a little breezy. 30s for some. 40s and 50s. the north bay, mostly sunny skies. but some patchy fog forming there. the low will send in clouds. the low clouds are there but they will burn off. even if you had the sun, it was breezy and cool. 70s for some today, 50s and 60s for others. here's sal. we're looking at a couple problem spots. this is in the east bay. we also have a look at the commute on the nimitz freeway northbound in the area. this might be affected by a crash southbound 880 north of alvarado niles road. the traffic may be affected in both directions and then we're getting word of a crash westbound 92 near the toll plaza of the san mateo bridge. now, the crash is reported before here. so the traffic after the san mateo bridge looks pretty good heading out to the high rise as you can see. by the way, since i'm looking at this, it reminds me planes usually come in over the san

mateo bridge. low ceilings are causing flight delays of about an hour at sfo. 48 minutes. we'll call it an hour. as you come into the city, you might want to check with your carrier. every delay is different. quickly, we go to the bay bridge. not all that bad. it's about a five-minute wait. back to the desk. >> thank you, sal. topping our news -- a tragic accident in menlo park. a driver hit and killed two people out for a walk with their dog last night. ktvu channel 2 reporter janine de la vega is live with what family members of the victims are saying about this crash. good morning, janine. >> reporter: good morning, tori. yes. such a tragedy and the family of the victims just came out here in the last half-hour. they wanted to see how this accident happened here and look at the broken branches. you see one of the family members there here. she wanted to take a look here at the scene. the couple lives in menlo park. we're told that they have three children under the age of 18

who are grieving the loss of their parents. now, here's some video of the aftermath that ktvu took last night. police say just before 7:00, a man and a woman in their 50s were out walking their dog when a darr crashed into all -- car crashed into all of them. it swerved into oncoming traffic, clipping a car with four people inside and hitting a tree. when emergency crews arrived, the couple was pronounced dead and their dog was injured. the four people in the other car were not harmed. police say 54-year-old marjorie reitzel of red road city was behind the -- redwood city was behind the wheel that did all of the damage. police suspect she was drunk. the family and friends are in disbelief. they say the couple loved taking evening walks. >> the loss, unbelievable. very painful. oh, my god. i hope these people don't drive when they are trinkging-- drinking. stay off the street, you know. >> reporter: rery. tzel is peaking treated at the

hospital -- reihzel is being treated at the hospital. she will be looked for manslaughter and dui. the family has identified the man who died as baldel singh and his wife, they are fromfygy. they are from -- they are from fiji. they spent all of last night with the three children who are obviously taking this very hard. reporting live from menlo park, janine de la vega, ktvu channel 2 news. >> thank you. more details now -- menlo park police had just been awarded a $52,000 grant to help reduce the number of dui crashes. the money that came from the state department of traffic safety will be used for dui training, checkpoints and serving warrants on repeat dui offenders. there's also money for cracking down on distracted driving and

seat belt violations as well as speeding. new this morning, the san francisco giants reportedly are bying investigated accused of -- being investigated accused of not paying some workers. an organization called fair warning says the labor department is investigating both the giants and the miami marlins for possible federal wage law violations. it reportedly involved the possible un-- them possibly not paying interns. so far we haven't heard any comment yet from the giants. fair warning leads reports on safety, health and corporate conduct. later today, law enforcement agencies all over the nation are converging on oakland for urban shield. it's a training exercise for law enforcement. now the alameda county sheriff's office is warning visitors that the occupy oakland protesters are expected

to show up at ethe vent -- up at the event. katie utehs is live where the protests are planned for 9:00 this morning. >> reporter: yes. the protests are planned for 9:00. we have yet to see any folks from occupy. at this point a lot of law enforcement converging here at the marriott. i'm joined with alameda county sheriff's office pio, sergeant nelson. what's so exciting about this year's event and why do you think it's important to the community? >> well, this year like every other year is exciting because you are combining police, fire, ems and it tests our resources and our ability to respond to any kind of event that could occur. these scenarios are based on real world events that have happened. it's not like we're making things up. we want our area to be prepared. >> reporter: some of the occupy protesters say they are concerned about some of the vendors who are telling weapons and they are coming out here this morning to picket. do you have any concerns about the pretesters in -- protesters

interacting with the law enforcement? >> i don't have any concern about that. i know oakland police have a team that's ready to handle anything that may occur. i don't anticipate anything to happen. the protesters here represent a very small segment of society and most of the military of people that live in the bay area want a well-trained police, fire and ems system to help them if something happens. >> reporter: thank you. the protesters plan to be here around 9:00. oakland pd is bringing in extra officers because today also happens to be the second anniversary of the eviction of those occupy protesters from city hall. so in addition to this morning's picket there is a march planned for this afternoon. opd bringing in extra officers, okaying some overnight. but they say the pickets are supposed to be peaceful. katie utehs, ktvu channel 2 news. >> thank you. we have new information now about a missing man in

berkeley. police say 59-year-old jared jacob was last seen at the berkeley marina on wednesday. officers found his wallet inside his locked truck at the marina. no word on how or why he disappeared. he was wearing a black san francisco giants cap, a jersey and blue jeans. police hope an autopsy will help police determine how a woman died near a clinic. the 58-year-old woman was found outside of the veterans affairs clinic on martin luther king way yesterday morning. police say her death does not appear to be suspicious but are still waiting for autopsy results. hundreds of east bay m.u.d. workers threatening to go on strike because of stalled contract talks. >> the ball is in their court. they are the ones that will dictate how this moves and the pace it moves. >> americans of the federation held these picket lines --

picket signs in front of the east bay m.u.d. signs in front of the building. they will go on strike if they don't offer an increase on the 4% cap they have now. california gun rights groups say they are planning recall petitions against several state lawmakers who have supported gun control. now, the recall efforts are targeting state state assembly speaker john perez and four other southern california democrats. now, that's because of the lawmakers' votes in favor of recent gun control bills. the pro gun groups say they are encouraged by the successful recall of two colorado lawmakers because they supported weapons restrictions. 7:10. an historic santa cruz cemetery has recently become a hangout for the homeless. evergreen cemetery is near harvey west mark. police say they often see

homeless people sitting on the concrete memorials and tombstones. they've been getting complaints from loved ones about cigarette buts and drug paraphernalia and other things being left around the graves. san jose police are still searching for a driver accused in a deadly hit-and-run crash over the weekend. the police say the victim, the 43-year-old woman, was walking on the capitol expressway just after 1 sunday morning when hit near center road. was rushed to the hospital but died tuesday night. >> grieving deeply. >> police say the suspect vehicle may have a broken window and front-end damage. anyone with information is asked to contact san jose police. your time now 7:11. where are the bay area's worst potholes? there's a new report that says

roads in marin, napa and sonoma counties are among the worst. the metropolitan transportation commission says st. helena, larkspur and sonoma county had the worst roads in the bay area last year. now, this comes as voters in larkspur consider a sales tax measure to pay for improving the roads. this new report says brentwood, dublin and el cerrito had the best bay area roads in 2012. the governors of eight states including california signed an agreement to put millions of electric cars out on the roads. supporters say this agreement means at least 3.3 million cars that emit zero emissions will be on the road by 2025. now, the state is hoping to meet the goal by charging more electric charging stations and also introducing tax breaks for the eco-friendly cars. the eight states taking part in the plan make up 23% by the way of america's auto market. >> that's a lot of cars. >> that's a lot of cars.

welcome back. 7:15. there are some new developments in the deadly limo fire that killed five women on the san mateo bridge back in may. while no criminal charges were

filed, family members of the victims are now filing several civil suits. ktvu's brian flores live in our newsroom now to tell us who the families are blaming for the fire. five women were killed including a new bride, brian. >> that's right, dave. at least camp pendletons are named in the civil -- at least five companies are named in the civil suits. the family is blaming negligence. the civil suits were filed in san mateo county yesterday and ktvu was able to obtain those documents as well. now, out of those companies, the biggest name in the civil suit is ford motor company which made the 1999 lincoln town car that caught fire in may. the other defendants include accubuilt, bay area limousine repair. a few months ago, prosecutors decided not to file criminal charges. the driver was cleared. he was not named in the civil suit. but one of the attorneys representing one of the

companies says he knew the civil suits were climbing. he said he will defend his client throughout the process. >> the vehicles had routine -- routine mant ebs. it was last in the shop two weeks before the incident on april 18 -- maintenance. it was last in the shop two weeks before the incident on april 18th. so i don't know what more they could have done from a maintenance standpoint. >> the plaintiffs call the car dangerous, hazardous and unsafe. five women died and four others were injured. one of the victims killed was the 31-year-old woman, a new bride. now, the complaints did not specify a dollar amount as well. ultimately, it will be up to a jury to decide that if it goes to trial which some say could take at least a year. in the newsroom, brian flores, ktvu channel 2 news. >> thank you. meantime, the mexican government is helping the family of five people killed tuesday night in a horrible

crash in lodi. a man, his pregnant wife and three of their children were killed in this crash. it involved six vehicles. the couple's 9-year-old son was the only survivor. he's still in the hospital in critical condition. well, now the mexican consulate in sacramento is trying to help out. they want to bring the boy's grandparents in from mexico to be at his bedside. norway has turned town a u.s. request to help destroy syria's chemical weapons. the foreign minister says the company had given serious thorough consideration to the u.s. request but that norway does not have the experience or capability to carry out such a task. several other countries are being asked by the u.s. the u.s. and russia have set a deadline of mid-20 14 for the destructiontion of the -- destruction of the chemical weapons. california's fair practices commission ordered the largest fine ever for campaign

disclosure violations. the $1 million fine was leveed against two arizona-based groups for failing to disclose the donors of anti-tax and antiunion campaigns right here in california. the fair political practices commission says the two groups are part of the conservative coke brother networks that finances conservative causes nationwide. the director of the lawrence livermore national laboratory will step down at the end of the month. he says he will pursue broader interests relating to national security. he made the announcement yesterday. some employees were surprised. he's been the director of the laboratory for the past two years. 7:19. we want to check in with sal and see how things are going this friday morning after a rather hectic rest of the week. >> you can say that again. we just had an injury crash westbound 80. chp is just arriving on the scene at gilman. we have a camera there. it's a little tough to see

because -- well, it's right there at the top of the screen where it's kind of tough to see. but a couple of lanes are blocked up there and traffic is going to be slow. now, you notice that after the -- after the accident, the traffic does get lighter because there is a lane blocked westbound 80 at gilman. >> the lights are flashing up there. it will be one of those things where it will slow traffic in richmond. if you are driving into berkeley. let's move along and take a look at the toll plaza, this is about a five-minute delay before you make it on the brick. we are also talking about crashes on 880 southbound 880 near alvarado. that crash is off to the shoulder but traffic is slow out of hayward. let's go to steve. thank you, sal. very good morning. a nice sunrise. there's still some low cloud deck around. definitely some breaks. a little of this, a little of that. temperatures are cold for some. not too bad for others. the source of the higher clouds is the olow out here.

fruit flies in santa clara county have a tiny target on their backs. a new program begins this morning. bait stations will be placed in a ten-mile square area around highway 85 and de anza where two oriental fruit flies were found. the smear will be out of

people's reach. a survey by the research firm pitch book found 190 stanford grads received venture capital money between 2010 and 2013. uc berkeley came in with 162 grads getting funds for their startups. the university of pennsylvania, harvard and m.i.t. round out the top five. now, teenagers may be losing interest in facebook. according to a new study, only 23% of teens in the piper survey said facebook was the most important social media website. 42% said the same thing a year ago. the teens cited privacy concerns and also online bullying as some of the reasons they are losing interest. the teens named twitter the most important site. this is a tense time of year for many runners as we move into the peak of the fall marathon season. many long-distance runners are seeking charitable donations from family and friends to help them secure a spot in a

hayward southbound 880 it's backed up from lelelling down to un you why city. we had a -- union city. we had a couple of earlier crashes. if this were monday, i think we'll be backed up into oakland. you can see by looking at the read sensors, it looks good. we had the crash in berkeley, i told you about. the backup into richmond, they moved it to the side and the backup is going away which is nice. let's go to the eastshore freeway. the lanes were blocked there briefly at gilman. the traffic is busy heading down to berkeley. northbound 280 now. that looks nice right through downtown san jose. back to the desk. thank you. we have more now about the deadly police shooting near santa rosa. 13-year-old andy lopez. sheriff's deputies say lopez was shot because he was holding what looked like an a.k.-47 rifle but the gun was fake.

there was a memorial in the area last night and another is planned for today. tara moriarty is near the school where andy lopez attended. >> reporter: that's right, lawrence cook mill -- middle school. students are planning a noon march and rally. it will start at city hall and go to the sheriff's office. a lot of them were wearing sweatshirts with the 13-year- old's image on it. there were sad an confused. last night -- and confused. last night hundreds came out. an autopsy reveals that the 13- year-old was shot seven times. two of those ones fatal. according to santa rosa police, the deputy fired eight shots within ten seconds at the boy. >> the community needs to feel there's transparency and honesty from law enforcement as they go forward and

investigate. i think if there's no feeling of that, that this healing, this bringing will not happen -- bringing will not happen. >> reporter: the rifle that lopez had did not have an orange tip on the barrel that's required for replica rifles. we're hearing that the tip broke off when he dropped it. justice for andy's facebook page has 14,000 likes. his mother has posted thank you to supporters in spanish. we'll be at the noon march and we'll bring you more details as we learn them. live from santa rosa, i'm tara moriarty, ktvu channel 2 news. >> thank you. 7:34. happening today, a meeting that could make crossing a bay area landmark a little more expensive. the golden gate bridge already charges some of the highest tolls in the bay area and they

could soon get higher. the bridge district board meets at 10:00 a.m. this morning to consider raising the toll to $7. right now it costs $5 to cross the bridge with fastrack. $6 without. board members say the higher tolls may be necessary to deal with the projected deficit over the next five years. >> the projects that have been out on the horizon are now here. we have to do them now. so our deficit has grown. >> the bridge district says it's already made internal budget cuts which is replacing toll takers with electronic payments. the b.a.r.t. strike may be over but there's still a tremendous amount of tension between management and unions. several union members attended the meeting and they blame the b.a.r.t. board for last week's deadly accident. two track inspectors were killed during a training run on

the second day of the b.a.r.t. strike. >> the arrogance with which these entire negotiations were handled are offense and now we have two -- offensive and now we have two people dead. >> this would be a quiet time for them and not filled with everything that's been happening. >> this comes as both union members and the b.a.r.t. board get ready to vote on the new contract. meanwhile, we're learning new details about what sparked that fire on a b.a.r.t. train filled with rush hour commuters. it happened wednesday evening at the orinda b.a.r.t. station. investigators say an electrical motor overheated. but the age of the train may also have been a factor. b.a.r.t. says the car that caught on fire was part of the oldest fleet of any major u.s. transit agency. the vast majority of b.a.r.t.'s trains were first put into service back in 1972.

7:36. the teenager arrested for shooting and killing a woman this week was the victim 'son. the -- victim's son. the 17-year-old is in juvenile hall in fairfield. he's been booked on one count of homicide. investigators are not releasing his name. they think the boy shot his mother several times. >> that's tragic. a child killing their parent. nothing gets that bad. >> now, ms. brown was 35, had a baby, believed to be less than a year old. the baby is in the care of relatives who told police they didn't know about any tension between the mother and her son. the police investigation continues. an update on a story we told you about yesterday and showed you here on the ktvu channel 2 morning news on "mornings on 2." a man is recovering from very serious injuries after being shot in a road rage incident in fremont. it happened about 5:15 yesterday morning. the victim pulled off 680 onto

mission boulevard. police say the shooter may have been angry because the victim was driving too slow. now, the shootert described as a -- shooter is described as a latino or portuguese man, 25 to 30, dark hair and with a widow's peak. if you have any information about this, get in contact with fremont police. economists say twitter is trying to avoid the same criticism facebook received when it went public last year. twitter announced it's setting a price of $17 to $250 a share for its -- $20 a share for the public offering. the san francisco-based company wants to sell 70 million shares and raise more than $1.5 billion. facebook was criticized for pricing it's initial shares too high at $38 each. and federal investigators say they found no evidence of wrongdoing in a much publicized fire that damaged a tesla car near seattle. the national highway traffic

safety administration says there are no indications of safety violations or safety defects. the fire earlier this month happened after the all-electric car ran over a metal object that pierced the car's battery. 7:38. police arrested a site supervisor at the 49ers new stadium and accuse him of grand theft and burglary. now, he's identified as 37-year- old vincent john latona. he works for cupertino electric. police say he stole materials that included copper wiring but it's not clear if those materials would have been used on the project itself. investigators say the stolen items belonged to his employer and they were stored in cupertino. he's being held on $400,000 bail. well, they've found the body of an abalone driver reported missing off the sonoma county coast. 56-year-old craig wills of timber cove. he was found yesterday, near where he was last seen at fisk

mill cove in salt point state park. he disappeared on monday. an autopsy is planned. 7:39. governor brown is asking the nation's highest court to allow california to send more inmates out of state. it's one of the ideas to reduce prison overcrowding. the governor is currently appealing a federal court's decision blocking him. he's asking for three extra years to end overcrowding. he says he needs more time to implement his ideas which include expanding contractors with private prisons and increasing state funding for probation programs. the search is on for california's first big powerball winner. someone in fresno county bought a powerball ticket on wednesday that is worth $213 million. the winner still has not come forward. but the owner of a fast and easy store gets $1 million just for selling the winning ticket.

officials hope to finish the demolition before the first anniversary of that horrible attack this december. also earlier this morning, hours ago, police arrested a how fast-taking gunman in north carolina after a long standoff -- hostage-taking gunman in north carolina after a long standoff at a pharmacy west of charlotte. now, he reportedly took at least three hostages and fired shots at the first officers to respond. the man eventually allowed the hostages to go free and then several hours later he gave himself up. a san francisco police sergeant has pleaded not guilty to drunk driving and hit and run charges. this is video of thomas heymond during an interview in 2006. police say when he hit a parked car in the sunset district two weeks ago, his blood alcohol level was more than three times the legal him it of -- limit of .08. officers say he did not stop.

december. we didn't know the exact date. now we do. asiana flight 214 crashed at san francisco international airport july 6th. three passengers were killed. the ntsb hearing will be held in washington, d.c. a congressman from california is being called a hero for helping a man who lost consciousness during a flight. freshman congressman raul ruiz is also an e.r. doctor. he helped save that passenger's flight. he was on a flight from washington, d.c. to texas. the passenger who became ill is a man in his 60s. he's a diabetic who, according to ruiz, stood up and then collapsed. >> applied oxygen and applied the automatic defribrillator on him and he passed out twice. >> now, ruiz said he made a medical judgment that this man's worst-case scenarios were very severe. he got the flight crew to divert the plane and land in

last night, five people in north carolina were hurt when an amusement park ride malfunctioned at the state fair. the ride is called the vortex. it stopped and the operator was helping people get off. when the ride started up again. the ride operator was among those who was hurt. witnesses say they heard a

de la vega is live with what family members have just tolder -- told her about the crash. good morning. >> reporter: good morning. about ten family members of the victim just left the accident scene they went back to the couple's home where the three children are mourning the loss of their parents. you can see what's left of the accident scene. family members just stared at these mangled trees just devastated. here's a picture of the couple and their three children who are now teenagers. relatives identified the couple as 51-year-old balder singh and his wife, in her late 40s. they lived in menlo park and were originally from fiji. their relatives are breeferning and can't believe the couple is gone. we also have video of the accident that ktvu took last night. police say just before 7:00, the couple was out walking their dog when a car crashed into all of them. it swerved into oncoming traffic. clipped a car with four people inside and hit the trees. when emergency crews arrived, the couple was pronounced dead.

their dog was injured. the four people in the other car were not harmed but police say 54-year-old marjorie reitzell of redwood city was behind the wheel of the car that did all of the damage. relatives say the couple sea children just found out their parents were gone when police knocked on the door at midnight and told them and their grandparents. >> drunk people have done this. now everybody is suffering. >> ty am here for you guys, i -- i'm here for you guys, i told them. i'll be your father. >> reporter: reitzell is at the hospital. she will be booked for involuntary manslaughter of and dui. this is the road, chilco street here. this is where the couple was walking. they were actually walking in the bike lane here, and the car crossed across that center

divide. there are no sidewalks. so police believe that's why they were there in the bike lane and got hit. reporting live from menlo park, janine de la vega, ktvu channel 2 news. >> thank you, janine. more details now, menlo park police had just been awarded a $52,000 frant to help reduce the -- grant to help reep dues the number of dui crashes. the money will be used for dui training, checkpoints and for serving warrants on repeat dui offenders. there's also money for cracking down on distracted driving and seat belt violations as well as speeding. new this morning, the san francisco giants reportedly are being investigated for not properly paying some of their workers. an organization called fair warning says the labor department is reviewing both the giants and the miami marlins for possible violations of federal wage laws. reportedly, there was improper use of unpaid interns.

back in august, the giants settled another wage dispute. they agreed to pay more than $500,000 to 74 lower level employees. so far, there's been no comment on this from the giants. happening later today, oakland hotels are packed with law enforcement officers from all over the country. they are in town for what's called urban shield. a three-day training competition. occupy oakland protesters say they will be pickets that event this morning. ktvu's katie utehs is live at the oakland marriott hotel. you've been out there all morning where the protests are due to take place. katie? >> reporter: dave, the protest is scheduled to take place within the next hour. occupy oakland protesters say they are upset about the military-like scenarios that take place during urban shield and they will be taking place all weekend in the bay area. the alameda county sheriff's office organizes this event. it's been a long-standing event. they say they've not had any

problems up until this point and that it benefits the entire area having people train in these types of scenarios. let me show you some video from last year's urban shield. s.w.a.t. teams practice natural disaster scenarios and terrorist attack scenarios. this year, they will re-create a sandy hook school shooting scene. they work with scenarios that have happened within the last 12 months. as part of the three-day event, officers and deputies have the opportunity to purchase weapons and equipment from vendors located here inside the marriott. occupy protesters are upset about the weapon but sergeant nelson with the sheriff's office says it's a good opportunity for officers to test new equipment. >> there are weapons of manufacturers here. i think there may be four out of the 200 vendors that are here. we are law enforcement. that's part of our business. we do have weapons that -- i don't think that's any surprise

to anybody. so therefore, they are here. >> reporter: today is the two- year anniversary of the eviction of occupy protesters from oakland city hall. oakland police are stepping up patrols both of this event and other events throughout the day. they've authorized overtime and notified other agencies. should the protests get out of hand, there's also a march scheduled for the evening. there will be s.w.a.t. scenarios throughout the bay area this weekend. you will want to have a lookout for the scenarios. they are not real. they may look very life-like. coming up in my next report, i will tell you specifically about a senator grow this year -- scenario this year planned for the bay bridge. katie utehs, ktvu channel 2 news. >> we have new information about a missing man in berkeley. police say 59-year-old jared jacob was last seen at the berkeley marina on on wednesday -- on wednesday. investigators found his wallet inside his locked truck parked

at the marina. but there's still no word on how or why he disappeared. he was last seen wearing a black san franciscos cap, a black giants jersey and blue jeans. police are hoping an autopsy will help determine how a woman found near an oakland clinic died. this occurred on martin luther king way and second street yesterday morning. police say her death does not appear to be suspicious. but they are still waiting for autopsy results. hundred of east bay m.u.d. workers threatening to go on strike because of what they call stalled contract talks. >> the ball is in their court. they are the ones that will dictate how this moves and the pace with which it moves. >> members of the state county and municipal county held picket signs yesterday in front of the east bay m.u.d. offices in oakland. the workers say they will go on strike if management doesn't offer a pay raise above the 4% cap that's offered in the

negotiations. east bay m.u.d. says they don't consider the talks stalled and will continue to negotiate with the union r. california -- with the union. california gun right brumes are recalling -- frups are -- groups are recalling gun control bills. the pro-gun groups are encouraged by the successful recall in colorado because they supported weapons restrictions. >> an historic cemetery has become a hangout for the homeless. it's right near har very west park. police say they often see homeless people sitting on the concrete and the memorials. they've been getting complaints about debris being left near

the graves. the owners of the property are urging police to increase patrols and hope to get help from volunteers. 8:-- 8:10. the governors of eight states including california have signed an agreement that will put millions of electric cars on the road. this means 3.3 million cars that emit no emotions will be on the road by 2025. the states are hoping to meet the goal by installing more electric charging stations and also introducing new tax break for eco-friendly cars. the eight states involved in the plan make up 23% of all of the cars in america. 8:11. hundred of supporters hold a memorial where a 13-year-old was shot and killed by a deputy. >> no reason why trained professional law enforcement officers had any reason to kill a 13-year-old. >> the new information we learned just this morning. they've been cleared of any

8:14. new developments in the deadly limo fire back in may that

killed five women including a new bride on the san mateo bridge. now, while no criminal charges have been filed at this point, family members of the victims are now filing civil lawsuits. ktvu's brian flores live in our newsroom now to tell us who the families are blaming. brian? >> well, dave, the victims' families are claiming wrongful death and negligence at least against five companies involveled in the production and maintenance of the limousine. the civil suits were filed yesterday. ktvu was able to obtain copies of the documents. out of the companies, the biggest name in the civil suit is ford motor company which made the 1999 lincoln town car that caught on fire back in may. the other defendants named in the lawsuit include -- >> a few months ago, prosecutors decided not to file criminal charges. one of the attorneys representing one of the companies said he knew the

civil suits were coming. >> as i understand the highway patrol report, the cause of the fire was -- the drive shaft rotating on -- on an undercarage of the vehicle. i don't know how my client do have foreseen that -- could have foreseen that. >> he went on to say that the car was routinely maintained and was checked out before the incident. the attorneys for the victims' family allege defects in design and manufacturer, calling the car, hazard out, unsafe. five people died, four others were injured on the bridge back in may. the complaints did not specify a dollar amount. the driver of the limo was cleared of any criminal wrong doing and was not named in the civil suit. brian flores, ktvu channel 2 news, reporting from the newsroom. the government of mexico is helping the family of five people killed tuesday night in a horrible crash in hoe tie. a man -- lower die.

a -- lodi. a manned, his pregnant wife were killed in the crash. it involved six vehicles. the couple sea 9-year-old son was the only survivor, still in the hospital in critical condition. now the mexican consulate in sacramento is trying to help out. they want to bring in the boy's grandparents from mexico to be at his bedside. new this morning, german officials will travel to the u.s. to talk with the white house and the nsa about spying allegations. that's after reports that the nsa had tapped the personal cell phone of bermen chancellor -- german chancellor merkel. allegations of u.s. spying were widely discussed at a european summit in belgium. many want the u.s. to agree on new surveillance rules with them. u.s. officials are alerting some foreign intelligence services that documents detailing their secret cooperation with the united states have been obtained by former national security agency

contractor, edward snowden. the material in question does not deal with nsa surveillance but primarily with standard intelligence about other countries' military capabilities. 8:17. voters will decide about a controversial plan for a condominium project on san francisco's waterfront. now, the proposition b calls for building 134 high-rise condos on washington on embarcadero streets. supporters say this would create a new waterfront park and also hundreds of jobs. but critics say the project would block views and create luxury housing that few people can afford. >> i think anybody walking, jogging along the waterfront can -- it's very obvious to realize we need an upgrade. >> we're against them because it would take our waterfront backwards to the days we had a freeway blocking off the

recovered. we had reports of traffic being slow from as far back as silver avenue but things are beginning to wind down there fortunately. also looking at the commute here at the bay bridge toll plaza, it's about a five to ten- minute delay as you drive through. there's reports of a new crash in the area of the macarthur maze. 580 near macarthur. so we'll be looking for that. right now, it's just a report. the chp has not arrived yet. this is a look at the 580 commute here coming in through. it's not a bad commute. however, 880 is little slow as you drive from san leandro to oakland. let's go to steve. thank you, sal. my goodness yesterday was gray, gray, gray. even if you had the sun, it was breezy. a at least today is bet -- at least today is better. we have some fog up there popping up in the sonoma county. but mostly clear up there. the low clouds favoring the peninsula and the south bay. it will burn off sooner. most of the coast, except for

westbound bay bridge, the fire -- i'm sorry. the backup has grown as you come up to the toll plaza. that's backed up for about a 15- minute delay before you make it through. i want to mention that today has been a good day in the south bay. it had a relatively light commute on 280, 101 and 85. pack to the desk -- back to the desk. we have more about the deadly police shooting near santa rosa of yand -- of yandy lopez -- andy lopez, the 13- year-old shot carrying a replica of a rifle. last night, there was a memorial held and another event is planned today. ktvu's tara moriarty is in the area now. you are near the school that he attended. you have new details about what happened out there. >> reporter: friends here are planning a noon march in honor of andy lopez. many will be walking out of

class, their parents will pick them up and head downtown to demonstrate. many are confused about how something like this could happen. last night, hundreds of supporters came out where lee pez was shot and killed -- lopez was shot and killed. an autopsy revealed that the 13- year-old was shot saven times. two of those wounds fatal. according to santa rosa police, the deputy fired eight shots within ten seconds of a boy he believes was holding an ak-47 assault rifle. ryan fong, a classmate, says the news of his death spread quickly. >> we all heerd it and it was -- heard it and it was depressing. no one was talking. so much crying. we're planning the march from roxy to city hall because we want justice for andy. >> reporter: wednesday police showed the fake that gun that

lopez had -- showed the fake gun that lopez had. there was no tip on the barrel that's required for represently call rifles. there's 14,000 likes on the justice for andy facebook page. they will march up mendocino avenue. it are take them at least an hour, they say. tara moriarty, ktvu channel 2 news. new this morning, the ntsb says it will hold investigative hearings on december 10th and 11th on the deadly asiana airlines crash in san francisco. earlier this week, we told you the recent government shutdown forced the ntsb to postpone the hearing from november to december. the hearing will be held in

washington, d.c. the b.a.r.t. strike may be over but it's clear there's a tremendous amount of tension between b.a.r.t. management and its unions. several union leaders attended the meeting in oakland and they blame the b.a.r.t. board for last week's deadly accident on the b.a.r.t. tracks near walnut creek. two track inspectors were killed during a training run on the second day of the b.a.r.t. strike. >> the arrogance with which these entire negotiations were held, it's offensive and now we have two people dead. >> this is something we've been warning about. we told the public and you. >> i'm sorry this wouldn't be a quiet time for them and filled with this. we're learning more details

about what sparked a fire on a b.a.r.t. train. this happened wednesday evening at the orinda b.a.r.t. station. investigators say an electrical motor overheated but the age of the train may also have been a factor. b.a.r.t. says the car that caught on fire was part of the oldest fleet of any major u.s. transit agency. the vast majority of b.a.r.t.'s trains about first put into service in 19 -- were first put into service in 1927. a meeting that could make crossing a bay area landmark a little more expensive. the golden gate bridge already charges some of the highest tolls in the bay area. they would get higher. the board meets at 10:00 to consider raising the tolls to $7. right now it costs $5 with fastrack. $6 without. board members say the higher tolls may machine necessary to deal with the projected $142 million deficit over the next five years. the projects that have been out on the horizon as part of

the projection are now here. we have to do them now. our deficit has grown. >> the bridge district says it's already made internal budget cuts such as replacing toll takers with electronic payments. the teenager arrested for shooting and killing a woman in vallejo earlier this week was the victim's son. the 17-year-old is in the solano county juvenile detention center in fairfield. he's been booked on one count of homicide. investigators are not releasing his name. they think the boy shot his mother several times. >> that's tragic. a child killing their parent. nothing gets that bad. brown was 35 -- >> brown was 35. she had a baby believed to be less than a year old. the baby is with relatives who told police they did not know about tensions between the mother and the son. police are still trying to determine a motive. an update on a story we

brought you yesterday on ktvu channel 2 morning news, a man is recovering from serious injuries after being shot in a road rage incident in fremont. it happened about 5:15 yesterday morning after the victim pulled off 680 onto mission boulevard. police say the shooter may have been angry because the victim was driving too slowly. anyone with information on his identity is asked to contact fremont police. 8:39. economists say twitter which is about to go public is trying to avoid the same complaints that facebook got when it went public last year. twitter says it's setting a price of $17 to $20 a share for its ipo which may happen next month. twitter wants to sell 70 million slars and raise more than -- shares and raise more than $1.5 billion. facebook got a lot of criticism forel raising the shares too

weapons and equipment to the officers. a tragic accident last night in menlo park. a driver hits two people who were out walking with their dog. now, the driver is facing charges of driving under the influence. ktvu's janine de la vega has been on this story since early this morning. you are back now. you've talked to family members after that arrest was made. janine? >> reporter: dave, the family members are obviously grieving. they are just devastated. but they are also angry. that's because police say the couple was walking here on chilco street and then the car kept traveling across the center divide and then mowed down several trees that you see right here that are all new mangled and broken. now, let's go to a picture that we just got of the couple with their children who are now teenagers. the family identified them as 51-year-old singh and his wife

tfl she -- she was in her late 40s. family became concerned when the couple didn't return with the dog. >> i'm very confused. i lost my brother. i'm pretty sad for the family right now and -- i have no words. when i look at the little kids over there, sleeping with me and all, making them go to bed and stuff. it's sad. >> reporter: police say the couple was walking in the bike lane before 7:00 last night when the driver truck and killed them from behind. again, the car continued to travel across the median before clipping another car and then crashing into the trees. police arrested the driver, 54- year-old marjorie reitzell of redwood city for involuntary manslaughter and driving under

the influence. relatives of the couple had harsh words for that suspect. they visited the crash site earlier this morning. they tell us that singh and his wife are originally from fiji but they live here in menlo park. they describe them as hard- working beautiful people that wanted the best for their children. we were told by relatives that they have two girls and one boy. they are all teenagers. reporting live from menlo park, janine de la vega, ktvu channel 2 news. >> menlo park was just awarded a $52,000 grant to represent deruse -- reduce crashes. the money will be used for dui training, for checkpoints and also for serving warrants on repeat dui offenders. there's also money set aside for cracking down on distracted driving and seat belt violations as well as for speeding. >> it's 8:49. halloween right around the

corner but a warning this morning if your costume comes with a mask. ktvu channel 2 reporter claudine wong joins us now to tell us what's hiding in that mask that may make you think twice before putting it on. >> halloween is big business. americans are expected to spend nearly $7 billion on halloween this year. they are buying a costume and spend an average of 30 bucks. if dressing up includes putting on a mask, be careful before you put it on. check it out. a television station in arizona went to four different stores and found folks there trying on a lot of masks. they bought about a dozen of them. swabbed the nose and mouth areas of each one. and then they took those samples to the head of the biotech program at play saw community -- mesa community college. he checked each one, a worker did, and tested how much bacteria that could be found. >> i was quite surprised, the

just released documents reveal a grand jury in 1999 i tighted the parents of -- indicted the parents of jonbenet ramsey for child abuse and being an acrescy to a crime. the grand -- accessory to a crime. the grand jury did not convict of them of killing her. but it did charge them with helping whoever did it. the district attorney refused to prosecute the parents saying he did not have sufficient evidence. her killer has never been found and patsy ramsey died from ovarian cancer in 2006. an elderly woman in fresno county claimed she was burned by a hot cup of coffee. the 74-year-old woman said she had second-degree bushes when coffee spilled on her lap at a drive-up window. she wants $2 million in damages in a trial set for next month.
