good morning. we are live here in walnut creek where the ntsb will continue their investigation into the deaths of two bart workers over the weekend. we will tell you how this will effect your afternoon commute coming up. and state safety officials are taking back their original decision that no violation occurred when a construction worker died earlier this year at the new 49ers stadium. we'll tell you about this latest development. we have new information about a deadly police shooting. it happened in santa rosa. the questions and controversy because of the age of the person who was killed. also the warriors get ready to kick off a new season. the big party plan in oakland this morning. ktvu channel 2 morning news continues.

>> good morning. you are looking live at the memorial that now sits along the fence near the bart tracks between lafayette and pleasant hill. all in remembrance of the two bart workers killed. the ntsb investigation is now under way and today the tracks will be shut down for a few hours as part of that investigation. brian flores will have more on that in a minute. good morning. it is wednesday, october 23rd i'm dave clark. >> and i'm claudine wong in for pam cook. let's get a quick look at your weather and traffic. steve has been trying to warm it up a little bit. steve, i will say the fall temperatures are nice. >> it gets warm but it cools down pretty fast. we do have a lot of fog out there. if you are by the coast, its not getting very warm. 50s for many. low cloud deck and fog equals a dense fog advisory until 11:00. there is a lot of fog. thick fog. reduced visibility.

it could be lousy to zero. very quiet here. just nothing changing. dense fog and clearing slowly to the coast. back over the bay. by friday a low will approach. i think it will just sit there and drive toward southern california. i think at best it will chew up the fog a little bit or ramp it up. 40s and 50s on the temps. really nothing every morning. these are about the same. san francisco and much of the coast. its 50s to very low 60s. we will go 63 but there are some areas i don't think we will get out of. a lot of lows to the north and south to the west. a lot of fog, sun. mild. there are freezing temperatures on the early morning lows for some. after everything is said and done 80s inland. 70s and 60s around the bay. 50s and 60s by the coast. here is sal. we are looking at a decent commute right now in many areas. its much different today but the fog as you mentioned is going to be dense and it might effect your drive to work. you might want to give yourself a little extra time there. the traffic also looks good on the golden gate bridge but its

thick fog. westbound bay bridge looks like normal. yesterday at this time it was completely full. we've been watching this commute closely for you. and right now you can only see a five minute delay. if you are driving on the concord commute. concord to walnut creek, that traffic looks pretty good. contra costa county 80 is getting a little busy as you drive into richmond. let's go back to the desk. happening today bart service between lafayette and pleasant hill will be stopped for three hours this afternoon. ktvu brian flores is joining us to tell us how today's track shut down is tied to last weekend's deadly tragedy. brian. good morning. the ntsb will continue their investigation into the two bart workers that were killed on the tracks here last weekend. a key question that needs 20 be answered is the role that speed played during that accident. of course the ntsb will be using that time today this afternoon to reeven act exactly

what happened. now in terms of the reenactment though this will have an effect on the afternoon commute for many bart riders today. again bart says service between the lafayette, pleasant hill stations will be halted for about three hours starting at noon until 3:30 as investigators use that time to again reenact what happened. bart will use a bus bridge which means they will be running buses between each location every 15 minutes for riders that need to continue on the bart line while the investigation is going on. lawrence daniels and chris shepard were killed last saturday while they were maintaining the tracks near the walnut creek station. at this point ntsb says they completed their inspection of all mechanical equipment. the train operator did honk the horn and both men received approval to do their work. this accident reenactment the will serve as to answer even more questions. a key role will be a role a look out person played while work was being done on the

tracks as well. of course these trains travel as fast as 70 miles an hour be as we take you back out here live again a reminder of just how dangerous working on the bart tracks could be. again this will have an effect on the afternoon commute today. if you are a bart rider, that does take the train between 12:30 and 3:30 this afternoon be aware between two stations they will be using bus services instead. once again we just want to remind you take a look on your screen so you have the information. there will be no bart service between lafayette and pleasant hill between noon and 3:30 today. bart has set up a bus bridge between those stations that will be operating during that time. glimpse time -- time now 6:05. they will be focusing on levi stadium because of the death of a construction worker there over the summer. inspectors cleared the company involved of any violations but that has changed.

janine de la vega is joining us live from santa clara now with these new developments. good morning, janine. >> reporter: good morning, dave. well two deaths of workers have happened here at levy stadium which is -- at levi stadium which is slated to open in 2014. cal osha has decided to look over evidence again because more questions are being raised. cal osha says 63-year-old elevator mechanic donald white was standing on the ladder when the counter weight came down and hit him on the head. the agency revealed that white was in communication with the person operating the elevator and was aware the elevator was running but unclear why he didn't move if he knew the elevator was coming toward him. cal osha is also investigating another work related death that happened at the stadium last week. 61-year-old truck driver edward lake was killed when a bundle

of rebar fell on top of him. investigators are still trying to determine whether or not to issue citations. cal osha can fine a company anywhere from $5,000 to $70,000. just depending on if they determine that violation was a general violation, if it was serious, or if it was willful. reporting live from santa clara janine de la vega ktvu channel 2 news. we have new information about a deadly police shooting that happened in santa rosa. the press democrat reporting that sheriffs deputies shot and killed a 13-year-old boy because he allegedly was carrying a replica of a rifle. deputies on patrol yesterday said they saw someone holding a weapon. they told him to drop the weapon but they opened fire and hit that person several times. they went up to him and handcuffed him before giving first aid but the victim eventually died at the scene.

deputies say they found this replica rifle near that person's body. the person also had a plastic hand gun in his westbound. a it is already illegal in california to buy, sell, or carry high capacity magazines under a law that took effect 13 years ago. but that ban does not apply to magazines bought before the law went into effect. anyone in san francisco that has one that can hold more san jose police are asking for your help to find a missing man. he is about 5'6" tall, 150 pounds with gray hair and brown eyes. you see his picture there. when he went missing he was wearing a multicolored shirt,

white pants and black shoes. police say he drove off in a gray 2009 honda sonata. he suffers from high blood pressure and does not have any medication with him. there is an investigation in lodi about the cause of a crash that killed five people last night including a pregnant woman and a young child. the crash occurred near a middle school. it involved two trucks, two suvs, and a mini van. witnesses say the impact sounded like an explosion. the crash involved a driver on a cell phone speeding straight through an intersection. officials add that at least 12 other people were hurt. almost two dozen colleges around the bay area say they will admit students from city college of san francisco if it loses its accreditation. city college as about 80,000 full and part time students.

welcome back. time now 6:13. police in roseville arrested a cal fire battalion chief on fire charges. ronald ray wright is stationed in the auburn area. he is accused of selling or transporting methamphetamine. reportedly he was caught in a sting operation. forral charges vice president been filed yet but -- formal charges haven't been filed yet. president obama meets with the prime minister of pakistan. he is trying to rebuild a rocky relationship with pakistan. there is resentment in pac stap over the -- pakistan over the secret mission. the boston marathon bombing suspect that was killed in a shootout with police is also accused of taking part in an earlier triple homicide.

tamerlan tsarnaev was named in the killing of three people in massachusetts. the information came from a friend of tsarnaev when he was being questioned by the fbi. lawyers in colorado movie theater shooting -- police did not have a search warrant before sending a bomb squad robot into the booby trapped apartment. time now 6:15. we now know how a federal criminal investigator from oakland sandra coke was killed earlier this year. alameda county medical examiner says 50-year-old sandra coke was strangled. her body was found in august. her former boyfriend randy alana was arrested but pleaded not guilty.

he says he and coke rescind led their -- rekindled their relationship when he got out of prison last year. today marks three years since the death of psychiatric technician donna gross. you are looking at video from last year's memorial. her death led to new laws and new alarm systems at state hospitals. the parent who killed gross is serving a sentence of 25 years to life. a plan to put more police officers on the streets of san jose has ignited a controversy. san jose is dealing with the number of dwindling number of police officers. so the city started reaching out to retired police officers. they wanted to hire those retirees to conduct background checks. the purpose was to allow the city to keep more active officers on the streets. >> that will make it more

difficult for us to do backgrounds on the new recruits. it may slow down the recruiting. some retirees have expressed interest but no one has been hired yet. warning to people driving in san francisco. this week the city is installing a traffic camera at what is rated to the be most dangerous intersection in the city for pedestrians and cyclists. officials want to crack down on drivers making an illegal right turn. there were 56 documented crashes there between 2005 and 2011. time is 6:17. security will be a lot tighter at utah state capitol building after a man drove am truck right up to the front door. tried to break down the doors of the supreme court chambers. look at this video. 36-year-old gerald green drove that truck up three frights of stairs. he parked it right under the governors office. he made it into the building and on to the third floor before officers captured him.

they say they found him trying to kick in the 100-year-old doors of the supreme court chambers. >> he made the comment this is his house and he had the right to be here. >> they tried to subdue him with a taser. when that didn't work they tackled him. they are considering putting large iron posts or a concrete wall to block cars from getting so close to the state capitol building. 6:17. let's head out to sal castaneda who is watching the roads for us. hi sal. >> hello claudine and dave. i think we've had a pretty decent commute. especially if you compare it to yesterday which was the worst day of the commute week so far. right now it doesn't look all that bad. we will look at the commute in the east bay but the fog is going to be one of the things you have to watch out for. and the fog is pretty low here in oakland. and it might factor in your commute. which is somewhat unusual. its unusual for this time of

the year. we will ask him that question. as you look at westbound bay bridge its not too foggy here. traffic is backed up for a 15- 20 minute delay. we've been looking at interstate 80 westbound. its getting slow out of hurricane lease -- hercules. so steve. it is a little unusual for this late in the season. this time of year if we get rain we get radiation fog. high pressure is built right on top of it so it smashes it right down on the deck. forecast will be the same as it was the last two days. if you are by the coast, cool. if you are inland, it will be warm. i need you to listen here. put on your thinking cap briefly. san francisco rainfall calendar jeer january to october. the rain year is july to june. the calendar year san francisco has picked up 3.94 inches of rain. that is it. the driest stretch was 1976 for

those that are here. it was a very, very dry year. the driest calendar. the same stretch of ten months we had 5 5.72. so we're at a deficit of 1.78. we have a long way to go. all i'm saying its very dry for ten months. too dry. let's hope things change in november. we do have a lot of fog which has prompted a dense fog advisory out in marin county until 11:00. there are some areas i'm seeing fog and reduced visibility. there is a lot to go around. the fog and low clouds will be slow to peel back. dense fog here. a low will approach by friday. it will not make much of an impact inland. we will not get any rain out of it. 74 for san jose today. a lot of low clouds up and down

the coast. keeping conditions really good. everyone says it will stop and slide toward southern california. there is another low down there that is producing higher clouds but no rain. we got a lot going on in the form of snow in ohio back in indiana. very cold. unseasonally cool for much of the great lakes and the northeast. that is where all the active weather is. we are very quiet here. expect for this fog. 40s and 50s on the temps. otherwise it very quiet. fog, sun, cool. livermore is in that category. and so is clear lake. 50s and 60s coast and bay. and then 70s to 80s inland. vacaville 84. pittsburgh in there. concord, pleasant hill. there is livermore 85. oakland and berkeley all between 64 and 68. low 80s. morgan hill and gilroy. free hasn't 72. santa cruz 68 that is one of

the warmest. 70s on the peninsula or 60s around san bruno. i don't really see any change inland. maybe some fog gets chewed up but a few high clouds by the weekend. this morning more than 210,000 motorcycles are being recalled. suzuki is concerned about the motorcycles because their front brakes may not work properly. the recall effects three models of gsx bikes they were built between 2004 and this year. suzuki blames a reduction of fluid to the brakes. for the first time in a decade amazon is raising how much you have to spend to qualify for free shipping. starting now shoppers must buy at least $35 worth of items to avoid shipping costs. it used to be $25. amazon isn't saying why its making the change 3:industry analysts say it could be to

in just about 30 minutes the royal baby prince george is going to be chrisened in st. james palace. ironically this is the same church where a wake for princess diana and conformation for kate middleton was held. this will mark the first time in 100 years that four generations of the royals are photographed together. that photo of the queen, prince charles, prince william and prince george will be relesioned later today. apple surprised a lot of people when it revealed the newest ipads. experts expected a lighter full

sized ipad and a few retina display. it will sell for $400. that is $70 more than before. apple also announced new software and upgrades will be free. which analysts say that is a way to compete with microsoft surface tablets. apple also resenior high schooled the new maverick operating system could make it harder for the government to read intercepted account systems. few apple has set address book updates for those counties to only be sent incrypted. san francisco giants pitcher tim lincecum is staying with the team. the former cy young award winner has agreed to a two year $35 million contract. now the amount of money surprised some baseball analysts who point to his below 500 record last season but the

50s. i don't expect these to change. san rafael is 45. san francisco at 49. we will go for a high of 63 degrees. its upper 50s or low 60s until things change and they will not change any time soon for us. a lot of fog out there. visibility could be this far. cool coast. half-moon bay was only 55 yesterday. livermore will be 85. 50s and 60s by the beaches. here is sal. steve, good morning. we are much different than we were yesterday. the fog might play a role but right now we are doing pretty well when it comes to the commute. now there is slow traffic. it will be slow here at the toll plaza. it is better than it was yesterday now that bart is offering regular commute service. you can see the traffic will be okay on interstate 880 as you drive up past the oakland coliseum. i want to mention 580 eastbound and westbound the traffic looks

pretty good. there are no problems on 238 or 880. 880 is already getting slow heading south. i also want to mention in the noncommute direction eastbound highway 4 near the exit there is a car on its side. so participate its not causing a big trouble. bart as i mentioned back on regular service. cal train and muni no regular delays. confusion over a replica gun may have cost a santa rosa boy his life. sheriffs deputies shot and killed a 13-year-old boy yesterday. christien kafton has been working this story all morning. and a clear look at where all of this happened. >> reporter: we have a closer look at where this happened. the incident unfolded here. take a look to the left of that evidence markers where shell casings appear to have landed.

the person shot here was a 13- year-old boy who lived in the neighborhood. and now we are getting our first indications about what kind of kid this boy might have been. investigators did e-mail us a photo of the replica weapon last night. a realistic looking ak47 style assault weapon. they say the person carrying it refused to drop it after repeated orders to put it down. investigators say it all happened around 3:00 yesterday afternoon. they say officers were on routine patrol in the area. saw the person with what appeared to be a gun and called for backup. the deputies repeatedly orders person to put that gun down and when he refused they opened fire. he was pronounced dead at the scene. workers say the boy involved stopped in frequently and was a good kid. >> good kid. he always paid and if he didn't have a dollar to spare, we

would spare him a dollar. but he would come back and give you the dollar back. real nice kid. >> reporter: there are several parallel investigations running looking into this shooting. the sonoma police and the direct attorney office is look into the shooting. two officers involved are on standard paid administrative leave. we are still waiting for a call back from either the santa rosa police department or the sonoma county sheriffs deputies to go over more details about this case including confirms the identity of that 13-year-old victim. live in santa rosa christien kafton ktvu channel 2 news. the labor dispute that led to the latest bart strike is moving on to its next phase. the tentative agreement is far from a done deal. the deal must still be ratified by barts board of directors and there are reports that bart directors are split over the agreement. the tentative agreement will go

before bart's unions rank and file members and those members could begin voting as early as tomorrow. the union workers must approve that contract by a simple majority to seal the deal. and you may think other bay area transit agencies made a lot of money during the two bart strikes this year, but we have learned the exact opposite is true. ktvu checked with the two agencies most effected by the bart strikes. ac transit and muni. despite a spike in ridership. among other things the addition natis fairs did not cover fairs. two bart strikes in one year has state lawmakers calling for a ban on transit strikes. . they point out transit workers are not allowed to strike in new york and other major u.s. cities. transit workers who can't strike can find other ways to cause trouble.

that would mean repeated demand of maintenance checks. a deadly tragedy on the bart tracks will have an impact on the service. brian flores will have that story at 6:45. time now 6:36. two men have died during the building of levi stadium. and now there is new questions about the first dead deadly accident there. ktvu janine de la vega is joining us live. she is in santa clara now to tell us what investigators are doing now. janine. >> reporter: yeah. i also want to mention too that construction workers just started arriving here at levi stadium in the last half hour. many of them hadn't heard the state was reopening sort of this investigation to exam what happened to -- to examine what happened to one of their coworkers. questions have been raised and workers still have questions too. cal osha says 63-year-old elevator mechanic donald white was standing on the elevator when the counterweight came down and hit him on the head.

white was in communication with the person operating the elevator and aware the elevator was running but its unclear why he didn't move. cal osha has rescinded its decision that white's employer didn't commit any violations that may have contributed to his death. this morning some of the construction workers said they felt it was a good thing the incident is being probed more. they say it could help them in the future. >> we are making improvements and double checking everything. definitely applying more. >> reporter: cal osha is also investigating another work related death that happened at the stadium next week. cal osha has until december 11th to december whether

schindler elevator committed any violations or if a fine should be imposed. reporting live from santa clara janine de la vega. an employee with the san francisco recreation and parks department due in court with charges he ran over and killed a woman while he was on the job last month. san francisco city gardener thomas burr burnoski is accused of running over christie while she was sunbathing in the grass. he hit her with his work vehicle and didn't stop to help her. now his lawyer says burnoski is devastated of what happened but that his actions were not criminal. a judge will consider governor jerry brown's request for a 60 day cooling off period. a organizer strike would seriously disrupt public transportation and harm public safety. if a judge agrees unions won't be able to strike. the hearing is set for 9:00 in

oakland. meanwhile ac transit is holding public hearings on the bus fair. it wants to introduce day passes that will cost $5 for dulls and $2.50 for youth and seniors. the hearings are at 2:00 and 5:00. investigators in san rafael began to question a man and a woman about a fire yesterday morning at a luxury home. that home on sea view drive caught fire early yesterday morning. the very same day the couple was evicted. now the husband and wife were not at home at the time. the sheriffs department said they found them at a resort outside of marin 14 hours later. according to the marin independent journal, the tenants recently lost a court battle with a homeowner over a $10,000 a month lease. mysterious outbreak sickens

happening today bart service between lafayette and pleasant hill will be stopped for three hours this afternoon. ktvu brian flores is joining us now to tell us what federal investigators will be doing during that track shut down. brian. >> reporter: yeah claudine, this will be part of the continuation of the ntsb investigation on how a bart employee and a contractor were killed on the tracks last weekend. very close here in walnut creek. and this will have an impact on the afternoon commute. now if you are bart rider this morning, you should know that bart says service between the lafayette and pleasant hill stations will be halted for 3.5 hours during this investigation. bart will make a bus bridge which means they will be running buses between each locations every 15 minutes for

riders that need to continue on the line while that investigation is going on. now they will be spending today reenacting exactly what happened. in the meantime lawrence daniels and chris shepard were killed last weekend while they were maintaining the tracks. at this point the ntsb says they completed the inspection of all mechanical equipment. everything was working fine. investigators say the train operator did honk the horn and both men received approval to do their work. but this accident reenactment taking place this afternoon will hopefully answer more questions. a key factor in this investigation will be the role of a look out person for any incoming danger like the bart train and that lookout person is required while work is being done on the tracks. >> the designation of the lookout is determined during the job briefing and a plan is also discussed on how and where to move into the clear of any on coming trips or other equipment operated on either track in either direction at any time.

>> reporter: now trains can fly by here at 70 miles an hour at some locations but the tragedy could also lead to new rules requiring bart trains to slow down to 25 miles an hour through any section where crews are believed to be working. that is according to the san francisco chronicle. they are also reporting trains will be manually driven past work sites as well. we tried contacting bart on that. we have not heard back on whether that is being considered. again if you are a bart rider this morning i want to repeat this once again two stations will be closed today between 12:30 and 3:30. those being the lafayette station and the pleasant hill and walnut creek station while the ntsb investigation will be going on today. and they will be using bus service to bus people between the stations this afternoon. brian flores ktvu channel 2 morning news. we are hearing the 911 tapes from the middle school shooting in sparks, nevada. >> someone brought a gun to school and shot the teacher. >> the teacher is down?

>> yes. >> police say a 12-year-old student opened fire just after the morning bell on monday. two students were hurt and the teacher was killed. the teacher put himself in front of the shooter allowing other students to run to safety and say the unidentified shooter brought the gun from home. they also say its possible his parents will face charges. the shooter died after turning the gun on himself. time is 6:47. president obama has brought in an expert now to fix the troubled website healthcare.gov. he is jeffrey syenites. syenites. he has been in this role before. many are blaming kathleen for the problems with the

people were uncertain if the trains were running. indeed some were. but it wasn't quite the same. this morning we have a look at highway 24 as it should be really on a normal 6:48 commute on a wednesday here. traffic looks good. it is getting a little crowded as you head up to the tunnel. there are no major problems by the way at the bay bridge toll plaza. there is a brief delay. its about a ten minute delay here. on 580 westbound we have slow traffic coming in from the altamont pass. and it slows again approaching dublin. once you get over the hill it looks good into castro valley. as we look the traffic in hayward is getting slow heading southbound on 880 and no problems really on the peninsula. remember bart is running full service today. at least for the morning commute. there will be an interruption later in the afternoon for some stations. cal train and muni no delays. we'll tell you about that intersection coming up in a bit. now let's go to steve. thank you. a lot to get to. let's go it right away.

weather today the same as yesterday. taking a look at the calendar year for rain. january to act. the rain year is july to june. how much rain have we had in ten months in san francisco if a whopping total of 3.94. ridiculously small and dry. the driest was 1976 for those that were here then and born then. 5.72 that is the driest calendar year. we are an inch and three quarters behind the driest year. there is no sign of rain in october. dense fog advisory 11:00. but that is in the forth bay. there -- north bay. there are a couple reports coming in visibility about 300 feet. which is better than yesterday but its still thick.

temperatures about the same as yesterday. if you are inland they are very warm. 40s, 42. monterey 48 degrees. this low will approach the coast. it may chew up the fog it will probably enhance it. there is a little low if you are heading down to southern california. if high clouds also deal with fog. all the active weather. we need to break down in the great lakes and northeast. we had hurricane rain and now its tropical storm rain. winds 65 miles an hour. it is beginning to drift out in the pacific away from acapulco so things will be much better for tomorrow. 40s and 50s on the temps here. its cold for some. you can see some of that cloud cover in southern california. some of that may spin up and around. otherwise we have dense morning fog. fog advisories. clearing slowly to the coast. this low will approach. i don't think there will be much to it. everything says its on its way to southern california. fog, sun. cold for some.

its what we did expect this morning. dow is down about 66 points. no more rally. it appears there is mixed numbers coming in from corporations. caterpillar leading the dow jones lower after missing

analysts estimates for both earnings and revenues and its apparently not alone. that is causing some downward trend on the markets this morning. there is a report this morning that several buyout firms are interested in taking over all or part of safeway. safeway is valued at more than $8 billion. making it the second largest grocery chain in the country. there have been indications that the company would be willing to listen to offers and experts say if a deal does go through, it could be one of the biggest leverage buyouts since the financial crisis. san jose police want your help. they are trying to find a missing 82-year-old man. his name is edward teo. he was last seen yesterday evening at his home. he is 5'6" tall, 150 pounds. gray hair and brown eyes. he was wearing a multicolored shirt and white pants and black shoes and he was driving a gray 2009 honda sonata.

he has high blood pressure and doesn't have any medication with him at the time. federal officials are investigating a mysterious outbreak of illnesses effecting pets and it involves jerky treats. the food and drug administration issued a consumer alert. they say you should be aware of the possible problems with those treats. since 2007, the fda received reports of more than 3600 dogs and ten cats getting sick after eating chicken, duck, and sweet potato jerky treats. of those cases, 580 of those pets have died. >> some of the first signs could be drinking more water or urinating more frequently. as that begins to advance, you might see weight loss, changes in appetite. >> now the fda didn't identify any specific brands but said those that are being investigated are made in china. and that the tests have not revealed a source for that illness. authorities in the east bay are investigating how two

yellow excavators weighing several pounds each were stolen from a work site. construction theft is a growing problem industry wide. >> we're seeing a huge increase in equipment, tools, anything that we use to construct a project. its being stolen. they are moving it across the border as quickly as they can. >> the missing excavators are the 307 and 308 models. they have green striping and yellow logos. coming up for you there was a deadly police shooting in santa rosa. the questions and controversy mainly because of the age of the person who was killed. and the bart strike is over but the bart board could be making many commuters uneasy.
