getting re-examined. hear what construction workers are saying this morning about this new probe. well, the b.a.r.t. strike may be over but the labor dispute is still simmering. the new signs the deal is far from over. a push for change after the death of a patient at san francisco general. why some hospitals are looking at cutting back on alarm systems. "mornings on 2" starts now. well, welcome to "mornings on 2." you are looking at a live picture from santa rosa, where an investigation continues into a deadly police shooting. the suspect reportedly was carrying a replica rifle when he was shot. but the age of the suspect is what's raising some concern this morning. details on that -- coming up in a live report. good morning. welcome, once again, to "mornings on 2." i'm tori campbell. >> i'm dave clark. let's check your weather and traffic. steve, fog still a problem?

>> dense fog advisory until 11:00. the fog goes to san jose, santa rosa. very warm air aloft. just heard from chloe up in clearlake, 88 up there. very warm air. thick fog, reduced visibility. that fog is capped. fog or sun again. cool, cold, to mild to warm to very warm. let's face it. 88 this time of year is very warm. there's no offshore breeze. if there was, we wouldn't have any fog. this week there's a hint of an onshore. 50s, 60s by the coast. 40s on the temperatures. if you are in the 40s and in the fog, it's cold, cold, cold. it will take a while for some of that fog to peel back from the bay. 63 in san francisco today after yesterday's 63. it's 49 right now. so cool, coast, warm inland. temperatures a big spread. last week there was hardly any difference. here's sal. good morning. we are looking at traffic that is doing pretty well in many areas but not so well in

others. it's back to the normal commute here at the bay bridge toll plaza and you can see it is backed up. it's backed up for about a 20- minute delay. not a huge delay but certainly not light traffic but at the very least, it's better than it has been the last few days when we had the uncertainty and didn't have any service. you know the rest of the service is okay. fog is a problem for some of these commutes. if you haven't looked outside, it will be pretty foggy. you may want to allow yourself extra time. we're looking at the south bay here. northbound 101 is busy near capitol expressway. 280 is slow near 17. nothing unusual here. it's just the normal commute. northbound 101 is slow getting into the sunnyvale area. no trouble in the santa cruz mountains. now let's go back to the desk. >> thank you, sal. our top story this morning -- a replica rifle reportedly led to the death of a boy in santa rosa.

the press democrat reports sonoma county sheriff's deputies shot and killed a 13- year-old playing with a toy gun. ktvu's christien kafton is at the scene of the shooting to give us details on exactly what happened. >> reporter: yeah, this whole incident unfolded here near moreland and west robles avenue in santa rosa. take a look on the ground. you can see the spray painted outline of where the sheriff's cruiser was stopped and what appeared to be markings where evidence landed yesterday, possibly shell casings from that officer-involved shooting here. the press democrat, again, reporting that the person shot here was a 13-year-old boy who lived in the neighborhood and now we're getting word from the neighborhood about the boy in question. now, investigators say it all happened at about 3:00 yesterday afternoon. they say the officers were on routine patrol, saw a person with what appeared to be a gun and called for backup. the sheriff's office say they repeatedly ordered to put down

the gun. when he refused, they opened fire and collapsed. it was a replica rifle and officers found a replica handgun tucked into his waistband as well. he was pronounced dead at the scene. workers at a nearby shop say the boy stopped in frequently and say he was a good kid. >> i've been here a year now. for the whole year i've seen him come in here and seen him, you know, smile, be happy, be polite. thank you, goodbye. have a good day. it's just tragic. >> reporter: now, investigators did e-mail us a photo of that replica weapon last night. it's a very realistic-looking ak-47-style assault weapon. they say that, again, the person carrying it refused to drop it at the time. so they opened fire, fearing for their safety. now, again, we to have calls out to santa rosa police, petaluma police and the sonoma county district attorney's

office. all three agencies are investigating this shooting. the two officers who were involved are on paid administrative leave. now, we do have calls out to the agencies trying to find out more about the shooting and trying to confirm the identity of the young victim. for now we're live in santa rosa, christien kafton, ktvu channel 2 news. >> thank you. besides santa rosa, there were two other officer-involved shootings yesterday. in san bruno, police say a 25- year-old man in a stolen car refused to stop and drove towards an officer who shot and killed him. and in union city last night, police say they shot a wanted parolee who came at them with a pipe. 7:06. state safety inspectors are investigating the death of a construction worker this summer at levi stadium, the future home of the 49ers in santa clara. inspectors at first cleared the company involved of any violations but apparently that's changed. ktvu's janine de la vega, live in santa clara now to tell us about this new information.

janine? >> reporter: dave, cal/osha says more questions were being raised as to how a worker died here at the new levi stadium in june. construction workers who are arriving here now are interested in finding out what state safety officials uncover. cal/osha is re-examining what happened to 63-year-old elevator mechanic, donald white. officials say he was standing on a ladder in the elevator shaft when the counter weight came down and hit him on the head. he was in communication with the person operating the elevator and was aware the elevator was functioning but it's unclear why he didn't move if he knew the elevator was coming towards him. cal/osha has rescinded the decision that white's employer didn't commit any violations that may have contributed to his death. construction workers arriving to levi stadium this morning say the investigation could improve worker safety in the industry overall. >> i think a longer

investigation is needed because it came in so quick and said what they thought happened and a lot of people want to know if it was a -- if it was himself that did it or if it was someone else that hurt him. >> reporter: cal/osha is also investigating another work- related death that happened at the stadium last week. 61-year-old truck driver edward lake was killed when a bundle of rebar fell on top of him. inspectors are still trying to determine whether or not to issue citations. now, in the earlier case involving the vateer company, cal/osha has until december 11th to determine whether violations were committed. janine de la vega, ktvu channel 2 news. new information about the next phase of the b.a.r.t. labor dispute. the tentative agreement that ended the strike monday night, it's still far from a done deal. it still has to be ratified by b.a.r.t.'s board of directors. today's chronicle reports the board is split whether to

approve the deal. some board members reportedly think b.a.r.t. gave away too much to reach a deal with the unions. five of the nine board members have to approve the deal. the tentative agreement has to go before the rank and file union meles. they -- members. they could start voting as early as tomorrow. facebook has gone back and forth but the menlo park company has finally decided to pull a gruesome video of a beheading. this follows worldwide outrage over the earlier decision to lift the ban on gory images and footages. the social networking site said it did not reverse or changes policies as a result of the controversy but it says this particular video glorified violence. now, last night, facebook issued this statement explaining its overall position on violent videos "if it's being shared for sadistic pleasure or to celebrate

violence, facebook removes it." there is an investigation in lodi about the cause of a deadly crash last night that killed five people including a pregnant woman and a child. it involved two trucks near a middle school, two suvs and a minivan. witnesses say it sounded like an explosion. they say the crash involved a driver who was on a cell phone speeding through an intersection. officials also add at least 12 people were hurt. federal regulators now considering a formal investigation of a fire involving one of tesla's sedans. now, video of that fire on a washington state highway went viral. tesla says the model s sedan's battery caught fire after the car collided with a large metallic object on the road. the ntsb says it didn't investigate this when it happened because most of its workers were furloughed during the government shutdown.

two dozen colleges across the bay area say they will admit students from city college of san francisco if that school loses its accreditation. city college says about 80,000 full and part-time students attend. they will help with chabot, college of alameda and de anza college. 7:10. a public meeting is scheduled for 6:00 tonight in san francisco. it will focus on a pilot project to protect bicyclists. now, officials want to increase safety for both cyclists and pedestrians on folsom between 4th and 11th street. back in august, a truck kibbled 24-year-old almalay muloloc, who was riding her back in the -- bike in the area. at first police say it was her fault but surveillance video shows now the truck caused the crash. the meeting starts at 6:00 at the south of the market recreation center on 6th

buckingham palace. they chose st. james because that's where a wake was held for princess diana. there will be a smaller gathering than usual. only 22 invited bests. instead of choosing royals for the god parents they chose mainly close friends. back in this country, the boston marathon bombing suspect killed in a shootout with police is now also accused of taking part in an earlier triple homicide. new court documents say tamerlan tsarnaev was named in a participant in the killing of three people in 2011. the information came from a friend of tsarnaev killed by an fbi agent in may while being questioned. the fbi says he lunged at the agent with a knife. lawyers in colorado for accused killer james holmes say the search of his apartment after last year's movie theater shooting rampage was not legal. they say the police did not get a search warrant before they sent in a bomb squad robot into

that boby-trapped apartment. now they want a judge to throw out the evidence sized by police. more court arguments are set for today. it is 7:16. an unusual trial starts in detroit this morning. a judge will determine if the largest public bankruptcy in u.s. history can go forward. unions are claiming the city failed to negotiate in good faith before filing for chapter 9 protection in july. detroit is at least 18 billion in debt. but a city is not eligible for a bankruptcy makeover unless it proves it met several critical steps. san jose mayor chuck reed is heading to the east coast to push for pension reform. tomorrow, reed is the keynote speaker at a conference on pensions in new york city. he's also scheduled to travel to washington, d.c. and meet with federal officials about pension reform. last week, reed and five other california mayors filed papers to get a pension reform

initiative on the november 2014 state ballot. 7:17. the baltimore ravens football team reportedly is being paid $130,000 in tax payer money to promote obamacare. the public watchdog group judicial watch says the state of maryland made that deal with the super bowl champions to encourage people to sign up for the president's affordable care act. this comes after the national football league decided not to promote the president's healthcare law. 7:18. some apartment tenants in concord are suing their landlord today over a bed bul infestation. tenants at the rosemont apartments say the bedbugs are everywhere and say the landlord is not doing anything about it. they've now teamed up with a tenants' rights group that says bedbugs have infested several concord complexes. 7:18. let's get you out the door. sal, how is 880 doing? >> well, it's okay.

fire investigators in redwood city say last week's six-alarm fire at the terrace apartments started in the kitchen of a fourth-floor unit. the fire marshal says it's possible someone was cooking and not paying close enough attention to a pot on the stove. four people were hurt and more than 70 people lost their homes

in that fire. police in roseville near sacramento say they've arrested a calfire battalion chief on drug charges. firefighter ronald ray wright is accused of selling or transporting methamphetamine. he was reportedly caught in an undercover drug sting. formal charges have not been filed but he could face a felony. he's stationed in auburn and is currently on leave. 7:24. apple unveiled a new approach to pricing its products when it showed sof the newest -- off the newest ipad. most tech experts thought apple would hold steady on prices despite the upgrades. instead, apple raised the price of the mini by $70 and new software and upgrades are gonna be free. analysts say that's a way to compete with microsoft's surface tablets. apple revealed the new mavericks operation system would make it harder for the government to read intercepted

account information. on the old system, account system preferences were unencrypted and could be intercepted when they were in between services like google and yahoo!, and now they are only encrypted. a fan favorite will remain with the san francisco giants. tim lincecum has agreed to a two-year recollection $35 million contract. the amount of money surprised many baseball analysts who point to lincecum alosing word -- lincecum's losing record. but the no-hitter in july is proof that the 29-year-old still has a lot left to contribute to the team, they say, and is still a big draw for the fans. neither the giants and the as are in the world series, but they are still linked to the

we'll tell you about that -- coming up in a live report. welcome to "mornings on 2," once again. i'm tori campbell. >> i'm dave clark. we're gonna talk about your weather and traffic. >> a very good morning. a very good foggy morning. not for everybody but a lot. if it's there, it's really thick. some locations on the cool side already. 87 livermore yesterday. 88 up in clearlake. that warm air is squashing the fog. no breeze whatsoever. what is there is kind of a puff of a westerly. so fog or sun today. that fog takes a while to burn back as everybody knows. if we had a northeast breeze, the coast would be clear. that was the case last week. that's not the case this week. there's a lot of fog. 50s and 60s on the high side for those near the beaches and bay. inland, we start off with 40s but end up with 80s. san francisco has dipped to 48. 48 cloudy to mostly cloudy. i'll still go 63 today. there's plenty going on north of us, south of us and west of us. none of it will make an impact

here. cold if you are in the fog. warm, inland to very warm. in fact, when clearlake hits 88 that's warm. today, 85 in livermore. oakland, 58. 57 pacifica. here's sal. traffic is doing pretty well around the bay area in some -- in comparison to other days this week. but we have a new crash on southbound 101 as you drive down to popular avenue -- poplar avenue. the alternate route would be 280 instead. with the b.a.r.t. service being back in full operation we've definitely noticed an improvement but there's still a back up at the bay bridge toll plaza. it's 10, 15-minutes delayed right now. if you are looking at the commute in san jose, northbound 280 is slowing down from about downtown san jose to cupertino. now let's go back to the desk. >> all right, sal. happening today -- b.a.r.t. service between la fayette and

pleasant hill is gonna be halted for three hours this afternoon. ktvu's brian flores here now to tell us how today's track shutdown is tried to last weekend's deadly tragedy. brian? >> reporter: yeah, dave. this is a key part of the investigation by the ntsb on how a b.a.r.t. employee and contractor were killed while they were maintaining the tracks last saturday. but if you are a b.a.r.t. commuter or if you plan on taking b.a.r.t. the early part of the afternoon, urneed to know of a service interruption while the ntsb uses that time to re-enact exactly what happened. b.a.r.t. says between the la fayette, walnut creek and pleasant hill stations, service will be halted for three and a half hours beginning at noon today going on until 3:30 this afternoon. during the re-enactment portion of the investigation. again, if you plan to commute, b.a.r.t. will make a bus bridge which means that they will be unking buses at each of the locations every 15 minutes for riders who need to continue on the line

while the investigation is going on. 66-year-old lawrence daniels and 58-year-old chris shepherd were killed last weekend while they were inspecting the tracks north of the station. they were hit by a northbound train saturday afternoon. at this point, the ntsb says they completed their investigation of all of the mechanical equipment. everything was working fine. investigators say the train operator honked the horn. both men received approval to do their work. but this accident re-enactment will serve to answer more questions. a key factor will be speed. as we know trains can fly by at certain locations. sometimes 70 miles an hour. but the tragedy from what we understand could lead to new rules requiring b.a.r.t. trains to slow down to 25 miles an hour through any section where crews are believed to be working. that's according to the san francisco chronicle this morning. they are reporting also that trains would be manually driven past work sites. it's unclear if that's being considered or was considered

during the b.a.r.t. contract strikes or if that is being considered moving forward. in the meantime, if you are a b.a.r.t. commuter from 12:30 to 3:30, there will be a brief b.a.r.t. service interrupttion while they re-enact this scene from la fayette, walnut creek and pleasant hill stations this afternoon. we're live in walnut creek, brian flores, ktvu channel 2 news. >> thank you, brian. 7:34. happening today -- san francisco's city gardner thomas ber -- gardener thomas bernowski is expected to make his first court appearance after killing a woman. police say the man did not stop or render aid but his attorney says his actions were not criminal. >> he felt a bump. he looked back and he saw a dog scarpering away and -- scampering away.

and thought maybe he didn't hit anything. >> we believe he was extremely reckless. >> he's behind bars on $350,000 bail. he faces felony manslaughter and offcamera the woman's husband says he thinks the charges are just but has been more focused on the loss of his wife and raising their baby girl. san jose police are trying to find a missing man. we're talking about 82-year-old edward sentayia last seen on his home yesterday. he's about 5'6", 150 pounds, gray hair, brown eyes. he was wearing a multi-colored shirt, white pants and black shoes. police say he was driving a gray, 2009 hyundai. he has high blood pressure and has no medication with him.

7:36. it's called alarm fatigue and it's definitely sounding an alarm at hospitals nationwide. claudine wong is in the studio to explain the term and the life-and-death consequences. >> there have been a lot of the questions surrounding the death of lynne spalding whose body was found in the stairwell of san francisco general hospital weeks after she went missing and days after she died. now one report says something called alarm fatigue may be partly to blame. she was found in a stairwell on the fourth floor of the hospital. that door had an alarm. there's questions about why the alarm didn't bring more attention. according to the chronicle, hospital workers say alarm fatigue may be to blame and administrators are calling this a nationwide problem. it comes in a workplace with a lot of alarms and monitors constantly going off. the problems come when workers get desensitized and tune them out.

between january and june of 2012, alarm-related problems led to 80 patient deaths and 13 severe injuries. the commission says the numbers likely represent less than 10% of incidents. the chronicle also says the study that analyzed 7,000 potentially critical heart rhythm alarms that went off in one month, 87% of those were false. one patient actually set off the 1100 alarms a day. most were false but three were for life-threatening events. the message to researchers is there has to be a balance. ucsf researchers say alerts have to monitor potential problems but the industry must also find a way to make sure the alarms are clinicallily important. so when an alarm sounds, doctors and nurses will know they are meaningful. >> thank you. a memorial is planned for a napa state hospital employee killed by a patient. today marks three years since the death of psychiatric

technician donna gross. this is video from last year's memorial. gross's death led to new laws and new alarm systems at state hospitals. the patient who killed gross is serving a sentence of 25 years to life. 7:38. this morning, a judge will consider governor brown's request for a 60-day cooling off period between a.c. transit and its unions. now, yesterday an advisory board found a worker strike would seriously disrupt public transportation and also hurt public safety. if the judge agrees with that, unions won't be able to go on strike. that hearing is set for 9:00 in oakland. meantime, a.c. transit is holding public hearings on its new bus fare proposal today. they want to introduce day passes that would cost $5 for adults, $2.50 for young people, for seniors and for the disabled. now, discounts would apply if the passes are used with clippard cards. the hearings are at 2:00 and 5:00 at a.c.

transit's offices at 1600 franklin street in oakland. 7:39. you might think other bay area transit agencies made a lot of money during the two b.a.r.t. strikes this year. but we've learned the exact opposite is true. ktvu checked with the two transit agencies most affected by the b.a.r.t. strikes. a.c. transit and muni. the two strikes cost muni nearly a million dollars and they cost a.c. transit hundreds of thousands of dollars despite a big spike in ridership. among other things, the additional fares did not cover the additional costs of running more buses on time. two b.a.r.t. strikes in one year has some state lawmakers calling for a ban on transit strikes in california. they point out that transit workers are not allowed to walk off the job in new york and other major u.s. cities. however, labor experts tell the chronicle that transit workers who cannot strike can still find other ways to cause trouble. that would include demanding repeated maintenance checks on their buses or trains as a way

led to the death of a boy in santa rosa. the press democrat reports sonoma county sheriff deputies shot and killed a 13-year-old boy playing with a toy gun. christien kafton is at the scene and just talked to friends of the victim who shared some important information. good morning. >> reporter: good morning. those friends confirming the identity for us of the young man involved. they say the young man shot and killed by sonoma county deputies was 13-year-old andy lopez. we do have a photo. we hope to turn it around for you in a few minutes. let's show you where the incident happened. it happened here at moreland and west robles avenue yesterday afternoon. if you take a look at the ground, you can see the outline of where the sheriff's cruiser was and some evidence markers off to the side there. again, the santa rosa press democrat reporting that the person shot here was 13-year- old andy lopez. friends confirming for us that he did live in the neighborhood. now we're getting word from the neighborhood about the boy in question. investigators say it all

happened at about 3:00 yesterday afternoon. they say officers were on routine patrol in the area, saw lopez with what appeared to be a gun and they called for backup. now, the sheriff's office says the opportunities repeatedly ordered lopez to put down the gun and when he refused, opened fire. immediately after shooting, lopez apparently collapsed ontario the ground -- onto the ground, onto the replica rifle. officers found a replica handgun with him as well. earlier we spoke with borkers at a nearby -- workers at a nearby shop who say lopez stopped in frequently. they say he was a good kid. >> good kid. good kid. he always paid. if he didn't have a dollar to spare, we would spare him a dollar. he would always come back and give you the dollar and everything. nice kid. >> reporter: investigators did e-mail us a photo of the replica weapon. it's a realistic-looking ak-47 assault style weapon.

the two girls i spoke to earlier said it's a neighborhood toy that various boys in the neighborhood play with it. they say it has an orange safety tip to distinguish it from looking like a real weapon. sheriff deputies say he did not put the weapon down. that's when they opened fire. at this point, there are at least three investigations running right now. santa rosa police, petaluma police as well as the sonoma county district attorney's office all looking into the shooting. the two officers involved are currently on paid leave which is standard in a situation like this. again, we are looking to see if we can speak to santa rosa police and sonoma county sheriff's office to get more details about the shooting. but for now we're live here in santa rosa, christien kafton, ktvu channel 2 news. 8:05. we have new information about the next phase of the b.a.r.t. labor dispute. the tentative agreement that ended the strike monday night,

it's far from a done deal. today's chronicle reports the board is split on whether to approve the deal. some board members reportedly think b.a.r.t. gave away too much to reach a deal with the unions. five of the nine board members have to approve the deal. the agreement has to go before b.a.r.t.'s rank and file union members. they may start voting as early as tomorrow. there's a new development in the death of an elevator mechanic at the new 49ers stadium construction site. it happened over the summer. state inspectors had originally cleared the elevator company of any violations. however, ktvu's janine de la vega is out there now in santa clara and you are telling us that may change. >> reporter: yes, dave. cal/osha isn't telling us any specifics but says that questions were being raised. that's what prompted them to re- examine the death of that

construction worker here at levi stadium back in june. construction workers that we spoke to in the morning say they would like to know more about what led up to the accident. cal/osha says 63-year-old elevator mechanic donald white was standing on a ladder in the elevator shaft when the counter weight came down and him -- hit him in the head. they say he was in communication with the person operating the elevator and was aware the elevator was functioning but it's unclear why he didn't move if he knew the elevator was coming toward him. cal/osha has rescinded the decision that the employer didn't commit any violations that may have contributed to his death. this morning, some of the construction workers said they felt it was a good thing the incident is being probed more. they say it could help them in the future. >> everybody is on their toes. nobody wants to get hurt. nobody wants to see nobody not go home to their family. that's pretty much the gist of it. we're trying to be safe.

smallest one-year bump in 30 years. a public meeting is set for 6:00 tonight in san francisco to discuss a pilot project to protect bicyclists. officials are looking to increase safety for bicyclists and pedestrians on folsom between fourth and 11th streets. back in august, a truck killed 24-year-old emily mulalok riding her bike in the area. at first place say it was her fault but bicyclists advocates found surveillance video that showed the truck caused the crash. today's meeting is at 6:00 at the south of market recreation center. the san francisco board of supervisors approved a ban on high-capacity ammunition magazines. it's already illegal here in california to buy, sell or carry high-capacity magazines under a law that took effect 13 years ago. however, that ban does not apply to ammunition magazines purchased before the law took effect. anyone in san francisco who has

8:24. several huge wildfires are still raging out of control west of sydney, australia. the fires have already destroyed at least 200 homes and ravaged 300,000 acres of land. there are concerns things could get a lot worse due to the hot temperatures and strong winds. disaster agencies are worried the fires could merge into a megafire which could have disastrous consequences for the ent tire region. firefighters -- entire region. firefighters plan to deliberately burn part of the point reyes seashore. the planned burn should take place near drake's from 11:00 a.m. to about 4:00 p.m.

80. we had a couple of earlier crashes. 80 through richmond is not bad. they are clearing a crash at northbound 680 at alamo. we have had picture that someone sent us from the scene. i want to look at 280 at the 880 interchange in san jose. i think we have that. traffic is going to be busy here. it is going to be very sloat from bascom to cupertino. back to the desk. >> sal, thank you. happening today -- for three hours, later this afternoon, b.a.r.t. service between la fayette and pleasant hill will be halted. ktvu's brian flores is out there now in pleasant hill to tell us how today's track shutdown is tied to last weekend's deadly tragedy. >> reporter: this will be part of the ntsb investigation, dave, on how a b.a.r.t. employee and contractor were killed on the tracks last saturday. they will be using this afternoon to reenact exactly what happened. if you are a b.a.r.t. commuter here in the east bay, you need to know that this re-

enactment will affect your afternoon commute. b.a.r.t. says that between the la fayette, walnut creek and pleasant hill stations, service will be halted for three and a half hours from 12:00 noon to 3:30 this afternoon. so they re-enact a portion of the investigation. now, again, if you plan on commuting through there, they will do what's called a bus bridge which means they will be running buses at each of those locations every 15 minutes for riders who need to continue on the line while the investigation is going on. now, 66-year-old lawrence daniels and 58-year-old chris shepherd were killed last weekend while they were inspecting the tracks north of the walnut creek station. they were hit by at northbound train saturday afternoon. now, at this point, the ntsb says mechanical equipment was working fine. investigators also say the train operator did honk the horn and that those men received approval to their their -- to do their work. but this re-enactment will hopely answer more questions and perhaps provide guidance on

safety rules moving forward for b.a.r.t. investigators say evidence like video gathered will also help during the investigation. >> there is a videorecorder, audio recorder that's able to capture the operator cab section of the railcar. there are also cameras within the passenger portion of the car that i also have taken custody of. >> reporter: but this tragedy could also lead to new rules requiring b.a.r.t. trains to, perhaps, slow down to 25 miles per hour through any section where crews are believed to be working. that's according to sources who spoke to the chronicle. they say rules could change to where the trains could be manually driven past work sites instead of being put on automatic. with that happening, b.a.r.t. says that will affect train schedules as well. we've not heard from b.a.r.t. on whether that's being considered but for the immediate time, if you are an east bay commuter that goes from here in pleasant hill to walnut creek and la fayette and

vice versa, you need to know that buses will be running instead from noon to about 3:30 this afternoon. we're live here from the pleasant hill b.a.r.t. station, brian flores, ktvu channel 2 news. >> thank you, brian. new this morning, the valero refinery company has agreed to pay a civil penalty of $300,000. the fine is for air quality violations at its refinery in benicia. the refinery was the target of 33 violation notices issued by the bay area air quality management district between 2011 and 2012. none of those violations was considered a risk to the public. happening today -- san francisco city gardener thomas is scheduled to make his first court appearance in connection with the death of a woman run over and killed at a park last night. prosecutors say the woman was sunbathing on the grass with her dog and 11-month-old daughter. police say thomas did not stopper offer aid but his -- stop or offer aid but his

attorneys said his actions were not criminal. >> he tried to avoid hitting the dog and that's why he went to the right off the path and down the grass. >> the parks need to be a safe place, and this was one of those cases where none of this needed to happen. >> thomas is behind bars on $350,000 bail. he faces felony vehicular manslaughter and hit-and-run charges. off camera, the woman's husband said he thinks the charges are "just" but also says he's been more focused on mowring the lot of his wife -- mourning the loss of his wife and raising their baby girl. san jose police are trying to find edward cen test eo last seen -- centeo last seen at his home. he's 5'6", 150 pounds, gray hair, brown eyes. he was wearing a multi-colored shirt, white wants and black shoes. police say he was driving a

gray 2009 hyundai. he also suffers from high blood pressure and he does not have medication with him. it's called alarm fatigue. it is definitely sounding an alarm among hospitals nationwide. ktvu eclaudine wong joins us from the stud -- ktvu's claudine wong joins us from the studio to explain this. >> well, there have been a lot of questions surrounding the death of lynne spalding. one report says what's called alarm fatigue may share some of the blame. spalding was found in a fire escape stairwell on the fourth floor of san francisco jeanle hospital on -- generalle -- general hog on october 8th. the stairwell was locked. there was an alarm. some had questions on why the alarm didn't alert hospital staff. administrators say the nationwide problem of alarm fatigue may be to blame. it happens in a workplace where alarms and monitors are constantly going off. the problems come when workers get desensitized and tune them

out. take a look at some of the numbers. according to the joint commission, between january of 2009 and june of 2012, alarm- related problems led to 80 patient deaths and 13 severe injuries in u.s. hospitals. and the commission says those numbers likely represent less than 10% of incidents. the chronicle also cites a ucsf study that analyzed 7,000 alarms that all went off in a one-month period. 87% of those were false. one patient actually set off 1100 alarms a day. most were false. but there were three that alerted staff to a life- threatening event. the message from researchers is there has to be a balance. there must be enough alerts to monitor potential problems but there must also be assurances that alarms will only be for important situations. so doctors and nurses know the sound of an alarm is meaningful. tori? >> all right. thank you. 8:38. a memorial is planned later this morning for a napa state

hospital employee who was killed by a patient. today marks three years since the death of psychiatric technician donna gross. this is video from last year's memorial. gross's death led to new laws and new alarm systems at state months. the patient who killed gross is serving a sentence of 25 years to life. 8:38. this morning a judge will consider governor brown's request for a 60-day cooling off period for a.c. transit and its uns -- unions. yesterday, an advisory board said a strike could seriously disrupt public transportation and hurt public safety. if the judge agrees with that, the unions won't be able to go on strike. that hearing starts in a few minutes at 9:00 in oakland. meantime thousand a.c. transit holds public hearings on the bus fare proposal. they want to introduce day passes that could cost $5 for adults $2.50 for youth, seniors and the disabled. discounts apply if the passes are used with clipper cards.

only 13 years old and was allegedly carrying a fake gun. christien kafton is in santa rosa now. you just obtained a photo of the boy as well. >> reporter: yeah, friends of the teen are identifying him as 13-year-old andy lopez. the whole incident happened here at moreland and west robles avenue. if you take a look, you can see the spray painted outline taken from where the sheriff's vehicle was and the evidence markers there where the shell casings landed after this shooting. friends this morning provided us a photo of 13-year-old andy lopez. they say he was shot to death yesterday by sonoma county sheriff's deputies after two students mistook a toy gun for a real weapon. investigators say it all happened at about 3:00 yesterday afternoon. they say the officers were on routine patrol, saw the teen with what appeared to be a weapon and called for backup. the sheriff's office says the deputies repeatedly ordered him to put down the gun. when he refused they say he opened fire. immediately after the shooting,

he collapsed on the replica rifle. officers found a plastic handgun tucked into his waistband as well. today friends who stopped by the scene were in shock. >> he loved everyone. he would never hurt nobody. >> reporter: investigators did e-mail us a photo of the replica weapon last night, a realistic-looking ak-47-style assault weapon. friends we spoke with earlier say they are very familiar with the gun. they say there are several boys in the neighborhood who play with it. the teen girls we spoke to say the gun had an orange tip to indicate it's a toy. now, there are several parallel investigations underway right now. the santa rosa police, petaluma police and the sonoma county district attorney's office are all investigating the shooting. we have calls into the santa rosa police and the sheriff's office looking to find out a little bit more information about this case. for now we're live in santa rosa, cyst on kafton, ktvu

channel 2 news -- christien kafton, ktvu channel 2 news. federal investigators are investigating a mysterious illness tied to jerkry pet streets. the fda -- treats. the fda issued an alert saying people should be aware of the potential problems with the treats. since 2007, the fda has received reports of more than 3600 dogs and ten cats getting sick after eating chicken, duck or sweet potato jerky treats. of the cases 580 pets have died. >> the first signs that you might see might be drinking more water or ure nateing more -- urinating more frequently. and then you might see weight loss, changes in appetite. >> the fda did not identify any brands but said those under scrutiny are made in china. in the meantime, the fda is encouraging owners to report any cases of pets becoming sick. the recent government shutdown forced a postponement of a hearing into the deadly

asiana crash in san francisco. the ntsb hearing in washington was set for november. well now, it's been rescheduled for december. ash flight 2 -- asiana flight 214 crashled at san francisco international airport on july 6th. two passengers died in the crash. a third one was killed when she was run over by a fire truck. and the irs is delaying the date when it will begin processing tax returns because of the 16-day government shutdown. now, originally, the irs was set to begin working on 2013 tax filings on january 21st. now the irs says it won't be ready until january 28th at the earliest. and february 4th at the latest. now, the delay means tax payers entitled to refunds, you have to wait longer to get them. 8:49. we want to check in with sal. sal, the toll plaza is -- what? >> much different.
