days ago. there is that system that will cower out the fog and usher in cooler conditions. only a patch or two of fog. a lot of 60s here. here is sal. steve, good morning. we are looking at the traffic that is mostly calm out there. there are a lot of people out there already driving somewhere. this is a look at the bay bridge toll plaza. its backed up for a five to ten minute delay before you make it on to the bridge. also we are looking at 880 north and southbound. that traffic is moving along very nicely as you drive through there. there are no major problems. there is a report of a car fire. northbound 87 and some three young men were seen running away from the car fire after it started. according to witnesses. so san jose police and chp are on the way. let's go back to the desk. we are following developing news mismorning. santa clara county sheriffs deputies remain at the scene of a deadly shooting outside of a

restaurant. it happened just before 10:00 last night on white road. this is in an area of east san jose. deputies found the male victim in the parking lot of the san jose taquria. there are no suspects at this time but since white road is a heavily traveled area, deputies open someone may have seen something. janine de la vega is there on the scene. she will give us an update in 30 minutes. just when you thought the bart contract talks were settled, now there is word of a glitch that may derail the talks that led to the four-day bart strike. ktvu brian flores is joining us live. you are in west oakland where details that the unions say they are not budging. >> reporter: commuters were certainly breathing a sigh of relief when they reached that agreement an the bart strike ended. but now with this language glitch there are signs of a

possible is another bart strike. when bart board of directors and management saw it there was language in it concerning paid family leave that management says they didn't agree to. that is being reported the issue resolves around how much they will receive under this new contract. the new contract would have given workers six weeks of paid family leave. prior language reportedly would have asked for workers to use sick leave and vacation time first. in any case bart board members say they are investigating while the union says they are not budging. >> they voted on what was presented by the district. the district had the same practice we have. its a complete agreement. we expect the borders -- >> it is under investigation how it ended up in the contract. whether an administrative error or otherwise. we do not know the cause at this time. >> reporter: bart unions have overwhelmingly ratified the

agreement. we asked bart board members whether this will lead to a strike and they say simply they just don't know. in any ways a closed door session with the bart board is scheduled for this afternoon. live in west oakland brian flores ktvu channel 2 news. meantime new talk of a strike looming at oakland airport by retail and fast food workers that threaten to go on strike during the upcoming holiday season. they protest unfair labor practices by host international. they have been in contract negotiations for the past year. wages and health benefits are the issues. the workers will walk off the job sometime duringth busy thanksgiving to christmas holiday travel season. happening today a dream comes true for a young leukemia patient. the five-year-old boy will be batman for a day with the help of thousands of volunteers. claudine wong is joining us now to tell us how san francisco

now being transformed into gotham city. claudine. >> reporter: pam, yeah. the buzz around this story has just been unbelievable. this little boy and his wish capturing the hearts of everybody. thousands of strangers signed up to become a part of this today because in just hours it starts all here at the grand hyatt in san francisco as san francisco transforms into gotham city. the reason five-year-old miles. he's from cyst cue county and loves super heros. batman imparticular. we knows what its like to fight tough battles because he's been battling leukemia since he was just a year old. we are happy to say that he is in remission. he's in kindergarten but he had this very important wish to be a super hero for the day. and batman will billion here and this little boy miles will be very, very busy today. now the chief of police in san francisco says look, his

department does the best they can, but they will take a super heros help any time. >> as you all know as well as anybody i wear a costume daily. so i will be attired as i am right now. i will have my bat watch in the spirit of the day and i will be there to thank batman and batkid for assisting san francisco law enforcement and keeping this city safe. >> reporter: now when we talk about the buzz people have been tweeting all morning long. some people tweeted i have never been so excited for something i haven't been a part of or doesn't directly involve me. i've seen pictures of people tweeting their kids. people have created batman posters. everyone following that atkid. so let's tell you how all of this will go down. its starts at 10:00 this morning where we are. the batkid will take off in a bat mobile and he will be very

commuters just about over. the ribbon cutting ceremony to open the fourth bore of the caldecott tunnel will be held this afternoon. u.s. transportation secretary anthony fox will be among those attending. the ceremony marks the end of the of a four of year $417 million tunnel project. the new bore is scheduled to open this weekend. but drivers if you are heading between oakland and orinda on highway 24 expect delays during the final hours of this project. crime fighting upgrades coming soon to the palo alto police department. next monday according to the weekly they may approve a camera system that police officers can wear. they will also upgrades in police cars. the goal will be to approve officer training, evidence collection, officer safety as well as accountability. internet and cell phone service has been restored at half-moon bay, pacifica, and other on the coast. late yesterday the sheriffs

welcome back. time now 6:13. now to continuing coverage of typhoon haiyan. the philippine government raised the death toll to 3,621. just a couple days ago the philippine president announced it would be closer to 2500. this new number comes from all of the philippine profits hit by the typhoon. there could be as many as 22,000 people missing. and they are getting shelter as they can. some are sleeping on basketball court and in the seats of a basketball court arena. satisfaction is inviting the public to join in the mass to pray for the typhoon victims. a service will be held at 5:00 this evening at the philippine center gallery at 447 sutter street. and there will be a prayer for

just ushered in a pretty good breeze. that has wiped out the fog. it has clear skies. and it is colder. i was looking at the santa cruz mountains. i couldn't see any 30s but i found a bunch. a couple around napa. only patchy fog. i should probably take that out there. cooler and breezy. 58 to 68. nice visibility but the breeze will pick up. san rafael being one. 47 to start off. we will go for a high of 66 degrees. it will billion sunny side up but it will be cooler. over all we have clear skies expect for a hint of fog on the san mateo coast. i think that will get wiped out pretty soon. 37 napa airport. 34 up in tahoe. 41 ukiah. tahoe just missed on some of

scene. >> the body of the man that was shot in this parking lot on white road was removed in the last hour by the coroner. crime scene investigators are still here gathering evidence. they will be towing away that white toyota camry for evidence. the body was found lying next to it. its unknown if its involved in this crime. at 10:00 last night several people called 911 to report a shooting. when emergency crews arrived they found a man on the ground unconscious in the parking lot of the santa fe taqueria. there were several witnesses in the area and homicide detectives are interviewing them. its unknown what led up to the shooting. >> we are going to find out first of all who this person is. we haven't even -- we are still working on that information. and also what this person was doing here. are they a customer here. were they meeting somebody here. what brings them to this location. >> reporter: sheriffs deputies have not reekerred the weapon

used in this crime. they do not have any suspects in custody and still developing leads. now white road is a heavily traveled road. so sheriffs deputies are saying if anybody may have witnessed something at 10:00 last night to give them a call. reporting live from san jose janine de la vega ktvu channel 2 news. there is troubling new information about the lax shooting on november 1st. two law enforcement officers who viewed surveillance footage at the airport say hernandez the tsa officer who was shot and killed bled for 33 minutes before he was wheeled out to paramedics and taken to the hospital. at the time police had not yet declared the terminal was safe to enter. however officers shot and kill -- however officers shot the suspect and took him to the hospital under police custody five minutes after the attack started. time now 6:34. just when you thought the bart contract issue was settled there is word that a glitch may

derail the contract talks. people are wondering what may happen next. brian flores is joining us live in west oakland and why the unions are saying they are not budging on this. good morning, brian. >> reporter: good morning. commuters certainly breathing a sigh of relief when the bart strike ended and there was a tentative contract agreement reached but this morning with the word of the language glitch in this contract there are concerns from commuters this morning whether or not there will be a possible bart strike. copies of the contract were signed and ratified by both unions but when bart board of directors and management saw it there was language in it concerning paid family leave that management said they didn't agree to. it resolves -- reinvolves how much paid family leave. the new contract would have given workers at least six weeks of paid family leave. prior language in the contract reportedly was to use sick leave and vacation time first. at any case bart board members say they are investigating the

language in this contract. the union says they are not budging. >> this is frustrating because this is not the first time they have seen it. you would think they would get their agreements and everything would be solved. it seems like year after year we have these same issues. >> reporter: now gone barts unions have overwhelmingly ratified the agreement and the bart board of directors was set to do the same add its november 21st meeting but with a split its unclear whether that will happen. we asked board members whether there would be a strike or not and they said they don't know. at any case a closed door special session meeting is scheduled for this afternoon in oakland. live in west oakland brian flores. a fight involving a transgender student at hercules high is now being investigated as a hate crime. officials say the fight broke out wednesday afternoon between

three girls and a transgender student who reported being bullied before that fight. >> there is a lot of hair pulling. hitting. slapping. it was a pretty bad fight. >> district officials are interviewing the four students involved in the fight and say they could be expended or expelled. the school has an aggressive antibullying campaign and students are encouraged to seek out counselors in the health center. time is 6:36. in a couple hours the oakland teenager accused of hate crime charges in the horrifying -- he is due back in court. 16-year-old richard thomas is accused of setting sasha's skirt on fire while they were on a bus in oakland last week. police investigating the attack says thomas has admitted to being homophobic. in the meantime hundreds of people marched through the streets of oakland showing support for sasha flash man.

they marched and hung rainbow ribbons on light poles. sasha cease father was among the marchers. sasha is doing great. the crab season kicked off just after midnight. this is the first season of the new state mandated crab pot limit. there are now seven permitting tiers that a fisherman qualifies for. based on the pounds of fish they caught. between 2003 and 2008. the most pots a boat can throw out is 5 500.

about 5:00, 6:00. you will notice it today. skies will be clear. that is the good news. not too much of a breeze. novato 12 miles an hour out of the southwest. livermore has an easterly breeze but any way you slice it, it will be a cool, cool day. 30s ands even -- 30s and 40s even up in the sierra nevada. cloudy skies up in tahoe and truckee. temperatures in the 30s. overall it will be dry over. there. clear skies for us. any fog won't last long. kind of breezy to blustery. but that cool air will work its way. we've been unseasonally warm here. sunny and breezy. a patch or two of fog. cooler temps for everybody here on the highs. on the lows. when you combine that with a breeze it will feel very cool for some. one of those days you're in the sun its not bad. you turn and hit that corner

the public will open up pop stars. they will be able to see, touch, and play with the latest devices. mcdonalds plans to speed up the drive through service by adding a third window to many of the restaurants. customers will pay at the first window if their orders are ready in a few seconds they can pick up their orders. if the order takes longer they will be told to pull up a third window where they won't block the drive through lane. time now 6:56. today is a day a lot of video gamers have been waiting for. yep. now they can buy the new sony play station four. they lined up at stores around the country. including 500 people outside the game stop at san francisco's market street last night. we checked some people who

bought them last night already have them for sale on e-bay. the price tags up to $2500. 2 investigates thousands of dollars of food meant for needy families up for food at a bay area flea market. ktvu investigation found extra virgin olive oil donated to the stockton food bank for sale at the flea market in oakland. the olive oil was donated by mezzetta foods and loaded on to trucks at its warehouse. >> i was disappointed to hear our product would be at a flea market. >> now the company says it has no idea how the olive oil ended up at a flea market and that the food bank is investigating. selling donated food is not illegal but this can violate irs regulations. coming up next on mornings on 2, breaking news more on that emergency landing at san jose airport happened moments ago. we have a crew heading to the
