a federal lawsuit in the kate of a 13-year-old shot and killed by a sheriff avenue deputy. the allegations against the sheriff's department claiming their training prak tickses may have played a factor in andy lopez's death. a man is hit and killed in a wheelchair. what we're learning about the victim and a look at the history of similar incidents at the intersection.

a wrongful death lawsuit is being filed in federal court in the case of 13-year-old andy lopez. he was carrying a fake gun when he was shot and killed by a sonoma county sheriff's deputy. lz also -- alex savidge has more. >> reporter: andy lopez's parents called the shooting unreasonable and unjustified. today here in san francisco, the family filed a federal civil rights lawsuit against the deputy who opened fire on that teenager as he was holding a replica assault rifle. nearly two weeks after andy lopez was shot and killed by a sonoma county sheriff's deputy, a federal lawsuit claims his death was unconstitutional. lopez was carrying a replica of a gun that turned out to be a

bb gun. gelhaus shot lopez seven times. the lawsuit claims he was walking with the toy gun and had his back to the deputy who ordered him to drop the weapon. the lawsuit suggests improper training by the department. it reads, "the sheriff's department encourages deputies to prematurely shoot suspects who pose no threat." todayant activist working with the lopez family talked about this. >> the family filed the suit because they feel their son was murdered by sheriff gelhaus. and that, you know, as it will be stated in the documents, it's a wrongful death. >> reporter: this is an unlimited civil claim seeking unspecified damages. the suit comes as the criminal investigation continues. the santa rosa police department is heading up that inquiry and the fbi is also investigating. an attorney representing sonoma

county told ktvu the filing of a civil lawsuit before the criminal investigation is unusual. lopez's parents and their attorney conducted their investigation into the shooting and their own autopsy and they will discuss the findings during a news conference set to begin at 1:00 this afternoon inside the office behind me in san francisco. alex savidge, ktvu channel 2 news. >> thank you, alex. and san francisco police are investigating an accident that killed a man in a wheelchair. it happened overnight in the area of market street and octavia boulevard, considered one of the busiest and dangerous intersections in the city. brian flores is at that intersection with what we've learned about the victim. good afternoon, brian. >> reporter: good afternoon, tori. we've been keeping in touch with the medical examiner's office. at this point, they have yet to positively identify the victim. they are currently looking at fingerprints to obtain a

positive i.d. an intersection considered one of the busiest, if not the most dangerous, many say despite recent changes that they are not surprised that this continues to happen. this accident happened harnd midnight. the man in a wheelchair was trying to cross market when police say the driver of a car hit him as he was making a right turn from southbound 101 to market. the driver stayed at the scene for several hours and from video he appeared shaken up and coherent. he lee -- he looked to be wearing a security guard jacket. 56 collisions occurred at this intersection according to records. despite camera being on last friday and a no-right-turn sign, commuters say safety issues continue. >> i've seen that in general. i've seen it on we'll and market -- on beale and market

and he died as well. it's sad. >> if you reduce the number of cars, where are they gonna go? i don't know what could be done quite honestly. maybe an overpass or an underpass or something. >> reporter: now, at this point, investigators say they will be reviewing the footage from the video cameras in their investigation. these cameras went live pretty recently on november 1st. as we take it back out here live, the sign was put out here recently, the violations will cost drivers $238. again this victim has not been identified but we hope to have more information during the ktvu news at 5:00 and 6:00 tonight. we're live here from san francisco, brian flores, ktvu channel 2 news. >> all right. thank you, brian. the man accused of killing a federal investigator appeared in an oakland courtroom a few hours ago for a preliminary hearing. randy alano faces life in prison without the possibility of parole if convicted of

killing san drew coke. police found her body in vacaville back in august nearly a week after she was reported missing from her oakland home. investigators say the man met coke about 20 years ago when he was intarscated at san -- incarcerated -- incarcerated at santa rita jail and they dated briefly. new information about the man accused of opening fire at l.a.x. police say paul ciancia texted his family on the morning of the shooting that he was going to kill himself. los angeles police officers got to his apartment 45 minutes after he left for the airport. police say ciancia killed one tsa screener and wounded two others and a passenger. some are calling for better security at tsa checkpoints. >> part of that investigation will be a review of the security measures that were in place not only at l.a.x. but i think a review of the

security arrangements that exist in other airports as well. >> police officers shot ciancia four times. he's heavily sedated following surgery for his wounds and is currently under 24-hour guard. a new study from uc berkeley raises concerns about the outsourcing of airport workers. according to the study, the share of airport workers outsourced to contractors grew from 19% in 2001 to 26% by 2011. during the same period, airport workers saw their hourly wages fall by an average of 15%. the study says the airport workers declining pay affects airport efficiency, safety and security. the study was financed by the service employees international union. stricter gun control laws may be coming to sunnyvale if voters approve a measure tomorrow. janine de la vega tells us why it's drawing controversy. >> reporter: a year after the shooting at sandy hook elementary school in connecticut, sunnyvale mayor is

leadth push for stricter gun control here. >> i guess it was a low crime rate in newtown, too. >> reporter: measure c requires a gun owner to tell police within 48 hours if their gun is lost or stolen. it prohibits ammunition magazines that can hold more than ten rounds. gun owners are required to lock their guns away ifs -- firearms are not in their immediate possession -- firearms are not in their immediate possession. >> not the way to do it. >> reporter: they would be required to maintain ammunition sales. those prohib interred from owning guns would be deterred from purchasing ammunition. some who live in the sunny arts neighborhood say the restrictions make them vulnerable. recent break-ins have led them to install security cameras. >> they know you can't have an

armed weapon. >> reporter: supporters say more gun safety is needed to prevent accidental deaths, shootings and suicides. >> it has to stop. the only way we can do that is make people aware if you legally gun a gun -- own a gun, take better care of it and keep accidents from happening. >> reporter: voters will get to decide when they cast their ballots tomorrow. in sunnyvale, janine de la vega, ktvu channel 2 news. in pleasant hill a vote on gun regulation is scheduled for tonight. this establishes distance restrictions between gun stores and mark parks -- parks and schools. if approved, owners and employees would have to pass background checks and stores would be required to install alarm systems and surveillance cameras. two battling a house fire discovered multiple marijuana plants in the home. firefighters arrived at the home on altamont road in

unincored -- unincorporated san leandro. newschopper2 was overhead. everyone was able to get out of the house. one person was hurt but fire officials don't know the extent of the injuries. it's still unclear whether the marijuana plants fire crews say they found played a role in the fire. could san francisco's at&t park soon be home to both the giants and athletics? we'll tell you about a controversy stadium sharing proposal. warming trend for the week ahead. rosemary will be here to tell you how high the temperatures will go. plus, making schools safer. the measure some north bay schools are taking to ensure student safety and how much it's costing the district. the novato school district will install security cameras today at elementary an middle schools -- and middle schools. 48 new cameras similar to these are going up on four campuses. the district says they will be used to keep kids safe, secure school sites and discourage any damage to school property. >> it's not just vandalism. but there's actual break-ins and loss of school property or destruction of school property. sometimes it can be graffiti on the walls. >> the district is paying more than $120,000 to install the

cameras. last year, it spent about $177,000 on security cameras at two of its high schools. looks like there is enough support in the senate to pass legislation that would keep most employers from discriminating against gay and lesbian workers. ktvu's kyla campbell explains how the bill would protect workers and who is pressuring lawmakers today. >> reporter: the senate is expected to vote later today. this bipartisan bill would keep employers with 15 or more workers from hiring, firing, compensating or promoting employees based on their sexual orientation or gender identity. it's the first major piece of gay rights legislation since congress entered the ban on gays serving open in the military. president obama posted in the huffington post and said does it make a difference if the firefighter rescues is gay or the mechanic who toos your taxes or -- who does your taxes

or who fixes your car? tim cook argued, we found that when people feel valued for who they are, they have the comfort and confidence to do the best work of their lives. all 55 democrats and at least five republicans in this senate support this bill so it is likely it will get the 60 votes needed to pass. it's doubtful the republican- controlled house will sign on. in washington, i'm kyla campbell, back to you. san francisco police hope a surveillance photo will help them find a missing brazilian sturnt. the photo was taken on halloween on 16th in the mission. it shows a man using a credit card belonging to 23-year-old paulo netto. several days earlier, his mother and sister say they received a panicked call from netto who has been missing for a work and he says people were following him and he was in trouble. police in davis are investigating what appears to be an attempt to blow up a fraternity house. students reported smealing gas around 1:00 yesterday afternoon

and investigators determined that someone had intentionally created a gas leak and then had lit a fire to try to ignite the gas. police say the explosion could have leveled the home and others nearby. so far, no arrests have been made. there are already traffic concerns ahead of tomorrow's grand opening of the graden casino in rhone et park. it's expected to bring in $500,000 a year as well as draw 40,000 more cars to the area. the chp is making plans to prevent a traffic backup on highway 101 from the streets surrounding the resort. and officers are encouraging guests to take back roads through petaluma to get to the casino. >> use alternate routes, plan your trip, continue say say -- don't say, let's go to the katy casino and -- let's go to the casino and get off where you know. >> graden resort is almost four

times as thunder valley in sacramento. a vehicle hit a pedestrian in san ramon. it happened just after 6:00 a.m. at stone leaf and south wedge wood roads. these are pictures from newschopper2. the fire department says an ambulance took the person to john muir medical center in walnut creek. but there are no other details of the crash. the oakland as are speaking out today about reports on the team moving across the bay to temporarily share the san francisco giants' ballpark. according to the chronicle, the move would happen if the as can't come to terms on a new lease agreement at the oakland coliseum. it says mlb would help them work out a deal with the giants to play at at&t park for two seasons. that move probably won't sit well with many giants or as fans. >> i don't want them to move but if they are gonna move, i would rather it be in san francisco than san jose.

sunshine. we do continue with the north breeze and gusting strong over some of our hills. anywhere from 20 to 30 miles an hour. we have no advisory in place but i want to show you some areas, livermore reporting 14 miles per hour. hayward reporting 14. san jose reporting 12 and the gusts to 20, 25 at times. a breezy afternoon in store with temperatures warmer than what we had yesterday. 21 reported at the airport in fairfield. i should say at the air force base in fairfield and gusting to about 30. that north breeze is going to continue. if i step way back, i can show you why. ridge of high pressure will strengthen and build its way toward the west coast. that will lead to a warming end interest. first half of our week temperatures will be warmer with each passing by. now as i zoom you back to the coastline, you can see how the dry northerly breeze continues. a little bit easier to understand why that dry wind will be with us for today.

relaxing a little bit for tomorrow. tuesday and wednesday, warmer and less wind. for the afternoon today, temperatures in and around vallejo, you are looking at 68. 70 for napa. 69 st. helena, 69 in petaluma. 68 for san rafael. getting to the east bay, upper 60s to low 70s. 68 for oakland. 66 in hayward. 70 degrees this afternoon. pleasanton. areas around brentwood, 72. into the south bay, 67 san jose, 68 for cupertino. along that stretch of santa cruz and the boardwalk, 71 for the afternoon under mostly sunny skies. along the peninsula for today, 69 redwood city, palo alto you are checking in at about 68. 66 san bruno. 64 for san francisco. low 60s with mostly sunny skies along the coastline. so again, for tomorrow, we wake up. it will be another cold start. as we get into the afternoon, temperatures will be up slightly over what we have today. wednesday looks to be the warmest day. widespread low to mid-70s for the inland communities.

mid- to upper 60s along the coastline. notice by thursday, temperatures begin to cool off a little bit. thursday, friday, saturday, into sunday. now with your bay area weekend always in view, we've got temperatures rolling back just a bit. low 60s along the coastline with more cloud cover and our first chance for rain right now may come sunday into monday. how fortunate we keep pushing it back. >> but it looks like at least for now dry for the foreseeable future. i know it's been about ten months. >> yeah, we need it. >> yes. >> thank you. >> you got it. sections of the old eastern span of the bay bridge are scheduled to start being dismantled this week. crews have been preparing to tear down the old structure since the new span opened on labor day weekend. the demolition has been divided into three parts with large sections expect gd to be removed this week. the complete dismantling is expected to take three years

and cost $239 million. and in the oakland estuary later this afternoon, a massive recovery project is scheduled. this is a photo of a partially submeged tub -- submerged tub boat named captain al. today, the epa is expected to raise the tug. the raising of the tug is part of a two-month long effort to clean up the estuary. a shakeup announced by a major smartphone maker. the change in the sales phone process and to top leadership. and information about twitter's ipo, how much money is expected to be raised and what san francisco mayor ed lee was doing near the company's offices this morning.

well, stocks basically flat right now. afternoon trading on wall street, investors pick up over the stock market that's near all-time highs. the dow you can see is up just 3. the nasdaq is up 7. s&p also up 3. not up right now, though, blackberry stock. it's plunged 16% today after the struggling company suddenly announced this morning it has given up trying to find a buyer and it's now replaced its ceo. this morning, the once uber popular smartphone maker announced a $1 billion investment agreement with fairfax. it also announced that the ceo hines will be stepping down and

john chen will serve as interim ceo. analysts say twitter's initial public stock offering could now raise more than $2 billion. regulatory filings show that twitter plans to price shares between $23 and $25. that's a big jump from the original projected price of $17 to $20 a share. market watchers expect twitter shares to start trading thissing with. and san francisco mayor ed lee toured the stretch of market street where twitter has headquarters. the mayor helped broker tax breaks to keep it from moving to south san francisco. lee says it was part of a larger revitalization of the area. today on ktvu channel 2 news at 5:00, continuing coverage of a deadly crash in san francisco that killed a man in a wheelchair. what family and friends are telling us about the victim.
