there's a lot of work to be done. it looks like somebody is coming out right now. if we come back here live this is josey with 1021. any word? any word? no? just a break right now. >> looks like they're just taking a break right now. let's take a look at the video actually from earlier. we were talking about this federal mediator that walked out at about 1:00 in the morning. you know, he basically made this announcement that negotiations have been making some progress. >> at the request of the federal mediation and conciliation service and because of all of our concerns about the public interest, i'm authorized to announce that trains will run tomorrow. >> >> reporter: now we have no idea how long both sides will go at it. we don't know if this is a break right now. at 10:00 last night the unions presented their counter offer

to sunday's offer that b.a.r.t. said was its best and final. we have heard from insiders that although the two parties are close to reaching an agreement they're locking heads on this key issue, which is pay. now another sticking point has been work rules regarding overtime. if they come out of here with no deal, that means that potentially, you know there could still be a strike come tomorrow. we'll just have to keep you posted. live from oakland i'm tara moriarty ktvu channel 2 news. there is no strike for now but many commuters following through with their alternate plans they made just in case. alex savidge at the ferry terminal with that part of the story. >> reporter: potentially it could be more crowded because of the uncertainty surrounding this labor dispute. a lot of people made other plans, backup plans on how they were going to get into san fransisco. you have to imagine people might stick with those plans even though the trains are running this morning. ferry's a popular option as we

saw during the last strike. could potentially see more people than normal taking those ferries even today into the city. ferries will be operating on a normal schedule today. that's the word because there is no b.a.r.t. strike. during the last strike in july, the ferry was a popular option. commuters lined up early. and if a strike does happen, the system will be trying to accommodate a lot more commuters. 200,000 people who use b.a.r.t. every day would need to find other ways to get into the city and the ferry would be one of those ways. in the event of a walkout by b.a.r.t. employees, every available ferry would be put into service. there would also be direct ferry service from the oakland terminal to san fransisco's ferry building and from alameda's mainstream to the san fransisco ferry building, and the ferries would be running about every 45 minutes or so. they would start earlier in the morning and run later on into the evening. the ferry's on a normal schedule. the first one expected to leave from oakland at 6:00 this

morning. alex savidge ktvu channel 2 news. we do know now that fewer people took b.a.r.t. on columbus day holiday yesterday than a year ago. b.a.r.t. says its ridership was at 184,000 by yesterday afternoon. on columbus day last year it was 208,000. now that's a difference of about 23,000 riders. the numbers are from 4:00 in the morning until 4:00 in the afternoon. as b.a.r.t. negotiations continued through the night, many commuters made alternative plans to get to work today. >> i plan to work from home. >> working at home. >> lucky people who get to work from home. but some commuters took their work laptops home with them yesterday just in case. other says they're frustrated at not knowing what's going to happen. the ceo of talk.com says a long strike would cause problems for his company. >> for a couple days it's fine. if the strike goes longer into weeks or potentially months that's a real problem.

>> a pg&e spokesman says the utility has a contingency plan in place for its 3700 san fransisco employees. they were encouraged to talk to their supervisors in advance about flex time or tell commuting from home. . here's a look at the top stories we're following this morning. a. c. transit workers have issued a 72-hour strike notice and could walk off the job thursday morning. members of local 192 have rejected two offers from a. c. transit management. the latest offer includes over 3% in raises over three years, but the unions say medical costs could rise as much as $280 a month. several small earthquakes hit the berkeley area this morning. the u.s. geological survey says a magnitude 3.2 quake struck shortly after 1 this morning. there were four after shocks including a 2-point # and a 2.6. overall no damage reported. senate leaders are close to a deal to reopen the government

through january 15th and raise the country's borrowing limit through february 15th. the agreement would have to be approved by the house. san fransisco police are looking for suspects in a triple shooting that killed one person. it happened last night on rose alley in the western addition. police say it was either a drive by or walkup shooting. the victims are said to be men in their early 20s and a teenage boy. the project developer at levi stadium plans to hold a meeting with all workers before that job site reopens this morning following a worker's death. work stopped yesterday morning after a bundle of rebar came loose and fell on a delivery truckdriver. the cal osha investigation could take several months. the state agency has said the work site is safe to reopen. now the medical examiner says the truckdriver killed in the construction accident in santa clara was 60-year-old edward irving lake junior. he died at the hospital. lake worked for gurdal a stadium subcontractor. neighbors say he lived with a girlfriend and several dogs at

his home in vacaville. >> he was always there when you needed him, would help you out in any way possible. >> long time friends say that the neighborhood will miss lake very much. the 49ers are also saddened by the death. the organization released a statement yesterday. it says in part, our sincerest thoughts and prayers are with the family, friends and co- workers affected by this tragedy. now there was another death at the stadium construction site prior to lake's death. that happened in early june. another construction worker, 63- year-old donald white was hit by an elevator counter weight in an elevator shaft. just four days ago cal osha decided not to issue a citation in connection with his death. investigators say white knew the elevator was in motion, but decided to stay where he was when he was fatally injured. happening now the warriors are playing a basketball game in china. the preseason game against the lakers tipped off just about 10

minutes ago in beijing. the teams are set to play two games against each other in china. golden state is also conducting a few clinics for youngsters and also intermingling with chinese fans who love basketball. the threat of a b.a.r.t. strike put ed lee's business trip to china on hold. we caught up with the mayor yesterday. he says he and an aide spent the afternoon calling b.a.r.t. management and labor leaders along with the government's office in an effort to urge both sides to find common ground. he was scheduled to attend this morning's warrior's game in china before meeting with beijing and metro officials. >> i think the saddest person was anita my wife because she expected to be on that flight with me but i told her to be the best representative she could along with the others, and i'll be here trying to avert what i think is devastating to the whole public and the bay area. >> now one person who doesn't have to worry about juggling her trip is oakland mayor jean quan who left friday for china with a separate delegation from the bay area council business

we're president following breaking news. b.a.r.t. trains will be running today. you're taking a live look at the caltrans building in oakland where talks are continuing this morning. 10 minutes ago we saw mediators

leave the building for a break. so far no deal has been reached. mediators announced at 1:00 this morning that b.a.r.t. would not strike today and that the talks would continue. those talks have been going on ever since. b.a.r.t. workers had threatened to go on strike today if they did not reach a contract deal by midnight. we're hoping to get an update sometime later this morning. we have some new information this morning about a pedestrian hit and killed on caltrain tracks in menlo park yesterday afternoon. caltrain now says that that person was a boy. he was hit just before 4:30 p.m. north of the rail crossing. caltrain has not released any further details about the boy or the circumstances behind his death. this is the 13th death on caltrain tracks this year. an arrest has been made in connection with a deadly shooting in san fransisco's mission district early yesterday morning. investigators say they've arrested 56-year-old vincent jacobo.

it happened on bartlett and 2 t streets at 4:30 in the morning. the victim has been identified as 28-year-old maurice white of san fransisco. no word on a motive for that shooting. time now 4:45. police in santa cruz have arrested five teenage gang members in a drive-by shooting of a 12-year-old boy last year. that's according to santa cruz sentinel. joey mendoza was on his way to his home on the lower ocean neighborhood on august 8th, 2012 when 19-year-old andrew carrera and four other gang members confronted him. mendoza was shot twice in the back, died on the scene. the names of the four suspects have not been released. a fire at a barn in a rural part of south san jose is under investigation. the fire department tweeted this photo of the damage. it started at about 10:45 last night on monterey road. firefighters say tara amy coe furniture restoration owns that barn. nearby power lines caused concern but no one was hurt.

uc berkeley police are investigating a robbery of a student on campus. the latest happened sunday night when two men approached a student walking near moffett library. the student was pushed to the ground and the suspects ran off with the student's cell phone. it comes after two more robberies near campus last week. police are urging students to put away their phones while walking on campus. the city of fremont may install surveillance cameras. the argus reports police are asking the city council to put up cameras on low to moderate income areas. they say their request comes after complaints about a rise in home burglaries. the cameras would be placed on fremont street lights and public buildings. no word on when the fremont cameras would go up. 4:47 is the time. let's check in with sal for a look at the commute. it could be interesting again because a lot of people just made those alternate plans in case b.a.r.t. was on strike. >> they didn't know what was going to happen when they went to bed. this morning b.a.r.t.

report. that includes both residential and commercial property. santa clara county tax assessor says one big reason is more people are getting jobs and that's driving up home prices. other bay area counties are reporting higher property values san mateo napa and alameda reporting increases of 5 percent or more. marin and contra costa report gross top 3%. targeted for their tools, the troubling crime trend that has left many bay area businesses thousands of dollars in the hole. >> and off limits to the public, while more people in california are ignoring park closures due to the budget battle in washington d. c.

delayed once again. we'll have a live report with the latest on the negotiations in about 5 minutes. police in solano county are looking for a man suspected of starting a fire inside a wal- mart store in fairfield. police released these surveillance photos of the man. he is suspected of starting a fire at 3:30 yesterday morning at the wal-mart on north texas street. that store was evacuatend evacuated but no one was hurt. boniva police are investigating a rash of vehicle thefts. this truck was among those stolen. it was found a few hours later abandoned. the owner says it had been stripped of $30,000 worth of tools and other equipment. . >> the containers were open, pretty much nothing in it. there were cleaning supplies that they took. they took almost everything out of the truck with the exception of a few small screws. >> benicia police say a dozen commercial truck asks vans have been stolen. they think the vehicles are being targeted because of the large amounts of valuable tools

that they typically carry. police are encouraging truck owners to install antitheft devices. some people are ignoring the government shutdown signs posted in national forests. the closed sign at lows pad race national forest near santa barbara is not keeping everyone out. hikers and bicyclists are going around the gate. others who aren't so daring say they're disappointed. >> last time we came here there was a fire so this area was closed. we're 0 for 2. i think we'll never come back here. >> there is a hefty fine for entering a closed area. up to $5000. and the forest service says they have rangers patrolling during the shutdown. richmond's point ma la tee's beach park is open for the first time in more than ten years. in 2001 the site fell into disrepair and had to be closed. help from volunteers and settlement money from the 2007 oil spill, the park has been spruced up. the city run beach features

picnic benches and barbecue pits and is open to visitors from sunrise to sunset. the half-moon bay pumpkin weigh off had a big winner this year. the biggest pumpkin weighed in at 1,985 pounds. that's the heaviest pumpkin in half-moon bay history. gary miller earned more than $11,000 for a record setting winner. >> it's kaepernicking. that's the only time i'll ever do that in my life. >> the pumpkin growers are doing the kaepernicking. if you want to see what that big pumpkin looks like, you can head there in person this weekend. the winning pumpkin, several of the other biggest gourds will be on display at half-moon bay. art and pumpkin festival through sunday. a lot going on down there. patient at children's hospital of oakland will get to celebrate halloween early. the hospital is hosting a halloween party for young patients and their families
