this is ktvu channel 2 morning news. >> and good morning, you are looking live at the arinda bart station where crews have been working for hours to remove a train damaged by a fire yesterday. it took longer than they thought. they did affect the morning commute. in the last half-hour we learned they were able to move it but still unclear it is off but right now christien kafton is getting information from barts spoke woman and will update us in a moment. good morning, i am claudine wong. >> i am dave clark, chilly this morning. >> it is, lifted a little bit so the bases are there and 3000 feet there and made a huge push there so if you are heading there may not see that there. around here 40s and 50s, don't

look like that will change, stuck in that fog, san francisco tough tough then and went that today, there is too much fog and a low approaching doing that so even though it lifted cloudy there but a cooler pattern inland today, the west wind has picked up, only a high of 68 there today. to the delta seeing 21, 22 miles per hour towards travis and also there so out there things are ramping up because of this, which will keep things on the cool side then, so morning cloud or low fog whatever you want to call it not as thick as then, some sun but noting down, 50s and 60s elsewhere, here is sal. >> we have a busier commute now than then. we want to tell you good news, westbound 580 into the valley a crash cleared however traffic is backed up big time. it was there for 20 minutes but caused a huge delay over the

altamont pass through to -- this is 1 solid line of stop and go traffic, so if this is your commute you need to get on the road. i can't recommend an alternate because as you know if you drive this every day taking side roads they get crowded and they are not really efficient so my best advice to you is just to get out there early if you can, a tall order on a morning commute but that is what is my advice would be, let's take a look at the bay bridge toll plaza, filling in westbound a 10 minute wait there, on the sunol grade 680 southbound looks good, past mission police activity there not affecting the freeway. back to the desk. >> we begin with the fire underneath the bart train there yesterday has affected bart service this morning. christien kafton joins us live from the station and i know we have been checking with with you, we saw it there, we see that now, i know you just talked with them, what have you learned? >> reporter: that is one of the

major issues that the train is now gone, take a look, that train had been up there this morning, you can see customers, passengers waiting for bart trains, they are still single tracking. alicia trost from bart joins us live to give us the latest update, an encouraging sign that train was able to power up on its own and move out. >> that's right we powered it up and it is moving at 5 miles an hour there so that is going to cause delays because trains will stack up behind it and we are still using one track there, the good news is we have got special equipment there cleaning up the mess left behind, we had a take a torch and break apart a 12,000 pound -- 1200 pound metal box that was part of a propulsion unit that overheated and failed, then what happened is what bolted into place also overhealedded and just chunk down and sort of stuck there,

so all broke into pieces, we have equipment removing it, the estimate is two hours until we clean it all out, the good news no damage to the third rail or trackings so we are going to be able to open it but we are expecting some pretty good delays going through oakland going -- going towards oakland this morning as part of the commute. right now only 5 minutes delay though. >> that was the question i think is on everyone's mind what is the outlook for the commute looking towards 7:30 as the commute starts to ramp up what is expected? >> it is hard to predict. we are seeing trains move quickly so that is a good sign, if you are in a rush give yourself extra time, hopefully 20 minutes, hopefully not more, hopefully we can do that. >> finally any idea on the cause? i know you said this piece of equipment failed. any idea on how that happened

and is there more inspections for that? >> we have our experts up there, they say it will take three to four days, the piece of metal may not be the cause, it may have actually just been part of the chain reaction that happened to that 5th train, it was the train in the middle of that train last night that that was that incident train smoking so heavily. >> alisa trost from bart thank you very much for the update again, again the latest updates minor delays we are hearing 5 minutes they are hoping to have both sets over tracks open here within an hour or so which would ease the congestion, there are again possible concerns of delays throughout the morning. we will continue to update you as the morning continues to let you know how this is going to impact the morning commute but for now live at the bart station christien kafton, ktvu channel 2 news. >> three hours from now they will meet for a meeting, they have got to decide whether to rat nigh the agreement that

ended the strike monday night. it takes 5 of the 9 board members to approve it and there are some reports some of the board members may reject it fearing bart give away too much to the unions, the greement still has to be approved by union members, they could start voting as early as today. meantime the bart board is also expected to talk about last saturday's deadly train accident. a bart employee and a contractor were killed near walnut creek's bart station during a maintenance and training job during the strike, that tragedy, that is the subject of a controversial news conference this morning. we will tell you more about that coming up at 6:30. >> firefighters are looking to the cause of a fire at a concord storage facility overnight that created quite a distraffic for drivers, it broke out around 11:00 last night near concord avenue, as you can see from the video there were flames. a car there also caught fire. no one was hurt. investigators are also

going to search for the cause of a fire in san rafael tuesday morning that gutted a home there. the journal reports the investigation was delayed because it took 14 hours to find the tenants. fletcher and bonita carson, scheduled to be evicted when that fire broke out tuesday morning. they were later found at a resort outside marin. the carsons claim they lost 30 years of belongs in the fire. >> 6:07. last night dozens of angry community members marched in the streets of santa rosa. >> we need justice. [ cheers ] >> now they marched through the neighborhood where a sheriff's deputy shot and killed a 13- year-old boy tuesday afternoon. investigators say officers repeatedly told teenager andy lopez to drop what turned out to be a fake rifle but they say the boy ignored those orders, then turned the barrel that fake gun at them. >> the deputy fired rounds at him, striking him alt least one

time. the subject immediately fell to the ground. >> this is like anywhere else, in rural sonoma county a kid with a pellet gun, they would not have done nothing for him. >> uh-huh. >> they not have done nothing to him but this urban area they just blast the kid. >> yesterday investigators displayed a real assault weapon next to the fake gun. they wanted to show how hard it is to them apart however many are still outraged saying it was unjustified, he promises a full investigation. law requires they have got to have a bright orange plug in the barrel and an orange stripe is supposed to be on both sides of the barrel. it is illegal to cover them up. santa rosa police say his rifle did not have an orange tip. >> fremont police are asking for the public's help in identifying a man accused of exposing himself in a wal-mart.

police say he was spotted walking there before he exposed himself to a woman there. this is a picture of him from a camera. he is described as 28 to 35, 5'9," with a medium to heavy build and as you can see from that he was wearing a red polo shirt with a sweater vest. dark pants and had an id badge. anyone with information is asked to call police. the city council is scheduled to consider a proposal monday for a bill poured on 101. supporters say it would bring in at least 700,000 dollars a year, that could be used to replace aging infrastructure, but critics say they are distracting, billboards have already gone up in those places. san francisco mayor ed lee has pledged to respond to all change.org petitions with a certain number of signatures. he is the first in the country to make that pledge. the white house has been responding to on-line petitions since 2011.

welcome back, 6:14, last night hundreds of people gathered in sparks, nevada, honoring the victims of the school shooting. this vigil was at sparks middle school that is where that shooting happened, police say a 12-year-old student shot and wounded two classmates and killed a teacher who is also a military veteran. michael lansbury, the boy later killed himself. the mother of one of the wounded boys says her son is

recovering. >> we are happy that he is on the road to recovery and he is doing well. in fact he is up and moving around. >> she also says her son was shot while trying to help the teacher and doesn't think her son was targeted. classes at sparks middle school have been cancelled for the rest of the week. >> a 14-year-old student in massachusetts has been charged as an adult in connection with the killing of a teacher. phillip chisolm was arrested yesterday hours after the body of 24-year-old colleen ritzer was found in the woods near the high school. police say chisolm was arrested based on statements he made and video, he is held without bail. police have not released a motive or said how she was killed. in washington an 11-year- old boy is accused of bringing a gun, fewer hundred rounds of ammo and several knives to school. the weapons found yesterday and the middle school. no one was hurt but the school was locked down for two hours. the boy was arrested and is now

facing an attempted murder charge. >> 6:15, tomorrow we will find out more about the case against the parents of jon benet ramsey, the case that eventually went nowhere, she was a 6-year-old child beauty queen, her body -- she was found beaten and strangled there, a judge ordered a grand jury indictment be unsealed tomorrow. the grant grand jury reportedly voted to indict her parents on charges of child abuse resulting in her death but the district attorney decided not to proceed with the case. despite a lot of suspicions they were never named as suspects, her killer was never found. it was a subject pushed off the agenda by the government shut down but president obama is expected to put immigration reform front and center once again this morning. ktvu's justin gray is in our washington, d.c. bureau now

where opposition from house republicans killed the reform plan last time around, justin. >> reporter: well, dave, president obama wants a comprehensive immigration reform plan but house republicans they want more smaller piecemeal measures and think that is the way to go. the president will deliver a statement in the east room of the white house this morning calling for what he calls a common sense approach to immigration reform. that would mean strengthening border security, creating an earned path to citizenship and holding employers accountable. an earlier 1 made it through the senate but went nowhere in the house, he gave some indication it is possible this time around, he said immigration is an important subject that needs to be addressed and hopeful something could happen by the end of the year. house speaker nancy pelosi says immigration reform would create

thousands of jobs in california, more on that at 7:15. justin gray, ktvu channel 2 news. >> happening now a congressional hearing looking into the problem plagued roll out of the healthcare.gov website. you are taking a live look at what is happening inside the house energy and commerce hearing room. several of them help set up a website will testify there. lawmakers wanted kathleen sebelius to be there too but she is in arizona today. she is however scheduled to testify at a hearing next wednesday. well, the obama administration appears to be moving on a deadline for all americans to have health insurance, under the terms of the act americans who don't sign up for health insurance could be charged a tax penalty. then rulement period is scheduled to end on march 31st but there was also a deadline of february 15th for people to

sign up in order to avoid the penalty. now they say they will extend that to match up. >> tonight in the world series game 2 with the boston red sox hopping to take a 2 games to none lead after they beat the cardinals last night 8-1. visibility is better, however the breeze is picking up, the delta breeze showing itself which has been quiet, not today, so low clouds, fog, but more of that, sunny, inland, cooler, 80s and 70s today, some areas 60s, the low will get close to us then slide towards there so maybe higher clouds and maybe local drizzle with even a bigger cool dune tomorrow as that fog bank makes a push inland, this time of year it is big, 39 ukia, 27 tahoe, sacramento 50, that is fog helped by that, if it marched there we might get rain but the best is drizzle as it does that to replace that low there, the low cloud deck is huge there, around 3000 feet so a gray day there and up to there, so 40s and 50s on the temperatures, these won't change too much, and fairfield has that, west wind at napa and

oakland, these wind directions have been just very calm but it is a westerly component so that means inland temperatures cool down as that fog gets bigger push or the low cloud decks, low, clouds, fog, sunny, cooler, high pressure losing its grip then, today and tomorrow, tomorrow the coolest day, one moving out and here comes the next one but everything says that right down there to replace that one, so morning fog, low clouds, some sun, i mean some areas concord says clear but even livermore says that, wind picking up to the delta and also some areas where it is about 20, 25 miles per hour, 60s, and 70s, closer together than it has been, we had 50s and 80s but not now, towards there now 70s, same for them, although morgan hill has been there, 50s coast, 60s peninsula, including there, 67, so a cooler day, cloudy, some sun, mostly cloudy 40, high clouds might clip us saturday, sunday looks good, next week

a man who worked on the movie chasing mavericks is suing the company, eric hatton says he was hurt there. he says he fell off the stairs there and that left him injured, his lawsuit says they knew it was broken but left them in place, it focuses on the surfing area off the coast of half moon bay.

>> 6:26, bay area officials are worried about the spread of mosquitos that carry yellow fever, they are working to keep them out. they have been identified spotted along the creek there just 800 feet from the santa clara county line, so now they are working together to get rid of breeding grounds, santa clara county is also focusing on getting rid of another pest after two fruit flies were found in cupertino. officials will put baited traps in an area around highway 85 there. that is where two of the flies were spotted. the mixture used in those traps attracts only the fruit flies, officials say the probably hitchhiked in on fruit from another country. >> all right, at 6:27 we are following breaking news from fremont. police are at the scene of a shooting they say is linked to

will have a live report coming up. >> 6:32. a fire be neat a bart train there yesterday is affecting bartd service this morning. there have been new developments in the past hour. christien kafton live at the bart station now. you have got new information and also new video. what is going on? >> reporter: yeah, at first that new information we just spoke with alicia trost the spokesperson, she said there are 10 to 15 minutes that are expected to recovery quickly as that situation gets better and better, and this is why, take a look, passengers up there, the train that had been there has now moved out. we did manage to hit -- record a few seconds of video as that train appeared to power up on its own and drive off on its own power, now that train is creeping its way at 5 miles an hour towards concord, tying up

the line as it moves, we have new video of workers clearing and inspecting the tracks following the fire, that work going on here in the last hour, we learned that crews had to break apart equipment that overheated and dropped down on to the tracks underneath the 5d 5th car of a 10 car train, crewed hat to cut it apart and tested it to mover it out and it turned out they were. >> we weren't able to successfully power on the trained age and move it so that is a great train and also no damage at first blush so a good sign for the morning commute. >> so again hearing 10 to 15 minute delays, those delays expected to get better shorter as the morning progresses and as that train creeps its way towards concord. they are hoping that it will be

completely cleared out of the system by about 7:30, which again really is when the bulk of the commute begins so again the news at this time for commuters 10 to 15 minute delays expected to get better as the morning progresses, we will continue to monitor the situation here at the arinda bart station and let you know how the situation is developing out here and how that morning commute is looking for bart riders, for now in arinda, christien kafton, ktvu channel 2 news. >> they want a criminal investigation into the deaths of the two workers there, the group says bart managers should face criminal charges as a result of the deadly accident that killed christopher sheppard and lawrence daniels, the group plans a rally this morning outside of the bart board meeting in oakland. the manager, who was being trained to drive the trains in the event of a strike was operating the train involved in that deadly accident. the ntsb is still

investigating the deaths of those two workers. a stretch of tracks was closed yesterday while they re-created the deadly accident. passengers going between lafayette and pleasant hill were transferred to buses. bart is also changing a controversial policy after the deaths of those two workers in walnut creek, san francisco chronicle reports bart has suspended a 30-year-old procedure that makes workers solely responsible for their own safety on the tracks. crews will also now be required to slow down the trains to 27 miles an hour, or come to a complete stop when work is being performed on the tracks. also this morning a decision about bikes on bart. coming up for you at 6:45 the vote scheduled today, this could be a big victory for people who bike to work. >> firefighters in contra costa county had to quickly extinguish a fire at a storage facility. brian flores is live now in concord to show us the damage and video just moments after

the fire started. >> reporter: claudine that video shows intense flames. you will see that in a few seconds. as you can see behind me this is a storage facility, a tow yard, u-haul rental facility as well. lots of damage from the fire last night. see at least one car damaged there, the dumpster also went up in flames and obvious damage to the building where the fire left its mark last night. if we look at the video again, as we have been saying strong response from firefighters last night. we understand it started just before 11:00 last night here in concord, firefighters say it started in the tow yard area where it spread and damage the side of the building as you saw and what it looks like one car was damaged from that video. also reported as well firefighters had to deal with the fire from the inside as well. we are hearing some cars from the inside as well as propane tanks also caught on fire, we have not been able to confirm

that with them this morning, however. but it did take firefighters from contra costa county but 10 or 15 minutes to extinguish the fire, unclear this morning how the fire started. witnesses say again it may have started from the outside. also unclear whether anyone was here. firefighters say overall there were no injuries. back out here live as you can see the damage from the fire late last night. i did just get off the phone with an employee here at this facility. he says that they are trying to track down the owner right now to try to get some comment but at this point they don't want to talk about the fire from last night. we are also trying to get in touch with contra costa fire on what may have started it, whether it sounds suspicious or not but we have last heard not back from them this morning as well, as soon as we do we will pass that along, live here in concord, brian flores, ktvu channel 2 news. >> and man says he was attacked while tying to stop a sideshow

there. they said they called police but they took along and he says he took matters into his own hands and confronted the drivers with a bat and several people attacked him. >> i got a number of bruises and scrapes and the beating in the head but they hit me in the head so i got lucky. >> a neighbor helped rescue morton and he was rushed to the hospital. residents say officers didn't arrive until 30 minutes after the first call. police say they are short staffed so they prioritize calls. >> police in livermore searching for the driver suspected in a hit-and-run yesterday morning at second and south l streets. there is a photo of the suspect's truck we want to show you. a white gmc sierra pickup truck right there. investigators say that truck ran a red light, smashed into a honda civic waiting to make a turn there, while the driver of the honda was not hurt the car

was totaled, witnesses took pictures of the truck speeding away. muni is working to better protect bicyclists after that deadly accident in san francisco's soma neighborhood. 800 buses are inspected to make sure they have got a special feature on the rear right wheel. now the s-1 guard is designed to protect bicyclists and pedestrians by pushing people who fall under the bus away from the wheels, the changes come after a 78-year-old cyclist was hit and killed last friday by a bus turning right on bryant and 11th streets. >> an event to teach students about the dangers of drugs goes wrong, the bizarre incident involving a police gun that injured three students. >> also the search for a man accused of exposing himself at a wal-mart in fremont. we have photos now of the man

identify a man accused of exposing himself in a wal-mart, police say he was spotted walking up and down the aisles before he exposed himself to a woman shopping there, you are looking at a picture of him. he is described as 28 to 35, 5'9" with a medium to heavy build and as you can see a red polo shirted, sweater vest and dark pants and an id badge, anyone with information is asked to police call. >> 6:43, a bizarre incident happened here, a police officer's gun goes off by accident during a drug prevent event. it happened yesterday morning at this school. now police say a student pulled the trigger of a rifle mounted on a police motorcycle. >> one fail safe that was effective was that the bullet did distent grate when it discharged by striking the metal plate where the barrel rests. >> luckily none of the children were hurt.

at least they were shot. they were not shot. police say metal debris did hit the students and there injuries. he announced he is running for mayor of san jose next year, he also ran in 2006, in his announcement cortezi expressed support for the unions in their battles with city hall over pension costs, san jose's current mayor chuck reid will finish his second term next year. there are 4 other contenders who have said they are in, the vice mayor and the san jose council members. >> we want to update you on the breaking news story we first told you about about 10 minutes ago. police right now investigating a shooting sparked by road rage. janine de la vega there where we understand there are two

crime scenes. >> reporter: yes, claudine there are two. this is where the victim's car ended up here in front of this fremont bank on mission boulevard. you can see police have this whole area taped off. the victim's car has several bullet holes there inside of it. let me explain what happened because it is a little bit confusing. earlier this morning at about 5:25 police tell us there was a road rage incident on the lanes of 680 southbound. the victim, who was in the mercedes, pulled off of the freeway and exited mission boulevard, he got off near brown street, when he was there he got into some sort of confrontation with the other vehicle. the suspect vehicle. he was then shot several times while sitting inside of his car. he don't know which way the suspect or the suspect car went. we do know that the victim then went down the block on mission

boulevard, pulled up to the fremont bank in front of a doughnut shop, apparently he called 911 and was yelling in pain, the clerk from the doughnut shop we are told also came out and called police. he was transported to a local hospital for his injuries. we are not sure just how badly he was injured but again two different crime scenes, police are waiting for crime technicians to arrive here as well as the other scene that is just a couple of blocks away. we will stay and monitor this situation to try to see if with can get some suspect information for you. at this point police are not telling us if the suspect is a man or a woman. reporting live from fremont, janine de la vega, ktvu channel 2 news. >> bart's board of directors is scheduled to hold a vote today on whether or not to keep allowing bikes on trains, they tested a program that allows them to bring it on the trains since july but it will end
