there but again it is causing some traffic problems there. we will check in with her in just a moment. it is wednesday, october 9th, i am pam cook. >> middle of the week. >> yeah. >> good morning, i am dave clark, let's check weather and traffic. will it be cooler -- >> -- cooler -- >> -- yeah -- >> -- low spinning and producing widely scattered rain and snow showers there. some of that drifting back. we have clouds around, partly cloudy and sunny here today, temperatures 60s coast and bay and 70s. chilly to mild, partly sunny, i will mention that but again east or south, probably not there, 45 napa, 49 redwood city, 50s, but a breeze holding things up. just kind of sandwiched between but that cloud cover continues to work its way back especially there and you can see there things are trying to get their acted together, some of that rain turning to snow, right now mainly rain, snow level 6500 feet, low clouds around, not

all that showing up yet but most favoring the coast and around the bay, that low is moving down will give us -- once it does that the wind will pick up there so cooler, breezy, low clouds, showers or two again, more towards the valley south. 60s and also 70s. we will go to break and be right back after this.

breaking news this morning has been the accident. it remains on an off-ramp there. claudine wong has details on what may have led that minivan to veer off the freeway and on to that ramp. >> good morning, yes, lots of activity here as the major accident investigation team for them tries to answer that question. take a look behind me, you can see cars out here as they try to figure out really again what led to this and when i asked them how long this off-ramp would be shut down they could only say a while. this all started at 1:40 this morning. chp tells us they had two officers in two cars setting at a construction sight when this minivan drove by. they said they heard it before they saw it because it had a flat tire on its right front tire, so they pulled out to try to make contact with the vehicle and they say moments later it hit the center divide

and then went over the embankment on to the central avenue off-ramp. why all this happened is still a bit of a mystery. >> we have no idea exactly why that happened yet other than there is a real -- the right front tire is chewed up so we are figuring it was on the rim for a while but not sure exactly yay the veer to the left all of a sudden yet. >> we did ask about speed, if the vehicle was speeding by or trying to evade something. they said speed doesn't look like it is an issue at this point. the driver was pronounced dead the scene and the coroner out here before 4:30 this morning and then left and then the major accident investigation team came in to try to do their part of all of this. again it likes like what happened is that this minivan was driving on a flat tire, the chp officers noticed it but they said before they were able to even call much information in besides that, the vehicle hit the center divide and went

over the embankment, again this area will be shut down for quite a while. we can see traffic moving along interstate 80 above us, it doesn't look like that is affected anymore than the normal commute and that is good news for the commute but again this investigation does continue. >> 6:06, the countdown clock in the dispute now in the final hours a-strike deadline 11:59 tomorrow night. pressure is on bart management and the union to work out a deal. the bart contract talks are set to resume at 9:30 this morning. there are signs of progress. ktvu's tara moriarty joining us live from the west oakland bart station with more on today's critical negotiations. >> reporter: the big question has been will there be a strike. and while the answer to that question remains unclear we do know that monday night union leaders came forward saying, hey we are not going to be issuing this customary 72 hour

strike notice bus we went to take every opportunity to see this, many see this as a very very positive sign although they have not said they are ruling out a strike. experts said the fact they are not engaging in public mud slinging is encouraging but negotiators do appear to be making concessions and exchanging proposals. >> we are talking trying to get somethings done, we have sat down with them and made minimal progress. i feel there have been changes in the tone of the negotiations. we will see how it goes. >> the rapport across the table with us as far as i am concerned have always been very professional. i have no criticism whatsoever of how they talk with me and how we have talked at the table. >> now the ap u is planning to give members an update today at its monthly membership meeting and as soon as we hear anything regarding negotiations we will of course let you know, live from the station tara march march ktvu channel 2 news. >> all right, make sure you stay right here with ktvu

channel 2 for all the continuing coverage and follow us on twitter and facebook for the latest developments anytime. >> new this morning a honor for a stanford scientist, the professor of cancer research has won the nobel prize in chemistry, janine de la vega there at stanford where he received that call of a lifetime. >> reporter: pam, stanford professor michael leavitt woke up at 2:00 this morning at a phone call from sweden, the person informed me he had just won the nobel prize for chemistry, he said his heart started pointing and he feels completely honored. now, here is video we took earlier this morning showing professor michael leavitt on the phone. he has been bombarded with phone calls and interview requests from local and national media. the royal swedish academy of sciences awarded him and two others the nobel prize for chemistry for laying the

foundation for computer models used to understand and predict chemical processes. it stems back to research that they developed in the 60s and 70s which helped scientists develop programs which helped look at the structure of proteins and basically understand what it does. this is what he had to say about his work. >> it is nice to see this work recognized right now, because it is kind of an acknowledgement that computers are important part of it. it has been an experimental science and this is the first prize -- well it is a chemistry prize for biological molecules. >> he has taught there since 1987 and is in the school of medicine teaching structural biology. we will have -- there will be a news conference on the campus of stanford university where leavitt will speak about this honor, that will be held later

at 10:00 this morning. you will hear more reaction from him and how his work really helped advance modern science today. reporting live from stanford, janine de la vega, ktvu channel 2 news. >> 6:10, the california public utilities commission ordered pg&e to keep a gas pipeline in san carlos shut down until the commission can determine if it is safe. a judge at first ordered the shut down sunday. saying carlos city leaders asked for that order after finding out about an internal memo, the e-mail from a pg and i engineer raised questions about the possibility of a san bruno type disaster and the safety of that 83-year-old pipeline. a day care facility in sunnyvale that operates inside a home is still open this morning. that is despite the arrest of a man who lived there and is accused of sexually abusing young girls. police say jose cristobal was

arrested last week after parents accused him of inappropriately touching children, police say at least two children were abused. the d.a.'s office says the day care has a valid license and it is actively investigating. >> new information on the latest shooting on a bus in oakland, there are new conflicting reports about a teenaged passenger who suffered a gunshot wound while riding a bus there yesterday afternoon. police said the 18-year-old student was shot in the leg by someone on the bus but aac transit spokesman says it may have been self-inflicted, no one else on the bus was hurt. this was the second bus shooting in oakland in the past eight days. police are still looking for the gunman who opened fire on an ac transit bus traveling on international boulevard last week. two people were wounded. they are now recovering from their injuries, police say the intended targets on the bus were not hit. san francisco police say passengers aboard a muni rail car were so focused on their

mobile devices they didn't realize someone had been shot. 30-year-old man has pleaded not guilty to killing justin valdez last month. prosecutors say they have video showing the suspect holding a gun. they say the other passengers were tooen grossed in texting and oblivious of their surroundings. >> in berkeley the groups trying to save the downtown post office are angry. the building is now listed as being officially for sale on the real estate company's website, earlier this month the postal service said the city has until the middle of next month to make a comment on negative effects selling that building would have on preserving it. a spokesman says no sale would be completed until after the historic value of the post office is decided. >> some bay area lawmakers are calling for a formal review of the employment development department. that is after a computer problem delayed unemployment checks across the state. last week the department

announced it had cleared its backlog but administrators tell us here that they are aware that some people are still waiting for their checks. democratic state signature jerry hill is among those calling for an investigation. >> we need an answer as to why this went bad, what the problem was, what caused the problem and how can we prevent it from happening again. >> now the state of california paid a new york company 62 million dollars to develop the new system to process unemployment claims. the boston globe reports that same company has had problems in massachusetts, florida and pennsylvania. 6:14, the u.s. will slash hundreds of millions of dollars in aid to egypt. the white house has been considering such a move since the egyptian military ousted the country's leader in june. the u.s. provides egypt will will a billion and a half dollars in aid, money going

there would be suspended. in another development this morning an egyptian court announced muhammad morsi will stand trial on november 4th on charges of inciting the deaths of opponents during riots. >> now to the continuing coverage of the shut down the president will meet today with house democrats. he will also meet with other lawmakers in the coming days. kyla campbell live in our washington, d.c. bureau with more on the battles over the government shut down and the debt ceiling. >> reporter: dave, president obama is willing to accept a short-term deal for both fiscal fights. that would likely mean funding the government and increasing the country's borrowing limit to cover the next four for six weeks, then democrats say they will sit down and negotiate with republicans for a long- term deal but the gop wants negotiations first. >> having such a conversation, talks, negotiations, should not require hanging the threats of a government shut down or

economic chaos over the heads of the american people. >> when it comes to the debt limit i agree with the president, we should pay our bills. i think -- government, i certainly didn't come here to default on our debt. >> we now know the shut down is keeping the government from giving money for families of fallen troops, not getting the expected 100,000 dollar payment known as the death gratuity from the government to cover funeral and related costs but the fisher house foundation is stepping in to provide grants. next hour there is a house hearing on the shut down affecting services for veterans and senators are scheduled to talk to reporters about those, i am working on that for you for 7:15. >> 6:16, first lady michelle obama was supposed to come here this weekend but that has been cancelled because of the shut down. the first lady was due to attend fund razers saturday and sunday but party leaders

worried that would look bad if she was seen raising money while federal employees are furloughed. that trip is expected to be re- scheduled. >> a family in san francisco that is being kicked out of their home can stay there for at least another two weeks. the lee family has been leaving in their rent controlled knob hill apartment for 34 years, supposed to be evicted last month but tenant advocates, including the san francisco mayor asked the property owner to give them more time. they first received 10 days. now they have been given another 12 days to find other housing. the man known as the naked bart acrobat may get out of jail today. he was charged with false imprisonment and battery after harassing passengers at the bart station in san francisco back on may 10th. attorneys say a judge will likely release him today so that he can get mental healthcare in alameda county. he is apparently not eligible for treatment in san francisco because he had been living in

berkeley. >> 6:17. police say a wrong way driver is responsible for a traffic mess last night near jack london square. investigators say the driver took a wrong turn right towards the train tracks near the amtrak station. the trains were stopped for more than an hour while tow trucks struggled to get the car off the tragedies that caused delays for passengers and drivers in that area. >> 6:17, back over to sal. that off-ramp still closed, right, in el cerrito? >> that's right and we are not expecting it to open soon. you know that claudine has been out there along with chp. they are doing the investigation there. chp is after a fatal crash on the afterroom p from westbound interstate 80 and that ramp remains shut down, you will see that traffic -- i will tell you that traffic on the freeway continues to drive by without any major problems. but this investigation -- i mean i don't think they are even close, that vehicle over there is still flipped over in

the position where it landed a few hours back. so this is not going to be open soon. it doesn't look like it anyway. this is a look now at the commute at the bay bridge toll plaza. that is backed up for a 10 minute delay, 10 to 15 minute delay before you make it on to the actual span. if utar if you are driving in the east bay already slow traffic there, the traffic is still looking good though on 880 there. let's go to steve. >> light rain that though, 39, lit rain blue canyon 38, snow 6500 feet, rain turning to snow that they will get that and that continues to drift back there and north bay is mostly clear, your midweek forecast calls for cooler pattern, it was warm and we will continue that and the breeze, you will

see that cloud cover inches back there, again favoring areas, san francisco oakland concord south, not north, but a cooler day because the system has a low associated with that rain there, so look for partly cloudy, sunny, 39 tahoe with light rain, 58 redding, 52 ukia, 58 sacramento, not too much of a breeze for some but a few areas there it is picking up, those are your temperatures there but enough cloud cover and breeze to hold the temperatures up now, wind directions all over the place, offshore, onshore, out of the south and west but picking up so the wind will be a factor today especially as it moves farther south, dropping right over the sierra now in between sacramento and tahoe and truckee, so some of that around the western edge of it will come back and you can see some of these green turning to white or mixed precipitation and that cloud cover continues to inch toward us, so the low doesn't have a lot but enough there

where a shower or two could impact our area but overall a cooler breezy partly sunny and cloudy day, temperatures settling in for a couple of days 60s and 70,, i will mention those showers again, close enough, i don't want to get caught again, 60s, 70s on temperatures, every 1 is close here, i mean it is not too much of a difference inland temperatures 70s, around the bay 60s, upper 60s or low 70s, best opportunity for rain would be probably santa clara valley or off east. 60s, 70s coast and also bay. tomorrow looks breezy, cool, mornings cold, days sunny, warmer friday into the weekend. >> this could be a good time to book a flight but you are going to have to act forecast. southwest airlines is offering round trips for less than 100 dollars, that includes many flights between the bay area and southern california but you do have to buy the tickets before tomorrow night. they are matching the fair. starbuck's taking in more

welcome back. 6:26 is the time. several members of congress were arrested for participating in immigration protests near the capitol yesterday. that includes congressman john lewis and charles rangel who linked arms and standing in the front of the pack, they were among the first people arrested after refusing orders to disperse so they could clear the street.

a post game tradition in being banned at high schools in kentucky. the athletic association has ordered all schools not to conduct post game handshakes in all sports. that decision comes after more than two dozen physical confrontations during the past three years. teams can choose to ignore the order but the handshakes have to be closely monitors and any incidents reported. one soccer coach says he has found a way around it. >> i kind of thought if we can't shake their hand after we should shake it before. >> they say it is up to them to teach sportsmanship and if fights occur they will be held responsible. >> the sharks beat the rangers and we have a new star, thomas hurdle scored a hat trick and check out this score. >> here is hurdle again -- oh -- >> -- does it, he scores again -- >> -- the legs, that was

up there, so it is not quite full strength but you will be waiting now. on the east shore freeway between pinole and richmond slow traffic there this morning, west bound on highway 4 and when you get to richmond it is also slow on the way down to el cerrito, a reminder the central avenue off-ramp remains closed for police activity. at 6:32, let's go back to the desk. >> all right, sal, the breaking news you heard sal just tell you, there was a deadly crash this morning on interstate 80 in el cerrito, a minivan veered off the freeway, went down an embankment and now as you just heard him say that is close, claudine wong has been there this morning, what is the latest? >> reporter: an investigator told me the new eta for getting this off-ramp back open is an hour, so that is the best time estimate we can give you. take a look behind me and i

will show you that as the major accident investigation team does their work. we just saw one of the investigators up on the embankment taking measurements and a look there but that as you are looking at right now is that van involved in this crash and then up there you see that. this all happened at 1:40 this morning. chp says they had two officers sitting at a construction site a mile and a half up from there on interstate 80 and said they heard it before they saw it because it apparently had a tire that was flat. two officers in two cars witnessed this and pulled out of the construction zone to try to make contact with the driver to figure out what was going on but they say the accident happened moments later. >> not sure if they had lights on yet but like i said they -- they heard the vehicle, they were going to try and make a stop on it but this happened like just a few seconds after they were behind the vehicle.

>> okay, so they didn't even have time to start pursuing. >> no, not really. they put out a little information on the radio and then all of a sudden it was like oh, hit the center divide, oh, went off the e-the shoulder. >> so still a bit of a mystery this morning as to what happened. firefighters came out here and they had to cut the top off the minivan to get the driver out but the driver was pronounced dead at the scene and the coroner was out here and took the victim away about 4:00, 4:15 this morning. coming back out here live again, this investigation is continuing as they take measurements there. again best estimate for getting this back open is about an hour. for now from what we can see traffic along interstate 80 is still moving along at a normal commute pace. live here in el cerrito, claudine wong, ktvu channel 2 news. >> the count down clock in the dispute is now in its final hours, that strike deadline

11:59 tomorrow night and the pressure is on bart manager and union leaders to reach a deal. the bart contract talks set to resume again at 9:30 this morning. there are signs of progress during these final hours of the cooling-off period. tara moriarty joins us now from the bart station with the critical negotiations. >> reporter: we have been talking to riders all week and many have made plans for friday just in case. according to experts there are positive signs that the two sides will be striking a deal before then. as far as the strike goes the unions have said they don't want to strike but they are not ruling it out. monday night they announced they would not be issuing their customerrary 72 hour strike notice. experts say the fact they are not mud slipping any more is encouraging. the negotiators appear to be making concessions and exchanging proposals. >> the rapport across the table with us as far as i am concerned has always been very

professional. i have no criticism whatsoever of how they talk with me and how we have talked at the table. >> we want to bargain, we want to deal so, at this point we don't want the riding public thinking we are going to disrupt service. that has never been our intention. >> now the atu is planning to give them an update today. we will let you know if we hear anything and if we hear anything on the negotiation front. tara moriarty, ktvu channel 2 news. >> they are still dealing with that and now the board of contractors says the next move is up to the union. they say they have made a offer and the leaders recommended approving it. however workers rejected it. the offer includes a 9.5% raise over three years and a flat- rate for health insurance. it is the second time in three months the workers have rejected an offer recommended by their union. >> 6:37. the this morning a stanford

scientist just won the nobel prize for chemistry. michael leavitt got the call hours ago. janine de la vega is on the campus now. you have the details. good morning. >> reporter: good morning. we are here in front of stanford professor's michael leavitt's apartment and he got a phone call this morning and when he first got it he thought it was the wrong person but when he called back he learned that and was overcome to learn he won the prize. he has been fielding interviews from them since. he is a physicist but is honored in the field of chemistry. they awarded him and those two the nobel prize in chemistry for laying the foundation for computer models used to understand and predict chemical processes. it stems back to research they

did in the 70s there called groundbreaking. only so much could be calculated with classic fittics so chemists needs to use quantum fixes so make calculations and that is where computer programs helped them understand this. he played a part in this work. >> it is not like i now know this is going to solve all the world's problems, you never think that. it is more like each step leads to the next step and you keep on working, you are passionate about what you do and you never stop. you work in as many hours as you can. >> leavitt is very humbled by this honor and taught there since 1987 and in the school of medicine teaching structural biology, now stanford plans on holding a news conference this morning to talk about this honor with him starting at 10:00 a.m. reporting live from stanford, janine de la vega, ktvu channel 2 news. >> it is make or break for them tomorrow evening there. >> there is a fly ball struck

went missing more than two weeks ago. the janitor found her body in an outside stairwell, reportedly the body of 57-year- old lynn spaulding, who disappeared from her room 18 days ago after checking in for a bladder infection. >> very concerning that this body was found, we are distressed, we don't know what happened, that is our top priority is to find that out. >> the san francisco sheriff's department does all the security for the hospital there and are in charge of that. later today the president is expected to nominate janet yellen to become the first woman to head the federal reserve bank. she serves as the vice-chair woman, she is the former president of the federal reserve bank of san francisco and was a uc berkeley economics professor. if she gets the senate confirmation she is likely to continue many of the current

policies. the current fed chair ben bernanke is leaving at the end of january. >> new information about the outbreak traced back to foster farms chicken at three facilities there. the center for disease control says 42% of the 278 people who became sick were hospitalized. the cdc says many strains of salmonella linked to it appear to be drug rest taint and were slow to discover it because a network is closed due to the shut down. they say two thirds of its staff is furloughed because of that, but because of the latest outbreak it is recalling them to deal with this fallout,that is allowed under the rules of the shut down. he says if it continues he plans to introduce a bill to re- open the cdc. democrats say they are against partial re-openings and say they need to come to an
