offshore direction on the breeze, i think it holds things in check. morning lows, grayton 36. kenwood, sonoma, 38. and san francisco city at 54. so there's a big difference. the lows are not as cold this morning. we're still cold, but a lot more 40s than we have seen the past couple of mornings. san rafael, 45, and end up with a high of 73. same as yesterday. it does look nice. lots of sunshine today as temperatures, we get a little help from the north or northeast wind. the system moving tonight, more likely on saturday, going to give us a dramatic cool down. cold lows for some it inland. 60s, but u a lot -- but a lot of 70s inland. we are looking at the commute and the traffic is going to be busy in some areas. this is a look at the westbound bay bridge. it's better than it normally

is. you're going to be waiting for just a little bit if you're driving to san francisco. it shouldn't be a bad commute at all. the morning drive on highway 4. that's busy. that's backed up from antioch through pittsburgh and bay point and 680 is slow. we haven't had any major problems. we have had a couple minor things. but for the most part pretty good. i want to mention on 680 northbound, we have an unusual back up on 680 northbound approaching scott creek, because of a fatal accident. and janine de la vega is following up up on this breaking news where a person was killed on northbound interstate 680. what's the latest there. >> reporter: you know, it's causing quite a snarl here in the northbound lanes of the 680 just before the scott creek road capitol hill. i want to go -- creek road exit. i want to go to a picture. just two lanes are open. this slow lane is closed here, so that the chp can investigate

this accident. now, the chp is saying that the driver who caused the accident is at a the hospital, and they -- is at the hospital, and they suspect that he was drunk. they were called to the scene at 2:40 after two construction workers were hit while moving a road sign on the right shoulders of the northbound 680 in milpitas. the driver of the silver nissan traveled out of the lanes and struck the two men who were wearing reflective vests on the freeway shoulder. one was pinned against the nissan, and his work truck. he died at the scene. the other man is suffering from minor injuries. they work for a company out of fairfield called statewide traffic safety and science. that's the company that contracts with caltrans. >> there have been some contractors, friends of the victims that have arrived on scene. they're shook up. every time you have a

contractor working on the side of the road, there's danger, and i just, i hope that all the commuters take heed to the road work ahead signs, in construction zones to keep everyone safe. >> reporter: the driver of the silver nissan was trapped and had to be extricated. field sobriety tests were done and officers determined that the driver was intoxicated. he was again, rushed to the hospital and is now suffering from serious injuries. the chp officer mentioned that there was a mask in the of that nissan. you know, it was halloween last night. it's unknown if that gentleman was coming from a party. now, the chp says that the reason that the two construction workers were out here is that they were doing emergency work on a dip in the freeway just north of scott creek road. they were scheduled to be out here until 6:00 a.m., but of course, now all that's changed because of the accident. i just got an update from chp

officers out here. he says that they expect to open up the slow lane of traffic in about an hour, so that's at 8:00 that things should be back to normal. reporting live from milpitas, janine de la vega ktvu channel 2 news. it is 7:05. now to the south bay where we're following a developing story of a victorian house catching fire this morning. this is a live picture from outside the home. this is on north 12th street in san jose, and you can see firefighters on the scene making sure there are no flair ups. a -- flare ups. a lot of fire trucks there. while the fire is out, they took pictures of the fire shooting from the home. this is around 5:30. firefighters say the flames were difficult to put out. they had to call for additional crews to help. we are told that 9 people live in that house. they were able to escape unharmed. >> my mom woke me up. my room had a bunch of smoke.

>> tenants say the fire started in the kitchen area. we'll have a live report at 7:30. new this morning, the search for a shooter is underway in hayward, a female victim is fighting for her life. she was shot several times late last night. ktvu's claudine wong joins us live from hayward with what police are saying, and residents who have had enough of the violence there. good morning. >> reporter: good morning, yes, we are at the lord tenson apartments, they are on sleepy hollow, and if you look behind me, it's actually a very big apartment complex. we have been talking to residents out here who say when this happened, this area was very busy with people. the kids don't have school today here in hayward. so a lot of folks out last night when this happened. the shooting happened just before or just after 11 rather. according to police, they got multiple calls, came out here and found a woman critically injured. she had been shot multiple

times. they took her to the hospital where at last word she was undergoing surgery. residents we talked to out here, we haven't found anyone who heard the shots. they say violence is common out here and getting more common. we talked to one man, he's lived here for 13 years. he's had enough. he wants to move. >> we're looking for a house. we have four kids here. we have a 13-year-old girl, a 10-year-old boy. 8-year-old boy: and 4-year-old boy. >> reporter: so when you hear about something like this. >> yeah, they can't be around here. it's too much. they need nice and quiet, nice neighbors. it's frustrating when you really like someplace and it just spirals out of control. >> reporter: now, police spent the night and into the morning working this case out on scene. they have cleared the scene but they say they are still talking to anyone who might have any information for them. at this point it's still unclear if the woman was here for some kind of gathering or if she lived in the apartment complex. we do not have shooter

information. we are touching base with police and we'll have any new information coming up on mornings on 2. claudine wong ktvu channel 2 news. two boys who were out for halloween were hit by a pickup truck and are recovering in the hospital. police say the 12-year-old and 13-year-old boys were in a crosswalk on south cloud coverdale boulevard when they were hit by a 75-year-old driver. one boy was flown to children's hospital in oakland to be treated for a broken leg. the other was taken to healdsburg memorial hospital with head ask shoulder -- and shoulder trauma. police say the driver is cooperating. in that same crosswalk in july, a woman was hit and killed and an 83-year-old driver was charged with vehicular manslaughter. maria was killed in that crosswalk at south cloverdale. she left behind 9 children, 33 grandchildren and 28 great grandchildren. residents are demanding more safety lights at that

crosswalk. time 7:09. last night, hundreds of people packed san francisco's castro district for halloween. but there were no major problems. crowds weren't as big as in year's past, but people didn't seem to mind. all kinds of costumes from madame butterfly and kramer and elaine from seinfeld. they attracted one hundred thousand people last year, but they scaled down after several violent incidents. and more details about violence in the past n. 2006, nine people were, in 2006, nine people were hurt, after -- in 2006, nine people were hurt after someone fired shots and many 2002, four people were stabbed. it's 7:10. we have new information on the controversial fatal shooting of a 13-year-old boy in santa rosa last month. sheriff deputy shot and killed

8 8th grader anthony lopez after mistaking the toy ak47 for a real rifle. the santa rosa man said the same deputy pulled a gun on him twice during a traffic highway stop. two months earlier, the man said the incident had him questioning the deputies emotional stability. the attorney declined to comment on the new allegation. lopez's family will file a lawsuit in federal court today against sonoma county citing excessive force. the coast guard has released a statement about the mysterious barge on san francisco bay near treasure island that has been linked to google. a statement says coast guard personnel have been on board for routine inspections and to make sure compliance with applicable safety, security and environmental protection regulations. the coast guard did not say if the barge belonged to google. it is 7:11.

>> a federal judge released the videos yesterday. one video from july of last year shows an inmate who was sprayed five times with pepper spray in 15 minutes before being tackled to the ground by half a dozen guards. officials say he needed emergency medication. the corrections department says the use of force is always a last resort, and what you don't see in the videos is the hours of discussion between the inmates and clinical staff before a cell extraction is ordered. time now 7:15. germany's top security official wants to set up a meeting between german investigators and edward snowden, if snowden is willing to talk about the national security agency and the reported monitoring of the phones of chancellor merkel and other politicians. a german lawmaker says he met with snowden on thursday and snowden said he was prepared to go to germany to testify.

some silicone valley are willing to put restraints on surveillance programs. google, aping, facebook, and yahoo, they're among the high- tech companies that wrote to congress calling for reforms. the tech companies say they fear consumers all over the world will lose faith in their ability to protect sensitive information and communication. 7:15. we're finding out exactly how many people were a able to sign up for health insurance on the troubled healthcare.gov web site. the first few days after it launched. in formal notes from a meeting show just 6 people successfully enrolled on the first day, october isst, and by the end of the -- 1st, and by the end of the second day, 248. the goal of the obama administration is to have an average of 39,000 people enroll every day for the next five months. a spokesperson for the health and human services department says the figures presented in the documents are unofficial. the agency has said its released the first official report on enrollment by mid

november. some disturbing new information about that castro valley nursing home scandal. today's chronicle is reporting at least one worker for the department of social services went to the facility days after most of the staff had left. but the report says the worker did nothing to end the chaos of valley springs manor. the staff abandoned 14 sick, elderly and bedridden patients last week after state regulators shut down that nursing home. those residents were cared for by a cook and a janitor, who had no training at all in taking care of elderly patients. it is 7:17. we're learning new details about the fbi sting that targeted state senator ron call da roan. an -- caleder o -- calderon. the fbi agent stalled himself

rocky fatel and set up a twitter account where he posted photos of himself with several southern california elected officials. that twitter account was taken down wednesday after details of the sting became public. president obama's aides secretly considered replacing vice president joe biden with hillary clinton on the 2012 ticket. that is according to a new book on last year's race for the white house. the aides reportedly began thinking about making the switch late in 2011 when president obama's reelection outlook appeared uncertain. but they eventually decided against the plan despite clinton's popularity, they felt the move would not provide a big enough political boost to justify such a radical move. time 7:18. what's happening on the roads right now. >> it's a little bit better than it was earlier, and we're getting that friday light going on. i do want to mention we have some problems in milpitas,

northbound on 680 as you drive up to scott creek road. still have what they call a hard closure and the investigation continues in this fatal accident on 680 northbound, where our construction worker was hit and killed by a suspected drunk driver. northbound 680 is backed up for at least a mile. the alternate route for you, if you're trying to get of -- out of this south bay is use 680 instead and cut across and use mission boulevard and avoid the traffic. it's pretty slow and unusual for this time of morning. on the other side, southbound 680 looks good. you can see northbound 680 is still slow coming up on this hard closure. it's not all that bad, but if you don't want to deal with it again, 880 is a good alternate. let's go ahead and take a look at the bay bridge. you'll like what you see here. it's only backed up for a small delay. that's less than 5 minutes. we're looking at contra costa. slow traffic in antioch, and

bay point. and southbound 680, they cleared an accident near south creek road, i'm sorry, near oak park, treat boulevard, they have a crash on the shoulder there, and 80 westbound is looking gooded from hercules to richmond. b.a.r.t., caltrain and muni are reporting no delays. now, let's go to steve. thank you sal. under clear skies, a little hint, just looking richmond, outer richmond, sunset even over on san francisco state, winds are easterly. there's fog off the coast. but it's staying off the coast. let's focus on the rain or the lack thereof in san francisco, 0, nothing, in october that's the first october that no rain has fallen on san francisco since 1980 and the 14th time in 160 years of o weather keeping. 9 -- of weather keeping. the odds are favoring dry, but i remain steadfast we'll see

. 7:25. new video of a big rig crash on interstate 80, just east of truckee, the wreck involved two cars and the tractor-trailer. one of the cars had broken down. it was then hit by another car and the big rig, which was hauling produce. one person was air lifted to a hospital eastbound traffic on 80 near truckee has been reduced to one lane now, because of that crash. a texas police officer did not let getting shot in the face stop her from doing her

job. >> shots fired. i'm hit. >> this dramatic dash cam video shows the terrifying moments after the officer made a routine traffic stop. this was around 4:00 a.m. saturday. as she approached the car, a passenger suddenly pulled out his gun and shot her twice. >> i was born to be a protecter. i always have been a protecter. >> shot by the driver's side passenger. >> despite her injuries, the officer who is a former marine chased the suspects for 7 minutes through the streets near houston. she eventually tracked the three suspects into an apartment building where the gunman was arrested. there is a new warning about the spread of a drug that is so dangerous the average life span of a user is about two years. >> if you take this drug, you will lose a limb and you will lose your life for sure. >> the drug, which is similar to heroin is just now being seen across the u.s. tonight at

construction worker. another construction worker has minor injuries. the driver has been rushed to the hospital with life threatening injuries. let's take a look at your alternate route. i do want to mention that northbound 680 as i mention second-degree going to be slow as we -- as my mentioned is going to be slow. and one of the alternates is to use 880 north and mission boulevard. come up here, and then one more time, come up here, and use mission boulevard up to 680. and you can just avoid all this back up right here doing that. i alsoment to mention one more -- i also want to mention one more thing in the traffic back up. now, let's go back to the desk. >> time now 7:32. developing news from san jose, a victorian house caught fire just about two hours ago. the people inside did get out safely. ktvu's brian flores is out there right now.

what are the new details. what happened out there. >> reporter: that is the good news that the family was able to get out safely. still a lot of work to do. no visible flames now. this fire is under control. as you see firefighters on the roof there. part of the job is to get rid of the hot spots that may be visible. they're on the roof, busting through the roof and they're going to put fire fighting foam to get through the attic. tough to get to. they're going to be doing that and getting to the hot spots if there are any in the home. take a look at the video from news chopper 2 this morning. shortly after this happened 508: you can see huge flames coming from the attic and roof. the two alarm fire took about 40 to 45 minutes, and shortly under control thereafter. as you mentioned, this is an old victorian home. this is a duplex where nine family members lived. when we spoke to the family, one person was sleeping in the kitchen area.

that person shelled -- smelled smoke and notified the others, and scrambled outside the house. >> my mom woke me up. my room was like, it had a bunch of smoke, and everything was coming from the kitchen. and my room's next to the kitchen. >> this fire spread through the walls and up into the attic. this is an old style victorian structure. the fire travels quickly and easily throughout the structure. we had a well involved attic fire. we called a second alarm assignment. >> reporter: the fire investigator is here looking for a cause. once the firefighters clear the hot spots, they can go back in and retrieve the belongings that are left. you see the family speaking to the red cross that just arrived here on scene. the family says they have been renting the home for about ten or eleven years. they don't know exactly what they're going to be doing. perhaps staying at a hotel or whatever the red cross can provide, but at this point, the firefighters say the home is

uninhabitable. live in san jose, brian flores ktvu channel 2 news. thank you brian. 7:34 in. in about 30 minutes, members of the b.a.r.t.'s largest union will be meeting before taking a vote on the tentative contract agreement. that agreement was reached last week ending b.a.r.t.'s second strike of the year. ktvu's katie utehs is live with more on when we may know the results of the of the -- of the vote. >> reporter: voting starts around 10:00 a.m. members will be gathering here at the downtown oakland marriott. they have a meeting around 8:00. so within a half hour and the voting will last for a 12-hour period today starting at so. members from both unions, sciu and atu, rank and file members have taken this week to look over the tentative contract agreements which ended their labor strike last week. as we know, negotiators reached

the deal and union by laws require that members get five days to review the deal before voting. and today they'll decide. 1400 people represented by sciu will vote at the marriott. they're b.a.r.t.s mechanics, custodians and clerical workers. i also spoke with leaders from the second largest union, members will be voting during the same time span today, that's 10 to 10, and their voting is taking place at an undisclosed location. if the two unions approve the tentative agreement, the next step is the b.a.r.t.'s board of directors, they will vote at a regularly scheduled meeting on the 21st or call a special session. b.a.r.t.'s board has not said when they will vote to ratify the contract or not. earlier this week, we spoke with members of the unions and they were favorable of the tentative contract agreement. they have had about a week now, five days to look over the contract. we're going to touch base with them as they arrive here to

vote to see if they're still in favor, and again, we could learn as early as tonight or possibly tomorrow morning if the two unions approve this contract. we're on top of it, again, for our next live hit. we'll tell you more about where the join members stand. for now live in oakland. katie utehs ktvu channel 2 news. it's 7:46. city councilman steve glazer has been on a campaign to fan future b.a.r.t. strikes and later today he'll present a petition with 20,000 signatures from people who support his plan to make it illegal for public transit workers to walk off the job. glazer notes new york city, chicago, and washington d.c. have all banned transit strikes. the councilman is a candidate for a state assembly seat. california's public utilities commission has new safety rules to protect rail workers. this comes less than two weeks after two b.a.r.t. track inspectors were killed on the tracks near the walnut

creek b.a.r.t. station. the new rules are the first of its kind, rail workers safety laws. they require extra training, better record keeping and better communication between train command centers, and the work crews out on the tracks. >> this decision will make california the first state in the nation to adopt such comprehensive rail transit safety rules. >> with the agencies around the bay area, particularly the bay area, the emphasis is not on safety. they talk about safety, but is it really. >> they first started considering new safety rules in 2009. it is 7:38. police in watsonville are searching for three men accused in a halloween home invasion robbery. police say a man, a woman, were passing out candy to trick or treaters at their home on gonzalez street when three masked man broke into the home. the male victim suffered face injuries and was rushed to the hospital.

if you have any information, call watsonville police. the santa cruz sentinel reports police made 18 arrests but the night was mostly quiet. all of the oars were for alcohol or -- of the arrests were for alcohol or probation violations. 52 students became sick this week at florence moore hall. four of them were hospitalized for dehydration. some of the students say it felt like food poisoning. >> i remember i ate lunch that day, and i felt perfectly fine and after class that afternoon, i came back here and then was sick for the next 8 hours. >> stanford says it has thoroughly cleaning out the dorms, and they plan to sanitize the entire o dine -- the entire dining hall. but the school says food and the food workers do not appear to have caused the illness. they will still be asking student what they ate and who they came in contact with, to see if it was a common person. there are picket lines up

at uc san francisco this morning. professional workers, including pharmacists and registered nurses holding the informational picket line outside uc san francisco right now. they say the uc system wants to cut their bay and their benefits. despite report a $524 million profit last year. there are similar picket lines outside four other uc medical centers around the state. it's not a strike and all the scheduled workers are expected to report to their jobs. 20 minutes now before 8:00,s fbi is investigating a threatening note found on board a plane from sfo. the united express flight was headed to san antonio yesterday afternoon when it was diverted to phoenix. the tsa says a crew member found the note in the restroom. when the plane landed in phoenix, passengers were escorted off the jet and interviewed by police. a bomb squad swept the plane but found nothing. the 43 passengers boarded a new

flight that landed in texas late last night. we're learning about what cause add deadly 2011 plane crash in watsonville, the decision of the pilot to take off in foggy weather may have been a major factor in the crash. david huton and his family were killed when the plane crashed into medical offices shortly after takeoff. he had only earned his pilots license three months before the crash. starting today, the bike path on the eastern span of the bay bridge will have some new hours. it will be open from 7:00 a.m. to 5:30:00 p.m. since its historic opening in early september, bicyclists have been able to ride on the path from dawn to dusk. with daylight savings time coming sunday, bridge officials decided they're going to make the change. and the lights on the bay bridge will shine a little longer. starting tonight, the bay

with what that means for this troubled city. >> the plan is to transform the army bay into the global trade center that will expand the port of oakland and improve the local economy. the $1.2 billion project includes a logistics center, a rail yard and warehouses for exporting and importing goods. it's estimated that the first phase of the plan will create 1500 on site construction jobs and with local hire requirements mandating that many of the jobs will go to oakland residents. the project is a public/private partnership. it's supposed to improve the port's ability to compete globally. the ground breaking ceremony, 1:30 this afternoon at the old oakland army base, near warehouse road. in our next hour of mornings on 2, oakland mayor, gene quan is going to be in the studios to talk about the changes and expectations for oakland. reporting live in the news

room, pam cook ktvu channel 2 news. time now 7:49. state officials are reaching out to people in the central valley who don't like the new high speed rail project. some of them have complained that the initial ruth would cause -- route would cause congestion and hurt valuable farmland. officials are now recommending a new route for the second leg of the train that would stretch from fresno to bakersfield. the rail board will consider the proposal next week. work on that first section, a 30-mile stretch of area north of fresno has already gun. it's 10 minutes before 8:00. apparently a crash on 880 in oakland. sal. >> an overturned vehicle on 880 southbound at 23rd and caused problems northbound, but look at the back up on 880 southbound. you can see it's very very slow as you drive down from the jack

london square or broadway area and it says that way the whole time heading down to the crash which is southbound at 23rd. it's actually been reported southbound at 23rd, but northbound though, is a minor accident caused by the first one. people were affected by that crash. let's take a look at it now, on the maps, if you want an alternate route, this is the crash right here on 23rd. the traffic is very slow as we showed you, so maybe what you could do is you could use 580. 580 does move well all the way through, all the way to castro valley, and you can connect with 880 using 238. that's a pretty decent alternate route for you. save you a little bit of time and hassle. let's move along to a live picture of the toll plaza. it is lighter than it normally is heading west into san francisco. and at 7:51. let's go to steve. thank you sal. we have clear skies. hardly any breeze, but there is a slight component, especially by the coast, for an easterly breeze, so that will hold the fog and check at least until

it was yesterday or today, but today looks about to be the warmest. it's cold in parts of the coast. we heard from nancy, and 43. and there's fog out there. it's trying. it needs help in the form of a front, tonight or tomorrow r for a san francisco cool down. -- or tomorrow, for a cool down. sunny and warmer. a slight offshore component, 30s, 40s and 50s. santa rosa back to 39 degrees. more 40s than we have seen the last couple of mornings. we had a rather cold pattern. san rafael, 73 yesterday, 73 today. morning low of 45 degrees. the big news will be the front coming in for the weekend. today things look pretty good, although the front will increase the low clouds and fog and give us a northwest direction on the wind and it will cut right through you. that won't be today. cold lows for some in inland. fog near the coast. it's trying but i don't think much of an impact until tonight or tomorrow. a lot of 70s today.

here's sal. steve, good morning, we are looking at a crash on 80. that is blocking traffic. -- on 880 that is blocking track. 880 southbound, r very slow. a crash -- southbound, very slow. northbound traffic is slow from the coliseum. the alternate route would be to use eastbound 580 instead. 580 connects back with 880 using 238. and that would be a much better way to go. you can save yourself some time, even though that's technically the longer way to go. at this point it's the faster way. let's go and take a look following the breaking news in the south bay where a deadly accident is causing major delays. this is happening in milpitas near scott creek road. the back ups are pretty long here on northbound 680 as you pass the seem. chp says a suspected drunk driver hit and killed a construction worker. another construction worker has minor injuries. >> there have been some

contractors, friends of the victims that have arrived on scene. they're shook up. every time you've got a contractor working on the side of the road, there's danger. >> now, the driver who was suspected of driving under the influence has been rushed to the hospital where life threatening injuries. the alternate routes, in fact i have some for you right here, we can push in. 680 is backed up longer than it was because it's later in the morning. the alternate would be to use 880 coming through and then use mission boulevard to get back onto 680. you'll encounter some slow traffic, but better than what you'll sit through on northbound 680 in san jose. new this morning, a woman underwent emergency surgery after getting shot several times at an apartment complex in hayward. as police shoot for the shooter, tenants are complaining about the violence in their neighborhood. claudine wong has talked to a

man who was home when the shots were fired nearby. good morning. >> reporter: good morning, tori, yes, we're on sleepy hollow avenue and behind me is the lord tenson apartment complex that is a big complex that stretches down the street and around the corner. you can see the crime scene tape that is still up which gives you a better idea of where this happened out here. we have been talking to residents out here. one man did hear the shots fired. this happened at 11 last night. police tell us they got calls from multiple people saying shots were fired. they got out here, found the woman outside and she had been shot multiple times. they did take her to the hospital. she underwent emergency surgery. her condition is not known at had hour. we have been talking to residents who say violence is not uncommon inside this sprawling apartment complex and many told us they are frustrated. we talked to one man who described what he and his girlfriend heard. >> we were watching tv last

night around a little bit before 11 and she heard about two shots. and shortly after we walked outside, and we seen paramedics and police driving down this way where we were at on sleepy hollow, and we were just like, you know, it's not again, you know, it keeps happening, you know. >> reporter: how long have you lived out here. >> i've been here for like two years. it's just sad this is going down. there's kids out here trick or treating and something like this happens, and not only that, we have our kids that live here, and it's just dangerous. >> reporter: he told us if he could move today, he would. we have talked to other residents who say they are right now looking for other places to live because they say the situation has just gotten intolerable. as far as this shooting, and this investigation, police tell us they're still not sure if the woman was visiting or if she actually lives here. they are also not really seeing any suspect -- releasing any

suspect information at this time, and they spent the night talking to witnesses and people out here hoping to have more information out here. claudine wong ktvu channel 2 news. time is 8:5. in cloverdale, two boys who were out for halloween were hit by a pickup truck. the boys, 12 and 13-year-olds were on the crosswalk on south cloverdale boulevard when the truck driven by a 75-year-old driver hit them. one boy had a broken leg. he was flown to children's hospital in oakland. the other had head and shoulder injuries and was taken to healdsburg memorial hospital. police say the driver is cooperating. back in july in that very same crosswalk, a 68-year-old woman was hit and killed and an elderly driver was charged with vehicular manslaughter. 68-year-old maria ponce was hit in the crosswalk. relates are demanding more

safety lights in the crosswalk. in san francisco last night, hundreds of people packed the castro district for halloween, but there were no major problems. crowds weren't as big as in years past but people didn't seem to mind. there were all kinds of costumes on display. >> is this your first time in the castro. >> yes. >> how did you hear about it. >> a friend. >> the costumes ranged from that, madame butterfly, to a tribute to the tv show seinfeld, a lot of people. now in past years, halloween and the castro drew about a hundred thousand people. city leaders scaled back the event after several violent incidents. there's more about that violence in the past on halloween in the castro. 2006, 9 people were hurt. someone fired shots into the crowd. in 2005, 1 person was stabbed and a man was severely beaten in 2004. in 2003, one person was shot and in 2002, four people were

stabbed. we have new information on a controversial fatal shooting of a 13-year-old boy in santa rosa last month. sheriff's deputy, erik gail house shot and killed 8th 8th grader andy lopez after mistaking his toy for a real rifle. now, a santa rosa man is telling the chronicle the same deputy pulled a gun on him during a highway traffic stop two months early. the man said gailhouse was so ire rational, he questioned the deputy's emotional stability. there is disturbing new information about the castro valley nursing home scandal. at least one worker for the department of social services went to the valley springs manor after a most of the staff had left. but the report says the worker did nothing to end the chaos at the nursing home. investigators say the staff essentially abandoned 14 sick,

elderly and bedridden patients last week after state regulators shut the nursing home down. a cook and a janitor with no formal training took care of the abandoned patients. south bay homeless advocates say more and more homeless people are living on buses to get shelter and say warm. the mercury news reports homeless men and women are using the 22bta bus as a shelter every night. that bus is the only 24 hour bus line in the system. it goes between east san jose, and palo alto. the new survey says there are 7600 homeless people in santa clara county. we have new video to show you. some disturbing treatment of mentally ill prisoners in california and we have to warn you, the video is very graphic. now, a federal judge released this video yesterday. the video from july of last year shows an inmate who was

sprayed five times in 15 minutes for being tackled -- before being tackled to the ground by a half dozen guards. officials say he needed emergency medication. the correctional department says use of force is always a last resort, and what you don't see on the videos is the hours of discussions between the inmate and clinical staff before that cell extraction was ordered. it is coming up on 8:o 10. the -- 8:10, the cost card -- guard has released a statement. personnel having on board for routine inspections and to ensure compliance with applicable safety, security and environmental protection regulations. the coast guard toured the barge on wednesday but they still have not said if the barge belongs to google. your time's 8:10. will hall of fame quarterback joe montana wants a new hotel

looking good. fog is trying to get close to parts of the san mateo coast. i don't think it will make much of an impact until later. the front will sweep in and give a good cool down over the weekend. starting off anywhere from 30s to 50s. san francisco still seeing components of an easterly breeze so as long as that holds, it will be in the 70s. if it turns westerly, all bets are off. i don't think it will until later. sunny for all, a little bit warmer for inland temps. 30s, 40s and 50s. these really haven't changed all morning long. a little bit more 40s than 30s than the past couple of mornings. system will come in, and give us more of a northwest direction. strong low, digs up nevada sunday into mondayment monday -- monday. fog near the coast. i want to point out that we found that crash what truck in san francisco. northbound 101 between candle stick, and 3rd. it's a huge problem for r

traffic there. northbound 101. it's backed up from candle stick and southbound 101 is going to be slow as you leave the city and head down. it's a big eyesore. if you want to use an alternate, get on 280. 280 southbound is busy. not as bad as 101. that's a good alternate route for you. i also want to mention 880 northbound. it's getting better. we had a crash southbound at 23 23rd. that crash is gone. still a little bit. getting up to 580. 580 all of a sudden is slow as well. i do want to mention that the toll plaza has been nice and light coming into san francisco. 8:32. let's go back to the desk. sal, thank you, at 8:32. new this morning, a san jose house fire chased a family out of this victorian home. this is on north 12th street. caught fire 5 this morning. it took firefighters about 45 minutes to get it out. now, this is a duplex, 9 family

members lived there. >> my mom woke me up, and my room was like, it had a bunch of smoke. >> firefighters say it's going to take some time before they're ready to allow the family to go back inside. investigators think the blaze started in the kitchen, and then spread to the walls and the roof. b.a.r.t. union leaders are prepping the ballot boxes, getting ready for a vote on the ten it -- on the tentative agreement. katie utehs is live in oakland. giving us an update from b.a.r.t.'s biggest workers union. seiu. what are you hearing. >> reporter: union leaders tell me that they expect a huge turn out here at the downtown oakland marriott. the last seiu vote had a 90% turn out o. out-- turn out. that tells you how passionate and involved the members are in

the vote. both unions, the seiu and atu, they start voting at 10 this morning. 1400 members, mechanics, clerical workers are expected to cast their ballots at the marriott. the morning will start with an informational session about the contract, and there will be time for question and answers from the members before voting. i also spoke with a representative from atu. she says members are voting within the same time span. 10:00 a.m. to 10:00 p.m. she's not disclosing the location. if the two unions approve the tentative contract agreement, b.a.r.t.'s board of directors would vote next. reps say they have not picked a date yet. there is a regularly scheduled meeting on the 21st. they could also hold a special session. seiu union leaders tell me there's a lot of excitement around the tentative agreement because of some of the safety measures that are being included. they do expect members to vote for it, and expect it to pass

tonight. they tell me they should have those votes tallied by 11 tonight. atu could have them tallied by 11 tonight as well or as early as tomorrow morning. live in oakland, katie utehs ktvu channel 2 news. at the same time, orinda city councilman steve glazer is trying to ban future b.a.r.t. strikes. later today he'll present a petition with 20,000 signatures from supporters of his plan to make it illegal for public transit workers to walk off the job. he notes that new york city, chicago, washington d.c., they have all banned transit strikes. by the way, he is running as a candidate for state assembly seat. it's 8:35. the california's public utilities commission has adopted a series of new safety rules to protect rail workers. the puc vote comes less than two weeks after the deaths of two b.a.r.t. track inspectors near the walnut creek station. these are first of its kind rail worker safety laws and

they require additional training, improved record keeping, and better communications between training command centers and work crews out on the tracks. this decision will make california the first state in the nation to adopt such comprehensive rail transit safety rules. >> the puc first began considering the new safety rules in 2009 four years before last month's deadly tragedy on the b.a.r.t. tracks. and we're following developing news in milpitas where a construction worker has been killed in a crash on northbound 680. ktvu's brian flores is live to let us know how traffic is moving after a very tough morning commute. good morning brian. >> reporter: no question about that, tori, good morning to you. traffic still a mess out here this morning. you're looking at northbound 680. 4 miles south of scott creek road where the tragic accident took place. as you can see, traffic backed up. we came up from san jose, and from what we understand,

traffic is backed up to allen. and chp continues to work the scene as they investigate this tragic accident. it took place around 2:40. the driver of a silver nissan swerved into lanes that were closed off by contractors who were on the road trying to remove signs. the driver another silver nissan pinned one of the workers onto the truck, killed him instantly, the other workers suffered injuries. we understand the person who was killed is from vacaville. as for the driver, he was taken to a nearby hospital with injuries as well, and from what chp tells us, the driver may have been drinking. >> we were able to get a preliminary alcohol screening device on him, as well as there was odor, and signs and symptoms of alcohol intoxication that were used to determine. >> reporter: now, the workers and the driver have not been identified this morning. the workers have what we understand are contractors from caltrans and worked for a company called statewide

traffic safety and signs. as we take it back out here live, the immediate need is the traffic that has been a mess all morning. you can see northbound lanes, now, traffic is going to be a mess for the time being. we did speak with coworkers who were visually shaken this morning. the victim was a great guy, and he was also a father who was in his mid-30s. we'll continue throughout the morning. we're live here south of milpitas, brian flores ktvu channel 2 news. it is now 8:38. police in watsonville are searching for three men accused in a halloween home invasion robbery. police say a man and woman were passed out candy to trick or treaters at their home on gonzalez street when three masked men rushed into the home. the male victim suffered face injuries and was rushed to the hospital. if you have any information, call watt -- watsonville police. police made 18 arrests and said the night was mostly quiet. all of the arrests were for

alcohol or probation offenses. our time is 8:38. starting today, the bike path on the eastern span of the new bay bridge will have new hours. it will be open between 7:00 a.m. and 5:30:00 p.m. since it opened in early september, pedestrians and cyclists have been allowed to use the bike path from down to dusk, but daylight savings time ends sunday and it gets dark early. bridge officials decided to make those changes. the lights on the bay bridge will stay on a little longer. starting tonight, the bay lights will be continually lit from dawn to dusk. the producer of the light sculpture was able to monitor the 2:00 a.m. shut off time. to celebrate it, they will now offer free coffee and pastries tomorrow morning, 6:30:00 a.m. right at the ferry building. >> sounds very nice. 8:39. a former stanford football star walks out on the miami follow

we're coming back with breaking news. i want you to see these pictures of this crash on northbound 101. this truck went over the side and partially ended up on bay shore boulevard below. and it looks like 101 is down to one lane coming into san francisco because of it. and as news chopper 2 is looking a at the back up on this major freeway coming into san francisco, it's not good. it's backed up past candle stick park and pretty soon it's going to be backed up all the way down into south city if it's not already.

when you reduce 101 to one lane. southbound lanes are slows. if you could tilt down for us, i want to see the crash one more time. just this dramatic video that we have here of this truck that went over the side. now, if you see there, they have tow trucks, it's unclear how badly the person driving the truck was injured, but we do understand there were some injuries, and bay shore boulevard below as you can see is also blocked. san francisco police and chp are handling this. let's go back to the desk. >> 8:44. stocks are mixed right now. october auto sales for the three detroit based auto makers rose by double digits from a year earlier. results at ford and chrysler narrowly missed expectations and stocks down 2%. the dough is up 30. the nasdaq is down 6. and the s&p is flat. your time is 8:44. let's bring you up to date on some of the other top stories we're following for you right

now. emergency surgery for a woman who was shot several times late last night in hayward. police found her in the parking lot of an apartment complex near west tennison road and sleepy hollow. investigators are trying to identify her. they say her injuries are life threatening. and the chp says a driver accused of hitting and killing a construction worker early this morning on 680 and milpitas, may have been under the influence. a second construction worker suffered minor injuries. the driver of that car suffered life threatening injuries. and an early morning house fire damaged a victorian home in san jose. investigators say it started in the kitchen area. luckily, a family of 9 inside was able goat out unharmed. -- get out unharmed. a ground breaking ceremony on a huge development project on the old army base and the port of oakland. james juan here to talk about

this morning. thank you for coming in. >> this is the first of 3 billion-dollar projects that oakland's going to launch in the next year. >> it's supposed to improve the efficiency of the imports and exports and create jobs right. >> what it is is 300 acres of port in the army based line that's been lying fallow for 15 years. what it will do is expand the port and create new births. oakland port is the 5th 5th largest in the country. it is the number one agricultural port in the country. that is we export a lot of california food to asia and other parts of the world. it's a critical part of the economy. with this expansion, we hope to create something like 1500 new jobs in the constructional zone, there's an e equal number -- there's an equal number of jobs. leading the country out of the recession, this is important for oakland. >> while you're here, creating

jobs a big part of improving the economy in oakland and could be a factor in reducing crime when you get people back to work. >> absolutely. >> i have to ask you whether we can talk about crime stats are up or down, the reality is kids are being shot and shot at in oakland. with had that horrible case of caradine shot through the door. what else is being done to make it safe. >> that's a whole show. i'm not going to go there totally. crime stats are down, and murders are down almost a 1/4. and shootings are down. the new organization of the police department is a critical part of it. you're right, this project has a 50% oakland hire. we're hoping to put a lot of people, young man out of prison, often unemployable into these construction jobs. we are developing a system with the school district and with the county, so we have a warm hand so that young men in particular, who are unemployed or drop out of school can get

these high paying blue collar jobs. a project like this at the port offers this. the oakland city council when i was on it, made a clear decision that we wanted a diverse economy and we wanted to use the land at the port because it would be more efficient. it would create more jobs, and also be greener, and that's a thing that people don't talk about. the trucks in west oakland have caused a lot of problems with asthma and health care,s new modernized more railroads and a faster turnover. the community will be healthier and safer. creating 1500 new jobs in the city where the employment for young african-american is three times the national average is critical. >> before you go, also today, another important aspect, b.a.r.t. union workers are voting on this contract. i would hope it seems people want the mayors to get on board of preventing a strike from ever happening again, are you working on that. >> i think the way you work on that a that they're going to

have to keep working. these negotiations did not go well. there were plenty of safety issues that we saw with the death of two workers that they barely touched. if they can work on those, you'll unify their joint leadership of the system. and that's what we saw is that there was a huge gap between management and the workers and some pretty critical issues, they were very far apart. >> a lot to work on, thank you very much mayor quan for being here. it's 8:49. we want to check in with sal for more on the serious accident in san francisco. sal. yes, tori, right now, northbound 101 down to one lane here in san francisco as you drive past the freeway. it looks like they have opened up another lane. northbound 101 near 3rd 3rd street. this truck went over the side, the driver of the truck was taken to the hospital, but it's not clear how badly that person was hurt. but the truck is over the side,

and it's also closed bay shore boulevard as you can see, and the back up is beginning to build. this is going to be there for a bit. it's not easy to get there dump truck that was pulling a trailer off the guardrail and down onto the street. it's going to be pretty intense operation for a bit. and northbound 101 did not recommend it. the alternate route is 280 instead. let's quickly go and take a look at 880 north and southbound at downtown oakland. that traffic is moving well. 580 traffic this morning is okay. this is a look at the bay bridge toll plaza, backed up for a 3 minute delay. fog is inching closer to the coast, there's a component of an easterly breeze in much of san francisco. they're starting off very mild, 50s. cooler and breezy over the weekend. today looks good. temperatures warming up. san francisco no rain in october. last time that happened was 1980 and we might get rain in november. we better get rain in november. a high of 72 today, clear skies, the fog is right, it's

trying, but still there's a little bit of resistance. it needs umph. it's digging into oregon and idaho and nevada, and the end result will be a cooler, breezy pattern. 30s, 40s # and 50s. 37 at novato. pretty good cool down over the weekend. warm friday, this will be the last one for a little bit as everything starts to turn northwest and that will give us a good cool down as we go early to next week. a cooler, blustery weekend for some. and today, sunny and warm. cold lows for some inland, not nearly as cold as we had. fog near the coast, trying to get close to the san mateo coast. i don't think it will make an impact today. temperatures 60s and 70s. north bay, east bay, peninsula, south bay, everyone will be close here, even temperatures around 70. still good on the coast for were money day. cool down and breezy windy conditions, a lot of low clouds

a campaign to shut down the net stop cafe on mission street. it builds itself as a business center with dozens of computers operating 24 hours a day. but critics say it's become a center for gambling, drug use, underage drinking and loitering. police say they are building their case against net stop but the process has been slow and difficult. starting today, families on food stamps here in the bay area will be feeling the effect of new budget cuts. 47million americans rely on food stamps every month. an increase in benefits from the 2009 stimulus package, it has expired. a quarter of a million people in the bay area will be affected by this. a family of four would get $632 in food stamps, which is $36 less a month. 62,000 families in alameda county, and an additional 31,000 in santa clara county are on food stamps. lays is expected to
