weather with rosemary orozco. thick pockets of fog report over parts of the north bay, the east bay. that's a -- also a chilly start with temperatures sinking into the upper 30s. for the afternoon just a subtle drop in temperatures for some of us. i'll have a look at what you can expect for your afternoon. the cool down in the extended forecast and where it may be tough to see outside at this hour coming up. and we begin with breaking news in the east bay. there has been a major injury crash on highway 24 in lafayette. for some time all eastbound lanes were shut down and allie rasmus is live for us at the scene as chp tries to clear up this mess. >> reporter: just in the last 20 minutes, the two right right lanes of eastbound 24 here in lafayette have opened to traffic. you can see cars going through. we are right in front of the pleasant hill road exit in lafayette. and behind me you can see two of the six cars involved in

this crash. now this happened around 5:30 this morning. i talked to one of the drivers involved in the crash off camera. he said that he was driving back from san fransisco and saw what looked like a cooler in the middle of the far left lane. he told me he swerved to avoid that cooler. he ended up hitting the concrete barrier here on the highway, and then his car spun back into on coming traffic hitting five other cars. now at least two people were taken to the hospital. the chp says they had serious injuries. as we take you back out here live, you can see the tow truck is getting -- one of the tow trucks, there's about at least two or three of them out here. they're getting ready to clear some of this accident scene and tow one of the cars involved, clear the area. you can see that the two for a left lanes while they're doing this work are still blocked off to traffic. chp says they are still investigating the official cause of what happened, and it's too early to tell if speed or alcohol was a factor. again, only two lanes of

traffic passing on eastbound 24 through lafayette. if you can avoid this freeway, you should because it is going to be slow going this morning. live in lafayette, allie rasmus ktvu channel 2 news. we are also following developing news from walnut creek. firefighters spent the morning fighting an apartment fire at an apartment building this. >> the fire started around 1:45 this morning in a building at the 500 block of north civic drive. flames started over a garage and spread through that 2 story building. 12 people are now looking for a place to live. that includes 7 adults and five children. >> we had an apartment fire spread into what we think is approximately four units. it is under control. >> authorities say four units were heavily damaged and two others sustained minor damage. no one was hurt in the fire, and that cause is still under investigation, but officials

say it doesn't appear to be suspicious. the national transportation safety board will handle the investigation into a b.a.r.t. train that struck and killed two transit workers in walnut creek. >> we just struck some individuals at approximate approximately the c1 track. >> central be advised it may be b.a.r.t. employees. >> you just heard an audio recording from the web site of a train operator reporting the incident to b.a.r.t. dispatch. officials say despite the ongoing strike, two men were inspecting a reported dip on the tracks a mile north of the walnut creek station. b.a.r.t. says the train was returning to its concord yard after delivering vandalized cars to richmond for cleanup. six people were on the train which was under computer controls. >> our hearts and prayers go out to the families of two workers who have just been

killed on the b.a.r.t. tracks. >> b.a.r.t. says the two victims were experienced employees who knew how to work around moving trains. the ntsb says it is sending two rail investigators to the bay area to find out what happened. allie rasmus will be live from the crash scene in the next half hour. the two deaths were the 7th 7th and 8th deaths of workers killed on the job. those deaths have shaken union employees currently on strike. members called it a "terrible human tragedy" they said since the last death five years ago they've been trying to improve visibility and lighting on b.a.r.t. tracks and tunnels. one union negotiator told us track side trees and shrubs providing sound buffers are often overgrown which affects visibility. >> these people i think that were there were not trained like our workers.

>> in a last work-related death, cal osha fined b.a.r.t. for poor communication and overgrown shrubbery which the investigators said created unsafe conditions. here's a list of some of the deadly accidents, transit worker jim strickland was struck and in 2001 b.a.r.t. electrician robert rose was killed by a train in san fransisco. in 1974 a worker died when a train hit a maintenance vehicle and in '73 a b.a.r.t. worker was killed on a track near hayward. the b.a.r.t. union's currently on strike are offering their condolences. we took new video in just the last hour of members of the service employees international union holding a candlelight vigil while picketing outside the lake merritt b.a.r.t. station. two vigils are scheduled for 6:00 tonight. the other union says it will not picket today out of respect for the two men killed yesterday.

the focus remains on the two people who lost their lives, the strike does continue today for a third day. before the accident, antoinette bryant told reporters the union planned to put b.a.r.t.'s last, best and final offer to a vote. she also said she expects members to reject that proposal. it raises their salary 12 percent over four years but the unions want pay increases of 16% and dispute continue over work rules. at this point there's no word of any scheduled talks between the two sides. check with ktvu.com for new developments on b.a.r.t. for both the strike and the accident investigation. you can also get updates on facebook and on twitter. happening right now, thousands of women and a few men are running through the streets of san fransisco. the 10th annual nike women's marathon began a little more than 30 minutes ago. this is a map of the race route. it started in union square and will travel along the waterfront before finishing along the great highway between

lincoln way and jfk drive. these are some new pictures just sent in from a viewer of the marathon from this morning. organizers say they are quite proud of how popular this marathon has become. also want to show you video from last year's event which drew just about 25,000 runners, 30,000 people are expected today. i guess we won't have that video. the event has raised more than $143 million for the leukemia and lymphoma society. tens of thousands of runners impaired with the b.a.r.t. strike, traffic expected to be heavy this morning. several streets are closed including parts of stockton and numerous muni bus lines are affected including the 38 gary, the 5 fulton and 2819th avenue lines. residents who have trouble getting into their homes or have their cars blocked by parked cars call 311 for assistant. time now is 7:08, and rosemary we always talk about how runners like it cool, and certainly it's cool out there. those pockets of fog should make for an interesting run.

there were times i drove through and i'm like i must be through and then another pocket. >> right, when it's patchy like that sometimes i'll mention it's almost more dangerous because you're not expecting it and you hit that wall of fog. that's what we're seeing this morning, pockets of really thick fog. i'm seeing some in oakland, giving a live look over the oakland estuary. the airport is reporting visibility down to a quarter mile. hay wood reporting thick fog into the north bay, santa rosa, napa, petaluma a quarter mile and half mile visibility. please as claudine mentioned it will come with very little warning. take it easy out there. and the temperatures quite cool once again for the runners in san fransisco. 48 degrees right now. 41 in novato. 50 in oakland, 42 for walnut creek. upper 40s in livermore. these temperatures within a degree or two of what we had yesterday morning. it was a chilly start then, a chilly start now. santa rosa reporting 38 degrees and as we shift to the north santa rosa not the only place

reporting upper 30s, sebastopol 39, 43 for hillsburg. a cool, cool one, but by the afternoon we're going to be mild once again because our pattern is shifting very little. the ridge of high pressure still in place. storm track still to the north. we are beginning to see temperatures cool just slightly. for some it will be so subtle you may not really notice, but along the coastline where we have the pumpkin festival continuing, temperatures are going to be on the cool to mild side. for the afternoon, partly sunny skies, low 60s by about noontime. mid-60s for the afternoon and, yes, we know. we've got shorter days, longer nights and so again, be prepared for cool weather once that sun begins to set. 80 degrees expected this afternoon for novato. upper 70s for san rafael, 73 for richmond, we just remain in a very mild to comfortable weather. 73 in oakland for the afternoon, 82 for danville, 83 in livermore. in the santa clara valley for

your afternoon, a lot like yesterday, upper 70s san jose. 80 degrees nor los gatos. 77 in santa cruz. for the peninsula 78. 69 in san fransisco. san fransisco warmed into the low 70s yesterday so you will be just a tad cooler for today. your extended forecast showing you temperatures again holding steady through your back to work monday. we do begin just a gradual cooldown, but it's a subtle one. we've got temperatures remaining in the upper 70s all the way through thursday for our inland communities, low 70s around the bay. mid-60s along the coast, and that chance for rain looks to have sizzled out for now. we may see some as we get into the second half, maybe into the first part of the weekend. that's very far out still at this point. in the meanwhile i'll have your lunchtime numbers coming up. san fransisco 49ers are beginning a long road trip with their first stop in tennessee. they will be taking on the titans today in a game that is expected to be filled with good

your day. the official sunrise in the next 5 to 10 minutes or so. we have patchy dense fog reported along the coast and along portions of the bay. >> the government shutdown is over for now, but some political analysts are cautioning there could be a round 2. the temporary budget deal funds the government through january 15th and raises the debt ceiling until february 7 february 7th. however there is a much earlier deadline for lawmakers. current rules require a bipartisan committee to produce a compromised budget by december 13th. ted cruz expects another tough political battle. >> unfortunately, a significant chunk of senate republicans instead came like the air force and began bombing the house republicans, our own troops. >> cruz says some fellow republicans are angry at him because some polls show that the public blamed the gop for the shutdown. however cruz says his attempt to fund the affordable care act was to help the people he serves now the gop leadership. >> i do not like them sam i am.

>> the fbi has confirmed it is investigating possible threats made on twitter against senator cruz. the agency is helping capital police investigate messages posed by a new jersey man who identified himself as a military veteran who fought in the vietnam war. some of the tweets were posted last wednesday when cardiology ended the -- congress ended the shutdown. tomorrow mom is president obama is expected to address the problems problems. the president will discuss his frustrations during a white house event. last week he ordered his team to correct the problems as soon as possible. he says there is no excuse for that web site not being ready. the administration says about 476,000 insurance applications have been filed through the new health care exchanges. however, officials are refusing to say how many people have actually enrolled. the congressional budget office predicted that 7 million people would get coverage during the 6 month signup period but health

care experts say without specific enrollment numbers it's unclear if the program is on track. and the u.s. says now that it will give pakistan more than $1.6 billion. federal officials say that money will be used for military and economic aid. monetary assistance had been suspended after the raid that killed osama bin laden but u.s. and pakistan officials are reopening a dialogue. the new prime minister will visit the white house later this week for more talks. same sex couples in new jersey are counting down the hours until monday. starting tomorrow, gay marriage is legal in the state. reporter darla miles spoke with some eager couples who have been waiting years for this day to arrive. >> being the first couple to apply for a marriage license in new jersey wasn't done on purpose. oscar madrid and gregory galves say they just wanted to get it done after 23 years. >> it's early. it's 9:00. >> yeah, we've got errands to

run. >> they decided to open the clerk's office for three hours saturday morning so that gay couples who fought for the right to get legally married wouldn't have to wait much longer. >> we used to live in california as well so we followed it there. we didn't get married there and we always said we would get married in the state we live. this is especially exciting for us because we live in jersey city. >> it's exciting. it's great to see families having the opportunity to formally be recognized. >> there is a 72 hour waiting period for those applying for new marriage licenses. couples who were married in other states don't have to wait. so thier us city mayor will start performing ceremonies as soon as the new law kicks in. >> i'll be here at 12:01. >> it was so much easier to go in like a man and a woman and just, you know, provide simple information and get a receipt. >> for us, the symbolic part of it is that we really wanted to wait and do it here in new jersey which is our home. >> put your hands down.

>> and that was darla miles reporting. the new jersey state supreme court rejected governor chris christie's attempt to block same-sex same-sex same-sex marriages. former san diego mayor bob filner is out of jail after being booked on several charges. that followed tuesday's plea agreement. he pleaded guilty to felony false imprisonment and two misdemeanor battery charges. under his plea agreement, filner must return his mayoral pension from march 26, 2013 to august 2013. he will serve probation. he is prohibited from seeking or holding public office again. hundreds of homeowners have made their way to the oakland marriott city center to get their house payments reduced and many more are expected to come. the nonprofit group

neighborhood assistance corporation of america is hosting the free mortgage modification event. representatives from 15 different banks and financial institutions have been on site since thursday and will be there through 6 p.m. tomorrow. jpmorgan chase is set to pay the largest penalty made by a single company. $13 billion will settle the justice department investigation into bad mortgages sold before the housing crisis. $4 billion will be put aside for consumer relief such as loan modifications. the settlement does not resolve a separate criminal investigation the company is undergoing. music will fill the air on treasure island, a look at the treasure island music festival and why organizers expect even more big crowds today. >> mostly sunny skies and mild weather will return for your sunday afternoon. this morning we're waking up with patchy dense fog and cool temperatures. i'll have a look at what is happening in your neighborhood coming up. k cheese, mushrooms,

live picture of highway 24. you can see that chp has stopped traffic near the pleasant hill road exit. the chp is trying to clear a crash that involves six cars and there were injuries, major injuries in that accident. just a short time ago they did block this again. they did have a couple lanes open but they stopped everyone because they're trying to move those cars off the road. this closure that you're looking at right now won't be in place for that long. they need to get though tow trucks in place and get those cars off the roadway. at least one person was seriously hurt. now we want to take you over to the bay bridge toll plaza. it looks clear right at the toll plaza, but there is a problem on the bay bridge. a couple of lanes blocked there. four vehicles involved. one is not movable. this is all going westbound into the city so you may see some delays and police activity and tow trucks out there as they try to clear up that situation. we'll keep an eye on both these incidents for you and keep you updated here on mornings on 2. >> festivities at the treasure

island music festival continue despite the b.a.r.t. strike. organizers say they were initially concerned the strike may have kept crowds aaway and e-mailed warnings to ticketholders about the strike. organizers say the crowds don't appear to be affected. many concert growers say they had been preparing for the potential strike and made alternate plans. >> i think people are resourceful. they're figuring out how to get here. we're seeing more people taking taxis on to the island. >> it was kind up in the air. we decided to do a party bus. everyone chipped in like 30 bus. >> event organizers say the only problem they have had so far is the location of their shuttle buses. the buses had been strategically located to accommodate b.a.r.t. time now is 7:25. we've been talking about that fog this morning. rosemary watching it, letting us know when it will burn off. >> i think it's something we'll be dealing with through mid- morning. we're seeing it along the east bay shore line, along the coast and over parts of the north

bay. take it easy out there. we're looking at mostly sunny skies over parts of the inner east bay and our pattern changing very little. the ridge of high pressure still in place, but on a local level. the sea breeze is there and we are, again, watching the return of the marine layer. it has grown over the last 24 hours by 500 feet. yesterday morning was 500 feet. this morning i'm seeing it right about a thousand feet. we are seeing some changes and that's where we're sealing and feeling -- seeing and feeling the changes along the coast. we'll be cool to mild once again with partly sunny skies. you go inland and temperatures budge very little. back into the upper 70s to low 80s once again for our inland communities. here is a look at your extended forecast. today temperatures drop off just a few degrees or so, perhaps around the bay, perhaps along the coast. and here is a look at your time line. the sun rose just a few moments ago. it is a chilly start once again, upper 30s to widespread 40s from our inland communities around the bay and a few areas

in the low 50s along the peninsula. i'm seeing like areas around mountain view, mostly sunny skies, temperatures feeling a lot better as we get into the 10:00 hour, upper 50s to low 60s and then by lunchtime low 60s around the coast, upper 60s around the bay to upper 70s for our warmer communities. as we get into monday, our temperatures remain right about the same. nice weather in the forecast. we get back to work monday, and then just a subtle slide, upper 70s remaining in the forecast all the way through thursday for our inland cities. low 70s around the bay. mid-60s for the coast. thank you rosemary. right now we're following developing news for walnut creek. a dozen people including five children displaced this morning. what we're learning about an apartment fire hours ago when the damage is left behind. >> mourning the loss of two members of the b.a.r.t. family, what we are learning about the incident that killed two men on the track yesterday.

its concord yard after delivering vandalized cars to richmond for cleanup. b.a.r.t. says six people were on the train which was under computer controls. allie rasmus will have more on the story coming up in just a bit. while the focus remains on the two people who lost their lives, the b.a.r.t. strike does continue for a third day. there are no new talks scheduled. before the accident, the imcolgated transit union announced it would take b.a.r.t.'s last best and final offer to a vote but said members would likely reject the proposal. >> if no agreement is reached, b.a.r.t. passengers will have to look for other modes of transportation tomorrow. the san fransisco bay ferry service is one of the local transit agencies picking up the slack. ridership has jumped as 3400 people took the ferry yesterday morning. that's compared to an average of 1600 passengers. the ferry service will add extra vessels during the b.a.r.t. strike. b.a.r.t. also running charter buses

today. this map shows the 9 east bay stations where people can take the buses. the dell nor day, west oakland, dublin, pleasanton, san leandro, hayward and fremont. the buses start at 8:00 and will go until 11:00 this morning. they are to drop off and pick up passengers in san fransisco on howard between fremont and beal street. the buses are free of charge. the return buses from san fransisco to the east bay go from 3 in the afternoon to 6:00 tonight. transportation officials are warning commuters to get ready for big traffic jams tomorrow morning and evening. it could take you two to three times longer to get to work and back home. on friday the first day of the strike, traffic delays across the bay area were just about 30% more than normal. ride shares proved to be quite popular. traffic on the car pool lane of interstate 88 leading up to the bridge was twice as busy as a typical friday. 880 and highways 24 and 37 are hot spots.

check with ktvu.com for new development offense b.a.r.t. for the strike and the accident investigation. you can also get updates on facebook as well as twitter. a public hearing will be held tomorrow in oakland as a potential ac transit strike looms. the panel appointed by governor brown will hold a hearing to determine what effect a strike would have on the community. both ac transit and labor leaders are scheduled to make presentations. last wednesday brown asked the board to investigate. it has seven days to look into the matter, and then will present its findings to the governor. he will then decide if he will call for a 60-day cooling off period. and now to developing news in walnut creek where this morning a large apartment building caught fire. that fire started around 1:45 this morning at a building on the 500 block of north civic drive. investigators say flames first started over the garage area and then spread through the two- story building. 12 people were burned out of their homes. 7 adults, five children, no word yet on the cause.

happening today, the 22nd anniversary of one of the deadliest fires in bay area history. on october 20th, 1991 remnants of a brush fire flared up and then raced through the oakland hills. the wind whipped fire killed 25 people and destroyed more than 3,000 homes. at 11 this morning, firestorm survivors and community leaders will hold a news conference to express support for the continuation of the wildfire prevention district was it was created in response to that fire but is scheduled to end next january. oakland hills voters are being asked to renew a special tax to keep the district in place. it would cost $78 per year for the next ten years. the family of a 2-year-old boy shot on friday is asking the gunman to turn himself in. police sadie on day say dionte jackson was hit by a stray bullet. he is in critical condition but recovering. witnesses say the toddler was struck by a bullet during a gun battle that was happening two blocks away. >> whoever did it, you know, i

wish they're looking that the now because how would you feel if it was your child. your nephew, your baby, a 2- year-old. >> oakland police are asking anyone who may have tips in this case to come forward. the family says if you know something but are too afraid to go to police, you can always go to them. fairfield police have released surveillance photos of a possible suspect in the strong arm robbery of a senior citizen. these images were taken by a store surveillance camera in september. they show a man who was following the victim around. later that day was the woman was robbed in the driveway outside of her home. police are asking anyone who recognizes this man in these photos to call fairfield police. a hearing is scheduled tomorrow to discuss the status of a natural gas pipeline in san carlos. pg&e want it back in service. according to the san jose mercury news an independent expert found that line is safe to resume full operations despite finding thinner than expected walls in a section of the pipeline. pg&e took that gas pipe offline earlier this month after a

company engineer raised concerns about its safety. state regulators have questioned the safety of pg&e's entire natural gas system in the wake of the san bruno explosion in 2010. santa rosa police are searching for more suspects in connection with a hash lab explosion. it happened friday afternoon at a home on yolanda avenue. police discovered a lab that had been set up to extract hash oil from marijuana plants. more than 100 pounds of marijuana and a large amount of cash was also found. police believe one of the suspects was injured in the explosion. a hearing continues tomorrow in marin county to determine if a man serving a life sentence can be released under the reform three strikes law. oscar micky curry was sentenced to 25 years to life in 1996 after being convicted for selling cocaine to an undercover officer. that was his third strike. under the reform law, people serving life can appeal for the sentence if the third strike was not a violent offense. prosecutors say curry is a known gang member and argue he will return to a life of crime

if set free. a sacramento county police dog is recovering at home after being shot during a pursuit. official say drego was running through a field after a suspected car thief on friday when the suspect opened fire. veterinarians say the k-9 suffered a collapsed lung. sheriff's officials say the suspect shot and killed himself right after shooting the dog. time now 7:37. let's go over to rose rosemary for a check on how this weekend is going to wrap up for us. the fog makes for a gorgeous look over the bay but it's chilly. >> right. a chilly start and we're waking up with fog this morning. i was checking out that same picture, just fingers of fog sort of floating over san fransisco. it makes for a gorgeous shot there. the sun is up. we will watch temperatures begin to slowly turn around in the next hour or so, and then i think by about 10:00 or so just like yesterday morning, temperatures will feel a lot nicer. here's a look at what we're seeing out there this morning, hugging the coastline, although half-moon bay reporting

away. two of the many questions federal officials are looking to answer. ktvu's allie rasmus just arrived there at the site in walnut creek with the latest. >> late. >> reporter: the train involved in this accident is still on the tracks. we are in walnut creek about a mile north of the walnut creek b.a.r.t. station. i talked to the spokesman for the ntsb who says a team of two investigators are en route to this accident site to begin a parallel investigation along with b.a.r.t. and local authorities to figure out exactly what went wrong yesterday. a b.a.r.t. worker contractor were working on this section of track when an on coming train struck and killed them. it is not clear if the person at the controls of that b.a.r.t. train was a manager who'd been authorized to drive trains during the strike. the director of operations for b.a.r.t. explained that the workers were doing a maintenance check on the tracks yesterday. >> they were out looking for what was reported to us from an

last b.a.r.t. work-related death five years ago they've been trying to improve visibility and lighting on b.a.r.t. tracks and tunnels. safety is a con ten, contentious issue. track side trees and shrubs are often overgrown which does affect visibility. >> there's a lot of place where is you can't tell what track the train is coming down, and these people i think that were there were not trained like our workers. >> in the last work-related death, cal osha fined b.a.r.t. for what it termed poor communication and overgrown shrubbery which the investigators said created unsafe conditions. and here's a list of some of the other deadly accidents involving b.a.r.t. employees. as we mentioned in 2008, transit worker jim strickland was struck near the site of yesterday's accident. in january of 2001 robert roads was killed by a train in san fransisco. in n 19 # 4 a worker died when a train hit a maintenance vehicle. while the focus remains on

the two people who lost their lives, the strike does continue for a third day. before the accident atu president antoinette bryant told reporters the union planned to put b.a.r.t.'s last, best and final offer to a vote but said she expects members to reject the proms. b.a.r.t. offered workers a contract that raises their salary 12% over four years. b.a.r.t.'s unions want pay increases of nearly 16%. disputes also continue over work rules. at this point there is no word of any scheduled talks between the two sides. check with ktvu.com for new developments on b.a.r.t. for both the strike and the accident investigation. you can also get updates on facebook as well as twitter. a public hearing is scheduled tomorrow in oakland over the threatened ac transit strike. the panel appointed by governor brown is hold the hearing to determine what effect the strike would have on the community. both ac transit and labor leaders are scheduled to make presentations. last wednesday brown asked the

care web site. aides say he has been frustrated about technical issues such as people having trouble enrolling into specific programs. the president will discuss his frustrations during a white house event. last week he ordered his team to correct the problems as soon as possible. he says there is no excuse for the for the web site not being ready. the administration says 476,000 insurance applications have been filed through the new health care exchanges. however official are refusing to say how many people have enrolled. a congressional budget office predicted that 7 million people would get coverage during the 6 month signup period. health care experts say without specific enrollment number it's unclear if the program is on track. there are no signs of the flu in california so far this year. that is according to the first report by the cdc since the government reopened. the agency had not updated its flu web site in weeks but on friday they sent out their first report. only states with a few reported

flu cases are alabama, south carolina and texas. two cantaloupe farmers are expected to plead guilty to several charges in connection with listeria outbreak that killed 30 people. eric and ryan benson are set to appear before a judge in airplay a plea hearing. the brothers are accused of not using a chlorine spray to kill bacteria. they initially pleaded not guilty to six counts but according to legal filings from tuesday they have now struck a deal with prosecutors and will change their plea. and former san diego mayor bob filner out of jail after being booked on several charges. that followed tuesday's plea agreement. filner pleaded guilty to felony false imprisonment and two misdemeanor battery charges. under his plea agreement he must return his mayoral pension from march 6th of this year to august 23rd of this year. he's going to serve probation for three years and be confined to his home for the next three months. he is also prohibited from ever

i heard the wheels screeching. a witness describing the noise he heard when a b.a.r.t. train hit two workers inspecting the tracks. this morning the search for answers as b.a.r.t. deals with another heavy blow. good morning and welcome back to mornings on 2. i'm claudine wong. >> and i'm mike mibach. >> who was operating the train and why couldn't the workers get out of the way. a couple of questions investigators are looking to answer. allie rasmus live at the accident site there in walnut creek, and that is also where investigators are scheduled to arrive today? >> reporter: that's right. he says a team of two investigators are en route to this accident site. this is the train that struck and killed two workers yesterday. the ntsb is going to be doing an independent investigation into what went wrong here, and he explained that unlike aircraft crashes, the ntsb does not have to investigate railway accidents but the spokesman explained that this agency will be looking into whether there

are "broader safety issues." >> our aim is to share information and lessons learned so prevent accidents like this from happening again. >> around 1:45 yesterday afternoon a b.a.r.t. worker and contractor were doing a maintenance check on this section of the track about a mile north of the walnut creek b.a.r.t. station. a train on its way to a b.a.r.t. train yard in richmond struck and killed the two workers. b.a.r.t. officials say the train was being computer operated at the time but it's not clear whether a b.a.r.t. nonunion manager was behind the controls when this happened. b.a.r.t. had certified 12 of its managers to operate trains during this strike. b.a.r.t.'s general manager spoke briefly at the accident and offered condolences to the families of the victims. this morning at the lake merritt b.a.r.t. station, striking union workers decorated the station entrance with candles. there are two candlelight vigils planned for this evening to remember the two victims of this accident. one at the lake merritt

b.a.r.t. station and the other at the b.a.r.t. nation walnut -- station in walnut creek. live in walnut creek allie rasmus. >> while the focus remains on the two people who lost they've lives, the b.a.r.t. strike does continue for the third day. before the accident the atu announced it would take b.a.r.t.'s last best and final offer to a vote but that members would likely reject the proposal which would raise their salaries 12% over four years. a sticking point remains over work rules. if no agreement is reached, b.a.r.t. passengers will have to look for other modes of transportation tomorrow. the san fransisco bay ferry service is one of the transit agencies picking up the slack. ridership has jumped as 3400 people took the ferry yesterday morning. that's compared to an average of about 1600 passengers. ferry service will add extra vessels during the b.a.r.t.

strike. b.a.r.t. is running charter buses where people can take those buses. del norte, west oakland, concord, walnut creek, lafayette, dublin pleasanton, san leandro, hayward and fremont. buses will run until 11:00 this morning. they will drop off passengers in san fransisco on howard between fremont and beale streets. the return buss from san fransisco to the east bay go from 3:00 to 6:00 tonight. transportation officials are warning commuters to get ready for big traffic jams tomorrow morning and evening. it could take you two to three times longer to get to work and then back home. on friday the first day of the strike traffic delays across the bay area were just about 30% more than normal. ride shares proved to be pretty popular. traffic on the car pool lane of interstate 80 leading up to the bay bridge was about twice as busy as a typical friday. other hot spots 80 and 880 as well as highways 24 and 37. check with ktvu.com for new developments on b.a.r.t. for both the strike and the accident investigation. you can also get updates on

determine if a man serving a life sentence can be released under the reformed three strikes law. oscar micky curry was sentenced to 25 years to life in 1996 after being convicted for selling cocaine to an undercover officer. that was his third strike. under the reform law people serving life can appeal for the sentence if the third strike was not a violent offense. prosecutors say curry's a known gang member and will return to a life of crime if set free. a hearing is scheduled tomorrow to discuss the status of a natural gas pipeline in san carlos. pg&e regulators want it back in service. an independent expert found the line is safe to resume operations. pg&e took the gas pipeline offline earlier this month after a company engineer raised concerns about its safety. regulators have questioned the safety of pg&e's entire natural gas system in the wake of the san bruno explosion. santa rosa police are searching for more people connect today a hash lab

explosion. it happened friday afternoon at a home on yolanda avenue. inside that home was a lab where hash oil was being extracted from marijuana plants. more than 100 pounds of marijuana and a large amount of cash was also found. police say one suspect was injured in the explosion. a sacramento county police dog is now recovering at home after being shot during a pursuit. sheriff officials say drego was running through a field after a suspected car thief on friday when the suspect opened fire. veterinarians say the k-9 suffered a collapsed lung. the suspect shot and killed himself right after shooting the dog. animal lovers in san fransisco are expected to pack a supervisors hearing on proposed restrictions for where they walk their dogs. the city is considering a proposal that places places restrictions within the golden gate national recreation area which includes fort fun son and chrissy field. two years ago the golden gate national recreation area

mostly sunny skies, 69 degrees for san fransisco today. state of emergency has been declared in new south wales australia as weather threatens to worsen wildfires. one man has died, thousands of others forced to evacuate their homes. fire officials say the recent fires have been some of the most destructive wildfires to strike the area. more than 300 homes have been destroyed, hundreds of others are threatened. >> these conditions that we're looking at are a whole new ball game and in a league of their own. >> fire officials say strong winds and dry conditions are making it harder for crews to control the flames. the biggest blaze fire crews are fighting stretches along a 190-mile front. >> and happening today, the 22 22nd anniversary of one of the deadliest fires in bay area history. on october 20th, 1991, remnants of a brush fire flared up and raced through the oakland hills. the wind whipped fire killed 25 people and destroyed more than 3,000 homes. at 11 this morning, firestorm

survivors and community leaders are going to hold a news conference. they want to support the continuation of the wildfire prevention district. that was created in response to the fire but is scheduled to end next january. oakland hills voters are being asked to renew a special tax to try to keep that district in place. it would cost $78 a year per parcel for the next ten years. the san fransisco 49ers are on the front end of a long road trip with their first stop in tennessee. they will be kicking off against the titans today in a game expected to be filled with good defense. the titans ranked 2nd in the nfl in turnover differential. the 9ers will then head to england. they'll take on the jacksonville jaguars. we'll have reports from london. you can watch today's game right here on ktvu. the oakland raiders have a bye this weekend. it's been more than a decade since the raiders won a game coming off a bye week. the team is looking to refuel before it hosts the steelers next weekend at the coliseum.
