this morning. >> cloud cover dave. cloud cover. yes unless you're up in the counties then on the colder side with some 20s and 30s up there. lot of 40s and 50s up there. still some snow up in the sierra nevada. not done yet. for us we have mostly cloudy skies and could be a few sprinkles or light showers and some light rain especially in the mountains south but that continues. partly sunny though by this afternoon. kind of cool and breezy though. 40s for some and mid 50s for others and again cloud cover versus maybe some breaks in that cloud cover. but most locations or locales whatever you want to call them are saying mostly cloudy skies. san francisco which hit 59 yesterday, they're 55 now. i'm only going 60 for a high but it will be mostly sunny later today and temperatures staying cool. there's the low and it will influence the weather today keeping the temperatures below average. partly sunny could be a few sprinkles here this morning and some on my wind shield on the way in. with a lot of temperatures only six degree spread. 59 to 65 degrees. here's tara. all right, thanks steve.

we each have two accidents on the peninsula. the first one we told you about earlier. it's a boulder versus a car just north of the san francisco international airport. that is off of the north access road. the other one is off of -- 92. it was a solo car hitting a guardrail. so each of those accidents not really causing any backup but we'll keep an eye on them for you. at the bay bridge toll plaza the metering lights are on now. they went on a short time ago and make sure you give yourself an extra several minutes as you make your way into san francisco this morning. and last but not least highway 24 through lafayette, you can see the traffic a bunch of brake lights and those are folks going to the tunnel and on through oakland hills. all right, it is 6:02. back to the desk. all right happening today, as we mentioned people in santa rosa are organizing a huge march for andy lopez. he is the 13-year-old boy shot and killed by a sonoma county

sheriff's deputy. ktvu channel 2 reporter aleck savage there at the memorial for andy lopez and alex we understand that groups from outside the area now planning to take part today. >> reporter: yeah we did just learn that occupy oakland is in fact planning to bus people from the plaza up here to santa rosa to take part in the large march later on today in the area. there's a growing sense of frustration in the community over the shooting of lopez which happened right here in the field. and you can see a memorial is growing in this area. hundreds are expected to march later on today to protest this deadly shooting of the 13-year- old boy by a sonoma county sheriff's deputy. at about noon the march will wind up at the sonoma county sheriff's department offices on ventura avenue. now county offices, city hall, and the courthouse will all close at lunchtime in response to what is expected to be the largest demonstration yet over last week's shooting. the middle school student was

shot seven times by a sheriff's deputy. and the department says lopez was holding an air soft gun. a replica weapon that resembled the ak-47 and that he failed to put down the gun. 48-year-old erick gelhaus is a 24 year veteran of the department. according to his linkedin profile he's an iraq war veteran and was also a weapons instructor. one of the organizers of today's march says the deputy was too quick to pull the trigger. >> i think the community here is tired of being you know somewhat persecuted. always feeling that they're suspicious in some way. >> reporter: santa rosa police are investigating the deputy involved shooting and so is the fbi. a post on the justice for andy lopez facebook page is encouraging students here in santa rosa to skip out on class to take part in the event but

the superintendent is trying to discourage students from doing that. and trying the get them the stay in school. in the meantime we did speak with lopez's father. ktvu -- his father is telling ktvu that he wants justice for his son and he believes that criminal charges are warranted against the deputy involved in this shooting. live this morning in santa rosa. alex savage, ktvu channel 2 news. time now 6:# 5. in the marin county court in the trial of 18-year-old max wade. he's accused of stealing the car of a chef and also attempted murder. yesterday, celebrity chef guy fieri testified he never gave wade permission to take his car. wade is accused of stealing his lamborghini. out of a san francisco dealership in 2011. he said several people reported they saw that car after it was stolen. >> people would call and we'd get reports and my attorney would hear about it.

well to come find out you know that he was driving it? brave kid. >> the prosecutors said wade stole the car to impress a girl and when the girl rejected him, he fired shots at her and her boyfriend in mill valley. the chef says he decided to get rid of that car. if you want to find out why, go to ktvu.com. you can see guy fieri's full interview. the unedited video is on the top story tab. a troupe of campers protesting a new plan to close the parks overnight. well they have now gone home but the protests are not over. christian captain joins us now from city hall where the protestors are set to meet again later today. christian? >> reporter: yeah, that initial protest that overnight protest at dolores park now over. we were there last now and now moved to city hall. protestors plan on coming here 12:30 today. they're going home and getting rest and preparing for the rest of the day's activities. we have some video of the

overnight protest breaking down overnight. this morning, the protestors began showing up last night to raise awareness about a new plan that they oppose. supervisor scott wiener pitched a plan to close city parks between midnight and 5:00 a.m. and the two dozen or so campers that were out this morning said the plan would essentially criminalize being poor. now supervisor wiener says closing the parks would give the police another tool to fight quality of life crimes like illegal dumping and vandalism. >> right now, i have just an enormous amount of vandalism and dumping that happens in the park. the cost -- that costs the park departments more than $1 million a year and that happens almost exclusively in the middle of the night. >> both vandalism and dumping as well as sleeping in our parks are already illegal. what this would do is really give the police and rangers extra agency to be in the parks. >> reporter: and protestors again telling me they'll be here at city hall for the 12:30

rally. they'll be also going into the board of supervisors meeting and they're going to be trying to sway some of the supervisors who are maybe sitting on the fence on this issue. we will have coverage for you throughout the day on this issue. including coverage about what happens in that board of supervisors meeting. we are live in san francisco, christian captain, ktvu channel 2 news. ten people are looking for a place to stay now after an out of control car crashed right into a heyward apartment building. it happened at 3:00 yesterday afternoon at jackson and grand streets. people say they heard screeching tires before a ford mustang crashed through a bedroom wall. no one was hurt. police say it appears the car was speeding. time now 6:08. there's new concern about the amount of kem cams getting into -- chemicalled getting into france -- chemicals getting into san francisco bay. if they're not checked, aquatic life out there could be hurt. experts say one chemical that's found in the most doses is

obamacare website continues this morning. the woman in charge of that office that created healthcare.gov testifies before congress less than an hour from now. as ktvu's chi la campbell reports from the washington, d.c. newsroom, lawmakers want to know when she knew the website was in trouble. kyla? >> reporter: pam, this marks the first time we'll hear from marilyn taviner. she is the administrator for services or cms. now cms is the branch of the health and human services department in charge of creating healthcare.gov. they brought in contractors to help build the website. those contractors testified before congress last week saying the administration wanted last-minute changes to healthcare.gov. the contractors say they warned cms of the risks involved with launching the website october 1st. today, lawmakers want to know when she knew these problems existed and why she and other officials at cms decided to

have healthcare.gov go live anyway. that hearing gets underway in about 45 minutes. i'll be watching live and i'll have highlights of testimony for you on mornings on 2 after 8:00. live in washington, kyla campbell, ktvu channel 2 news. business religious and high- tech leaders from around the country are also in washington, d.c. today to pressure congress to take up the issue of immigration reform. the u.s. chamber of commerce is hosting a forum on the need for immigration reform. high-tech representatives from the silicon valley immigration advocacy group are also attending the event. president obama wants to congress to pass immigration reform legislation before the end of the year. time now 6:15. disgraced former sap that clara county supervisor george shirakawa has been indicted by a criminal grand jury. the indictment is tied to allegations of a political dirty trick three years ago. investigators say shirakawa impersonated a san jose city council candidate on bogus mailers that linked her to the

communist government in vietnam. shirakawa resigned in march due to another scandal. he was accused of stealing public money and campaign donations to pay for his alleged gambling habit. a federal judge is ruling that former alameda fire chief dave kapler has to pay the city's legal costs in his termination lawsuit. in september of 2010 he was fired after he was photographed using a city gasoline pump to fuel up his bmw. kapler appealed the city's decision but last year, it was upheld by a state appeals court. on friday the judge ruled that kapler has to pay the more than $260,000 the city spent during that appeals process. there's a meeting tonight for the people who were burned out of their terrace apartments in redwood city. it's at 7:00 at the fair oaks community center at the middle field road. it will help the former residents to have building get back on their feet. it comes less than two weeks

after the huge fire damaged every apartment in that complex. tonight the berkeley city council will make a big decision regarding an apartment building that caught fire last march. former tenants have filed an appeal. they say the owner disconnected fire alarms before the fire and improperly installed a water heater. firefighters say the fire at the building on dwight way was an accident that started in a water heater closet. time is 6:16. will a surfer may have just ridden the biggest wave of all time in portugal. yesterday, carlos burle -- >> i can barely watch. >> he went to portugal trying to break the guinness world record for the biggest wave ever surfed. the title right now belongs to garrett mcnamara of hawaii. this photo is just incredible. the 78-foot ride and they're hoping it beat the record. in 2001 burle rode a 72-foot wave in mavericks. meantime off the coast of

norte of portugal, surfer was rescued yesterday. the surfer was knocked unconscious by that really rough surf. other surfers you see here pulled him to shore. he was taken to a hospital and he did have broken leg though. 6:17 is the time. let's go back over to tara in for sal and accident now on the east bay fight. >> we have a car accident 680 southbound before 780. the slow lane is blocking traffic. a look at the maps this morning and the south bay shows a pretty nice commute. and lots of green not too much red. same story on the peninsula. and if we head over the bay there you can see it's looking good in the fremont area. a little congestion there near heyward. but not too bad. at the bay bridge toll plaza meters lights went on early this morning about ten to 6:00. of course fighting your way over to get to them can be a challenge. so give yourself an extra ten to 15 minutes into san

up in lake county. 30s, 35 tahoe and 53 monterey. you can see that continuing to stream off the pacific and we have a lot of cloud cover over us and maybe some light rain over us down towards santa cruz. and the valley and mostly cloudy morning will give way to a partly sunny afternoon. you can see some of the rain/snow mix over the sierra although it looks like things can r calmer -- are calmer today than yesterday. it's a big low. all the way back into idaho and the four corners and that's going to give some pretty good snow to the rockies as well. further north a little bit more of a break but cooler temperatures. decent little system for this time of year came through and did its -- did what it's supposed to up in the sierra and pretty good snow. partly sunny after mostly cloudy morning. a few sprinkles staying on the cool side though. upper 50s and low 60s. clear lake only 60. 62 nevada. napa 63 and fairfield at 65. lot of 64s in here. pittsburg and antioch brentwood have to throw oak plea in there as -- oakley in there as well.

oakland, we are lee all low 60s and everyone is pretty close here. 64 san jose to santa cruz. 65 more began hill and gilroy. upper 50s and low 60s to mid 60s palo alto redwood city. mostly sunny tomorrow and now once we get rid of the cloud cover it's going to be cold in the morning. al probably be a factor but sunny and warmer into friday. looks okay on friday. the latest smart phone sales are in and as expected samsung dominates the market. samsung reports shipping a record 88.4 million smart phones in the third quarter. apple's sales jumped but the cupertino company's market shares slipped to 13.4% of the worldwide total. google is relying on friends to get its internet connected glasses on to more people. the 10,000 testers of google glass are being asked to invite three friends to also if buy the device. -- buy the device. those will have to pay $1,500 to get their own google glass.

welcome back to the ktvu channel 2 morning news. 6:24 is the time. firefighters trying to figure out what caused a major fire that damaged several buildings in san francisco's mission district. that fire started yesterday afternoon in a residential building on valencia street. fire crews had to help people escape but luckily no one was hurt: eight people though are now without a place to live and a pilates studio was also damaged. a san francisco judge a restricting the driver privileges for the gardener accused of a deadly hit and run at holly park. 58-year-old thomas burnoski appeared in court yesterday. the judge says that he is only allowed to drive when he is taking his children to school

or to find work. burnoski has been suspended without pay from his job at wrecken parks. he is accused of running over and killing christina have they are my. very lucky to be alive and he says his cell phone has to be thanked. that's because that cell phone stopped the bullet fired at that clerk during a robbery yesterday morning. the clerk had no idea he'd been shot until he felt a pain in his chest. well, when the police came, and they removed that phone, the bullet was still inside. >> that's crazy. that's like -- movie stuff. that's just amazing. that something like that would happen. >> yeah, the clerk very lucky. he has sombres on his chest but officials say otherwise he will be okay. well, baseball's all-time home run champion is now fighting for another day in court. lawyers for barry bonds are asking a federal appeals court in san francisco to reconsider its ruling last month. that ruling upheld bonds' 2011

plaza because that's where occupy oakland organizers are planning to have buses pick people up and drive them up here to santa rosa to take part in this march that again will begin today at about noon or so is when people will begin to gather here in this area. we are live this morning in santa rosa. alex savage. ktvu channel 2 news. all right alex. time is 6:34. the suspect who was wounded in sunday's police shooting in san francisco's marina district may be formally charged today. police say they were forced to open fire on the gunman after he beat and shot another person at chestnut and pierce streets. the ktvu news learned the name of the man wounded in this shooting is navares mobo jr.. he's in critical condition at san francisco general hospital. the woman accused in a deadly drunk driving crash in menlo park killed a couple walking their dog is expected to be in court today. ktvu's brian flores in the newsroom this morning with why the brother says she suffers

through some mental illness. brian? >> reporter: yeah pam ronald reitzell says his sister marge yee has been dealing with in issues and it spiraled out of control since the death of their mother last year. now marjorie reitzell was supposed to be in court yesterday but it was postponed because of an undisclosed medical condition. she is expected to appear in court today. she is accused of drunkenly driving her car and killing the couple balbir singh and his wife kamal last thursday. the district attorney says she was driving with a blood alcohol level well above the legal limit of .08. we spoke with her brother who offered his deep condolences to the family but because of her mental health issues marjorie doesn't remember the incident. >> i think it's going to take its toll on her. once it sets in right because right now she doesn't realize what she did. i just visited her yesterday and she didn't realize -- she still don't believe she killed nobody. >> reporter: she has had several run-ins with the law

dating back to 1984. last year she pleaded no contest to drunk driving but had undergone a substance abuse program and was allowed to drive again. past convictions also include possessing drug paraphernalia and driving without a license. as for members of the family they didn't want to speak to the media yesterday. the convicted marjorie reitzell faces up to 15 years in prison. in the newsroom, brian flores, ktvu channel 2 news. police in burling game want your help. family members say 79-year-old scotty morris was last seen monday afternoon leaving his home on raulston avenue. his wife thinks he went for a walk several blocks from their home. mr. morris was wearing a white sweatshirt and black sweatpants and right now there's no other information involving what may have led up to his disappearance. happening now, a group of protestors that camped out overnight in san francisco's delores park now getting ready for a board of supervisors

now about the case of a castro valley nursing home where 14 people were found abandoned. yesterday, we got a look inside that home. on saturday the people were removed by paramedics after someone called for an ambulance. and there were just three staff members there on duty. the owner's attorney says that she had spent more than $100,000 fixing up the nursing home. she says she was fixing deficiencies found by state inspectors. her attorney says the patientser not abandoned and that a staff of three is adequate. time now 6:40. the price tag to build a new san francisco arena for the warriors keeps going up. the "san francisco chronicle" says the cost to rehab the aging waterfront piers where the arya would be built could be as much as $170 million. that's about $70 million more than planned. the team is also facing a shrinking time frame to get the arena project approved and built in time for the 2017 nba season. that's when its lease at oracle

welcome back. time now 6:43. a bay area apartment complex has caught the eye of the department of justice and it's being sued. it all has to do with allowing kids to play on the property. ktvu's janine de la vega joining us live from fremont now with all the details. what's going on janine? >> reporter: i put in a call to the department of justice for more information but here's what we know. the department of justice is saying that the owners of the woodland apartment complex is being discriminatory towards some of the tenants here because they're not allowing the kids to play in the grass at the complex. the department of justice filed a lawsuit against the owners

and operators of the woodland garden apartments alleging they discriminated against families with children. the suit says they prohibited kids from playing in the common grassy areas of the complex which is in violation of the fair housing act. the lawsuit arose because five families with children filed complaints with the department of housing and urban development. several online reviews by former tenants say management of the complex was threatening eviction if kids continued the play in the gas -- to play in the grass and instead suggests parents take their kids to a park. now the suit seeks a civil penalty, monetary damages for the families as well as a court order barring future discrimination by woodland garten apartments. now i called the complex for comment but i am still waiting to hear back from them. janine de la vega, ktvu channel 2 news. time now 6:45. b.a.r.t.'s two biggest unions scheduled to vote this yesterday on a -- friday on a

new four year contract. they'll decide whether or not ratify that tentative deal that ended the latest b.a.r.t. strike one week ago. the results are expects late friday night -- expected late friday night or early saturday morning. the board of directors would then decide if they will ratify the new contract. both sides are expected to approve that deal. more than 120 new bike racks, they've been added to the north berkeley b.a.r.t. station. and b.a.r.t. says more bike racks will be installed at the lake merit station in oakland in the next two weeks. b.a.r.t. police say these racks are more secure than the standard poles. and yesterday, police passed out these information packs on how to prevent a bike theft. they say. shaped locks are better than the cable locks. they also recommend write down the serial number of your bike. one year ago today, hurricane sandy devastated the northeast coast. it was the second costliest storm on record after hurricane katrina with damage totalling $50 billion.

more than 100 people were killed in that storm. several people are still without a home and the rebuilding effort continues. many who live near the shore now fear they may have to leave for good with the cost of flood insurance skyrocketing. there are reports that congress has reached a bipartisan agreement that would delay at least four years of flood insurance rate hikes impacting more than a million homeowners. the agreement would reportedly require fema to complete an affordable study before increasing future flood insurance premiums. the legislation is expected to be filed in the senate today. well, ski resorts hoping for an early ski season this year after more snow fell in the sierra overnight. several ski resorts report 10- inches of new powder in the last 24 hours and higher elevations saw about 12 to 15 inches of new snow. crews were out overnight making snow for the base in hoping -- in hopes of opening the lifts early. >> the colder it is, the more we can open up the water

morning news. time now 6:49. tara, several cars in a crash in the fremont area? >> yes, the chp has canceled the alert for 680 southbound near the grade all the cars have been moved to the shoulder that was a multicar crash. my maps still showing red though may take time for things to get back to normal. you can see that everything is looking fairly decent here in the south bay. over in the peninsula, near san mateo also looking good. but you can see that there is quite a bit of backup here on 880 southbound and at the toll plaza there near the san mateo bridge. all right up next we have a look at 280 and you can see this is near san jose. it's looking pretty bad right now. these are folks headed toward highway 17. it has been stop and go for the past half hour. last but not least the bay bridge toll plaza. the metering lights have been on opinion armour now and -- for an hour now and probably an extra 20 minutes to get into

welcome back to the ktvu channel 2 morning news. taking a live look at the big board numbers actually higher than earlier indications. live look at the dow jones. it is up about 54 points. right now tesla's stock though down more than $1 a share. that's after dropping 4% yesterday. investors worried about this. another model s. sedan caught fire. a mexican newspaper posted this video on its website. it was recorded just moments after that tesla sedan ran through a concrete wall and into a tree. now the driver was not hurt and tesla says he does plan to buy another model s.. earlier this month a video showed a model s. on fire after it hit a large piece of metal on a state highway in washington. federal reserve chairman bernanke and his colleagues opened a two day policy meeting in washington, d.c. today. when they last met, it was a fairly close vote to continue their bond buying program. since then, the economy has

been hit with a 16 day government shutdown of course that delayed government reports and dented consumer confidence. analysts say it's likely to mean that that vote to maintain the current policy will be more one sided this time. time is 6:56. a company that makes a very popular asian chili sauce is being sued by the southern california city where they make the sauce. huy fong foods is based in irwindale about 20 miles outside of los angeles. the city says the company is polluting the air with the spicy smell of sriracha sauce. some of the residents in irwindale complain of burning eyes, irritated throats, and headaches. now the city wants a court to order production stopped until the company either reduces or gets rid of those factory smells. later today, san francisco's supervisor wiener will call for a new tax on sugary drinks. now he wants to raise the price of sodas and other sweet drinks by two cents an ounce. so a 12-ounce bottle or can would cost 24 cents more.

wiener says the money raised will pay for health and nutrition programs for kids and teenagers. the san francisco supervisors are expected to approve this proposal. but it would still need the voter approval as well. also starting today, santa cruz police will crack down on halloween partiers. police say they'll enforce triple fines for drinking in public, leading up to halloween on thursday. they'll also be watching out for people who vandalize. fines can cost about $200 to more than $1,000. coming up next on mornings on 2, the blame game continues over the obamacare website. what is happening on capitol hill this morning. >> also another big march protesting the fatal shooting of a 13-year-old boy by a sheriff's deputy. last happening now -- it's happening now in both santa rosa and in oakland.
