union leaders gave a grim update. >> reporter: i am going to update you on everything. bart came out and drew a deep, deep line in the sand and the unions immediately responded all but declaring a strike for midnight tonight. they are claiming bart's management has been bad faith, surprised them, done everything to do something to them that is negative. they can go on strike in 72 hours but it would be subject to the governor calling a 60 day cooling off period which is almost certainly what would happen if bart goes on strike. to bart, it is a big mess. here is what both sides had to say. >> we feel we have reached the limit. financially of what we are prepared to offer. to settle this. >> the strike notice we issued and the disruption in service

ready for tomorrow's possible bart strike. ktvu's allie rasmus is here with what we will face tomorrow. >> reporter: if bart workers go on strike all day carpool hours will be in effect 5:00 a.m. to 7:00 p.m. caltrans switched out the signs to reflect that change. chp says if more people carpool there will be fewer cars on the road and less congestion. >> reporter: commuters haven't forgotten the grid lock the last time bart workers went on strike in july. >> read it the 24. it is a big hassle. >> reporter: with the threat of another strike it feels like deja vu. >> i feel like we have been down this road, feels like it happened 2, 3 times already. i am ready for resolution.

>> reporter: during the strike on july 1 the average drive time from the tunnel across the bay bridge was 38 minutes. 17 minutes longer than average. >> [ inaudible question ] >> 45 minutes. >> reporter: [ inaudible question ] >> 2 hours. >> reporter: if bart is on strike tomorrow and you are driving solo the carpool lanes will be off limits. if a strike happens chp will be enforcing the carpool hours like they did during the last bart strike. in july they issued 122 carpool violations in san francisco. a strike tomorrow would come at a busier time of-year. >> it could be more congested. every available officer will be out on the roads.

we treat this as every other day but expecting heavier traffic. >> tomorrow the chp olympians to have -- plans to have extra officers to clear stalled cars a ufthe road -- off the roadways. allie rasmus, ktvu channel 2 news. >> if there sabart strike tomorrow -- is a bart strike tomorrow there are alternatives. additional ferries will be on the bay with extra service to san francisco. a.c. transit is adding buses for its service but those workers have issued a strike notice and could walk off the job thursday and casual carpoolers. >> bart says it will provide up to 200 charter buses to take passengers free of charge into

5:30 p.m. but they are being single tracked through the area. sam transand vta are accepting cal train fairs while they clear the traction. university of california at berkeley police issued a crime alert. a robbery last night near the library. two men approached a student, and took his cell phone. two other people were robbed also over the weekend. students say they are already on alert. >> if i am walking late at night or if i am walking alone i need to get where i am going and i will have the stuff on me. >> police are advising students to keep their electronics out of view and if they are alone call for a escort to walk with them. continuing coverage now, a truck driver was crushed to death by rebar today at the 49ers new stadium site.

the secondb deadly accident there in four months. work will resume tomorrow. ktvu's ann rubin is looking into the safety record of the sub contractor involved and has the latest. >> reporter: an accident, however cal-osha inquiry could take months. a contraction worker was fell when rebar crushed him about 6:30 a.m. cal-osha will look into the lighting conditions at the site, though the fork lift looked fine and they were using a spotter to watch the process. following the accident the general contractor shut down for the day. they say they have been cleared to resume work tuesday morning.

>> we will hold a all hands meeting inside and talk about this tragedy and the access the workers will have for the support systems and that -- we will have a safety discussion as well. >> reporter: we looked into the safety records of the sub contractor. in 2007 there was a serious accident. a 5 story parking garage in flue collapsed, killing one work -- florida collapsed killing one worker and a 2013 instants where they received a fine of $3,700. both the sub contractor and general contractor are coping with the investigation and -- cooperating with the investigation. live ann rubin, ktvu channel 2 news. >> more details now. this is the second death at the site in four months.

a construction worker was killed on june 11 in an elevator shift. he was an employee of the sub contractor. construction was halted for two days following the death. replacing paper and pencils, the new education standards and why they could jeopardize funding and the glitch that delayed -- glitch that delayed unemployment checks. the warning they had. >> chilly mornings and warm afternoons. the swing in temperatures you could see tomorrow. unions accept it. this comes as a.c. transit workers announced today they could walk off the job on thursday. if both go out on strike that could mean trouble for commuters considering a.c. transit is part of b.a.r.t.'s back up plans. b.a.r.t. made its last, best and final offer. it would give a 12% raise during had next four years. that is 3% a year. employees contribute 9.5% to their health plan, $132 a month and workers would begin contributing to their pension plan. 1% the first year. ktvu's tom vacar explains the significance behind this final offer. >> good morning everybody. >> reporter: today a negotiator sited magic words. >> we were very surprised, stunned to get the last, best and final offer. >> reporter: she presents a

last, best and final offer. labor lawyer says that has legal consequences. >> using the terms, last, best and final offer is usually meaning we are done. >> reporter: once a last, best and final offer is presented to the union, the employer will ask the union to print. if the unions say -- to present it. if the unions say no they have more information they are at an impasse. unless negotiations continue b.a.r.t. can declare an impasse and declare its last, best and final offer on the employees. >> they can hire people off the street. they can have managers run the trains. they can operate with any strikers who don't want to

he says all kids under common core will take tests on computers starting in march with a pilot program involving 3 million students. the star tests are dead. >> governor jerry brown signed a bill to do away with the star tests. move to the future. let's not look at the old tests. >> reporter: the u.s. department of education is fighting california's move to get rid of the old tests and it could costs millions in funding. he says the u.s. department of education wanted california to use the old and the new tests simultaneously. ken pritchett, ktvu channel 2 news. new developments stemming from the delay in unemployment benefits to thousands of californians. there is word officials had prior warning about a computer glitch that caused the back up. they knew some claims would
