you can see people packed in the street and there in front of us this is why, two bat cars, one for batman and one for bat kid and where are they? they are getting a bite to eat because they are exhausted. it has already when a been a busy morning and it is just beginning. it was a super morning as they rolled out, batman in one and bat kid in the other, the streets were jammed with masses all who wanted to see his dream come true, in he crowd his parents and a bus load of family and friends overwhelmed by it. >> i never dreamed it would be like this, but san francisco thank you, it is amazing. we are just from a small town up north and to have it explode like this is just really a blessing. >> back up, please. >> there is something about

adventures today and a slide show, just go to our home page at ktvu.com. happening today the long wait is nearly over for highway 24 commuters, ktvu has learned the state fire marshal has signed off and approved the new caldecott tunnel for public use. today there is a ribbon cutting ceremony scheduled for 1:30 at the 4th bore. cal trans will be able to open the new bore after it restripes lanes leading into the tunnel. it marks the end of the project. the new bore is scheduled to open sometime this weekend, drivers there should expect delays during the final hours of the project. the final emergency drill took place early this morning in the new 4th bore, the california highway patrol tweeted this picture, the chp

and firefighters from those fire departments participated the drill wrapped up around 4:00 a.m., they simulated an accident where people had to be evacuated through the new emergency exits and as we told you the state fire marshal has signed off and approved the tunnel. the tentative agreement between bart's unions and management potentially could by on the fringe of falling apart. at issue the current contract includes a clause on paid family medical leave that bart says should not be in there. ktvu's brian flores is live in oakland with a special meeting and how riders are reacting. >> reporter: no question about that, we spoke with many riders who say they can't believe this contract is not a done deal yet, many are concerned another bart strike is on the horizon and even more baffled this issue wasn't seen earlier. it was supposed to be pretty much a done deal, the bart strike over, a tentative contract reached between bart's unions and management.

instead now a bit of a hold up. >> i hope they come to some type of resolution because there is a lot of other people suspecting -- suspecting thousands and millions of people a day so it is like i would hope they would be able to come to some type of agreement. >> at issue in the agreement is this clause talking about paid family leave, bart says family law states workers are allowed up to 12 weeks of unpaid family leave. this copy of the contract obtained through sources says eligible employees would receive six weeks of that time paid. but from what we heard from bart's management and the board is this was something that was never agreed to. >> it was a mistake and we need to work together in order to move forward. >> bart says this page may have inadvertently been added to a stack of other tentative agreements. the unions however say this was not a mistake and a signed agreement agreed to by all sides in august. the local president says she is baffled by all this but still

expects the board to eventually ratify the contract. >> you can't piecemeal stuff out after the fact. this was an agreement. it wasn't a mistake. >> this afternoon we learned the bart management will not recommend the board to reject the agreement but they want the board to know all the facts before it goes to a vote. >> so to add on this additional proposal the board will need to find the costs and the details and that is what is going to happen today. >> bart president has called on a special closed door session this afternoon at 3:30. bart says this is going to be meant as a fact-finding meeting to talk about the costs if the board were to approve this tentative agreement. the board is scheduled to vote on the tentative agreement next thursday. i do want to say there is a public comment session before this closed door meeting and many union members say they will be there to have their voice heard. brian flores, ktvu channel two news. >> new information on the attack of a homeless woman in san francisco. ktvu confirmed an hour a.

>> that an arrest has been made. video obtained by ktvu showed the woman being attacked by a man walking down the street. the san francisco chief of police confirmed this morning the man has been arrested and has made a full confession, we are gathering information on who the suspect is and will have a full update tonight on ktvu channel 2 news at 5:00. santa clara sheriff's investigators are looking for the person who shot and killed a man outside of a taco reia. they heard shots there and they found them there, he had been shot at least once, he was dead at the scene, they would like

the oak land teenager facing hate crime charges in the attack of a passenger a board a bus was back in court today, 16-year-old richard thomas did not enter a plea, his family was in the courtroom. he is charged as an adult and his attorney says police and prosecutors are acting unfairly and what happened was a childish prank that went terribly wrong, not a hate crime, he is accused of using a lighter to set the security of sasha fleischmann on fire, he is hospitalized with severe burns, thomas is set for appear in court often november 26th. at hercules high school a school fight on camera is now being investigated as a hate crime. officials say the fight on wednesday afternoon was between

three girls and a transgender student who reported being bullied before the fight. >> there is lots of hair pulling, hitting, slapping. it was a pretty bad fight. >> school district officials are interviewing the four students involved and say they could be suspended or expelled, hercules high officials say the school has an aggressive anti- bullying campaign and students are encouraged to seek out counselors in the health center. the santa clara county sheriff's office released a sketch of the person they say is responsible for a sexual assault at the college in cupertino, described as being in his early 20s, with shoulder length dark brown hair and a lot of acne on his chin, a student says she was raped in the bathroom of the media and learning center on the 4th, she said she believes he is a student named johnny. frightening moments this morning for passengers on board a plane that took off from san jose heading to dallas but the

plane had to turn around and make an emergency landing due to a bird strike. ktvu's janine de la vega tells us what passengers experienced on board and what the airport has in place to handle bird strikes. >> reporter: as this american airlines m.d.-80 made an emergency landing this morning many passengers breathed a sigh of level as it landed, several minutes prior those on board heard a loud noise. >> i heard a pop, seen a flash and the airplane slowed down a little bit. >> you could feel the engine was stopping so harrowing really. >> it departed heading to dallas but a bird struck the engine, the pilot immediately turned it around to land, fire trucks were waiting as a precaution but no one was injured. >> it is a huge concern for us, safety is our number one priority for aircraft operations. >> from january to july the faa

reports 46 bird strikes at the san jose bird strike and has a plan to discourage them from being at the airport, this is the time of the year that birds my great so since september they have been stepping up efforts and biologists have been deploying tactics, including shooting birds down and hazing. >> hazing is using sound makers. >> from january to october the airport has killed or relocated 138 birds, passengers say the pilot told them he trained for the situation but it was not routine. >> he sounded a little bit like it got to him a little bit but he was calm. >> once on the ground they had to wait in line to rebook but they were glad they were safe. >> congress is considering whether states should get a refund for keeping national parks open during last month's government shut down. six states used their own funds

to keep the parks open during the 16 day federal closure, california was not one of them, but the states that did re-open the park made the decision even though the u.s. parks service made clear at the time the feds would not pay for it. taxpayer watch dogs say the states should not expect to get money now. >> i am not saying the states were wrong, they actually got economic activity, benefit from it, but don't expect us to retro actively pay you for your decisions. >> the u.s. house and senate are considering bills to refund a total of 2 billion taxpayer dollars. crab season is now officially underway in the bay area, many crab fishermen set their crab pots yesterday and began bringing them in early this morning as soon as the season opened at midnight. this is the first season of the a new crab pot limit. there are 7 tiers they qualify for based on what they caught
