good afternoon, i'm torrey campbell. the teen accused of setting a passenger on fire is expected to be in court. this is video of the 16-year- old oakland high school student being arrested tuesday, the a day aft incident. tara moriarty joins us live with the charges the teen could be facing and the latest on the victim. good afternoon. >> reporter: good afternoon. as far as the suspect goes, we know the high school student is going to be arraigned at 2:00 this morning at the wiley emmanuel courthouse. we don't know if he's going to be charged as an adult or could be facing enhanced charges for a hate crime. we say that because the victim in this case is agender. he is a gender activist. fleischmann was asleep on a you public bus when another passenger lit his skirt on fire. we spoke to the school director

safety rules for workers are now focusing on one policy in particular. sal has been monitoring today's meeting and joins us live. >> reporter: all those this meeting was called before the two workers died, the process of simple approval which is when workers are out on the tracks working and watching out for trains on the road, that process is now under intense focus. as a matter of fact, california state assemblyman says simple approval is in direct conflict with state law. >> california state law squarely puts the burden of safety on employers. employers have to provide a safe working environment for their employees. >> reporter: last month christopher shephard and lawrence daniels were killed as they inspected tracks near the pleasant hill station october 19. at the time a trainee was operating the train because it was during the bart strike.

there's a conflict with cal owe sho and bart over bart's safety records. bart has appealed the state's citations regarding simple approval and other violations. bart maintains it has a good safety record and has taken adequate steps to safeguard workers, something assemblyman roger hernandez says is not true. >> i would say that they are erroneous in the statement and to support that, my position is finally it was after the most recent deaths that the simple procedure method has been suspected after many, many years of them contesting that that procedure was safe. >> reporter: since the accident that took the workers' lives last month, simple approval has been suspended by bart but today bart executives will address at the hearing saying simple approval the last five years alone has been used more

than 40,000 times without incident. they're imprying that the procedure is safe. they've also said that -- they've also conflicted with osha. they don't want to end it permanently so there's a conflict there. more on the hearing coming out. my colleague will have more on the evening news. live in san francisco, sal castaneda, ktvu channel 2 news. >> thank you. muni officials in san francisco today launch add new public safety campaign. the new public awareness project called eyes up, phones down aims to remind passengers to be aware of their surroundings at muni stations, stops and on vehicles. the sfmta and san francisco police are also teaming up to deploy more rivers r officers on muni to increase overall security. muni's quarterly performance report is out and confirms what many already know. muni buses still run well behind schedule. just 59% of muni buses were on time in june and july. there was a slight improvement

in august with 60% of buses on schedule. that's lower than muni's goal of 85% on time rate. muni says the number of extended delays has dropped and more vehicles are being put into service. the highway patrol is still trying to figure out what happened before a woman was killed while running on a busy east bay freeway. the unidentified woman was in the lanes of traffic on westbound interstate 580 around 4:45 this morning in oakland. this is near the mcarthur boulevard off ramp. the chp says the driver called 911 and said he could not avoid hitting the woman with his pickup truck. >> what the driver of the car said was that the pedestrian was in the number two lane and for an unknown reason decided to sprint toward the center median directly in the path of his truck. >> the chp says the woman was killed on impact. the two left lanes of the freeway were shut down for about an hour and a half at the scene.

a college in cupertino is warning students of a sexual assault on campus a. female student told police the assault took place monday afternoon in a women's restroom at the school's media learning center. however, the student did not report the assault to police until yesterday morning. the student also told police she knows her attacker. the santa clara county sheriff's office and campus police are now investigating. a pervasive environment of sexual harassment and assaults by students. a federal investigation finds that west contra costa unified school district officials have failed to adequately address these serious problems because of the findings the u.s. department of education has reached an agreement with the district to make sure it complies with its legal obligations under title 9. it requires schools to take immediate actions to eliminate harassment, prevent its recurrence and address its effects. the man who sparked a statewide amber alert after taking off with his two week

old son is behind bars today. 22-year-old was arrested yesterday in mexico and baby henry was found safe. now henry's mother is waiting to be reunited with her son. she told ktvu through an interpreter that waiting for word on her baby for 24 hours was very difficult. >> i was afraid i wouldn't be able to find him again or see him again. i was really scared. >> guler crossed into mexico through arizona despite an amber alert. he was caught at a second check point after mexican authorities learned that he was wanted. more finger pointing in the san francisco general hospital case of a missing patient who was found dead 17 days later in a hospital stair well. yesterday san francisco sheriff announced the preliminary investigation shows hospital

staff gave deputies faulty information. he says because of that, it took over two weeks to locate the missing patient. >> twice during that conversation, the deputy was told that the missing woman was african-american and wearing a hospital gown. >> when a full search of the hospital was ordered, his deputies only searched about half of the stairwells. san francisco general has released a statement outlining its immediate steps. they include an independent review of security and facilities. recommendations are expected in 30 to 90 days. also refresher training is now being provided to deputies assigned to the hospital. administrators add they are exploring whether to expand private security contracts to help fill in gaps. after much anticipation, twitter is now officially trading on the new york stock exchange. a look at how the stock is doing right now and why not everyone is happy about it.

a group fighting prostitution says the state is failing to protect those from sex trafficking. california gets an f. the group praised new california laws that increase prison times and fines for sex traffickers but says that's not enough. >> the state needs to take some of these stronger laws and implement them, putting guys in jail, prosecuting them for buying commercial sex with children. if they were not a buyer, there would not be a victimized child. >> most other states that receive failing grades last year improved their scores but california has the least effective antitrafficking laws in the country. piedmont police may soon have a new tool to catch criminals. license plate readers may be up and running by the end ever the

week. the installation process started in september. once complete, 39 cameras are expected to be installed at 15 piedmont locations with a price tag of $678,000. people who live in a castro valley neighborhood are being told to be on the lookout for whoever is responsible for starting a series of suspicious fires. officials say someone has been deliberately setting brushfires in the area of walnut and almond roads. two fires were started just after 6:00 last night. over the past month, there have been a dozen fires in the area and several more during the last year. they've all been started in a canyon of trees where there are homes nearby. >> it is unusual to happen in the same area for the past year that we're aware of. it is of concern. >> investigators are not sure if it's one or more people starting the fires and they're urging neighbors to call police if they see anything suspicious

in the area. a community group fighting to save san francisco city college is suing the commission that is revoking the school's accreditation. right now the save ccf coalition is holding a news conference to announce the lawsuit against the accrediting commission for community and junior colleges. the organization announced this summer that san francisco city college's accreditation will be revoked next july unless an appeal is successful. the decision would force the schools to close. san francisco-based twitter is now a publicly traded company. before its initial public offering this morning, shares were first priced at $26 but they soared right out of the gate at one point touching $50. taking a look right now, they are trading up 82% from that original $26 price at $47.51. but while investors were showing their excitement over the ipo, ktvu channel 2

explains why the housing fear could hurt local families. >> reporter: a flurry of trading followed tatter's initial public offering on the new york stock exchange. priced at $26 a share, many investors flocked at the opportunity to buy. from san francisco's market street to wall street, all eyes or twitter today. the new york stock exchange even live streamed the ipo in honor of the social media giant. but others are being more cautious. >> i'm going to wait until i see how the market reacts. i think there's a lot of hype sometimes. >> reporter: twitter boasts some 230 million users which means major advertising potential. but in its seven years has not produced a profit. it's also upsetting housing advocates. >> have you heard? >> reporter: housing advocacy groups san francisco rising is concerned about the fortunes resulting from the ipo as tech millionaires buy up real estate formally owned by the working

rally at stanford university ahead of tonight's much anticipated game against the oregon ducks. this is a live shot of the scene on campus right now. lots of people there. and espn is already built a set to conduct a live broadcast of the game. the 6:00 game is creating a lot of excitement but also concern about traffic jams. in fact, some stanford fans even camped out overnight in anticipation of the game. stadium gates open at 4:00 this afternoon and palo alto police are bracing for very heavy traffic all around the stadium. actually they say that could start around 2:00. stanford is letting employees leave early to ease congestion. >> or gone usually -- we -- oregon usually -- we travel well as fans. i came all the way from boston. there will be a lot of us. >> it's great to see the cardinals, the hometown teach i grew up watching playing the oregon ducks. >> the game sold out back in august. if you are one of the lucky 51,000 fans going to the game,

out toward right around pacific grove and the sal lien nass area as well -- salinas area as well. current temperatures are warming back up. with the cloud cover overnight, in fact, we had a nice warm start this morning. not as cold as the past few mornings but we had the readings in the 40s to low 50s. right now 71 degrees in santa rosa. san jose 66. livermore right now checking in 70 and fairfield looking pretty good with partly cloudy skies. the current temperature of 68 degrees. throughout the day today, throughout the afternoon a forecast high on track to reach the mid-70s. so the forecast at the -- owe for the big game, partly cloudy skies this evening. temperatures will be in the lower 60s. winds not much of a factor, right around 10 miles an hour coming in out of the northwest. forecast deadline for today -- headlines, tomorrow partly cloudy, cooler. these are all minor tweaks to the forecast. and the weekend will be dry but the winds could pick up on sunday. as far as rain chances, we've been talking about this the paps few days. still a ways out.

the forecast models backing off on the accumulations but there is a chance especially in the north bay tuesday morning watching out for the potential commute. could be a wet one out there. >> thank you, mark. thousands of people are scrambling to get out of the path of a powerful typhoon as it barrels towards the philippines. residents are evacuating and stocking up supplies instead of the super typhoon. it's currently in the western pacific and expected to make landfall in the eastern part of the philippines tomorrow. meteorologists say it's one of the most intense tropical cyclones ever recorded, the equivalent to a strong category five hurricane. we'll be keeping a close eye on that throughout the day here. the fda says at least 7,000 deaths per year and now it's taking measures to phase out an artery clogging food ingredient in some foods. >> plus, it's not your typical hospital theme. we'll tell you why this dance party in an operating room is

it is still at the -- trading at $46.69. today the fda announced new regulations to require the food industry to gradually phase out trans fats. the move is predicted to prevent as many as 20,000 heart attacks a year and 7,000 deaths. the agency is not yet setting a timeline for the phaseout but will collect comments for two mondays before officials 2ker78 how long it will take -- determine how long it will take. transfats are often found in processed food including some microwave popcorns, frozen pizzas, refrigerated doughs. not too often you see nurses, doctors and even a patient all dancing in an operating room. but that's just what happened tuesday in san francisco before her double mastectomy. ucf doctor debra cohen asked the operating team to take part in a flash mob dance that's now
