you know immediately. if you are driving on interstate 880 the traffic is is moving well but the fog is an issue. its very foggy in oakland. a lot of times the fog is confined to the coastal cities but this time its near the bay as well. also we are looking at the commute. a little road work here. livermore and altamont pass on 580 westbound as you drive through. i want to give you a heads up you might see slow traffic surrounding some of the closures. at 4:31 let's go back to the desk. >> happening today bart service between lafayette and pleasant hill will be stopped for three hours this afternoon. ktvu brian flores is joining us now to tell us what federal investigators will be doing during that track shut down. >> reporter: its all part of that ntsb investigation in regards to the deadly bart accident that happened over the weekend. they will be spending that time recreating what happened. trying to figure out how the two workers were not able to get out of the way of the on

coming bart train. behind me you can see a reminder of how dangerous it is to work on the bart tracks. according to bart, service between the lafayette station and pleasant hill will be halted for three hours as investigators use that time to recreate exactly what happened. now this will effect riders from noon until 3:30 this afternoon. remember those charter buses, well, they will be used again as a bus bridge from lafayette to pleasant hill by busing passengers in both directions every 15 minutes. terms of the reenactment investigators will go through every single detail. including one person who will act as a lookout. >> the designation of the lookout is determined during the job briefing and a plan is also discussed on how and where to move into the clear of any on coming trains or other equipment operating on either track. >> reporter: and again the ntsb will be recreating this scene. they want to see if all safety

rules were followed. again no service as we take you back out here live from lafayette to pleasant hill. that starts from noon until 3:30. instead you will be bussed from each location and they will have buses running every 15 minutes. we'll have more on how this will effect your afternoon commute coming up on the morning show this morning. live in walnut creek brian flores ktvu channel 2 news. >> as we said bart trains are rolling again this morning but the tentative agreement that ended the strike is far from a done deal. the contract has to be ratified by bart board of directors. union leaders are going over that fine print. >> the sooner we can get everything signed off, the sooner we can get it to our members for review. >> bart workers can vote as early as tomorrow. they must approve that contract by a simple majority. barts board of directors will need five of the nine board members to approve it. ktvu learned the two bart strikes have had a major

financial impact on other tran sit agencies. but what we discovered may surprise you. that story coming up at 4:48. a judge will consider governor jerry brown's request for a 60 day cooling off period between ac transits and its unions. a worker strike would seriously disrupt public transportation and harm public safety. if the judge agrees, unions will not be able to strike. it wants to introduce day passes that would cost $5 for adults and $2.50 for youths. discounts would apply if the passes are used with clipper cards. sheriffs deputies shot a suspect they thought was armed only to find out the rifle was a replica. there is a report that the

person shot was a 13-year-old boy. >> reporter: the young person that was shot was a 13-year-old that lived in the neighborhood. so far the sheriffs deputies are not confirming that account. they say there was a 13-year- old who was shot with a replica assault weapon. investigators sent out a photo of that weapon last night. a realistic looking assault rifle that the person was carrying. that person refused to drop it after repeated orders to put it down and the two officers that were here opened fire. it happened around 3:00 yesterday afternoon. the officers were on routine patrol in the area and saw the person with what appeared to be a rifle. the officers called for backup and within minutes the person with that gun was dead. sheriffs office says immediately after the shooting the person collapsed on to the rifle and officers found a handgun as well. there are several parallel

investigations running looking into this shooting. the petaluma police and the district attorneys office are all look into the shooting. the two officers involved are on standard paided a mt.ive leave. we are waiting for more information on the shooting. including looking into accounts again that the young person involved in this was a 13-year- old who lived in this neighborhood. we are going to go exploring through the neighborhood. we are again hearing that he may have lived. for now we are live. are san bruno was the site of another deadly police shooting. ryan was killed just after 2:00 yesterday morning. police say he was driving a stolen car on is popular avenue. the officer was not hurt. happening today a san francisco city gardener charged with hitting and killing a

woman last month will appear before a judge. he is scheduled to make his first court appearance. christie was sunbathing on the grass with her dog and 11-month- old daughter. police say he hit her with his work vehicle and did not stop or render aid. his attorney argues his actions were not criminal. >> he tried to avoid hitting the dog that is why he went to the right off the path and down the grass. >> parks need to be a safe place. and this is one of the cases where none of this needed to happen. >> burnoski is behind bars on $350,000 bail. he faces felony vehicle manslaughter and hit and run charges. cal osha is taking another look at a deadly accident.

63-year-old elevator mechanic white was hit and killed by an elevator counter weight back in july. inspectors originally cleared the elevator company of any violations however new questions are being raised which has prompted the agency to examine the ed. the agency would not go into specifics. cal osha is continuing their investigation into another work related death at the stadium last week. edward lee was killed when a 30- foot long bundle of rebar fell on top of him. today investigators in san rafael plan to question a couple about a fire at a luxury home. that home is on sea view drive. it caught fire yesterday. the same day that couple was evicted. the husband and wife were not home. they found them at a resort outside of marin 14 hours later. the tenants had recently lost the court battle with the homeowners over their $10,000 a

month lease. tenants are suing their landlord over a bedbug infestation. people who live at the rose mont apartments say the bugs are rampant and bite them all the time and accuse their landlord of not doing thinking to help. they have teamed up with a tenants right group that says bedbugs have infested several concord complexes. tim lincecum is staying with the team. the former cy young award winner has agreed to a two year $35 million contract. the amount of money surprised some baseball analysts. but the giants say the 29-year- old lincecum and his no hitter in july still has a lot left to give. happening now the 49ers are practicing in england ahead of this sunday's game at london's stadium but our ktvu crew who is traveling with the team found american football is

president obama has brought in a fix it man for the troubled healthcare.gov website. jeffrey is a tomorrower ceo and management consultant who will oversee the repair of the website. seeon has been in this role before. he was brought in to fix issues with the federal for cash for clunkers website. many people are blaming health and human services secretary for the problem. some republican lawmakers are calling for her resignation. >> i think my job is to get this fully implemented and to get the website working right. and that is really what i'm focused on. i work at the pleasure of the president.

>> there are now calls from republican and democratic lawmakers to push back the march 31st deadline for people to sign up for health insurance because of the website glitches. the recent government shut down has forced the postponement of an investigative hearing into the deadly asiana plane crash. the hearing has been scheduled for november but it has been rescheduled for december. asiana flight crashed at the san francisco international airport back on july 6th. two passengers died in the crash and a third victim was killed after she was run over by a fire truck. the internal revenue service is delaying the date it will begin processing tax returns because of the 16 day government shut down. originally the irs was scheduled to be working on 2013 tax filings on january 21st but now the agency says it will not be ready until january 28th at the earliest and february 4th at the latest. the delay means taxpayers entitled to refunds will have to wait longer to receive them. the blue angels will return

to san francisco next year after missing this month's fleet week because of the federal budget cuts. the navy says the jets will perform at fleet week on october 11th and 12th of 2014. the blue angels are the center piece of the fleet week event. local businesses say they took a hit this year when people stayed home because of the blue angels cancellation. and you might think that other bay area transit agencies made a lot of money because of the bart strikes. but the opposite is true. ktvu checked with the two transit agencies. the ac transit and muni. the two strikes cost muni nearly $1 million despite a spike in ridership. >> this is a big financial hit for us. we don't benefit. we are not doing much parking enforcement. we are not doing fair

enforcement because we have all hands on deck directed to keep the traffic moving. >> it was the same story for ac transit which operated additional buses to san francisco and around the east bay. ac transit lost hundreds of thousands of dollars because the additional fairs did not cover the addition gnat costs of running more buses on overtime. a new website helps home buyers find out more than the law requires about a homes history before they enter into a deal. they were surprised to find out someone had died in a home he owned but no one told him before he bought the property. so he started the website died www.diedinamhouse.com. property values can drop if a death happened in a home. >> you are not asking did someone die in this house? that doesn't happen until you are in the house and here a creek in the night. >> california is one of just three states that require home

we are now hearing the 911 tapes from the middle school shooting in sparks, nevada. >> the teacher is down? >> yes. >> okay. >> police say a 12-year-old student opened fire just after the morning bell on monday. two students were hurt and a teacher was killed. police say the teacher put himself in front of the shooter allowing other students to run to safety. the unidentified shooter brought that gun from home and says it is possible that his parents will face charges. the shooter died after turning the gun on himself. they are large heavy pieces of equipment weighing thousands of pounds but it did not stop leave thieves from taking two caterpillar excavators. someone swiped them from a construction site on monday
