. now at noon -- the b.a.r.t. strike is over but not all of the trains are running. we'll tell you about the morning confusion and the current status on b.a.r.t. services. two people are dead after being shot by bay area police in separate incidents. the investigation is now underway. and new features and upgraded products from apple. what the tech giant unveiled at the big event. good afternoon. i'm tori campbell. the latest b.a.r.t.

strike, finally over after four days without train service. right now, trains are running on limited service. this is after the transit agency and its unions reached a tentative agreement last night. but the contract still needs to be approved by union members. despite the strike being over, it was a messy commute. most of the highways were gridlocked with people trying to drive to the city and there confusion -- there was confusion over whether the expanded h.o.v. hours were in effect. and in walnut creek despite station gates opening up at 4:00, some were still forced onto b.a.r.t. charter buses. we will have team coverage on what the tentative agreement includes. we start with janine de la vega on the current status of things. >> reporter: good afternoon. i've just been told that 48 trains are running out of the normal 52 that run at this time. so they are just four trains

short. trains are coming every 15 minutes. not any delays here. earlier, there was a holdup. >> operators are driving from here to the hayward yard. >> reporter: this was the scene at b.a.r.t. stations this morning, closed gates an confused riders -- and confused riders. trains were supposed to start running at 4:00 a.m. but that didn't happen. >> almost getting to the point where i should get back in my car here. i don't know. >> reporter: at walnut creek, this commuter took out his frustrations on a b.a.r.t. worker. >> you keep lying to us. >> well, i'm sorry. >> reporter: other commuters took the delay in stride. >> it's understandable, trying to call someone into work, not giving them a notice is kind of understandable. but i just wish they would have thought about that before. >> reporter: gates finally opened a short time before 6:00 a.m. a.m. the first train at the dublin- pleasonton station arrived

then, but traffic was light. commuters who were not sure how reliable service would be did not come. but those who doctor were glad trains were up and running. >> it's a relief. it's been a nightmare. hopefully with everything settled, we won't have to deal with another strike for a while. >> happy it's running. a three-hour commute to and from and then $30, $40 in parking. i have a baby at home that's only four months old, i need something shorter than three hours each day. >> reporter: earlier there were delays of 35 to 45 minutes but that shrunk to 20 minutes. b.a.r.t. says the goal, full service for the afternoon commute. they will still provide free charter bus service for the afternoon. and just to give you an idea of just how much lighter traffic was on b.a.r.t. trains this morning, i was told by a spokesman that ridership was down 69,000 people compared

to a typical tuesday. reporting live from fremont, janine de la vega, ktvu channel 2 news. >> all right. thank you, janine. even though the b.a.r.t. strike ended last night, san francisco bay ferry continues to provide its b.a.r.t. strike service schedule today. it's running 12 boats between oakland, alameda, san francisco, south san francisco. on a normal day, they would run eight boats. >> she thought the public probably didn't know b.a.r.t. was back on. my understanding is that b.a.r.t. is not at full strength. it will take until this afternoon. we thought it was best to provide the service we could to the public. so they know we're there and they know to get back to their cars runway or another. >> ferry ridership was down noticeably compared to the four days of the b.a.r.t. strike. on friday, more than 7,000 people rode the ferry boats. sunday, the load was 1900, twice the normal sunday ridership and yesterday, it climbed to more than 15,000.

even though the b.a.r.t. strike is over, the extended carpool hours are still in effect for the h.o.v. lanes. in the east bay on interstates 80, 880 and 680, diamond lanes are extended all day until 7:00 p.m. tonight and single motorists be aware. h.o.v. lane violation tickets carry a minimum $490 fine. so now that the strike is over, union members will have to vote on the tentative deal. tara moriarty has our first look at the numbers and she joins us live in oakland. good afternoon, tara. >> reporter: good afternoon. we have a copy of the -- some of the pages of the contract that the union leaders are urging the members to vote 0 yes on. we have -- too vote yes on. we have a break down of the numbers and they say they feel confident it will be approved. this is according to the atu contract. workers are looking at a 13% salary increase over the next four years.

that's up 1% from that last deal we heard about. employees will contribute 4% toward pension over four years and pay $130 in medical per month. we received a copy of one page that shows safety provisions for state a -- station agents including bulletproof glass to be installed in 15 booths. life insurance coverage will double to twice the employees' pay. overtime provisions will include a narrowly defined 40- hour workweek. today we asked antoinette bryant if she believed that talks progressed in the wake of the two recent b.a.r.t. worker deaths. >> to some degree it did, but i think the management recognized that this situation had to end. you can't run service with people that are not trained or that were trained many years ago. if you are not being recertified, if you don't have the seat time, if you don't have the reflex and action, these kinds of things can happen. >> reporter: this contract it's tentative but members will vote and they will most likely get

all of this wrapped up by early next week. here's the clincher -- they are meeting with the mediator right knew at caltrans headquarters. they still have an important part of their contract to get ironed out. if that doesn't happen, the other unions say they will stand in solidarity and we could be looking at another strike all over again. life from oakland, i'm tara moriarty, ktvu channel 2 news. >> all right. thank you, tara. ntsb investigators confirm that a trainee was at the controls of the train whoen it struck and killed -- when it struck and killed two workers on the track saturday afternoon. >> he would just struck some individuals at approximately 16 decimel 2. >> the two victims, christopher shepherd and lawrence daniels were inspecting the tracks near the lawrenceville station when they were hit. they say it appears that a message did go out over a

the governor heard testimony about the impact of a possible strike. a.c. transit union members have already rejected two contract offers. the panel will deliver their report to the governor tomorrow. san bruno police say an officer shot and killed a suspected car thief early this morning after a short car chase. it happened after 2:00 a.m. police say the officer spotted the stolen car and chased it to a dead end street in the 500 block of poplar avenue. the district attorney is investigating why the officer shot the driver. other officers took the passenger into custody son an unrelated warrant -- on an unrelated warrant. the alameda county district attorney is investigating another deadly shooting, this one involving union city police. it happened last night at 8:30 when police were called to an argument between neighbors on saturn way. one of the suspects was a parolee with a warrant. when officers went into his home, they say he was armed. >> they began to communicate

with him, give him orders. he refused to comply. shortly after he threatened the officers with the weapon and officers were forced to use deadly force. >> one officer shot the man who later died at a hospital. that officer is now on leave as part of the department policy. ukiah police are looking for a 36-year-old man who dropped off his dead 5-month- old son at a hospital emergency room last wednesday. investigators say that after junes brought in the child, he left the hospital and drove to his family's ranch south of ukiah. that's where he left his car. police have listed him as a missing pirn. the coroner -- person. the coroner has not yet determined the child's cause of death. complaints over the website and problems with the directory. so how well is the state healthcare program working? we will hear from the local service center. steve paulson will be here

criminal activity but we have no more details than that. the two schools are jesse bethel high school and wardlaw elementary school. we're working to get more information and we will update you if we get any more information during this newscast or you can always follow us on twitter for updates. two at noon -- apple unveils new product upgrades just in time for the upcoming holiday shopping season. david stevenson is in san francisco with word of one freebie that's in the mix. good afternoon, david. >> reporter: good afternoon. you are right. the offerings today at the annual event didn't just center on hardware. a big announcement inside was that apple's mavericks operating system, which it states offers better power efficiency and increased graphics, is now available for free starting today. but the big news for everyone else inside was the new ipad. it's called the ipad air. so far apple has sold 170 million ipads this month.

it launched about three and a half years ago. this new boddle is touted as -- model is touted at lighter with larger pixels, twice the data transfer speed and improved cam rausm the cost is $399 for -- camera. the cost is $399. it's the fourth on the market in part of a lineup being applauded by some analysts in the audience. >> they -- they've got a wide range of tablets now. they upgraded the mac pros, they have given away all of their software for free. this is the software you saw. i think the scope of the offering is very strong. >> reporter: now, coming up at 5:00, i will have a complete roundup of all of the products released including why some analysts say why they are seeing a slowing demand for these products. david stevenson, ktvu channel 2

news. >> thank you. the executive director of covered california gave an update on healthcare signups in contra costa county. he said the county service center has started over 125,000 applications since october 1st. he spoke about the contra costa health plan option along with others from anthem, blueshield, health anything and kaiser. he says despite stories about problems, the contra costa website has been working well. >> 2.2 million different individuals have been on the website. now there's a lot of stories out there about glitches on websites. i want to be clear, our website is working. we're enrolling people. they are getting on, absolutely. >> peter lee says they've taken 150,000 calls and many calls are getting good news about medi-cal or financial help with their coverage. san jose parents are

voicing their concern over what police are calling the city's number one priority. gang violence. last night, residence gathered for the city's first gang violence forum. some parents say their kids were harassed regularly by gangs. others voice concern about city mains next that they contribute to the -- mains next that they -- mainsence that they say contributes -- maintenance that they say contributes to the violence. >> street lights are out. >> more forums are scheduled for the next three monday nights. the results will be used to create a task force for the next three years. in oakland's rockridge district residents raised enough money to hire their own patrol. they are in contract negotiations with a private contract to start patrols on november 4th. the decision for private patrols comes after a recent rash of robberies and frustration over the city and police department's response to

the crime problem. firefighters in san rafael are trying to figure out what sparked a two-alarm fire at 2:30 a.m. on sea view and mission avenue at a home. firefighters say they had a difficult time getting a handle on the fire because it was on a hillside near a lot of vegetation. our camera crew was there and a hot spot flared up, re-igniting the fire. crews were able to quickly douse those flames. no one was inside the home at the time and no firefighters were hurt. the national weather service has issued a warning for beachgoers. you are advised to be on the lookout for rip currents and sneaker waves. officials warrant the strong rip currents can sweep people and pets into the water. the high surf advisory is expected to last through thursday. this morning crews resumed the search for an abalone driver who went missing on the san mateo county coast. he was reported last night

missing by his wife at salt point state park. at 8:00 this morning, state point divers and the sheriffs picked up the search. the man's name is not being released but he's described as an experienced diver. well, some of the comments from this morning, it's freezing. it was. temperatures even if you had clear skies was cold. if you are in the fog and temperatures in the 40s, it's finally slowing burning back. a lot of fog on the coast. most inland locations now say sunny to mostly sunny. you can see, i mean -- i didn't pull a file out from july to show you the fog bank. a few high clouds off southern california. the fog will be back in it's all its glory tonight. thick fog, warm inland. you are getting into the upper 70s to low 80s but hard presses to get out of the 50s for some. temperatures really staying in the low to mid-60s. it's cold up in the mountains but -- but now it's 63.

72 ukiah. sacramento, 73. temperatures down in the desert, warming up. you would expect that. plenty of gray to go around. if you get a few pockets of sun by the coast. a little low will start to work its way toward us. three of them. one of southern california, one off vancouver and they dumbbell around each other. they could just chew up the fog. there won't be any rain from it. 50s to 70s. walnut creek, 71. 73 fairfield. livermore, 70. half moon bay, 54. san francisco, 56. santa rosa, 59. low 60s for some, including san jose at 612. plenty of low clouds -- 61. plenty of low clouds and without a north or northeast wind, it will stick and stay. very clear to cold. mild to warm inland. temperatures -- they are trying to warm up, especially in lake county, might as well head up there and go swimming. in the 80s in clearlake. 60s and 70s closer to the

some good earnings reports from whirlpool, delta and kimberly clark all helping the dow go higher. taking a look, the dow is now up 100. the nasdaq also up 12 and s&p up 12. also helping the numbers, the latest government report on job creation. while the report itself was disappointing, it increases the odds the government's stimulus program will continue and investors like that. the report which was delayed 18 days due to the government should shows just 148,000 jobs were created in september. that's about 30,000 less than expected. the jobless rate also dropped

from 7.3% to 7.2%. it sounds good but analysts say it's mainly because job seekers became discouraged and stopped looking for work. the tsa is expanding its prescreening process to include more extensive background checks. right now, passengers' name, gender and date of birth are exired with -- compared with terrorist watch lists. but soon it will be compared to government and private databases including dmv records, passport numbers, and employment information. the tsa says the goal is to stream line the security procedures for millions of passengers. bay area travelers are benefiting from a west coast airline battle. delta is adding flights to los angeles from san jose and san francisco international airport. and it plans to add service to seattle next march. that prompted united and alaska to also add flights to seattle. that could mean some of the lowest fares on west coast

flight for years with other airlines all peteing for -- competing for passengers. facebook is allowing controversial videos of beheadings on its website. back in may, it announced it would ban videos while it carried out a policy review. now it believes the users should be free to watch and condemn such videos but not glorify them. public safety groups say allowing videos with such graphic violence on the website could be harmful to young use -- young users. kanye west rented out the entire at&t park last night and proposed to kim kardashian on a jumbotron that tase please marry me. this is a look at the 15-carat diamond ring. this is a picture she posted to her instagram page. the couple is in town for the concert tonight in san jose. san jose police are
