolve their problems and get it together because we, the people, are the ones that suffer. >> reporter: breart's general re-- b.a.r.t.'s general manager said if a reimbursement was made for one glass of alcohol to hock, b.a.r.t. will retroactively recover payment as a credit to a future invoice. they say they only reimburse for coach fare. we should find out where b.a.r.t. stands with the contract but no word when the a.c. transit transit deadline is. i'm tara moriarty, ktvu channel 2 news. >> thank you. just hours ago, san jose fire crews put out a house fire in about 20 minutes. it started about 3:30 this morning. ktvu's janine de la vega is at the home now to tell us about the health of one of the residents there plus what firefighters found inside where the flames started. good morning, janine. >> reporter: good morning, dave. when we first were driving

here, we could see the plumes of smoke from 280. we thought there would be a lot of destruction. but as you can see, the home is still standing. most of the attic is converted into a prayer room. the homeowner called 911 at 3:30 after he heard a crackling sound coming from the attic and saw flames. he and three relatives were able to get out of the home safely with no injuries before firefighters arrived. crews were able to knock down the flames within 20 minutes and save the home. they did have to breakdown skylights to ventilate the roof. firefighters say it appeared to have started in the attic where the homeowner set up a prayer room where there was a shrine area with oil lamps. >> really good people. really good people. good man and his family happened to be hear from visiting him -- to be there from visiting him. >> reporter: and you just heard from a neighbor very concerned about the homeowner's well being. as firefighters were mopping

up, they discovered there were no working smoke detectors inside. they were concerned because the homeowner and his family decided to stay in the house even though there's no power on yet. they made sure that he wasn't going to light any candles and installed smoke alarms before leaving. fire officials say they will still be investigating a cause of this fire. reporting live from san jose, janine de la vega, ktvu channel 2 news. thank you. time is 8:07. turning to the government shutdown situation just this morning, the white house announced that president obama is canceling two stops on his upcoming trip to asia because of the government shutdown. the president is scheduled to leave saturday night. he will still travel to indonesia and bernai. but is canceling visits to malaysia and the philippines. secretary of state john kerry will go to those countries in the president's place. and the budget battle continues in washington, d.c. with no end in sight. no movement at all on either side. republicans try to partially

restore funding to specific parts of the government including national museums and parks and veterans benefits but democrats blocked those efforts saying they want one clean bill to fund the government with no strings attached. 8:07. some california members of congress are refusing to be paid until the government shutdown is over. dublin's congressman says he won't take his paycheck until the furloughed workers get paid. dianne feinstein says her checks are going into escrow in the this is over. barbara boxer said she would donate most of her salary to sal charity. the government shutdown could bench football teams from armed forces. the army, navy and air force may have to cancel their games this weekend because of the

shutdown. the defense department temporarily suspended sports competitions because of a lack of funding and also because of legal concerns. army is scheduled to pay at -- to play at boston college. the air force is supposed to play navy. these teams are looking for other financial options hoping togy ahead with the games -- hoping to go ahead with the games. go to ktvu.com to find out which programs will be affected by the shutdown. look for the links under the hot topics section. new details in the case of a redwood city high school student accused of trying to rape a teacher at knifepoint. david velasquez testified that the attack two years ago was part of a senior prank intended to scare his teacher at the charter high school. he's currently on trial facing charges including assault, kidnapping and false imprisonment. he says he waited around the campus wearing a scarf around his face and was shoeless.

a man accused of shootinged a killing a san francisco state student is scheduled to return this morning. the 30-year-old first appeared in superior court last week. prosecutors say he went out hunting for victims. he's accused of randomly killing 20-year-old justin valdez as he stepped off a muni train. the suspect faces charges including murder and possession of firearms. 8:10. new this morning. in an early-morning house fire in winters, it's left four people without a home. it happened about 5:00 this morning. two brothers were in the home when they say they smelled smoke and saw flames shooting out of an air-conditioning unit. everyone got out of safely. fire investigators say it appears the fire started in an outdoor trash can, then spread to the front bedroom and the attic. another fire in winters that started last thursday, this is gonna burn for a couple of more days. 20,000 bales of hay caught fire last week. it is still causing air quality

problems. health warning has been extended because of that bad air. children, senior citizens and people with breathe be problems. you are advised to stay indoors. the cause of the fire is still under investigation. 8:10. the san jose sharks return to the ice tomorrow night. they will start the regular season at home against the vancouver canucks. while there are a few additions to the team this year, one of the biggest changes is the new name of the shark tank. hp pavilion will be called the s.a.t. center. 8:11. a san francisco clothing store in union stair was burglarized -- square was burglarized. possible charges in the ash nana -- in the asiana plane crash when a 16-year-old was run over and killed by a fire truck. traffic is moving along refly well.

just hours ago, a fed-ex cargo jet made an emergency landing at the oakland international airport. the control tower received the call around 4:20 saying the jet

was experiencing hydraulic problems and that crews to the runway in a so-called yellow alert. the plane landed safely 20 minutes later. the san mateo county district attorney is considering filing charges against the firefighter who allegedly ran over a teenaged girl after the asiana airlines crash at sfo in july. the coroner said she survived the crash but was run over and killed by a fire truck on the runway. new information now about an incident overnight at florida's jacksonville international airport. it forced a five-hour evacuation. a federal law enforcement source says this morning a man arrested at the airport said he had a bomb but that turned out to be a hoax. earlier, police said two suspicious packages were found

at the airport. one in the parking garage, the other in the terminal. >> one of the devices was located -- was found near the checkpoint. exactly where i couldn't say. >> now, incoming planes were delayed out there on the tarmac until buses could pick up the passengers. no planes were allowed to take off. but again, the jacksonville florida airport is open this morning. there's a new flag flap in the east bay. yesterday more than a dozen protesters forced the cancellation of plans to raise china's flag outside of the city hall in alameda. the flag was supposed to go up during a ceremony conducted by the alameda sister city association. that ceremony was to celebrate china's national day which marks the founding of the people's republic of china. well, there was a similar controversy in san leandro just last month. a protest stopped the city council's plan to raise the chinese flag in that city. supporters say raising the -- the flag would be a show of

sport for the growing chinese community. some say it would be about the civil rights allegation. oscar pistorius has hired a forensic team for his murder trial to challenge evidence. his representative says the team is already in south africa and has met with the defense team. the trial is scheduled to begin on march 20th of next year. there are several new developments in the kenya shopping mall attack. crews have recovered the bodies of two kenyan soldiers and the remains of several other victims. an al qaeda group from somalia responsible for last month's attack is pledging a new terror campaign against kenya. the mall attack also has far-

reaching economic implications. they will lose money with many canceling tours. the family of the 16-year- old, kevin, killed in an accident, announceled the details for a memorial -- announced the details for a memorial service killed in a violent crash. he died friday morning in a horrific crash in san francisco's lower pacific heights neighborhood. a speeding driver slammed into his family's van killing the teenager and critically injuring his mother and sister. now, the wake for kevin is scheduled for saturday afternoon at the funeral home on 17th street in san francisco. his funeral will be held at the same funeral home saturday morning at 8:00 a.m. there will then be a funeral procession to colma for a 9:30 burial ceremony. 8:18. the nation's largest career fair for the lgbt community takes place in san francisco today. the event starts at noon at the lgbt center on market street. some of the companies looking

for workers, include bank of the west, macy's safeway international airport, apple and the san francisco police department. entry level to management positions are available. job fair organizers say all of the employers are committed to workplace diversity. 8:19. hey, sal, how is the south bay doing. it's actually a little slow, dave, and tori. northbound 280 will be slow. it's better than it was yesterday. but if you are wondering what the general tone of the south bay commute is, it's moderately heavy. 280, 85, 101, just a little better than yesterday when it was sold out. on the peninsula, we have a crash southbound 101, this is at holly. it's an injury crash. traffic is backed up from burlingame and the bayshore freeway is slow but 80 is a better option for you -- but 280 is a better option for you. 101 is slow near candlestick to downtown san francisco. marin county has had slow traffic. we had an earlier accident at lucky drive and then slow from

highway 37. all of it is slowed down to about corte madera across the bay going to the richmond bridge and coming down on 80 westbound, very slow there as well. 8:19. the bay bridge. that's what we like to see. almost no delay at the toll plaza. much improved. let's go to steve. >> thank you, sal. a lot of high clouds, a little bit of fog. emfa soins a little bit. you can see -- emphasis on a little bit. you can see some working around. there's a front coming by. 40s and 50s on the temperatures. cool readings on the coast. it looks like that's clearing out. some of that cool air is beginning too filter in. the wind direction has been light and variable and subtly. expect that to turn more westerly or northerly later on. san jose is south. most locations are calm. even the higher elevations are not that bad.

t.j.maxx. welcome back. governor brown signed a bill banning so-called revenge porn in california. it can lead to jail time for people who post naked photos of their former lovers on the internet. the law takes effect immediately. it makes it illegal to post nude photos with the intent to

cause emotional distress or humiliation. violaters could get up to six months in jail and a $1,000 fine. the man who was appointed to oversee the oakland police department is explaining why he blocked a potential firm. thomas frazier rejected the proposal saying it would have threatened efforts to increase the staff. the proposal called for an independent police board made up by citizens to receive internal affairs complaints. frazier says rank and file officers were against the plan because they didn't trust the workers and the civilian board. that could undermine the entire reform progress. plans for a cell phone tower in a pinole park may have to be put on hold. the city agreed to lease a section of land in pinole valley park to verizon. the cell phone company wanted

to build a 78-foot cell phone tower near adobe road. in exchange the city would get $2200 a month. a lot of neighbors oppose the tower. now the state says pin nome would violate -- pinole would violate terms of the grant if the land is used for anything but recreation and verizon is threatening to sue if the deal does not go through. the family of a murder victim accuses a san diego judge of improper behavior. the defendant, danny despro, was found guilty of first- degree murder. two weeks ago, judge patricia cookson sentenced him to 53 years to life. afterwards, she cleared the court and presided over the wedding of him and his fiancee. photos appeared on social media showing photos of him and his hands uncuffed. the judge is accused of making him a cake. >> why would the judge do that? you know -- i'm lost for words.

exit. it looks like we're done there for the morning. san jose we have a couple of different crashes here. northbound 101, one is at tully. and one at old oaken road. that one should be out of the way. the one at tully, they are sending medics. the traffic is slow into the sunnyvale region all the way through to the valley and so is 80 traffic. highway 17 is cleared out which is nice. if you are driving in, let's say you are driving late to the mountains. it looks good down to the valley. i do want to mention that the traffic is going to be busy on highway 9. there was an earlier accident near mill creek. 8:32. back to the desk. we've got new information about last night's smash-and- grab burglary at a clothing store near san francisco's union square. it happened in the 100 block at post street about 11:30 last night. claudine wong is joining us

live now with new information about crimes in the area. >> reporter: we're learning about an uptick in criminal activity within this block and with some of these stores. this is icebreaker. this store was hit last night. there's plywood in here. the alarms went off in the store. it was -- it closed at 8:00 last night. police were called and came out here to investigate. we talked to a woman earlier who was out here helping the manager clean up. >> police were dispatched. they came over and the company came together and cleaned it up, put the board on the window. >> reporter: as we have been talking to people out here this morning, we learned that this icebreaker store was not the only one to be hit in the past few days. we have been talking to police as well. one man told us he saw the store across the street get hit within the last couple of

weeks. >> i had come over in the morning twice and both the side panels have been knocked out at different times. >> reporter: in the store across the street? >> yes. >> reporter: and that's just been in the last week and a half, you said? >> about two weeks. >> reporter: and in fact, taking a live look back at that store one of the other ones hit, when we talked with police within the last hour, they confirmed within the last ten days you've had several stores. that store was hit on the 23rd of september. the north store was hit last week as was the walgreens store and then you have the icebreaker last night. what's unclear, if it's connected, the same people, cases of vandalism, cases of burglary? that's what investigators are trying to sort out right now. live in san francisco, claudine wong, ktvu channel 2 news. >> thank you. 8:34. happening right now. want to take you live to washington, d.c. and a live picture of a news conference going on right now. this is being held by senate

democrats and some furloughed federal workers. you can see a number of people coming up to the microphone. they've been talking about the effects of the federal government shutdown. also we just got word just a short time ago from the white house that president obama has invited congressional leaders to the white house later today for a shutdown meeting. it's unclear if that will help to break the political logjam. so the partial government shutdown continues and so does the blame game. the impasse in congress is no closer to being resolved. kyla campbell joins us live from washington to explain how bay area lawmakers are reacting this morning. kyla? >> reporter: congress is back to work on capitol hill this morning. but there's still no deal on funding the government. oakland congresswoman barbara lee spoke about a half-hour ago. >> the american people deserve a functioning government. >> reporter: so far this, with the house passed four bills to

fund the government but they chip away at the healthcare law. this is something that the senate democrats refuse to sign on. last night republicans failed to house a bill that would fund the government stages, starting with veterans affairs, national parks and the city of washington, d.c. they are expected to vote on that today. senate leaders slammed each other's party a few minutes ago. >> instead of reading the writing on the wall, house republicans have turned to a new bad idea, to cherry pick the few parts of the government they like and reopen evenly those parts. >> this week, democrats had a choice, to defend fairness when it comes to obamacare or shutdown the government. they chose the latter. >> reporter: the partial government shutdown is hitting the white house, too. prak prak leave -- president obama leaves this week for a trip to asia. he's canceling two of his four stops because of the shutdown. kyla campbell, ktvu channel 2 news. meanwhile, the federal government shutdown is having

a ripple effect here. ,000 people -- 3,000 people work at the federal building. now that many have been told not to come to work, nearby shops and cafes say they are hurting. >> i hope it doesn't last long really for everybody's sake. >> this is the way i feel. we're not -- i can't respect either one of them. they are not working as a team and they are not playing fairly with each other. >> the business owners say they can handle having fewer customers for a day or so but if the shutdown continues for a week or more, their businesses will take a hit. today is also day two of the rollout of president obama's new healthcare law. the california version is called covered california and offers a variety of health insurance plans to californians. coming up at 8:45, the first day glitches that covered

california website had and what's happening this morning. well, fleet week in san francisco starts next week. this year you won't see the blue angels and those big navy ships. both. those major attractions have been sidelined by federal budgets that happened earlier this year. ktvu's brian flores is in san francisco now to tell us how some business owners are gonna try to keep the fleet week celebration alive. good morning, brian. >> reporter: good morning, dave. they are certainly trying. fleet week brings in about a million businesses each time it rolls around. without some of the major see vents, area -- events, area businesses are finding out more. it won't include the angels or the navy ships. they are putting together four consecutive saturdays where fireworks shows will take place here throughout the month of

october. those shows begin at 8:30. the first show happens this saturday. officially pier 39 is celebrating the 35th anniversary. it's unclear how much it will cost but officials hope the fireworks shows will draw in tourists in a normally slow tourist season in october. tourism officials say it's meant to make up the potential lost revenue that would normally be brought in for things like the blue angels. we spoke to a pier spokesperson who open -- who hopes this will be a big deal. >> we've planning our anniversary with the fireworks and it just kind of all came together. fleet week is not happening bedecided -- we decided rather than do the fireworks on one saturday night, we'll do it more so everybody has a chance to come down and plan for it. >> reporter: this coincides about the annual wharf fest.

officials also say they will have events every weekend leading up to the fireworks every saturday. event coordinators say it will be family friendly. there will be a chowder competition and tasting. this has been a difficult start for businesses here, at least for the month of october. not only to have federal budget cuts. but also the government shutdown affecting tours to alcatraz as well. we're live from pier 39, brian flores, ktvu channel 2 news. the government shutdown could slow down san jose's efforts to lure away the oakland as to the south bay. that's because the city's lawsuit against mlb is being heard in federal court. now, on friday, a judge is due to hear from both sides in this case and also to consider major league baseball's request to have the lawsuit thrown out. all of that could be delayed because of the government shutdown. while the as get ready for the playoffs against detroit. city leaders are trying to convince the as to stay in

oakland. yesterday, hundreds of fans were at this rally for the green and gold. city leaders say there's a very rich investor backing a coliseum city plan which expands the current coliseum site towards the airport and builds up to three pro stadiums. oakland mayor jean quan adds that a second site at howard terminal right next to jack london square could be ready within months. >> now that the city is expanding, the port into the deep water at the army base, most people believe that it is a better site. >> game one on friday against the tigers it's already sold out. there's only about 1,000 tickets left for game two on saturday game one starts at 6:30 friday night. the first pitch game two is 6:00 p.m. on saturday and then the team heads to detroit for games three and four. and if necessary, they will be

s&p down 8. a.c. transit workers rejected the latest proposal. the vote was last night. we don't know if this result do lead to an a.c. transit strike. this comes eight days before the strike deadline in the b.a.r.t. labor dispute. in san jose, a family of four escaped a house fire overnight on del mas avenue. the homeowner said he heard crackling and then saw flames. the fire started in the attic. there was a prayer room with a shrine and oil lamps. firefighters say there were no working smects in -- smects smoke detectors in the house. the white house says both the republican and democratic leaders from the house and the senate have been invited to a meeting. the white house official says the president will urge the house to pass a spending bill and allow the government to

reopen. 8:47. despite a suspect's confession, police in pinole have decided to reopen the case of a little girl who vanished 25 years ago. pam cook is in our newsroom to tell us about the new effort involving the disappearance of amber swartz garcia. >> pam cook has more. >> the announcement came that a new set of eyes should look at this missing person's case. the 7-year-old girl disappeared from her front yard back in 1988. police closed the case 11 years later after convicted killer anderson confessed to her murder from death row. amber's mother was never convinced that confix was true. she's writ -- confix was true. she's written a book with a family friend that's convinced police to look at a man with a strange background and creepy behavior during the time amber disappeared. >> he was the number one

suspect up until anderson confessed to taking amber. at this point, they closed the case. >> i don't think anything that anderson offered us had anything to do with anything. i think he wanted to make a name for himself and get off death row. >> she says she would rather her daughter be on the missing person's list for eternity than to close the case when she's not conconvinced -- convinced. the woman we spoke to is helping kim swartz write a second book. she said she's discovered new evidence in the case and has brought it to police. the police chief in pinole said there's no new evidence to contradict anderson's confession. that case has reopened. new this morning, a pennsylvania appeals court has just ruled jerry sandusky does not deserve a new trial after being convicted of sexually abusing ten boys. lawyers for the penn state football coach had argued they did not have enough time to

prepare for trial and the judge mishandled jury instructions. however, the appeals court let the conviction stand. sandusky -- sandusky is serving a 30-year confession. tom clancy has just died. he was best-known for his espionage, spying and military books during and after the cold war. some of his best-known books were turned into movies. his most famous fictional character was jack ryan. he was 66 years old. the cause of his death is still not known. the website for the covered california health insurance exchange is back up and running this morning after being shut down on its first day of business. the covered california website got more than 5 million hits. that's where californians can

sign up for health insurance under the new affordable healthcare act. after glitches, the website was shut down for repairs. besides the website, covered california has three call center r for people to sign up by phone -- call center for people to sign up by phone. there's a little bit of slow traffic there because of a crash. it's not a major crash. you can see traffic is slow although they've moved it to the shoulder. it's imimproving. this -- improving. this is when i saw it moments ago. you can see where i got it to get out it out of the way. traffic is gonna be busy in the south bay. we've had a couple of different crashes. 101 at tully, 101 at oakland road. getting into san jose will be slow.

new details about a homicide case in oakland. according to the oakland tribune, a gunfight that killed a former tribune freelance photographer was sparked by what prosecutors call a school yard argument. 54-year-old lionel flukier was hit by a stray bullet while sitting in his car near macarthur maze boulevard and

seminary avenue. two men at a nearby gas station began shooting at another when one insulted the other girlfriend's. both face charges. you can find its easier to ask for a more flexible work schedule to help care for family members. the board of supervisors unanimously agreed to support new legislation requiring employers to consider worker requests for flexible hours because of care giving. that bill would apply to companies with only 20 or more employees and employers would be able to say no if they have a good faith business reason for it. ed lee said he would sign that bill. in just about an hour from right now, eight newly refurbished tsunami sirens along the san mateo coast will be tested. the see were -- the sirens were aseven years ago. over -- over the past two months they've been upgraded to
