>> we want just -- justice. >> rallying for justice after a 13-year-old classmate was shot and killed by sheriffs' deputies. a driver behind bars, three children without parents. we're hearing from a family in grief after a suspected drunk driver hit and killed a couple in menlo park. police officers from around the country gathering in oakland right now and drawing a crowd of protesters. we have crew monitoring the situation.

good afternoon, i'm tori campbell. right now a crowd made up mostly of students from santa rosa gathering for what they call a march for justice. mike mibach is there and joins us live to explain why they are outraged. good afternoon. >> reporter: good afternoon. 200 plus students you can say are starting to march in the downtown santa rosa area. they started to march a couple of minutes ago. for the past hour or so they've rallied outside of santa rosa city hall. the focus as they says is justice for andy. >> it's kind of sad that one of our students died for, like, nothing. it was just a mistake. they shouldn't have done that. we're feeling all sad, mad, angry. our emotions are mixed right now. >> he was a good friend. he didn't -- he was nice to everybody,

always smiling. >> reporter: they are talking about andy, andy lopez, the 13-year-old shot and killed by a snohomish county sheriff's deputy tuesday. police say he had an air soft toy rifle, that caught the attention of the deputy that shot him seven times in fear of his life. emotions have changed in the last 48 to 60 hours from shock to sadness. now we're seeing more of a sense of anger among the students about why the unnamed deputy felt the need to fire at 13-year-old andy lopez. >> it was wrong that they did that to andy. >> he deserves justice and so does his family. the cops shouldn't have done that. it was wrong. he was only 13 years old. >> reporter: the students here say they will march to the sheriff's department and demand that the deputy who killed lopez be arrested and charge. the lead investigative agency hasn't released the name of the deputy. we know he's a 24-year veteran with the department. mike mibach, ktvu channel 2

news. a head on collision between a car and santa rosa city bus sent three people to the hospital this morning. it happened before 9:30 on montgomery county avenue near yelupa avenue. the driver of the bus and sedan driver was hurt. the driver had to be extracted from the car. fire officials say seven people were treated at the scene, three taken to santa rosa memorial hospital with non life-threatening injuries. three children are grieving the loss of both parents after a suspected drunk driver hit and killed the menlo park couple as they took the family dog for a walk last night. ktvu's ktvu janine d de la vega spoke about the tragic loss. >> reporter: this portrait was taken several years ago. the children are teens and will never be able to take a picture with their parents again. both died last night after hit by an alleged drunk driver. >> she was the one that should have been dead.

not these beautiful people leaving their children. you know? she should have died. but she killed a beautiful couple and left three children? who is going to pay for them? >> reporter: relatives came to the crash site where they say 50 -- the 51-year-old man and his wife were walking the dog at 7:00 last night. all that was left were mangled trees mowed down by the car. there are no sidewalks on the street, that is why they were in the bike lanes when a car struck and killed them from behind. the grandmother an three children were at home and found out at midnight when they got a knock on the door. >> the police officer told them your mom and dad are gone. >> i told them your mother and father is not here but i'm here for you guys. i will be your father. >> reporter: the couple is originally from fiji but lived in menlo park. relatives describe them as beautiful, hard working dedicated parents. police arrested the driver who they found yelling in pain at the crash site. identified as 54-year-old

marjorie reitzel of redwood city. booked for gross vehicular manslaughter while intoxicated and dui. >> if he chose not to drive today this would not have happened and they would have had their parents. nothing we can do now. too late. >> reporter: the family left devastated and now planning for a funeral. in menlo park, janine de la vega, ktvu channel 2 news. >> menlo park police had just been awarded a $52,000 grant to help reduce the number of dui crashes, the money which came from the state department of traffic safety will be used for dui training, checkpoints and serving warrants on repeat dui offenders. also money for cracking down on distracted driving and seat belt violation as well as speeding. developing news from japan. a magnitude 7.3 earthquake struck off the east coast near the crippled fukushima nuclear site. japan's meteorological agency

raised the warning for honshu but none nor the united states. in 2011 a 9.0 quake triggered massive leaks at the fukushima plant. 19,000 people were killed. friends and family will hold a memorial tomorrow for a truck driver killed last week at the santa clara construction site for the new 49ers stadium. 6 69-year-old edward lake when a bundle of steel reinforcing bar fell on him. the funeral will be in vaccaville. scheduled for 1:00 p.m. organizers say it will be casual and ask people to bring food and drink to share. happening now -- law enforcement agencies from across the country are in oakland for a three-day training exercise called urban shield but just a short time ago some uninvited guests set up a protest in front of that

convention. bryan -- brian flores is there to explain more. >> reporter: this is just the beginning of several events planned for police that are here from throughout the country as well as occupy oakland and groups affiliated with the movement. behind me though is the group facing urban shield action network who earlier read off the names of victims killed because of police brutality. >> reporter: the group is protesting the annual gathering of police from around the country. officers, deputies and first responders are here this weekend taking part in urban shield. an annual event hosted by the el camino county sheriff's office. they will re-enact real world emergencies. at issue now is that weapons vendors are at the marriott showing law enforcement some of

the newest crime fighting tools. it's a combination of that equipment being here as well as perceived police brutality that has some calling for an end to it. >> we want to see an end to the mill tarrization of police and end to the use of weapons that were used in iraq and afghanistan which shouldn't have been used either on the streets of our city. the war is coming home. the war is coming to our streets. >> reporter: meantime this also marks the second anniversary of the eviction of occupy protesters from city hall. while many expect protesters to be peaceful, oakland police say they have stepped up additional patrols. they also say there's a no tolerance policy to vandalism and violence. >> if you do an act of criminal intention you may not get arrested today. we may not catch you today. but we will catch you later. we have video teams out here. we also are using a lot of electronic tools available to

us. we have a lot of law enforcement personnel out here as well as our community working with us. >> reporter: more than 5,000 officers will take place in urban shield for the next two days which will take place throughout the bay area. back here live in terms of occupy they are planning a rally and vigil around 5:00 tonight before a march to oakland city hall. live in oakland, brian flores, ktvu channel 2 news. napa police say they've made a bust in a major marijuana grow operation. napa special agents say they seized almost 600 pounds of marijuana as well as cash and guns at a home in santa rosa wednesday. also arrested five men there. four suspects are described as transients from mexico. investigators say a fifth suspect is an oakland resident. agents say the bust stems from an investigation that began in august in unincorporated and a napa county and they say more arrests are expected. have vallejo firefighters

were battling a house fire at a large house on dryden drive. firefighters worked to put out flames from inside the house. as you can see there's heavy damage to the roof. there's no word on whether any one was home when the fire started. no injuries were reported and the cause is under investigation. a financial shortfall could force the golden gate bridge tolls to go up. the bridge's board of directors today is discussing the district's financial outlook for the next five years. the deficit has more than doubled in the last year. >> this year our five-year projections show a $142 million five-year shortfall. that's sizable. for example last year it was $66 million. the reason it's grown is that we're doing more capital projects meaning we're doing more improvements to the bridge and more improvements to our infrastructure for the bus and ferry system. >> reporter: right now the bridge toll is $5. if you fast track $6.

key documents were made public a few hours ago in the jonbenet ramsey murder case despite the objections of her father. a colorado judge decided to unseal documents from a 1999 grand jury indictment. no one has ever been arrested for the 1996 killing, however the court papers show the grand jury voted to indict jonbenet's parents john and patsy ramsey, on charges of child abuse resulting in her death. but the boulder district attorney decided there was not sufficient evidence to file charges. >> there has always been the dispute was this an inside job

by the ramseys or was there an outside intruder? it appears the bulk of the grand jury believes it was done by the ramseys. that's quite a revelation. >> patsy ramsey died in 2006 from ovarian cancer. from the beginning they claimed an intruder killed their daughter, however, the document also alleged both parents intended to delay or prevent the arrest of the alleged killer. today a santa clara county judge is set to release the man known as the pillow case rapist. christopher hubbard was convicted of raping 38 women in the 1970s and 1980s. they occurred throughout los angeles and bay area including at monroe middle school in san jose. he was being hild at calinga state hospital and expected to be released somewhere in l.a. county. he will be requiring to wear a gps monitoring device. families of nine women trapped in a limo fire on the

san mateo bridge filed several civil lawsuits. five women died in the fire in may including a new bride. the lawsuit claims six companies including ford and the owner of the limo are responsible for a vehicle malfunction that sparked the deadly fire. >> the cause of the fire was the driver shaft rotating on an undercarriage of the vehicle. i don't know how my client could have foreseen that. >> no criminal charges have been filed in the case. the driver of the limo has been cleared of any wrongdoing. one of the attorneys involved in the civil suit says he hopes to move the case forward as quickly as the court will allow. still the attorney expects it will take 12 to 18 months before the case goes to trial. new at noon -- an update on the investigation of asiana flight 214. federal authorities are revealing new details about the probe and scheduling a critical

hearing. jacqueline fells in our washington, dc bureau. the focus seems to be on the flight crew. >> reporter: the national transportation safety board has been taking a look at pilot awareness. ntsb officials went to korea to interview asiana officials. they spent time in an aircraft simulator and gathered asiana training documents. they want to know whether the cockpit crew had enough instruction on how to fly the highly automated boeing 777. it may help explain why the plane fell short of the runway hitting a rock wall at sfo. the ntsb is also reviewing maintenance records and scouring the reckage once again. they are also working on a computer simulation of the crash to better understand what happened last summer. we will hear more from the ntsb in december when a two-day investigative hearing about the crash will take place here in washington. we've also discovered that the ntsb is looking at something else. emergency evacuation slides. one didn't open outside of the

plane, it opened inside pinning two flight attendants to the floor. tonight on channel 2 news, my investigation of the faulty slides and my federal investigators probably weren't surprised they -- why federal investigators probably weren't surprised they didn't work. a site supervisor at the new 49ers stadium under arrest on charges of grand theft and burglary. 37-year-old vincent john latona is a employee of cupper tino electric and police say he stole materials that included copper wiring but doesn't know if they were to have been used on the stadium project. prosecutors say they were stored in cupertino and he's held on $400,000 bail. fire damaged a popular restaurant in the san francisco mission district this morning. the two-alarm fire started 8:00 a.m. at maverick's restaurants on 17th street at the corner of mission. people in the apartments above the restaurant had to evacuate. the restaurant was not yet open

for the day and no one was injured. witnesses say the inside of the restaurant was charred and water-damaged. there's no word yet on when it might reopen for business. sunnier warmer day shaping up around the bay area this is going to be the trend for your weekend. a live look outside our doors. what you will notice overhead for today, high clouds passing from time to time. so we will have white sky mixed in between the blue. it's not going to be the low clouds and fog that we had yesterday. in fact most of us are sunny at this hour seeing a little bit of cloud cover over parts of santa cruz. i'll show you that in a moment. a few degrees warmer from walnut creek to concord. these temperatures are running anywhere from three to six degrees warmer than 24 hours ago. with the sunshine it probably feels warmer in most cases, even the coastline is seeing mostly clear skies from ocean beach down into pacifica. the last few hours i've seen high clouds pull in.

i'm going to show you where the high clouds are linked to. a system off the coastline here. if i move in a little closer you can even detect a little bit of rain popping up 160 miles off the coast. this is not going to shift our way. in fact it's going to be moving south. so we will remain with just the dry conditions and the mix of high clouds from time to time for your afternoon. let me show you what i mean. saturday into sunday it's moving out of the way rather than towards us. we could use rain here but we're not going to get it. so the weekend sunny and mild expected for the afternoon. here's a look at the afternoon highs for today. 70 novato. low 60s in sausalito. 72 danville, mid-70s in brentwood. san jose for 72. 71 morgan hill and 70 degrees in santa cruz with a mix of high clouds and sun.

63 san francisco. upper 50s to low 60s expected along the coastline. a look at the extended forecast with the weekend in view. notice temperatures in the upward direction in time for the weekend. upper 70s for the inland communities, low 70s around the bay, 60s at the coast. if you're going to be outdoors this evening we'll have mostly clear skies turning patchy fog in the evening hours. here's a look at the numbers. 5:00 this afternoon temperatures in the 60s along  the coast. 70s for our inland communities. sun will set 6:19. partly cloudy skies at the 7:00 hour. temperatures ranging in the mid-50s along the coast. widespread 60s around the bay and inland and then cooling off in the evening hours. who wants to think about monday? but notice a change in the temperatures. we're going to take a plunge as we get into early next week. the northerly winds are expected to kick up. >> 10-degree dropoff. thank you. just a couple of hours surfers and organizers are set to gather for the opening ceremony of the mavericks surf

competition. it marks the opening of the contest window which happens next week, next friday, november 1st. from then to the end of march officials will monitor conditions and when they are just right surfers have as little as 24 hours' notice to show up and take part in the competition. a proposal to establish the first food safety guidelines for pet food. rental prices soaring.

shares of microsoft, amazon boosting wall street after positive earnings came in. the dow and s&p 500 in fact heading for the third straight week of gains but that is leading some market watchers to think stocks may look a little expensive. it appears twitter is trying to avoid the same criticism facebook received when it went public last year. twitter announced it's setting a price of $17 to $20 a share for its ipo which is expected to happen next month. the san francisco-based company wants to sell 70 million shares and raise more than $1.5 billion. facebook was criticized for pricing its initial shares too high. at $38 each, struggled for a while but now facebook stock is selling for just about $52. the price of renting an apartment is soaring all over

the bay area. that is according to a survey by the data company real facts. at the same time the rates of increase appears to be slowing. real facts listed the median prices in the third quarter for one bedroom, one bath. the fda is proposing a rule aimed at improving the safety of food for pets and animals. if approved it would be the first rule to establish manufacturing standards for processing and packaging animal food. the proposed rule will be published october 29th. the agency is under a court ordered deadline to compete the final rules of the food safety act by 2015. today on ktvu channel 2 news at 5:00 -- north bay high schoolers marching for justice an deputies shoot and kill their 13-year-old classmate.
