will be no settlement tonight. in fact the situation is such that they are still millions of dollars apart so much so that a settlement seems allusive. the one good news is the b.a.r.t. people have yet to present their final offer, which means we will go no further than this, that hasn't happened yet and that means the talks can continue but the idea of a strike can come after midnight which is to say the unions don't have to give notice but the unions did give us this pledge. >> i can't tell tell you how much notice, because we are working to avoid a strike but we will give the public notice. >> reporter: some legislators have been seen coming in and out of the building.

hands and planning their day tomorrow as if b.a.r.t. has already called for a strike. >> reporter: at this hour b.a.r.t. trains are running but if workers decide to strike 400,000 commuters will need alternate transportation. >> them going on strike is disrespectful to the people who give them their jobs. >> reporter: other transit agencies are prepared. san francisco ferry system told workers to plan as if there is a strike. >> they should expect there will be a strike tomorrow. >> reporter: this is the scene in july when b.a.r.t. workers went on strike. commuters were stuck in long lines, waiting for buses and ferries. so this time they are hoping people plan ahead. >> i will have to wake up an hour and a half earlier. >> reporter: a.c. transit will add extra buses.

death of a patient there. the review will begin tomorrow. the body of lynne spaulding was found tuesday in a rarely used outdoor stair well. she was reported missing two weeks ago. police are segging her -- investigating her death. a san francisco police officer is under arrest on suspicion of dui. police also say he left the scene of a crash. ktvu's amber lee is live in san francisco with the trail he left behind that helped fellow officers track him down. amber? >> reporter: we are near 12 avenue. san francisco police sergeant is accused of hitting this blue car caution rear and friend end damaging. it happened at 8:35 p.m. tuesday night. a witness saw his friend's car was damaged. another neighbor saw a car

speed away. the witness says another driver followed the car to where it stopped at his home. the driver who followed the car traced the skid marks back to the scene and told the owner where the hit-and-run driver was. the police was called. the victim didn't know the driver was an off duty police officer till the next day. police say he was off duty. this is video of him when he -- when we interviewed him in 2006. he was arrested that night and released. she now on paid leave pending an investigation. i reached him by phone, he tells me he was advised not to speak about the matter and referred me to his attorney. the 22 year veteran is expected of driving drunk and facing a misdemeanor hit and run charge.

amber lee, ktvu channel 2 news. green, gold and pink are combining for tough traffic today. here is a live look at interstate 880 near the coliseum in the area right now not looking too bad. different than earlier today. the a's are playing a game 5 against thetiers. the -- the tigers. add in a pink concert tonight and you will have a big crowd later on tonight. all of the national parks closed by the government shut down could reopen if the states pay up. the white house said today it will allow states to use their own money to reopen national parks. governors in four states, utah, south dakota, arizona and colorado have asked for permission to open the parks. we spoke to governor jerry brown and they said the budget is balanced. it is not clear if they would

be reimbursed so as of the moment california national parks will remain closed. here is where we stand on the government shut down. a meeting at the white houses with gop leaders and the president ended with no deal but more talks are expected later on tonight. wall street seems to think there is a possible deal close on the debt ceiling or the government shut down. the dow is up 323 to 15,126. also the senate approved and the president signed a bill to provide benefits to families of fallen troops during the shut down. military veterans turned out on the peninsula today hoping to find jobs. a higher our heroes job fair was held. sprint, walgreen's, bank of america and dozens of other companies set up tables. they gave veterans a chance to learn valuable skills. >> work shop classes that helps

what police call a report of a gunman on the san jose state university campus had studentsb and faculty under-- students and faculty under lock down. a student spotted a man carrying a hand gun at 9:00 a.m. this morning. san jose state university locked down sweeney hall. police did not find anyone with a gun after a two hour search. >> most of our class went into the corner and huddled as a group and kept on our phones to remain informed. nerve-wracking. >> we asked why sweeney hall was locked down and not other buildings, because it is near

the police department and officers responded quickly and believe they had any threat contained. it was three months ago today that daphne webb disappeared without a trace and tonight a candlelight vigil was held for her in oakland. today is also her second birthday. trouble in jolly old england for a raiders fan. he had too much to drink on a flight and when the plan land things turned ugly and fast. video tells the tale. the man stepped off the plane. stripped off the raiders shirt and everything else. urinated and challenged the capten to a fight -- captain to a fight. the man finally put his clothes back on and police moved in, tasered him and arrested him as well. >> you say he was a raiders fan?
