good morning. welcome back. breaking news. after we rarted problems this morning. we can tell you the trains are running. the new development that happened moments ago. >> complete bay area news coverage starts right now. this is ktvu channel 2 morning news. >> good morning. these are live pictures. this is the hayward bart work yard. the trains are getting ready to start rolling this morning. there have been delays this morning but we're told limited service will be available for you this morning on bart. they hope to have full service this afternoon. ktvu's alex savage is out there. we have live team coverage. sal and everybody else covering this for you. welcome to tuesday. it is october 22nd

. i'm dave clark. >> i'm maureen naylor. >> cool, cold for others. a little band of high clouds zipping through. a lot of fog out there and the warm air is squashing the fog. we have reduced visibility and thick fog until 9:00. thick fog out there. it will still be warm inland. some areas are very warm. especially out towards clear lake. cool to cold by the teaches. 50s. hazy sunshine. 70s and 80s. a lot of 40s here. reduced visibility from san jose to santa rosa. san francisco who had 80s last week. 50s. 59. and a brisk 49 right now. a lot of low s all over the place. there's a lot of fog that is making an impact. cool to cold over by the coast. mild to warm inland. a big difference here. 50s to low to mid 80s. >> good morning. a little bit

of confusion. the trains are running limited service. 30 to 45 minute delays. at this point, some people are happy to see any trains at all. you can take shuttle buses from the walnut creek station. bart says it should have all service restored to normal by this afternoon. let's take a look at the commute. it's still rather crowded. a lot of people decided with the uncertainty to take the cars. the back ups are not as bad as they were yesterday. still rather robust i would say as you can see. let's move along and take a look at highway 24. i asked for some tweets to read on the air and the sentiment says it's over but where are the trains? hopefully she's watching. the trains are now running limited service. let's go and take a map we've been looking at everyday this week. you can see improvement. 24 is only backed up to the macarthur bart station.

not quite backed up to 980 as it was yesterday. back to the desk. >> 6:02. bart is telling us it is now running limited service. you can expect delays of 30 to 45 minutes. we want to take you to the dublin bart station. janine is there. you've been out there since early this morning. what's happening out there right now? >> reporter: the gates are open as you can see. and we just heard the train come in. it's right above us. we know that it's here. we're not sure if they've actually started boarding yet. but let's show you what it looks like. people are still coming here. nobody's been able to talk to us cause they want to make sure they catch the train. let's take a look at what it looked like earlier. bart riders started arriving at 4 a.m. they heard bart service would resume at that time. the trains were still in they'd have to wait.

lots of commuters left then but shortly after 5:00, the gates opened waiting for the first train to come here on the dublin bart station for about an hour. now, again, bart has butt out a notice that they will be running limited services, that trains are running. they are saying to expect delays between 30 to 45 minutes. so even though the first train is here, again, we're not sure when the next one is going to arrive. they are asking people to be patient. but back out here live, you can see there are plenty of commuters here arriving and hoping to catch that first train. reporting live, janine, ktvu, channel 2 news. >> we continue team coverage on the problems for bart this morning. brian flores at the lake merit bart station. what's happening over there? >> good morning. just about 20 minutes ago bart made the announcement that yes, all

stations are open. as we've been reporting, there is limited train service this morning. if you are trying to take bart this morning, keep that in mind. expect delays this morning as they try to get the trains rolling. for more on the situation this morning, i have here jim with bart. good morning to you. >> good morning. so i can give you an update. we have 25 minutes running right now. normally we would have 45. so as you said, there is limited service. but the good news is we do have service. >> talk to us about why there was not enough train workers today. what happened there? was there a system that went out? >> well, as you know, the tentative agreement was reached late last night. the train operators and agents begin early. so the unions were working hard to get the word out to members. but for someone who gets to work at 3 or 4:00 in the morning, they are not often staying up late at night. so it's only natural that they are

trickling in and coming ins minute by minute. >> when do we expect to have full service? i know this afternoon but a little closer nailed down? >> we're still saying for the afternoon commute is our hope to get full service restored. >> talk to us about what happened last night. negotiations went late last night. what can you tell us in terms of safety? were those settled? what did we come to an agreement? >> tick say we have a tentative agreement and happy to get the trains running again. and we'll let the leaders speak. >> are charter buses running this morning? >> we have 90 buses from the same stations. but now that we have train service, we will hope to bring people back on the trains rather than the charter buses this afternoon. >> i do want to ask you one more question. obviously, we were at the ferries yesterday. a lot of people say i don't want

to take bart any more. this is not a pure nightmare but going to take time for the public to trust bart again. what do you say to the public who may not be wanting to take bart? >> i understand that people would be frustrated with the situation and be weary of bart. our brand is our reliability. we have 95% or better on time performance. the number one thing we can do to earn trust again is to offer reliable train service. and i know that every woman and man who works for bart wants to do that. i'm sure we'll be back up to speed and reliable again. >> thank you for taking the time to speak with us. 30 to 45 minute delays this morning. 25 trains out there on the tracks right now. 45 trains normally on a normal service. it's going to take time this afternoon until full service returns for many bart commuters.

live here brian flores, ktvu channel 2 news. >> all right. thank you for that update. 6:07. we want to continue our coverage with alex savage. he joins us live from the bart maintenance work yard where you've been able to see some of the trains where they had been sitting and start to get moving again. >> yeah, they are getting them slowly moving again. the system coming back online. it is a slow process. the big issue is staffing. not enough to operate all of the trains you see here. they are sitting idol right now and ready toe go. they just have to wait for the operators to arrive here at bart's hayward maintenance yard. let me show you what we've been seeing. watching employees returning to work for the first time since the strike began last thursday. and over the past hour, more and more trains on the move pulling out of the yard here. we just heard from bart spokesman only 25 trains are

running right now and supposed to have #w45 train as at this point. -- 45 trains at this point. there was a delay, of course. train operators out here told me there were a couple reasons for that delay in service. first off, there were trains scattered around the system and they were out of place. in addition, operators say it took longer than usual to do safety checks on their trains that have been sitting idol. meantime, overnight, maintenance workers were on site and they had to clean up the trains and get them ready to carry passengers this morning. one union employee told me he showed up as soon as he heard the strike was called off. >> i have to come back and make money. i have to work and it's nice to have a great job like this. it's like a weight been lifted off of me. and i was glad to come back to work. >> reporter: again, it has been difficult to get the system back up and running because of a

shortage in staff. i did talk to one operator arriving for work. he told me he came in to board a train and get it out. he told me he came in four hours early for work. didn't have to do that. maienance yard he and its though an operator is about to take this train and put it out on the system.eoe we are watchig arriving for work. ktvu, channel 2 news. >> all right. a live look at what a lot of people have been waiting to see.'s confusion comes after welcome news thent e transit agency and bart's two largest unions. they did not

reveal the details of the deal that brought the bitter dispute to an end. >> we will go back to work andee bay area moving. we did not want to strike. and we are glad to have an agreement we feel will work for all parties. >> this offer is more than we wanted to pay. it is a new path in terms of our partnership with workers and helps us to deliver the bart service for the future. >> the agreement still mt be ratified. more than a dozen politicians showep including lute governor. >> a lot of people's lives have been impacted. we're grateful we're here. bu this can never happened again. >> some say law makers are pushing for a law that would make transit strikes illegal in california. >> federnvlledwo bart workers oe

tracks was being controlled by operator in training. >> we struck individuals at approximately 16 decimal 2 on the c-1 track. >> saturday afternoon, the two men were inspecting the tracks when they were hit and killed. one of the victims was a member of a union that represents 220 train controllers and operation supervisors. the president of that union says before the accident, the union questioned an idea to the trains if the strike continued. >> the certification is over a >> bart responded by saying it's too early to comment. they are going to wait until the investigation is over. still not clear if the operator in training was a bart manager. the two men killed were following procedures bart put in

but you should expect delays of min. all this comes after the unions announced a tentative. >> the al media county district investigating shooting death of a the suspects was a parolee with a warrant. they say he was armed with some kind of pipe. >> began to gave him orders. he refused to comply . shortly after he threatened the officers and they were forced to use deadly force. one officer shot the man who died at the hospital. the officer is on administrative leave. >> firefighters are trying to reus at a house.

started at 2:30 this morning. the fire was a challenge to put out. it was on a hillside near vegetation. no one was inside and no firefighters injured. >> santa clara county is creating a grading system for restaurants. not everybody in alameda county. used color place cards and even a letter grade at some of the restaurants. >> with this grading, adds a lot of pressure to operate it. >> to the safety about a food born illness. we don't want to make anybody sick. >> many owners say they hope customers and consumers will make decisions on those grades. in just a couple hours, apple is expected to roll out upgrades for popular products which could include the ipad and ipad mini. only we have a lot

thick fog out there. place. i don't think it's going anywhere the e oakland is 66. overcast and 52 right now. 40s around. monterey. 20s, 30s up in the mountains. 60s down south. there is a lot of fog to go around. there's a couple lows. one off vancouver. one towards southern california. it's falling apart. looks like it's going to approach. end result will be really no change here. you can see circulations all around the place. there's no moisture associated with it. we end up with a lot of fog. a whopper of a hurricane and stationary. 115 miles down th be here today and drift westward tomorrow. a lot of 40s. 43 walnut creek. you combine that with the fog. 49 san francisco. it's a bite to the morning air. a few high clouds . it will be sunny and another mild to warm

cold conditions. there's a lot of 40s here. not much of a breeze. seems to be a little puff of an easterly. itwesterly near the coast. there's a lot more 40s and 50s. end up with a high of 59 which cloudsdegrees warmer than overall. a lot of fog and either sunny or cold and foggy. mild or warm or warmer inland. you can get into the low or mid 80s. back into the summer pattern. here's sal. >> steve, we are obviously, having a glitch getting bart service back online. not we but it. but the trains are running. at least some of them are. and people are using them. there are more people on the roads still. you can see the bay bridge. it's crowded out to the macarthur maze. that's about a 30 to 45 minute commute.

it's down from yesterday. yesterday it was longer than that. remember, they say that bart service should be fully ramped up by this afternoon. some people may be waiting it out. others can't wait because they are on the roads now. when we look at highway 24 yesterday at this time, it was busier. now this morning it is busy through lafayette. but it's getting back to somewhat of a normal commute here. and again, bart service isit's coming back. limited service. 25 trains on the system. normally about 45. in fact, every minute that goes by, there might be more than 25 trains at this time. 6:33. this is a look at the road sensors. 80 is taking a beating though coming in from richmond. let's go back to the desk. >> all right. that's our breaking news we're following for you right now. 30 minutes ago bart started limited service after early morning commuter chaos and confusion out there. bart says it was a staffing problem. they had to get the

workers in. that delayed the trains which were supposed to start at 4:00 this morning. the trains finally started running at 6 a.m. but you should expect delays 30 to 45 minutes at least. just a short time ago, bart spokesman explained what was causing this morning's delays. >> the unions were working hard to get the word out to their members. but for someone who gets to work at 3 or 4 in the morning, they are not often staying up late at night watching television. it's only natural they are trickling in and coming in as minute by minute goes by. >> that's what he said. and bart is hoping to have full bart service by the afternoon commute. >> and limited bart service right now comes after a morning of some confusion. tara moriarty is live at the walnut creek station where she saw a very welcome site. the first train finally arriving to pick up grateful passengers.

good morning, tara. >> reporter: this is the first train that we've seen pull in here this morning. trains officially running and it's beginning to look normal around here. the gates opened for the second time just before 6:00 and riders knew they were back in business. >> the first train pulled into the walnut creek station here and some folks will be late to work this morning because service was supposed to kick in at 4:00 this morning. the low staffing levels presented them from operations. most people scrambled across the parking lot into san francisco. some were annoyed that bart didn't deliver what it promised. mostly relieved the trains would be running soon. >> trains aren't going until 6 a.m. i'll just be waiting until then. it will be shorter to do that than taking the shuttle. >> yeah and at the end of the

day i don't have to commute out. thankfully my office is flexible. >> so we've been noticing that there's about a 45 minute delay on the trains here. the signs have been keeping people updated off to sort of a rocky start this morning. we won't be back to full service until this afternoon. about 25 of the 45 trains running at this point. so you are looking at delays into san francisco this morning. live from walnut creek, tara moriarty, ktvu channel 2 news. >> time now 6:36. east bay commuters rushing to the bart station now that the trains are running again. janine has been out there since early this morning. what's the latest? >> reporter: well, one train has come and gone. i still haven't heard the second train come in. but let me show you, there are people and commuters still coming in here to the dublin station. we're not sure when that next train is supposed to come.

let's go to video we took about 15 minutes ago. this is the first bart train that arufbed. came about 6 a.m. riders were already on the platform. some had been waiting for more than an hour. told us they were glad to be back. riders are relieved the strike is over. >> i'm glad it's back but i guess just be more productive on the train. driving was as simple. >> you didn't have a long wait? >> no, i leave early enough and get off early enough it worked out. i just modified my commute hours. >> earlier this morning, there was confusion. bart said trains would start running at 4 a.m. the gates remained closed for an hour because trains were still in the hayward yard and still waiting for staff to arrive. the gates opened up at 5 a.m. and bart workers allowed people to wait for that first train. again, limited train service.

bart is saying to expect delays between 30 to 45 minutes. in the afternoon, it's supposed to resume to normal operations. reporting live from dublin, ktvu channel 2 news. >> all right. thank you. time is 6:37. governor jerry brown has until tomorrow to decide whether ac transit needs a 60 day cooling off period. yesterday a panel appointed by the governor heard from ac transit managers and the public about the impact of a possible strike. several people told the panel a strike would hurt low income riders, the disabled along with students. >> we also need to factor in the safety. even our elementary students who will be on foot walking to school. five year olds walking down our busy and dangerous streets. >> ac transit union members have already twice rejected contract offers. one of their main

objections is increase in the amount of money they'd have to pay toward health insurance. the panel will deliver their report tomorrow. >> time now 6:38. police in vallejo investigating a shotting last night where three people were hurt. happened around 8:00 last night on fair grounds drive in north vallejo. one victim was found inside the restaurant. two other victims were at nearby hospitals. all are expected to survive. so far, no arrests have been made. also a proposal to enforce tougher regulations for gun dealers in pleasant hill. that attracted a full house. under the proposal, gun dealers would have to get permits from the police department every year. and also have to install alarm systems and surveillance cameras and all of their employees would have to undergo background checks. the city council will not vote on the measure. they are expected to take it up again in two weeks. >> trying to determine what

prompted a middle school student to bring a gun to school and open fire. injured two 12-year-old boys and killed a popular math teacher. the unidentified student began firing a semi automatic handgun just after yesterday's morning bell at sparks middle school. they say he brought the gun from home. teacher 45-year-old michael tried to get the student to put down the weapon when he was shot and killed. >> he loved teaching. he loved the kids . he was a good all around individual. >> police say moments after they arrived, the boy shot and killed himself. other students say that boy had been bullied. police say it's too early to tell if the students shot were targeted or if the shooting was random. >> 6:40. we're going to continue to cover the bart strike, the fact it's over and problems this morning. we're going to check on the ferry service the day after the strike ending.

welcome back. time now 6:43. bart running limited train service for you this morning. this is in walnut creek. the first train picking up passengers and leaving the bart station there this morning. bart said even though the trains are running, you should expect delays. 30 to 45 minutes. we continue our team coverage for you on the big problems on bart. ktvu's alex savage joining us live from hayward. you are at the bart work yard there. what's happening there now? >> i'll tell you what, staffing is the real issue this morning just trying to get enough people to operate all the trains. we have watched here over the past

half hour or so, there were about four or five trains sitting here behind us at the maintenance yard here in hayward this morning. you can see now all of those trains have pulled out. that is probably good news for commuters this morning. we have been watching employees returning to work for the first time since the strike started last thursday. more and more trains on the move ready to go pick up passengers. still though only about 25 trains in service. they should have about 45 trains at this time of the morning. a normal morning. limited service was supposed to resume at 4 a.m. but there was a delay. some train operators here told me there was a couple reasons for that delay. trains were scattered around the system when operators first got here this morning. operators say it took longer than usual to do safety checks. trains had been sitting idol for several days. one train operator returning to work told me he feels for commuters but says this strike

is necessary. >> we wanted to work for good ways and support our families but we're ready to go. >> overnight maintenance workers were out here on site cleaning the trains to get them ready to carry passengers this morning. many workers really doing their part and running. one operator told me he was here four hours before his shift was supposed to begin so he could help to ease the morning commute. again, they don't have enough people at this point to operate all of the trains they would like to operate. we are seeing more and more trains leaving this yard in hayward. live this morning, alex savage, ktvu channel 2 news.. >> bay area ferries expected to be packed again today despite the fact the bart strike ended last night. this is new video at the lines of the ferry terminal. a lot of people out there. the san francisco bay ferries says yesterday the morning rider ship almost

tripled. again, this was the line at oakland's jack london square. waited for the boat ride to san francisco. more than 7500 people road the ferries yesterday morning compared to 2600 people on an average monday morning. >> time is now 6:46. new developments surrounding a san francisco general hospital patient whose body was found in a stairwell. a hospital visitor got stuck in the same rarely used stairwell five months before the body of lynne spalding was found there. the woman who got stuck there reportedly said security workers did not come to find her even though an alarm went off. as for the patient who died, she disappeared on september 21st. then lynne spalding's body was found two weeks later. ktvu has confirmed a report was made several days before her body was found about a person lying in

the stairwell. an attorney for the family says that raises questions about the thoroughness of the search. this morning, the search for a missing diver will resume off the sonoma county coast. a diver was reported missing last night in salt lake state point. in salt point state park, rather. yesterday three divers spent an hour and a half searching for the man. today state park divers and the sheriff's office plan to search the coastline. a coast guard helicopter will also be used during the search. if you plan to head to the beach, just be careful about big waves today. there could be dangerous waves along the coast through this afternoon. although, they are not expected to be as big as yesterday. strong currents could catch someone off guard and fisherman are advised to stay away from rocks and je trjs ties. >> let's check in with tori campbell to see what's coming up. >> coming up in minutes on
