"mornings on 2" starts now. morning. live pictures from fremont where we are following breaking news. police investigating a road rage incident. there are several crime scenes involved. we'll have a live report with the latest details coming up. welcome to "mornings on 2." i'm tori campbell. >> good morning. i'm dave clark. let's get to steve paulson. >> tori and dave, thank you. a lot of low clouds. in fact, a big fog bank out there being helped along by a low just beginning to move into the picture. it looks cooler. in fact, mostly cloudy here. dool to cold for -- cal to cold -- cool to cold. fog, sun for some. if you are stuck in some of these 40s, it's cold. 40s, 50s, they haven't moved all morning long. fair field, 47 with a southwest wind at 24 miles an hour. that will cut right through you. san francisco starting off at

50. the fog bank is being held along by this system. that low will give us a low fog bank. maybe some drizzle. and then it's on its way to southern california probably friday or saturday. low clouds, whatever you want to call it. visibility is not as bad as yesterday. wind is out of the west. sunny, cooler for the inland temperatures. more 7s 0 -- 70s. 50s and 60s coast and bay. here's sal. traffic is moving along relatively well in some areas. let's start off with a look at the toll plaza where this looks pretty typical even though it's slow. i would say this is a decent commute getting into san francisco. about a 25-minute delay. you saw they just turned the lights off at the toll plaza there. traffic is moving well. the commute will be okay on the westbound san mateo bridge as you drive through. there was an earlier accident near the san mateo bridge on 880. that's been cleared. but southbound 880 getting from hayward to union city is going to be slow.

that's southbound 880 into union city. also 238 is slow into castro valley. now let's go back to the desk. >> thank you, sal. breaking news from fremont as police investigate a shooting linked to road rage. this happened about 90 minutes ago. it's forced the closure of several streets. the dispute started on highway 680 and ended up in the area of mission boulevard and brown road. ktvu's janine de la vega is live on the scene where officers have cordoned off the area. we can see the yellow tape behind you, janine. >> reporter: yeah, police are have had to hope off this strip mall parking lot located on mission boulevard here because they need to process this scene for evidence, especially that mercedes that you are looking at. now, this is not where the shooting occurred. but it's where the victim drove to after he was shot. police tell us this started as a road rage incident in the lanes of the southbound -- the southbound lanes of 680 at 5:25 this morning. a driver of a mercedes and another car exited the freeway

at mission boulevard and then pulled off on brown street. then there was some sort of confrontation between the two. the other person in the car fired several shots at the man in the mercedes hitting him. the suspect fled the scene. we don't have a description at this point of the suspect or the car or how many people were actually in the suspect's car. we do know that the victim drove a couple of blocks down mission boulevard into the strip mall parking lot. that's where there's a fremont bank and doughnut shop. he parked there. he called 911 from that parking lot there saying he was in a lot of pain and that he had just been shot. the doughnut clerk, that person also witnessed him yelling. we don't know how badly he was hurt. but he was rushed to a local hospital. police are still here at the crime scene, again, waiting for crime scene technicians to process this scene as well as the other scene that's several

blocks away. evidence was left here. you can see surrounding the car, there appears to be clothes. i know there's several bullet holes that are visibility on the passenger side of that mercedes. again, so a lot of activity here as police are searching for the suspect as well as, you know, more details about how this incident happened. reporting live from fremont, janine de la vega, ktvu channel 2 news. >> all right. 7:05. we're still following developing news involving b.a.r.t. a fire underneath at b.a.r.t. strain at the orinda yesterday is still affecting the commute. there's been developments in the past 90 minutes. christien kafton is there at the b.a.r.t. station. what's happening there? >> reporter: the big headline for b.a.r.t. riders and commuters is the delays are relatively short and only expected to get better as the morning progresses. take a look. you can see b.a.r.t. trains pulling in and out of the station here in or -- in

orinda. there was a train stalled there earlier this morning. that train is now gone. we did manage tote go a few seconds of video as that train powered up and drove away on its own power. the train is slowly creeping out towards concord at about 5 miles an hour. that's still tying up that one track. at some point, they do have to go and -- on one track or single track around the area. that's what's leading to some delays. it's still getting better throughout the morning. crews had to break apart a 1600- pound piece of equipment that failed yesterday and caused that fire. it overheated, then overheated the mounts which hold it in place. crews did have to cut that big box-like piece apart and the train was tested to see if they could move it out of the station. they were able to get that train out of the station. now b.a.r.t. is saying the major impact on the morning commute is over. and b.a.r.t.'s schedule is

recovering. >> right at 6:30, it was the peak of the peak of the delays. 20-minute delays. some reported 30-minute drays. those were -- delays. those were the ones stuck in this. now that everything is open, it will only get better from here out. >> reporter: certainly good news for b.a.r.t. commuters that the delays will be getting shorter and shorter. b.a.r.t. says it will be conducting a full investigation as to how this incident happened. that expected to take three or four days before they have a definitive answer on exactly how that fire broke out yesterday afternoon in the first place. we're live in orinda, christien kafton, ktvu channel 2 news. b.a.r.t.'s board of directors in two hours will hold a very important meeting. they have to decide if they will approve the tentative agreement that ended the b.a.r.t. strike monday night. it takes five of the nine board members to approve that deal. and reportedly, some board members may reject the agreement. they fear b.a.r.t. gave away too much to the unions. the tentative agreement still has to be approved by the union

members. those b.a.r.t. workers could start voting as early as today. 7:07. happening right now -- a congressional hearing looking into the problem-plagued rollout of the healthcare.gov website. this is a live picture of the house energy and commerce room. on the screen sitth at this -- sitting at this desk are several contractors who helped set up the website for the affordable healthcare act. they are testifying. there's been a lot of problems. the chairman noted that these same contractors appeared before the committee just last month. >> over the last few months leading up to the launch, top administration officials and lead contractors appeared before this committee looked us in the eye and assured us repeatedly that everything was on track, except that it wasn't as we now know too well.

>> lawmakers wanted health and human services secretary sebelius to testify. but she's in arizona. she's scheduled to testify at a hearing next wednesday. and in a half-hour, president obama will call on congress to pass comprehensive immigration reform legislation before the end of the year. the senate passed an immigration reform bill in june but there has been no action in the senate. coming up at 7:15, the main sticking point house republicans have with this bill. 7:09. the napa county sheriff is warning about a scam. he says someone is calling people claiming to be a major wilson or deputy wilson. then the caller tells them to send $2,000 to avoid being arrested for failing to report for jury duty. well, the sheriff says his office never asked for or accepts payments for a warrant. so far, no one has reported actually sending some money.

state corrections officials are working on new rules to limit the use of pepper spray on mentally ill patients. the policy change comes in the wake of video showing six mentally ill inmates screaming for help while being sprayed with large amounts of pepper spray. the inmates reportedly were sprayed after they refused to be handcuffed. one in three inmates in california sufficients from mental ill -- suffers from mental illness. today is the last day of a control burn at point reyes national seashore. if you see a lot of smoke in the area. don't be alarmed. it starts in about three hours on 141 acres near north ranch and drakes. there was also a control burn there yesterday. the purpose of these fires is to eradicate non-native plants like the scotch broom. there will not be any road closures but drivers are asked to use extra caution because of the smoke. 7:10. the palo alto city council is due to consider a proposal on monday for an electronic billboard on highway 101. now, supporters say this would

bring in at least $700,000 a year that could be used to replace aging infrastructure. but critics say the billboards are distracting to drivers. digital billboards already have been put up in east palo alto, redwood city and santa clara. ed lee has pledged to respond to all of the changed dot-org petitions with a certain number of signatures. he's the first mayor in america to make the pledge. the white house has been responding to online petitions since 2011. now, the topics range from wall street reform and gun violence and -- to questions from star wars fans about the possibility of building a real-life star. these petitions from lee have called for an end to the ston- and-frisk program and also questions about protections for occupy protesters. throw the book at them. find out exactly what a bay area labor group wants to happen to b.a.r.t. managers after saturday's

investigators say officers repeatedly told the teenager, andy lopez, to drop what turned out to be a fake assault rife- - rifle. but they say the -- rifal. but they -- rifle. but they say he ignored their requests. >> the deputy fired and struck the subject one time. the subject immediately fell to the ground. >> this urban air -- this urban area, i mean, they just blast the kid. >> yesterday investigators displayed a real assault weapon right next to a fake gun, as you can see here, they wanted to show how difficult it was to tell them apart. however, many people are outraged saying the shooting was totally unjustified. the district attorney is promising a full investigation. federal law requires that fake or toy guns have a bright orange plug in the barrel and an orange stripe one-inch thick

that is supposed to be on both sides of the barrel. that's illegal to cover those markings. santa rosa police say lopez's rifle did not have an orange tip. hundreds of people gathered last night in sparks, nevada honoring the victims of monday's tragic school shooting. ♪ >> this vigil was at sparks middle school, where the shooting happened. police say a 12-year-old student shot and wounded two classmates and killed a teacher, michael landsberry. the boy later killed himself. classes at the middle school are canceled for the rest of the week. 7:16. we're just minutes away from a major immigration reform announcement by president obama he will be asking congress to you come up with a bipartisan by the end of the year. justin gray is in our washington, d.c. newsroom with details on exactly what the president is proposing.

justin? >> reporter: well, to give you an idea how important this is for the state of california, nancy pelosi says if we pass immigration reform, it would add as many as 70,000 jobs to the california economy just next year. but in order for that to happen, democrats and republicans, they will have to come together for some sort of solution. president obama will ask for what he is calling a common sense approach from the east room of the white house in about 10, 20 minutes. that would mean strengthening border security, creating an earned path to citizenship and holding employers accountable. >> there was a lot of important work achieved in the bill to pass the senate that meets the president's criteria. he believes that -- he believes there is a bipartisan majority in the house and probably a significant one that would support that similar comprehensive approach. >> reporter: john boehner says immigration is an important subject that needs to be addressed and he's hopeful something could happen before the end of the year.

we'll hear from the president here in the next 20 minutes or so. coming up at 8:15, i will break down some of the specifics of the president's proposal. live in washington, justin gray, ktvu channel 2 news. 7:17. a wyoming man accused of stealing a lawsuit in sausalito and running it aground in pacifica has been released from jail. the chronicle reports lesliealen gardner -- leslie alan gardner faced charges originally that could have led to a sentence of six years in prison but a judge sentenced him to a year in county jail with time served to access mental health services. he will be on probation for five years and has been ordered to pay $1.3 million in restitution. 7:18. halloween, just a week away now. we're already seeing some pretty unique costumes. come on, tori. that's pretty good. >> very good. >> the photographer posted this

thank you, guys. sunol grade, the traffic here is moving along relatively well. if you are driving through, no major problems here. bay bridge toll plaza is looking slow and crowded. 15 to 20 minutes. okay. so now i have the correct map up for the crash i told you about at mission and anza right near aloney college. obviously, it's causing major delays. it doesn't take much to cause delays on mission near the college. it's that much worse. let's go to steve. a little bit more of a westerly breeze there. that was nonexistent the last couple of days which is why we had the thick fog and high pressure losing its grip because there is a low coming in. that's enhancing the fog, lifting it, but also making more of a west wind kick in for some inland areas that have had calm conditions for a while. it will be a gray day for some. very cold near the coast.

a worker hurt during the filming of "chasing mavericks" is suing the production company in san mateo's court system. eric hatten says he fell when the stairs on a bank of portable toilets gave way. he injured his hip, back and ankle. his lawsuit claims the production company left the stairs in place even though they knew they were broken. the movie is about surfing off the san mateo coast, where the movie was filmed. we're learning the source of severe stomach illnesses that sickened 643 people in 25

states last summer. the cdc says outbreaks in iowa and nebraska have been linked to salad mix from taylor farms mexico. that's the branch that supplies the olive guarded and red lobster restaurants. taylor farms shut down in august after the illnesses were discovered but has been allowed to since reopen. an outbreak in texas has been linked to cilantro to a farm in mexico. dan boyle from the sharks is back to the team after suffering a nasty hit. the blues forward was sus spensded five games for the illegal hit. boyle suffered an unspecified bodily injured, the team is describing. he's not expected to play in the game against boston. tonight in the world series, game 2 with the boston red sox, hoping to take a 2-0 lead after beating the cardinals, 8-1 last night. >> here's the two out.

tackle the blaze. welcome to "mornings on 2" once again. i'm tori campbell. >> i'm dave clark. let's check weather and traffic. steve, you think people are driving with the heat on? >> and the seat warmers on. 40s, 50s you get the low cloud deck, and it will be cool. there are 30s up north. fog or sun, breezy, cooler, even if you have the sun today, i think you will notice a difference in the temperatures. 40s, very, low 50s. the low cloud deck keeping things in check. san francisco, which was 61 yesterday. i went 59 today. i think there's too much low clouds and fog. it's really not going to be -- if it's warmer it won't be that much warmer. this low will control the weather for the next couple of days. should be out of the picture by saturday it's enhancing the fog bank. it's also picked up the west wind. sunshine for some. inland, that fog will be reluxant to -- reluctant to burn off for a few. back to the 70s for many.

50s, 60s by the water. here's sal. we have troubles when it comes to the macarthur maze. northbound 880 is causing slow traffic on 880 north which is not the commute direction heading over to the eastshore freeway. it will cause slow traffic a the bay bridge toll plaza, the traffic is backed up for about a 15-minute delay. you will see some slowing there. i want to mention that traffic on the bridge is moderately heavy on the way into the city. on mission boulevard in fremont at an saw there is a crash. they are clearing it up. if you are going to aloney college, you might be late if you don't get on the road now. westbound 80 due to earlier problems coming in. i would add ten, 15 minutes to that commute between the altamont pass and dublin. that will be taking you longer. it will take you longer as well in castro valley. back to the desk. we're starting this half- hour with the breaking story we first told you about on the morning news, police in fremont

investigating a shooting that may have been sparked by road rage. investigators say the victim was driving on 680 about 5:30 this morning, when he got into a dispute with another driver. the victim then drove to the area of mission boulevard and brown road. police say there was a confrontation. one of the people was shot several times in his car. he was taken to the hospital. the shooter got away. ktvu's janine de la vega is on this story. she'll have a live report coming up at the top of the next hour. 7:33. protesters are expected at this morning's meeting of the b.a.r.t. board of directors. ktvu's claudine wong joins us live from the newsroom with more on what will be happening at that meeting and what that group of protesters is now calling for. claudine? >> reporter: well, in about 90 minutes, the board will meet for their regularly scheduled board meeting but there is a lot on their plate. in the last half-hour, i spoke with the b.a.r.t. spokeswoman who says the board will introduce a resolution this morning in honor of the two workers killed.

but we are also seeing protesters. the group is planning to rally outside of oakland. that group wants managers to face cil charges for the accident that killed the two workers. at the time of the accident, a manager was being trained to operate trains in the event of an extended strike. the ntsb spent several hours yesterday reciteal the -- re- creating the accident. >> you have to have re-created as best as mankind can an exact dueplication of the conditions in which the incident or accident, whatever phraseology you would like to use, occurred. >> b.a.r.t. has suspended a 30-year-old procedure called simple approval in the wake of the accident. this is how alicia, the spokesperson, explained the change this morning. >> we're no longer allowing workers to go on the track under the simple approval.

early this morning. you've got video of all of the flames and there was a big response from firefighters. >> yeah. they big response, dave. good morning. very unfortunate for this business owner who has been here for several years right now. i'm here with richard, the owner of the towing company. give us your reaction. i know we talked about it this morning. you've been here for several years now. damage. what's your reaction to what you are seeing? >> where do you start? building damage, vehicle damage, smoke damage, water damage. fire department cut into the building. where do you start? >> reporter: yeah. >> it's just -- >> reporter: what do we know what happened? do you have any idea on what may have started this at all? >> no. not at all. we did have an operator that was here approximately 45 minutes prior to this and everything was fine at that

point. >> reporter: from what we're hearing, this styer started around -- fire started 11:00 last night here in concord. firefighters were able to quickly put it out 15, 20 minutes later. richard, what's the situation like in the building? i know you are having a tough time getting the business up and running again, correct? >> right. yeah. we have pretty extensive smoke damage, water damage. we to have some cars that were involved to some degree. they were parked alongside the building on the inside and -- >> reporter: did the fire investigators tell you anything, does this look suspicious? >> we'll have a fire investigator hopefully back this morning to dig through to see what we can figure out. >> reporter: thank you for speaking with us. good luck to you in trying to get the business up and

running. firefighters doused it 15, 20 minutes later. as we saw from the damage, several cars that were damaged and richard told me since this is a tow facility, he will have to try to contact those owners of the cars this morning. but the first thing, trying to get the electricity back on, get the phones ringing again. for him, it's trying to get back to square one again. brian flores, ktvu channel 2 news. an oakland man who tried to stop a sideshow said he was badly beaten up for it. it happened sunday afternoon at tookhill an mack -- foothill and macarthur boulevard. neighbors complained. jack morgan said he finally took matters into his own hands. he confronted the drivers with a baseball bat but then several people attacked him. >> we don't have the protection that our property taxes pay for. >> in one sense, i don't care what happens to me or them. it has to stop. >> now, one neighbor helped to

rescue morton. he was rushed to the hospital. residents say police tnt arrive until -- didn't arrive until 30 minutes after their first 911 call. 7:38. fremont police are asking for the public's help identifying a man accused of exposing himself inside a walmart. police say the man was spotted walking up and down the aisles before he reportedly exposed himself to a 20-year-old woman shopping in the store. i want to show you a picture of this suspect from a surveillance camera. he's being described as 28 to 35 years old. 5'9" with a medium to heavy build. as you can see from the image. he was wearing a red polo shirt with a sweater vest, dark pants and had an i.d. badge around his neck. anyone with information is asked to call fremont police. tomorrow morning, the golden gate bridge district will talk about whether to raise the price of the tone. the district faces a $142

million budget deficit over the next five years. according to the district's staff report, a one-dollar toll hike could help to close the budget gap. if the increase is approvalled -- approved, it would take effect by april. the last toll hike was in 2008. most school children are taught about the very first flight by the wright brothers. we'll tell you why three states claim they were the birthplace of aviation. and new reaction to reports that the u.s. has been tapping the cell phone of german chancellor, angela merkel. traffic will be busy trying to get to the bay bridge also trying to get on the eastshore freeway. we'll explain. plenty of gray out there. much more of a strong inland push. that will equal more 70s.

phone of angela merkel and spied on her. merkel talked to president obama last night about these reports at the national security -- about the nsa listening in on her phone calls. the white house says her phone is not being monitored nor will it be in the future. they didn't comment on allegations that it has happened in the past. all of the surviving victims of the asiana crash in san francisco are out of the hospital. the only victim who remained at the hospital was finally released this week. she's now at a rehab center. doctors say she spent 109 days at sf general and had 30 dink surgeries -- different surgeries. the chief of surgery said that woman was one of the sickest patients she ever treated but is adding the woman was smiling as she left the hospital. muni is trying to better protect bicyclists in the wake of an accident. 800 buses are being inspected

to make sure they have a safety feature on the rear right wheel. it's called the s-1 guard and it's designed to protect bicyclists and pedestrians by pushing people who fall under the bus away from the wheel. the order comes after a 78-year- old bicyclist was hit and killed last friday by a bus making a right turn on bryant and 11th streets. the bus did not have the safety feature in place. >> it's not a regulatory requirement. but -- but most of our buses have them. >> friday's crash was the fourth deadly bike accident in the soma neighborhood this year. b.a.r.t.'s board of directors is scheduled to hold a vote about whether to allow bikes on trains. efb.a.r.t. has been testing a pilot program since july. the program will end december

the past 90 minutes from fremont. police are continuing to investigate a shooting linked to road rage. the dispute started on highway 680 and ended up in the area of mission boulevard and brown road. ktvu's janine de la vega is live on the scene where she's just received some new information about this case. janine, what have you learned? >> reporter: well, some scene technicians arrived at the first scene. this is the second crime scene. when they get to this one, they will be processing this scene and concentrating on that mercedes that you see there. there are several bullet holes there on the passenger side. police tell us that they believe three to six shots were fired here towards this mercedes. the man who was inside the car is now at the hospital. he's being evaluated but we've learned that he will survive. police tell us that this started as a road rage incident on the 680 in the southbound lanes at about 5:25 this morning. a driver of the mercedes and

another car exited the freeway at mission boulevard and then pulled off on a side street brown. there was some sort of confrontation between the two men. the man in the suspect vehicle, we're told, fired several shots at the man in the mare say december -- mercedes, hitting hill. police say he was hit at least three times. one of those shots was in the upper torso. the suspect then fled the scene in his car. we do not have a description of that male suspect or what kind of car he's driving. police tell us that right now, it's just too vague to put out that information. the victim then drove two blocks down mission boulevard and parked in a strip mall parking lot in front of a bank. at that point, he called 911, told them he was shot. he was then rushed to regional medical center in san jose. it appears that he is in his late 50s. police say he is from pleasanton and that right now he is sufficienting from non-

life-threatening injuries. again, after crime scene technicians process the other scene, they are going to come here and concentrate on that car. this will be a challenge for them, they said, because right now they still don't have a suspect's description. they need to interview the victim who is now at the hospital. so there are some detectives there in san jose waiting to talk to that victim. reporting live in fremont, janine de la vega, ktvu channel 2 news. 8:05. we're also following developing news involving b.a.r.t. we first told you about this at 4:30 this morning. yesterday's fire underneath a b.a.r.t. train at the orinda station. it's had an impact on this morning's commute, but b.a.r.t. is now back on track. ktvu's kristen kafton is out there at the orinda b.a.r.t. station. what's it doing? how does it feel? >> reporter: it's looking very good. a train just departed. there are passengers waiting on

the platform. this station back in business. i just texted with a b.a.r.t. spokesperson about five, ten minutes ago. she says at this point, there are no delays on the b.a.r.t. system. trains running on time. they've recovered following a train fire -- recovered delays following a train fire yesterday. we did manage to record a few seconds of video as the train began to power up and drive away on its own power. it slowly made its way out to a yard out in concord. that tied up. lines as it moved through the area. we also had video of workers clearing and inspecting the tracks following yesterday's fire. the fire started about 6:10 yesterday evening and stalled. a ten-car train as it approached the orinda station. we learned that crews had to break apart a 1200-pound piece of equipment that failed yesterday and a piece of equipment overheated, starting smoking and then it overheated the mount that holds it in

place. it dropped and crews had to use various tools to cut it apart. the train was tested to see if it could move out of the station, which it eventually did. now b.a.r.t. is saying the major commute is over. the b.a.r.t. schedule has largely recovered. b.a.r.t. will be conducting a full investigation into how this accident happened. that investigation could take three, four days. again, the headline for commuters now, b.a.r.t.'s schedule now back on track. we're live in orinda, back to you. new details about yesterday's b.a.r.t. train fire. we're also hearing some of the radio communication, the moment b.a.r.t. ownd fought about the fire -- found out about the fire at the orinda station. >> have a report of the smoke coming from car 372 on the -- [inaudible] >> that recording is from radio

reference.com. after the fire was spotted, b.a.r.t. shut down the entire pittsburg- bay point line. authorities got all passengers safely off the train. in one hour, the board of directors will hold a very important, critical most meeting -- meeting in oakland. the board will decide if they will ratify and approve the tentative deal that ended the strike on monday night. the tentative agreement must be approved by union members. the b.a.r.t. board is expected to vote after the union members vote. 8:08. dozens of angry community members took to the streets of a santa rosa neighborhood last night. >> we need justice! we need justice! [ cheers ] >> they marched through the neighborhood where a sheriff deputy shot and killed a 13- year-old boy tuesday afternoon. investigators say officers repeatedly told teenager andy lopez to drop what turned out to be a fake assault rifle.

but they say the boy ignored the orders and then turned and pointed the barrel of the fake gun right at them. >> the deputy then fired several rounds from his service weapon at the subject, striking him at least one time. the spubt immediately fell to the ground -- subject immediately fell to the ground. >> yesterday, they displayed a real assault weapon next to a fake gun. they wanted to demonstrate how difficult it was to tell them apart. many people are outraged saying the shooting was totally unjustified. the district attorney is promising a full investigation. federal law requires that fake or toy guns have a bright orange plug in the barrel and an orange stripe, one-inform thick -- 1-inch thick that's supposed to be on the sides of the barrel. happening right now, in washington, a congress tal hearing investigating automatic of the problems with the new

protesters rallying outside. claw keen? >> reporter: good morning. that meeting starts at 9:00 a.m. there are already protesters outside the building right now. we can take a live look. we want to tell you that the b.a.r.t.'s spokesperson told us about 90 minutes ago there will be a special agenda today introducing a resolution in honor of the two workers killed but this group, that's a group called united public workers for action. they are rallying because they want criminal charges to be put on the b.a.r.t. managers for this accident. the accident that killed christopher shepherd and lawrence dan yells. now -- daniels. at the time of the accident, a manager was being trained to operate trains in the event of a strike. the ntsb does continue to investigate and spent several hours yesterday re-creating the deadly accident. >> you have to have re-created as best as mankind can an exact

dueplication of -- dueplication of the conditions -- duplication in which the incident occurred. >> reporter: b.a.r.t. has suspended a 30-year-old procedure called simple approval in the wake of the accident. this is how the spokesperson explained the change for us this morning. >> we're no longer allowing workers to go onto the track under the simple approval. it's usually for a very quick thing, walk on the track and they say i'm on the track. i know it's live. i have somebody with me. he's my lookout man. he's to remain outside of the envelope. we're to always have a rescue plan in place and remove ourselves from the area within 15 seconds. these are some of the parameters that provides protection. as of right now and moving forward until further notice, we're no longer allowing a simple approval process. >> reporter: instead from now on they will get a work order which b.a.r.t. says will provide more protection.

of the damage from the late night fire from last night. you can see at least one car there that was damaged from the fire to the right of it is actually a travel trailer and then you see the extextive damage to the building on the outside. but what you don't see is there is extensive smoke damage on the inside as well as to other cars as well. pretty quick response from firefighters last night. this single alarm fire started before 11:00 last night on the 2200 block here in concord. firefighters say it started in the tow yard area of b and d towing. several firefighters came to the scene and were able to put out the flames in 20, 30 minutes and to keep it from damaging more of the building, nearby businesses and other cars parked in the tow yard. this morning, the owner spoke to us and said overall, there are between 4, 6 cars that are damaged along with the travel trailer. there's also extegessive smoke -- extensive smoke damage from

inside the building as well. >> next month is my 30th anniversary in business. this is the worst thing that's ever happened to me. you look at that where do you start? you know, it's a complete disruption of our business and our customers. >> reporter: the owner says he doesn't know how it started. fire investigators are expected to be back here on scene later this morning to see -- to see if it was suspicious. overall, though, firefighters say there were no injuries. now, if we take it back out here live, you are taking a look at three employees. the gentleman in the blue shirt is -- they are cleaning up trying to get this up and running. for the immediate need, the owner says he's trying to get power back on today. at this point, there's no electricity or phone service in the building right now. but he says that he will try to spend the morning also contacting the owners of the cars that were towed here than damaged from the fire late last night. we're live here in concord,

brian flores, ktvu channel 2 news. >> thank you. an oakland man says he was beaten while trying to stop a sideshow outside his home. it happened sunday afternoon at foothill and macarthur boulevard. neighbors say they called police repeatedly but officers took too long to get there. 69-year-old jack morton says he finally took matters into his own hands. he confronted the drivers with a bat and then several people attacked him. >> i got a number of bruises and scrapes and the -- they hit me in the head. >> a neighbor tried to rescue morton. he was rushed to the hospital. residents say officers did not arrive until 30 minutes after their first 911 call. police say they are so short staffed, they have to prioritize calls. police in fremont want your help. they are trying to identify a man accused of exposing himself inside a walmart. police say the machine was walking up and down the aisles before he reportedly exposed

himself to a 20-year-old woman who was shopping. now, i want to show you a photo of the man taken from a surveillance camera. you see it here. he's described as about 28 to 30 years old. 5'9" with a medium to heavy build. you can see he was wearing a red polo shirt with a sweater vest, dark pants and he had an i.d. badge and his -- around his neck. in lodi investigators still trying to figure out what caused a multivehicle crash that killed five members of the same family on tuesday. a vigil was held last night for those victims. a man, his pregnant wife and three of their children. the only survivor in the beam, a 9 -- family, a 9-year-old son. the mexican consulate is working with local officials trying to contact their relatives in mexico. six vehicles were involved in the wreck on tuesday. witnesses blage the crash -- blage the crash on a man -- blame the crash on a man

talking on the cell phone and speeding through the intersiction -- intersection. you may see something new across the bay bridge. work crews are planting palm trees on the oakland side. there will be 30 trees once the project is complete next spring. however, the bridge landscaping is raising questions and concerns. the palm trees stand 20 to 30 feet grow and can groi as high as 50 -- grow as high as 50 feet. that has some worried. >> my main concern is the leaves coming down and falling down on the brick. i can see it creating -- bridge. i can see it creating danger. >> caltrans says each tree will cost about $15,000 to acquire and plant. that's about half of the budget for the $900,000 bridge landscaping project. >> can you imagine? palm trees? >> yeah. it would like nice, anyway. it may cost you more money to go across the golden gate bridge.

several cars, but luckily no one was hurt. and in fremont, sa -- a car was riddled with budgets. police say -- bullets. police say it started with a disrupt. investigators say one driver may have been mad that the other was driving too slow. janine de la vega is back now in from -- fremont. the police just made an announcement. what's the latest? >> reporter: well, the spokeswoman told us they are investigating this as an attempted homicide. they roped off this parking lot area here in front of a bank and a doughnut shop on mission boulevard. this is where the victim's bullet-riddled car is parked. now, we learned that the victim had a dog in the back seat when another man opened fire. police say this started as a road rage incident on 680 at about 5:30 this morning. the two drivers pulled off on

the mission boulevard exit onto brown street. there was some sort of confrontation and a male suspect in another car fired multiple shots at the her say dietz while the victim was sit -- mercedes while the victim was sitting inside. a detective told us earlier this morning that that victim was hit three times after he was shot, the victim actually drove down mission boulevard where he parked and then called 911. he was rushed to the hospital. we're told he's being evaluated but is suffering from non-life- threatening injuries. the suspect's whereabouts are unknown. police told us that the victim briefly told them what happened -- what happened and what may have sparked this to happen. >> the early information is maybe that one of the two parties involved was driving too slow and the other party was upset with that but as to what exactly transpired and what the events were, we're not 100% sure still. >> the victim had his german shepherd in the back of the

car. the dog was not hit. officers were originally concerned about the dog because it wasn't moving a lot. but it is being taken to a shelter until the owner can go pick him up. police still need to reinterview the victim who is at regional medical center in san jose to get more details and possibly a suspect description and a description of the car. they are going to be seeing if they can get their hand on any sort of surveillance video that may have shown the incident. any sort of help they would like especially from drivers who were on the road on 680 who may have witnessed this apparent road rage incident. just wanted to give you a little bit more information about the victim in this case. we're told he's from plonton and he's in -- pleasanton and he's in his late 50s. reporting live from fremont, janine de la vega, ktvu channel 2 news. >> thank you. muni is working to better protect bicyclists in the wake of a deadly accident in san francisco's soma neighborhood.

800 buses are being inspected to make sure they have a safety feature on the rear right wheel. the s-1 guard is designed to protect bicycle its and pedestrians by pushing people who fall under the bus away from its wheels. the change has come after a 78- year-old bicyclist was hit and killed last friday by a muni bus making a right turn on bryant and 11th streets. >> at some point all of our buses do have the s-1 guard installed onto their bus. >> the san francisco kronicle reports the -- chronicle reports the bus in the crash did not have a safety guard. friday's crash was the fourth deadly bike accident in the so ma neighborhood this year -- soma neighborhood this year. b.a.r.t.'s board is scheduled to vote whether to allow bikes on trains. they've been testing a pilot program allowing riders to bring their bikes since july. the program will end december 1st unless the board votes to
