their inspection of the mechanical equipment on the train, and he says everything was working properly from the brakes to the horn. they've also completed interviews with the three people who were in the cab of the train when it struck the workers on the track. two of those people were going through a training exercise to be certified to operate trains. the third person in the cab was behind them supervising that training. the ntsb is going to be doing a reenactment tomorrow of the accident on the tracks in order to gather some more information. one of the questions they'll be trying to answer is how these two workers on the tracks may have been caught off guard. the two men did get a verbal approval from bart dispatch to do the work they were doing on the tracks. >> to allow them to go on or near the live tracks, the responsibility of their safety is on themselves. >> the average speed for a bart train on this section of track is about 70 miles per hour according to bart. it takes a train going that speed about five seconds to travel a tenth of a mile, and if you staund right next to the track, you first hear the train

only about three seconds before it zips by. the bart tracks where the accident happen run parallel to 680, and the noise from freeway traffic is constant in the background making it even more difficult to hear anything. the ntsb says bart procedures call for one person to act as a lookout whenever work is being done on the tracks. >> and a plan is also discussed on how and where to move into the clear of any oncoming trains or other equipment operating on either track in either direction at any time. >> and the ntsb investigation will also try to answer the question of whether those exact procedures were followed before this all happened. now, the ntsb reenactment of this accident is schedule today happen at noon tomorrow. it's going to be happening on the bart tracks. bart is going to be operating some buses to shuttle passengers

back and forth. those buses will be coming every 15 minutes, but, again, between noon and 3:30 tomorrow while this investigation reenactment happens on the tracks, there will be no bart service. live in walnut kriek, allie rasmus, ktvu channel 2 news. >> the strike is over but service is not yet fully restored. the system has a dozen fewer extra trains running tonight than they would have in a normal rush hour. ktvu john joins us live from san francisco and reports that after this second strike, the dollar signs are adding up for everyone affected. john. >> ken, this is one place where the bart strike is still afktsing drivers. all the added traffic today is slowing down the evening commute here at first and harrison, but transit agencies also lost money. >> san francisco's muni pickup much of the slack in this year's bart strikes. >> if there was never another bart strike, i'd be a happy guy. >> inside muni headquarters, the

city's director of transportation said even though the bart strieks caused ridership to strike, they cost the city nearly a million dollars. >> this did not generate money for our agency. this was a big financial hit for us. we don't benefit. frankly, we're not doing much parking enforcement. we're not doing fair enforcement because we have all hands on deck directed to try to keep the traffic moving. >> like wise, ac transit which operated additional buses to san francisco and around the east bay lost hundreds of thousands of dollars. 165,000 for the july strike, and although a final tally is not complete, ac transit officials say this week's strike will be even more expensive. >> everything is big circles. it affects everybody when something like that happens. >> at the foot of maeshth, fewer bart riders met a drop in business for street vendors who send a page sels her custom-made jewelry. >> there were fewer people here. i think it did impact our

businesses. >> as for bart, the numbers are still being tallied, but the earliest mat for a loss of service is $8.4 million per week, and the two strikes totalled eight days, plus buses bart uses were $200,000 a day. even though the agency says $4 million a week in unpaid wages, it is still millions of dollars in the hole. politicians tonight warned bart and its unions that the public will not tolerate another strike. a group of contra costa county elected officials today urged sacramento to outlaw bart strikes. they promised to go to voters if necessary to prevent transit strikes. independent sources told ktvu today it apierce bart management was willing to tolerate a strike, and lieutenant governor warned bart. >> people in this region are not going to put up with this again. they will move forward legislatively or otherwise to disband an agency that cannot effectively govern itself. >> newsome also told us the

proposed agreement mandates a joint labor management committee to try to diffuse issues before they blow up. more details now on the bart labor dispute. union workers first walked off the job on july 1st but were back at work four-and-a-half days later. on august 11th, 60-day cooling-off period was ordered by governor jerry brown. on oblth 10th that cooling-off period expired and last friday, october 18th, union workers again walked off the job. last night a tentative agreement was reached ending the strike. trains were back in service this morning. the man behind the wheel of a city parks truck when it hit and killed a mother in a san francisco park is in jail tonight. he is charged with two felonies in her death. within the past hour, ktvu's david stephen sovn spoke with the driver's attorney who says the fight hr his client has just begun. >> well, julie, a friend of the victim late today told us they are relieved to hear about these charges, but the attorney for the man in that jail right now

toild us they plan to vigorously fight the felony charges. 57-year-old recreation and pashgs worker thomas burnoski surrendered this afternoon on felony vehicular manslaughter and felony hit and run charges. police say he veered from a paved path in a park while driving a park truck and ran over christine as she lay sunbathing on september 5th with her baby in a park. the infant was not injured. after hitting her, burnoski continued driving to nearby rec & park building. he was arrested that day and freed on $25,000 bond. we spoke to burnoski's attorney in the past hour. he says this is all a horrible accident and one that does not warrant the felony charges filed today. >> everything is showing that it was a tragic accident. there's no drugs. there's no alcohol involved. there's no recklessness. there's no gross negligence, and

yet they have still chosen to file felony charges against mr. burnoski, which i think is very absurd. >> burnoski's attorney says his client has fully cooperated with polices and remorseful. he's being held here on $350,000 bail, and his attorney tells us late this afternoon he plans to ask for reduction in that bail tomorrow saying mr. burnoski is not a flight risk and does not pose a threat to the community. reporting live in san francisco, david stephenson ktvu channel 2 news. a police chase in san bruno ended when an officer shot and killed a suspected car thief. it happened a little after 2:00 this morning when an officer spotted a stolen vehicle and tried to pull the driver other, but the driver refused. officers pursued the suspect on a dead end street. while trying to arrest him, the officer said he felt threatened and fired his weapon. the suspect died at the scene. a passenger said the suspect's vehicle was taken into custody on an unrelated warrant.

in alameda county, investigators say union city police were called to an argument between neighbors on saturn way. police learned one of the suspects was a parolee with outstanding warrants. he was armed and threatened them. one office shot the suspect who later died at the hospital. the officer is now on administrative leave as part of department policy. san francisco supervisors voted to allow the chair of a state grant to help build a new jail. sheriff ross mirkarimi wants to build a 640-bed jail at this mcdonald's next to the hal of justice. he says the current county jails inside the hal of justice are unsafe because the building is believed to be at risk in a big earthquake. opponents say the money could be better spent. >> whether it's drug programs, jobs programs, family reunification. there's many, many things that would be more positive than just locking people um. >> the state grant the sheriff is seek is $80 million. the rest of the money for the

$390 million project would come from the city's general fund. the family of a berkeley man killed outside his home has reached a settlement in its wrongful death lawsuit against the city. 67-year-old peter was killed in february of last year. he was attacked while waiting for police to respond to his call about an intruder on his property. the city will now change its policy to allow dispatchers to tell callers an officer will respond when able, but there could be a delay because of other calls. his alleged killer was ruld incompetent to stand trial and sent to napa state hospital. sheriff ross mirkarimi is speaking to ktvu for the first time since the body of a patient was discovered in a rarely-used stairwell. lyn spalding disappeared on september 21st. her body was found more than two weeks later. just yesterday, ktvu confirmed that a report was made several days before spalding was found about a person lying in the stairwell. her family and loved once are

demanding answers, and sheriff mirkarimi is vowing he'll get those answers they're looking for. >> so we are being very diligent about making sure we understand what happened. it's a tragedy, and we have to make sure that it never happens again. >> the medical examiner's report on spalding's death still has not been released. san jose mayor is heading east to talk pension reform. reid is due to travel to nshg city and washington dc tomorrow through friday. his office says he'll meet with federal officials to talk about pension reform and participate in two pension summits. last week, reid and five other california mayors filed papers to get a pension reform initiative on the november, 2014, state ballot. to get more officers on south bay streets has sparked a battle. currently the san jose police force has less than a thousand officers. that's several hundred less than just a few years ago. after an arbitration fight, the

department was able to take officers who were conducting background checks on applicants and put about 17 officers back on the streets. background checks were then turned over to agencies that hired mainly retired officers, but a letter from the police union put an end to that practice and angered city officials. >> that'll make it more difficult for us to do background tons new recruits. it may slow down their recruiting. that's going to undermine the department. >> police department says it has put five full-time officer on background checks and plans to supplement them, though none has been hired yet. conservative groups are pushing to overcome a state law required a child to choose which bath rooms they use and whether to play i'm girls or boys sports team. a conservative coalition is now collecting sittings to get a measure repealing the law put on the november, 2014, ballot. 505,000 valid sittingings are

the beacon is back on its perch after a volunteer restoration. three pearl harbor survivors turned the light on briefly for testing. the historic landmark sweeps the sky every december 7th to honor the victims of the japanese attack on pearl harbor.

the save mount diablo conservation group raised a hundred thousand for the restoration. hoim surveillance video has a local neighborhood taking action. the video shows the two men taking their time picking through drawers and boxes. new at 6:00, ktvu patty lee shows us how these images are uniting a neighborhood to fight crime. >> this frame shows a burglar calling into a doorway to avoid setting off sensors. he is joining his partner in crime, whose face you can see clearly here. >> fortunately, they had surveillance in the house and the picture is just as clear as can be. >> other imajs obtained show them using an iphone. arnold shah says he found out his neighbor had been found almost immediately through the online grapevine. this is the impaj of the burglars originally shared by police on a private community web site. from there, it hit the social net works where the men appeared to be laughing.

neighbors are meeting to find out if they can put security cameras on street lights so they can monitor who comes in and out of that i shall neighborhood. well, apple's new arrival is thinner and lighter but pauks a more powerful pufrnl. the cupertino company unveiled the new ipad today. achl also introduced an upgrade to the i fad mini, which now sports a retina display, but the company is not expanding its support for computers. the new mavericks operating system and upgrades to its laptop line. those are all refining companies agree today pay a hefty penalty to settle air quality violations at its refinery. the air quality management direct said today the company agreed to pay a civil penalty more than $300,000. the set m involves 33 violations issued between 2011 and 2012. officials say none posed a significant threat to public

health. the money will be use today fund operations at the air quality drikts. the search is now in its second day. the diver disappeared in south point state park around 4:00 yesterday afternoon. his wife reported him missing. the search was called off overnight and rimed around 8:00 this morning, but heavy fog prevented the sheriff's helicopter from taking part in the search effort. outside our doors we're just a couple of minutes away from sunset, and as we settle into the evening hours, the low clouds are on their way back. we even have a dense fog advisory for the north bay inland valleys starts late tonight at 11:00, will last all the way until tomorrow morning, 11:00 in the morning. and as for inland communities, along highway 101 tomorrow morning could be a really tough drive getting through park, petaluma, down into novato. you can see sonoma, st. helena,

napa, and one last stretch here into san rafael as well as leading all the way into tiburon. mill valley, you're included in this. this to be aware of. maybe set that alarm clock a few minutes early and give yourself extra time. again, it's really thick at times. the dense fog advisory remains visibility down to about quarter mile in some areas. that makes it railly tough to see. the system about 800 miles out is making its track towards the bay area. it's not going to bring us any rain, though. take a look at what happens on the future cast model here picking it up for you tomorrow. there it is on the screen. by thursday, doesn't really budge a whole lot. friday moves a little bit closer. looks to be a couple hundred miles off the coastline, but it doesn't go any farther than that. it starts to shift south. earlier in the week we were looking at the possibility of maybe scattered showers coming our way. at this point it looks like we are going to remain dry and mild throughout. as we get going tomorrow morning, a lot like what we had this morning with the dense fog

getting back into the ring after shoulder surgery. the world's super middle weight champion talked with the media today in oakland. ward has been sidelined because of an injury for the past year, but now he is schedule today fight undefeated edwin rodriguez next month in southern california. should be a good one. mark here with good news for giants fans. >> yeah, i think so. you know, he's not really the pitcher he used to be statistically any way, but tim clearly means a lot to the san francisco giants organization, and they proved that with the bottom line. as tim lincecum, despite his record the last couple of years, signs a two-year deal worth $35

million. most of all for giants fans who admire him greatly, no drama on the free ajent market, in other words, didn't seem to be any hesitation on the giants' part, and tim lincecum not out snooping with other teams so it didn't get down to a situation where the new york yankees or boston red sox or some big spenders like even the dodgers got involved. tim lincecum a giant for at least two more years. speaking of baseball, right here on fox 2 tomorrow, the world series starts at fenway park. for you who were baseball fans way back when, kind of a rematch. remember when the boston red sox played the st. louis cardinals and bob gibson back in 1967? well, it's a different cast of characters, of course. john lester will start for the boston red sox against adam waynewright the two aces. weather supposedly good at fenway park boston tomorrow for the opener.
